bout 15 years ago a flood had a tremendous impact on B. Vasquez Farms. A phone call was made to the Farm Service Agency (FSA) to ask about disaster benefits, but the farmers didn’t qualify. Those farmers are still waiting for help, however they are not the only ones. "We've been battling this thing so long, it's not a money issue any more," said Jose Luis Vasquez. "We might not get anything and we might die fighting it because it's been going on for ten years, but we’re doing it for the next generation." Vasquez and brother Bernardo Jr. went into farming because their dad went from being a farmer to owning some acres where they grew lettuce and broccoli. They are used to being treated badly and believe it’s because of their nationality. The Vasquez brothers along with Juan Carrillo are plaintiffs in the Garcia v. Vilsack lawsuit, filed by a group of Hispanic farmers against the United States Department of Agriculture (USDA). It seeks to remedy decades of well-documented discrimination against Hispanic farmers and ranchers perpetrated by USDA in the administration of its farm credit and non-credit farm benefit programs. “There’s actually several minority farmer law suits against USDA,” said attorney Collette I. Harell. The first to file a lawsuit were the African Americans in 1998 during the Clinton administration and by 1999 the case settled for $1 billion. It also granted the farmers debt forgiveness. Meanwhile, the B. Vasquez Farms was going bankrupt. Harell explained that they have been in a

legal battle for nine years fighting over the issue of class certification. The judge decided that the group of Hispanics should be treated individually. “It's unrealistic that each farmer can go in with an attorney and bring a lawsuit before court,” said Harrell. "Bottom line is that these farmers are being denied justice." After fighting for nine years, Obama's administration, the Department of Justice has started to talk settlement and offered 1.3 billion to female and Hispanic farmers as a settlement. There are about 80,000 Hispanic farmers within its group. "I did get to see first hand discrimination there,” said Juan Carrillo. Carrillo served as the first minority advisor for the county of Salinas in the USDA, but that didn’t interfere with his experience with discrimination. He saw all the applications for loans and benefits that were being denied. Hispanics weren’t getting anything, he said. Working for the USDA didn’t guarantee Carrillo payments or loans. He has shared his testimony in Washington D.C. and strongly believes that the USDA is getting rid of minority farmers. "I've been working on this case for seven years and working with these farmers and know the ins and outs of what's going on and what they've suffered," said Collete. "It's an atrocity and these are all tax paying US citizens." Currently, there is an offer on the table but its as good as nothing says Harrell. They are trying to persuade the Department of Justice to agree to a settlement that is fair and just. "The era of farming is pretty much gone for us (Mexican Americans)," said J. Vasquez. "There's no way that you can get into farming right now."

Heated Immigration Debate Lighting a Fire Under Latino Voters

ashington, DC – A new summary of recent Latino voter polls highlights the way the immigration debate is influencing Latino political engagement in the run-up to the November mid-terms. The lack of action on comprehensive immigration could dampen enthusiasm among Latino voters at a crucial time. According to an article in today’s POLITICO: “The swing in opinion couldn’t come at a worse time for Democrats, who need a strong Latino turnout in November if they hope to maintain control of Congress. That voting bloc could be decisive in dozens of competitive House, Senate and gubernatorial races across the West, according to a report by America’s Voice, an immigration reform advocacy group.” However, the three recent polls also make clear that national attention to Arizona’s antiimmigrant law and the negative rhetoric espoused mainly by Republicans—like the latest flap over repealing the 14th Amendment— could, in fact, energize Latinos to turn out this year and punish Republicans. According to Lynn Tramonte, Deputy Director of America’s Voice, “Clearly, the current immigration debate—including the national at-

tention to Arizona’s anti-immigrant law—is having a major impact on the way Latino voters view the two political parties and the importance of voting in November. While the lack of action on comprehensive immigration reform could depress turnout and harm Democrats who are most ‘on the hook’ for delivering that core priority, the anxiety over Arizona’s anti-immigration law and heated rhetoric from the GOP is having a mobilizing effect on Latino voters that could hurt Republicans in November and beyond. While the story of the 2010 mid-term elections remains to be written, it is clear that Latino voters and the immigration issue in general will be a key chapter.” The polling summary highlights the results of three recent surveys conducted by LatinoMetrics for the Hispanic Federation and League of United Latin American Citizens (LULAC); Dr. Ricardo Ramirez of the University of Southern California for the National Association of Latino Elected and Appointed Officials Education Fund (NALEO); and the National Opinion Research Center (NORC) at the University of Chicago for Associated Press-Univision. A U.S. Constitutional Crisis Is Being Created By Hilbert Morales

