The Beginning of Change A By Dave Cortesse Santa Clara County Supervisor

s we reflect on the first decade of the 21st century, we can see the ups and downs and the tumultuous economy. But we can also look to the future and see the path towards recovery. Despite the tumultuousness, families pulled together and did more with less. Likewise, here at the county, we were still able to accomplish a lot, despite diminished resources. I wanted to take a minute and reflect over some of the great things we put in place in 2010 to benefit the residents of Santa Clara County, thanks to your support. Highway 101 Corridor Improvements I hope you got my email from last month, announcing the pending construction of Highway 101 at Tully Road. If you travel Highway 101, you may have seen the construction equipment appearing around Tully interchange. I am very excited to see this as it is the realization of almost a

decade of hard work and perseverance. Since I was first elected in 2001, I have fought tooth and nail to upgrade this interchange. This project will dramatically increase motorist and pedestrian safety. Also, it will begin to ease the traffic congestion on this vital road. But the fight isn’t over. Just before Christmas I met with state leaders to develop a strategy for securing the remaining funds to update the Yerba Buena and Capitol Expressway interchanges. The projects are already designed; all that is needed now is about $31 million to complete the construction. This is my number one transportation goal and, hopefully, I’ll have good news for you in late spring 2011 on securing the funds. I am also working to plan a celebration of the groundbreaking of the construction work. District 3 out in the community I strongly believe in the power of communities. In 2010, my office and I participated in dozens of local events put on by neighborhood associations and community organizations to show support and help connect residents to county services. Also last year I co-sponsored the First Annual Day on the Bay: A Multicultural Festival in Alviso with the Santa Clara County Parks and Recreation Department. This festival allowed residents from across the county to learn about services and resources available to them as well as to enjoy free live entertainment, free food, free kayak rides at the Alviso Marina and free pumpkins. My staff and I are already planning this year’s events and I hope to see you at one of them. A greener Santa Clara County In order to ensure our community’s survival, we must make it sustainable. With that in mind, I’ve focused a great deal of time on greening and making sustainable not only county operations but the community too, including supporting the creation of a County Office of Sustainability. This office will further the goals of the environment, the economic stimulus and equity. To put it simply, the office will help the county ensure that all its residents have a healthy place to live and a chance for good jobs. No more young minors in Juvenile Hall Last year was a significant year for social justice in Santa Clara County. After studying the issue and taking public testimony, I asked the Board of Supervisors to approve a resolution to no longer place any child 12 years old or younger in Juvenile Hall – and the Board unanimously agreed. Children this young need one-on-one, highly intensive intervention – and Juvenile Hall is not set up to do this. Young offenders are now being placed in highly

trained parental care-like settings, where they can receive the attention and care needed to rehabilitate and re-enter the world. Studies show that 97% of these kids will not re-offend. A cost efficient and rehabilitative criminal justice system In an effort to make the criminal justice system fairer, while at the same time saving taxpayer dollars by easing the burden on the courts, my office has been working with county staff on how to divert certain low level offenses away from the judicial process. Such “diversion” programs have been successful in many other jurisdictions because they allow non-violent offenders to correct their offense while not taking up valuable time in the courts. Last December, the Board approved the first diversion method – giving infractions (as opposed to misdemeanors) for certain low level vehicle offenses. These are just a few of the changes that I worked on last year. I have more ideas for this coming year, but I know you have many other great ideas. To that end, I led in the creation of a whistleblower hotline for county employees and residents to make anonymous tips and suggestions to help us create a more efficient and accountable county government. Special Task Force Raids Fraudulent Internet-Based Moving Companies

