Por Rosario Vital - El Observador El representante demócrata Luis Gutiérrez por fin hizo oficial los lineamientos de una reforma migratoria el pasado 13 de octubre en el Capitolio de Washington DC. También aseguró que formalmente será presentada al Senado a fines de noviembre, precisamente después del Día de Acción de Gracias y si todo sale bien sería aprobada el marzo de 2010.

"No podemos permitir que continúe la criminali zación de nuestra comunidad. Los inmigrantes no somos criminales", exclamó Gutierrez durante su presentación en Washington.

El pasado 15 de octubre activistas salieron a protestar alrededor de la Universidad Santa Clara tras la llegada de la Secretaria de Seguridad Interna, Janet Napolitano. "No más redadas, todos queremos unidad familiar", dijo en llanto Eraclio quien es víctima de redadas y esto ha arruinado a su familia.

Delegaciones de Washington, Idaho, San Diego, Los Angeles llegaron para hacerle saber a Napolitano sobre su frustración.

While neither proposal would kill legalization, the logic is misplaced and advocates should work to limit the impacts.

Back of the Line is Back of the Bus Undocumented immigrants, marginalized in their home countries, have been similarly marginalized in the United States by having to wait over 10,000 days to improve their conditions of life in an The last legalization program (IRCA in 1986) included those who entered the United States in 1981 or before. Those who entered after 1981 have been waiting 28 years for an immigration remedy. Ten thousand days have gone by from Jan. 1, 1982 to May 18, 2009.

As a moral imperative immigration reform should try to avoid oppressing the already oppressed by making them wait longer. Decades without basic human dignities and internationally recognized human rights such as the right to work, drive, travel, vote, or access a safety net are long enough.

To force non-criminal hard-working tax-paying immigrants to the back of a long line is to consummate and accept a back of the bus approach. Black people had to ride in the back of public buses until they successfully fought for civil rights. Immigrants need to do the same.

Not a single person in the family preference system has waited 28 years or 10,000+ days, the waiting period of the undocumented. If "back of the line" becomes a bedrock requirement for approving legalization reform, then substantial compliance with "back of the line" should be the goal, not absolute compliance.

The Obama Administration's preference for back of the line to credit "lawabiding immigrants" may feel necessary, but this should not be taken literally.

Assuming a two-step process of temporary and then permanent resident stages, once a substantial reduction of the family-based backlog is accomplished, legalization applicants should be allowed to adjust status as lawful permanent residents (LPRs).

IRCA Did Not Require a Fine In discussing earned legalization with a group of poor undocumented women in East San Jose, they gasped at the thought of having to pay a fine of $500. A new legalization program must be made affordable or hundreds of thousands or even millions of legalization applicants will not apply.

One woman in her 50s told me on October 4, 2009 at St. Lucy's Church in San Jose: "After I applied for amnesty in 1988 and received temporary legal status, I could not afford the second step to pay for legal residence. Now I am still poor and undocumented again."

Both the application fees and the fine, if there is one, must be reasonable amounts. A fine of $1000 on top of legal fees and application fees will put the two-step process of earned legalization out or reach for a large group in Santa Clara County, one of the richest counties in the United States.

Furthermore, the requirement that the USCIS self-finance legalization applications is unfair and discriminatory. It not only targets low income people of color (the vast majority of the undocumented) but also demonstrates institutional bias based on national origin by requiring only immigrants to pay as they go. No other federal agency requires such self-financing of application processes.

The policy result is that potentially millions of mixed status family US-born children will be denied access to basic human needs because their parents will not have access to work or public services.

In 1986 the amnesty law did not impose a fine on legalization applicants.

A new law should avoid the fine or make it affordable for low-income families.

CONGRESSMAN MIKE HONDA SPOKE OPTIMISTICALLY

his past Saturday, October 10, 2009, the Santa Clara County Democratic Club had Congressman Mike Honda (D-District 15, Campbell, CA) as its meeting's keynote speaker. The only topic presented, followed by a Q & A period, was Honda's presentation on the pending health care legislation. About 100 individuals attended the brunch and behaved as friends from the neighborhood who knew each other and kidded around a bit.

Honda's initial comments had to do with the reorganization of the National Democratic Committee's organizational structure to incorporate the ability to communicate to its supporters using the latest email blasts methods. While describing the inclusive diversity of the Democratic Party, he mentioned that he was surprised to learn that three Spanish language radio stations were located in Des Moines, Iowa. Honda was wearing a sweatshirt having LATINO VOTE imprinted upon its front.

