No matter what your feelings are about the current President of the United States and his administration, things in Washington, D.C. and throughout the nation are about to change. Just as in relationships, this pending change presents waives of emotions ranging from fear, to anticipation, to anxiety and happiness. While detaching yourself from the realities ahead might be a first and natural reaction, now more than ever is a time to become educated on the issues and contribute in an informed manner. Creating clarity for the business community brings unique challenges – often requiring individuals to separate emotions from logic and outcomes. The North Orange County Chamber has provided a Voter’s Guide to help educate readers on issues impacting the business community. This task requires us to reflect on voting records as well as to review philosophies. Revisions to Federal and State employment regulations continue to distract businesses from their day-to-day activities. As a Chamber we are working to guide compliance and prevent employers from encountering fines and other penalties. Finally, as we look to new beginnings, we remind readers as we approach the holiday season to Think Local and Buy Local. EMPLOYMENT UPDATES What Does $47,476 Mean for Your Business? The U.S. Department of Labor (DOL) announced final updates to the Fair Labor Standards Act overtime rule. The final rule is effective December 1, 2016, and changes the salary level which must be met before an employee can be exempt from overtime under “whitecollar” exemptions (executive, administrative and professional). Employers are also reminded that California minimum wage for most employers will increase to $11 per hour in 2017.

Key Provisions of the Final Rule The minimum salary threshold for exempt employees increases nationwide to $913 per week or $47,476 annually for a full-time worker. An employee paid less than this threshold amount will be guaranteed overtime. This threshold is higher than the current California minimum salary threshold for white-color exemptions which is currently $41,600. In addition, the order sets the total annual compensation requirement for highly compensated employees (HCE) subject to a minimal duties test to the annual equivalent of the 90th percentile of full-time salaried workers nationally ($134,004); and establishes a mechanism for automatically updating the salary and compensation levels every three years to maintain the levels at the above percentiles and to ensure that they continue to provide useful and effective tests for exemption.

Employer Choices Employers have a wide range of options for responding to the changes to the salary level. Employers can choose the one that works best for them. Options include: Raise salary and keep the employee exempt from overtime: Employers may choose to raise the salaries of employees to at or above the salary level to maintain their exempt status, if those employees meet the duties test (that is, the duties are truly those of an executive, administrative or professional employee). This option works for employees who have salaries close to the new salary level and regularly work overtime. Pay overtime in addition to the employee’s current salary when necessary: Employers also can continue to pay their newly overtimeeligible employees the same salary, and pay them overtime whenever 6

they work more than 40 hours in a week. This approach works for employees who work 40 hours or fewer in a typical workweek, but have occasional spikes that require overtime for which employers can plan and budget the extra pay during those periods. Remember that there is no requirement to convert employees from salaried to hourly in order to calculate their overtime pay!

Evaluate and realign hours and staff workload: Employers can ensure that workload distribution, time and staffing levels are all managed appropriately for their white-collar workers who earn below the salary threshold. For example, employers may hire additional workers. As you evaluate your options for moving forward, planning will be the key. Start preparing now – December 1 is not far off!

JOB CREATORS California Employment Law Update The Federal Wage order for exempt employees has captured the headlines, but several other changes to employment law in California will bring or have already brought change to businesses in our state, and some highlights are noted below. Employers should check local ordinances and consult counsel to assure compliance in all areas related to employment law.

State Minimum Wage Increase: Beginning January 1, 2017, California minimum wage will increase by $.50 per hour. The rate will then increase $1 per year thereafter until 2022. Small businesses (25 or fewer employees) won’t be required to begin the scheduled increases until 2018.

Updated PDL Posting Requirement: California’s notice obligations relating to pregnancy leave (PDL) changed on April 1. Employers with five or more employees must post the updated PDL notice – Your Rights and Obligations as a Pregnant Employee (revision date 4/1/2016). This replaces the former “Notice A” and satisfies PDL posting requirements.

