They also accused Swenson of hiring non San Jose residents to work on his projects. “The way the rules have been bent to favor Swenson is unbelievable,” said San Jose resident Bob Brownstein. “Nothing good comes out of bending the rules.” But those who supported Swenson said that he would never bend any rules in his favor and that his contribution to San Jose was immeasurable. “Barry Swenson has been committed to the city of San Jose for over 30 years,” said Swenson’s employee Jessie Woodyard. “Too much time has been wasted and so much could have been done by now.” Those who accuse Swenson of not playing by the rules also accuse him of bribing council members into voting in his favor. But the council members said this was simply not true. “Swenson has no influence over me,” said District 1 Councilmember Pete Constant. “I have only met him once and I have never received a check from him.” District 2 Councilmember Ash Kalra also said he was not influ-

Prior to voting on the final decision, District 5 Councilmember Nora Campos asked her fellow council members to disclose the names of those they had met prior to the council meeting. Most of the council members admitted that they had met with Barry Swenson and/or his associates. The city council and the mayor voted 6 to 5 in favor of giving Educational Park Branch Library Project to the lowest bidder Barry Swenson Builder. The council agreed to accept Barry Swenson Builder’s bid of $7,136,300, and approved a contingency in the amount of $1,070,445. In addition, the council approved the first amendment to the agreement for consultant services with Anderson Brule Architects, for the Project, extending the term of the agreement from October 31, 2010 to April 30, 2011, modifying the scope of services, and increasing the amount of compensation by $90,000, for a total agreement not to exceed $1,280,000. “Everyone looked at the language of this bid and Swenson followed the rules,” said District 3 Councilmember Sam Liccardo, Esq.

R

aging Grannies think that health care is a human right, not a commodity like a pair of shoes. We think it is shameful that in the richest country in the world, 48 million people are uninsured. And even among those with insurance, many people are denied care and many are forced into bankruptcy by medical bills. It is shocking that 18,000 people die every year because they lack access to care. We want all Americans to have medical care when they need it. Can we leave it to the for profit private sector? Obviously not. However, it IS possible to provide comprehensive care for everybody if we adopt a single payer system, sometimes called Medicare for All. Like Medicare, money would be managed by the government and care provided by private practitioners. It works in many other countries, where they get better results for less cost than we do. A majority of Americans and their doctors and nurses support this solution. U.S. Congressman John Conyers has sponsored a bill in the House of Representatives, HR 676, for a single payer plan. Sadly, because insurance companies and drug companies contribute millions to Congress and pay for deceptive ads on TV, real reform is hard. Because of lobbying efforts by big companies, Congress has resisted serious discussion of the single payer solution, and the media gives it little attention. So activists like the Raging Grannies and others write letters and make phone calls and take to the streets to get the message to the public. A number of legislators have proposed a “public option,” a non-profit public plan. Congress has proposed some changes that might help a small number of people benefit from such a plan, but it is a far, far cry from Medicare for All. Clearly, real reform will have to come state by state. The California legislature has already passed a single payer plan twice (both times it was vetoed by Governor Schwarzenegger). But we can’t give up! Call your representative and our two senators with this message: 1. Vote for HR 676 and 2. Preserve the states’ right to pass single payer by supporting the amendment put forth by Congressman Dennis Kucinich The White House switchboard can put your call through. The number is 202-224-3121. Comprehensive Health Care Issues By Hilbert Morales, EL OBSERVADOR

E

ven in a time of severe recession, America remains a land of plentiful resources. Our collective challenge is to establish reasonable and fair standards of access and practice. While the current ‘American’ health care system is disjointed and broken, it does provide the best health care, especially in the medical specialties. To reform existing health care into a ‘comprehensive health care system’ one must understand that reform, if it happens, will stand on five main pillars: a) regulation, b) mandates, c) competition, d) subsidies, and e) the political will of the American people. Let’s deal with the political will of the American people first. Every constituent who is registered to vote must communicate with his/her Senators and Members of the House with the message that comprehensive health care legislation must deal with and establish a system which is accessible and affordable. It is very essential that the medical care consumer communicate their needs, perspectives, and support for what is best for the people. Many medical insurance groups are against the establishment of ‘socialized medicine’, but they neglect to inform the public that the American federal government is already successfully providing medical care insurance to its members of Congress, Medicare and through its Veteran’s Hospital system. ‘Big government’ already operates the most effective health care programs so why not expand it to meet the needs of those 47 millions presently uninsured because of unemployment and other reasons. Note that no private profit oriented corporation is enthusiastic about these potential clients because they see no profit there. Their interests are neither humane nor altruistic. Insurance is defined as the business of providing insurance protection against the costs of health care the insured may need when sick or when untimely death occurs. The insurance industry practices ‘selective insurance coverage’ of those who have good health today because the payout of benefits, called ‘medical losses’, will be quite low which guarantees profits. The practice of denying coverage for preexisting medical conditions needs monitoring and regulation. It is for these two reasons that the public insurance option must be included and retained in the forthcoming comprehensive health care legislation. The private medical health insurance corporations need the public option competition to force them to a) insure the entire population rather than the current ‘cherry picking’ approach and b) to keep costs of insurance low. Competition is not regulation. The proposed legislation must contain provisions to monitor and regulate. Medical equipment suppliers, especially high tech medical equipment, must be monitored with respect to

