Auditor Selection Extended By Osvaldo Castillo El Observador

he City of San Jose has been without an Independent Police Auditor (IPA) for almost a year now, leaving many in the community discontented. Avery and Associates has been hired to find an ideal candidate to fill the position. On January 6, Avery and Associates held a meeting to discuss what characteristics the new IPA should have according to the community. However, many community members are not satisfied with the time frame and methods used by Avery and Associates to select candidates for the position. Avery and Associates claimed to have confered with several organizations, including La Raza Roundtable, but several community members said that they never contacted by email or phone. Only three people showed up to the January 6 meeting. “There should be an extension in this process because not all the members of the community have been contacted,” said San Jose resident Betsy Wolf-Graves. “The police should be audited by someone that is looking out for the best interest of the community and not the police department.” Council members Ash Karla (District 2) and Kansen Chu (District 4) agreed with the community members and asked for an extension of the process.

“January 6 was not a good time to have a meeting. Council members need more time to notify their constituents about this process,” Karla said. “The fact that only three people showed up to these meetings reflects that an appropriate outreach method was not made by Avery and Associates.” Council member Judy Chirco agreed asking, “ Why did Avery and Associates try to contact people over the holidays when people are either busy or not home. Avery and Associates should have asked the council members for email lists?” The Council is asking that Avery and Associates conduct one more meeting at the end of February to discuss the selection of the new police auditor and to write down what was said by community members regarding the decision process. A 19-member panel will be created to interview the candidates. All candidates must be residents of San Jose. All the panelists must be allowed to ask the candidates questions. Four panelists from the Independent Police Auditor Advisory Board should be randomly selected. This process will require a two-week period to coordinate and finalize logistics for interviews. The Council will interview the final candidates on March 8 and make a final decision on March 15.

Abuse of Temporary Workers Demonstrates Urgent Need to Reform Immigration System

ashington, DC-Today's national headlines revealed another example of the need for comprehensive immigration reform, says NCLR (National Council of La Raza), the largest national Hispanic civil rights and advocacy organization in the United States. The New York Times has documented another story of the undue suffering that workers face under our broken immigration system, this time when Immigration and Customs Enforcement (ICE) advised Signal International, a marine oil rig company, to deport temporary workers protesting abusive working conditions. "When temporary workers are not guaranteed basic protections under our labor laws, then abuse of all workers is likely," said Clarissa Martínez De Castro, NCLR Director of Immigration and National Campaigns. "The only way to prevent more cases like this is to enact comprehensive immigration reform that levels the playing field for all workers, affords them all the same basic protections, and punishes unscrupulous employers who engage in abusive practices for the sake of profit." The story, "Suit Points to Guest Worker Program Flaws," reports that ICE helped Signal International manage immigrant workers who were protesting working conditions and documents the dubious circumstances under which they were brought into the country. Signal International imported the temporary workers from India under the H2B Program to help with the repair of oil rigs after Hurricane Katrina hit the gulf coast in 2006. According to reports, ICE advised the company to deport workers who were being "disruptive". The collusion came to light after depositions from Signal managers were unearthed in a federal lawsuit by the workers against the company. Carl Falstrom, an immigration lawyer not associated with the case, remarked that "private companies cannot carry out deportations." Current ICE leadership seems to agree, and Brian Hale, an ICE spokesman, stated that "agents are generally aware that a company that fires H2B workers is prohibited from compelling individuals to get on the plane." Both the Department of Justice and the Department of Homeland Security have opened up investigations into the matter. "The complicity between the government and business is unusual and stark in this case, but the abuse of temporary workers in all industries is well documented," continued Martínez De Castro. "The fact that workers were being held in dangerous conditions and forced to pay recruiters astronomical fees for their jobs speaks to the urgency of enacting reform that does away with abusive programs which limit a worker's basic rights. All workers will benefit from removing these practices from our labor markets."

