isconsin S tate Senato r Spencer Coggs (D) spoke to city workers just hours before the San Jose City Council scheduled to declar e a “fiscal emer -

gency” outside of City Hall in do wntown San Jose. “It looks like in San Jose y ou have Mayor Chuck Reed and he’s trying to make public employees his scapegoat for the city’ s financial problem,” said Senator Coggs.

Coggs, who is for unions, talked about his experience as an opposition leader to union busting pushed by Wisconsin’s governor Scott Walker (R). He described the conflict as a fight against unfairness and referred to the current situation as a perfect copycat of what went on in his state. “Both Wisconsin and San Jose send a negative signal to working families because you can work hard, gain ground but, just like big business, g overnment t ends t o v alue p rofit over the people,” said Senator Coggs. San J ose i s f acing a $ 115 m illion b udget gap, unprecedented cuts to cor e city ser vices and the loss of 600 jobs in the fiscal y ear that starts July 1, 2011. That’s on top of closing a $118.5 million shortfall and eliminating 800 jobs last July. The language ar ound the “fiscal emer gency” d eclaration w as a mended b y M ayor Reed to read: “Direct staff to return to the Council on June 21 with a formal declaration of a fiscal and public safety emer gency that describes the necessity of making fiscal r eforms to avert a fiscal disaster, prevent substantial degradation of public safety and other vital city services, and maintain the integrity of our retirement system so th at earned and accrued benefits can be paid to curr ent and futur e retirees.”

June 21 is also the date for the Council’s final adoption of the 2011-2012 budget. “I think that ther e are a lot of challenges that are in front of us and I think the right path should be to continue negotiating with employees,” said councilmember Xavier Campos. With the council chambers at full capacity, the city workers were not only present but they made their voice heard. The majority was very upset about the proposed budget. A retired plumber and union member said he only had one word for the council and that word was “shame.” The retired plumber wasn’t alone, the workers pr esent also held a sign with the bold word. “Warning fr om Wisconsin, may or of San Jose, don’t do it, don’t abolish worker’s rights,” said Sentator Coggs. “Now is the time to listen to the people.” Sam Liccardo assured the workers that the budget is not a right wing pr oposal and was one of the councilmembers who voted to move forward with analysis of the pr oposal fr om Mayor Reed. Councilmembers Ash Kalra, Xavier Campos, and Chu opposed. Staff was directed to meet and confer with the unions and begin exploring changes to the City Charter. This issue will come back to the Council on June 21.

n May 23, two sanitation workers, Alvin Turner and Baxter L each shared their story with city workers at the First Christian Chur ch in downtown San Jose. â&#x20AC;&#x153;They just wanted to be treated with justice and respect,â&#x20AC;? said Laverne Washington, President, American Federation of State, County & Municipal Employees (AFSCME), Local No. 101.

Former sanitation worker Baxter Leach. In 1968, Memphis sanitation workers made history when they stood up for their rights and dignity on the job. They were subject to hatred and violence including these two special guests, but they stood their ground. The strike was also televised like the r ecent one in Wisconsin. â&#x20AC;&#x153;It is a crime for a working person to receive a starving wage and today weâ&#x20AC;&#x2122;re going through the same thing,â&#x20AC;? said 76-year-old Alvin Turner, referencing a speech made by Dr. King.

Right before his assassination, Dr. Martin Luther King, Jr. joined these workers, who were fighting to form a union with AFSCM E. The workers continued to inform and inspire. â&#x20AC;&#x153;I think these two gentleman ar e national heroes,â&#x20AC;? said Cindy Chavez, Executive Officer, South Bay Labor Council. â&#x20AC;&#x153; They are a par t of our history and they have an important story to tell.â&#x20AC;? The sanitation workers fought for a mor al and justifiable living wage. Throughout their journey, the workers suffered beatings, shootings and thr eats while sear ching for workerâ&#x20AC;&#x2122;s rights and recognition. â&#x20AC;&#x153;We had enough. We stood up for our rights and the unionâ&#x20AC;&#x2122;s struggle is still going on,â&#x20AC;? said 71-year-old Baxter Leach. Leach and Turner think that the city workers are in the same situation they were in during their struggle. They are also considered brave by believing that union members should stand