costs and profiteering. This is especially needed in the prescription drug industry currently benefiting from no competition because of the protectionism provided. Certain medications can be obtained in Canada and Mexico at lower costs than within America. During the recent Bush Administration, a sweetheart deal was passed that is now being protected and defended by the “conservative blue-dog” Democrats. These hypocrites make no sense unless one considers their personal self-interest. The American people need to tell President Obama to insert himself into the formulation of the desired comprehensive health legislation desired and needed to cover all the people. Forget bipartisan approaches and deal with this legislation on a power politics basis because both Republicans and Democrats will vote along party lines. In their own self-interest a few Republicans will support the legislation being proposed. The ‘single payer’ proposed system opposed by the uninformed and ignorant who deny the reality that Medicare, which is a very successful medical insurance program, is a single payer medical insurance program already administered by the government.

The Truth About Health Care Reform

As Paul Krugman, a Nobel Prize winning economist says, “The unregulated markets don’t work for health care....never have and never will. To the extent that we have a working health care system at all right now it’s only because the government covers the elderly, while a combination of regulation and tax subsidies makes it possible for many, but not all, non elderly Americans to get decent private coverage.” These days it is mandatory that children’s health care programs be provided from prenatal care to age five. What President Obama proposes as ‘Comprehensive Health Care’ using regulation and subsidies to make reasonable coverage available to all is not radical, it is as American as, well, Medicare. Once established with adjustments, this updated. Health care system will permit control of the current cost rises being experienced along with no major additions to the federal deficit because of competition, effective monitoring and regulation. Since an effective health care system is essential to us all, it behooves the voters to express their concerns to their congressional representatives while the latter are at home during this ‘August vacation’ period.Δ

very August thousands of music fans converge on San Jose to enjoy three days of music and fun at the AT&T San Jose Jazz Festival, which runs Aug. 7-9 in and around Plaza de Cesar Chavez. Volume of Caltrain Horns To Be Lowered

C

altrain has begun installing regulator valves that will allow a dramatic reduction in the level of noise produced by its horns. The valves are adjustable and will allow the volume of the horns to be fine-tuned. The volume will be returned to the previous level of 98 decibels, which is at the low end of the range set by federal law. Although crews will work on the project through the weekend it is expected to take several months to install the valves on all of Cal-

train’s 29 locomotives and 34 cab cars. Caltrain moved the horns from underneath the trains to the top of the trains when it was discovered that the horns could not produce the sequential blasts required by federal law. This increased the volume and the range of the sound. The Federal Railroad Administration, which stipulates the decibel range of the horns, the pattern of blasts and when the horn must be used, regulates train horns.

a noche del 22 de enero de 2006 Vanessa y sus tres hijos terminaron en una casa de refugio para protegerlos de la violencia domĂŠstica a la que estaban sometidos en los Ăşltimos seis aĂąos. El lugar no fue revelado pero estaban protegidos para asĂ­ evitar mĂĄs tragedias familiares. Ahora cualquier vĂ­ctima de violencia no tendrĂĄ a dĂłnde ir luego que el gobernador Arnold Schwarzenneger exterminara los recursos para ayudar a los menos protegidos. Report on San Jose Police Released by Independent Police Auditor

S

an Jose, CA - Acting Independent Police Auditor (IPA) Shivaun Nurre has released the 2008 IPA Year End Report detailing complaints received, closed, and audited during the 2008 calendar year. The report provides an overview of the classification of cases, officer demographics, complaints by Council District, and the IPA community outreach program. The total number of complaints filed by members of the public in 2008 was 467, a decrease from 491 complaints filed in 2007. The three types of allegations most frequently reported were procedure, courtesy and force. The IPA audited 388 investigated cases in 2008 in order to determine if the investigations were complete, thorough, objective and fair. The IPA disagreed with 17% of the 338 investigated cases audited and agreed with 83%. Significant changes to the police misconduct

complaint process were implemented by the San Jose Police Department in July of 2008. The report presents an overview of those changes and describes some preliminary effects on the complaint process. City of San Jose Housing Department: Foreclosure