he good news last week was the purchase of the land occupied by the closed down San Jose Medical Center. Purchasing that property ensures that a future medical facility, most likely a modern clinic, will be located at 725 East Santa Clara Street. It is made up of 13.39 acres bounded by Santa Clara, East St. John, and North 14th and North 17th Streets. The Santa Clara Count Board of Supervisors authorized in December of 2009 the purchase price of $24.6 million. With today's medical knowledge and its applied technology, it is essential that this proposed clinic with its specialty equipment and personnel be housed in a building that is engineered to withstand a Richter 7.0 earthquake. Look at what happened to hospitals and clinics during Haiti's recent earthquake to know that the inability to deliver essential medical services happened because all their facilities collapsed, destroying essential medical services infrastructure required for the delivery of medical services to survivors. In additions, the buildings collapsing also killed many essential medical personnel. And to make things worse supplies became inaccessible when buried under rubble. Therefore, health services planners must be authorized to ensure the buildings will withstand a Richter 7.0 earthquake such as the one which occurred in this area in 1906 and again during Loma Prieta earthquake of 1989. Supervisor George Shirakawa representing District 2, where this site is located, expressed elation. The Health and Hospital System of the County of Santa Clara must now perform what is necessary in guiding the construction, organization and establishment of the medical facility system that can operate effectively after a major earthquake occurs. There is no doubt that such an earthquake will happen in the future, since its location is between the San Andreas and the Hayward Fault. While existing plans call for the remodeling of an existing 37,000 square feet medical office building, it would be prudent to have seismic safety engineers assess its ability to remain operational after a Richter 7.0 quake (the structural standard at SCVMC). The necessary structural upgrades must be implemented if required. ensure operational capability after an earthquake. This could not come at a better time because President Ken Yeager of the Board of Supervisors is totally committed to improvement of the health care status of the residents of this county. In addition, the County Executive, Dr. Jeff Smith, M.D., is knowledgeable about the scope and requirements of a modern medical clinic. Finally, since jobs and health care are the top priorities of the Obama Administration, it would seem very possible to have adequate American Recovery and Reinvestment Act (ARRA) funding for this medical facility. While this proposed medical facility is being planned, it would be instructive to study clinic systems such as the Palo Alto Medical Foundation, the Mayo Clinics and the Case-Western Reserve Clinics for organizational and medical service delivery concepts. And it is not too early to begin to have preliminary discussions to establish the network of relationships with area hospitals and specialty medical services providers. And let's not overlook the need for Stanford Medical School to have access to this clinic for its primary care training programs. It takes time and due diligence to establish the optimal mosaic of relationships that make up medical services delivery capability. The biggest danger is to remodel that existing building without looking into its ability to be of use after a major seismic incident. The challenge is to take the time to do the creative visionary planning which results in a freestanding clinic facility, which is capable of providing medical services during normal times, but most especially, after experiencing a major earthquake already predicted by the local U.S. Geologic Service. Expediting things and cutting costs now will only result in the inability of this facility to serve the community when it is needed the most. Just look at what happened in Haiti, where the earthquake exposed the inadequate construction standards accepted by authorities, contractors, and developers who looked the other way when short cuts were taken. Eventually, it was ordinary residents who paid with anguish, suffering and their lives. That may be mitigated here. So let's ensure that the proposed downtown clinic will serve the people all of the time, even after a major earthquake.Δ

Honda sería el mensajero de "Mantengan a nuestras familias unidas", importante lema que los inmigrantes vienen pidiendo de muchos años atrás. "Hay que pedirle a los Congresistas que se oponen. Obama dijo que si se puede y que ya es hora de la inmigración", dijo el Congresista Mike Honda El Congresista también elogió la notable labor hecha por parte del Congresista Luis Gutierrez. ¿Peligra reforma? Por su parte el Congresista Luis Gutierrez dijo en un noticiero radial que si no hay apoyo para abril la reforma muere. Sin embargo dejó bien claro que cuenta con el 90% de apoyo por parte de los Congresista para pasar su propuesta. Community Loses an Inspiration:

ometimes life can become really difficult for some people. The world becomes a hopeless place and the easiest thing to do is to just

