Worker’s rights

n August 28, the Consulate General of Mexico in San Jose, along with union representatives presented the third annual Labor Rights Week proclamation

2

that runs until September 2. The event took place in a simultaneous way in the other Consulates of Mexico across the nation. Individuals are encouraged to attend the different workshops available. Some of the topics include safety in the work place, workers

compensation, discrimination issues, and salary violations. Last year, the event provided information on labor rights to more than 500 people. Ninety personal consultations were taken care of and 38 serious cases of labor abuse were de-

tected. These cases were advised by attorneys, investigated by labor authorities and given suitable pursuit by the Consulate. “”Having that relationship is very important to us, to let them know that we are here to protect their rights,” said Neil Struthers,

Chief Executive Officer, Building and Construction Trades Council. ”We are not here to take advantage of them.” The workshops take place at the main office located on 2125 Zanker Road, San Jose, CA. The event is open to the public, free of charge. The local legal services as well as the national departments participate on a pro-bono basis. ”With the economy’s slow recovery some segments of our society responded by blaming immigrants. So we need to stand up and stand together against racism, against discrimination,” said Ron Lind, Presidents, United Food & Commercial Workers Union, Local 5. ”We need companies like Wal Mart and Mi Pueblo accountable if they violate the rights of workers on the job.” The panelists are prepared to take any complaints and assist with any type of question relating to labor rights. One big concern of an attorney is operations run by other Latinos. “”We see a tremendous amount of abuse against

workers. We see workers that are being payed straight time for 60 hours,” said Fernando Chavez, Chavez Law Group. Sometimes the abuse goes unnoticed because the worker doesn’t want to lose his job. It’s important that the worker stands up for what he or she is entitled to in terms of being paid a fair and legal wage. The legal teams approach each case in a positive manner for the worker. The consultations of greater frequency are nonpayment of extra hours, discrimination in the workplace, reduction of working hours, dismissals by no-match of the social security, and responsibility of the employer regarding injuries made on the job. ”This week only reflects the intention of the labor authorities, authorities in†Mexico and the unions,to show our intention and our concern, but obviously this†is a permanent duty of the Consulate,” said Carlos Ponce, Consul General of Mexico to San Jose.

he Obama Administration’s announcement that it will bring its deportation practices in line with common sense law enforcement priorities has generated the predictable outcry from mass-deportation advocates, who incorrectly have characterized the sensible policy announcement as a “backdoor amnesty.” However, the wildly exaggerated rhetoric of immigration opponents combined with unsavory scam artists – notaries who pretend to be lawyers and unscrupulous lawyers who pretend to be helpful – who prey on the hopes of immigrants has led to confusion over the implications of the policy for individual immigrant families. As a result, longtime immigration reform champion U.S. Representative Luis Gutierrez (DIL) is teaming up with the Illinois Coalition for Immigrant and Refugee Rights (ICIRR) and other local organizations on a nationwide education campaign to highlight the opportunities and limits of the policy announcement and to ensure that immigrant families don’t fall victim to those seeking to exploit the hopes of desperate immigrants for profit. At the new education campaign, Rep. Gutierrez praised the policy announcement from the Obama Administration but warned, “There are scoundrels out there. There are people who prey on our immigrant community. This is not amnesty. This is not a program you sign up for. Don’t be fooled. As the Chicago Sun-Times reported, “By scoundrels, Gutierrez was referring to the predators who have historically played immigrants for suckers whenever a change in federal immigration law created an opportunity, although I’m sure he also feels that way about some of the

conservative voices who would want you to think Obama has thrown the borders wide open. The Sun-Times went on to clarify, “There is no legalization program, despite how the policy change has been portrayed by its opponents, and therefore no reason to be paying for anything, The change of direction from the Obama administration doesn’t do anything to solve the underlying problem of a country in bad need of comprehensive immigration reform, but in the meantime, it restores a little bit of common sense to a program that sometimes has targeted immigrants for traffic violations. At best, it gives temporary breathing room to some — and a reason to hope for a more lasting solution. According to Frank Sharry, Executive Director of America’s Voice Education Fund, “The immigrant community should listen to Luis Gutierrez, not Lamar Smith and the scam artists he’s enabling. This policy announcement is an important step forward in bringing humanity and common sense to our nation’s enforcement practices, but it remains limited in scope. Those seeking to take advantage of this announcement – whether scam artists seeking financial profit or Lamar Smith and his allies who are seeking political profit – should stop exploiting it for their own benefit. Fortunately, the new education campaign from Rep. Gutierrez, ICIRR, and other advocates should go a long way towards setting the record straight and ensuring the new policy is implemented fully and fairly. (Article provided by America’s Voice)

