2017 GENERAL ASSEMBLY SESSION KICKS OFF, DON’T MISS REALTOR® DAY ON THE HILL BY KIM MCCLELLAN, PUBLIC POLICY DIRECTOR

The Virginia Association of REALTORS® has a comprehensive legislative agenda to promote during the 2017 General Assembly session. The items on this year’s legislative agenda will provide certainty to tenants and property managers during a foreclosure, gives some real enforcement options to the CIC Board for HOAs that violate the law, and clarifies that the current red flag disclosure statement is really a buyer beware statement.

2017 VAR Legislative Agenda

Transfer of Security Deposits upon the Sale of a Dwelling Unit (HB 1623 – Yancey; SB 991 – Dance) Allows a property manager to transfer a security deposit to the owner and to simply provide notice to the tenants, versus having to obtain the written consent of the owner and tenants.

This legislation does not change Virginia Code Section 55-248.15:1 that places the responsibility on the landlord at the lease termination to make disposition of the tenant’s security deposit, regardless of whether that landlord received the tenant’s security deposit from a prior landlord.

POA Act Amendments (HB 2045 – J. Miller; SB 1231 – Stanley)

Licensee Responsibilities – Transfer of Escrow Funds and Foreclosures

Condo Act Amendments (HB 2274 – D. Marshall; SB 1255 - DeSteph)

(SB 966 – Obenshain; HB 2281 – Leftwich) Allows for a smoother transition for an existing tenant and a new owner following a foreclosure. Allows the tenant to continue to pay rent to the: (i) new landlord, (ii) the property manager at the time of the foreclosure, or (iii) the courts, through an escrow account. Allows for the written property management agreement to continue in place following a foreclosure on a month-to-month basis until terminated by either the property manager or the new owner, unless a shorter period is provided for in the property management agreement.

Associations cannot condition, limit or prohibit for sale signs other than limiting signs to those that are in compliance with the VREB regulations. Associations cannot require a formal power of attorney from a real estate licensee to represent their clients before the association and are required to accept a document from the real estate licensee signed by the owner that confirms representation. Adds that failure to deliver the association disclosure packet within the 14-day requirement subjects the association to up to $1,000 fine imposed by the Common Interest Community Board.

WHAT DOES RPAC DO FOR YOUR BUSINESS? Stop onerous sign regulations, that’s what! BY KIM MCCLELLAN, PUBLIC POLICY DIRECTOR

When a house goes up for sale, the first thing you see is usually a sign in the yard. Signs are such a big part of the real estate business that it seems like second nature to many agents to throw up a sign wherever and whenever to get the property sold. In general, most real estate signs, especially those for residential property, are exempt under our local zoning ordinances. But imagine if they weren’t. Imagine if you had to pull a sign permit for every sign that you put into the ground that was going to be up for longer than a few months. Well, it isn’t such a crazy dream, it almost happened in Stafford County!


Stafford County began to rewrite their zoning ordinance pertaining to signs over the summer in an effort to comply with a Supreme Court ruling that said it could be discriminatory to regulate signs based on the words on the sign. Ordinances regulating signs have to be content neutral, based on other factors such as size and material instead of what the sign actually says. This presented a challenge for Stafford County because they need to treat all signs equally whether they’re advertising real property or support for a specific candidate or selling puppies. The language they settled on would have allowed for a temporary sign for up to 60 days and anything up for longer than that would have required a sign permit. This language was quickly brought to our attention and we swiftly engaged with members of Stafford County’s Planning Commission to let them know that the timeframe on a temporary sign absolutely would not work for real estate. Most properties do not close within 60 days which would mean that hundreds of sign permits would be required for anyone selling property in the County. The Planning Commission voted down the sign ordinance and FAAR engaged with members of the Board of Supervisors and staff to craft a compromise that would accomplish the County’s goals while also allowing Realtors® to advertise property without the burdensome need for a sign permit.

After working extensively with Aquia District Supervisor Paul Milde, Garrisonville District Supervisor Laura Sellers, and staff from the Planning and Zoning Department, FAAR was able to negotiate a provision in the new ordinance that allows for a minor sign without a permit. The minor sign category has a maximum size of six (6) square feet, which encompasses the vast majority of real estate signs. If it were not for the relationships FAAR has been able to foster through RPAC support, we might not have been able to reach this compromise. Running for elected official is expensive, even at the local level, so being able to support elected officials such as Paul and Laura means a lot to them. When we contribute RPAC funds to a candidate, they understand that it is truly a vote of confidence in them and they don’t forget that. They understand that our members contribute their hard-earned money to protect the real estate industry and RPACsupported elected officials work hard to ensure that the real estate industry continues to be a strong part of our local economy. It doesn’t take much to help FAAR continue efforts such as this one. Just $30 per year counts as the Fair Share amount and will allow us to continue to support quality candidates who will in turn support our industry. There are many ways to give to RPAC, the easiest of all is to contribute along with your dues payment. Each August, FAAR sends a dues bill that will

THE FREDERICKSBURG REALTORS® FOUNDATION PROVIDES NEARLY $19,000 IN 2016 GRANT FUNDING BY MARY BETH RICH, FOUNDATION PRESIDENT

The Foundation provides grants to local charitable organizations whose clients struggle with hardships that threaten their ability to secure and retain shelter.

Founded in 1990 by the Fredericksburg Area Association of REALTORS®, the Fredericksburg REALTORS® Foundation, Inc. is a private, non-profit organization. The Foundation solicits public and private contributions to distribute among various charitable organizations throughout the Fredericksburg area. It is governed by the IRS as a Section 501(c)(3) private foundation. All donations to the Foundation are tax deductible.

