Ramblings From The Editor

Ideas, idle gossip and occasionally important odds ‘n’ ends... by Jack Wright

e wish Cape May’s new Chief of Police Rob Sheehan a long and successful tenure in his office at City Hall — and not just because it’s a really good idea to stay on good terms with the men in uniform. Chief Sheehan has always come across as a genuine, down-to-earth guy with his heart, and his head, in the right place. And I happen to think both of these are important in a town like Cape May. Yes, of course, we should all follow the letter of the law but good sense and proper discretion have sometimes been overlooked in Cape May and it hasn’t always been the fault of the CMPD. I remember one of the most embarrassing things that has happened to this town in recent years — that shocking idea, a few years ago, of pulling over and ticketing drivers who weren’t wearing seatbelts as they headed into town on Lafayette Street over Memorial Day weekend! This was part of a safety campaign mandated by then Governor John Corzine — for “safety campaign” you might also want to read “fundraising campaign”. We SHOULD all wear seatbelts but people coming to relax and spend money in this town should not have been targeted in such a manner — it was like shooting fish in a barrel. At the time Mayor Jerry Inderwies was horrified such an action had taken place without council’s knowledge. Turned out it was the idea of then City Manager Lou Corea who tried to say that the state had forced such an action — but the state never told individual municipalites WHEN to target drivers. Memorial Day weekend was apparently Corea’s idea. Then there was another shooting-fish-in-a-barrel policy of ticketing drivers who parked on Park Boulevard while attending festivals in Wilbraham Park. Again, people should not have been parking there, but the signage was far from adequate. In recent years, this has been sorted out. My point is... the police need to remember that their department, and this town, would be in a pretty bad way if it were not for the millions of dollars of tourist money that comes into city coffers. I get the strong impression that Chief Sheehan is well aware of this and will run a department that shows common sense, and compassion, when they’re called for. We called Lucas Manteca who, along with wife Deanna Ebner, owns The Red Store in Cape May Point, early on Monday morning. He was likely very tired since Monday is the day after Sunday, when The Red

Store’s much buzzed-about Brunch Club, for which Lucas is up and prepping by 3am, takes place. But the Argentinian-born chef was happy to talk with us while on his way to check the waves for surfability — a passion for Lucas behind only food and family in his list of priorities. The topic of our conversation? A 10-acre stretch of land off New England Road which Lucas and two partners — land owner Tom Rossi and farmer Jaime Alvarez — will transform into a sustainable, community farm called Fincas del Mar, or Farms of the Sea. It’s an idea that’s been in the works since Lucas’ days of working at the acclaimed Blue Hill at Stone Barn in upstate New York, which sources ingredients from its own land. “It exploded my mind,” Lucas says, in his ever-endearing, English-as-a-second-language way. His was the first stool on the left when you sat down at Dellas’ 5 and 10 soda fountain. He could be found there every morning having his coffee, talking politics. Young adults remember him as the Little League umpire who would not hesitate to call it a strike, even if you were his niece. Folks remember him as someone who would not hesitate to tell you exactly what he thought, even if you were his brother or his friend. Above all else, he was a man known for uncompromising integrity. His name is Allen Major and he will be sorely missed. Fans of the Merion Inn (and there are many) will have noticed that the restaurant hasn’t opened this year and isn’t able to take reservations. This is, sad

