Violent Video Games and Children By Osvaldo Castillo El Observador

I

t seems today that most video games include some sort of violence, alcohol pornography and tobacco. These video games include Grand Theft Auto, Resident Evil and NARC. There is nothing wrong with the content of these video games, unless it is children who are playing these video games. Children who play these games are prone to violent and aggressive behavior, arguing with adults and failing grades. They increase crime rates and may even become a serious threat to our society. The marketing strategy has been very successful in targeting children. In fact. the United States military has also invested money in marketing their own violent video games such as Global Gaming League. Legal action has been taken by California lawmakers to decrease the number of children playing these video games. Senator Leland Yee (D-San Francisco/San Mateo) has written a law on this issue. In 2005, Yee wrote AB 1179, which according to Yee’s office, prevented the sale and rental of violent video games that depicted serious in-

jury to humans in a manner that is especially heinous, atrocious or cruel, to people under the age of 18. Retailers who violated the Act would be liable in an amount of $1,000 for each violation. “Based an extensive body of peer-reviewed research from leading social scientist and medical associations, we narrowly tailored this law to serve the State’s compelling interest in protecting children,” said Yee in a press release. “We need to empower parents with the ultimate decision over whether or not their children play in a world of violence and murder. The video game industry should not be allowed to put their profit margins over the rights of parents and well-being of children.” The bill was endorsed and signed by Governor Schwarzenegger. However, the US Ninth Circuit Court of Appeals struck down the bill this past February. Their reason was that the Act was a presumptively invalid content-based restriction on the “Freedom of Speech”; ideals and practices. The ruling has been appealed to the U.S. Supreme Court where the state of California vows to continue fighting to protect children from violent video games.

D

uring the past several weeks, two local issues of great interest to the Hispanic community keep coming up. One is the selection of the next Independent Police Auditor, and the second one is the search for an evenhanded application of the law to the citizenry of this great city, whose roots begin in recorded Hispanic history and Native American Lore. These two issues are interconnected and require clear direct communication and understandings. The selection of the next Independent Police Auditor (IPA) must be made in a manner that ensures being truly independent except for the direct responsibility to the appointing authority, which is the Mayor and the members of the San Jose City Council. A source of great concern is the lack of involvement in cases involving the use of tasers and firearms. One possible and reasonable resolution is to permit the next IPA access to the all the information collected by the San Jose Police Department’s Internal Affairs along with a requirement for strict confidentiality. The application of the professional practice of embargoing information, would mitigate many

Mucha gente no sabe que en los Estados Unidos la palabra matrimonio, marriage, es un término legal. El matrimonio otorga protecciones, derechos y res ponsabilidades a nivel estatal y federal. O sea, es válido en el país entero. Sociedades domésticas, o domestic partnerships, no cargan el mismo peso. El matrimonio también significa el ser iguales ante la ley, la mayor promesa de este país. Muchos venimos a los E.E.U.U. a conseguir el sueño americano de auto suficiencia. Pero este sueño es imposible si se nos niega la igualdad ante la ley. Como inmigrante entiendo perfectamente como esa desigualdad me afecta. El hecho de que además soy lesbiana aumenta mi dispariad. Por suerte mi matrimonio continua siendo válido. Lo triste es que a millares de personas se les ha negado esta oportunidad. Y lo peor es cómo esto se dio. Al reconocer el voto popular, la corte creo un precedente donde una simple mayoría puede alterar la constituición para afectar a una minoría. Consecuentemente la constitución no significa nada y los derechos de minorías están sujetos a los gustos y disgustos de la mayoría. Y no estamos hablando de una mayoría substancial. La Prop. 8 pasó con una dife rencia muy pequeña. Esa es la nota agria que la corte nos regaló a todos, no solo a los gays. La corte nos dijo que si somos minorías nuestros derechos no valen nada si el 50 porciento más un voto así lo decide. Yo aún me acuerdo de la propuesta 187, y me pregunto que habría pasado si hubiese sido esta propuesta en juego, y no la Prop. 8. La constitución de un territorio es el equivalente a la Biblia de una congregación. Cambios a este docu mento legal sagrado no pueden ser hechos a la ligera. La gran promesa de la constitución es que esta proteje a las minorías de la tiranía de la mayoría. La demo cracia no puede funcionar si las minorías no gozan de esta protección. Hoy me tocó a mi por ser lesbiana. Solo Dios sabe a quien le tocará mañana. Δ

determine if any action is needed. The San Francisco Police Department lowered the level of citizen’s complaints simply by assigning certain officers to desk jobs (i.e., taking them off the streets). The community must understand that progress is possible. Not too long ago, the ‘at-large’ elections of civic officials were changed to ‘district’ elections. Also, not too long ago the makeup of the local law enforcement groups began to reflect both the racial diversity and language communication usage extant in this community. It seems that inclusive diversity must be accompanied by support and trust and clear direct communication. When objective data reveals that the law and local ordinances are applied to all in an even-handed manner, then the current second concern of the local Hispanic community will have been mitigated. It is essential that this opportunity to make progress not be lost because all segments of this community need to sustain communications in order to become more trustful and supportive of local law enforcement personnel.

