Momentum Builds for Passage of DREAM Act this Year

W

ashington, DC – There is renewed urgency around the DREAM Act in Washington. Across the country, Spanish-language media is chronicling these developments, showing how important the legislation is to a large segment of the Latino population. Last night, a televised town hall hosted by Lawrence O’Donnell on MSNBC made a compelling case for the DREAM Act as a key stepping stone on the way to broader immigration reform. Today, the most influential Spanish-language newspaper in the nation, La Opinión, made a compelling case for DREAM in an editorial entitled, “The Time is Now!” The newspaper writes, “This is the moment to make the effort to pass the DREAM Act and open up the path for hundreds of thousands of young people to enter the university or serve in the Armed Forces. This legislative session is filled with dozens of legislators who have either lost their reelection or are planning to retire. They have nothing to lose by doing the right thing and voting for a bill that will help the economy in the short and long term by preparing our country’s future labor force. At the same time, they will be strengthening the military. Political savvy and determination will be needed to pass this legislation. Opportunities exist to attach it to other bills if it appears that it cannot be approved on its own. With so much at stake, the time to act is now!” Similarly, the leading figure on Spanish-language television, Jorge Ramos of Univisión, wrote a column (in Spanish) imploring both parties to remember that the DREAM Act is a practical and common sense approach to strengthening America’s military and economic futures while living up to our best national traditions.

Over the past few days, momentum has built on behalf of DREAM in the corridors of Capitol Hill, as Democratic leadership from both congressional houses announced plans to move on DREAM during the impending congressional lame duck session. Today, the DREAM Act will be the topic of a meeting between President Obama and leading members of the Congressional Hispanic Caucus (CHC), Senator Robert Menendez (D-NJ), Rep. Nydia Velazquez (DNY) and Rep. Luis Gutierrez (D-IL), who also are expected to discuss the need for comprehensive immigration reform. Notably, the Democratic leadership support has been joined by important Republican voices in recent days, such as Representative Lincoln Diaz-Balart (R-FL), who yesterday called on Speaker Pelosi to schedule a vote on the legislation this year; Congresswoman Ileana Ros-Lehtinen (R-FL), who noted her support for moving DREAM in an interview with Univisión; and incoming Representative David Rivera (R-FL), who told Jorge Ramos that he supports the DREAM Act on Al Punto. According to Frank Sharry, Executive Director of America’s Voice, “Not only is passage of the DREAM Act a priority for Latino voters, but it’s broadly popular with all Americans. Democrats have a window of opportunity to show they can pass real immigration reform. Republicans also have a window of opportunity to show that they can move past their anti-immigrant party image and support common sense immigration reform. ongress will convene what is termed ‘a lame duck session’. Mainstream Media is focused upon what the Republicans may do to redirect matters towards their ideologies. However, Senator Harry Reid and the Democratic members of the Senate are still an effective majority until replaced. It is estimated that about 175 pieces of legislation have been passed by the current House of Representatives under the leadership of Speaker Nancy Pelosi. There is a Democratic Party majority in the House until after December 31, 2010. It is these 175 pieces of legislation which the Senate, under the leadership of Senator Harry Reid (Democrat) must now ram-rod through its voting procedures so that President Obama may consider them for signature which will make them the ‘law of the land’. That will provide the coming Republican majority of the House something to consider and cope with. Democrats will still control the Senate and the White House. After January 2011 expect Congress to become extremely ineffective unless the Republican majority is willing to negotiate and compromise. One of the very important issues being faced is the national deficit. The current deficit spending, especially the borrowing of money to conduct two wars, must come to an end. It does not matter which administration initiated the borrowing. It does matter that the borrowing stop. In addition all entitlements and subsidies must be re-evaluated and re-assessed. It is impossible to decrease the national deficit without cutting back on spending and cutting back on borrowing. A pay-as-you-go effort is not enough. Our nation is strongest when it lives within its means.