fter a year-long investigation prompted by numerous consumer complaints, a special task force organized by the Santa Clara County District Attorney’s Office and its Bureau of Investigation executed search warrants at the premises of three Internet-based moving companies. Task force participants include the Federal Bureau of Investigation, the U.S. Department of Transportation, the California Public Utilities Commission, Santa Clara County’s Department of Weights and Measures, the San Jose Police Department, the District Attorney’s Offices of Monterey and Alameda County, and the U.S. Department of Homeland Security, Immigrations and Customs Enforcement. Wayne Allen, Eran Bar, Roni Hayon, Melissa Jiminez, and Adalinda Reyna-Mendoza have been arrested for theft-related offenses in connection with the investigation. Others are being sought. The fraudulent movers offer low prices over the Internet, but increase the charges using various scams, including fraudulently “reweighing” goods and using extra packaging

materials which are billed at exorbitant rates. The movers then hold the customers’ goods hostage until those consumers pay the inflated charges. Deputy District Attorney Kenneth Rosenblatt, assigned to the Santa Clara County District Attorney’s Office Consumer Protection Unit, reminds consumers to avoid booking moving services over the Internet or accepting estimates over the phone. Rosenblatt offers the following tip: “Do not hire any company unless they come to your residence and give you a detailed written estimate of the cost of moving your possessions.” He also cautioned that since the companies investigated by the task force used names similar to large, and legitimate, moving companies, consumers should make certain that “what appears to be a nationwide mover is not just a fraudulent group with an internet connection.” Consumers who believe they have been victimized by one of these companies should call the District Attorney’s Consumer Protection Unit at (408) 792-2880

he HCCSV is committed to promoting and supporting businesses in Silicon Valley. We know that by creating a climate for business to prosper, we also create opportunities for individuals to find jobs or have jobs. This improves their lives for themselves and their families. We also believe that consumers benefit when they have a full range of competitive choices in the marketplace for goods and services. Consumers know best their personal situation. Consumers should be allowed to individually choose the best product or service for their specific need at the price they want to pay. Now the City of San Jose is working on an ordinance that would build barriers to restrict some local businesses and put jobs at risk. This proposed ordinance would curtail personal choice and potentially raise cost to consumers. The S.J. City Council is considering placing a development moratorium coupled with harsh zoning restrictions in this city on just one type of financial services retailer: The Payday Lenders. This may hurt our community, our civic economy and our citizens. These restrictions would be anti-business. Like banks and credit unions, payday lenders are a state regulated legitimate alternative for short-term credit. Consumers and the

competitive marketplace should be allowed to decide if legitimate and regulated businesses should exist, not government officials. These proposed restrictive ordinances could put certain job opportunities at risk. Payday lenders along with other local businesses are important economic engines for jobs in our communities. We cannot afford to curtail opportunities or put existing jobs at risk, especially now. These proposed restrictive ordinances would limit consumer choice and could increase how much they have to pay for legitimate short-term credit in the marketplace. Payday loans may not be for everyone, but many consumers find them to be the most practical and least costly option for borrowing a small amount of money for a very short period of time. Consumers should be allowed to choose the best product for themselves without unnecessary limits on their options and potentially higher costs. The San Jose City Council should be working to create a welcoming environment for businesses, not closing doors. It should be looking to foster more job opportunities, not shutting them down. It should be promoting legitimate financial alternatives, not limiting choice and raising costs. A moratorium or new zoning restrictions on a legitimate financial service business is simply the wrong policy for San Jose.