onia Sotomayor has served as a judge on the United States Court of Appeals for the Second Circuit since October 1998. She has been hailed as “one of the ablest federal judges currently sitting� for her thoughtful opinions, and as “a role model of aspiration, discipline, commitment, intellectual prowess and integrity� for her ascent to the federal bench from an upbringing in a South Bronx housing project. An American Story Judge Sonia Sotomayor has lived the American dream. Born to a Puerto Rican family, she grew up in a public housing project in the South Bronx. Her parents moved to New York during World War II - her mother served in the Women’s Auxiliary Corps during the war. Her father, a factory worker with a third-grade education, died when Sotomayor was nineyears old. Her mother, a nurse, then raised Sotomayor and her younger brother, Juan. After her father’s death, Sotomayor turned to books for solace, and it was her newfound love of Nancy Drew that inspired a love of reading and learning, a path that ultimately led her to the law. A Fearless and Effective Prosecutor Fresh out of Yale Law School, Judge Sotomayor became an Assistant District Attorney in Manhattan in 1979, where she tried dozens of criminal cases over five years. Spending nearly every day in the courtroom, her prosecutorial work typically involved “street crimes,� such as murders and robberies, as well as child abuse, police misconduct, and fraud cases. A Corporate Litigator She entered private practice in 1984, becoming a partner in 1988 at the firm Pavia and Harcourt. She was a general civil litigator in-

volved in all facets of commercial work including, real estate, employment, banking, contracts, and agency law. In addition, her practice had a significant concentration in intellectual property law, including trademark, copyright and unfair competition issues. Her typical clients were significant corporations doing international business. A Sharp and Fearless Trial Judge Her judicial service began in October 1992 with her appointment to the United States District Court for the Southern District of New York by President George H.W. Bush. Still in her 30s, she was the youngest member of the court. From 1992 to 1998, she presided over roughly 450 cases. As a trial judge, she earned a reputation as a sharp and fearless jurist who does not let powerful interests bully her into departing from the rule of law. In 1995, for example, she issued an injunction against Major League Baseball owners, effectively ending a baseball strike that had become the longest work stoppage in professional sports history and had caused the cancellation of the World Series the previous fall. She was widely lauded for saving baseball. A Commitment to Community Judge Sotomayor is deeply committed to her family, to her co-workers, and to her community. Judge Sotomayor is a doting aunt to her brother Juan’s three children and an attentive godmother to five more. She still speaks to her mother, who now lives in Florida, every day. She has served as a member of the Second Circuit Task Force on Gender, Racial and Ethnic Fairness in the Courts and was formerly on the Boards of Directors of the New York Mortgage Agency, the New York City Campaign Finance Board, and the Puerto Rican Legal Defense and Education Fund. Sonia Sotomayor: juez centrista nominada a la Suprema Corte de EU

N

ueva York, (Notimex).- La juez Sonia Sotomayor será la primera persona de origen latino en formar parte de la Suprema Corte de Estados Unidos, de ser ratificada su nominación en el Senado. Sotomayor, de 54 años, es actualmente magistrada del Segundo Circuito de Nueva York, en cuyo condado del Bronx nació y donde ha hecho la mayor parte de su carrera. De ser ratificada, además, sería apenas la tercera mujer en ser juez de la Suprema Corte. De acuerdo con los miembros de la Barra Nacional de Abogados, Sotomayor es consi derada una magistrada ubicada al centro del espectro político. Hija de una familia emigrada de Puerto Rico, su padre murió cuando ella tenía nueve años, y junto con su hermano fue criada con estrecheces económicas por su madre, de ocupación enfermera. Estudió en la Universidad de Princeton, donde se graduó con altos honores y obtuvo el