The projected monies needed for Social Security entitlements can be funded by continuing and applying the “Bush Taxes” to the top one percent of all taxpayers. It is projected by several sources that taxes on the ‘ultra-rich’ could fund all the Social Security Administration entitlements from now on. The current stance of the Republicans on extending the “Bush Taxes” to all without modification is not rational. The ‘ultra-rich’ will never miss that money. It has always fallen upon the very wealthy to assist all those who have legitimate needs.

Another tax issue must be addressed. Currently, many American multinational corporations have parked enormous amounts of money in ‘offshore’ financial institutions. This is done to avoid taxes on profits generated offshore. Some adjustments are called for which enable this money to come home because those multinational corporations can then use that capital to establish new domestic production and manufacturing systems which may provide employment to many without the use of federal subsidies. The federal funding of ‘shovel-ready’ infrastructures can only do so much. American corporations must step up to undo the damage already done to the American consumer economy by their current practices which establish factory jobs offshore. If America is to continue to be a superpower, it must have an economy which is enabled by a domestic work force that is educated. Therefore, education is the issue which must be addressed in a bipartisan manner by Congress. Meg Whitman was correct in advising all who could, to go experience that documentary about our current educational system (Waiting for Superman). Too many children having high potential are simply not being taught the basics of reading, writing, and math. Without these skills a developing individual cannot proceed towards vocations and professions which require facility in communications, information technology, and engineering. An understanding of science is basic to development of professionals in biology, biomedical sciences, engineering and technology. The stranglehold of special union interests such as the National Education Association and the National Teachers Association must be mitigated to permit retention of effective teachers; the rehabilitation of the incompetent; and the relief of burnt-out teachers. Simply stated, until the newly elected officials are sworn in and seated, the present U.S. Congress is still dominated by Democrats. The Obama Administration needs to receive from the Senate all those 175 legislations that the House has already passed. All of us need to call our Senators and Members of the House to let them know that we expect Congress, especially the Senate, to do much before the end of the current congressional session. onstructed in 1854 to 1855, Casa Grande (the big house) is the most prominent building in the Hacienda, the previous mining area now known as New Almaden. It was built as a hotel but became the mine manager’s residence. The Hacienda also contained the homes of additional management and furnace workers. The Santa Clara County Parks and Recreation Department purchased the house in 1981. “This is a very exciting day for the county, for everyone here, for the Daughters of the American Revolution and we’re dedicating this Casa Grande after 150 years of existence," said Supervisor Don Gage, District One, Santa Clara County. "If you saw it before you wouldn’t recognize it, today, it is absolutely beautiful.” Casa Grande, the second most historical building was newly renovated, receiving a $5 million transformation made possible by several grants from the state and nation. Renovations include re-creations of rooms furnished with period pieces, a sales area and the mining museum. The museum has exhibits on quicksilver mining as well as historical photographs and artifacts showing what life

were like in the quicksilver mining towns. It has maps showing the huge network of mining tunnels. There were around 100 miles of tunnels. Some descended hundreds of feet below sea level. “This is drop dead beautiful, just gorgeous, no matter what side you’re looking at. You can see lush foliage or hillsides,” said San Jose City Councilmember Nancy Pile. Attached to the Casa Grande is the Opry House. This was added on to the Casa Grande in later years. It was a dance hall for miners in the 1920's. Additions and improvements were made to it over the years. More recently, until 1998, the theater in the Opry House was a popular spot for watching baudy vaudeville-revival entertainment. “The Casa Grande set the tone for the multiethnic community of respected Mexicans, Irish, Swedes, Germans, Spanish, Chinese, Native American, and others who call these hills home,” said keynote speaker and author Craig McDonald. Casa Grande is open year-round Fridays, Saturdays and Sundays except for major holidays. The district of New Almaden is located in south San Jose, off the Almaden Expressway. The Museum is located at 21350 Almaden Rd.

