arlos Ponce Martínez (45) asumió oficialmente el nuevo cargo como cónsul general de México en San José en reemplazo de David Figueroa Ortega, quien actualmente se desempeña como cónsul general en Los Angeles. A Ponce Martínez le toca representar a unos 665 mil inmigrantes m exicanos r adicados e n c uatro c ondados d e California en la costa del Pacífico: Santa Clara, San Benito, Santa Cruz y Monterey. Antes de llegar a San José fue Director la Procuraduría de la P rotección del Medio Ambiente en el Estado de Puebla, precisamente de donde es originario. Ponce nació en Atlix co, un pequeño lugar de P uebla que aún recuerda con mucha nostalgia. El cónsul es Administrador de Empresas y también ha trabajado como trabajador social par a pr esos en el ár ea de San Antonio, Texas. Allí conoció a su actual esposa Patricia Ponce quien trabajó como enfermera y que r ecientemente ha dejado su trabajo para acompañar a su esposo en su mandato consular. Ponce Martínez como gr an conocedor del medio am biente y las necesidades de pr otección a nuestro ecosistema, no descarta l a posibilidad de promover campañas ecológicas entre sus propios connacionales. Se tiene en mente iniciar trabajos de reforestación en algunos lugares que no se han especificad.

“Vamos a empr ender esta gr an tarea en br eve y les estaremos avisando en dónde plantaremos más árboles”, dijo Ponce Martínez. Sin embargo la principal tarea que tiene en mente es continuar algunas proyectos que impulsó su antecesor, David Figueroa, tales como los consulados móviles que llevan servicios consulares a mexicanos en zonas rurales o con horarios incompatibles a la oficina consular. “Vamos a trabajar próximamente en estudios para determinar en qué otros lugares podemos extender nuestros consulados móviles”, dijo el cónsul entrante. Al margen de estos servicios que posiblemente se amplíen a otras ciudades Ponce será testigo de la renovación de Consejeros del IME. El IME (Instituto de Mexicanos en Exterior)-local- en los últimos seis años ha sido duro crítico de la cabeza consular. Sin embargo Ponce está abierto a escuchar y afirma que ” las críticas enriquecen”. La nuev a autoridad consular busca maximizar con eventos culturales las amplias instalaciones del consulado en San José. También quiere seguir promoviendo el talento mexicano en la meca de la alta tecnología. Al margen de sus tareas diplomáticas Ponce Martínez se autocalifica como un gran cocinero. “Me encanta cocinar y soy un experto en las labores de casa. Soy un experto en la Paella”. ∆ Carlos Ponce Martínez, natural de Puebla, es el nuevo Cónsul General de México en San José.

SCC Approves New District Boundaries

T

he County of Santa Clar a Board of Supervisors approved the adoption of Map 1 Revision 1, which sets new Supervisorial District boundaries. The new boundaries assure that the county’s 1.78 million residents are represented by one of fiv e county supervisors. The Voting Rights Act of 1965 calls for each district to be as nearly as equal in population as possible. The ideal target population per district would be 356,320 residents. Under the M ap appr oved today, population shifts between districts and range from minus 5.2% to plus 4.4% compar ed to the ideal target. Map 1 Revision 1 was offered by President Dave Cortese, County of Santa Clara Board of Supervisors, following a decision two w eeks ago to keep four alternativ e maps under consideration. Key Changes Area 1 – A por tion of Sunnyv ale mo ves from District 3 to District 5, from El Camino Real nor thward along Mathilda Av enue and Central Expressway. Area 2 - Monte Sereno and an unincorporated pocket moves from District 5 to District 1. Area 3 – A portion of San Jose moves from District 2 to District 4, from Park Avenue north to The A lameda; M ontgomery S treet i s t he

