Ideas, idle gossip and occasionally important odds ‘n’ ends... by Jack Wright

LOVE it when I get to say good things about local businesses, and how can you not love the story of Ugly Mug waitress Diana Lee, who returned $6,000 dropped in the Mug by a customer from Collingswood who was using the money to buy a motorcycle. Diane used her phone as a f lashlight to search under the booths after the customer called up, desperately hoping he had dropped the money in the Mug. Sure enough, she found a big wad of money, all in $100 bills. And when the beyond-grateful man returned to retrieve his money, Diane refused his offer of a $100 tip. Karma is definitely with you, Diane. I was also impressed by a recent interaction with Lace Silhouettes. My girlfriend’s sister wanted to go there to get some accoutrements for her upcoming wedding, but was coming to Cape May from the ferry and was running too late to make it before the store closed at 6pm — however, we called Lace Silhouettes just to double check when they closed, and were told by general manager Emily Hansen that they would stay open until we got there. And they did. Guess what — my girlfriend’s sister dropped $250 there in a matter of minutes. Superb customer service has its rewards. When a fire destroyed the home of the Nazareth, Pennsylvania-based Gregus family on January 22, the bitter temperature and pounding wind kept firefighters’ equipment — a portable pond in lieu of nearby fire hydrants — from working efficiently. The home was engulfed in f lames and, while no one from the family of five was hurt, everything was lost. Everything, that is, except for the Gregus’ two dogs and cat, which the oldest daughter, home alone at the time and later treated for smoke inhalation, retrieved from the house while it burned. From what we’ve been hearing, this kind of self less act is typical of the family, who are now staying in a hotel. Since the incident, we are proud to hear of, though not at all surprised by, the response from the Cape May community. Thanks to the work of our Historical Editor Ben Miller, a Nazareth resident, in getting the word out, The Blug Pig Tavern and Bella Vida restaurants have donated gift certificates, while the Grand Hotel and Summer Station have donated weekend stays. “This is about neighbors helping neighbors,” Ben says, “which is something that’s lost in a lot of other communities today. This kind of thing restores your faith in humanity.”

Jule may have traveled to the world’s most exotic locations in the course of her job, but every year (for 50 years!) it’s Cape May, and the Chalfonte Hotel in particular, where she and husband Ron choose to take their vacation. Congratulations to chef Lucas Manteca, who owns The Red Store in Cape May Point with wife Deanna Ebner. He has been nominated for a James Beard Foundation Award in the category of Best Chef, Mid-Atlantic Region. There are only 19 other chefs up for the same, and only two of these are from Jersey. For those of you who aren’t familiar with the James Beard Foundation, it’s the New York-based nonprofit that promote the culinary arts — their awards are the Oscars of the food world. So, yes, it’s a huge deal. Also cool? Ben Sukle, son of Joe and Louise Sukle, who own Press and Journal, which prints Exit Zero, was also nominated in the Northeast Region for his work at Birch restaurant in Providence, Rhode Island. Congratulations to both gastronomic geniuses. Thanks to Cape May VFW adjunct Colonel Rich Nowakowski for letting us know this great piece of news: In 2014, Cape May VFW will give a total of $11,000 in scholarship funding to high school seniors who attend the Lower Cape May Regional, Wildwood Catholic, or Cape May County Technical. The breakdown is three $3,000 scholarships and one $1,000 scholarship. Interested students should get applications from their guidance counselors, and return them there by April 28. Good luck to our new neighbors, the Cape May Artists Cooperative Gallery, who moved this month from West End Garage to the site of the former Cape May Bait and Tackle on Sunset Boulevard, across the road from the Exit Zero Store and Gallery (and world HQ). “We had a great experience at West End Garage, but a lot of us wanted to be able to teach classes or do demonstrations, and since that space didn’t allow for it, this was the next logical step,” says Diana Cutshall, one of the 19 artists who belong to the collective. “We’ve only been open a week, but the response has been wonderful.” I’m so excited to welcome a new addition to the Exit Zero family — the cartoon strip below. Talented artist Rosemary Dery is responsible for a charming seagull — name of Bird — that our readers are going to love. Follow the adventures of Bird in every issue.