O

n November 16, hundreds of students, parents, faith leaders, and People Acting in Community Together (PACT) held the second annual community action meeting at Cambrian Park United Methodist Church to raise awareness about bullying. One of the goals of PACT’s anti-bullying campaign is to hold schools accountable by creating systemic, long-term, school and district-wide solutions to this challenging problem. Another goal is to empower students to prevent and to stop bullying. Recent school bullying statistics show that 85% of reported incidents receive no intervention. Each day 160,000 students miss school for fear of being bullied. Nationwide, one of seven students seriously considers suicide as a result of persistent bullying nationwide. “I was cheated out of a full high school education, because of all the bullying and harassment I faced during my years in high school. For more than two months straight I spent breaks and lunch in the girls bathroom or in an empty hallway to avoid verbal threats or things being thrown at me as I walked through crowded halls,” said Ashley Garnica, former student at Prospect High School. Garnica went on to share her most difficult moment in high school was contemplating suicide and at one point acting on it. Her best friend, who reminded her that people cared about her, talked her out of it. “I can’t wait anymore. Something needs to change immediately,” said Garnica. There are several types of bullying that include verbal, psychological, physical/sexual, and cyber bullying. Cyber bullying is an increasing form of violence. Yet many members of the community are not aware how pervasive and severe this problem is or that it is directly linked to increases in teen suicides and poor academic performance. PACT, faith and community leaders, parents and students asked school officials to make commitments to identify the scope of the problem at their schools through district-wide school climate surveys, create accountability structures to ensure the surveys are acted upon and that results are made public, prepare and implement pilot (and eventually adopt) reputable school-wide programs that not only prevent bullying from being a norm on campus, but also intentionally extend into every facet of the school culture. The objective and goal is to create safe, high achieving learning environments, and to research the best practices of schools in our community that have little to no bullying with the intention of replicating what works where needed.

Durante la audiencia más de 30 estudiantes procedentes de diferentes escuelas dieron testimonio que fueron víctimas de amenaza, de acoso y también fueron testigos de todo. Tanto la Superintendente Rhonda Farber del Distrito Escolar de Campbell, asi como miembros de la mesa directiva del distrito escolar se reunieron para debatir esta problemática. Lamentablemente, los niños y los adolescentes reportan que no sienten que tienen un lugar seguro para ser oídos cuando son molestados o intimidados. Incluso con las nuevas leyes este año en materia de seguridad y la educación, las escuelas son incompatibles en la forma de hacer cumplir esas leyes y adoptar medidas preventivas “Me acosaron, me insultaron como retardada mental por ser la única estudiante sorda de la escuela”, dijo Mycaela Avila-Terra de la Escuela Secundaria Leigh. PACT pidió a las autoridades educativas a que se comprometan a tomar cartas en el asunto sobre este grave problema. Se les pide que hagan una encuesta que luego se haga pública sobre el número de incidentes de este tipo. Esto a fin determinar si las amenazas existen, prevenirlas y hacer de las escuelas un lugar seguro para todo estudiante. Recordemos que uno de los cargos bien sonados fue el de Amanda Solorio Brownell quien intentó suicidarse por las continuas amenazas que recibió el 11 de diciembre de 2008 mientras estudiaba en la escuela secunda-

ria Del Mar en San José. Una amiga le salvó la vida cuando Amanda intentaba suicidarse en su propia escuela. La joven se quedó en estado vegetativo. “The Amanda Network” o “La red de Amanda” es un sitio web que nació debido a este gravísimo incidente para prevenir que esto vuelva a ocurrir entre los jóvenes. “Afortunadamente mi hija vive, fue rescatada de las garras

de estas amenazas que existen en las escuelas. No permitan que esto suceda a sus hijos”, dijo Anne Brownell, madre de Amanda. El 11 de diciembre se realizará una vigilia en honor a Amalia y para combatir las amenazas y acoso en las escuelas. La cita es a las 5:00pm en la rotonda del Municipio de San José. (200 E. Santa Clara) De acuerdo a las estadísticas nacionales se sabe que más de

