The classroom has been bulging with members taking advantage of our great education offerings and you needed more space. You will enjoy your next training in the newly enlarged classroom, with added video screens and speakers so that even those who like to sit in the back of the room will feel like they have front row seats. FAAR had the opportunity to expand into our first floor, creating an annex that now offers a Media Studio, Committee Meeting Room and Board Room. Enjoy your next meetings in the professional setting in the Annex. Also, watch for upcoming announcements about how FAAR is partnering with area businesses to use our Media Studio to create videos that serve your clients and the community. FAAR now has more to offer its members, and we look forward to

While the renovation hammers have been swinging, the FAAR Staff has been actively implementing major improvements to the FAARMEMBERS.com website, which has a fresh new look and format, with more enhancements to come. President Kevin McGrath Long & Foster, Inc. Following the merger of the RE/MAX Bravo franchise with Long & Foster Real Estate in 2013, Kevin was looking for a new challenge, and education and leadership in the association seemed like a good place to start. Regularly teaching CE, PL, and Success Series at FAAR, Kevin finds it rewarding to see agents get excited about their business and after teaching GRI classes at associations throughout the state, Kevin is continually impressed at what a premiere organization FAAR is and is honored to serve as the BOD President in 2018. Maintaining a busy schedule as a managing broker for over 150 agents and father of 7 children, Kevin still makes time for volunteering service to the association. “Providing FAAR members real value in their membership is my top priority. I hope that my service will somehow be an example and will encourage other REALTOR® members to volunteer as well. If not us, who?”

Drew Fristoe, raised in Fredericksburg, VA, graduated from the University of Mary Washington in 2006 with a B.S. in Business Administration. A firstgeneration real estate professional who was licensed in 2008, Fristoe is active in his state and local association as well as the National Association of REALTORS®. Drew will chair the NAR YPN committee Advisory Committee in 2018 and is also the co-founder of the Fredericksburg Area Association YPN, which Drew chaired in 2012, and the co-founder of the Virginia Association of REALTORS® YPN. He has served on the Virginia Association of REALTORS® Information Management Committee. In addition to chairing the Fredericksburg REALTORS® Foundation in 2011 and 2012, Fristoe has also worked on the Federal Political Coordinating Team for 1st District Rep. Rob Whitman (R-VA) since 2009.

Mark is the Executive Vice President - Real Estate Instructor at Century 21 Redwood in Fredericksburg, Virginia where he is surrounded by dynamic people. He is a lifelong resident of Fredericksburg. He is currently the Secretary for the FAAR Board of Directors and a governor for the Fredericksburg REALTORS® Foundation. When not online, he can be seen at the BBQ smoker, in the kitchen or at his kids sporting events.

Treasurer Carrie Danko, 1st Choice Better Homes and Land Carrie Danko has been a member of FAAR for 5 years. During this time, she has held numerous positions, to include the current President of the Fredericksburg Chapter of the Women’s Council of REALTORS® (WCR) and Governor on the FAAR Foundation. Previously, she held the position of Secretary of WCR. She also had the honor of being named the FAAR Rookie of the Year in 2012. Carrie hopes to continue to serve the members of FAAR in a meaningful way by being elected to the BOD. She is an active REALTOR® who strongly believes in the power of building business through building relationships. She hopes to continue to support the efforts of the current BOD by identifying ways to bring value to the members of this already exceptional association.

Director Chip Taylor, Century 21 Battlefield Chip Taylor has worked at the same company, Century 21 Battlefield and has been an active member of FAAR for the past 28 years now. He is honored to be completing his second term on the BOD. Chip presently serves as the Vice-Chair of the Education Committee. He also sits on the Events, Awards and Public Policy Committees. In addition, he is the Chair of the Meet Up networking group. At the state level, Chip has served on the Member Communications Committee for the last three years at Virginia Realtors and was a graduate of the Virginia Leadership Academy in 2015. Chip’s passion remains to be on member outreach and he focuses on connecting with new members that join FAAR. He looks forward to continuing that commitment to FAAR members in 2018.