give up. But then, almost out of nowhere, an inspiration comes into their lives and guides them in a direction towards personal recovery. For many people, that inspiration was Albert Cobarrubias. A graduate of San Jose State, and with plans to attend Law School at Santa Clara University. Cobarrubias joined the community organization Silicon Valley DeBug, and began to work with families facing legal issues. Whether it was a youth who just got arrested, or a husband being sent to prison for life, Cobarrubias was there to comfort those who were suffering. Unfortunately, Cobarrubias' remarkable life was brutally cut short on Saturday, January 23, in a random act of violence. Cobarrubias was 31 and his death was the first homicide in San Jose this year. On Friday, January 29, Cobarrubias' friends and family gathered at the Silicon Valley DeBug Community Center in San Jose to remember, honor and celebrate his life. MYSTERY PENALTIES By Osvaldo Castillo - El Observador

t is no secret that the City of San Jose is in need of money. Sacramento has asked San Jose to contribute more than its fair share towards the State’s deficit, and this has led to several questionable arrests including being drunk in public and driving under the influence. There are also other methods the city uses to collect money from its residents. I called these “Mystery Penalties”. To put it simply, Sherlock Holmes would have a difficult time solving the mystery behind these penalties. A perfect example of someone who is subjected to such penalties is my father. He lives in a corner house across the street from Independence High School. His house has a couple of trees and a fence.

The leaves and branches from the trees fall onto the street, sidewalk, cars, mailboxes, everywhere. The fence is pretty much a canvas for all the homeboys to express themselves or disrespect others. But my father does not care. “Its what trees do,” or “There is no point in painting the fence because the kids are just going to write over it,” he would say. However, the City of San Jose does seem to care. And it seems to care a lot, resulting in several penalties. These penalties only range between twenty and thirty-five dollars, but they are an annoyance. “Why should I have to pay for this,” my father would ask. “I can’t control what the trees or the kids do.” He has tried writing several letters to the city

but their only response was a couple of plastic bags, a bucket of paint, and a due date for the fine. This has been going on for several years and my father is just one example of some this. Another example is Steve McGarry, who owns a house in downtown San Jose between 18th and 19th Streets. He is constantly fined by the city for the mess the tree creates. “I have had nothing but problems with this tree ever since I bought this property,” McGarry said. “I have asked the city several times to remove it but they told me they would not.” McGarry wants to pay to remove the tree himself and estimates that it would cost him $10,000. “I am still waiting for the city’s response,” McGarry said. The bottom-line is that the city should either pay

for these inconveniences or let them be. If the city wanted a tree in a neighborhood then it should hire someone to maintain it. Why should the residents deal with inconvenience? We have enough of our own problems to deal with. San Jose is going through some hard times. We all are. But the city should stop using methods to raise money that leave residents scratching their heads. It is simply unfair. Residents should also bring this issue to the attention of their City Council members and County Supervisor to deal with this issue. As for the trees, we were thinking of just paying to cut them down and not deal with it anymore. Nora Campos or her successor will be receiving a letter about the fence.

Recorte en California dejaría a 880 mil niños sin servicio de salud San Diego, (Notimex).

a organización Proyecto de Presupuesto de California advirtió que 880 mil niños podrían perder servicios de salud debido a que el gobernador Arnold Schwarzenegger propone por segundo año consecutivo desmantelar parcial o totalmente el programa. El gobernador presentó una propuesta para cancelar los servicios a los niños del programa Familias Saludables cuyas familias tengan ingresos de 36 mil 620 dólares anuales, clasificadas como poco más arriba del nivel de pobreza. Son familias -en su mayoría latinas- con ingresos medios bajos que sin embargo, gastan en vivienda más de 20 mil dólares anuales, de acuerdo con Proyecto de Presupuesto. La organización sin fines de lucro agregó que los restantes 680 mil niños inscritos en el programa perderán servicios de oftalmología y dentales en los siguientes meses, si es que el servicio no desaparece totalmente. El año pasado Schwarzenegger propuso eliminar completamente el programa Familias Saludables pero la legislatura acordó reducir presupuesto a otras áreas para conservar los servicios por lo menos hasta junio próximo.