to say, down to a financial dispute between the owner Vicki Watson and the contractor who began repair work on the building after a fire in December 2010. The Merion and the contractor have been in litigation for the last two years but Vicki is hopeful that “some good things are in the works so keep your fingers crossed.” I second that emotion — the Merion is more than a restaurant, it’s an institution, and a beloved one at that. I also want to do a shout-out on Vicki’s behalf for help with the Third Annual George Mesterhazy Tribute Concert, which will be held on June 8 at Convention Hall. The Mid-Atlantic Center for the Arts and Humanities will once again provide core funding for the concert but another $7,000 is required in order to make the concert happen. The new size of Exit Zero continues to provoke spirited debate. I have received quite a few more positive comments than negative ones but I do, naturally, take the views of readers and advertisers very seriously. But listen, we are committed to this new size for the whole of 2014 and at the end of that time we will see how we all feel. Just the other day, one lady in her 70s visited the shop and said, “I love the new size! It’s to easy to turn the pages.” And yet, last week, a good friend of Exit Zero (a lady in her 60s, for what it’s worth) said she found it hard work turning the larger pages. So you can see how opinions differ quite sharply. Me? I love the bigger photographs — they deliver so much more impact — and I really love the little popup bubbles that accompany our photographic coverage, and they wouldn’t have been possible with the previous size. To Baldly Go... More than 60 students and faculty from Lower Cape May Regional High School and Richard Teitelman Middle School have reached out to family, friends and businesses for donations to the Saint Baldrick’s Foundation, which funds childhood cancer research. On March 28, the effort will culminate in a headshaving event, where all participants will have their hair sheared off in a show of solidarity. The goal this year is $40,000, which would add considerably to the grand total — this has been an annual event since 2010 — of $108,675. “I am beyond proud,” says LCMR English teacher and St Baldrick’s organizer TJ Belasco. A special shout-out, he adds, is due to businesses who’ve offered support, including The Crab House at Two Mile Landing, which hosted a beef and beer for the cause, and Cape May Brewing Company, which will donate a portion of the proceeds from their St Paddy’s Party. Ah, those good old Cape May days... by Jackson D’Catur

rather miss the snow. I know, I know, we are all overdue some sun, and to be honest I was rather bored of frostbitten digits (I refuse to wear gloves, no matter how bitter the cold: the habit stems from the time I led Russian troops in driving Hitler’s devils back from Moscow, and I had to have my trigger finger free at all times. Also, when wolves attacked, and one’s gun had jammed in the cold, one had to poke them right in the nose, hard, and mittens rendered that action not just futile but amusing to sadistic bystanders). Actually, Young Albert has refused to leave the D’Catur Mansion for the last month until he was assured there was no more snow. I understand his motives, whilst deploring his drama and need for attention: he had wandered off one cold evening to find a rental car or stray tourist to pee against and it was so cold his wee turned to ice mid-stream, attaching him firmly to the hubcap of a rather tacky Ford from Philly. The car had then driven off, with Albert spinning like a dervish. All of this I had deduced from the scene of the crime when I went looking for him:

I saw tiny footprints, a newly vacated parking spot and a Yorkie-sized trench in the deep snow running closely parallel to the tire tracks. Albert is nothing if not resourceful, though, and I worried not: I simply had my Faithful Manservant, Kitchener, deactivate the minefield and machineguns between the side gate and the kitchen door, and sure enough, a week later, Albert returned, still a little dizzy and furious, dragging a shattered hubcap and what seemed to be a tattered size 16 white sneaker. I asked no questions and he

offered no explanations. Since then, though, Albert has been a house dog, much to the annoyance and worry of the staff, who have taken to carrying cudgels when alone on the upper levels, in case he decides to play. So, the thaw has been welcome, though I admit there have been some surprises under the deepest drifts in the shadier parts of the garden. The frozen Mormon missionaries were a mild surprise: I told these clean-cut lads that lightweight nylon suits were not ideal for the bitter cold as I chased them from the porch with my walking cane. And the hibernating polar bear was certainly not expected, nor easily explained. His anger at being roused was a little extreme, I think, and as a result he now occupies pride of place above the fireplace in the library, his expression a mix of rage and surprise that I had Ernie Hemingway’s Elephant Gun with me on a simple walk in the grounds. Always be prepared, says I and the Boy Scouts. Tho their preparedness does not include large bore weaponry and a brace of hand grenades, I will wager.

One Happy Turtle Meet Tina, who came to the Nature Center of Cape May via Weis Ecology Center in Ringwood, New Jersey. “That center closed and they needed to find homes for all of their animals,” says Nature Center of Cape May Director Gretchen Whitman. “She is at least 20 years old and has been used in education programs all of her life. She is a feisty lady, very personable and sociable.” In the warmer months, Tina even has her own outdoor pen. Here she is enjoying her fruit salad lunch! Dear Answer Lady I’ve been invited to a St Patrick’s Day party by my ex-boyfriend. We are still friends, even though he has a new girlfriend. He throws great parties and, in the interest of civility, I’m going. The problem is I’m not a fan of the new GF, and, to add insult to injury, this is a “must wear green” gig, and I look terrible in green. (She, on the other hand, is one of these looks-great-in-a-burlap-bag types.) I know it sounds ridiculous, but will I look like a spoilsport if I don’t wear green? – Dear Reader Excuse the analogy but it seems to the Answer Lady that you are asking her if you have spinach in your teeth when, in fact, your hair is on fire. Whether or not you should wear green to this party does not seem to be the proper inquiry, when it