Ben was born and raised in Fredericksburg. He received an Environmental Science degree from Virginia Tech. Ben began his Real Estate Career in 2010 as a Leasing and Sales Agent. In 2013, Ben became the Vice President and Managing Broker of Coldwell Banker Commercial Elite. He has closed $75 Million in Commercial Real Estate Transactions and has built many strong relationships in the area. Ben is a devoted family man with a lovely wife and 3 sons. Sandy Pearce Coldwell Banker Elite, Spotsylvania Sandy has been a resident of the Fredericksburg area for over 30 years. She previously worked in the public school system as a computer trainee and elementary school teacher. She was a charter member and 2014 President of the Fredericksburg chapter of the Women’s Council of REALTORS®, and she has served on the FAAR Board of Directors since 2016. Sandy understands the challenges REALTOR® associations face as our profession evolves and wants to focus on keeping FAAR relevant and providing meaningful services to all members. She has 3 grown children – one son currently serving in the Navy, one son in the Army Reserves, and her daughter is a REALTOR® in Richmond. Her husband, Rick, fully supports the unpredictable hours that come with REALTOR® territory!

Phillip Blake MBH Settlement Group Phillip has 15 years experience in the Real Estate Settlement Industry and since 2008 has served as Manager of MBH Settlement Group – Fredericksburg. Phillip was the 2013 FAAR Affiliate of the Year. Since 2013 he has served as President of Spotsylvania County Little League. He earned his BBA in Finance from Radford University in 1996. Phillip has a proven record of leadership and volunteerism through his work with MBH and Spotsylvania County Little League. He desires to use his leadership abilities and dynamic experience to help FAAR, its Affiliates and Members in becoming the model association for REALTORS® in Virginia.

Barry Moore is a Loan Officer and Branch Manager with ALCOVA Mortgage. He has been helping clients obtain mortgage financing in the Fredericksburg Area since early 2003. He is married with two children and enjoys yardwork, cooking, and auto racing. Barry is currently the ViceChairman of the FAAR Events Committee and teaches the FAAR finance class. He was awarded the 2015 FAAR Affiliate of the Year and is very active in all FAAR events. Barry is glad to see that there will be an affiliate on the 2018 Board of Directors, he feels a different point of view will help strengthen the decisions made by the Board and make FAAR a stronger organization.

Donna Schmidt American Home Shield Donna Schmidt is an 11 year military veteran and a 13 year American Home Shield veteran. She likes to focus on how she can use her career to help others. “American Home Shield has given me an avenue to “pay it forward” by helping homeowners in need.” Her territory includes Central and Northern Virginia. Before joining AHS, Donna was a manager with AmeriSpec Home Inspection Services. She serves as a Governor for the Fredericksburg REALTORS® Foundation and is a past Chairman of the FAAR Special Functions Committee. Donna also teaches continuing education for the ABCs of Home Warranty course. AHS is more than a job for Donna; she lists travel, children and work as her hobbies. Her family includes 4 children and 3 grandchildren. With a penchant for helping people and an approach to work as a hobby, Donna is a natural partner for real estate agents who want the best for their clients. As a FAAR Board member, Donna would bring her experiences with working with multiple boards to the table. FLOOD INSURANCE IS KEY FOR A HEALTHY LOCAL REAL ESTATE MARKET BY KIM MCCLELLAN, DIRECTOR OF PUBLIC POLICY

In 2010, the National Flood Insurance Program (NFIP) lapsed for 53 days and sent the local real estate market into chaos. New policies couldn’t be written, delaying closings and panicking buyers and sellers alike. Existing policies couldn’t be renewed, impacting future plans to sell and leaving homeowners vulnerable. The National Association of REALTORS® (NAR) estimates that over 1,300 home sales per day were stalled due to the lapse.

Once the program was reauthorized, local REALTORS® were reporting exorbitant premium rates, sometimes totaling 10% of the replacement value of a home. On a $400,000 home, that’s a $40,000 annual flood insurance premium. After an outcry from REALTORS® across the nation and under pressure from the National Association of REALTORS® (NAR), the U.S. Congress amended the NFIP reauthorization legislation and fixed the most egregious issues with the law. Now we’re five years past that time staring down another reauthorization.


With this reauthorization, NAR has been advocating on behalf of homeowners since the beginning of the year to avoid any program lapses and ensure that homeowners aren’t faced with massive premium increases. It is vital that the federal government continue to provide a backstop for flood disasters. Floods claim more lives and property than any other natural disaster. Flood disasters have been declared in every state in last five years alone. This is truly a national issue and needs to be addressed quickly and effectively when the current law expires.