together in solidarity and not br eak, because there are more workers than policy makers. â&#x20AC;&#x153;Weâ&#x20AC;&#x2122;re fighting for more justice for the poor people,â&#x20AC;? said Leach. These two men w ere inducted into the Labor Hall of Fame in April of this year. They also received a standing o vation prior to sharing their story to fello w union members and r eligious leaders. â&#x20AC;&#x153;I feel awe-struck,â&#x20AC;? said Chavez. â&#x20AC;&#x153;I feel Iâ&#x20AC;&#x2122;m in the presence of two individuals who were very important to the lifestyle that so many people in this country live today. They have no idea to be thankful to persons such as these two.â&#x20AC;? In unity and solidarity, San Joseâ&#x20AC;&#x2122;s city workers w ant a m oral a nd e quitable c ity b udget. Most importantly, they want a budget that is not balanced on the back of vulner able seniors, children, neighborhoods and public ser vice workers.

Engagement, Reconciliation And Resolution By Hilbert Morales

La Sombra del E-Verify? Por Maribel Hastings o que se avecina es un duro debate sobre la funcionalidad de programas como el E-Verify sin resolver la realidad de que hay 11 millones de indocumentados e ntre n osotros; e l p apel de l os indocumentados e n n uestra e conomía; y cómo medidas que algunos definen como de combate a la inmigr ación indocumentada pueden afectar a ciudadanos y r esidentes legales, y a la economía. El E-Verify, establecido en 1997 como programa piloto y voluntario, coteja los datos de los trabajadores con información de la Administración del Seguro Social (SSA) y del Departamento de Seguridad Nacional (DHS). Grupos p ro i nmigrantes y d e d erechos civiles ar gumentan, entr e otr as cosas, que pese a las “ mejoras” que el DH S asegur a haber implementado para evitar errores clericales que dejen sin empleo a personas au torizadas, la Oficina Gener al de Contr aloría (GAO) concluyó que “l os errores de E-Verify persisten”. Se calcula que 3.6 millones de tr abajadores estadounidenses tendrían que corregir su información en los bancos de datos y que unos 800,000 tr abajadores autorizados podrían perder sus empl eos por err ores en esos bancos de datos. De hecho, el í ndice de error de datos es mayor entre ciudadanos naturalizados y residentes legales que entre ciudadanos nacidos en Estados Unidos. Los ciudadanos naturalizados y los r esidentes permanentes tienen 32 v eces y 10 veces, respectivamente, más probabilidades de figurar como “no” autorizados para trabajar qu e c iudadanos n acidos e n E stados Unidos. Según datos del propio gobierno, en más 50% de las ocasiones el programa no identifica adecuadamente a los trabajadores indocumentados. Asimismo, la Oficina de P resupuesto del Congreso (CBO) concluyó que el E-Verify nacional y obligatorio reduciría los ingresos federales en $ 17,300 m illones e n u n l apso d e diez años porque “la verificación obligatoria de elegibilidad de trabajo a través del sistema