Early Prevention And Intervention Required By Hilbert Morales

he tragedy in Tucson, Arizona changed that community because many in that community and throughout the nation are now aware that the danger from within is great. Despite signs of personal mental pathology which was definitely antisocial, Jared had the freedom to operate under the radar screen of local law enforcement and institutional authorities at local community colleges who had cause to reject him as a student. However, current law and its behavioral standards were not violated, so therefore, Jared was not subjected to early intervention. A large void exists between local institutions, local community police, the state and national levels of law surveillance and authority. It would behoove state assemblies and national government to meet and confer concerning the many barriers to our ‘tradition to be free’ and the successful surveillance and recording of those who have the potential to be violently destructive. Communities have all experienced violence involving guns, knives and improvised bombs. Locally, in one weekend, five individuals were slain. It is time for individuals to take note of friends and acquaintances who emanate those tell-tale signs of a transition from ‘normal human behavior’ (who knows how to define that?) and extreme anti-social behavior. Recently, the Secret Service released a comprehensive study about those who attempted to assassinate the President of the United States. Despite the unique nature of each and every assassin already incarcerated, the finding was that all went through a very similar and recognizable transition from “normal human behavior’ to one of being a psychopath who would solve personal issues with a destructive action. Locally, some steps are being taken to deal with these basic issues. This Saturday, January 18, 2011 San Jose Mayor’s Gang Prevention Task Force will conduct a summit which will address local issues of gang violence. San Jose is at the forefront of providing resources to establish after school programs and support programs which engage children from after school until the parent comes along after having worked all day. Many of these programs will suffer from the draconian budget cuts which are in the offing though they mitigate gang recruitment efforts. Today, the current generation of youth is used to receiving services which can be accessed for ‘free’ simply because those who ‘benefit’ are never really informed about how and who funds these services. A sense of entitlement has been generated which is unsustainable in any economy, good or bad. When needed services cannot be funded through the usual

local government agencies, we expect the state and federal levels to provide resources. The current economy does not generate the tax revenues needed to fund the level of services required. A paradigm shift is necessary. Those 30 odd bullets discharged in Tucson, AZ have brought to the fore that many good Samaritan are amongst us. In a crisis they respond as best they can. However, the majority of us need to begin to think about ways to provide assistance to those who need them. This can happen without a formal government program being responsible or being involved. Have we forgotten how to sweep the sidewalks and gutters in front of our homes (or storefronts)? Many simple jobs have become ‘unionized’ in a manner that denies developing youth an opportunity to perform simple tasks needed. The biggest impediment to success in achievement of public security and safety is the practice of not snitching when one sees wrong behavior. Many murders are unsolved simply because the witnesses do not step forward as witnesses willing to testify to establish facts and truth. It is these acts of nonconformance that undermine public safety, security and denies justice to all. Whistle-blowers and certain witnesses are provided protective custody simply because they did the right thing. It takes courage to do the right thing. Think of the human pain and suffering coupled with the prevention of property damage that did not happen in this community. That was when the 2 hour photo clerk called the police’s attention to the pipe bombs and automatic weaponry photographed by an individual who was planning to conduct an incident at a local community college.. Speaking to each other with enhanced civility is not enough. Each of us must be the conscious steward of public security and safety in the environment wherein we personally operate daily. We must speak up when the signs of violence become apparent. We must learn to be as non-violent as was Mahatma Ghandi, The Reverend Dr. Martin Luther King, and César Estrada Chavez. We all must become engaged in securing each other from discharged bullets which destroy the safety and serenity required for humane activities. We must become acquainted again with the Ten Commandments and the universal commandment, which is to treat your neighbor as you would want to be treated. Let’s stop those who discharge bullets by learning what it takes to do early prevention and intervention. Let’s establish laws and behavior standards that permit serene peace amongst us.

A Nation Of Immigrants’ Concert T

he Peninsula premiere of “Misa de los Inmigrantes” by Henry Mollicone, with text by Kathy Mollicone will be presented by Henry Mollicone, the choir of the Unitarian Universalist Church of Palo Alto, members of the San Jose Symphonic Choir and a small orchestra, with narrator Maria Marroquin. A traditional mass in Spanish, the piece also includes Lupe's Story, the true story of Guadalupe and her family, and their difficult journey from Mexico to the United States in search of a better life. This beautiful and emotional work was written as a tribute to all immigrants with the hope of raising awareness of the injustices in our present immigration system.