he top local news last Thursday, August 25, 2011 was that Police Chief Chris Moore terminated the agreement between the SJPD and ICE that utilized two ICE agents to root out undocumented criminal gang members. Commentary, Aaron R. Resendez As a member of the Police Chief’s Community Advisory Board, I composed a published Letter to the Editor to the Mercury News giving kudos to Police Chief Chris Moore for listening to the community and taking action. Congratulations, Chief Moore! You listened and acted! Now the community knows that the Police Chief is a man of his word who has honored the declarations he made publicly to Congressman Luis Gutierrez (D-Chicago, Illinois) that the San Jose Police Department would not participate on immigration enforcement. I am a U.S. citizen born and educated in Mexico who came to San Jose 31 years ago. I live in two worlds and two cultures, seeing both sides of this issue. Understanding immigration is an important key for a better world. I was once critical and participated in a rally in front of City Hall against San Jose Police for their actions towards Latinos. In December of 2009 my wife and I attended the Citizen Police Academy. This course experience helped us understand police officers and their work in the line of fire. In April of this year I was asked to be part of the Police Chief Advisory Board. Since the beginning of the collaboration between SJPD and Immigration Customs Enforcement (ICE), I personally opposed and advised Chief Moore of the fear, anxiety and distrust in the community. A coalition in opposition to Operation Community Shield (OCS) including PACT and SIREN urged the Police Chief to terminate that partnership with ICE. Chief Moore, the San Jose Latino community looks forward to working collaboratively with SJPD to better serve the Latino community and the community at large. To Build communication, to build a bridge and to build trust is a two way street of honesty, sunshine and compromise from both, our community and the San Jose Police Department. Chief Moore decision to end his partnership with Operation community Shield (OCS) was great. Now, we as

community have a bigger responsibility to cooperate in helping SJPD, reaching out to our community and keep to continuous improvement in relations for the better of our great City of San Jose. Commentary, Publisher of El Observador Hilbert Morales The above reflects the positive feelings generated by the news that those two ICE agents are no longer working collaboratively with the SJPD. Now the challenge in the Latino community is the following: 1) Let’s make an effort to reduce violence of all types in our communities. Killings, domestic violence, elder abuse, and child abuse are all are wrong and can be mitigated. If you are a witness to a criminal act, be willing to report it to the police investigators. Know that your act of being a witness can be made anonymous and confidential by using Crime Stoppers (Phone: 408947-7861). 2) Since many individuals and families are in great need and under a lot of stress, especially if unemployed, become aware that these unfortunate people need all the help which can be provided. Learn to tell them personally that groceries are available at the local food bank and be able to refer them to Social Services Agency, etc. Be aware that desperate individuals do desperate acts to survive. 3) Be willing to organize and participate in community groups like Community Watch which informs local households and community members on the many methods used to deter burglars, vandalism, and other acts which destroy or damage property. 4) Be willing to tell others that there is no need to carry a weapon (knives or guns) in this community. And be willing to be the role model for your kids by not carrying a weapon, showing weapons provide no security at all. 5) Be willing to take prior action by training yourself and others in anger management. Know that in a moment of passionate anger, your life may be permanently changed. 6) If our community really wants safety, security, and tranquility the effort begins with each of us doing the right thing in the right manner, and being responsible for our own actions. Safe and secure communities begin with the individual, not with those who enforce the law.