In addition, Honda undercut critics of President Obama by pointing out that the Obama Administration has addressed many more public policy issues during its first six months than did the prior Republican administration during its eight years in office. These issues included domestic public policy addressing the Comprehensive Health Care Reform legislation being considered by Congress, both Senate and the House; immigration, the economy and the wars in Iraq and Afghanistan.

"All these issues are connected to each

other. I believe Congress will have a bill which will be signed by President Obama sometime between Thanksgiving and Christmas," Honda said.

He also indicated that the Comprehensive Immigration Reform legislation would begin being addressed before Thanksgiving with the objective of presenting legislation, which the President can sign sometime during May 2010. After that, members of Congress will be into the elections of June 2010 and November 2010.

Getting back to Congress's deliberations of health care reform by three House Committees and the Senate, Honda revealed that the health care insurance industry alone spent a record $250 million during August '09, protecting its current profitable status quo.

In contrast, President Obama has met with all stakeholders including groups representing hospitals, doctors (American Medical Association), nurses, the elderly (AARP), educators, etc. Currently three bills are being crafted which will be consolidated into one bill in the House. That consolidated bill will then be presented to the Senate where again, after more discussion and debate, a single "Conference Committee" consolidated bill will be sent to the President for his signature.

Honda indicated his belief that some sort of "single payer" provision will be included despite being opposed by the insurance lobbyists.

"Incidentally, the insurance industry is not currently subject to any antitrust laws and regulations, did you know that?" asked

Honda.

The Comprehensive Health Care Reform legislation will not be perfect, but President Obama is committed to being the last president who has 'done nothing.' The objective is to provide insurance coverage to all in an affordable secure stable manner, which contains public options and allowances for cooperative demonstration projects.

In closing, Honda revealed that his Congressional District 15, despite being a highincome area, still has 77,000 uninsured residents. He believes the final bill should contain provisions, which allow the undocumented to purchase some form of health insurance. He is working to have the comprehensive health care bill presented to the President before Thanksgiving (before Christmas at the latest) so to permit beginning work on the comprehensive immigration reform act, which needs to be completed by May 2010. This effort requires that all citizens use emails and Faxes to communicate to all those Democratic members of congress who are not active supporters at this time.

So, in my final analysis, registered voters need to remind members of congress who voted them into office. Citizens need to register to vote, learn about the issues (and participants) and be willing to remove from office these members of congress who are not dealing with the public policy issues important to their constituents.

Fortunately for all, Congressman Mike Honda deserves your support, and do plan to vote on November 3, 2009 and June 2010,

Saving the CSU "The California dream has become a nightmare," said Jonathan Karpf, an anthropology professor at San Jose State University and a member of the California Faculty Association. "It is time to reinvest in higher education."

or almost ten years now, students who have attended colleges and universities in

California have suffered in a variety of ways. They have seen their tuition dramatically increase, many of their teachers have lost their jobs and many have not graduated on time because the classes they needed to graduate

were not available.

The reason this has occurred is because the state of California is cutting funds to California colleges and universities in order to pay off the state's debt.

Several students and California Faculty Association members joined Karpf on Monday October 12, 2009 at San Jose State University in support of Assembly Bill 656, which was written

by California Assembly member Alberto Torrico.

One of the faculty members present was Liz Cara, an Occupational Therapy instructor at San Jose State.

"We can't let our education disappear," Cara said. "We need to close the chancellor's office not the admission's office."

California is the only oil-producing state in the nation that lacks an oil/natural gas severance tax. AB 656 would create a stable funding source for all three segments of public higher education in California by enacting a new tax on oil and natural gas "sev-

ered" from California land or water.

"We can no longer accept this sort of political extortion," Torrico said.

"We need to let the oil companies know that it is not ok to dig our oil and not pay a tax for it."

AB 656 creates the California Higher Education Fund (CHEF), which will receive revenues from a 9.9% tax placed on oil and natural gas extracted in the state.

The CHEF would allocate funds to the California Community Colleges, the California State University, and the University at California to pay for instructional costs.

AB 656 also contains oversight provisions to prevent oil and natural gas extractors from passing the new tax onto consumers through higher prices for oil, natural gas and related products.

"I am proud to call this bill the Torrico Tax because I stand with the students and the teachers not the corporations," Torrico said. "Failure is not an option in this situation."

Torrico said he would continue to travel to colleges and universities across the state to gain support for this bill.

"We are going to work hard and hope to collect 100,000 signatures in 100 days in support of this bill," Torrico said.

"Today we gather to talk about our hopes and dreams and how we can wake up to a better tomorrow," said San Jose District 5 Councilmember Nora Campos. "A better tomorrow that we have been waiting a long time for."