The program will also feature Veronika Agranov-Dafoe, the LyriCats, Richard Heydt, Kathy Parmentier, Ted Brown, and Mike Cudahy singing and playing music celebrating all immigrants and their music! Disaster prep tips for small and home-based business owners (ARA) early 30 million small businesses operate in the United States, according to the Small Business Administration Office of Advocacy. They employ just over half the country's private sector workforce and hire 40 percent of high tech workers, such as scientists, engineers and computer workers. "With 52 percent of small businesses located in homes, it is important for these business owners to protect their personal and business assets properly," says Bruce Peterson, a senior vice president with Fireman's Fund Insurance Co. "Employee and family member safety comes first in the event of fire, flood, earthquake, windstorms, or any other physical loss." Whether a natural disaster such as flood, hurricane, earthquake, or tornado strikes, an individual loss occurs from a fire, flooding from a washing machine or a burst frozen pipe, or theft occurs, it is important that the business can survive and resume normal operations. Disaster preparedness is the key and it can be simple. Fireman's Fund Risk Services consultants recommend these steps to prepare your homebased or small business to cope with any disaster: Safety * Make an evacuation plan and practice with employees and family members. * Change all smoke alarm batteries once a year. * Be sure fire extinguishers are available and in working order. * Keep supplies such as canned food, water, batteries and flashlights easily accessible.

Business * Inventory items and equipment used in the business. Video or photograph the items and keep in a location away from the property. * Pick an alternate location to relocate to temporarily and keep the business running. * Be sure to back up computer records regularly and store off site. * Include provisions to cover continuing

payroll expenses in your financial plan. * Create a communication plan via e-mail, phone and/or text messaging to get a hold of employees in the event of a disaster or loss. * Contact information for all vendors should be kept up to date and accessible, including insurance agent and policy numbers. * Temporary repairs may be necessary and should be documented. Having business insurance is another important way small business owners can prepare their companies to deal with possible disasters. Business insurance usually covers things like business interruption, lost wages, lost revenue and extra expenses such as temporary rental space, equipment and moving expenses. Insurance "Business insurance can mean the difference between staying in business and having to shut down after a loss," says Petersen. It is important for business owners to discuss the emergency plan with employees, and provide training and periodic testing of the plan, according to the Institute for Business & Home Safety. Employees should be notified any time changes are made and a current copy of the plan should be kept where employees can refer to it easily. Protect your business by carrying proper limits of liability insurance. Homeowner insurance won't cover business liability losses. Business insurance is separate from personal insurance. Worker's compensation, employer professional liability, libel and slander coverages, etc. must be considered to protect the business owner in case of lawsuits. Automobiles that are used for business and may be driven by employees in the course of employment require a separate commercial auto insurance policy. Insurance agents are usually small business owners themselves and offer great advice to their fellow small business owners. They are local and knowledgeable of the resources in the community. Protecting your business investment is key to its survival and prosperity. Take time to plan ahead and avoid stress later.

Caltrain Faces $30M Budget Shortfall and Drastic Service Cuts

s Caltrain begins its budget process it faces a $30 million deficit and the prospect of drastic cuts to its serv-

ice.

Under the current budget scenario, cuts could be as severe as a reduction in service to 48 trains that would operate only during the weekday commute. All other service would be eliminated including: weekday service outside the commute peak, weekend service and service south of the San Jose Diridon station. The schedule also would require the suspension of service at up to seven stations. Caltrain is the only Bay Area transit system without a permanent, dedicated funding source such as a sales tax. Instead the railroad has relied on contributions from its three partner agencies - the City and County of San Francisco, the San Mateo County Transit District and the Santa Clara Valley Transportation Authority – to balance its budget. In Fiscal Year 2011, passenger fares make up around 44 percent of the operating budget and contributions from the partner agencies make up 34 percent. “We are not saying that this is what we are going to do, or where we are going to end up,” said Executive Officer for Public Affairs Mark

