Por Rosario Vital - El Observador l próximo 4 de agosto se celebrará el Día Nacional de Una Noche Afuera.

Este día es especial para todos los miembros de la comunidad. Aquella noche se invita a cada individuo a conocer a su vecino, la policía sale a socializar y a conversar con su comunidad.

Una tarde para celebrar con carne asada, con música y en algunos lugares hasta con espectáculos locales.

Desde las 6 de la tarde hasta las 10 de la noche los residentes de cada vecindario son invitados a salir de sus casas para conocer a sus vecinos, para platicar con el vecindario en general o para disfrutar de horas La Noche Nacional está diseñada para aumentar la concienciación sobre las drogas y la delincuencia, generar el apoyo y la participación en los esfuerzos anticrimenes locales, fortalecer el espíritu de colaboración de barrio entre la policía y la comunidad. Enviar un mensaje a los criminales haciéndoles saber barrios están organizados y luchan por una comunidad segura

Se ha previsto en esta celebración una serie de actividades en cada barrio. Muchos vecinos van a cerrar sus cuadras, otros cocinarán afuera, habrá helados gratis, carne asadas y otros fiestas familiares informales muy cerca a su barrio.

Estas fiestas no son caras ni a lo grande. Lo más improtante de todo esto es pasar y disfrutar buenos momentos con su vecindario y salir a conocer a sus vecinos Salga salude a su vecino, haga las pases, platiquen de la seguridad de su vecindario y disfrute viendo jugar a los pequeños en este verano. Participando en este acto comunitario usted estará haciendo un alto a los crímenes.

El año pasado en San José se realizaron cerca de 100 eventos a nivel de vecindario A estos eventos oficiales de la policía salieron a conversar con su comunidad. Este año se han inscrito más de 70 vecindarios para celebrar Una Noche en la calle.

Eventos Los vecindarios se reunirán el próximo 4 de agosto. Es mejor que contacte y pregunte a su vecino dónde sera la fiesta de su barrio. El Distrito 2 de el Concejal Ash Karla ha confirmado un evento público en el Silver Leak Park (5790 Southview Dr, San Jose, CA).Los vecinos comerán helados y el Distrito 5 de la Concejal Nora Campos celebra el National Night Out en elEmma Prusch Farm Park(esquinas de Story y King Rd.). El ingreso es libre, habrá feria de recursos, comida y actividades.

Let’s Celebrate National Night Out

n Tuesday, August 4th, neighborhoods throughout San Jose are invited to join forces with thousands of communities nationwide for the 26th Annual National Night Out. National Night Out will involve over 10,000 communities from all 50 States, U.S. Territories, Canadian cities and military bases around the world. In all, over 34 million people are expected to participate in Americas Night Out Against Crime.

National Night Out is designed to: (1) Heighten crime and drug awareness; (2) Generate support for, and participation in local anticrime efforts; (3) Strengthen neighborhood spirit and police/community partnerships; and (4) Send a message to criminals letting them know neighborhoods are organized and fighting back.

From 6 to 10 p.m. on August 4th, residents in neighborhoods throughout San Jose and

across the nation are asked to lock their doors, turn on outside lights and spend an evening outside with neighbors and police. Many neighborhoods throughout San Jose will be hosting a variety of special events such as block parties, cookouts, ice cream socials, barbeques and informal gatherings. National Night Out events don’t have to be big or expensive. The important thing is to spend some time enjoying your neighborhood and getting to know your neighbors. Relax in the front yard, talk with neighbors and watch the kids play. You’ll be supporting crime prevention efforts in San Jose while celebrating your neighborhood.

Last year approximately 100 San Jose neighborhoods showed their support for National Night Out by enjoying an evening with their neighbors and local police officers.

Darkest Day for Californians (Sacramento Calif.-) ”This is the darkest day for Californians as we vote in favor of drastic cuts. The compromise has been made - on the shoulders of college students, poverty-stricken children, the unemployed, disabled, elderly, the sick and the poor. On our worst economic day in California we are still the eighth largest economy in the world and we have decided to abandon the most vulnerable in our society. I cannot in good conscience support this budget.We should have the responsibility of careful analysis on the human and economic costs of cutting $30 billion from education, higher education access, and healthcare for vulnerable populations. We are creating a two-tier system in our society. We should have the responsibility of truly asking ALL of California to share the burden - and this would include closing egregious corporate tax loopholes and asking oil companies to pay their fair share.

Governor Arnold Schwarzenegger signed a $24 billion budget solution that includes $16.1 billion in spending reductions. Humane Race Relations: The Foremost Issue

hile it is unfortunate that Harvard Professor Henry Louis Gates, an African American, and (white) Cambridge Police Sgt. James Crowley had that encounter in the living room of Gates’s home, the event would never have been discussed nationally if President Barack Obama had not made his unfortunate ‘stupid’ comment. What first happened is that a neighbor of Gates saw two men forcing Professor Gates’ front door open. A dutiful Cambridge citizen phoned the police.