oo many of us are bystanders who are watching what is going on in Arizona after its enactment of SB 1070 and the subsequent stay of implementation by a federal judge. There are many who have partial information and as a consequence have not yet recognized the danger and threat that is already upon us. Our attention is being diverted by all that press and media turmoil concerning “gay marriage”. Several cities have adopted ordinances which prohibit the rental of residences to the undocumented. Under the past Bush administration, Homeland Security Department escalated the raids by ICE on certain industries (packing houses, especially) which employ high numbers of the undocumented. Employers are threatened with large fines for knowingly providing employment for the undocumented. Go back a bit to recall those who consistently state that President Obama has no right to be our Commander-in-Chief as well as our elected Chief Executive Officer, specifically the individual who has been elected to be our President. His proof of birth in Hawaii has consistently been contested and undermined. Throughout the nation there have been verbal attacks by members of the Republican Party, especially their radical elements who often come across as being very stubborn ignorant racists. Although that is what is perceived publicly, if one takes all these events together as was done for the first time that this publisher has heard, a case is being assembled which undermines the U.S. Constitution, especially its 14th Amendment, which proclaims and establishes that anyone born in America has the birthright of being an American citizen. Little by little, these events will add up to a very serious challenge to the current American Constitution, especially its 14th Amendment. Last week, the Mexican American Legal Defense and Education Fund (MALDEF) sponsored a mass at St. Joseph’s Cathedral, San Jose. clear presentation was made by Miguel Marquez, the first Latino to hold the office of County Counsel, County of Santa Clara. This reception was sponsored by the Interfaith Council on Economies and Justice, South Bay Labor Council, La Raza Lawyers Association, La Raza Roundtable, and the Hispanic Chamber of Commerce. There is no secret that Latinos, especially Mexicans and other immigrants across the nation are now facing escalating threats to strip them of their civil rights and personal security. No place highlights this more than the SB 1070 legislation, signed by Arizona’s Governor Jan Brewer. SB 1070 is designed to be a discriminatory law as well as an anti-immigrant law. These actions, taken collectively, call for a change in attitude and awareness because the rights of any human resident of America are being challenged. If allowed to succeed, America will no longer be the champion of personal freedom and democracy. MALDEF is amongst the leaders in this collective effort to block this Arizona SB 1070 law in federal courts. Citizenship, immigration issues, and the national border security (or lack thereof) is a Federal government responsibility and jurisdiction. This must not be eroded by all those local jurisdictions and states who are adopting legislation which addresses citizenship and immigrant issues. MALDEF is challenging SB 1070’s discriminatory impact on Latinos as well as the ways it will violate the constitutional rights of both citizens and non-citizens. It was in light of these relationships that Miguel Marques, Esq. persuaded authorities of the County of Santa Clara to file an ‘Amicus Brief”. Fifteen jurisdictions across the nation joined in support of MALDEF. These included the Cities of San Jose, Los Angeles, Palo Alto, Berkeley, San Francisco, El Paso, Portland, Seattle, New Haven, Minneapolis and St. Paul. These sorts of attacks on the Latino community are on the rise across the nation. MALDEF is the organization to be counted on by Latinos to step forward to counter these attacks upon our civil and human rights. H

uman trafficking can come in many forms such as bonded labor, debt payments and the most common forced prostitution. On Thursday, July 29, community members met with San Jose Police Department’s Lt John Vanek at the Vineland Branch Library to discuss human trafficking in San Jose. “Slavery has been around forever and it is estimated that there are some 27 million people enslaved in one form or another,” Vanek said. “These people are recruited through scams and have to work to pay off a massive debt that is sometimes unachievable.” The San Jose Police Department has teamed up with several groups to help fight human trafficking. Some of these groups work with domestic violence victims and immigration issues. “Sometimes it an be very hard to talk to individuals who we believed are being trafficked because they are afraid they will be deported,” Vanek said. Vanek added that it is especially hard for women who are victims of sex trafficking to come forward because there is a lot of money to be made. “Once a woman has paid off her debt, she has no way of supporting herself when she is on her own. So she goes back to doing what she has been doing to survive,” Vanek said. “Sometimes she can be working as a sex worker for