seems evident that you are not over this relationship and you have as much interest in socializing with the new woman in your ex’s life as you do in sitting through a contentious city council meeting while having to pee. While civility is a drum the Answer Lady is very fond of beating, she is not a fan of inf licting uncomfortable situations upon ourselves when it is wholly unnecessary. Civility with an ex means not throwing a drink in his face

at the Mug, at least not when it’s really crowded. It means conducting oneself respectfully in public (whether or not the other party, in fact, deserves such respect). It does NOT mean forcing oneself to appear on the other party’s home turf to witness one’s replacement prancing about in a color which everyone is arbitrarily wearing for a day and which makes us look less than stellar. Yes, a great party is a wonderful thing but if you’re suffering through it, why bother? Go get a corned beef sandwich and a beer with a close friend. Dear Answer Lady I’m an old-fashioned Italian guy, and I just fell in love with a crazy Irish woman. Can this work out? Dear Reader You live in a town where a Carney’s and a Cucina Rosa peacefully coexist. Differences in temperament, upbringing and custom can be celebrated if both parties are willing. The Answer Lady does feel compelled to point out that “crazy Irish woman” is redundant. Twice. Carry on, and mazel tov!

O

n March 4, after 24 years with Cape May Police Department, Robert Sheehan, Jr, son of former CMPD Sergeant Robert Sheehan Sr, became the city’s new Chief of Police. We sat down with him to discuss the man behind the badge. Have you ever been arrested? No! But I have gotten parking tickets. [Editor’s note: He really has. Chief Sheehan showed us at least eight, all of them paid in full.] That’s pretty funny. It was when they were $15 each, not so much know that they’re $32. People will come to me and say, “I got this parking ticket; is there anything you can do

for me?” I say, “Yes! Go downstairs and pay it like I did!” Let’s back up. Are you from Cape May? Yes, born and raised. Growing up, I thought the world revolved around that little league field next to the elementary school. Did you always want to be a police officer? You know, I’ve been thinking about that a lot. I think maybe on a subconscious level I did. I went to Stockton University and got a degree in Business Administration and I remember people asking, “Aren’t you going to a be a policeman like your dad?” And I always told them no. Lo and behold, I ended up taking the test for the heck of it, to keep my options open. Then I got into it and I really enjoyed it. It was like… of course. Of course I should be doing this. What was it like, having a cop for a dad? It was nice having him around; if he was working patrol, he’d stop at home

for dinner. What’s the worst job you’ve ever had? My dad had a landscaping business — Lawn and Order. I pushed a lot of lawn mowers, and it was horrible. Now you have a family of your own? I have a wife and three kids, ages 16, 12 and 11. They must think it’s pretty cool their dad is the chief, right? I don’t think they care! I remember my daughter saying to me once, “Daddy, you’re not a real police officer, right? You just sign your name all day!” Would you be okay with them following in your footsteps? I would. It’s a very rewarding job. I like coming to work. I like being a policeman. But the shiftwork can be tough on you physically. And sometimes, being exposed to certain stuff, to hostility, to the bad guys... it’s not C March 13-March 26, 2014 EXIT ZERO Page 41


THE EXIT ZERO Q&A From Page 41 the best thing in the world. Has it made you more cynical? You know, it’s funny… not as much as you would think. This might sound like a piein-the-sky kind of thing but you see people’s backgrounds and you see that not everyone has had the same opportunities as you, so you feel more compassion. Also, sometimes good people do dumb things; it happens. It’s that old concept: To know all is to forgive all. I imagine you also get to see humanity at its best. Do you have an example of that? I always think of this time I was working patrol down in Village Green before I had children. It was the middle of night and there was a car that kept driving around the block. I wanted to know if he was casing the place so I pulled him over and I figured I’d take a gentle approach. I said: “Hey, are you lost?” But the driver was just trying to put his baby to sleep. You mentioned being exposed to hostility. Do you think there is an inordinate amount of hostility directed at Cape May’s summer cops — the yellow shirts? Yes, because at times they have to do our dirty work. They’re the ones who have to tell the kids they can’t bike up here, or can’t be skateboarding here, but there’s two sides to every story. Merchants call us to say

