La dura prueba de Sotomayor

U

na semana de audiencias, preguntas y críticas le llueve a la juez Sonia Sotomayor. El Comité Judicial del Senado realizó la audiencia de confirmación de la juez Sonia Sotomayor como magistrada de la Suprema Corte de Justicia de Estados Unidos ante críticas y elogios de ambos partidas. Sotomayor, de 55 años y origen puertorriqueño es evaluada para ver si califica para servir al más alto tribunal de la nación. Demócratas y republicanos discrepan sobre Sotomayor Senadores demócratas y republicanos mostraron sus diferencias con respecto a las calificaciones de la juez Sonia Sotomayor, al comenzar las audiencias para su confirmación como magistrada de la Suprema Corte de Justicia de Estados Unidos. “No tenemos que especular sobre la clase de magistrada que será, porque hemos visto la clase de juez que ha sido”, dijo el presidente del Comité Judicial del Senado, el demócrata Patrick Leahy, quien destacó la trayectoria de Sotomayor como juez federal apelaciones. “Ella ha sido una juez en la que todos los estadunidenses podemos confiar. Ha sido una juez para todos los estadunidenses. Será una juez para todos los estadunidenses”, apuntó Leahy, al recordar que Sotomayor fue nominada a cortes federales por los presidentes George H.W. Bush y William Clinton. La juez Sonia Sotomayor dijo que su filosofía judicial es la “fidelidad a la ley” en su discurso inicial en una audiencia ante el Comité Judicial del Senado que analiza su confirmación como magistrada de la Suprema Corte de Estados Unidos. “En el mes pasado, muchos senadores me han preguntado sobre mi filosofía judicial. Es simple: fidelidad a la ley”, anotó Sotomayor, de origen puertorriqueño, quien en caso de ser confirmada por el pleno del Senado se convertiría en la primera hispana en el máximo tribunal. “La tarea de un juez no es hacer la ley, sino aplicar la ley”, apuntó Sotomayor, quien indicó que su trayectoria en tribunales federales refleja su “compromiso riguroso” en interpretar la Constitución y las leyes “de acuerdo con sus términos” y con la intención del Congreso. “Espero en los próximos días responder a sus preguntas, que los estadounidenses conozcan más acerca de mí y ser parte de un proceso que refleja la grandeza de nuestra Constitución de nuestro país”, subrayó la juez.

oday many need to understand the social safety net which contains many entitlements. The term “entitlement” is defined as something to which an individual has a right or a claim to receive. An individual may be eligible to receive assistance in the form of food stamps. Federal food stamps are an entitlement funded through the Department of Agriculture and a few years back could be accessed through a local program administered by CET. Food stamps are accepted as cash at local food stores. Another example is the social security check received monthly by many retired elderly. Employers and employees both contribute employment taxes for many years. Those taxes end up being administered by the Social Security Administration. Periodically, analysts reveal that the SSA reserve fund does not have sufficient money to meet all of its future obligations. Supplemental Security Income (SSI) is another entitlement. Jobless low income parents with minor children (under 18) and even single adults can receive support checks as an entitlement. This Temporary Assistance for Needy Families (TANF, called CalWORKs in California) replaced Aid to Families with Dependent Children (AFDC) as part of the Personal Responsibility Act of 1996. This “ended welfare as we knew it” because of the required work participation requirements, the 5-year lifetime limit for receiving welfare, and the disqualification of legal immigrants. State Disability Insurance (SDI) deductions from salaries & wages paid go into a reserve fund used to rehabilitate seriously injured workers. This is another entitlement that many pay and forget. There are also unemployment benefits, an entitlement designed to assist the unemployed. We expect home entitlements such as Section 8 vouchers to subsidize our housing and make it affordable for the lowincome. We expect K-12 education entitlements to pay for the education of our children, including special education services mandated for students with special needs. We expect medical entitlements when we need preventative or catastrophic care and cannot afford the costs-that is why the national campaign for universal health care deepened this past week.