máximo reconocimiento otorgado a los estudiantes, el Premio Pyne, para luego especializarse en la Escuela de Leyes de la Universidad de Yale. Desde que terminó su instrucción académica, Sotomayor se integró a la vida pública como abogada al ser asistente del juez de distrito Robert Morgenthau, y sólo brevemente suspendió su carrera pública para integrarse al despacho legal Pavia & Harcourt. Más tarde fue nominada a la Corte de Apelaciones por el hoy ex presidente William Clinton, y luego a su actual puesto en Nueva York por el también ex mandatario George W. Bush. na gran frustración para Mike y Alvaro de San José cuando se ente raron de la posición que adoptó la Corte de California que prohíbe los matrimonios entre personas del mismo sexo. Mike y Alvaro llevan seis años de una relación feliz pero lamenta que California en vez de avanzar está dando un paso atrás. “Es injusto negar el derecho de parejas que necesitan estas protecciones para cuidar de la persona que aman y de sus familias. Estamos agradecidos con el Centro Nacional de Derecho

para Lesbianas, la ciudad de San Francisco y los de más defensores y parejas demandantes por su abogacía y compromiso a la igualdad y oportunidad para todos los californianos”. Las reacciones locales no se hicieron esperar y en la ciudad de San Jose organizaciones de la comunidad homosexual realizaron movilizaciones de protesta ante la resolución adoptada el pasado 26 de mayo. Un promedio de 500 manifestantes reco rrieron pacíficamente las calles del centro de San José y caminaron desde la Plaza César Chavez hasta el Municipio de la Ciudad. Los manifestantes se congregaron desde las cinco de la tarde hasta casi las 8 de la noche. A la espontánea manifestación el Concejal Ash Karla, la ex-Asambleísta Sally Lieber dieron su voz de apoyo a la comunidad que vio afectada sus derechos civiles. “Tengo una profunda desilusión con la decisión emitida por la Corte Suprema de California, que continúa negándole a un grupo el derecho fundamental al matrimonio civil en Ca lifornia”, dijo Sally Lieber. Las organizaciones manifestaron además que están preparando una nueva propuesta que, tras conseguir las firmas necesarias, podría revivir el tema en los comicios del año próximo. ¿Academia de Policía para restaurar confianza? Por Rosario Vital - El Observador

U

n reporte recientemente publicado por la organización PACT realizado en la Iglesia Cristo Rey la segunda semana de mayo indica que el 57% fue víctima de un crimen, el 44% de las víctimas no reportaron el crimen y el 54% tiene poca o nada de confianza a la policía de San José. La encuesta fue elaborada una a una. Se entrevistaron a 120 personas de la Iglesia Cristo Rey y los resultados no son nada positivos para los efectivos del orden. El Observador entrevistó al Jefe de la Policía de San José, Rob Davis quien dijo que “es probable que la desconfianza surge porque muchos de las per-

Por su parte la Concejal del Distrito 8 Rose Herrera dijo que tiene que hay que encontrar alguna manera de restaurar las relaciones entre la comunidad y la policía. El Alcalde de San José Chuck Reed expresó su preocupación que esto esté ocurriendo en una de las ciudades más seguras de los Estados Unidos. Reed estará dispuesto a liderar un esfuerzo a desarrollar un plan comprensivo para ponerlo en práctica durante el otoño. Pero el alcalde se negó a hacer un contrato de sindicatos de policías por un mínimo de dos años asignados a una específica comunidad, según el alcalde no tiene poder de ejecutar esa orden. Estos datos se dieron en el marco de la presentación que tuvo PACT el pasado 21 de mayo en la Iglesia Santísima Trinidad en la ciudad de San José. El Alcalde que fue abordado por temas de embargos, empleos ecológicos y educación tuvo la oportunidad de reunirse con miembros de la comunidad y platicar con ellos para meorar estas preocupaciones.

he San Jose Police Department set up a DUI/Traffic safety checkpoint on Saturday, May 23, which was located in front of City Hall on fifth and Santa Clara streets. The checkpoints were a result of a couple of grants received by the state of California. “The grants were received by the California Office of Traffic Safety and the checkpoints are a requirement of the grants,” said San Jose Police Department Sergeant Paul Woo. “These check points are here to enforce DUI and licenses laws.” The first of these grants is the Countywide Coordination of Traffic Safety Services. It was received on October 1, 2007, and ends on September 30, 2009. According to the California Office of Traffic Safety, the grant provides innovative strategies to address countywide traffic concerns by building on the experience of the Traffic Safe Communities Network collaborative. A facilitator’s guide to support the booklet “Underage Drinking and Driving” will be developed and both will be distributed statewide. Traffic Safe Communities Network’s law enforcement partners will increase patrols to decrease speeding and red light running. School based traffic safety committees will develop and implement site specific traffic safety plans, and a juvenile traffic diversion program will be integrated into existing systems. Intersection safety will be increased with enforcement and the purchase of Pedestrian Countdown Signals. The second of these grants is for the AVOID the 13 DUI Campaign. It was received on October 1, 2008 and ends January 31, 2012. The Santa Clara County Sheriff’s Department will serve as the host agency for a Regional DUI effort in Santa Clara County to reduce alcohol-involved fatalities and injuries and raise general public awareness regarding the problems associated with drinking and driving. Participating agencies include Police Departments from the Cities of every municipality, the County Sheriff’s and Probation Departments, College Police Alcohol Beverage Control and the California Highway Patrol. Activities will include DUI Checkpoints, DUI Saturation Patrols, Multi-Agency DUI Risk Force Ops, Warrant/Probation Sweeps, Court Sting Ops for repeat DUI offenders during the August-Labor Day and Winter Holiday Mobilizations, Memorial Day and Independence Day weekends and Special Events with Identified DUI problems. Those who were pulled over were either intoxicated or driving with out a license. All cars were put in a lot to be impounded. However, those who were simply driving without a license were given a thirty-minute grace period to call someone with a valid license to come pick them and their car up. “This grace is not a requirement of the grant,” Sergeant Woo said. “We want to cut people a break by giving them a grace period.”

