At the helm of Esterline’s Buena Park operation is Dr. John H. Danley, Jr. who serves as President of the North America Operations for Esterline Power Systems. Escalating prices are largely due to the region’s severe housing deficit. The Orange County Business Council (OCBC) puts the local housing supply shortfall at 50,000 to 62,000 units per year.

Yet, Orange County continues to add jobs. One can only assume that those leaving to live in nearby Riverside and San Bernardino counties are returning to the OC job market. As Walrod goes on to say, nearly 40% of the OC workforce commutes more than an hour a day, adding significant usage to our roads and freeways.
Orange County needs to get serious about increasing our housing supply if the region is to remain attractive to a younger workforce – keeping in mind that supply and demand is only one slice of the pie. Studies suggest that an increase in housing supply could lower cost of purchasing or renting a home. In the recent UCLA Anderson Forecast, the authors state that a 20% increase in housing stock could lower overall prices by 10%. While such a scenario is difficult to imagine, how would these dynamics affect Orange County? By loosely applying the math, and pulling data from Cal State Fullerton’s Center for Demographic Research, to meet the housing demand, Orange County would have to add an additional 216,712 housing units to complement our current stock of 1,083,563. However, even if this were possible, deducting 10% from the current median home price still puts the average home out of reach for those earning the OC median household income of $78,428. Increasing our housing stock is imperative – but housing production must also be more cost effective. According to the McKinsey Global Institute, California’s local impact fees can account for up to 15% of the cost of a home, and can vary per jurisdiction. To compare nationally, California’s local impact fees are three times the national average. To put this in perspective, in just the last year, the Building Industry Association - OC Government Affairs team has engaged on over a dozen local impact fee proposals, with some jurisdictions pushing increases upwards of 100%. Local impact fees can include park fees, traffic fees and the counter productive public art fee – requiring new home construction to pay for public art within a city’s boundaries – all with the possibility of adding thousands to the final purchase price of a new home. Given limited available land, combined with increasing land and labor costs, Orange County’s local elected officials need to reject inequitable fee increases and burdensome regulations. Furthermore, local jurisdictions should consider flexible design standards to accommodate more infill product with a modest increase in height and density – looking to underutilized commercial and industrial zones for residential usage. There are ways to help alleviate our current state of housing and ensure our strengthening economy continues to flourish. If we want to keep our workforce, we need to adequately plan for an increase of housing – but it will require all of us to get on board; employers, employees, and current homeowners.

PASS-THROUGH BUSINESSES Owners of partnerships, S corporations, and sole proprietorships, which are taxed as “pass-through” entities, have paid tax at the owner’s individual tax rate. Under the newly adopted bill, for tax years after 2017 and before 2026, individuals would be allowed to deduct 20% of “qualified business income” from a partnership, S corporation, or sole proprietorships, as well as 20% of qualified real estate investment trust (REIT) dividends, qualified cooperative dividends, and qualified publicly traded partnership income. (Special rules would apply to specified agricultural or horticultural cooperatives.) A limitation on the deduction would be phased in based on W-2 wages above a threshold amount of taxable income. The deduction would also be disallowed for specified service trades or businesses with income above a threshold. Nuances of the law are many, so please consult a tax professional for details and specific impacts to your business or industry.
ALTERNATIVE MINIMUM TAX (AMT) The final GOP bill gets rid of the corporate alternative minimum tax, a big relief to the business community.