os pasados días fueron como una montaña rusa de desarrollos migratorios positivos y negativos: algunos ce lebrados y otros cuestionados, pero la pregunta que muchos nos hacemos es ¿qué pasó? ¿Dónde está el cambio? ¿Por qué se sigue echando mano de las mismas tácticas baratas de pretender que están haciendo algo aunque ese algo no solucione el problema de fondo? La administración de Barack Obama primero anunció que rescindió de la regla de las cartas de discrepancia que se envían a empresas cuando los datos de un empleado no coinciden con los del Seguro Social. Pero al mismo tiempo anunció que reforzará el uso del programa E-Verify, que se basa en datos del Seguro Social para determinar la elegibilidad de los trabajadores. Grupos de derechos civiles y pro inmigrantes han denunciado el programa porque el banco de datos está lleno de errores y porque puede prestarse a prácticas discriminatorias y a que muchos ciudadanos y residentes legales pierdan sus trabajos injustamente. Pero ahora el gobierno dice que las empresas con contratos fe derales tienen que usar el programa. Después vino la ola de enmiendas al plan de gastos del Departamento de Seguridad Interna (DHS), sometidas por republicanos del Senado, pero aprobadas con apoyo demócrata, entre ellas, una para completar las 700 millas de barda en la frontera con México, y otra para que el programa E-Verify se haga permanente. Y para cerrar la semana con broche de oro, el DHS anunció el reforzamiento del desacreditado programa 287(g) que incluso jefes de policía han denunciado por sus efectos nefastos sobre individuos y comunidades y por afectar la forma en que ellos conducen sus labores al generar la desconfianza de la comunidad en las autoridades. La Sección 287(g) básicamente permite que policías locales actúen como agentes de inmigración. La administración dice que las 66 jurisdicciones que lo aplican y las 11 nuevas jurisdicciones que lo implementarán deberán regirse por nuevas reglas y no usarlo indiscriminadamente para determinar la situación legal de una persona, sino que deberá emplearse sólo contra criminales que cometan delitos graves. ¿Funcionará? Que le pregunten a la comunidad hispana de Arizona donde hispanos ciudadanos, residentes, legales e indocumentados han sentido de primera mano los efectos de los perfiles raciales cuando el programa se ha aplicado al estilo del alguacil Joe Arpaio. Siempre se argumentará que para ganar votos en el público y por ende en el Congreso se necesitan estas medidas de mano dura. Pero raya en lo absurdo que se quieran perpetuar medidas que ya han demostrado su inefectividad y que no solucionan el problema de más de 12 millones de indocumentados en el país. Pueden aplicar todos los E-Verify del mundo y seguirán habiendo millones de indocumentados entre nosotros. Ojo. Nadie está abogando para que no se implementen las leyes, pero debería hacerse de manera inteligente y no ampliando un programa que hasta la Police Foundation catalogó de pro blemático a diversos niveles. Nunca he sido persona de impresionarme con promesas de políticos y de confiar en que algún partido demuestre de una vez y por todas el coraje de agarrar al toro por los cuernos y de enfrentar este asunto sin tener que recurrir a medidas mediocres o a llamar indocumentados “ilegales”, o a ponderar una potencial tarjeta nacional de identidad. Varios grupos pro inmigrantes siguen dando a la administración Obama y al Congreso de mayoría demócrata el beneficio de la duda sobre sus buenas intenciones en el frente migratorio. The Veteran’s Administration deals with entitlements to veterans who are disabled physically. Lately, assistance has been provided to veterans with post-traumatic stress disorder (PTST). While many individuals grow up receiving entitlements as part of our health and human service safety nets, concerned elected officials and agency administrators at both the federal and particularly the state level are struggling with the budget impacts. The concern is not only the relatively high or growing cost of certain benefits as the recession deepens, but also the impacts of possible state reductions of key safety net programs such as CalWORKs, MediCal, and Healthy Kids. These reductions will dramatically undermine the quality of life of the poor in our State. The reality being experienced by all today is the result of a failed economic system. Revenues projected have not been realized. Sales taxes, license fees, property taxes, and all sorts of income taxes are simply not at the level previously generated during “good economic times” of the recent past, and it is questionable that the “good times” will roll again. In other words, the economy and our state and federal safety net programs are in a deep funk. The expanding economy that “lifts all boats” is now a sinking economy that is sinking the boats of the poor. What has been forgotten is that entitlements are a good thing that enable society to help the vulnerable and needy. It is very low income persons and families who rely on entitlements and who are most affected by funding shortfalls for services provided by social services, mental health agencies, health care systems, and public education. Policy makers are now telling the public that they can no longer provide services to those who have been qualifying legal immigrants and to other vulnerable populations. Does this concern you? Today, all individuals would be well advised to learn about all entitlements and their related eligibility requirements. Then learn to monitor those entitlement systems. This is how you may prevent those reserve funds from being reallocated to other pressing needs by misguided policy decisions. Do you really care enough to make an elected official or agency executive accountable? More importantly, do you know how to access entitlements when needed? Δ