axpayers sometimes need tax returns from previous years for loan applications, to estimate tax withholding, for legal reasons or because records were destroyed in a natural disaster or fire. If your original tax returns were lost or destroyed, you can obtain copies or transcripts from the IRS. Here are 10 things to know if you need federal tax return information from a previously filed tax return. - There are three options for obtaining free copies of your federal tax return information on the web, by phone or by mail. - The IRS does not charge a fee for transcripts, which are available for the current and past three tax years. - A tax return transcript shows most line items from your tax return as it was originally filed, including any accompanying forms and schedules. It does not reflect any changes made after the return was filed. - A tax account transcript shows any later adjustments either you or the IRS made after the tax return was filed. This transcript shows basic data, including marital status, type of return filed, adjusted gross income and taxable income. - To request either transcript online, go to www.irs.gov and use our online tool called Order A Transcript. To order by phone, call 800-908-9946 and follow the prompts in the recorded message. - To request a 1040, 1040A or 1040EZ

tax return transcript through the mail, complete IRS Form 4506T-EZ, Short Form Request for Individual Tax Return Transcript. Businesses, partnerships and individuals who need transcript information from other forms or need a tax account transcript must use the Form 4506T, Request for Transcript of Tax Return. - If you order online or by phone, you should receive your tax return transcript within five to 10 days from the time the IRS receives your request. Allow 30 calendar days for delivery of a tax account transcript if you order by mail. - If you still need an actual copy of a previously processed tax return, it will cost $57 for each tax year you order. Complete Form 4506, Request for Copy of Tax Return, and mail it to the IRS address listed on the form for your area. Copies are generally available for the current year and past six years. Please allow 60 days for actual copies of your return. - The fee for copies of tax returns may be waived if you are in an area that is declared a federal disaster by the President. Visit www.irs.gov, keyword “disaster, for more guidance on disaster relief. Visit www.irs.gov to determine which form will meet your needs. Forms 4506, 4506T and 4506T-EZ are available at www.irs.gov or by calling 800-TAX-FORM (800-829-3676).

New School on The Block By Cinthia Rodriguez |El Observador|

an Antonio Elementary school first opened its doors in 1967 in East San Jose. It was an exciting feeling. but things have changed dramatically since then. Freshly painted classrooms, an improved jungle gym, and new lawns make up the campus now. ”Something important is going on here,” said Joe Coto, former California Assembly-

member. The appearance of a school sends a message to students. The right message is critical to students, parents, and teachers. That message is that there is nothing more important than the beauty of dreams and the education of students. The campus even has a new principal, awardwinning Norma Rodriguez. ”You see further proof of valuable education with members of the board from the Alum Rock School District. It

gives me a lot of pleasure to be here and to be able to tell you that this facility is further proof that you all deserve the best,” said Councilmember Xavier Campos. Campos spoke directly to the students present, telling them they can do whatever they want. He also told them to aspire to be great because they are the future leaders of the city. San Antonio is the newest school in the Silicon Valley. It is also the most wired elementary school. Students in K-3 will receive an iPod touch while grades 3-4 will work with iPads. The electronics will be used to explore the different ways students learn. Some are visual learners while others are auditory learners. The equipment provides those two features. Other schools in the state have already integrated iPods in the curriculum.

”We worked very hard to make this a reality,” said Dolores Marquez, President, Board of Trustees, Alum Rock Unified School District. Construction cost $20 mil-

lion, paid for through $12 million in bond funding and $8 million in state assistance. The technology improvements provided by federal stimulus funds cost $450,000.

”Someday some of you out there are going to be sitting on the 18th floor of city hall, meeting the next generation of the East Side Community residents,” said Campos.

Memorial and Wreath-Laying Service for the Tenth Anniversary of 9/11

ak Hill Memorial Park will host a candlelight vigil and wreath placement ceremony at the 9/11 monument and memory wall inside Oak Hill Memorial Park, commemorating the tenth anniversary on Sunday, September 11 at 7:30 PM.

The monument was designed in remembrance of loved ones lost during the 9/11 tragedy ten years ago. The monument includes a depiction of Flight 93 that went down in Pennsylvania. Also, a newly-erected 24-foot memory wall will be on display for this event, listing all names of those lost on that tragic day. “The defining moments of ten years ago on September 11 will never be forgotten, as it changed the landscape of our lifestyles forever,” said Brian Kestenblatt, General Manager of Oak Hill Funeral Home and Memorial Park. “Disasters need not be buried, but provide hope and honor. It is during times like the 9/11 tragedy that true heroism is demonstrated and encourages people to come together.” The theme of coming together as a community will be reflected in the program that will include guest speakers and a slide show. The placing of three wreaths will reflect that message: one for first responders, one for the military and one for the civilians who gave their lives. “We shall never forget” rings true while the public is invited to honor, support and love those who sacrificed their lives, who had the courage to help others and the strength to live on. Oak Hill Funeral Home and Memorial Park is located at 300 Curtner Avenue at Monterey Highway in San José. For more information call 408.297. 2447. Parking will be available throughout the park.