The Fredericksburg REALTORS® Foundation was able to provide grants totaling $18,971 in 2016. That is truly an amazing number and on behalf of the entire Board of Governors, I would like to express my sincere gratitude to the Realtor® and affiliate members who have so generously supported the Foundation throughout the year. Without all of you, we would not be able to do the good work that makes such a difference in our community. In 2016, the Foundation supported the following grant requests: 1. Beauty for Ashes Women and Children’s Home to support their in-home substance abuse program: $5,000 2. S.E.R.V.E to provide emergency financial assistance for housing needs: $750 3. Loisann’s Hope House to purchase security cameras to ensure the safety of residents: $3,034.97 4. FAAR HOSTS ANNUAL CEREAL DRIVE 2016 proved a record-breaking year with FAAR members collecting 14,248 boxes of cereal. Realtors® from across the region collect cereal from their clients, family, and friends and a friendly competition inspires each office to beat their prior year totals. FAAR would also like to recognize those individuals who worked especially hard to ensure a successful Cereal Drive. Chip Taylor of Century 21 Battlefield single-handedly collected 1,502 boxes of cereal while Michelle Wilson and Barbara Cornwell of Century 21 New Millennium spearheaded their office’s collection of 2,247 boxes of cereal. This annual event has long supported the local food pantries and provides countless meals for the 34,000 residents served by the 69 food pantries throughout the Fredericksburg region. Cereal was also delivered to food pantries in Westmoreland County and Louisa County.

Exclusive Agency Listing Agreement – K1337; Exclusive Right to Sell Listing Agreement – K 1336; and Exclusive Right to Sell Unimproved Land Listing Agreement – K1335. a. Property. The committee added language which tracks the MLS fields associated with listings such as the number of levels, whether there is a basement etc. b. Conveyances. The list of conveyances was amended to distinguish between the different types of fireplaces and their attending equipment. c. Broker Duties. This paragraph was updated to include bolded language towards the end of the paragraph providing a blank to write out specific showing instructions for the property if applicable. d. Marketing/MLS/Internet Advertising. This paragraph was updated to comport with the reality of the life cycle of a listing and continue to be in compliance with the DOJ-NAR settlement. To that end, we have separated the authorization for internet display from the rest of the VOW disclosures. That way, a seller will first choose whether or not they will allow their listing to be disseminated on the internet. If they choose yes, then there is a disclaimer which follows and the listing agent needs to complete section D. If they say no, then section D may remain blank. e. Broker Compensation. The offer of compensation language which used to be in the marketing/MLS/Internet Advertising paragraph has been moved to this paragraph for consistency and clarity. In addition, a new section C was added to address whether there will be a variable rate commission entered in the listing. f. Current Liens. This paragraph was updated to comport with the current practice. A reminder was inserted for the seller that the loans on the property will need to be paid off at settlement. The account numbers for the loans have been deleted as they were no longer necessary. Finally a paragraph was added to ensure that sellers agree to comply with requests from settlement agents for loan payoffs. g. Seller Duties. The old miscellaneous information paragraph was divided into two paragraphs. One entitled Seller Duties and the other Miscellaneous Information. The Seller Duties paragraph was modified to provide for a disclosure of whether the seller has an audio recording system in the property followed by a warning and release of liability for real estate agents. This paragraph was further modified to allow access to the

property by the Broker’s unlicensed assistant to perform their duties as outlined in the real estate regulations. h. Utilities (Land Listing Agreement Only). This paragraph was updated to include additional descriptions of the utilities which may be available at the property such as cable or fiber optics. 2. Sales Contract for Unimproved Land– K1321 This form has been completely updated to match more closely our Residential Sales Contract. However, the following three paragraphs are specific to this contract: Fees and Expenses; Land Use Assessments/Rollback Taxes; and Study Period Contingency. 3. Rental Application – K1008 The rental application was modified to include two additional questions: Whether the tenant requires a visual smoke detector (to comply with new laws) and whether they are entitled to diplomatic immunity. 4. Lease – Common Law – K1333 and Lease – VRLTA – K1354 These forms were updated to comport with significant legal changes. a. Lease Term. The two options for lease term have been reduced to one option whereby the tenant agrees to vacate at the end of the lease term unless the parties have provided at least 60 days notice their wish to extend the term. b. Early Termination. The paragraph was moved to follow immediately after the lease term paragraph. No new language. c. Late Payment. This paragraph was simplified. The language now outlines clearly the fees associated with any late payments by the tenants. d. Fixtures and Appliances. This paragraph was modified to separate those fixtures and appliances which are part of the premises and those which are provided in as-is condition. e. Smoke and Carbon Monoxide Detectors. This paragraph was updated to comply with recent changes in Virginia law. The tenant may not tamper with carbon monoxide detectors and must maintain them where installed. f. Access to the Premises. This paragraph was clarified to state that the tenant allows the listing agent to place a sign, a lockbox and show the premises 90 days prior to the end of the lease term if the property is listed for sale and 60 days prior to the end of the lease term if the property is listed for rent. In addition, language was inserted to warn tenants about the damages they may incur if they fail to allow showings to potential tenants or buyers. g. Notice Regarding Diplomats. This paragraph has been made into an informational paragraph for the benefit of the landlord explaining the possible consequences of renting their property to a diplomat.

FAAR’s Expansion project STARTS FEBRUARY 20 The plan to acquire approximately 1300 sq. ft. of the C&F first floor office space begins February 20. Not only will the first-floor space be completed but also the expansion of the secondfloor classroom. The annual February Bingo event is now scheduled for May and classes slated for the current classroom will be held at other locations during the construction. The staff will keep the members informed about any changes to the schedule. Look for social media posts picturing the progress of the renovation. The Association plans to hold an open house after the work is completed, probably in early fall.