As NAR continues to work with Congress and the NFIP expiration date moves closer, it may be crucial for FAAR members to engage their Members of Congress to ensure that they understand how important the flood program is to the local real estate market. If a Call for Action is issued by NAR, FAAR will echo that message and ensure that everyone in our Association has the chance to respond. NAR makes it incredibly easy to make your voice heard with just one click on your computer or one swipe in the Realtor® Action Center app. Stay tuned for more information on flood insurance in the coming weeks and months.

NAR is fighting for a reauthorization bill that will protect homeowners from major rate increases when a flood map changes, called “grandfathering”, so that we don’t see the huge increases we saw the last time. NAR is also championing the creation of accurate, propertylevel flood maps. NAR believes the NFIP should be required to use modern mapping technology to produce building specific risk assessments. Currently, homeowners bear the burden of appealing the maps to remove low-risk buildings from the floodplain. The method for flood mapping that is used now is inefficient when light detection and ranging (LiDAR) can collect the data for whole neighborhoods at once.

DPOR CREDIT CARRYOVER PROCESS BY BARBARA CASTILLO, DIRECTOR OF PROFESSIONAL DEVELOPMENT

Licensees soon will need to submit a worksheet, along with their course completion certificates, to the Board if they have continuing education (CE) they wish to “carryover.” The Board’s computer system is not capable of automatically calculating the amount of carryover CE, so the worksheet is mandatory and will be available in early September. Once DPOR staff reviews the worksheet and evaluates whether a licensee has CE that qualifies for carryover, the eligible credits

will be entered into the licensing system and then show up on License Lookup on the website. All licensees who submit a worksheet will receive a letter indicating if he or she has carryover CE, no matter the eligible amount. By implementing the process now, licensees will know what carryover credits are available to them by the time they actually need to use any: October 1, 2017 (the first day a license that expires in November of 2017 can be renewed).

STRATEGIC PLANNING PROCESS UNDERWAY BY PAT BREME, RCE, CIPS CEO

Every three years the Association holds a strategic planning session and 2017 is the last year of the current Plan. Task Force Chair Kevin McGrath and his group will decide the focus of this year’s session, perhaps retain elements of the current plan but certainly focus on what the Association needs to do for the inevitable changes in the future.

The process begins with a membership survey which was sent last week. Member input is crucial in this process. The group plans to also hold a Focus Night, in September, where members representing a wide range of membership category are invited to discuss a variety of topics. Those invited are top producers, brokers, property managers, those new to the profession, seasoned agents, commercial agents and

others. Please say “YES” to the invite if you are selected. The information gathering culminates in a probing and thoughtful strategic planning session so the best goals for the Association are selected. The session is scheduled for October with a facilitator. The Plan once approved by the Board will be implemented the beginning 2018.

As agents, we rush from one appointment to the next often without time to take a breath, and certainly not to contemplate what’s happening at our local association. As President of the Fredericksburg REALTORS® Foundation, I want to assure you that your association is accomplishing good work in the name of REALTORS® throughout the year.


That $20 contribution you gave to play Bingo or the $10 in raffle tickets you bought is helping someone repair a leaky roof, finally get a wheelchair ramp, or obtain the care and advice they need to maintain their health and thus their employment and their home. So far in 2017, the Foundation has given $1,000 to the Hazel Hill Healthcare Project and $5,000 to the 516 Project. The Hazel Hill project helps residents stay in their homes by providing on-site and in-home visits with a nurse. These visits help residents manage chronic medical issues and achieve stable housing. The

516 Project provides home repair services throughout our service territory by enlisting volunteer assistance coupled with financial support from organizations like the Foundation. The Foundation was very pleased to give these grants, but we know we can do more. The Foundation’s 2nd Annual Par for FAAR golf tournament is coming up on Friday, October 13, 2017 at Augustine Golf Club. FEE TO FILE AN ETHICS COMPLAINT? NO! BY PAT BREME, RCE, CIPS, CEO

Let me start off by dispelling a misconception regarding filing an ethics complaint with FAAR. THERE IS NO FEE, however, members must complete a form, attach a narrative detailing the situation and file within 180 days of the occurrence or knowledge of the occurrence. Additionally, there is no fee if the complaint is processed through the Citation System. The mediation process has no fee. There are, however, fees for the following1- A $250 Processing Fee is imposed on a member who is found in violation of an Article of the Code. 2- A Broker who requests an arbitration and the responding broker are levied a $350 Filing Fee. The party who prevails is refunded the Filing Fee. 3- Appealing an Ethics Hearing Decision- $250 4- Requesting a Procedural Review- $250 5- Dispute Resolution Fee- $250 from the primary parties

Pathways to Professionalism—Do unto others… Created by the National Association of REALTORS®, Pathways to Professionalism, is a useful, common sense guide to simple courtesy. For example, - Never allow buyers to enter listed property unaccompanied. - Respond to other agents’ calls, faxes, and e-mails promptly and courteously.