In their defense, they get the dirty jobs. There’s no glory in a parking ticket, especially a meter ticket. Am I using a derogatory term, calling them yellow shirts? I think that’s the best name they’ve gotten. We know people call the police when they’re in trouble, but what are some of the more surprising calls you’ve had? You’d be surprised how many people call wanting

to know what time the fireworks are on the Fourth of July. We also get calls about injured seagulls. Or when people find a bat in the house. What’s bat-in-the-house protocol? Duck! Seriously, I think the officers can be half as scared as the people. You wing it, pardon the pun. What about the strangest call? It happened on a Sunday night. The caller said he’d accidentally stabbed — or maybe it was that he’d accidentally slit — his friend’s throat. So you knew something was up… I mean, when’s the last time you accidentally slit your friend’s throat? An arrest was made. What is your goal as chief? Really getting back to basics. This is stuff we’ve been good at over the years, and I’d like to concentrate on it more — better interaction with businesses and more of a focus on residential areas. Sometimes there will be a higher concentration of summer officers on the mall or out in front of a bar. My plan is really to spread the wealth, so to speak, and to have good bike patrols in the Village Green section and some other areas. I think you can’t go wrong with that. Police work requires a certain level of strength and toughness. What’s the least policeman-like thing about you? I listen to books on tape. I just got done with

Orange is the New Black, and I get through a lot of books this way. Often nonfiction. One summer I decided I would do all of the classics. It took me forever to get through Great Expectations. I should have read that in high school when I was supposed to. Are there any misconceptions about police work in Cape May? Cape May is a great place to work and we’ve had great, quiet years, but we are busier than you’d think. I felt glad when I started working here that I didn’t realize as a kid how busy my dad was; I would have worried. Also, no one gets a toaster for writing the most tickets! And I always like to give the dispatchers a plug when I can. They’re doing one of the most underappreciated jobs in law enforcement. What makes you most proud to be chief of this police force? I believe it is how we deal with the public. I don’t think all police departments everywhere focus on customer service the way we do. When someone comes to us for help we do the best we possibly can, even if it’s not something that’s necessarily in our job description. What’s your favorite thing about Cape May, apart from Exit Zero? Aside from Exit Zero, it’s the people. This is a great community and the members of this force truly want to do the right thing by them and to serve them as best we can.

I

have spent my entire life as a preacher in this state — two and one-half years in Atlantic City and 48 years in Collingswood. I have been most outspoken as a fundamentalist. I have opposed about everything that has come down the road; the race track, bingo, the Atlantic City casino, sex education, abortion on demand, taking prayer and Bible readings from the schools... We have been exceedingly vocal, for the Bible says, “Cry aloud, spare not, lift up thy voice like a trumpet, and show my people their transgressions, and in the house of Jacob their sins.” So began a letter from Reverend Carl McIntire to President Ronald Reagan on August 19, 1981. It went on... “To do this is costly, but the liberty to do so is priceless. Everywhere we have turned we have met opposition from the political forces that have power. We opened a Bible Conference in Cape May. After four years of litigation, the state’s highest tax court said that we were entitled to tax exemption on our Bible Conference property, but

these government officials went into the state courts and had it reversed. When we knocked on the door of the Supreme court, they would not look at it. We are the only Bible Conference in the State of New Jersey that has to pay taxes. “Now we are going the same route with our Christian college. Mr President, we have to have a college... We cannot build our churches, our doctrine, our position in the religious world without a college. Does not one small college count anymore when it comes to liberty? “Have we become so insensible, so numbed so blinded and so intolerant, that a tiny religious college cannot exist in a state where the state officials are determined to close it down unless they direct it...? Our sufferings are real. Our losses are irreparable. But, Mr President, our faith in that Constitution is our one hope for a free America. Unless we can preserve that, our nation will be gone.” The Christian college Reverend McIntire spoke of in his letter, Shelton College,

is shown above in this snapshot taken from the Bible Conference he also mentioned, the Christian Admiral hotel. Shelton College began life as the National Bible Institute and was based in New York City when it was founded by Dr Don Odell Shelton in 1907. Following the death of Shelton in 1941 and the subsequent college leadership of McIntire’s friend, J. Oliver Buswell, Jr, McIntire took control of the school, which had been renamed to honor Shelton in 1950. McIntire moved Shelton to Cape May in 1964 and the building was dedicated on Memorial Day, 1970. Less than a year later, the state of NJ revoked its accreditation, forcing the college to close at the end of the school year. Reverend McIntire relocated the college to Cape Canaveral, Florida two months later. It would eventually move back to New Jersey but it would never fully regain its accreditation, which means it would not be allowed to offer legitimate degrees. The building was briefly used to house the Cape May Institute before the bank-

ruptcy proceedings surrounding Reverend McIntire’s organization, the Christian Beacon Press, forced it to close permanently. It stood silent and empty until about one month ago, when the roof and walls collapsed and Shelton College finally succumbed to the elements.