Simon. “But this is where we are starting.” Caltrain currently operates 86 weekday trains, including 22 express trains, with an average ridership of 40,000. Saturday service includes 36 local trains and four express trains; Sunday service includes 32 local trains and four express trains. Over the last few years, Caltrain has made aggressive efforts to reduce costs and maintain service. For the last three fiscal years, salaries have been frozen. Employees will have taken a total of 17 furlough days from FY09 through FY11. Jan. 1, four weekday trains during the midday were eliminated and fares were increased 25 cents for each zone. In an effort to generate additional revenue, a pilot program for weekend Baby Bullet service was introduced. In 2011, Caltrain administrative staff costs make up only 6.4 percent of its operating budget, below the rate at Bay Area and other comparable commuter rail agencies. SamTrans is expected to reduce its annual contribution to Caltrain by approximately $4.7 million. If the other partners follow suit, the budget shortfall is expected to be $30 million. At its Feb. 3 meeting, the Peninsula Corridor Joint Powers Board, which owns and operates Caltrain, will be asked to call for two public hear-

ings, one on the proposed service changes and one to declare a fiscal emergency. Pérez fue una de los cinco estudiantes que testificaron en la segunda vista regional de la Comisión sobre los Derechos Legales y Responsa-

bilidades de los Hispanos de la American Bar Association (Colegio de Abogados de los Estados Unidos) que tuvo lugar el jueves en San Francisco. Pérez dijo que sus planes futuros incluyen cursar estudios para convertirse en abogada. Dean, quien es una estadounidense de primera generación y cuyos padres emigraron legalmente, habló de la necesidad de que los estudiantes de bajos ingresos encuentren recursos adicionales que les permitan hacer realidad sus sueños de tener una carrera universitaria. “Con frecuencia los latinos se ven obligados a escoger entre la pasión y el sentido práctico” cuando se trata de permanecer en el college o sobrevivir”, señaló Dean. Noe Rivas, un estudiante senior, dijo que sus deseos de convertirse en médico lo impulsaron a dejar su familia en El Salvador y venir a los Estados Unidos — solo y a la edad de 15 años. El viaje le tomó dos meses con paradas durante el mismo para trabajar y ganar algún dinero. Se decidió a emprender este viaje porque de acuerdo con sus palabras: “En El Salvador el gobierno no podía proveerme una educación superior”. an Jose, California— Local high school seniors attending Cash for College student financial aid workshops are eligible for a raffled $1,000 scholarship. The California Student Opportunity and Access Program (Cal-SOAP) of San Jose, in collaboration with local colleges and school districts, will host a series of 17 Cash for College workshops from January to February 2011 throughout the San Jose area. High school seniors and college students are encourage to attend the workshops in order to receive FREE one-on-one assistance with the Free Application for Federal Student Aid (FAFSA). All high school seniors who attend are entered into a raffle for a $1,000 scholarship (more than one scholarship may be raffled per workshop), provided by the California Student Aid Commission. Other prizes will also be available. Last year, 1,197 parents and students from 40 high schools participated in one of the 14 workshops held across the San Jose. Eighty percent of the students completed their FAFSA onsite. Eighteen $1,000 scholarships were awarded and there was a 49% increase in attendance from the previous year. Scholarship lists and other financial literacy resources were also

provided. The goal is to increase the Cash For College workshop attendance in order to increase the number of financial aid recipients, considering that the state grant, known as CalGrant, alone can total an extra $11,124 in free Cash for College. Downtown College Prep releases data on college persistence and graduation rates

anuary.- Downtown College Prep has released its first- ever “College Success Report Card,” measuring high school students’ rates of college eligibility, enrollment, persistence, and graduation. The report is believed to be the first of its kind produced by a K-12 organization. Nationwide, only 10% of low-income students graduate from college in 6 years compared to 77% for high-income students. DCP graduates—low-income Latino students—complete college at 5x the rate of their peers. “K-12 education has the responsibility to prepare low-income students of color for college success and colleges have the responsibility to build a path to degree attainment that is responsive to the unique needs of first-genera-

tion college students,” says DCP co- founder and executive director, Jennifer Andaluz. Downtown College Prep’s mission is to prepare underachieving students, who will be the first in their family to go to college, to thrive at four-year universities. The school measures its success on whether students graduate from college. DCP was the first charter high school in Silicon Valley and is one of the few schools in California to focus explicitly on college success for low-achieving urban students. DCP has graduated nearly 400 students in seven graduating classes. DCP opened its second school in the north San Jose community of Alviso in August 2008. reporte de tráfico, el pronóstico del tiempo y entrevistas de gran interés son los temas que a diario se transmiten con la presencia de un equipo de profesionales en el periodismo.