Communicate, Coordinate, & Cooperate To Achieve Transparency By Hilbert Morales

T

o “make it together” we must all communicate, coordinate, and cooperate these days because our governments depend upon a r obust economy which gener ates tax revenues. Tax revenues can no longer be ‘taken for granted’ because of the corporate focus on profits and a mindset change b y ex ecutives who guide multi-national enterprises. Today these executives consider “labor” to be chattel which can be obtained at ‘lo west market price’. This is basic capi talism without any moral obligation to provide meaningful employment to domestic American workers. American manufacturing has been r elocated to ‘off-shore sites’ where skills and labor can be obtained at lower costs. Think of that television ad which shows all those stockpiled shipping containers. The commentator says, “American labor needs manufacturing to fill these containers with goods to go overseas.” There is another factor. American production has gone up while employment l evels drop! Today cer tain manufacturing industries produce extra-ordinary amounts of goods while employing less laborers. How c an t hat b e? Well, co rporations a re lowering their domestic labor needs by investments in automation and robotics. These robotic m achines t ake n o t ime o ff; d o n ot ge t sick; and ar e v ery efficient. It takes few er skilled workers to man the assembly line for planes or cars. Even the steel industry’s blast furnaces are automated, thus needing fewer workers to produce more product than was accomplished before inv estment in automation, r obotics and cybernetics. What has not been addr essed is the need to define a new balance betw een being a very profitable corpor ation which pays its tax es, and, which makes the effort to provide employment to the local labor for ce in their community. Let’s view a differ ent perspective. At pr esent time a large portion of the American middle class labor for ce is not emplo yed. Thus no wages ar e earned which permit the wageearner to provide for his/her family. This has been going on for decades. Yet no one c ampaigning f or el ected o ffice i s d iscussing the need to examine traditional profitoriented capitalism. No one is discussing its responsibility to provide employment for those who labor ‘for their bread’. Tax avoidance and lower tax rates are continually sought by their lobbyists.

These very same business entrepreneurs resist the efforts of government to redistribute ‘wealth’ thr ough taxation. These same business entrepreneurs do not see their role in providing jobs to the American labor for ce, union or non-union. How do they expect these unemplo yed or underemployed labor force members to earn money with which to be consumers of the products being manufactured by robotics, automation and cybernetics? The only way out of this situation is not to blame the Obama Administration, but to become engaged in an ev aluation which determines a balance betw een employment of labor, profit levels, and acceptable levels of ‘return on investment (ROI). It will take a lot of ‘communication’ in good faith negotiations to achieve the needed cooperation and coordination. The American economy is v ery dysfunctional due to the fallout of corporate greed and those ‘ overvalued deriv atives’ which Wall Street financial cheaters insist on selling. The entire financial industry must be monitor ed (which is not r egulation) so that those who would be ‘cheaters’ can be detected early on, which permits us all to avoid doing business with them. Simply stated, wrong-doers are reluctant to do wrong when their wr ongful acts can be directly connected to their decisions and acts. Transparency is needed in the financial industry ( banks, c redit c ard p roducts, i nsurances, mortgages, etc.)/ Integrity and honesty must be re-established if the economy is to recover. All of us are stakeholders in the role of compassion, integrity and honesty which can be achieved through good faith communication, cooperation and coordination. Capitalism needs to beco me tr ansparent because it ex cels in the accumulation of wealth, but is v ery deficient in the r edistribution of that same w ealth to those who need some money for their basic living essentials. These are bankrupt consumers. Yet their business leaders object to the taxes which fund welfare programs. When the majority of the ‘Fortune 500’ corporations pay no taxes, they all join the narcotraffic car tels who also pay no tax es though they continue to use the infrastructures of our economy. Ordinary small businesses and individuals pay their taxes because they have no ability to avoid all taxes. This all requires the re-assessment of corporate welfare (subsidies and enti tlements). The entire economic system needs to operate with more compassion….communication, coordination and cooper ation are required along

n Wednesday, June 15th of this year, in Chicago, Illinois, the San Jose Police Department was honored by Connected World magazine for technology innovation. Recipients of the award had to have utilized technological resources, strategies, and tacticss to overcome their particular organizational challenges. Recipients were judged on individual merits and the extent to which they met several criteria, including the benefit to the overall business practices and productivity improvement. The San Jose Police Department received the Gold Award, which was the highest award given at the ceremony. The San Jose Police Depar tment conducted a pilot pr ogram utilizing a CIRA (Cellular Internet R outing Appliance) box which was attached to police v ehicles. This device was equipped with a Wi-Fi router, allowing officers to connect laptop computers as w ell as ecitation and mobile fingerprinting devices over a local wireless network centered in their patrol vehicle. This enabled officers to remove the laptop computers in their cars and write reports outside of their vehicles. Officers also had the ability to monitor field events on the laptop from outside their patrol vehicles. The device also provided two-way mobile broadband connection with police headquarters as w ell as G PS capabilities. Building Donation to Second Harvest Food Bank