The plan of the Latino Leadership Alliance is to create a pro-active Public Affairs Committee to promote Latino interests and create a semi annual media summit to discuss fair representation of Latinos in the media.

"We’ve got great leaders to take us where we want to go," Garcia said. "We’ve got great people at MACSA, Mexican Heritage, MACLA, and countless of other organizations. It is time to put the pieces of this dream together."

The Latino Leadership Alliance will also establish and implement a Latino Leadership Academy that will provide Latinos with the tools needed to advance the community, business and political leadership positions.

"We want to make this Academy well rounded and include people of all backgrounds," Garcia said. "We want leaders that happen to be Latinos, not 'Latino Leaders'."

The Academy's program will last six months and Stanford University professors will help the students develop skills that will improve schools, businesses and non-profits in the Latino community.

"We have selected six males and six females

to participate in the Academy's program. These individual have proven to be leaders in our community," Garcia said. "But these will not be the only ones. We hope to continue to educate our community over the years."

Defining the Role of the US in the World

hen it comes to discussing the role of the US in the world, opinions can vary dramatically. That is why The Fund for Peace organization held community dialogues across the country to gather people's opinions regarding the role of the US in the world.

On October 7, The Fund for Peace made a stop at the Asian American Community Involvement center. The National Dialogue was co-sponsored by Services, Immigrant Rights and Education Network (SIREN), the Asian American Community Involvement (AACI), the American Leadership Forum-Silicon Valley, and Generation Engage.

"We are going across the country to gather the opinions of people on what issues the US should focus on," said William Ferroggiaro, Senior Associate for The Fund for Peace. "We hope that through these dialogues we can find ways to sustain world peace."

One of the dialogue's participants was former San Jose City Councilmember Forrest Williams.

He said that one way the US can change its role in the world is by assisting those nations who are stuck in difficult situations throughout the world.

"We need to use our dollars to construct, not to destruct," Williams said. "We can not bomb our way into the future. We need to help people by giving them aid and technology."

The Fund for Peace organization agreed with Williams. The organization released a report that focuses on countries that are struggling in a variety of ways. “The Failed States Index” includes countries such as Zimbabwe, Burma, Iran and Yemen.

According to the report, one of the reasons these states fail is because of geographic location and because of past history. They also fail because of corruption and mismanagement. In Zimbabwe for example, the GDP has dropped from 14 percent, to negative 5 percent during Robert Mugabe's nearly three decades of rule.

The participants of the dialogue believed the US could help out nations dealing with difficult economic factors.

"We need to find ways to create sustainable living wage jobs in these countries," said Richard Hobbs, Interim Director for SIREN. "We need to help them develop jobs that respond to human needs such as a fire departments, not false needs like military bases."

Other ideas that the participants discussed were improved relations with the United Nations and better treatment for women all over the world.

The Fund for Peace will publish the ideas and themes discussed at their events and present their findings in a major news conference, which will be held in Washington, DC prior to President Obama's State of the Union address in January of 2010.

Remembering Loma Prieta, 20 Years Later O

n October 17th 1989, the Loma Prieta earthquake ripped through the Bay Area causing 62 deaths and destroying or damaging thousands of buildings.

Twenty years later, the events of that day serve as a reminder of the devastating power of earthquakes and a warning of what's to come.

Many current local Red Cross volunteers still remember the day of Loma Prieta and the aftermath. Moments after the earthquake struck, the American Red Cross sprung into action. Hundreds of volunteers from the Santa Clara Valley and Palo Alto Area Red Cross chapters (two chapters that have recently merged into the American Red Cross Silicon Valley Chapter) were deployed throughout Santa Clara County.

They quickly opened six shelters, most of them situated

in local schools that had survived the earthquake.

The shelters served thousands of Santa Clara County residents who had suddenly found themselves without electricity, water, food, or a place to sleep. Local Red Cross volunteers provided survivors with medical care, housing, and comfort for months until they could be relocated to more permanent housing. By the end of the relief efforts, the American Red Cross had provided Santa Clara County residents with over 32,000 meals and 14,000 nights of shelter.

The Loma Prieta Earthquake caused widespread damage and destruction to buildings and property, as well as injuries and loss of life. It is regarded as one of the most devastating earthquakes in United States history. At the time, some people believed that Loma Prieta was "the big one," the giant Bay Area earthquake that experts have been predicting for years. However, this is not the case. While the Loma Prieta earthquake was quite large, it pales in comparison to the great San Francisco earthquake of 1906which

killed over 3000 people. The United States Geological Survey predicts that within the next 30 years, an earthquake of a similar magnitude to the 1906 earthquake will strike the Bay Area.

