Gov. Schwarzenegger Declares State of Emergency Due to Budget Impasse

F

ollowing the legislature’s inability to pass a comprehensive solution to solve California’s entire $24.3 billion deficit, Governor Arnold Schwarzenegger today

proclaimed a fiscal emergency and called a Proposition 58 legislative special session to address this emergency. Additionally, the Governor exercised his executive authority to save cash for vital state func-

tions and services by ordering three furlough days every month. The Governor followed through on his promise to veto any budget bills sent to him by the legislature that failed to solve for the entire deficit. Furthermore, the Governor today announced that he will not sign any legislation until a solution for the entire budget deficit is in place. Beginning July 10, DPA will direct state offices to be closed the first, second and third Friday of every month through June 2010. This will require state employees to take unpaid furloughs on those Fridays. For employees who work in critical positions that cannot be furloughed on this schedule, the furlough days can be used at another time.

All state hospitals, prisons and other 24hour care facilities will maintain normal hours of operation, as will the California Highway Patrol and CAL FIRE fire stations. A limited number of state offices also will remain open on these “furlough Fridays.” Under Proposition 58, the legislature has 45 days to pass and send a bill or bills to the Governor’s desk addressing the state’s budget crisis. If the 45 days pass and the legislature has not passed a bill or bills to address the problem, they cannot adjourn or act on other bills until the state’s fiscal emergency is addressed. The Controller has said he will begin issuing IOUs instead of payments to state vendors tomorrow. Just months after the Governor and

state lawmakers came together in a bipartisan effort to solve a $42 billion deficit, the worldwide economic slowdown produced a new multi-billion dollar deficit. To bring the budget back into balance, the Governor unveiled his May Revision budget proposal on May 14, 2009 < including a mix of cuts, borrowing and other measures to solve the deficit. He further urged the legislature to take immediate action on the state’s fiscal crisis when he addressed a joint session of the legislature on June 2, 2009 noting that even though the state would be forced to take unprecedented actions to bring the budget back into balance - the deficit would only get larger and the decisions more difficult as more time passed.

America’s Grotesque Legacy of Torture

he Inauguration of President Barack Obama seemed like a new day in America— a rebirth of democracy and the rule of law--after the eight-year Bush-Cheney reign of corruption, ineptitude and war based on faked intelligence. The reign began with Cheney’s still secret Energy Task Force plan that reaped a tripling cost of energy, followed by the vacationing Bush napping through CIA warning that Al Qaida planned to attack our nation. The brutal wakeup on September 11 was immediately recognized by Bush-Cheney team as the “Second Pearl Harbor” required for their “Project for a New American Century” to control the Middle East, ensuring cheap petroleum to U.S. petro corporations throughout the next century. The hopeful promises by candidate Obama included: 1. Ending the war in Iraq, 2. Closing Guantanamo and other secret prisons, and. 3. Re-storing justice at the Justice Department. Six months into Obama time in Washington appear to be melting into a diminished businessas-usual, getting along with Congress by going along. In spite of June 30 National Sovereignty Day celebrations in Iraq, declaring complete withdrawal of U.S. troops from most cities in Iraq, more than 130,000 American soldiers and untold mercenaries will remain to support the tenuous peace—paying former insurgents to fight Al Qaeda rather than their own government or our forces, training their army and police, and disbursing untold billions to rebuild this broken country. Our troops may leave most cities, but not our massive bases, and will venture out mostly at night. Certainly, American casualties will continue to arrive at Dover Air Force Base. Meanwhile, the war in Afghanistan spirals further into chaos, as well as in Pakistan, in spite of billions in aid that disappear, only to be accounted for as insurgent weapons captured in both countries, with U.S. manufactured serial numbers. As in all wars, the certain winners are the arms merchants. Guantanamo detainees continue to be abused by Bush era “harsh interrogations,” stubbornly yielding no news of ticking time bombs after an average of five years of water boarding (near drowning), walling (heads thrown against walls), using dogs or insects to intimate, hours of stress positions, extreme cold or heat, or weeks of sleep deprivation, forced nudity, and other inhumane treatment--illegal by U.S. law, United Nations treaties, and in Obama’s words, “American values and traditions.” Individuals, kidnapped and “extraordinarily rendered” to sites in the U.S. military bases or other nations, are kept secret from their families, possibly from their governments, and from the Red Cross. These prisoners are not listed, often are not charged with any specific crime, and certainly without access to legal representation or trail in any open court of law. If we are truly a nation of laws, and not of men, President Obama must restore the quest for justice by our Justice Department. The eight-year Bush-Cheney regime will forever be a despicable era of lawlessness where our Constitution, Bill of Rights guarantees, and laws, including Universal Human Rights and the Geneva Conventions (against torture), which are incorporated by treaty into federal law have been disregarded. The Justice Department must restore the rule of law by investigating this abuse of power, and prosecuting anyone who has broken our laws by ordering, enabling or committing torture. We must cleanse our nation of this Grotesque Legacy of Torture.

A

s this recession’s economic noose tightens, many daily newspapers have stopped publishing because low ad revenues and subscriptions result in not being profitable.