Smoking Ban Extended: New rules relating to smoking in the workplace became effective June 9, 2016. In part, the new legislation: · Treats the use of e-cigarettes and other nicotine delivery devices as “smoking”. · Expands smoke-free workplace protections getting rid of most exemptions to areas including bars, hotel lobbies and warehouse facilities. · Raises the legal smoking age from 18-21 except for active military personnel. · Expands the workplace smoking ban to include owneroperated businesses and eliminates any small business exemptions for employers with five or fewer employees. Although much of the news from Sacramento negatively impacted businesses, the Legislature sent three Chamber supported “Job Creator” bills to the Governor at the end of the 2016 session. Bills currently on the Governor’s desk include: AB 2664 (Irwin; D-Thousand Oaks) Increased Innovation and Entrepreneurship. Provides resources for Californians who are establishing a new business by providing the University of California (UC) with funds to expand its capacity and increase access to its innovation and entrepreneurship centers, which provide incubator space, legal services, entrepreneur training and more for researchers and other individuals looking to develop innovative solutions. Presented to the Governor on September 2, 2016. SB 936 (Hertzberg; D-Van Nuys) Loan Access. Encourages creation of small businesses by expanding their access to loans, which helps them grow. Presented to the Governor on August 24, 2016. SB 1069 (Wieckowski; D-Fremont) Increases Housing Supply. Creates and expedites additional housing supply by streamlining the permitting process for Accessory Dwelling Units through reduced parking requirements, expedited procedural processes, and allowing ADUs to be constructed within existing properties. Presented to the Governor on September 8, 2016. Job Creator signed into law includes: SB 269 (Roth; D-Riverside) Incentivizing Disability Access and Education. Seeks to limit frivolous litigation and claims regarding construction-related accessibility violations by providing businesses that have proactively sought to become Americans with Disabilities Act (ADA) compliant with an opportunity to resolve any identified violations. SB 269 was an urgency measure and went into effect immediately upon being signed on May 10, 2016. NOCChamber.com

YOUR NORTH ORANGE COUNTY CHAMBER PROPOSITION VOTING GUIDE: PROMOTING THE PROSPERITY OF BUSINESS AND FISCAL RESPONSIBILITY

ovember 8 places measures in the hands of voters. Members of the North Orange County Chamber Board of Directors carefully analyzed the measures which fall under the scope of the Chamber’s advocacy efforts. The positions identified below are based on the Chamber’s ethos that the ballot measure aid rather than regulate or impede business growth. The propositions vary from bonds and taxes to legislature transparency, healthcare, and education. Prop 51: Support Authorizes $9 billion in general obligation bonds for new construction and modernization of K-12 public school facilities, charter schools and vocational education facilities, and California Community Colleges facilities. Appropriates money from the General Fund to pay off bonds. Prop 52: Support Increases required vote to two-thirds for the Legislature to amend a certain existing law that imposes fees on hospitals. They direct those fees and federal matching funds to hospital-provided Medi-Cal health care services to uncompensated care provided by hospitals to uninsured patients, and to children’s health coverage. Prop 53: Oppose Requires statewide voter approval before any revenue bonds can be issued or sold by the state for projects that are financed, owned, operated, or managed by the state or any joint agency created by or including the state, if the bond amount exceeds $2 billion. Prohibits dividing projects into multiple separate projects to avoid statewide voter approval requirement.

Prop 54: Support Prohibits Legislature from passing any bill unless it has been in print and published on the Internet for at least 72 hours before the vote, except in cases of public emergency.

Prop 55: Oppose Extends by 12 years the temporary personal income tax increases enacted in 2012 on earnings over $250,000 (for single filers; over $500,000 for joint filers; over $340,000 for heads of household). Allocates these tax revenues 89% to K-12 schools and 11% to California Community Colleges. Prop 58: Support Amends and repeals various provisions of Prop 227, deleting the sheltered English Immersion requirement and waiver provisions. Allows school districts and county offices the opportunity to provide structured English immersion programs. Prop 61: Oppose Prohibits state agencies from paying more for a prescription drug than the lowest price paid for the same drug by the United States Department of Veterans Affairs. Exempts certain purchases of prescription drugs funded through Medi-Cal. Prop 65: Oppose Redirects money collected by grocery and certain other retail stores through sale of carry-out bags into a special fund administered by the Wildlife Conservation Board to support specified categories of environmental projects. Prop 67: Neutral Challenges a state law previously approved by the Legislature and the Governor prohibiting grocery and certain other retail stores from providing single-use bags but permits sale of recycled paper bags and reusable bags. Measure QQ: Oppose Eliminates Funding for 9-1-1 Public Safety and Essential Services Protection by repealing a voter approved enactment of a one cent (1%) Sales and Use Tax on the retail sale and use of goods within the city.