The Sports Illustrated Swimsuit Issue does nothing for me. Never has. And I’m really not just saying that to earn Brownie points. I just don’t get a kick out of girls cheesily posing in bikinis. But I do get a kick out of Cape May getting good PR, and that has been happening in the aftermath of the issue coming out. For those who are unaware of such things, the magazine shot some of their models in Cape May last summer. No one was supposed to know about it — Sports Illustrated used local cops and their own security goons (I had a run-in with one of them who was violating my right to walk on the promenade) to help keep the public away from the models, photographers, and the 15 or so hangers-on who always attach themselves to photo shoots and get paid for it (I experienced a lot of this when I worked in magazines in New York — a typical photo shoot is a disgusting waste of money, but I digress). In the end, it’s been a good thing for Cape May — the beaches and the town look beautiful, both in the magazine shots and in promotional videos that were released. And here’s an interesting tidbit, courtesy of local writer Karen Fox, who tells the story of how the Swimsuit Issue began in her book The Chalfonte. The idea was born when the magazine asked fashion reporter Jule Campbell to go on a shoot to fill space in the less interesting winter issues with beautiful models. The first issue, released in 1964, featured a cover photo and a five-page layout. Campbell took the idea and ran with it, working with the

HE city of Cape May’s decision to dissolve or leave our regional high school district may be good news for some lawyers, but it’s bad for our school and worse for our stu-

dents. As both Cape May and Lower Township bulk up their legal budgets for the long and costly slog through the Department of Education and into the courts, a cloud hangs over our regional school, and its ability to budget. Before we proceed any further down this road, I appeal to Deputy Mayor Jack Wichterman, Cape May City Council, and Cape May voters: Let’s not go to court, let’s go back to school. Cape May does not really want to dissolve our school, or hurt our students. But Cape May has been listening to a lawyer for hire who says the current funding formula, based on property valuations, is not “fair.” The same lawyer advises Cape May to pursue a long legal strategy to “explore more equitable alternatives.” In our state, each and every child, regardless of zip code, has a right to a

good education. That’s why the state has chosen property valuations as the fair way to fund education (and many other vital municipal, county and state services). As a 20-year local taxpayer now paying more than $3,000 a year in school taxes (even though my wife and I don’t have children), I can understand why some might prefer a formula based on the

number of children they have. But it only took a tour of our local schools for me to see the amazing deal I was getting for my tax money. Classes, from botany to boat-building, led by passionate teachers desiring for their students to learn and find their purpose in life. One only has to see our schools (and imagine our community without them) to realize the priceless return on our investment. So I invite Cape May voters to join our two councils for a tour of our regional school, with tax bills in hand. Let’s then ask ourselves: Isn’t this a great deal for all of us? Isn’t our arrangement better than each town building its own schools? Finally, isn’t it fair that those of us with means and without children should fund the blessing of education for all our children? Please, let’s not go to court. Let’s go back to school! HERE’S a wee hint of spring in the air, and with it, a chap’s sap rises, he gets a little swagger in his step and he thinks ahead to this fine city’s famous, secret Summer Solstice Festival. Famous AND secret, I hear you say, puzzlement on your face as you scratch your head. Well, dear friends, it is famous among those of you who know, and secret from the rest of the world. And for very good reasons: I know that in these modern times, with aye-phones and suchlike, we scoff at The Old Ways, but have you ever wondered why Cape May enjoys such a blessed existence, free from tsunamis, sea serpents, ghost ships and the ebola virus? One solstice day, long, long ago, when we all wore animal skins and crude axes were our primary tools, we were debating a particularly fierce drought in these parts. Some present were for digging a canal from wetter parts, which would have made us the first irrigated civilisation in the world. But that seemed like way too much work, and I opted to strike