Was this neighbor guilty of ‘racial profiling’?

The police 911 tape does not report the race of the two men.

Now it happens that President Obama is a friend of Prof. Gates, so when asked at the end of that press conference about this incident, one can project that the President forgot he was speaking as the first African American President. He revealed his humaneness by slipping into supporting his friend by stating that the Cambridge police acted ‘stupidly’. I was watching this press conference on TV and immediately sensed that the President had ‘misspoken’. The President is an accomplished intellectual who has “Lived while Black” for 48 years and has been accused of being ‘unpresidential’. To his credit, later he apologized for adding to this already emotionally charged situation.

Now recall that these days the main agenda for the Obama Administration is the current Congressional legislative effort on Comprehensive Health Care Reform being debated. This Gates/Crowley encounter immediately distracted the mainstream media from that legislation to this incident being

l conocimiento de los derechos laborales es un tema de suma importancia, especialmente para los migrantes que viven en los Estados Unidos, ya que muchos empleadores se aprovechan de la situación migratoria de sus trabajadores y del poco conocimiento que éstos tienen sobre las leyes que los amparan. Los Consulados de México tienen la obligación de velar porque estos derechos sean respetados, a través de su relación institucional con autoridades, sindicatos, y a través de la red de abogados especialistas en la materia.

Sin duda, hay mucho por hacer para que estos derechos se cumplan. La responsabilidad es compartida entre el empleador que tiene la obligación de respetar la ley, y el trabajador que también debe estar informado y así poder exigir sus derechos.

Lamentablemente demasiados trabajadores aceptan condiciones de trabajo que los perjudican, porque creen que debido a su situación migratoria irregular no tienen esos derechos, o que no pueden pelear por ellos y son víctimas de abusos por parte de los empleadores.

El conocimiento de sus derechos laborales por parte de los trabajadores es un paso esencial para su defensa. A continuación enunciamos algunos de los más importantes: 1. Tienen derecho al salario mínimo que establece el Estado de California, de siete dólares con cincuenta centavos por hora.

2. Después de trabajar una jornada de ocho horas, tienen derecho al pago de horas extras.

Cualquier hora laborada después de una jornada de diez horas, se debe pagar doble.

3. Si se trabaja el séptimo día, toda hora se debe pagar doble.

4. Si trabajan para un contratista, tienen derecho a que se les pague semanalmente.

5. Si los despiden, de inmediato se les debe pagar lo que se les debe. Si renuncian voluntariamente, tienen derecho a que se les pague lo que se les debe, a más tardar tres días después de que dejaron de trabajar.

6. Un lugar de trabajo seguro y sin peligros. Si usted necesita equipo especial para protegerse, el patrón tiene la obligación de proporcionar de manera gratuita a los trabajadores dicho equipo y las herramientas necesarios para desempeñar su trabajo.

7. El patrón debe proveer a los trabajadores de sanitarios limpios en el lugar de trabajo.

8. Los trabajadores tienen derecho a un descanso pagado de diez minutos por cada cuatro horas de trabajo, y por cada cinco horas laboradas, merecen media hora para comer, sin pago.

9. Recibir una indemnización cuando se lastima por un accidente laboral.

characterized as a ‘racial incident’ or a ‘police profiling’ incident. Let me suggest that this highly publicized encounter is a ‘human relations’ incident because the American society needs a more comprehensive perspective that helps it resolve the implicit overtones involved which include racism, police profiling, social class, and authority & power issues. When that policeman entered the living room equipped with a handgun, baton, and possibly a taser, Professor Gates exhibited his ‘implicit bias’ as much as Sgt. Cowley exhibited his ‘police authority’ bias.

Understanding this is very important for the communities of color because they all have experienced these very same issues. Locally, the San Jose Police Department has been documented for awarding Hispanics too many ‘public intoxication’ arrests. The California Department of Corrections (the prison system) presently incarcerates more Hispanics and African American than any other ethnic groups. Santa Clara County jails have too many Hispanic occupants. Keep in mind that inmates never are incarcerated unless arrested by police; convicted by district attorneys who prosecute these individuals in the courts having jurisdiction, tried, found guilty, and a sentence assigned. Does the justice system and process in our nation have an implicit bias? Too many times the force of authority coupled with power disrupts the capacity of those directly involved to appropriately communicate with clarity, humane compassion and understanding.

Do recall that the recent Judge Sonia Sotomayor Supreme Count Senate hearings were an excellent example of these same is-

sues coupled with gender bias. Time and again, Sotomayor’s critics refused to concede the following: That how we think, what we see, how we reason and react are directly related to who we are. And our race, ethnicity, gender, social class and economic status condition some of whom we are.