Annual Backpack Drive San Jose, CA. ven though school graduations occurred just a short time ago, The Sacred Heart Community Service is already helping prepare students to succeed in the coming school year with their annual Pack-a-Back program. This community effort aims to provide 1,500 needy children with backpacks filled with school supplies making certain they receive a successful send-off to the 2009 - 2010 academic year. Sacred Heart Community Service seeks to unite the community to create a lasting impact on poverty and education. “Education allows children the chance to rise above economic barriers and Sacred Heart is offering the community the opportunity to come together and invest in their success,” noted Sacred Heart Community Service Executive Director Poncho J. Guevara. School Supplies Drive Each summer, Sacred Heart puts out the call to the entire community to donate much needed school supplies and backpacks for

Working with churches, synagogues, local retailers and more, Sacred Heart’s goal this year is to raise enough to provide 1,500 needy students with backpacks filled with pencils, notebooks and even a voucher to purchase a new pair of shoes in time to successfully start the school year. SJ airport prepares to open new terminal

T

he activation of the first six gates of the new Terminal B Concourse later this month will mark a major milestone for the creation of a modern, more efficient, international gateway for Silicon Valley. Southwest Airlines will start using the first six of twelve gates in the Terminal B Concourse until the new facility is completed next summer. Gates 18 to 22 have been activated and Gate 17 will be activated in early August. During the interim, Southwest passengers will continue to check in at Terminal A and claim their baggage at the carousels in the Terminal A garage. This will continue until we shift all their operations to Terminal B, currently scheduled for June 2010. During this time, sections of the concourse will be closed off from time to time to allow con-

struction crews to do their work. In addition to opening the new gates, the Airport will also open the first of its restaurants and shops in the new building with the launch of “The Sharks Cage,� by HMS Host. The 380,000-square-foot, $342 million Terminal B Concourse is the first major component of the airport’s overall terminal area improvement program when construction started in 2004. At the end of construction, there will be a total of twelve commercial aircraft gates with waiting lounges, free Wi-Fi and power outlets for laptops, and new shops and restaurants that will enhance passenger experience. The buildings also have been designed and built to achieve environmental sustainability goals.