Sin embargo, al iniciar el próximo año fiscal estatal en julio, el programa carecería de fondos para continuar, si antes el gobernador y los legisladores no alcanzan un nuevo acuerdo. Rudy Madrid Lives on in San Jose Memories By Gil Villagrรกn

hen Rudy Madrid was laid to rest at Santa Clara Mission Cemetery on February 1st, it was his second death after his first on the day he stopped breathing eight days earlier. Citing a Mexican dicho, Father Jose Rubio sermonized to the standing room only audience at Sacred Heart Church, "We all die three deaths: First, when we stop breathing; second, when we are buried; and finally-when no one is left to remember us." If there is truth to the proverb, then Rudy Madrid lives on in the memories of those who love him. There were more than a thousand who attended a tribute concert with a dozen bands on Saturday, 500 attending a Rosary on Sunday, and a thousand participated in Mass on Monday, after which he was laid to rest, and then at an enchilada and chile verde reception with hundreds sharing tableside stories--some sad but mostly funny and joyous, about this San Jose original troubadour of the Chicano Movement. Here are some of those memories: Rudy, the middle child of a family of eight siblings

was born in Fowler, a farming community near Fresno, and grew up in East San Jose when the family migrated in 1960. Rudy attended Goss Elementary, then Fisher Middle School and graduated from Overfelt High were he played drums in marching band and jazz orchestra. Community organizer Sofia Mendoza had been advocating for Santa Clara University to enroll Mexican students, and having met the Madrid family, she recognized Rudy as an excellent student who could be the first to break the Catholic University's color and economic barrier. He qualified for a full four-year scholarship-making him the first and only low income Mexican student in the rich white bastion of Jesuit education on the other side of Santa Clara Valley. Rudy's hope was to become an attorney-using the law to remedy the social injustice he witnessed: poverty, racism, the Vietnam War, police abuse, educational inequities. However, while music was pulling his heartstrings away from academics, trading books for his guitar that he was mastering; at the same time, he tearfully revealed to his family and friends that racist abuse was directed at him daily on the campus. But such abuse caused us to organize (with the gradual increase of Mexican students) to fight back against racist students and the administration (that was blind to the injustices inside and outside the university). "We finally organized a sit-in/sleep-in inside the Mission Church to demand admission of more Mexican students and relevant classes. During our three days inside, refusing to leave under threat of arrest, Rudy inspired us with his music-keeping our spirits up until our arrest. After two years, Rudy left Santa Clara to enroll at San Jose State College, where he studied music, excelling in jazz piano and guitar. Ramon Martinez recalls, "I met Rudy in 1969 when 1,000--most of us farm and small town kids from the central valley, were enrolled at San Jose after the San Jose Chicano community pounded down the gates. Rudy's music was the soundtrack to the Chicano Movement and MEChA (Movimiento Estudiantil Chicano de Aztlan) in San Jose.” Sofia Mendoza recalls, "Rudy was an energetic organizer, writing the "El Machete" newsletter, printing leaflets at the original MACSA office, setting up rooms for planning marches and walkouts. He stayed in the background, not giving speeches, but rather would bring people together, entertaining us with his music." She relates, "Rudy's music was an integral part of our organizing the community for our rights, the right to our culture, our language; a safe neighborhood without abuse by the police, good schools and college for our youth. Rudy was active in the walkout at Roosevelt Jr. High (the first in the nation), United People Arriba, Community Alert Patrol (against police killings), advocacy for the McKee Health Clinic, and countless anti-war marches and United Farmworker pickets. And always, Rudy playing his music, enlivening our hearts with corridos, boleros, and oldies before they became oldies. By 1979 Rudy formed his life-long band, Rudy and the Cruisers, performing at such clubs as Antuna's, The Glen, Keyes Club, Patty's Inn, Caravan, Toon's, Willow Glen Inn, Eagles Hall, Bob's Surf n Turf, Starlight Ballroom, Saddle Rack, and at conferences and local hotels. Perhaps his biggest event was at the first and largest anti-war concert at Golden Gate Park, with an estimated 250,000 attending.