I took the credit, as one would, and that, as they say, was that. Every year we perform a human sacrifice and every year we continue to be the best seaside town in America, and grow in prosperity. We do change with the times, of course — we are not savages: we moved on from clubbing our sacrificial ‘volunteer’ to a spell of burning them in a longship,

to setting an interesting basket alight with them inside, through a few decades of surprise assassinations using a knotted silken cord (we were lucky enough to have a vacationing group of Thugees from India here one year: charming lot, though rather prone to extreme reactions if service was not up to scratch: we got through dozens of extra serving staff that summer) to submerging them in an automobile in the town pond (“what pond”? I hear you ask... well, exactly, it soon filled up and had to be asphalted over to save a major scandal). Nowadays we are a lot more populist and in tune with current affairs: this year, for example, we are pleased to announce that the ‘winning’ candidate will be a banker, most likely one of the self-declared ‘one per cent’, who will be placed inside a brass replica of the Wall Street bull, under which a heap of junk bonds will be burned. “Callous, cruel and yet strangely fascinating”, I hear you say? Well, yes: such was actually Cape May’s official motto until not too many years ago. Prepare for summer!

Dear Answer Lady I feel like the only person in the world who does not text. Has it completely replaced actual conversation? I think it’s tiresome and rude. Am I hopeless? Dear Reader The Answer Lady believes you mean: “Is texting going to go away, so I needn’t bother with it?” and the answer is “No. No, it is not.” Yes, texting is omnipresent; we’ve seen people texting while driving, at parties, and in restaurants and bars. The Answer Lady even witnessed someone texting at a funeral — in the church. On the upside, texting has substantially lessened the number of annoying, often inappropriate, conversations one is forced to overhear in public. On the downside, texting has contributed to the bastardization of the language, as in: “R we going

to C U?,” which is text-speak for, “I’m just very lazy.” (The Answer Lady herself recently used the @ symbol in place of the word ‘at’ while texting; thankfully the friend with whom she was texting quickly reminded her that she is not a 13-year-old girl and she was able to correct her behavior immediately.) Texting is a tool, which, when used properly and efficiently, can serve us well, conveying quick messages without the need for lengthy conver-

sations. Not all of us are good at it, and maybe not all of us SHOULD do it — much like the way that not all of us should reproduce just because we’re capable. But the Answer Lady would hate to miss out on a group text like: “We’re all meeting at the Oyster Bay bar at 5pm for happy hour.” Wouldn’t you? Dear Answer Lady I have a friend who initiates text conversations and then drops them – “Got plans this weekend?” and I’ll say “Just lunch Saturday — why, what’s up?” And then... nothing. For hours, or even days. Am I crazy or is this rude? Dear Reader Yes, this is unspeakably rude. In fact, there should be some sort of public shaming or other sanctions enacted for this offense until it becomes a thing of the past, like plaid polyester pants. This very thing happened to the Answer Lady recently and she called the person in question to scold. To add insult to injury, his voice mailbox was FULL, which she believes should be an offense punishable by jail time.

Todd R Pierce, a retired detective, substitute teacher and coach, lost his life in a car accident while visiting his sick father in California last year. Friends organized a benefit to help the family — wife Mary is unable to work due to illness, and and 20-year-old daughter Katelyn is a college student — and $15,000 was raised. “He was a very cool guy,” says Marion Hubbard, who bartended with Todd at the Villas Fishing Club. “Very down to earth. THE BIG EXIT ZERO Q&A NBC SPORTS PRODUCER BILLY MATTHEWS

N THE 26 years that Cape May resident Billy Matthews has worked for NBC, he’s visited 20 countries, produced seven Superbowls, won 12 Emmys, and drank the milk of one pigeon. Apparently, this is not an uncommon drink in Sochi, Russia, which is where Billy was last week, producing the Olympics, which more than half of all American television viewers have watched on the NBC networks, and answering all of Exit Zero’s most pressing questions… When we first spoke, you were driving through Sochi security. How intense is it? This is my 11th Olympics, and aside from Beijing in 2008, this is probably the most intense. In addition to the metal detectors and the checking of bags and the bomb-sniffing dogs, I have tape put around my vehicle after getting inside, to make sure nothing is snuck in through any openings while driving from my hotel to the Olympic venue. Let’s back up… are you from Cape May originally? Yes. I graduated from Lower Cape May Regional High School in 1984, and from Rutgers University in 1988. I’ve been with NBC ever since. I know you have two adopted sons… do they realize where their dad is? My wife Nancy says every time they see a man on the street, they say, “Dada,” so they realize someone is missing, but they’re too young to understand. Nancy is doing a stellar job keeping everything going while I’m gone… it’s been almost a month now and, in addition to