T

he Mexican Heritage Plaza is currently going through a transition. The consensus vision is that the Plaza should be a community arts and cultural center, and the City Council has approved a process to create a new, sustainable business plan for the plaza reflecting that vision. A 13-member steering committee has been put together to create a business model that will guide operations at the plaza during the transition period. The committee is made up of a broad range of stakeholders, who held their first meeting on July 14, at the plaza. “Everyone wants to make the best use of this space,” said Laurie MacDougall, facilitator at the Mexican Heritage Plaza. “We want to focus on the future.” The plaza is located at the corner of Alum Rock and King in San José, in the heart of the area where Mexican Americans settled in San Jose in the mid-19th century. The site formerly housed a grocery store that was the target of one of the first boycotts for farm workers’ rights organized by César Chavez. The plaza features a theater, an outdoor square and gardens built in the architectural style of a traditional Mexican plaza. “The theatre is state of the art and goes through all sorts of tests all the time,” said Alex Corona, Mexican Heritage Plaza Facility Manager. “Up to 530 people can fill this theatre.” There is also a dance pavilion and two classrooms. “The dance classes are held by Los Lupeños dance group, in the Gallery/Rehearsal space,” said Elisa Echeverria, Mexican Heritage Plaza Transition Manager. “The classrooms are used on a week to week basis depending on who is renting these spaces.” Art is present throughout the gallery. Echeverria said that the Mexican Heritage Plaza is in the process of confirming a visiting exhibition by the Smithsonian Institute on the Bracero Program. “The plaza has had a longstanding relationship with the Smithsonian and so the City wants to work with them to bring this relevant exhibition to the plaza,” Echeverria said. The Mexican Heritage Plaza hosts plays, other performances, community events, corporate meetings, weddings, quinceañeras, and more. AN JOSE, CA. - Only 37 percent of Santa Clara County 8th graders meet California’s standard for Algebra 1 proficiency. Students who don’t master Algebra in the 8th grade historically don’t perform well in high school math, which in turn reduces their chances for success in college. To address this problem, SVEF created an innovative summer math program called “Stepping Up to Algebra.” The program is taking place in seven school districts across Santa Clara County, and benefits underserved and underperforming students who have completed 7th grade to improve their understanding and love of math so they can pass the California Algebra I test by the end of 8th grade. Last year student scores rose more than 20 percent between pre-testing and post-testing. Students also commented in post-class attitudinal surveys about losing their fear of math and successfully grasping algebra concepts. Much of this can be attributed to the innovative approach to teaching, which emphasizes fun, hands-on learning, and encourages students to collaborate in groups, sitting cross-legged on the floor to solve problems together. This year, Silicon Valley Education Foundation is sponsoring nearly 600 7th grade students. Funded by sponsors from across Silicon Valley, the program gives students an experience they otherwise would not be able to have. In addition, employees volunteer as classroom mentors and act as role models by explaining the importance of math in the real world. “Kids lose ground during the summer,” says Muhammed Chaudhry, CEO of SVEF. “Our program addresses this issue head on.” We want to ensure students do not lose ground, but actually get ahead.” The seven school districts participating are Alum Rock, Berryessa, Franklin McKinley, Milpitas, Oak Grove, Orchard and Sunnyvale. Schwarzenegger Urges Californians to Prepare for Hot Weather

G

overnor Arnold Schwarzenegger issued the following statement to remind Californians to take precautions and prepare for increased temperatures through the week: “This week’s rising temperatures should remind everyone to prepare for California’s summer heat waves. By following simple steps such as drinking an adequate amount of water, staying indoors during the hottest times of the day and pacing yourself when outside, we can all keep cool and safely enjoy the outdoors during hot weather,” said Governor Schwarzenegger. “I have directed my Administration to ensure that the state stands ready to assist local governments in the event this hot weather continues.” Californians should use the following tips to stay cool: Increase your fluid intake; especially water, regardless of your activity level. Avoid alcohol and caffeinated beverages such as coffee, soda and tea. If you or someone you know is feeling ill from the heat removes them from the heat immediately, offer water and seek medical help or call 911. Limit outdoor activity to morning and evening hours. Check on neighbors, family members and pets to ensure the heat is not harming them. Turn on air conditioning, swamp coolers, portable or ceiling fans to help keep rooms cooler. Visit malls, theaters and other public places that are airconditioned if a person doesn’t have his or her own air conditioning. To reduce the risk of heat illness for those working outdoors, drink plenty of water (at least one quart per hour) and take necessary breaks in the shade for at least five minutes when a preventative recovery period is needed. Employers must also ensure all employees are trained about heat illness prevention before they begin working.∆