any in the local Latino community know Blanca Alvarado, retired Supervisor, after 30 years of distinguished public service. After all, Blanca is the “Grand Dame” of local Latino politics who continues to be very active, and engaged in local community matters. In an exclusive interview with EO’s publisher, Hilbert Morales, her personal “diabetes story was conveyed with the purpose of encouraging all to be checked for this insidious disease process, which is so often ignored or denied. Those who have family members with diabetes need to be tested on a regular annual basis to permit early detection and management. Diabetes can be and is very destructive and eventually is the cause of other organ system failures (kidneys, blood circulation, blindness, etc.) Adult onset diabetes is known as Type Two diabetes. It is caused when your pancreas fails to produce the insulin essential for the normal metabo-

12

lism of glucose (sugar). Blanca first became aware of her diabetes when she traveled to southern California to visit her brother who was afflicted with bone cancer. During the trip she experienced frequent urges to urinate which she “put up with . Some time later she went to her doctor. He ended her medical exam by telling her ”your health is good.” Then, on her way out, her doctor decided to prick her finger to obtain a drop of blood to do a simple blood glucose test. ”Goodness, Blanca, you have diabetes.” He then referred her to Planetree to learn about diabetes management. Of course, Blanca did not go and for about 10 years just took her prescribed pills and went on with her life. She developed a severe neuropathy (loss of nerve function essential to feeling heat and cold.) One day, Supervisor Diane McKenna, whose husband was diabetic, insisted upon referring Blanca to her husband’s doctor who was a well known diabetes disease specialist practicing in Palo Alto. Blanca was thoroughly ex-

Blanca’s Journey With Diabetes

amined by Dr. Pendergast, who, after having all the test results in hand, informed Blanca that her personal case of diabetes was totally “out of control .

Blanca had ignored her diabetes symptoms and could no longer do that without very serious health and wellness outcomes. Dr. Pendergast was able to formulate a personal diabetes control process for her which did not include any insulin injections. As a member of the Health & Hospital Systems Committee, she consulted with Dr. Alfonso Banuelos, Medical Director, who referred her to SCVMC’s diabetes specialists, Dr. Aguinaldo. A patient-doctor relationship evolved which informed Blanca about the many ways diabetes does damages to the body. The establishment of SCVMC’s Diabetes Center benefitted from Supervisor Blanca Alvarado’s role as its influential champion. Its focus is on education and training concerning diabetes with its special focus on local Latino residents. In her particular case, she

developed a very disciplined attention to her dietary intake coupled with exercises required to maintain upper body strength, especially that her arms remain capable of reaching up. Today Blanca delights in effectively controlling her diabetes by eating correctly (nutrition), doing her exercises (physical therapy), and getting the sleep her body requires. ”It is very essential that I stay very interest in my life’s interests and activities,” said Blanca Alvarado who now checks her blood sugar levels morning, noon and evenings daily. She manages her diabetes so well that no insulin injections are needed because her disciplined practices keep her AIC levels below 5 and blood sugar levels below 100. ”Once I got beyond my denial and neglect, I was able to learn all that was needed to go on with my life, its interests and activities,” said Blanca who enjoys a

chocolate now and then but everything is now controlled and in moderation. As a result, today Blanca Alvarado enjoys excellent wellbeing and health status; feels full of energy and vitality; at her age her mind is sharp and clear; and her body functions well. Alvarado recommends that anyone who experiences unexplained urge to pee ; unexplained loss of feeling (toes, fingers, lower legs and arms), to immediately undergo a diabetes test. Early detection enables effective preventive management when one learns what to do that works. Neglect only leads to complications. ”I do not now neglect nor ignore the many signals my body provides me which may indicate the onset of some disease process. I encourage anyone who has any of the initial symptoms of diabetes, to get fully examined and diagnosed. Then take charge of your own health and wellness so that you can live your life normally.” Blanca is very active today as evidenced by the experiences in getting her to take time from all those meetings wherein she continues to be a “retired but active and experienced community leader in San Jose’s East Side neighborhood. Our community has benefited, and continues to benefit, from her interests, experience, and community service.