caring for the boys, she’s a full-time vet at Cape Veterinary Hospital. She deserves a gold medal. Where are you staying? I’m about 40 miles outside of Sochi, in what they call the Mountain Cluster. It wasn’t really a town until the Olympics. The hotel was built for the games, and we’re the first people to stay in it. Many of the local buildings were still being put together when we arrived; a Baskin Robbins across the street that was full of sheetrock on day one was open for business two days later. So they were a little behind, but now they’re firing. The mountains here are some of the best for skiing and snowboarding, outside of competition, and they are untouched. Hopefully, this place will become a ski and vacation sport for the world. So the accommodations aren’t as bad as we’re hearing from journalists? Picture having the Olympics in Philadelphia. Someone staying in a bad part of the city might not be staying in a nice place, but that’s true for any place you go. If your toilet is not f lushing, that’s because you chose to stay in a place without a f lushing toilet. I’ve had no problems. Maybe one cold shower, but that’s likely because they were working on the plumbing at that moment. What does your job entail? Can you walk me through your day? Well, there are 12 producers at the Olympics. Some are in the studio; Bob Costas will have one, and there’s

another for the afternoon show. Then there are venue producers covering the games. I’m a venue producer for snowboarding and freestyle skiing — moguls, aerials, racing. It’s pretty much deciding what to put on air, how much is worth putting on, who makes it on, that sort of thing. I’m in a control room in a truck, talking to announcers in their ear, saying things like: “We’re going to show Shaun White, then go to commercial, then show these three people and go to commercial…” I usually leave the hotel about 6am, arrive on site by 7:30, and get home about 11pm. The New Yorker magazine wrote an article following the infamous Bode Miller interview questioning whether NBC’s coverage has gotten “mean.” How do you respond to that? I always say, believe it or not, that not everyone has a story. The back story of some people is, simply, that they are middle class and good at their sports. But if there’s a true moment, well, there’s a real moment. I’d rather have it be raw and true, rather than poke at something that’s not really there, for the sake of getting at viewers’ emotions. So are you in the reporter’s ear, telling her to back off or keep going? Yes, and we discuss beforehand about different scenarios. The other day, snowboarder Lindsey Jacobellis, who overcame injury and has never won a gold medal, fell and lost the lead. THE EXIT ZERO Q&A From Page 41 emotionally, so we didn’t poke it. But if the athlete brings it up and starts saying, “This is the worst day of my life,” we ask why. If you listen, Bode Miller brought it up, saying it’s been a rough year. The other thing is… this is an entertainment event. I’m not saying the competitors aren’t athletic, just that this isn’t traditional sports coverage. A lot of people tune in to see back stories or people overcoming adversity. The ratings are so much higher than, say, a World Series game, which proves you’re getting a larger audience than your typical hardcore sports fans. Have you gotten choked up at all? Here’s one for you: Sarah Burke, a Canadian women’s freestyle skier who pushed to have women’s superpipe skiing included in the Olympics, died in an accident at the age of 29. The sport is in this year, and her family is traveling here today to see that vision realized. There’s nothing gimmicky, just a good story. What’s been your personal Sochi highlight? I’ve been in charge of covering a lot of the younger action sports where Americans have swept gold, silver and bronze. I get to say, “I produced that coverage,” and that’s exciting and rewarding. And the low point? Well, the morale here was really low when the Russian

hockey team lost. But, it’s like with print media… I cover my beat. I don’t get a broad spectrum of Olympic coverage while I’m here; I can’t watch NBC! So if I ask you what you thought of the opening ceremony…? I was sleeping for most of it! How much experience have you had with the sports you cover? I’ve never been on a snowboard.