The Law of the REALTOR® world… The Code of Ethics The Code of Ethics is a REALTOR’S® compass for professional behavior. It is composed of 17 Articles covering duties to clients and customers, the public and to REALTORS®. The Code goes beyond common sense niceties to what REALTORS® pledge to abide by in their business activities. For REALTORS® it is the law!

Observing unprofessional behavior… Filing an ethics complain—Is it really snitching? Some describe filing an ethics complaint as ratting out, snitching, and view the whole process as unsavory. For the Complainant, time is spent on writing a narrative, citing Articles and gathering information. From the Respondent’s point of view, time is spent on gathering documents to defend his or her motives and actions. When a complaint is sent to FAAR, a Grievance Committee meeting is convened to examine the complaint to see if it has been properly filed. They do not review the information from the Respondent. The Grievance Working Group bases its decision on the facts of the complaint and the final question they ask themselves is, “If the facts alleged in the complaint were taken as true on their face, is it possible that a violation of the Code of Ethics occurred?” In most cases the complaint is moved on to a hearing because the answer is usually, yes. Why doesn’t the Grievance Working Group look at the Respondent’s view of the situation? When a group has both sides presented it is too easy

to draw conclusions and determine outcomes. That is not the role of the Grievance Working Group. It acts like a Grand Jury and only looks at the complaint’s viability. It can also dismiss a complaint.

The Citation System With the adoption of the Citation System, the Grievance Committee may decide a complaint fits the criteria and ask the Respondent whether he or she wants the issue to proceed to a hearing or, without admitting guilt, pay a fine and/or attend mandatory education for the alleged violation. The program only covers certain Articles of the Code- 1, 3, 4, 5, 6, 9, 12, 14, 16. The fines range from $150 to $950. Complaints coming from other participating Associations- PWAR, DAAR, NVAR, BRAR and GPAAR, will be treated in the same way as outlined. Is it like getting a traffic ticket? Yes. The Respondent accepting the fine avoids an uncomfortable and often times a consuming hearing process. The Ombudsman Program The Ombudsman Program in its simplest definition is informal telephone mediation. In some cases it can address and solve minor complaints from the public. The ombudsman can also solve inter-REALTOR® conflicts before they become serious problems. Some complaints do not allege specific articles of the NAR Code of Ethics and many times they are transactional, technical and procedural questions that can be addressed by communication. Like a mediator, an ombudsman helps parties find solutions that 30 | August FAARside

everyone can be happy with.

Where’s my commission? Another service the REALTOR® Association offers is arbitration of contractual disputes. Most often disputes are over commissions- who was the procuring cause of the sale? This is a broker-to-broker issue but the agents who are party to the transaction are involved and usually present at the hearing. There are no cookie cutter answers to an arbitration involving procuring cause. The answer to “who did the work” question is colored by many things, such as, client behavior, lapses in service, lack of communication between all parties, etc. Some disagreements can be resolved and the formal process averted if brokers are willing to agree to a resolution.

Mediation, a reasonable compromise FAAR offers mediation to the parties after the Grievance Working Group has determined an issue is an arbitral matter or has determined that an ethics complaint needs to advance to a hearing. Both parties must agree to come to the table to try to resolve the matter. If mediation fails or one party declines the offer to mediate, the case moves on to the hearing process.

The hearing Due process is the goal of the hearing because both sides have an opportunity to present their case, call their witnesses, and crossexamine. Only after both the Complainant and Respondent have their say does a panel of peers decide whether a violation has occurred. It is a fair process and much is disclosed during the process. The truth usually rises to the surface. If an agent is found in violation the panel serves a disciplinary action ranges from taking a class on a particular subject to

Broker to broker problem solving Often unprofessional activities or commission disputes are resolved if brokers take it upon themselves to communicate with each other. Often problems don’t have to become formal complaints requests for arbitration or worse, not addressed at all, if brokers step in and resolve issues.

Ignoring the problems Unprofessional behavior ultimately harms everyone in the business. The public, who may be a victim is observing the behavior and forming negative opinions about REALTORS® in general.