twenty years.” The victims of human trafficking suffer through depression, suicidal tendencies and several kinds of illnesses. “They are also threatened with violence or through black mail by their traffickers,” Vanek said. According to the 2005 Trafficking in Persons Report, 600,000 to 800,000 people are trafficked across international borders each year. The United States Department of Justice estimates 18,000 to 20,000 people are trafficked into the United States each year. Internationally, there are many groups working to combat human trafficking. The United States is a recent entrant to this struggle. Aside from producing the most comprehensive analysis of trafficking persons, the United States has been successful in encouraging countries with trafficking problems to take action against it. What to ask when you suspect a person is a victim of human trafficking: “What type of work do you do?” “Are you being paid?” “Can you leave your job if you want to?” “Can you come and go as you please?” “Have you or your family been threatened?” “What are your working or living conditions like?” “Where do you sleep and eat?” “Are there locks on your doors or windows so you cannot get out?” “Do you have to ask permission to eat, sleep, and go to the bathroom?” “Has your identification or documentation been taken from you?” For more information visit http://www.sjpd.org/stopht

Back to School with TOPS’ Healthy, Child-Friendly Recipes

usy schedules, including work, school, extracurricular activities and more, often cause healthy eating to fall by the wayside. Kids can end up munching on pizza, snacks, and junk food too frequently, instead of freshly prepared, wellrounded meals. As the school year approaches, it’s important to consider nutritious meal and snack options for chil-

dren. One of the best ways to implement healthy eating into their diet is to make the food fun and tasty and easy for parents to prepare. 1. Popcorn-Banana Mix a. Mix together popcorn and banana chips in a large bowl. b. Add additional treats, such as dried berries or nuts, for greater variety. 2. Fruity Faces a. Use a fruit that can easily be cut in half, such as a grapefruit or orange. b. Halve the fruit and adorn it with a cluster of grapes, representing hair. c. Add three grapes - two for the eyes and one for a nose. d. Use two strawberries as ears. e. Blueberries make the smile. 3. Apple Art a. Slice an apple and use slivered almonds as skewer decorations on top. 4. Icy Delight a. Blend together two cups ice, one cup juice, and one and one-half cups assorted fruit in a blender. Add more juice if necessary. b. Pour into individual cups and place in the

freezer for at least three hours. c. When ready to taste, remove from freezer and let sit on counter for a few minutes to thaw. Makes four servings. 5. Berry Delicious a. Add fresh berries to yogurt. b. Top with granola for an extra, nutritious treat. 6. Fruit or Vegetable Skewers a. Place a variety of fruits or vegetables on a skewer and enjoy. 7. Cool Carrots a. Set out a bowl of carrots with three individual dipping sauces, like peanut butter, low-fat ranch dressing, Italian dressing, or avocado dip. 8. Banana Hot Dog a. ADISON – Los psicópatas toman decisiones de una forma que refleja el comportamiento de pacientes con daño en la corteza prefrontal ventromedial (CPFVM), un área del cerebro responsable de sentimientos tales como la empatía y la culpabilidad. El Dr. Michael Koenigs, profesor adjunto de Psiquiatría de la Escuela de Medicina y Salud Pública de la Universidad de Wisconsin, dio recientemente un informe de los hallazgos. Microsoft Donates $100,000 to Hispanic College Fund

anta Clara, CA– The Hispanic College Fund received a $100,000 donation from Microsoft, a leadership gift that helped ensure the launch of the inaugural Silicon Valley Hispanic Youth Institute on July 28-31 at Santa Clara University. About 100 local Latino high school students are expected to attend the four-day, three-night college empowerment program where they will participate in college and career workshops, attend a college admission fair, connect with local Hispanic professionals and college admissions officers, and compete for $10,500 in scholarships. The students will receive ongoing support and information in their East Side Union high schools during the 2010-2011 school year through the Hispanic College Fund.