You’re meeting people from all over the world; how many have heard of Cape May? It’s definitely a conglomeration of cultures, and a lot of people HAVE heard of Cape May. Many will say, “Oh, it’s so pretty, I vacation there.” Others will ask if it’s near New York City, I’ll tell them yes, and they’ll say, “That must be exciting.” And then I have to say, “Not that close.” How long prior to an Olympics do you

start preparing? With winter and summer alternating, once one is done, we start gearing up for the next. But I still work on other spots. I land back in the States, and then have to be in Greensboro, North Carolina the following Saturday for gymnastics, and then I do a hockey game in Pittsburgh next week. God, I love my wife. Something I’ve noticed is that everyone working for this Olympics — absolutely everyone — is 100% volunteer. They’re not getting paid; they’re doing it for the pride of their country. Actually, a friend of mine went up the chair lift earlier, where he sat next to a guy from Columbus, Ohio. This guy read that Russia was looking for volunteers and he thought to himself, “Hell, yes.” He’s now living in a flat with a bunch of people, having a blast. In America, they have to pay everyone. Any other Sochi trivia? It doesn’t get light here until 8:15am; it’s pitch black at 8! Also, there are no ice cubes in Sochi. And I just had a sip of pigeon milk. I kid you not. Can’t get that at Lucky Bones.

Historical Editor Ben Miller picks some of his favorite memories from America’s Original Seaside Resort

T

HAT cute little blond-haired boy sitting in the sand is me, back in 1976, with my brother Chris, sister Jen, and the Collura brothers, Kevin and Kyle. Being only 18 months old, I can’t say I remember this day, but the picture tells many stories. The first thing that catches my eye is the landmark Windsor Hotel in the upper right of the shot. This was taken three years after the hotel was closed by the City of Cape May for multiple fire code violations. Lawsuits and innuendo punctuated the significant differences of opinion between the hotel’s owner, Reverend Carl McIntire, and Mayor Bruce Minnix. The poor relationship between McIntire and the city continued even after Minnix’s successor, Mickey Blomkvest, took office. Because of the distance, it’s impossible to see that the Windsor is in a serious state of disrepair with large boards covering the windows. The hotel had

sat empty and decaying on one of Cape May’s prime beachfront properties for three years at the time of this picture and remained that way for another three years, until it burned to the ground on the morning of May 18, 1979. Although arson was suspected, no one was ever caught and, since the building had no insurance, the property was sold to pay off back taxes and other bills. Reverend McIntire lost all the antiques from his other properties that had been stored in the hotel, forfeited all profits from the sale of the land, and walked away with only a small unit in the new Regency Condominiums that were built on the land. If you look closely you’ll see the small Cape Motel just beyond the Windsor. It was your standard L-shaped, one-story motel, as was the style in the 1970s. The great thing about the Cape Motel story is the ending... it is still standing in the same location. Those of you who know Cape May

fairly well might think along the lines of, “Wait a second. I know that land is home to the Sandpiper, so how can the Cape Motel still be standing there?” It’s a fair question and the answer is a good one. When the Sandpiper was built in the early 1980s, rather than demolish the Cape Motel to make way for it, they simply built over and around it. The first f loor of the Sandpiper is primarily made up of the old motel. Oh, and for those of you who visited my exhibit at the Emlen Physick Estate in 2012, From the Pages of The First Resort, take a look at that wooden oar sticking out of the Cape May Beach Patrol dinghy — it was hanging on the wall of the Carriage House as part of the exhibit. Back around the time this picture was taken, the oar snapped and broke in the oar lock. My brother, who had become a mascot of sorts for the CMBP, was given the oar as a souvenir. HERE are a lot of strategies for dealing with the winter blues. Some are good for you, like spending time with friends, volunteering, or indulging in extra exercise and extra sleep. Others are less so, like whining or indulging in extra wine and extra chocolate. Sometimes it takes something small, like dressing in bright colors or cleaning out the linen, closet to shake you out of a bad mood. Sometimes it takes a mental challenge: a jigsaw puzzle. A concert. A chance to learn something new. Like these for example... Put all the drama in your life onto the page with the East Lynne Theater Company’s playwriting getaway weekend on February 28. This event, held at the Henry Sawyer Inn, combines workshops with free time for writing. The cost is $399 for two people and $299 for one (plus tax), which includes accommodations, breakfast, afternoon tea and treats for two nights, and the workshop fee. yard pond with the help of wildlife expert Pat Sutton, as part of her series of workshops sponsored by the Nature Center of Cape May. Other workshops topics include battling invasive plants and wildlife-friendly landscape design. Helpful handouts are included. The cost for each workshop is $45, $35 for members of the New Jersey Audubon Society. Preregistration is required and each