The First Resort You’ve likely heard that Cape May is America’s Original Seaside Resort, the original vacation city for our country’s founding fathers and its earliest wealthy citizens from Philadelphia and New York City. The town of Wolfeboro, NH calls itself The Oldest Summer Resort in America, but they’re wrong. Wolfeboro was settled in 1768, while Cape May was settled in 1630. Wolfeboro’s claim as the oldest summer resort is based on the building of one estate for John Wentworth in 1770. By that point Cape Island was already a thriving seaside town with an active fishing port and many farmers who supplemented their income by taking in sojourners. The first hotel in Cape May, the Atlantic House, was constructed by Ellis Hughes in 1791. New York City’s City Hotel is regarded as America’s oldest by those unfamiliar with Cape May’s history. herlock Holmes is more popular than ever, thanks largely to the BBC TV drama Sherlock and the CBS show Elementary. The actors who play the legendary detective in each series enjoy legions of rabid fans. Fan clubs around the world for the actors and the character have names like Hounds of the Internet, the Order of the Blue Carbuncle and Mycroft’s Brother. A local group is called The Capers. Female fans of Benedict Cumberbatch, the star of Sherlock, call themselves cumberbabes (or another, R-rated nickname). Fans of Elementary star Jonny Lee Miller don’t have a catchy nickname but he was once Mr Angelina Jolie, so don’t cry for him. The two actors are friendly, having worked together on stage in Frankenstein, but their fans get a little competitive. Since fan sites for both men — and one for Robert Downey Jr, who played Sherlock on the big screen — have promoted Cape May’s Sherlock Holmes Weekend, we could have a donnybrook on our hands. However will Mrs Hudson handle it? A Study in Scarlet appeared in 1886, the

first of 60 Holmes stories and novels written by Sir Arthur Conan Doyle. These stories are the basis for the TV and film adaptations and Sherlock also appears in works by other authors. Shane Peacock writes The Boy Sherlock, a young adult series, while Laurie R. King’s The Beekeeper’s Apprentice introduces fans to Mrs Sherlock Holmes. The Sherlock Holmes weekends are a Cape May tradition. Some people choose to dress in Victorian attire and some in jeans. Some are serious fans and others are just following the fun. You may win the $250 prize for solving the case or wind up

as the “clueless wonder.” Weekend packages are available at $200 per couple or $105 per person, and include the welcome reception, tour, performances and lunch. Packages do not include accommodations. The fun begins Friday, March 14 at 8:30, with a reception at the Inn of Cape May. A House With History The Columbia House on the corner of Ocean Street and Columbia Avenue is actually the fourth Cape May inn to bear the name. It was a daring (not to say reckless) choice for a moniker, considering each of its predecessors were destroyed by fires. Nonetheless, Jim and Laura Zeitler accepted the challenge in 2003 when they bought the building and painted their Columbia House its signature color scheme. Jim, a craftsman at heart, renovated what was once William Essen’s house and it looks better than ever. The Columbia House stands on the same site as the first one, a large hotel which spanned from Ocean to Decatur, and from Beach Avenue just beyond where Hughes is today. The second Columbia House stood between Jackson and Perry, just north of today’s Seven Sisters properties. The third was on Ocean Street, where the parking lot of Victorian Towers is today. — Ben Miller