T

he Foreclosure Help Center provides information and referral services to assist families impacted by foreclosure. Volunteers assist with mortgage loan modification packets and will connect you to HUD-certified foreclosure prevention counselors, nonprofit legal services, emergency financial assistance and other housing services. Foreclosure impacts everyone in the community, from family to friends and even our neighbors. To help residents in need of foreclosure prevention assistance, the City of San Jose has established a free Foreclosure Help hotline at 408.794.1242, and has opened a Foreclosure Help Center to assist homeowners facing foreclosure and tenants impacted by foreclosure.

Through the Foreclosure Help hotline, callers can receive information and referral services or can schedule an appointment with experienced volunteer staff that will assess the homeowner’s situation and assist them in preparing a complete documentation package prior to meeting with a HUD-certified foreclosure prevention counselor or their lender. On the homeowner’s behalf, the HUD- certified counselors will work directly with the lenders on loan modification requests, refinance, forbearance or short sales. HUD-certified counselors can also provide assistance in navigating the foreclosure process. The homeowner may also be referred to free legal services provided by our legal nonprofit partners if they are victims of predatory lending or real estate fraud. Others may be referred to nonprofit agencies that provide limited emergency financial assistance for emergency situations. The Foreclosure Help Center and hotline is a collaborative effort between the city, Santa Clara County Association of Realtors, National Association of Hispanic Real Estate Professionals, California Association of Mortgage Brokers - Silicon Valley, and three HUD-approved nonprofit agencies who employ HUD-certified foreclosure prevention

an Francisco based band Los Valenberg recall the days when they did not know how to play their instruments. The music chords were wrong and their timing was off. But in only two years, the band polished their skills and developed a following throughout the Bay Area. On Saturday, August 1, the band played at South First Billiards in San Jose. The band members include: Omar Prieto on bass, Hermez Flores on guitar and vocals, Josh Jones on drums and Angel Canizal on guitar. EO: How did you guys come up with the band’s name? Omar: At first we did not know how to play too well. We just came up with the name because that’s who we are. We are Los Valenberg. EO: Where else have you guys played? Omar: We’ve been playing around San Francisco and so many other places. It’s hard to remember all of them. Hermez: We also played a show down the street at MACLA. EO: What are some of the band’s influences? Josh: Well, I don’t think we have a preference when it comes to music. We like it all. That’s what makes us who we are. Omar: We also have a demo going around that has fives songs on it. EO: Who is your target audience? Hermez: Well, we don’t really have a target audience. EO: Who writes the songs? Hermez: We all write the songs. Sometimes someone will start off with something and we all build from there. EO: What’s your favorite song to perform? Omar: Well all of them really. We just want to entertain the audience and hopefully they will like us. EO: What do you guys usually sing about? Hermez: We sing about everything. Someone did you wrong, heartache, someone told you a lie. EO: What’s next for Los Valenberg? Hermez: We just basically started but we got a lot coming. Earthquakes Sign Brazilian Midfielder Andre Luiz Moreira SAN JOSE, Calif. he San Jose Earthquakes announced that the team has signed Brazilian midfielder Andre Luiz Moreira. Per league and team policy, terms of the deal were not disclosed. Andre Luiz most recently played for Jaguares de Chiapas FC in the Mexican First Division. He registered four goals in his 51 appearances for Jaguares since signing there in 2007. He helped them finish second in Group 3 in the 2009 Clausura tournament in Mexico and earn a spot in the playoffs. They also made the playoffs in the 2008 Clausura tournament. The Sao Paulo native has made 21 appearances for the Brazilian national team and has scored two goals. He was also a member of the Bronze medal winning Brazil team from the 1996 Olympics in Atlanta.

The 34-year-old central midfielder has played for successful clubs around the world such as Paris St. Germaine (France), Olympique de Marseille (France), S.L. Benfica (Portugal), C.D. Tenerife (Spain), Sao Paulo (Brazil) and Corinthians (Brazil). Overall, he has appeared in over 300 professional matches in his career and scored over 20 goals. While with Sao Paulo, Andre Luiz won two Copa Libertadores titles and two Intercontinental Cups. He helped Sao Paulo defeat FC Barcelona in 1992 in the Intercontinental Cup, and the following year they defeated AC Milan in the final. He also won two Paulista titles in Brazil with Corinthians and one Paulista title and the Conmebol Cup with Sao Paulo. In France, he was a part of the 2003 Paris St. Germaine team that won the French Cup.