He shared stages, performed or toured with Tower of Power, Trio Los Panchos, Little Joe y La Familia, Tierra, and others. Rudy's music was integral to the weekly Misa Floricanto at Sacred Heart Church's Hardeman Hall, and he also played his music for family and friends for weddings, baptisms, quinceñieras, and birthday parties. He also played for funerals, but would never accept any payment for funerals, insisting that a funeral is no occasion to make money. Rudy's lifelong commitment to the education of our youth was evidenced annually when he performed for Abrazos and Books, Rigo Chacon's nonprofit organization to raise funds for scholarships and assistance to child victims of poverty, disability or catastrophes. In gratitude, Rigo stated in his eulogy, "Rudy was an American icon, let us take a moment to celebrate, for there is a new voice in the heavens, with his infectious smile, and tell Cesar Chavez that his noble work continues, tell Mauro Chavez that our kids are going to college." The love that Rudy gave to so many was returned by his friends, compañeros, carnales, as stated by Karl Soltero, "This inner feeling of love, loyalty and friendship were the ties that bound us to Rudy. One could not ask for a better friend, a better carnal." Last August almost 500 such carnales were brought together by Antonio Chavez, a longtime friend whose home was always open to Rudy, for A Tribute to Rudy Madrid. "He was so happy to see so many people from his past attending, to say hello. Little did we know we were also saying goodbye to our dear Rudy." Rudy's family and friends report that he was always writing songs, trying new arrangements for his favorite corridos of struggle against injustice, oldie love songs, or traditional ballads in English or Spanish. His 45-year music and recording career include such hits as Cruising Baby, Chula Chula, Caminando, Visalia, and his favorite ballad, "Just One More Time." A recording by Rudy was played at the end of his Rosary on Sunday night, with his melodic voice repeating the words "just one more time, let me hold you in my arms, just one more time..." Bittersweet tears moistened many eyes as we walked out into the rain soaked pathways at Oak Hill Cemetery, with Rudy's song in our hearts. Rudy lives on in our San Jose memories...

t would not be prudent for those of us who live in this area which is located on the Pacific Rim that is prone to have earthquakes to ignore the lessons of Haiti and Katrina. One obvious observation is that the construction standards used in Haiti were inadequate. Many buildings collapsed. The falling structural debris killed may residents. Important facilities such as government buildings, hospitals, clinics, were medical offices destroyed because of their location within structures that were not designed to withstand the seismic event that occurred. Building codes and seismic safety standards exist for a reason in this area so do apply them to your situation. Another observation is that the head of a household must plan for having enough emergency supplies stashed away in a location that will not end up under the rubble. These emergency supplies may need to last at least five days. They include water, food, midications, blankets, etc. A major observation is that it took more than five days for meaningful assistance to arrive at the devestated sites. The damaged infrastructure needed to be reestablished first. Roads needs clearing, bridges and overpasses needed to be checked out for structural integrity and safety, and heavy equipment moved into place. The outcome is that at least five days supply of essential water, food, and medications needs to be available for sustenance durng these recovery activities. The safety net of public services will need to take time to recover and become available to serve the public needs. Police, firefighters, emergency medical personnel, etc. will need to take time to care for themselves and their immediate families before being effecive as emergency services personnel. Immediate assistance was provided by surviving neighbors. It is essential that hand tools be located where access is possible after a seismic event. To improve effectiveness plan on forming an emergency response tieam in your immediate neigborhood. Take time now to learn about search and rescue basic techniques and the creation of emergency shelters from available materials, etc. This information may be available now from the FEMA funded program already available in your community. Plan ahead to ensure your safety, comfort and survival in any emergency. Mexico to Face Bolivia on February 24 at Candlestick Park

he San Jose Earthquakes and Soccer United Marketing (SUM) announced today that the Mexican National Team will face Bolivia on Wednesday, Feb. 24 at Candlestick Park in San Francisco, presented by Visa. The match kicks off at 8 p.m. PT and will be the first of six matches that Mexico will play in the United States in preparation for the 2010 FIFA World Cup. l cantautor mexicano Lupillo Rivera aseguró que es un logro más en su carrera haber ganado un Grammy en la categoría de Mejor Album de Banda por "Esclavo y amo", aunque admitió que nunca se imaginó obtener un premio de este "calibre".