Dispatches from the nation’s birdwatching capital… by Seymore Thanu

T

he subject today is American robin, Turdus migratorious, a big, burly, ruddy-breasted thrush that strides across lawns and carols with the dawn. It is probably the best known bird in North America — it is found just about everywhere and has acclimated itself to habitats we design for ourselves (suburban yards for example). But one thing the bird is not is a harbinger of spring. There are more robins in Cape May in winter than in summer. In winter robins subsisting on fruits and berries. But as soon as lawns begin to thaw they switch over to earth worms, which is why so many people are suddenly noticing robins. Ten thousand robins roosting in the marsh and disappearing into holly thickets by day are easily overlooked but 50 robins striding across your lawn are going to garner attention. When I was a kid growing up in North Jersey I always equated the arrival of robins with Easter — largely because a lot of them seemed to weave that coarse, plastic Easter egg grass into their nests. Paper products and cloth are also used as build-

ing material to augment the mud and natural grasses that constitute the bulk of the bird’s cup-like nest. The neat thing about the turdus thrushes is that no matter where you travel in the Americas a robin-like thrush seems to have made itself at home. Go to McAllen, Texas and you’ll encounter clay-colored tobins lurking beneath the shrubbery. Same genus, different species, but very similar in structure and behavior. Go to Ecuador and the suburban yard niche is filled by chestnut-bellied thrush or the

all-dark plumbeous thrush, which looks a great deal like the blackbird, the widespread turdus thrush of Europe (of the four-and-twenty-baked-in-a-pie kind). I’ve not tried either blackbird or American robin myself but judging by the partiality shown to robins by our neighborhood Cooper’s hawk, robin must taste pretty darn good. Mind you, I’m not lobbying to have American robin added to the list of game species. New Jersey Audubon fought very hard for the passage of legislation protecting songbirds in the first decades of the 20th century — and just because a thing is common doesn’t mean it is here for our gastronomic pleasure. Yet, and still, there seems no reason not to take a moment and admire one of our most fascinating — and common — birds. A bird doesn’t have to be rare or out of range to be entertaining. So why not take a moment. Go out on your front porch and say “howdy-do” to your handsome neighborhood turdus — the creature that really should have been our national bird.

Hauling In Millions Cape May was known as having the third-largest fishing port on the east coast of the United States until 2009 when it took over the second place spot. The most recent data available is from 2011 when local docks brought in $103 million according to National Marine Fisheries Service. The actual catch was lower from the previous year by three million pounds. That discrepancy is due to the variety of fish that were caught. There is a wide range of fish available in the waters off Cape May, but the commercial fleets primarily specialize in mackerel, fluke, sea scallops, flounder, sea bass and lobster. Of those, the sea scallop industry is by far the largest and most lucrative. Sea scallop prices went from $7.92 a pound in 2010 to nearly $10 a pound in 2011. Of course, that’s the price paid to fishermen. You or I will pay at least double that in a store. — Ben Miller

An Oscar wrap-up by Dottie Knapp, President of Cape May Film Society

o many Oscar surprises, it’s hard to know where to start. Sure, we didn’t expect Captain Phillips to win much — after all it just wasn’t getting the buzz. This was not a bad movie, not bad at all, just not buzzworthy (and obviously not worthy of a single Oscar). Well who knew the same would be true of American Hustle? The movie had been garnering a lot of buzz, but in the end turned out to be a fizzle, with zero Oscars! Again, not a bad movie, not bad at all, just had the buzz and lost it. Between the two possibilities (no buzz or lost buzz) I’m not sure which is worse. The big award was won by 12 Years a Slave, but Gravity gathered up the most statuettes. These two films are the critics’ choice and they receive high praise from audiences as well. And both movies were part of the chatter locally during last week’s Oscar party at the Mad Batter. To quote one of our most beloved volunteers, Lynda C., about Gravity: “I asked myself why I wanted to watch this astronaut bounce off of stuff and talk to a disembodied voice. This is boring.” Got to love

Speaking of jazz, Holly K. did her always show-stopping “All That Jazz” from Chicago and finished with two songs from Frozen, including the Oscar winning “Let It Go.” To all of you who missed this evening start thinking about putting it on your calendar for next year. Mark Miller considers some interesting scenarios on Cape Island... this issue, how the beach tag was born

either my grandparents nor likely yours (depending on your age) had to buy a beach tag for much of their lifetime. Until the 1950s, the state provided free access to the beach. In 1955, the legislature granted municipalities bordering the Atlantic Ocean the authority to charge for access to the beach. Cape May did not follow the state’s lead initially. Then in 1977 the city passed an ordinance that set up six categories of beach tags: 1. Seasonal tag ($13 if bought before May 1, $16 after); 2. Weekly tag for $10; 3. Daily tag for $4; 4. A “20th Century” tag, entitling the owner to one seasonal tag annually up to and including 2000 for $100); 5. Three-day tag for $7; 6. A “decade certificate,” entitling the owner to one seasonal tag annually for a period of 10 years for $100. For many years you could dodge the taggers. I know — I lived it. An industrious person could find a way onto the beach in the late 70s and 1980s without too much trouble — this was before the days of fences and dunes. And if you saw a tagger (all the ones I remember were cute young ladies) you headed into the ocean for a swim until they passed you by. That 1977 ordinance also said that the tags — except for daily ones — could not be transferred. In theory, that meant hotels couldn’t buy seasonal tags to start the summer and then transfer them among guests C