l 1ero de junio la frecuencia de Amplitud Modulada (AM) de Univision Radio deja de operar. La programación va a pasar a una version HD (alta definición). Es decir se pasa a una versión digital. La buena nueva es que la radio local está a la vanguardia, el otro punto de vista es que la comunidad latina tiene menos voz en la frecuencia AM (la más preferida por muchos), y aquellos que deseen continuar con esta programación tienen que correr a las tiendas para comprarse una radio con HD. Univision Radio ha decidido pasar su frecuencia AM a HD. ¿Qué es esto?. Que la emisora en la Amplitud Modulada (KLOK) ya no es parte de su red y ahora cuenta con un programación en la radio KBRG HD2 llamada Recuerdos 100.3. Univision radio deja la amplitud modelada e ingresa a la señal Híbrida Digital más conocida como HD. Los Radios HD “La tecnología de Radio HD es un sistema utilizado por las emisoras AM y FM para transmitir el audio digital en conjunto con sus señales analógicas. Para escuchar a las emisoras en HD tienen que comprar nuevos receptores”, dijo el ingeniero de Univision Radio David Lee. Algunas personas no están de acuerdo con este cambio. La situación económica no les permite comprar una radio y este grupo podría quedarse relegado. Por su parte Irma Campos fiel radioyente de Celina Rodriguez y Más dice que “deberíamos tener promociones especiales, descuentos así como en el cambio de la televisión. Esto es demasiado gasto”. Por su parte Alejandro Aguilar fiel seguidor del programa Dra. Isabel se ha quedado sorprendido que la emisora no haya realizado alguna campaña. “¿Por qué avisan recien, me está tomando por sorpresa esta decisión. Yo escucho la radio cuando manejo”, dijo el residente de San José.

La mayoría de las personas sintonizan sus radios más en sus vehículos para informarse de las noticias, para escuchar las condiciones del clima. Otros pocos tienen radios portátiles y la encienden en casa o en sus centros de trabajo. “No voy a poder escuchar mis programas porque no me voy a poder comprar una radio. Cuánto cuesta una radio para el auto, cuánto cuesta instalarlo, en este momento no puedo hacer este gasto”, dice César Guzman. Las radios portátiles más baratas tienen un valor mínimo de $60 y comprar un radio para el auto está entre $100 a $400 dólares a esto se le tiene que añadir del precio de instalación que cuesta $60. También le puede poner un convertidor que está aproximadamente a $35. “Me molesta mucho que no se hizo a tiempo, y nos dan pocos días de aviso. No es justo, no puedo comprar radio”, dijo Maria Cavallera. “La programación no va a cambiar todo sigue igual el único detalle es que va a escuchar más emisoras. Es un sistema gratuito que no hay que pagar”, dijo Lee. “Me voy a comprar una radio con HD pero no creo que pueda hacerlo este fin de semana”, dijo José Mendiola quien lo escucha en su taller mecánico. En el mundo la estaciones con HD se están expandiendo. En EU existen un promedio de 1,879 estaciones que cubren aproximadamente el 84% de este país y hay más de 1,000 emisoras con el sistema HD2. La tecnología se mueve a pasos agigantados. El 12 de junio le toca a la televisión pasar a sistema digital, los periódicos también tuvimos que ajustarnos a la última tecnología e ingresar con gran fuerza al mundo del internet. A la radio también le ha llegado este gran cambio. Algunas personas no están preparadas para el cambio,pero también llega este cambio en un momento crítico donde miles de familias han perdido empleos.