E-Verify resultaría en un alza en la cifra de trabajadores indocumentados que serían remunerados fuera del sistema tributario”. Y sólo implementar el programa, según el CBO, supondría gastos de $23,000 millones en un periodo de diez años.T ampoco queda claro qué pasará con las industrias que dependen de mano de obr a indocumentada, como la agrícola. El efecto es en cadena pues 3.1 millones de empleos no agrícolas dependen de la industria agrícola.Con todo, existe la posibilidad real d e q ue a lguna versión d e E -Verify progrese, especialmente en la Cámar a Baja, impulsada por Smith y el presidente del subcomité de Inmigración, Elton Gallegly, republicano de California. La estrategia republicana es ignorar las fallas y e l c osto d el s istema, y s u i mpacto sobre la economía en general, sobre ciertas industrias en particular, y sobre trabajadores autorizados porque creen que con el E-Verify “liberarán” empleos y de paso orillarán a los indocumentados a autodeportarse. En su borrador sobre lo que se r equiere para enmendar el sistema migratorio, la Casa Blanca señala que un sistema E-V erify obli gatorio puede implementarse en etapas, por un periodo de v arios años, pero “en combinación” con un plan que permita la r egularización de trabajadores indocumentados. Con las elecciones en puerta es de anticipar que los republicanos quieran convertir este asunto en tema de campaña y es posible que encuentren eso en algunos demócr atas electoralmente vulnerables. Apply that to the many retirement plans that were approved many y ears ago, without engaging an actuarial expert to define the scheduled funding needed for investment growth, which would be used to pay out the retirement benefits when due. The City of San Jose is facing those obligations today when tax revenues are very low. Reconciliation is defined as bringing to acceptance or agreement. Current employees of San Jose who may soon be retirees, whose pension levels cannot be fulfilled today by a city organization that is experiencing very insufficient tax revenues, may need to accept cer tain adjustments needed today . We all kno w that something is better than nothing. L ook at the calculated actuari al projections before you r esist t he r econciliation r equired. Reaching an accord or agreement is possible if all par ties are willing to deal with r eality and facts in a tr ansparent manner. It must be accomplished in the manner that does the least financial damage to all of us who are residents of San Jose. The reality is that many r etirement agr eements of the past were not ‘complete’ in the sense that the f unding l evels t o b e ‘ saved’ a nd i nvested were not calculated nor estimated by a competent actuarial service. Following reconciliation information accepted by all parties, what follows is the essential a nd n ecessary r ecognition o f t he fiscal crisis being faced today and becoming more acute in the near future. If this process is not followed, then the City of San Jose has one option left, which is to consider authorization o f bankruptcy p roceedings which amounts to the legal process of settling untenable and unr easonable contracts. Is this an unusual case today? Not at all. It will behoove the County of Santa Clara to review all o f its r etirement contracts with any and all unions. The same may be true for state and feder al pension agreements which were set up decades ago without full actuarial analysis to establish the nature of the obligations and expectations being established. The pr actice of setting up r etirement plans without adequate investment funding

began during the 1960’ s. At that time the economy was robust; today it is not. In fact, today America’s economy faces global competition. There i s n o s ource o f ‘ bail-out’ funding. All stakeholders must understand that fact. Today’s b usiness environment does not agree with nor support the social contracts and obligatio ns of past gener ations. There was a time when the very wealthy w ere w illing a nd a ble t o pa y t he taxes t hat p ermitted r edistribution o f wealth to r etirees, the needy , poor and handicapped. Today the very wealthy want to accumulate even more wealth. They have set aside any sense of moral or social obligation for retirees and the less for tunate. They do n ot ev en pay their fair shar e of taxes. The outcome being experienced is that local governments simply do not have the r evenues to pay r etirement contr acts coming due soon. And borr owing the money is not the answ er because that ‘kicks the fiscal obligation into the futur e’ which is what was done for the past 40 to 50 years. Let’s face reality: Why should taxpayers today pay for pension plan obligations which were never fully determined and funded several decades ago? Why should today’s taxpayers experience a decr eased level of ‘ civic ser vices’ because gener al funds are being used to pay retirement obligations of the past flawed agreements? It is unreasonable to expect today’s taxpayer to accept such a resolution. The fact is that inadequate r etirement funding was accepted resulting in the outcome that inadequate r etirement pay outs ar e being anticipated. Mayor Reed is doing his civic duty by putting that fact out wher e all can see it. The retirement deals of the past were incomplete. The Mayor is asking all stakeholders to be part of completing the deal. It is painful, but it must be accomplished. Today’s San Jose City government must operate as a ‘business of all the people, for all the people, and by all the people.’ One way to get to the desired future accord is to agree to engage, reconcile and resolve beginning right now. Then let’s pay as w e go for everything. Our City’s governance must become fully transparent with no fiscal surprises to r e-establish the honesty and integrity required for all of us to have faith in our common future together.∆