nigo Lopez, Herman Gallegos and Adriana Garcia Cabrera may not be familiar names to many Latinos in San Jose. They are not as famous as people such as Cesar Chavez and East San Jose native and Super Bowl winning Quarterback Jim Plunkett. But like Chavez and Plunkett, they too have made a significant impact on the city of San Jose. They, along with several others are featured in a new book, “Mexicans in San Jose.” It is a book that consists of several images of San Jose since Jose Joaquin Moraga founded it in 1777. Put together by Nannette Regua and Arturo Villarreal. “Arturo and I felt that there was a need to document the history of Mexicans in San José,” Regua said. “We got the idea after seeing a similar book by our publisher, Arcadia Publishing, Filipinos in Stockton. That got me thinking about creating a book on Mexicans in San José. I was able to persuade Arturo to join me in the journey of writing this book and collecting photographs.” The images were collected from local colleges and institutions. Community members also contributed to the project. “We solicited the San José community members for photos,” Regua said. “We were welcomed to businesses and homes of the community in which the members opened up their family photo albums and provided pictures to us.” The book is divided into eight chapters that represent different eras of San Jose’s history. These chapters include: The Early Years, East San Jose, Chicano and Youth Movements, Religion and Family, and Arts and Entertainment. The images include an 1806 painting of Ohlone dancers at Mission San Jose, an 1843 image of St. Joseph’s Cathedral (located on the corner of Market and San Fer-

nando Streets), and documents from the late 1700s and early 1800s outlining the city’s streets and development plans. There also pictures of community events such as Cinco de Mayo, protests and sporting events. “We were given nine months to complete this project,” Regua said. “It took a year from the initial discussion stages with the publisher until the book’s release.” There are over 5,000 publications of the “Images of America” series. Four other books are about Mexicans. “This book is truly a pioneering project as it helps fill a void in the national awareness of Mexicans in the United States,” Regua said. “Mexicans in San Jose,” $21.99, Arcadia Publishing, is available at local retailers, online bookstores or through Arcadia Publishing at www.arcadiapublishing.com or 1(888) 313-2665.

El concierto, que se realiza en memoria del líder campesino y de derechos civiles de ascendencia mexicana César Chávez, tendrá como invitados a Carlos Santana, Los Lobos y Ronstadt, quien además funge como directora artística del encuentro musical. La 18 edición del Festival del Mariachi y la Herencia Mexicana de San José (San Jose International Mariachi Festival) ofrecerá en septiembre próximo una semana de música y eventos e ducativos que atraen a unas 50 mil personas. Hijos de indocumentados sufren de tensiones y miedos

L

as personas indocumentadas viven en un mundo de tinieblas lleno de miedos y tensión -miedos de deportación y estrés causado por la falta de recursos económicos, lingüísticos y educacionales. Por supuesto, si estas personas son padres de familia, sus preocupaciones afectan a sus hijos. Un nuevo estudio de UCLA examina las inquietudes acerca del desarrollo, aprendizaje y comportamiento de niños pequeños de origen mexicano e identifica si estas preocupaciones varían dependiendo del estado legal o de ciudadanía de los padres. El estudio aparece en la edición de julioagosto del diario de Academic Pediatrics y muestra que de acuerdo a los padres, los niños mexicanos cuyos padres son indocumentados corren un riesgo mas alto de tener problemas de desarrollo que niños latinos o no latinos cuyos padres residen en el país legalmente o que son ciudadanos estadounidenses. Añadió que existe la preocupación de que “el sector de cuidado de salud podría pasar por alto un número significante de niños cuyos padres son indocumentados con riesgos de problemas de desarrollo”. Lo que es menos claro, dicen los autores es lo que está causando esta preocupación entre los padres. Pocos estudios han examinado el impacto que la inmigración tiene en el desarrollo y comportamiento de los niños. Gente Morena By Osvaldo Castillo - El Observador