“Al Despertar” se ha convertido en el único programa de televisión local que se transmite en directo y que se repite a las 7:00 am en su segundo horario por Telefutura KFSF 66.

En esta segunda parte se actualizan las noticias, las carreteras, entrevistados, consejos e incluso entrevistas a artistas de nuestro medio local y nacional. Los segmentos son ágiles, breves y precisos. A este equipo se suman una serie de especialistas tanto en la rama de inmigración, psicología, educación, finanzas, astrología entre otros. Don't Turn a Deaf Ear to Safe Ear Cleaning

“Ofiuco” el nuevo signo del zodiaco

ran conmoción está causando dentro de la comunidad astrológica la aparición de un nuevo signo zodiacal. Aparentemente “Ofiuco” es el signo número 13, un signo que supuestamente fue ignorado por los astrólogos desde muy tempranas épocas. Parece ser que el Sol orbita además de las doce constelaciones de la Vía Láctea, en otra constelación conocida como “Ophiuchus El Serpentario”, se cree que debe ser tomado en cuenta el tránsito del Sol por la Eclíptica entre el 30 de noviembre y el 17 de diciembre. Esta situación viene a cambiar por completo los designios y pronósticos astrológicos a los que ya estamos acostumbrados, pues casi la gran mayoría ya no perteneceríamos a nuestro signo habitual sino al signo anterior o al posterior. Toda mi vida me he sentido orgulloso de ser nativo del signo Escorpión opina Walter Mendoza, pero parece ser que con la nueva configuración astral, ahora resulta que soy del signo Virgo. ¿¿¿What??? El emblema tradicional de la medicina es el mismo símbolo de “Ofiuco’. Ahora según esta teoría los signos del zodiaco no tendrán la misma duración, la primavera no dará inicio en marzo y todos los libros de astrología y los horóscopos deberán ser reescritos y configurados de una manera diferente. Con eso de que Plutón ya no es un planeta y Ofiuco es el nuevo signo zodiacal, la astrología está siendo remecida desde sus cimientos más profundos. A continuación la configuración y nuevas fechas de los ahora supuestos 13 signos del zodiaco: Aries- del 21 de abril al 13 de mayo Tauro- del 14 de mayo al 24 de junio Géminis-del 25 de junio al 20 de julio Cáncer- del 21 de julio al 19 de agosto Leo-del 20 de agosto al 14 de septiembre Virgo- del 15 de septiembre al 31 de octubre Libra- del 1 de noviembre al 21 de noviembre Escorpión del 22 de noviembre al 29 de noviembre Ofiuco del 30 de noviembre al 17 de diciembre Sagitario del 18 de diciembre al 19 de enero Capricornio del 20 de enero al 15 de febrero Acuario del 16 de febrero al 11 de marzo Piscis del 12 de marzo al 20 de abril Bastante confusa la situación que hoy enfrenta la astrología con los últimos descubrimientos, sin embargo, la última palabra no ha sido dicha y estoy casi convencido que los horóscopos, las cartas natales y los pronósticos astrológicos mantendrán su mismo formato, el mismo patrón que se ha venido utilizando desde hace varios milenios. Por nuestra parte el horóscopo mensual de EO mantendrá el mismo patrón con el que lo hemos venido realizando. Tendrán que realizarse innumerables estudios al respecto para que el signo “Ofiuco” se decrete oficialmente como el signo 13 del zodiaco, el signo de la nueva era.