The issues of prejudice and bias coupled with statistics have contributed to ‘implicit personal biases”. In addition, the issue of ‘racism’ needs clarification through candid open forum discussion by all. Is it possible to discuss this incident in terms of basic human relations that we all can agree with, support and practice? There is a double standard in our society that establishes a class system of dealing with others. So many individuals of color are involved in the service industries (e.g., janitors, hotel maids, farmworkers, etc.) that result in an implicit bias, which many unconsciously accept and use.

It is time that all look into their personal makeup to determine if an implicit bias exists. If it does, one has to become aware enough to deal with it constructively.

The value of this incident is that it placed racism on the table for all to view. We all need to treat others with respect and courtesy. Resolution requires understandable communication coupled with appropriate levels of ethics, morals, and religious convictions. The issue of race relations is always with us, so let’s begin to deal with its mitigation by having a commitment to deal with it as a person, then as a community, and maybe we will get to a national resolution.

La comunidad inmigrantes pide reforma migratoria y espera una respuesta de la Congresista Lofgren.

Plan propuesto de reducción del servicio de transporte público A causa del continuo deterioro de las circunstancias económicas, Santa Clara Valley Transportation Authority (VTA) ha propuesto reducir los servicios de autobús y tranvía.

Del 10 al 13 de agosto de 2009, VTA llevará a cabo reuniones públicas para evaluar el plan propuesto de reducción del servicio de transporte público y obtener los comentarios del público sobre el plan. Retenes dejan sin vehículos a familias

E

l pasado 24 de julio se llevó a cabo otro retén . En esta oportunidad este control tuvo lugar en las esquinas de Aborn Rd y Brigadoon Way. Los resultados indican que se remolcaron 7 vehículos. Sin embargo 15 personas fueron citadas por no tener licencia de conducir. Estas citas son cargos de delitos menores y que para efectos de una posible legalización en este país podrían no cali-

ficar para una reforma migratoria.

En este retén cuatro conductores fueron citados por manejar con licencia suspendida.

De un total de 823 vehículos inspeccionados fueron arrestados dos personas bajo la influencia del alcohol y un arresto fue procesado por la patrulla. Este es el retén 140 que contó con la participación de 2 sargentos y 17 oficiales.

Got Water...For Now

W

ater is a precious resource, which we depend on for survival. However, over consumption for personal, industrial, and agricultural purposes is depleting this natural resource. Less than 1% of Earth’s water is available for human needs, regardless of dry or wet seasons. On March 24th, Santa Clara Valley Water District imposed a mandatory 15% reduction in water use for Santa Clara County after declaring a third year of drought. While we applaud this decision, sustainable measures need to be implemented to make water conservation a viable way of life.

By the year 2020, county water use is expected to increase 1% annually due to population growth in San Jose. Beyond this year, the county will need to draw from groundwater reserves, even during years of normal precipitation, unless permanent water conservation methods are in place. Water conservation, as a way of life, does not demand drastic lifestyle changes. Rather, it calls for meaningful actions at the individual, community, and policy levels.

As individuals, we can replace water-wasting toilets with ultra efficient 1.28 gallon per flush toilets and water our lawns twice weekly in the early morning or evening hours. Contact the Water Conservation Hotline, (408) 2652607, or your local water retailer to inquire

about water conservation programs and rebates.

As a community, we should request that public pools be covered when not in use, minimizing excess water evaporation, and report all significant water losses to the local Water Management District. As citizens, we must engage government to enact policy change requiring all homes to pass water efficiency inspections prior to closing escrow, and ensure all new homes and businesses have ultra low-flow showerheads and toilets. Additionally, the Water Conservation Landscaping Act should be amended to place restrictions on landscaping for new multi-family, commercial, and institutional construction.

Water is our most precious resource. It is crucial to our continued survival that we preserve our remaining supplies by making lasting changes to guarantee its availability. Conservation requires careful, deliberate actions, beginning with our community, our state government, and with each of us. Join us in fighting for our future.

Mayor Sets Example

I

n 2007, San Jose Mayor Chuck Reed released his Green Vision. It is a 15year plan aimed at reducing San Jose’s carbon footprint and boosting the economy through environmental practices.

A year later, San Jose was recognized by the U.S. Department of Energy for its commitment and development of solar technologies.

That same year, Reed made the switch from a traditional gasoline car to his more fuel-efficient Prius.

On Wednesday, July 29, 2009, Mayor Reed continued his commitment for a “greener” San Jose by switching from traditional power sources to clean and renewable energy by installing a Solar Voltaic System in his home.

“It is important to lead by example,” Reed said. “Installing this system makes both environmental and economic sense.”

The mayor will be financing an 18-year plan and hopes to save approximately 80 percent the cost of his electricity bill.

“I put down $1,500 for the installation, which is a fraction of the total cost,” Reed said.

Cinnamon added that the system that the mayor purchase was a standard system that anyone could purchase through different payment plans.

“The system is very inexpensive and over time more people will be able to afford it,” Cinnamon said.

In the past, solar technology was expensive and there were not many supplies to build solar panels.