Affordable Housing Barriers SB 1150 (Leno; D-San Francisco) Erodes Housing Availability: Increases liability risk and the cost of residential loans by allowing a party not on the mortgage loan to interfere with appropriate foreclosures and creates a private right of action for violations of overly complex and burdensome requirements. Enrolled and presented to the governor. 8/30/2016. SB 1318 (Wolk; D-Davis) Erodes Housing Affordability: Inappropriately leverages necessary affordable housing in order to solve infrastructure issues with the consequence that the housing won’t be built by imposing requirements on water or wastewater districts to serve certain communities first. Passed Senate, 6/2/16, 23-13. Held in Assembly Local Government Committee, 6/9/16; failed deadline. Arbitration Discrimination AB 2667 (Thurmond; D-Richmond) Consumer Arbitration Agreement Discrimination: Unfairly discriminates against arbitration agreements and is likely preempted by the Federal Arbitration Act, which will lead to confusion and litigation, by prohibiting arbitration of Unruh Civil Rights violations made as a condition of a consumer contract for goods or services. Burdensome Environmental Regulation SB 32 (Pavley; D-Agoura Hills) Slows Economic Growth: Increases costs for California businesses, makes them less competitive and discourages economic growth by adopting further greenhouse gas emission reductions for 2030 without regard to the impact on individuals, jobs and the economy. Increased Labor Costs SB 3 (Leno; D-San Francisco) Automatic Minimum Wage Increase: Unfairly imposes a potential 50% increase in the minimum wage by 2022 (actually an 87% increase over an 8-year period when combined with the January 2016 increase), and automatically adjusts minimum wage beyond 2018 according to national inflation, with no “offramps” to suspend the indexing if employers are struggling with other economic factors or costs. Approved by governor, 4/4/2016. SB 654 (Jackson; D-Santa Barbara) Imposes New Maternity and Paternity Leave Mandate: Unduly burdens and increases costs of small employers with as few as 20 employees by requiring 6 weeks of protected employee leave for child bonding and exposes all employers to the threat of costly litigation. SB 654 was gutted and amended on August 11. Enrolled and presented to governor. 9/9/2016.

SB 1166 (Jackson; D-Santa Barbara) Imposes New Maternity and Paternity Leave Mandate: Unduly burdens and increases costs of small employers with as few as 10 employees, as well as large employers with 50 or more employees, by requiring 12 weeks of protected employee leave for maternity or paternity leave, and exposes all employers to the threat of costly litigation. Passed Senate, 6/1/16, 22-14. Failed passage in Assembly Labor and Employment Committee, 6/22/16. Meritless Litigation AB 2748 (Gatto; D-Glendale) Increases Environmental Litigation: Eliminates incentives to settle lawsuits and instead exposes businesses to multiple rounds of litigation at great expense to the parties and the courts by creating statutory prohibitions on

“release” clauses in settlements pertaining to “environmental disasters.” Job killer tag removed due to June 2 amendments, which made clarifications and narrowed the bill to apply only to the Porter Ranch area gas leak or to contamination surrounding the Exide Technologies facility, but CalChamber remains opposed. Enrolled and presented to the governor. 9/9/2016. SB 899 (Hueso; D-Logan Heights) Increased Frivolous Litigation: Drives up consumer costs and increases frivolous litigation similar to the disability access lawsuits in California, by prohibiting a retailer or grocery store from discriminating against a person on the basis of gender with the price of goods and subjecting them to a minimum $4,000 of damages for each violation. Passed Senate, 5/26/16, 22-12. Held in Assembly Judiciary Committee, 6/28/16.