an Jose, Calif. — As families across California plan for upcoming spring travel, there’s not much you can do to control the cost of filling up the gas tank, but you can avoid a costly ticket by making sure that everyone in the car wears their seat belt. Law enforcement throughout the state, including San Jose Police Department, will be looking for unbelted drivers and passengers as part of the 2011 Click It or Ticket mobilization until June 5. The fines and fees for first time adult seat belt violations is a minimum of $142. For children under 16, the fine is $445 for a first time offense. Because nighttime passenger vehicle occupants are among those least likely to buckle up, and most likely to die in crashes when unrestrained, nighttime enforcement has become a priority of the Click It or Ticket mobilization. Nationwide, of those who died in nighttime crashes in 2009, nearly two-thir ds (62 percent) were not wearing seat belts at the time of their fatal crashes. “Many nighttime traffic deaths can be prevented if more motorists simply start wearing their seat belts. Law enforcement throughout the area will be looking for seat belt violators, day and night,” said Police Chief Moore. “Citations will be issued without warning. It’ s not just about av oiding a costly ticket; it’ s about keeping the ones y ou care about alive. Remember to buckle up on ev ery trip, day and night.” California’s current seat belt use r ate of 96.2 per cent is at an all- time high, but that still leaves nearly one million people who are not buckling up, putting their lives at risk every time they get into the car. The Click It or Ticket mobilization is cr edited with incr easing the state’s adult seat belt usage rate from 92.5 per cent in 2005 to 96.2 percent in 2010. “We are very proud of California’s seat belt and child safety seat use rates,” said Christopher J. Murphy, Director of the California Office of Traffic Safety. “However, with nearly one million motorists still not buckling up , there is much more work to do. Reaching the last four percent of motorists is crucial to reaching our goal of zero deaths.” More than 600 perma nent Click It or Ticket highway signs, which have been up since 2005, have been updated to reflect the ‘Minimum $142’ message as a reminder to motorists that failing to buckle up is costly. Properly r estrained driv ers, passengers and children have a 50 percent better chance of surviving a crash than unbelted occupants. Those ejected from vehicles in crashes or roll-overs are up to 35 times more likely to die than restrained occupants. In 2009 alone, seat belts saved approximately 1 2,713 l ives n ationwide. In California, it is estimated that 320 people who w ere killed in 2009 would be aliv e today if they had been wearing seat belts. More than 140 l ocal law enfor cement age ncies statewide and the California Highway Patrol will be participating in this y ear’s Click It or Ticket mobilization. Funding to support California’s Click It or Ticket campaign was pr ovided by a grant from the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

he University of San Francisco (USF) conferred an honorary doctorate on Isabel Castillo, an activist whose high-profile fight for federal immigration legislation could have her deported at any time. USF president Stephen A. Privett, S.J., bestowed the degr ee during gr aduation ceremonies f or u ndergraduate s tudents i n a rt, architecture, performing ar ts and social sciences last Friday, May 20th. Castillo is a passionate adv ocate of the DREAM Act (Development, Relief and Education for Alien Minors), which would give legal standing to undocumented college students whose parents brought them to the country illegally when they were children. She has received national attention after leading rallies, organizing a march on Washington and staging a no n-violent s it-in a t S enate M ajority Leader Harry Reid’s office, which led to her arrest, but not deportation. An undocumented immigr ant herself , Castillo says, “I’m not ashamed or scared. I’m not a criminal. I’m no longer going to hide in the shadows.” A documentary film about her struggle is in progress. Isabel was just six y ears old when her family came to the U.S. from Mexico. Despite her e xceptional a cademic r ecord i n p ublic schools, she had difficulties gaining admission to college because she had no social security number, and she could not apply for state and federal financial aid. She eventually earned a bachelor’ s degr ee with high academic honors in social work fr om Eastern Mennonite University. But, without a social

security number, it is impossible for her to land a job in that field. “We honor Isabel Castillo for her selfless courage in advancing the cause of undocumented college students and to underscor e the fundamental unfairness of our denying a path to citizenship to some of the most motivated college students in the country ,” said USF President Stephen A. Q: Can you talk about your new project? A: “When I was preparing my s econd r ecord I g ot o ffered a job in Warner USA to

have the possibility of making an English record. I thought it would be a good enough challenge so that’s why I took it.” Q: Did you collaborate with any artists? A: “It was a massiv e collaboration. I w orked w ith everybody fr om Tim Armstrong f rom R ancid to G reg Kurstin from The Bird and the Bee an d L ily A llen. I t w as amazing. It’ s a lot of r eally

great artists that I got to meet in the making of the record.” Q: Can you talk about the songs?
