One of the favorite occasions for small business is the kick-off of the holiday shopping season that traditionally begins just after Thanksgiving with Small Business Saturday! Winter holidays can only mean that the New Year is around the corner and in California that means new laws regulating business. NEW YEAR BRINGS NEW EMPLOYMENT LAWS
G
overnor Jerry Brown signed several key employment law bills that businesses need to be aware of for the coming year. In 2018, the Legislature introduced more than 2,600 bills including 1,217 bills that made it to the governor’s desk. Of those approved by the Legislature, Governor Brown signed 1,016 into law. CalChamber together with business organizations including NOCC tracked 213 California bills, stopping 115 opposed bills (including 29 job killers), and backing 27 bills that were signed into law. Strong advocacy by the CalChamber, members, local chambers of commerce and allied employers prevented all but one job killer bill from passing the Legislature.
Lactation Accommodation (AB 1976): Under current state law, an employer must provide a location other than a toilet stall for an employee to express breast milk. The location must also be private and in close proximity to the employee’s work area. This law requires that the employer provide a location other than a “bathroom,” rather than a “toilet stall.” As a result, employers cannot designate a bathroom as a designated space to express breast milk.
Of note, the Governor vetoed AB 3080, which would have banned settlement agreements for labor and employment claims, as well as arbitration agreements made as a condition of employment. If passed, AB 3080 would have significantly expanded employment litigation, delayed resolution of claims and increased costs on employers. The new regulations, however, will require California employers to update their employment notice postings. NOCC is offering a discount on postings for orders placed through December 15, 2018. Here are some of the new laws taking effect in January 2019 that employers should anticipate:
LEAVES OF ABSENCE AND BENEFITS Paid Family Leave (SB 1123): The Paid Family Leave wage replacement program will be expanded beginning Jan. 1, 2021, to any employee who takes time off to attend to situations related to the covered active duty status of the employee’s spouse, registered domestic partner, child or parent who is a member of the US Armed Forces. Known as “qualifying exigencies,” these situations could include time off for official ceremonies, briefings, changes to childcare arrangements, financial or legal arrangements, counseling or spending time with the covered service member during rest and recuperation leave, among others.

HIRING PRACTICES Salary History (AB 2282): This new law clears up ambiguities in last year’s AB 168, the ban on salary history inquiries and the requirement to provide pay scales to applicants. The Labor Code will now specify that employers may inquire about an applicant’s salary expectations applicable to the position to which a candidate is applying. External applicants (not current employees) are entitled to a pay scale upon request, but only after completing an initial interview. Criminal Background Checks (SB1412): Current law generally prohibits employers from considering judicially sealed or expunged convictions when conducting a criminal background check on a job applicant. However, employers hiring for certain sensitive positions cannot legally hire applicants with specific convictions, such as where a bank teller has a conviction related to a bank robbery, even if sealed or expunged. SB 1412 narrows an employer’s ability
to consider sealed or expunged convictions to only those circumstances where a particular conviction would legally prohibit someone from holding that job.
DISCRIMINATION, HARASSMENT AND RETALIATION PROTECTIONS: Defamation Protection (AB 2770): Under this bill, employers and victims of sexual harassment will be protected from liability for defamation lawsuits for injury to an alleged harasser’s reputation after a complaint of sexual harassment has been made. An employee who makes credible reports of harassment will be shielded from liability, as will an employer who communicates with interested parties such as victims and witnesses. When contacted for a job reference about a current or former employee, an employer will now be permitted to reveal whether the individual is not eligible for rehire because the employer determined that he/she engaged in sexual harassment. Confidentiality Clauses in Settlement Agreements (SB 820): This new law expands the types of cases in which socalled “secret settlements” are restricted. It prohibits any settlement agreement in a case where sexual harassment, assault or discrimination has been alleged from including a confidentiality provision that prohibits disclosure of information regarding the claim, except with regard to the claimant’s identity. Sexual Harassment (SB 1300): In this sweeping new law, the legislature declared its intent to create a much lower bar for employees to bring harassment lawsuits, and limited the ability of employers to obtain summary judgment in such cases.

The Department of Fair Employment and Housing will be required to provide an online training course that meets the new legal requirements. Waivers of Right To Testify (AB 3109): Under this new law, any provision in a contract or settlement agreement will be unenforceable if it prohibits a party to the contract from testifying about criminal conduct or sexual harassment in an administrative, legislative or judicial proceeding. AB 3109 covers only testimony that is required, such as by subpoena or court order, or in response to a written request in an administrative or legislative hearing. Gender Representation on Boards of Directors (SB 826): Any publicly held corporation with principal executive offices in California will now be required to place at least one female director on its board by December 31, 2019. A corporation may increase the number of directors on its board to comply. Depending on the board’s size, up to three female members may be required by the end of 2021. Significant financial penalties apply if a company fails to achieve the required number of female directors. In his signing letter for SB 826, Governor Brown noted that there have been “serious legal concerns” raised about its mandate. Such a quota likely violates the United States Constitution, California’s Constitution, California’s Civil Rights Act and the internal affairs doctrine, which places companies headquartered in California in a legal predicament. Sexual Harassment Training (SB 1343):

Current law requires employers with 50 or more employees to provide supervisors with two hours of sexual harassment training within six months of hire or promotion. Beginning January 1, 2020, all employers with five or more employees will be required to provide two hours of sexual harassment training to supervisors and one hour to nonsupervisory