C

ypress Semiconductor Corp. (Nasdaq: CY) announced the donation of a 75,000-squar e-foot, one-story office building on five acres of land to Second Harvest Food Bank of Santa Clar a and San Mateo Counties. Valued at approximately $9 million, the building and land, located at 4001 North First Street in San Jose, is the singlelargest corporate gift made to the Food Bank to date. The announcement comes at a time when Second Harvest Food Bank is facing growing demand for ser vices in Santa Clar a and San Mateo counties. Requests for assistance have increased nearly 42% over the past three years, forcing the Food Bank to expand into rented warehouse space. The new facility will nearly double the Food Bank’s overall space and increase its food distribution capacity by at least 50% over the next five years, from 46 million pounds of food to 69 million pounds, translating to 18 million additional meals provided. In addition to enabling fr esh produce warehousing and distribution, the building will also become the Food Bank’s new Santa Clara County volunteer services hub. Once in operation this fall, the site will pr ovide the Food Bank with a presence in the heart of Silicon Valley, centrally located between its main facility in San Jose and its San Mateo County operation on Bing Street in San Carlos. Cypress Semiconductor , based in San Jose, has been the largest per-capita corporate donor to Second Har vest Food Bank in each of the past 20 y ears. In 2010, the company made a joint $1.1 million donation with former Cypress subsidiary, SunPower Corp., to put solar panels on the roof of the organization’s Curtner Avenue facility. The installation is one of the largest in Santa Clara Valley

at 322 kilowatts, and is projected to save the Food Bank enough money in reduced electric bills to provide 6 million additional meals to the comm unity o ver the 25 -year life of the system. Second Har vest F ood Bank CEO K athy Jackson said she is delighted with C ypress’s large gift. “We are thrilled b y Cypress’s generous building donation to Second Har vest. We have been struggling to address physical capacity limitations for some time, and this truly transformative gift will allo w us to pr ovide increased amounts of fresh, nutritious produce to members of our community who are experiencing hunger —many for the first time.” T.J. Cypress is once again pleased to support Second Harvest in its effor t to stamp out hunger in our community.” For each of the past fiv e years, Second Harvest Food Bank has received Charity Navigator’s 4-S tar r ating for efficiency and extraordinary fiscal responsibility, placing it in the top 5 percent of all nonpr ofit organizations in America. The Cypress building that is being gifted to Second Harvest was, until recently, the headquarters site of Cypress’s Data Communications and Memory Products Divisions. Cypress mo ved these emplo yees to other Cypress b uildings t hat were n ot f ully o ccupied, making the building available for donation to the Food Bank. ∆

altrain will raise its fares effective Friday, July 1, adding 25 cents to the base fare charged to ride the Peninsula commuter rail service. This will be the sixth time Caltr ain has raised its fares since 2005. The Caltrain Board of Directors approved the 25 cent incr ease after extensiv e public input on r esolving the r ail system’s current and ongoing fiscal problems. There were four public meetings on Caltrain’s fiscal issues, as well a s a f ormal pu blic h earing b efore t he Board. Members of the public, including customers, fr equently commented that they would be willing to pay mor e to ride Caltrain if the incr eased fares helped to r esolve the immediate budget crisis. Approximately 40,000 Caltrain customers use the rail service every weekday. Fares paid b y customers co ver approximately 44 percent of the cost of providing Caltrain service. During public meetings, ther e were suggestions that Caltrain charge what it costs to