160 mil estudiantes a diario no van a la escuela por temor a ser amenazados y atacados. El 85% de los incidentes reportados por amenaza las autoridades no han intervenido. Uno de cada 7 estudiantes de la escuela secundaria han contemplado el suicidio como una respuesta a las amenazas persistentes. Una epidemia de suicidios se ha dado en varias escuelas del “Área de la Bahía”. Δ

Es difícil enseñarle a los niños que no pueden tener todo lo que quieren, o lo que tienen sus amistades. El estimularles a apreciar lo que tienen, a disfrutar la naturaleza, y a ahorrar para algo especial toma tiempo, atención, y paciencia. Es trabajo de los padres, familiares y maestros dedicarle tiempo a los niños, y no usar el dinero o los regalos como sustitutos de la atención. California Supreme Court Unanimously Upholds AB 540 By Cinthia Rodriguez - El Observador

O

n November 15, the California Supreme Court rejected a challenge to Assembly Bill 540 (AB 540), which allows undocumented students to pay in-state tuition for higher education. California is one of 10 states to grant tuition equality to its students. “This is a great idea because there are many undocumented students who deserve to pay the same amount of tuition as everyone else. Just because they’re AB 540 students doesn’t mean they haven’t lived in California for most of their lives or that they don’t deserve to have the same tuition rate as everybody else,” said Viridiana Cisneros, senior at San Jose State University. “As it is, it is very difficult for AB 540 students to get into college and pay for college and why try to take that away.” Currently, an out-of-state nonresident American citizen attending one of California’s public colleges or universities pays out-of-state tuition. In contrast, an undocumented student who physically resides in California can attend a California public college or university and pay in-state tuition under state law. A class action lawsuit against the California policy, filed by students paying out-of-state tuition costs, claimed that federal immigration law preempted California Education Code section 68130.5. “Some out of state students might be upset over that but the point of the matter is that they’re not out of state students, they went to high school for four years, they applied to be AB 540 students, they were accepted, so it shouldn’t make a difference for out state students,” said Cisneros. The U.S. Congress passed legislation that prohibits states from granting postsecondary education benefits to undocumented students unless the same benefit is given to all U.S. Citizen-students without regard to residence. The California law granted in-state tuition to undocumented students if they attended a California high school for three years and graduated. The court said that was not a residence requirement. "The court correctly rejected a misguided and politically-motivated campaign that attacked the state's education policy and tried to stifle the hopes and intellectual ambitions of the students California. This lawsuit and similar lawsuits in other states are shortsighted, mean-spirited and driven purely by politics. We hope the court's decision will send an unmistakable message that dedicated college students should not be used as pawns for political purposes," said Lucas Guttentag, Director of the ACLU Immigrants’ Rights Project. As it now stands this law remains in effect. AB 540 provides that students who have attended at least three years of high school in California, graduated from a California high school, and meet certain other conditions may attend state colleges and universities paying the same tuition rate that is charged to state residents. Those students who qualify for AB 540 are undocumented immigrants who live in California. Others are U.S. citizens who attended school in California in the past but are now unable to establish state residence, such as those who live in a neighboring state or those who recently returned to California after living elsewhere. Cuando se comienza a evaluar el hogar utilizando las tÊcnicas del Feng Shui, el primer paso a seguir es desechar objetos en desuso, la energía de Êstos crea obståculos, puede tratarse de periódicos, revistas, prendas de vestir, adornos descontinuados, muebles o simplemente desperdicios. Los sabios consejos del Feng Shui tienen como propósito el influenciar la llegada de la prosperidad y la buena suerte en la vida del practicante canalizando la energía o Ch’i. Venda, done o simplemente recicle lo que ya no le es de mayor utilidad y pronto comenzarå a sentir la diferencia. Mantenga limpios y ordenados los closets y bodegas de los que disponga. including: * Avoid touching your eyes, nose, and mouth; * Covering your mouth and nose when you cough or sneeze; * Throwing away tissues right after you use them, don’t save them on a table or couch until you feel well enough to throw them all out; * Wash your hands often with soap and warm water, particularly after coughing, sneezing, or blowing your nose. * Stay healthy by eating a healthy diet, drinking plenty of