Twenty years later, the American Red Cross disaster response technology and techniques have evolved, and our understanding of disasters has greatly improved. However, we still have no way of predicting exactly when the next great earthquake will strike. We don't know whether the next big earthquake will strike tomorrow, or years from now. Whatever the case, the best way to deal with disasters is to start preparing early.

The American Red Cross Silicon Valley Chapter offers several ways for local residents to prepare for an earthquake. We sell disaster survival kits that contain all the essentials needed to keep you alive and healthy in the aftermath of an earthquake, when you may be stranded without electricity, water, heat, or access to emergency assistance. We offer a range of kits, from a single-person portable kit, to a 50-person office cabinet of survival supplies. We also offer free presentations on disaster prepared-

ness to teach people how to prepare and respond to disasters such as earthquakes. We provide free training for local residents on how to become disaster relief workers. ace un mes tuvimos la grata visita del Embajador, Carlos García De Alba Zepeda quien es el Director Ejecutivo del Instituto de Mexicanos en el Exterior (IME). García de Alba explicó a los periodistas del Área de la Bahía sobre las tareas y grandes retos que tiene el IME para el bienestar de sus connacionales en el extranjero.

Son muy pocos los que tienen acceso a la información o simplemente están algo confusos de quién es quién dentro de su gobierno. A conti nuación revelamos una encuesta que fue efectuada en las afueras del consulado en San José entre el 21 y el 24 de septiembre y nos permitió conocer en persona que tanto los mexicanos conocen del IME. De las 63 que aceptaron ser encuestados: 43 no conocían el IME 31 si están interesados en saber qué hace.

"Para nosotros la atención de los mexicanos que residen en el extranjero es primordial, hemos atendido cerca de 11,700 mexicanos en el extranjero", indica Carlos García De Alba.

El IME es una fuerte institución que respalda actividades de salud como la Semana Binacional que recientemente ha culminado con éxito y que

por cierto el Dr. García De Alba dice que es un evento que debe ser llamado "Semana Ibeorameri cana de la Salud" porque se extiende a otros países.

Además el IME está detrás de las Plazas Comunitarias que han permitido que cientos de mexi canos culminen los estudios que no pudieron completar en este país. García De Alba precisamente llegó a esta zona de California para inaugurar una estas Plazas Comunitarias en King City, con esta el IME se anota 383 plazas a su favor que son de beneficio para la comunidad mexicana.

A nivel educativo la institución está velando por el progreso de sus connacionales pero también para ayudarles económicamente con programa de becas destinado a elevar el nivel educativo de la población.

El IME se expande en todos los estados de los Estados Unidos de América y que busca cubrir los temas de deporte, gastronomía. organización comunitaria, remesas y viviendas.

El tema migratorio es responsabilidad de los Consulados de Protección, tema que quedó aclarado para los periodistas que no teníamos ese dato tan preciso. La cultura no se queda atrás, ellos están detrás de concursos educativos tales como un evento denominado "Mariachis de todo el mundo", en la que se invita a participar a grupos de dife rentes partes del mundo a cantar el género tradicional que internacionalmente es reconocido por todo el mundo como un patrimonio cultural.

Andrade exhibe "Dia de los Muertos una Pasión de Vida" en las instalaciones de la Biblioteca Martin Luther King Jr. localizada en la calle 150 de San Fernando. (2do. Piso) En esta exposición hay más de 50 imágenes que resume gran parte de la vida de Mary Andrade, oriunda de Guayaquil, Ecuador y quien radica en Estados Unidos desde hace más de 40 años y conoce México como la palma de su mano y cuyo corazón expresa con fervor cariño, afecto y admiración a la tierra mexicana.

Andrade presenta en esta exposición aspectos distintos de la celebración tradicional prehispánica en diveros estados de México.

"Me cautivó el cariño de la gente, cómo esta gente te recibe y al mismo tiempo honra a su gente que murió. Una profunda admiración a todos aquellos que permitieron a revelar y difundir uno de los Patrimonios Culturales según la Unesco", explica Andrade.

ells Fargo has donated a total of $25,000 to 10 Hispanic nonprofits across the Bay Area at the 7th Annual Hispanic Spirit Awards Ceremony. Wells Fargo's Amigos Bay Area team member resource group hosted the ceremony. The organizations nominated by team members and selected by Amigos leaders, will use the donations to support much-needed programs that serve the Latino community.

Nonprofits receiving grants include: Arribas Juntos in San Francisco. Canal Alliance in Marin, East Side Heroes in Santa Clara, New Connections in Concord, and School Health Clinics in Santa Clara.