Fewer weekly newspapers have stopped publishing because these publications have sufficient revenues. There is the possibility that a community may not have a community newspaper. What would be the impact on that community? What might emerge to fill the gap? What is known about communities without a newspaper is very limited because every community had a publication of some sort since our nation was founded. Recent internet developments have changed all that. Recent research directed at this possibility has been made available by the Pew Foundation. What follows are some of their research findings: Much information on the internet was first collected and made public by some newspaper reporter who did the investigative research followed by a published report. In our Hispanic community, who would do the investigative reporting needed on such issues as the selection of the Independent Police Auditor, Vehicle Check Point operations by San Jose Police Department, public intoxication arrests, public transit issues, access to health care, social and mental health services, etc.? One finding is that members of Congress who get a lot of newspaper coverage work harder for their constituents than those who don’t. They funnel more money back to their district and testify at more committee hearings. They are also less likely to vote along party lines (i.e., act and vote in a non-partisan manner). Elections require information permitting the comparison of the candidates. A professionally competent investigative reporting staff can collect, organize and present factual information about each candidate so that the voter may choose. This applies to all elections: school boards,water districts, city councils, state officers and assembly members, and other elected officials. What about justice? Who monitors what goes on at the court house? How can we be assured of fair reporting without facts? Citizens need to know much about all issues in order to take a position which influences and shapes public opinion. The influence of a newspaper is related to its ability to present information to an audience of interested and engaged local residents, particularly the opinion makers of a community. With good information and logic, an informed community of opinion makers becomes a center of influence resulting in leadership and public service. The mission of a community weekly publication such as EL OBSERVADOR is the gathering and presentation of information to its readers. This necessarily involves all public affairs in order to present the journalism that matters to the people who care about their community. A lot happens in any community which is of unique local interest. For example, ESUHSD recently proposed elimination of sports as a way to meet the draconian budget levels required. After several months of discussion and activity, the ESUHSD allocated $800,000 to their sports program with an understanding that the community would raise the $1,000,000 needed to fully fund the ESUHSD sports program budget needing an estimated $1.800,000. A coalition of organizations will conduct events that will raise these additional funds. EL OBSERVADOR’s Community Calendar informs all of these scheduled events. Today the most threatened accountability reporting is in those local communities that do not have a newspaper. The community newspaper can act as a megaphone in raising a large outcry. Through a good newspaper, a community can talk to itself about the many issues being faced simultaneously. If the newspaper goes away for any reason, then what goes away is the information and communication infrastructure needed by its leadership. EL OBSERVADOR continues to provide its information service targeting the Latino community? Our web site (www.el-observador.com) already has more than 700,000 visits per month. Much information which does not make it to the printed page is presented on EO’s web site. We are already providing our community with an online newspaper. We practice there the same high standards which result in accurate information and correct attribution resulting in no instances of libel, slander, or defamation of character. We also ask that you provide support to defray the costs of operations (all our employees are Hispanic and most are bilingual and multicultural). Until our online virtual newspaper can earn its way, it does need your involvement and engagement. Encourage your local small businesses to place banner ads on our web site. Encourage professionals (doctors, lawyers, dentists, CPA’s, etc.) to use our site to inform the community about their professional services. A final comment: Have you tried to make a decision about anything without information? Try it. You will find it very frustrating. EL OBSERVADOR is the most read community weekly publication. Learn to use it, support it, and enjoy it. Learn to tell us about things you want to know about. We provide our community with the power of the press. So do not believe anyone who tells you that EL OBSERVADOR is doing nothing for our community . The reality is that this publication does its best to empower and enable you with good information.Δ

Earthquakes Partner with Stanford Blood Center to Host Blood Drive on July 11 at Buck Shaw Stadium

AN JOSE, Calif. - The San Jose Earthquakes announced they have partnered with the Stanford Blood Center for the second year in a row to host a blood drive on Saturday, July 11, when the Quakes take on Toronto FC at Buck Shaw Stadium. The game kicks off at 7:30 p.m. Prior to the game, fans can donate blood at the Stanford Blood Center Blood Mobile, which will be located at the VIP lot by the South Gate entrance of the stadium from 2:30-6:30 p.m. PT. his past June, the San Jose Police Officers Association posted a video on Youtube and on their blog (www.protectsanjose.com) targeting Raj Jayadev, a local community leader and Executive Director of Silicon Valley De-Bug, for speaking out against the highly disproportionate arrest rates by the San Jose Police Department. Many community leaders, activists and members believe the video is false and inflammatory. They held a rally in front of San Jose’s City Hall to express their outrage and concern, and to respond to allegations by the San Jose Police Officers Association that leaders like Jayadev were “threatening” city councilmembers and Mayor Chuck Reed through “street responses.” “The community will not be intimidated,” Jayadev said. “This is a street response. It is peaceful, urgent and a time honored mechanism for change.” Community members are also upset over the San Jose Police Officers Association’s Second Chair, George Beattie’s comments against community members, such as Jayadev, as being “thugs” and who engage in “outrageous criminal behavior.” “I believe now is the time for Mayor Reed and the Council to decide just exactly who’s side