operate the system. That would require an increase in far es of mor e than 100 per cent. A current round trip fare from San Jose to San Francisco costs $21. Earlier this year, the board rejected an initial proposal to slash w eekday service from 86 trains to 48 and close up to 10 stations. Instead, Caltr ain was able to patch together funding to keep the ser vice operating at the current level for another year. In an effort to increase revenue and at the urging of customers, Caltrain implemented a pilot project to test the success of expr ess service on w eekends. The w eekend Bab y Bullet trains, as well as the local trains scheduled before and after them, hav e seen a 30 percent boost in ridership since the beginning of the year. Caltrain also increased on-board bicycle capacity, assuring that all trains will have two bike cars. In the past two years, Caltrain has increased o n-board b ike c apacity b y m ore than 56 percent. Day of Action in the Mayfair neighborhood By Cinthia Rodriguez El Observador n June 21st, over 200 volunteers joined United Way Silicon Valley’s Day of Action to help improve conditions in the Mayfai r neighborhood. There were 15 projects designed to enhance schools, parks and the Mayfair Community Center. United Way Silicon Valley’s Day of Action is a nationwide call to community residents and local corporations to help improve conditions in the areas of education, income and health. This year United Way SV partnered with Somos Mayfair to help the residents in East San Jose. “There’s a lot that w e can do, but w e also need help , so the United Way helped ‘Somos Mayfair’ kick off this new f ocus at the Cesar Chavez Elementary School of the ESUHSD, by working with community volunteers there at the Mayfair Community Center and Lee Mathson School,” said Jaime Alvarado, Executive Director, Somos Mayfair. The Mayfair neighborhood is a working-class community of more than 20,000 residents. The majority of which are first generation immigrants, mostly from Mexico. Somos Mayfair works with those residents to cultivate the dreams and empower the people through cultural activism, social services and community organizing. They have recently committed to working with Cesar Chavez Elementary School for the next five years. They would like the school to become the highest performing school in the ESUHSD district. “I think the main thing we hope to accomplish is to create a more welcoming environment when it comes to learning because w e know that kids being ex cited about their education leads to completing their education,” said Patrick Soricone, Vice President, Community Building & Impact, United Way Silicon Valley. Some of the volunteers included teachers who are ‘teaching staff’ at the Cesar Chavez Elementary School. They made their contributions by painting encouraging slogans on the walls. The school’s blacktop parking lot’s stalls and directional arrows were also repainted. Other sites included Mayfair Park, where volunteers built a permanent interactive learning trail that is focused on early development. Also, Kidango had its benches and planters boxes cleaned and painted. “The opportunities to create a better comm unity environment really came to life when a whole lot of people w ere willing to come together as v olunteers for pr ojects such as these. And I think today is a good example of that,” said Soricone. United Way Silicon Valley and the Somos Mayfair Community organization want a healthy neighborhood that engages parents. They want community members, as stakeholders. to be the ones to make the difference they want to see in their community’s environment.

n Thursday, J une 1 6, c hallenged athletes fr om Special O lympics and members of the Santa Clar a County Law Enforcement Community participated in the 34th annual Law Enfo rcement Torch Run benefiting the Special Olympics. The Torch arriv ed at the Center of P erforming Arts, where a ceremony honored and acknowledged the Special O lympians and Torch Run participants. The Torch w ill u ltimately m ake i t t o it s final destination, the UC Davis campus. It will

arrive on June 24th to inaugurate the opening ceremonies of the Nor thern California State Summer Special Olympic Games. The annual Law Enforcement Torch Run is an i nternational e vent t hat n ot o nly r aises funds for, but also brings community awareness, to the courageous challenged athletes of Special Olympics. The Torch Run has raised over $10.3 million. It is also the largest single supporter enabling 1 4,000 challenged children and adults.

n June 17, the class of 2011 from San Jose Conservation Corps & Char terSchool (SJCC&CS) r eceived their hard earned high school diplomas. Keynote speaker Councilmember Xavier Campos delivered a speech about hard work and diligence to over 200 students in the Exposition Hall at the Santa Clara County Fair Grounds. He related to these students by sharing his experience growing up in East San Jose. “We are very proud of our gr aduates who have o vercome many obstacles and worked

hard to pass the California High School Exit Exam and complete the academic credits they needed to graduate,” said Bob Hennessy, Executive Director and Founder, SJCC&CS. SJCC&CS is a unique charter school for students who have dropped out of high school and have made the com mitment to return to high school to gr aduate and learn impor tant job skills. Since 1987, SJCC&CS has provided 18.500 young women and men an oppor tunity to change their lives.