water, exercising, and getting enough rest. If you are, or someone in your family is, sick, you should stay home from work - Sick kids should not go to school or daycare. It is important for us all to stay home when sick to prevent the spread of illness to others. There are groups of people who are at a higher risk to developing complications from the flu. These include: * Children from 6 months of age through 5 years of age; * Anyone over the age of 50; * Pregnant women; * People with underlying health conditions such as asthma, chronic obstructive pulmonary disease (COPD), diabetes, heart, or neurologic disease; * Adults with a Body Mass Index over 40; * Residents of nursing homes or chronic care facilities. There is a vaccination that can be given to almost anyone over 6 months of age. This vaccination will help to protect you

from a variety of different flu types that are expected to be in our community this year. If you remember last flu season there was a concern over H1N1 and many people got both a flu shot and an H1N1 shot. This year, only one shot is needed. The current flu vaccination includes protection against H1N1, along with several other flu strains. Caregivers of individuals in these groups – particularly health care workers and anyone who takes care of a baby less than 6 months of age – should also get their flu shot sooner rather than later. It is very important for those in the high-risk categories listed earlier to consider getting a flu vaccination. Those who are allergic to eggs, have had a reaction to the flu vaccine in the past, or those who are seriously ill may not be able to get vaccinated. Please check with you doctor if you have any questions about your eligibility to get the vaccination. Don’t forget, too, that in Cal-

ifornia, Pertussis has been declared an epidemic. Although it causes mild symptoms, if any, in adults, this disease causes serious complications for babies under one year who have not been fully vaccinated. This year, in California, ten babies, most under three months of age, have died from Pertussis – which is passed to them by the people around them. The TDAP vaccination is recommended for all adults who are living with, or are in regular contact with, children under one year of age. There are a number of places to get your flu shot or TDAP vaccination. Illegal Tobacco Sales To Minors Reach Historic Low

ACRAMENTO – The California Department of Public Health (CDPH) announced their annual compliance checks at retail outlets showed tobacco sales to minors are at an all-time low. The 2010 Youth Tobacco Purchase Survey revealed the lowest rates of tobacco sales to minors in the survey’s 15 year history, with sales transactions being completed at just 7.7 percent of the 742 retail outlets surveyed this year. When the state first started monitoring in 1995, the minors participating in the survey were able to buy tobacco products during 37 percent of tobacco purchase attempts. In

2008, it was 12.6 percent, and in 2009 it was 8.6 percent. This year that number went down to 7.7 percent. Among types of stores surveyed in 2010, drugstores and pharmacies had no illegal sales in 43 purchase attempts. Traditional stores, such as grocery, drug, tobacco, liquor, and gas stations, sold an all-time average low of 6.8 percent. Among these store types, those with lower illegal sales rates were liquor stores (4.5 percent) and supermarkets (5.5 percent). Tobacco sales at doughnut shops dropped significantly, from 21.6 percent in 2009 to 8.7 percent in 2010. Discount or gift stores have the highest rate of illegal

tobacco sales with 22.6 percent in 2010, considerably higher than its rate of 8.9 percent in 2009. This annual survey of illegal sales of cigarettes to minors is conducted to gauge the rate of illegal tobacco sales across the country and to comply with the Stop Tobacco Access to Kids Enforcement (STAKE) Act. States with rates of illegal sales of tobacco to youth above 20 percent, risk losing as much as 40 percent of federally provided drug and alcohol prevention and treatment funds. California retailers that sell tobacco products to minors are also subject to fines ranging from $200 to $6,000.