they are on,” Beattie wrote on the San Jose Police Officers Association’s website (www.sjpoa.com). “Are they on the side of us, the protectors of the weak and vulnerable? Or are they on the side of the thugs, who attempt to get their way by threatening anyone who opposes them with physical violence.” Jayadev believes this is a false ultimatum of “them or us.” “There is no us verse them, there is only the City of San Jose-made up of civilians, officers, elected officials, immigrants, youth, and families who all want a safe city, accountability and trust.” Jayadev added, “Let me testify that there is not one “thug” among us. We have redefined THUGS as meaning Trust-Builders, Healers, Unites, Generators of Solutions, Street Responders.” Other community leaders at the event included Reverend Jeff Moore III of the National Association for the Advancement of Colored People, and Richard Hobbs, Director of the Services, Immigrant Rights and Education Network. “The San Jose Police Officers Association, produced a video attack against a member of our community, denying a United States citizen’s right to freedom of expression and to consider him to be a threat or a thug goes against or police officers’ sworn duty to serve and to protect his or her community.” Reverend Moore III stated.

Richard Hobbs believes that the high arrest rates of Latinos can lead to immigration issues among the Latino community. “Hidden within the high arrest rate of Latinos is the incredibly important side effect impact on Latino immigrants,” Hobbs said. “City police policies and San Jose PD practices create the basis for untold family break up in mixed status

immigrant families.” The delegation met with councilmembers after the press conference to discuss possible ways to improve the relationship between community and law enforcement in San Jose. vez en una audiencia pública el pasado 30 de junio plantearon una posible salida a la crisis que ahoga California. Parar la pena de muerte y evitarle gastos millonarios al estado. Existen 680 personas en lista de espera para ser ejecutados, 55 son personas de diferentes países 35 mexicanos y 2 salvadoreños.

“¿Cómo es posible despedir a maestros, bomberos, policías, trabajadores del sector salud en vez de continuar con las ejecuciones de pena de muerte en California?”, se pregunta Terry McCaffrey de Amnistía Internacional y representante de California People of Faith. “Los contribuyentes tienen el derecho de saber los costos de estas ejecuciones”, agregó McCaffrey. California puede ahorar un billón de dólares en cinco años suspendiendo la práctica de la pena de muerte en vez de mantener prisioneros. El sistema de la pena de muerte cuesta por año $125 mi llones. De acuerdo a la Comisión de Administración de Justicia de California el costo a California por año es de $137 millones. Si se ponen a los presos más peligrosos en prisión le cuesta 11 millones de dólares. Ahora construir celdas para los presos condenados por pena de muerte costaría a California $400 millones de dólares. Esto es el mismo valor que costaría construir otro locación como San Quentin. Acelerar la pena de muerte costaría mucho más. La Comisión de California concluye que a fin de reducr el tiempo de revision de los casos, el estado tendría que hacer gastos adicionales por el orden de los $100 millones cada año. La intención de los activistas es pedir al gobernador que las sentencias se conviertan en sentencias de vida sin posibilidad de una li bertad condicional y la posibilidad que los presos puedan ser liberados y también que se suspenda las sentencias por pena de muerte por cinco años hasta que el estado se recupere de la crisis fiscal que enfrenta. New Senior Policy Advisor for Public Safety and Neighborhood Outreach

S

AN JOSE - Mayor Chuck Reed announced the appointment of Jose Salcido as Senior Policy Advisor for Public Safety and Neighborhood Outreach. Salcido has served as a Santa Clara County Sheriff since 1977, serving as a Lieutenant since 2002. He currently is Assistant Division Commander over the Jails Administration Division, overseeing an $11 million budget, and has previously managed the Records Division and worked as a Watch Commander overseeing the Patrol Division. He is a past President of the Deputy Sheriffs’ Association of Santa Clara County, the first Latino elected to this position. Born in San Jose, Salcido graduated high school from St. Joseph’s Seminary in Mountain View, originally planning to join the priesthood. He followed an older brother into the public safety field, and obtained an AA degree from San Jose City College in Administration of Justice and a Bachelor of Science Degree in Business Management from San Jose State University. He earned a Masters in Public Administration from San Jose State with a thesis

on “Humanistic Management in Law Enforcement.� Salcido’s community volunteer work includes serving on the board of directors of Sacred Heart Community Services in San Jose and as treasurer of the Hispanic Political Action Committee - Silicon Valley. Salcido will start his new position on July 6.

The contestants submitted essays and the business had to have been operating for one year. Verizon provided an atmosphere where contestants were able to network. At the dinner guest speakers Phil Cisneros, a business counselor, and local realtor Lisa Inzunza, spoke on the importance of technology. Verizon wants to provide the technology to better-run small businesses, and are proud to help the community. The winners received $2,500 for business needs and $2,500 in Verizon products and services.

Comcast has provided additional funding to expand the annual fireworks show and United Site Services is providing the necessary support facilities which will allow the local community to watch the show for free. San Jose State University led the effort to make space available for the community along with Happy Hollow Park & Zoo, History San Jose and Kelley Park to open the entire South Campus area for local citizens to watch the fireworks.