L

a Colectiva is a San Jose based band whose cultural background spans all across Latin America. Band members can trace their roots to Mexico, Peru, Puerto Rico, El Salvador and Nicaragua. After playing together for over five years and with the release of their first album “Gente Morena,” the band is ready to embark into the next stage of its career. The band is hoping to get things started with a performance at Music in the Park. Federico Zuniga (Bass) and Omar Gutierrez (Vocals) sat down with El Observador for this interview. Q: What do you enjoy about creating music? A: Omar: I feel that there are some things that we are born with. Music is one of them. It is a great way to communicate and to meet new people. Maybe new friends will be made. Federico: The group has found an appreciation for roots music. Before we used to listen to mainstream music. As we grew older we began to get a better understanding of roots. Music was part of that discovery. We wanted to create music that stuck to traditional format. We also wanted to present new ideas. Q: What are some of your influences? A: Omar: I am influenced by all sorts of Latin American music and musicians. These include Artemio Posadas, Lalo Izquierdo and Los Camperos de Valles. All of whom we met. Federico: We are also influenced by life in general.

That may be a difficulty we face or a beautiful girl walking down the street. Q: Where else have you played? A: Federico: We’ve played all over California in Berkeley, San Francisco, Sacramento, San Jose and Los Angeles. We will also be doing a tour in Mexico. Q: How do you feel about where the band is at now? A: Omar: We are very excited. We were given an opportunity to play at Music in the Park, which is very exciting because it gives us a chance to give back to the people of San Jose. Federico: We are also excited about our first CD. It was independently done and produced in San Jose and Union City. Q: What’s next? A: Federico: We well continue to keep doing what we are doing. That’s creating music and playing shows. Joining Zuniga and Gutierrez are Eric Molina (Caja Vallenata), Juan Carlos Angulo (Percussion), Ivan Flores (Accordion), Pedro Rosales (Vocals), Jose Leyva (Timbales), Ali Luna (Congas) and Oscar Martinez (Bongo). Freud, padre de la Sicología moderna Por Mario Jiménez Castillo El Observador

S

igmund Freud (18561939), médico austriaco, fue quien desarrolló las teorías centrales para el psicoanálisis, la sicología de la sexualidad, y la interpretación de los sueños. Aunque sus teorías publicadas a fines del XIX fueron muy controversiales durante su época, la aceptación de su trabajo se reconoció a finales de su vida. Su contribución más sobresaliente en cuanto al mundo onírico se refiere a la conexión entre la abe rración de la conducta humana y la mente inconsciente. Los libros y tratados de Freud fueron prohibidos y muchos de ellos quemados por Hitler antes que comenzara la segunda guerra mundial, ya que el régimen nazi le consideraba un mal elemento para la sociedad por ser judío y por la fama que tenía de recetarle cocaína a sus pacientes. Entonces Freud no tuvo más remedio que exiliarse junto a su familia en Inglaterra. En sus observaciones, Freud encontró pruebas claras de la represión y resistencia del mecanismo mental. Él describió la represión como un artificio de defensa inconsciente para hacer inaccesible a la mente consciente el recuerdo de eventos dolorosos o amenazantes. Definió la resistencia también como una defensa inconsciente para prevenir la ansiedad emocional que causa el conocimiento de experiencias

El trabajo más sobresaliente de Freud, “La Interpretación de los Sueños”, fue publicado en 1899, pero fechado de 1900 porque él quería entregarle su obra maestra al nuevo siglo. En esta obra él analiza muchos de sus sueños y los de sus pacientes, registrados todos en el período de análisis y auto análisis que dio inicio en 1896. Según Freud, la mente que sueña está dominada por un proceso diferente del que rige la vigilia. Y dice que ese “proceso primario” se distingue por sus mecanismos más primitivos, sus rápidos cambios de energía y emociones, y su contenido sexual y agresivo derivado de la infancia.