NEW YEAR, NEW EMPLOYMENT LAWS
I
n 2017, the California legislature enacted new employment laws that may affect your business’s day-to-day operations in 2018 and beyond. Summarized below are those regulations that will affect nearly all employers. Please contact your HR specialist for more information or call NOCC for a copy of CalChamber’s white paper summarizing regulations changing for businesses. Employer notice and posting requirements will change as a result of new laws. In addition to those areas noted below, keep in mind that on January 1, 2018, the state minimum wage increases to $10.50 per hour for employers with 25 or fewer employees and to $11 per hour for employers with 26 or more employees. Every California employer is required to update their notices and postings. Posters are available for purchase from the Chamber.
SB 63 - PARENTAL LEAVE FOR SMALL EMPLOYERS: An important new law requires that small employers provide new parents with up to 12 workweeks of unpaid leave. The New Parent Leave Act, requires small businesses with 20 or more employees to provide eligible employees up to 12 weeks of unpaid, job-protected leave to bond with a new child. The leave must be taken within one year of the child’s birth, adoption, or foster care placement.
AB 1008-BAN-THE-BOX LAW: Employers with five or more employees are now prohibited from asking about criminal history information on job applications and from inquiring about or considering criminal history at any time before a conditional offer of employment has been made. There are limited exemptions for certain positions, such as those where a criminal background check is required by federal, state or local law. Once an employer has made a conditional offer of employment, it may seek certain criminal history information. However, before denying employment because of a criminal conviction, these specific steps must be followed: • The employer must first conduct an individualized assessment to determine whether the conviction has a direct and adverse relationship with the job’s specific duties that justifies denying employment. • Any preliminary decision not to hire because of a conviction history requires written notice to the applicant, who must be given the opportunity to respond. A specific timeline and process for this step must be followed. The employer must consider any information provided by the applicant before making a final decision.
The legislation requires employers to provide parental leave only for baby bonding; it does not require employers to provide leave for other reasons, such as a family member’s medical issue. The New Parent Leave Act will have the greatest impact on employers with 20 to 49 employees who are not currently required to provide baby bonding leave under the federal Family and Medical Leave Act or the state California Family Rights Act. If an employee takes this leave, an employer must maintain and pay for coverage under a group health plan at the same level and conditions that coverage would have been provided if the employee had continued working.
• Any final decision to deny employment because of the criminal conviction requires another specific written notice to the applicant.
Before the leave starts, an employer must provide the employee with a guarantee of reinstatement to the same or comparable position. Failure to provide the guarantee will be deemed a violation of the law, as if the employer refused to provide leave.
AB 450-THE IMMIGRANT WORKER PROTECTION ACT:

AB 168-NO MORE SALARY HISTORY QUESTIONS: Employers may not ask about a job applicant’s prior salary, compensation or benefits (either directly or through an agent, such as a third-party recruiter). In addition, employers cannot rely on salary history information as a factor in determining whether to hire the applicant or how much to pay the applicant. However, an employer may consider salary information that is voluntarily disclosed by the applicant without any prompting. Workers are provided protection from immigration enforcement while on the job and imposes varying fines from $2,000 to $10,000 for violating its provisions.
AB 450’s provisions include the following: • Employers cannot give federal immigration enforcement agents access to non-public areas of a business without a judicial warrant. • Employers cannot provide these enforcement agents access to employee records without a subpoena or judicial warrant. This prohibition does not apply to Form I-9 or other documents for which a Notice of Inspection was provided to the employer. • Employers must follow specific requirements related to Form I-9 inspections. Those requirements are to: • Post a notice to all current employees informing them of any federal immigration agency’s inspections of Forms I-9 or other employment records within 72 hours of receiving the Notice of Inspection. This notice must also be given to the collective bargaining representative, if any. • Provide a copy of the Notice of Inspection to an affected employee upon reasonable request. Once the inspection is over, provide each “affected employee” and the employee’s collective bargaining representative a copy of the inspection results and a written notice of the employer’s and employee’s obligations arising from the inspection. This must be done within 72 hours of receiving the results. An “affected employee” is one identified by the inspection results as potentially lacking work authorization or having document deficiencies. This bill also makes it unlawful for employers to reverify
the employment eligibility of current employees in a time or manner not allowed by federal employment eligibility verification laws.
DISCRIMINATION, HARASSMENT AND RETALIATION PROTECTIONS Several new laws expand employee protections for 2018. Many of these laws focus on gender equality and gender identity/gender expression protections. Highlights of these new laws include:
SB 396-GENDER IDENTITY/GENDER EXPRESSION, SEXUAL ORIENTATION: California employers with 50 or more employees must provide supervisors with two hours of sexual harassment prevention training every two years. Under SB 396, covered employers will have to make sure that any mandatory training course they use also discusses harassment based on gender identity, gender expression and sexual orientation. The legislation also requires employers to display a poster on transgender rights that the Department of Fair Employment and Housing will develop.
SB 179-GENDER IDENTIFICATION: California residents may now choose from three equally recognized gender options — female, male or nonbinary — on state-issued identification cards, birth certificates and driver’s licenses. For changes to birth certificates, the law is effective on September 1, 2018. For changes to driver’s licenses, SB 179 is effective on January 1, 2019. The bill also makes it easier for individuals to change their gender on legal documents effective on September 1, 2018.