workshop is limited to 20 participants. The workshops are held at the Cape May Bird Observatory Center for Research and Education, 600 Route 47N, Cape May Court House, and include a site visit to Sutton’s nearby wildlife gardens. PRING is in the air. Literally. Early breeding species are signally their intentions to each other in song. It seems that every morning some new species is adding his voice to the choral lineup. Yes, his... in most bird species only the males sing — although some, like wrens, duet. One species that tunes up early is northern cardinal. The song is a loud series of short, whistled notes commonly given in two segments of different volume, duration and cadence. Example: TEW, TEW, TEW, TEW–too, too, too, too, too. You can go online and find websites that offer bird vocalizations to accompany descriptions. But you already know what a cardinal looks like, right? If not, leaf through that pile of undiscarded holiday cards — cardinal is the bright red bird featured on about half of them. Another early vocalist is Carolina wren, whose song is a loud, ringing, and repetitive three-note whistle. Phonetically rendered it sounds as if the bird is saying, “cheeseburger, cheeseburger, cheeseburger” over and over again.

Mockingbirds, too, chime in early with a loud and varied series of whistled phrases, many repeated several times. One species just joining the hit parade is house finch, a small, streaky bird with a red wine-stained head that warbles like a happy drunk and ends its song with a rough-sounding p’chew. Cardinals and mockingbirds commonly sing from old television antennas. House finch are fond of utility lines as are mourning doves, whose plaintive two-part cooing is a somewhat owl-like coo-oooha;

coo coo, coo. Woodpeckers also get in the act early — but, rather than sing, they play. They’re percussionists, drumming tattoos on resonating tree limbs. Aluminum drain pipes. And anything else that can be used to beat out a tune. On warm days American robins can be heard caroling. Since January, male redwinged blackbirds have been flashing red epaulets and breaking winter’s hold on the northern hemisphere with their classic tur-a-ling incantation. Even this year’s incessant snow storms can’t halt the procession of one season into another. The angle of the sun always trumps — and birds set their clocks by the sun. So, why not take a walk and treat your winter weary soul to a bit of spring. The sound will go right to the heart and warm your spirits, no matter what the air temperature happens to be. If you care to see what the members of the chorus look like, head to Cape May Bird Observatory, 707 East Lake Drive, Cape May Point, and test drive a field guide or two. You might also find someone who can decode a snatch or two of song.

HE Oscars are coming, and Cape May Film Society celebrates with its annual party at Mad Batter (thanks to Mark and Pam!) on Sunday March 2 at 5:30pm. Food, prizes, cash bar. You get the idea. And what will you be talking about there? Perhaps you’ll be talking about American Hustle, a film that appears to be a front runner (in a lot of people’s minds at least) for Best Picture. The film is fantastic, the acting is (and better be) superb. I say “better be” because let’s face it this is a premiere cast that’s paid dearly to turn in award-winning performances. There isn’t much to say about the film that’s negative. The story is well told, the acting… well okay didn’t I just say superb. But still… there is something here that doesn’t scream Oscar! What is it? I don’t know. Whenever I’m in this quandary, I usually blame the story, but I really can’t say that here. So what is it? If you come to our party (did I mention, Sunday, March 2, 5:30pm, Mad Batter — fun, fun fun!), perhaps you’ll talk about films that didn’t make the Best Picture

list. Many of you thought The Butler (or at least Forrest Whitaker or Oprah Winfrey) was snubbed. August: Osage County got actress nods, but did it deserve more? Gayle Stahlhuth, Artistic Director of the East Lynne Theater Company (who says she’ll be at the Oscar party) says of August: Osage County, “There isn’t a false note in this film, and no sugar-coating. Meryl Streep and Julia Roberts have never been better. The play landed a wallop, but