akland, CA,– In the aftermath of Hurricane Irene, the American Red Cross Northern California Blood Services Region is now urging immediate blood and platelet donations. The Red Cross has already had to cancel more than 72 blood drives along the East Coast due to Hurricane Irene, resulting in the shortfall of more than 2,400 units of blood. In addition, hundreds of blood and platelet donors have been unable to make their scheduled donation appointments because of storm-related issues. And local blood drive cancellations because of power outages continue to impede Red Cross operations along the East Coast this week. The Red Cross is moving blood products to the areas affected by Hurricane Irene so that these products will be available in locations where blood cannot be collected. If people will make an appointment to donate blood in the upcoming days and weeks, blood will be available should conditions continue to prohibit people in some parts of the country from traveling or coming to blood drives. “Since the Bay Area is no stranger to natural disaster, we expect strong local response to Hurricane Irene, said Jeff Meyer, CEO, American Red Cross Northern California Blood Services Region. “If you are asking yourself what can you do 3,000 miles away, the answer is simple. Please donate to the American Red Cross. During this time of need, we all need to do whatever we can to help. The Red Cross has an urgent and very

critical need for platelet donors. Eligible platelet donors are asked to schedule a donation as soon as possible. Platelets are commonly used for patients undergoing cancer treatment, trauma victims and many other hospital patients. Since platelets have a shelf-life of just five days, it is imperative that there are enough platelets on-hand to meet the needs of local hospital patients. Nationwide, around 44,000 blood donations are needed every day to meet the needs of accident victims, cancer patients, and children with blood disorders. Every two seconds, someone in America needs a blood transfusion. These patients and others rely on blood products during their treatment. To schedule an appointment to donate blood, please call 1-800-RED CROSS (1-800733-2767) or go to redcrossblood.org. Eligible platelet donors should call 1-888-881-0988. Please be aware the Red Cross anticipates unusually high call volume during the next several days from those directly affected by the hurricane and you may experience long delays. The cost of the Red Cross disaster relief response will be millions. People who can help are encouraged to click, text or call to donate to American Red Cross Disaster Relief. Visit www.redcross.org , call 1-800-RED CROSS or text the word REDCROSS to 90999 to make a $10 donation. Contributions may also be sent to your local Red Cross chapter or to the American Red Cross, P.O. Box 37243, Washington, DC 20013. (Foto Notimex)

A good soldier doesn t bite her tongue Following her own advice, Valenzuela was a good soldier and did not bite her tongue on her latest material. She talks about insecurities, loss of a relationship, sadness, but she also described some of songs as fantastic, intellectual, and gutsy. “Chile has been kind of my cradle, where I’ve developed my art and grown a bit more. So I’m ready to come back to the states and keep growing,” confessed Valenzuela. Born and raised in California, until moving to her current hometown of Santiago, Chile at age 13, she has had the best of both worlds. She loves the diversity and progressive culture the state has to offer. She enjoys contributing to society and did so in a particular way. She wrote “Salvador” for Latin America. Where she talks about someone going and saving the area. The title itself means savior but she isn’t talking about religion. In its place,

she would like to see more people congregate and actually make change in the status quo there is today. There isn’t enough true leadership to her. Other tracks are just fun to listen to, they’re sweet catchy love songs. Some are even folksy, mellow, and jazzy. Although she is always writing songs or poetry, and all sorts of stuff, she loves being on stage. Performing at shows allows her to grow. She finds it exciting and delivers with her personalized shows. “Everyone has to be a good soldier, respect what they do, whatever endeavor they’re in and move forward, just keep working,” said Valenzuela. “I’m doing that as well.”

P

op, rock, piano, and singer-songwriter are the five words Francisca Valenzuela used to describe her music during a recent interview with El Observador. She just released her second album “Buen Soldado,” and fully explained the process behind it. “It’s kind of like siting down and saying what do I want to talk about,” said Valenzuela. Her latest 12-track album, all written and composed by her, is musically different. She experimented with instruments, arrangement and built her band in a distinctive way. While the first album was more organic and feminine, her new stuff explores social and political issues. “It was a challenge but it was awesome to sit down and try to write about other stuff and become other people as well,” admitted Valenzuela.