MORE ON THE OMBUDSMAN PROGRAM In order to comply with a new NAR mandate, FAAR and REALTOR® associations across the country have added an ombudsman program to their list of services. FAAR and five other associations in the area, Northern Virginia, Greater Piedmont, Prince William, Blue Ridge and Dulles Area Associations of REALTORS® already have a regional professional standards agreement in place. Several FAAR members are trained in the program and are ready to review requests from members and the public. Diane K. The ombudsman must be fair and credible, avoid making a judgment of who is right or wrong and can also not give legal advice to any party. Careful listening, summarizing the situation, determining what is most important to resolve the situation or make everyone satisfied and working toward that goal.

Why now, you might ask? The main reason is because it’s been so successful for associations that have a program in place. It seems that many members of the public are reluctant to file a written ethics complaint for several reasons; the process is too cumbersome and the paperwork is too hard to understand. They really just want someone to listen and help solve their problem. They do not want to fill out paperwork. Many times the problem is not a violation of our Code of Ethics and the complaint is dismissed. Even REALTORS® are often reluctant to file ethics complaints for similar reasons and also because they would rather not “rock the boat” and cause conflict with other members that they cooperate with on transactions. Many ethics complaints might be averted with enhanced communications and initial problemsolving capacity at the local Association level. In reality, many association staff people have been providing services similar to that of an ombudsman for years since they are the first point of contact when a REALTOR® or consumer wants to file a complaint. In many

instances, staff is successful in alleviating the concerns. However, that isn’t always the case. Consumers and our members really just want their story to be heard and having a team or committee of qualified REALTOR® members serving as ombudsman available to assist in resolving disputes has met with great success. It shows that we really care about trying to help resolve the problem and also overcomes the perception that one REALTOR® may be trying to cover up for another and reopens communications between the parties. The goal is to accelerate the ethics enforcement process and provide a means to clear up misunderstandings that members may not know exist. This is a valuable service which can get a transaction back on track so the consumer has a positive real estate experience. It’s an opportunity to improve our professional reputation as REALTORS®. Over the years, the mediation of monetary disputes between REALTORS® has been a huge success and mediation is the “preferred dispute resolution” process of the National Association of REALTORS®. Hopefully, the ombudsman program will have similar success. It’s a very positive step in providing an opportunity for the public and our members to resolve disputes without anyone having to file a formal complaint and insuring that our customers and clients continue to have great relationships with REALTORS® who truly want to make sure they have a great real estate experience.

ANOTHER YEAR, ANOTHER SUCCESSFUL CLOTHING DRIVE! BY KIM MCLELLAN, PUBLIC POLICY DIRECTORY

FAAR hosted another successful clothing drive, collecting clothes for the entire month of May and culminating with a beautiful shopping experience hosted by Lifepoint Church in Fredericksburg on June 8, 2017. FAAR members and the general public contributed thousands of articles of clothing, shoes, jewelry, accessories, handbags, and more. Dozens of volunteers sorted, organized, and presented the donated items in a lovely boutique that serviced nearly 80 women. FAAR would not have been able to put on such an amazing event if it weren’t for the support of our volunteers and Lifepoint Church. FAAR has decided to take a year off from the extremely laborintensive clothing drive and explore the opportunity of hosting an association-wide community service day. The goal is to the bring the clothing drive back in 2019, so keep putting your gently worn professional and business casual clothing aside! The new project will aim to accomplish five home repair projects with one in each of the FAAR service territory including the City of Fredericksburg and the counties of Caroline, King George, Spotsylvania, and Stafford. When he has a unit come available, his first call is to Ms. Gaskins to see if she has any clients that could be a good fit for his property. “It makes my job so much easier keeping my units rented,” stated Mr. Milhoulides. “It’s a win-win. I keep my units rented and help somebody out.”

Awards Committee Chair Bonnie Ramey is happy to report that applications were up and we are hoping that the fall awards season has similar increases. Some of the forms were tweaked to be easier to fill out. “There are members out there who are deserving and cumbersome forms should not be a deterrent to giving recognition to them.” She and Vice Chair Corey Green urge members and brokers to take the time to review the various recognitions. “There is someone in your REALTOR® life who is perfect for one of the FAAR awards.” The managing broker community is urged to recognize the achievements of their agents by promoting nominations or nominating someone from the office. Application deadline is October 31, 2017.