the film lands a punch!” And I cannot agree more! The movie left me speechless. When you get to the dinner scene, and Streep’s character enters to completely take command as a matriarch, you are simply captivated. Words can barely describe it. I get chills thinking about it now. Wait! That’s what I want from my Oscar winner. Did it give me chills? Do I still get chills thinking about it to this day? Oscar and I rarely agree. The King’s Speech (Best Picture, 2010) did not leave me speechless, and I only liked (didn’t love) The Artist (2011). I have to go way back to 1993, when Schindler’s List won to agree with the Academy regarding a truly captivating Best Picture. The eye of the beholder casts the true ballot, right? OME may think that Cape May arrived, fully formed, in its picturesque, Victorian state. On a midsummer’s night walk down Jackson Street, the stroller feels as if time has stood still on a street built possibly by god — it’s so beautiful. But in fact, every house in town, every motel and hotel that makes Cape May what it is today was born of a tug-of-war between the owners and the city government, with a third group of historical preservationists also often pulling the rope, and nearly every building speaks to tradeoffs that each made over the years in the interest of making Cape May the town we love. Take the example of Congress Hall. It’s a hotel that has become a favorite of the famous and well-to-do in the 21st century. At the turn of that century, no one would have believed it possible. In the late 1990s, Congress Hall looked to an outsider like it was headed the way of its foster brother, the Christian Admiral. Many of us still mourn the loss of the Admiral to the wrecking ball in 1995, and few thought Congress Hall would avoid the same fate. Fires, water damage, and structural damage had left walls unstable, and the hotel C

THE LEGAL COLUMN From Page 75 mostly vacant for the last few years of the 20th century. Luckily, one of the few who thought it could avoid that fate had the wherewithal to do something about it. Curtis Bashaw, a grandson of the former owner of both the Admiral and Congress Hall, brought together a myriad group of investors and asked for federal assistance (by way of loans and grants) to transform the building into the grand dame she was in earlier years. For the most part, the City of Cape May did what it could to support Bashaw. But there were some who did not view Bashaw’s plans for a renewed Congress Hall through rose-colored glasses. History credits a number of local men and women with helping to preserve Victorian Cape May in the 1960s and 70s after the wrecking ball had, in the name of ‘progress’, visited a number of formerly magnificent Victorian homes and inns. A group of people decided to initiate litigation with the city, the state, the federal government, and Congress Hall’s owners regarding the redevelopment of the hotel. The litigation was taken seriously, even if in hindsight it’s easy to say that the dissenters picked the wrong battle. What was that argument? If one reviews the litigation that arose, it was a

convoluted one. In law, there is an old saying that goes, “if you have the law on your side you argue the law; if you have the facts on your side you argue the facts, and if you have neither the law nor the facts then you bang on the table.” In my opinion, this litigation was about banging on the table. In the main, the group complained that the city had not followed proper administrative channels in approving the proposed renovations to Congress Hall. Following proper procedure is, of course, important, but if the merits of Bashaw’s ideas for the new Congress Hall were sound, then arguing procedure sounds like sour grapes. The courts seemed to think so, anyway. Secondarily, the group also complained about the way Bashaw intended to manage The Great Lawn, the expanse of grass that sits in front of Congress Hall. The objectors felt that Bashaw’s intent to use part of the lawn for parking was improper and not historically accurate… but that argument failed to account for the fact that a good portion of the lawn had been used for parking for several decades by the time Bashaw made his move towards renovation a hotel that many thought unsalvageable. It is this dispute over the lawn that led the federal district judge who reviewed the dispute to offer up the quote with which I started this article — that romantic views of Cape

May have to sometimes give way to progress. And may I add, fighting about a lawn and parking on that lawn — even a Great Lawn — in federal court seems like a bit of a waste of time (and money), both for the litigants and the court system. In Cape May, I generally favor Lady Justice putting her thumb on the preservationist side of the scales as opposed to the side in favor of “progress.” Yes, I am sometimes guilty of romanticizing the past. But, when it came to Congress Hall, favoring progress instead of over-romanticizing the past led to the magnificent re-creation of one of Cape May’s grandest dames. Three cheers, in this case, for progress! PS: In the last issue, I erroneously wrote that the seven gingerbread buildings on Stockton Row were comprised of five B&Bs and two whole-house rentals — it’s the other way around.