n June 20, janitors and community supporters rallied to denounce enforcement-only immigration policies at the Federal Building in downtown San Jose. The workers express frustration with repeated enforcement-only policies that separate families and spr ead fear and disillusionment in the Latino community. They are asking for immigration reform. “We should have the same opportunities like everyone else. We come here to have a better life,” said janitor Vicenta Casarrubias. “I wish that the bad treatment towards Latinos would stop. We are all humans.” Janitors are part of United Service Workers West, a union committed to highlighting the connection betw een immigration reform and good jobs. They are standing against a broken immigration system and recently proposed federal legislation that would mandate E-verify to businesses of every size. The bill is said to further threaten economic recovery. “E-Verify is a distr action from real immigration solutions, one that will negatively impact local economies alr eady suffering from anemic g rowth a nd s poradic h iring,” s aid Julien R oss, E xecutive D irector o f t he C olorado I mmigrant R ights C oalition. “ As h as

been demonstrated in Arizona, which has a mandatory E-Verify law in place, the goal of reducing unauthorized immigration will not be reached by enforcement alone. Until w e have a fix for the whole system of immigr ation, standalone measures like E-Verify will only create more problems and cause unnecessary suffering among immigrants and their citizen families.” The workers are asking for solutions that raise wages and living standards, keep families together, and str engthen the economy. Solutions like those would take immigr ants out of the shadows and into the work force. “We need the political will and leadership to fix our br oken immigr ation system, not policies and practices that spread fear in our communities,” said Denise Solis, vice pr esident of SEIU United Service Workers West. Solis believes that immigrants come full of hope. She is asking that the president help the people that contribute to society . She wants the administration to provide a more accessible legalization path for immigrants. “We want immigration reform. We want the raids to stop. We want respect and dignity,” said janitor Br aulia Delgado. “We are workers that contribute and we don’t deserve to be mistreated.”

Pero esa div ersión puede estar acompañada con el riesgo de enfermarse p or i nfecciones contraídas en el agua, enfer medades que cada año afectan a unas 10.000 personas en Estados Unidos. La Encuesta Nacional de Salud In fantil d el H ospital C.S. he County of Santa Clar a launched the Santa Clara County Gener ating Green initiative b y br eaking gr ound for the Civic Center Solar Photo voltaic (PV) Project. The initiative star ts with the i nstallation of a 1 megawatt Solar Photovoltaic (PV) system on the roof of the Sheriff ’s Office in San Jose and in the adjacent parking lot. “It will take government, business, and residents working together to r everse global warming,” said County of Santa Clar a Supervisor Ken Yeager. “Santa Clara County is doing its share by working toward 100 per cent renewable energy use.”

The Solar PV energy generating facilities are funded by $20 million dollars in Qualified Energy Conservation Bonds, (QECB). The County will only be required to pay 30 percent of the interest fees, while 70 per cent ar e subsidiz ed thr ough the American Recovery and Reinvestment Act (ARRA) program. Major construction of the four Santa Clara County Generating Green Solar Photovoltaic projects will star t in July , 2011. These pr ojects ar e scheduled to be completed and generating renewable power in mid-November, 2011.∆

DEPOSITO DE GARANTIAS EN CALIDAD DE RETENCION De acuerdo a los términos y condiciones establecidos a continuación en el código sección 22300 de los contratos públicos el contratista puede sustituir ciertas garantías por algún dinero retenido por la ciudad para asegurar el desempeño del contratista bajo el contrato. Como substitución de las garantías en calidad de retención debe ser por pedimento o a solicitud del contratista y cubriendo el solo sus propios gastos. Las garantías deben ser por un monto equivalente a la retención que será liberada. SALARIOS PREVALECIENTES Se pone especial atención a que no menos del salario general por dia prevaleciente y que los salarios generales prevalecientes para días festivos y tiempo extra deban ser pagados en este proyecto. Copias de los salarios por dia prevalecientes están en los archivos de la Oficina de la Seguridad para la Igualdad y pueden ser obtenidas de esa oficina por los ofertantes interesados.