THE LEGAL COLUMN From Page 75 as they came and went. But that’s not what happened. Hotels would buy seasonal tags and give them to their guests to use as they pleased — at the end of a visit the guest returned the tag and the hotel gave it to the next guest in the door. If that doesn’t seem fair, keep in mind that neither Wildwood nor Atlantic City have ever ussed beach tags. The city reluctantly put up with this until 1999, when then they got a little draconian by limiting beach access points. But even with more enforcement the beach tags did not cover the costs of cleaning the beach and providing lifeguards — there was a $100k-plus shortfall each year. The general tax coffers had to make up the difference. This did not make sense to city leaders. So they hatched a plan. As usual, when government hatches a plan it involves raising taxes — in this case on hotel and motel owners who already were struggling to make a buck. The city decided these hotel/motel owners were wrong to buy up seasonal beach tags and transfer them among guests. So it decided to pump up the cost of a “commercial” seasonal tag. This change shrunk that shortfall to $30,000 or so. But boy, did it anger the local hotel and motel owners.

So in 2001 the city went back to one class of seasonal beach tags — but hotels could not buy seasonal tags and transfer them among their guests all summer. A regular joe could make such a transfer if it was ‘gratuitous’ — no charge involved — so I could give you my tag for the day and vice-versa. But the owner of, say, The Montreal Inn? No way. This change took the beach tag program from out of the red and into the black but again angered hotel/ motel owners. It probably didn’t help when one city councilman said that the hotel owners who wanted to buy seasonal tags were greedy. When government calls the honest businessmen in town greedy and makes the businessman’s efforts to make a buck more difficult, look out — litigation usually follows. And that’s what happened. In 2003 the judges of the State of New Jersey decided that allowing an individual to buy and transfer tags while prohibiting a hotel owner from doing the same was unreasonable — even unconstitutional. After that decision, hotel and motel owners should have been able, by law, to transfer beach tags among their guests without fear of reprisal from the city. ken, several years ago the city decided to criminally prosecute one hotel owner by way of an elaborate sting for transferring the beach tags in a manner no different than the courts had said he could in 2003, as best I can tell from the law and the news of the time. (This little bizarre moment in Cape May legal history is worth an entire article itself — maybe another time.) Thankfully, since that strange prosecution, reason has won out. Because of a new state environmental regulation that required beach tags to be freely transferable (which trumped Cape May’s local ordinance) hotel owners can now transfer seasonal tags among their guests. And you’re not breaking the law if you give a tag to your friend. Buying a beach tag helps to make the Cape May beach a better place. I have spent time on beaches all up and down the east coast, and I do not think there’s a prettier, cleaner beach anywhere. Boogie’s Book Of Poop Mark Allan, Marketing Director of South Jersey Marina, has a book in the works inspired by his dog Boogie and where she chooses to, um, go. “I got the idea a couple of years ago while we were visiting Montauk when Boogie pooped in the parking lot,” Mark told us. “We travel a lot and almost always with Boogie and she almost always poops wherever we go. What an interesting and humorous way to present travel destinations.” The book starring Boogie will be called 101 Places to Poop Before You Die. And, no, apparently Mark isn’t joking.

Lower Cape May Regional High School Student Of The Week Lower Cape May Regional High School senior Karlson Hughes, 17, of Cape May, tried out for and made the 2014 Redline Classic team, where he will play with Philadelphia Flyers and New Jersey Devils’ alumni. Karlson’s fellow student Nicole Hornbeck (also pictured) caught up with him recently. How long have you played ice hockey? I’ve been playing ice hockey for 14 years. Who are your biggest influences? My father is because he constantly motivates me. What is the Redline Classic? It’s a charity ice hockey game to raise awareness for the heart health of firemen. How did you get involved with the event? My father’s friend, who played in the game last year, told me about it, so I tried out and ended up making the team. What do you see yourself ten years from now? I see myself graduated from college, hopefully with a videography-related major.