WELDING PROGRAM RECEIVES $1 MILLION
F
ullerton College recently benefitted from $1 million in funding from the 2018-19 State Budget designated to improve and modernize the college’s welding program. Assemblywoman Quirk-Silva, who represents the district in the state Assembly, was instrumental in securing the funds that will provide students an opportunity to gain the skills needed to meet the growing needs of the industry. “This funding represents a critical investment in Orange County, and California’s future workforce and economy,” Quirk-Silva said. “American manufacturing is the bedrock of our economy, and students with the technical skills learned in this department will find a wide variety of manufacturing opportunities and technical positions in today’s job market.” The Assemblywoman visited the Welding Department and presented a ceremonial check emphasizing importance of the workforce training programs at the college and thanked faculty and students for the positive impact they make in Orange County’s economy and job market. The check presentation coincided with National Manufacturing Week, which provides an opportunity for manufacturers, community colleges and universities to open their doors to highlight new and emerging technology used in advanced manufacturing. “This funding support for our welding and manufacturing programs will allow Fullerton College to be more responsive to the significant demand for certified welders, welding inspectors, and manufacturing technicians in Orange County and beyond,” said Fullerton College President Dr. Greg Schulz. “We are so grateful for this support and the doors it will help us open for students. These funds will help us serve a greater number of women, minorities, veterans, unemployed and underemployed individuals.”

Fullerton College also plans to purchase new fabrication and cutting equipment, designed to train students to design more complex structural weldments. Manufacturing is increasingly adopting welding robots and technicians in automation, and adding robotic technology will help the college’s facilities up-todate with technology used in manufacturing around the globe. “These are exciting projects that will have a great impact for many years. Thank you Representative Quirk-Silva for your vision and support of manufacturing and welding in our area,” remarked Ken Starkman, Dean of Technology and Engineering. Other improvements include welding inspection instruction and lab spaces will be installed to teach inspection processes and skills. In addition, the welding technology department will further their outreach to veterans and encourage them to continue in new training programs that lead to jobs in manufacturing. The college has been in talks with Chip Foose and Mitch Lanzini, from the TLC Network show Overhaulin’, to help the department build a functional welding vehicle to bring welding education to area schools and businesses.

BG: Not only do we provide

When people walk through our doors, it is rewarding to hear them say, “I feel like I’m in a shop back home.” If the customer has never been to Britain before, we also get the same reaction of how quaint and homelike the feel of the store is to them and that it transports them into a new experience.

BG: Facebook has been
successful in helping us to update our customers on all the new products we get in. As many returning customers know, Christmas and Easter holidays are some of our most busy times of year because we get in the unique seasonal items.
We also cross market through our pub and restaurant, The Olde Ship. We have locations in Downtown Fullerton and Santa Ana. When the World Cup was going on, we had customers come in looking for banners and flags to celebrate with. We make it a point to advertise The British Grocer through our restaurants so people can bring home with them the same quality products we serve.

North Orange County Chamber (NOCC) investors recently gathered for an intimate gathering with Sheriff Sandra Hutchens, OC’s Top Cop.

Sheriff Hutchens, who is retiring this year, was elected as the 12th Sheriff-Coroner for Orange County in June 2010 after first accepting an appointment from the Orange County Board of Supervisors to serve out a two-year term of her predecessor. The Sheriff rose through the ranks of law enforcement and now leads more than 3,800 sworn and professional men and women who serve in areas as diverse as Patrol Operations, Criminal and Special Investigations, the County’s Crime Lab and the courts, Coroner’s Office. In addition, she oversees those who serve in Orange County’s five jails that collectively comprise the eighth largest jail system in the nation.
During her remarks, Sheriff Hutchens gave an insider view of how the Orange County Sheriff’s Department manages difficult issues such as impacts of California criminal justice reform, efforts to combat the opioid epidemic, and school safety --- all while maintaining OC’s quality of life.

The session also addressed the guests concerns regarding public safety, especially in our schools, and how a new standardized program APT – Assess, Prepare, Train – would assist school districts and law enforcement to prepare and prevent critical incidents on campuses. Sheriff Hutchens concluded the program stating, “One of the top ways to keep your city safe is through community engagement. You are the eyes and ears of your community.”

Since I started my internship in Spring 2016, the North Orange County Chamber has always encouraged my growth as a designer. The Chamber provided opportunities to build relationships, take initiative, and learn to work with challenges. One of the many favorite aspects working here has been seeing the organization growing throughout the North Orange County region. I continued to work for NOCC after graduating in May 2018 from California State University, Fullerton, but will now make my departure in mid November 2018. I will begin working for Dynamic Dynosaur, a design firm located in Costa Mesa. I will be collaborating with the design team in producing Fender Musical Instruments Corporation designs and promotional materials. I am excited for the opportunities ahead, but truly grateful for the experience gained at the NOCC.

Through my internship at the NOCC, I was able to use the skills I developed in bill tracking and policy analysis to acquire a part-time job at the Association of California Cities Orange County, which coincided with graduation from California State University, Fullerton. At that time, I was immediately able to step into a role as a Policy Assistant compiling an analysis of council meetings of Orange County cities and tracking legislation at the state level.
NOCC empowered me to be creative and provided me with individual projects to allow me to gain a sense of responsibility for my work. Through my internship at NOCC I was able to gain experience in strategic messaging, event planning and networking.
I recently started working at FASTSIGNS in Fullerton as a visual communications specialist. The majority of my day is spent communicating with my coworkers and our many clients. My internship at North Orange County Chamber prepared me for this position in many ways, but most importantly it helped me to practice and perfect my interpersonal communication skills.

My position has now evolved into a full-time job as a Policy Analyst where I coordinate committee meetings and workshops, conduct research, and have facilitated contract negotiations between telecommunications carriers and several Orange County cities. The Chamber opened my eyes to the importance of all the various stakeholders throughout the region. Further, they introduced me to my future supervisor at my first full-time position at Prime Strategies of California, a public affairs firm located in Los Angeles. As an Associate, I serve as a liaison between clients and various elected officials while also conducting research on topics including bills or propositions that relate to the client.