“A number of community leaders were asking us to bring the program to San Jose this year, but each Institute costs approximately $150,000 to hold, and the fundraising environment is incredibly challenging right now,” said Kathryn Grady, Hispanic College Fund director of corporate and foundation relations of western states. “Microsoft heard about this program and our track record of success in other communities, and they took a true leadership role. They’ve donated

$75,000 towards the program plus $25,000 worth of in-kind product donations. With Microsoft on board at such a high level, we were able to quickly rally other supporters in the region and break even in our first program year. That is unheard of, especially in a recession. In addition to their monetary contribution, over twenty Microsoft employees will be participating as volunteers during the program. The Hispanic Youth Institute guides underserved Hispanic students to pursue higher education, achieve a professional career, and become engaged community leaders and volunteers. Following a summer college residency called the Hispanic Youth Symposium, all students are enrolled in year-round programming that reinforces the key themes of the symposium: 1) Achieve a college education, 2) pursue a professional career (with an emphasis on business and STEM), and 3) become community volunteers. In 2010 the Hispanic Youth Institute is serving eight regions, including Central California, Dallas, Los Angeles, Maryland, New Mexico, Phoenix, San Jose, and Virginia.

Trace Elementary School ahora cuenta con una biblioteca, sala de cómputo, cafetería y salones para estudiantes del tercer grado. Sin embargo se siguen aceptando donativos para reconstruir esta escuela. Recordemos que son aulas móviles que van a requerir ser reemplazadas por salones fijos. Por esta razón se siguen recibiendo cheques Gandy Moreno está feliz de regresar a clase.

Resolution introduced to evoke college readiness

S

everal Summer Youth Leadership Academy (SYLA) students from the East Side Union High School District (ESUHSD) held a community townhall at Overfelt high school on Tuesday, August 10, to obtain recommendations on how to ensure students are prepared for meaningful careers and a life after high school . “I want to be a successful woman of color, said Patricia Navarro. “I want to go to college and have a career.” Californians for Justice (CFJ) have worked with the East Side Education Alliance (ESEA), a San Jose coalition of community organizations, elected officials, unions, and education advocates, to develop a regional campaign: “A-G Graduate with Me!” The campaign seeks to ensure that the ESUHSD implements A-G coursework as part of the graduation requirements, strengthen support programs and career tech education. The A-G requirements are college preparatory courses that California high school students need to complete upon graduation in order to qualify for four-year colleges like CSUs and UCs. CFJ, a statewide grassroots organization works for racial justice by building the power of communities and organizes the youth with programs like SYLA. Those students are then made aware of things like A-G requirements, by which

more sudents are notified. “I think it's a right to go to college and there’s so many students that think just by passing their classes they can go to college,” said Navarro, a junior at Independence High School. “Our community is made up of a lot of immigrant parents so they don't know of the things.” Nearly 2/3rds of students in the ESUHSD graduate without the necessary classes to attend a 4-year university. While only 20% of Latino students graduate with their required classes. “What we really want to do is to change the requirements to graduate high school into the same requirements needed to get into college because everyone will be set," said Benjamin Long, junior at Independence High School and SYLA graduate. Long and Navarro didn’t know about the college requirements until their sophomore year. They both hope to rearrange their schedules to better prepare for college. Students, allies and community members have rallied at the State Building to demand college and career readiness for students in the ESUHSD and a stop to devastating budget cuts. In addition to the resolution being presented, the campaign leaders plan to identify the resources, support services and systems necessary to make it a success. "I'm in agreement that we need to get this ini-

Moser said that everyone should be ready for college after high school and made a point about the importance of higher education in the future. He has support from CFJ and the different allies. "I feel cheated that nobody told me about it

uan Hernandez came to the United States when he was 15 years old without knowing a word of English. He was a chubby kid who found it difficult to adjust to life in the United States. That was until he discovered boxing. “I have been training Juan for the past six years, but he has been training for the past nine years. He is 24 now and is ready to

make the transition from amateur to professional,”said Rick Nava, a volunteer boxing coach at the Redwood City Police Athletic League “This sport takes a tremendous amount of discipline and hard work to get to this point.” Hernandez is 5’9’ and fights as a cruiser weight at 194-197 pounds. “As an amateur, he has alw ays fought people that were much bigger than him,”Nava said.“Naturally he tends to go inside for body shots against his much bigger opponen ts. He trains by practicing with much taller individuals and b y watching his opponents on YouTube.” The reason Hernandez is turning professional is because he has had great success as an amateur. “He was winning a lot in the first r ound by knockout, so it only made sense that he turn pro,” Nava said. Nava says he has great expectations for Hernandez and believes he will make an impact in the boxing world. “Everyone around him believes he will do well because he has great skills,”Nava said.“He has great speed and a lot of power.” Juan is making his debut on Aug 14 at the San Mateo Event Center (Fight Night on the Way to the Playboy Mansion, Sat. August 14, 2010). Hernandez, Nava and some close friends put up $1,000 t o make this event happen.
