the State Capitol. While Mr. Trump and his victory might earn him national press, Orange County also made headlines in the election with changes to our representatives. Josh Newman was elected by a narrow margin to represent the State of California’s 29th Senate District and Sharon Quirk-Silva returns to the Assembly serving the citizens of the 65th Assembly District. Democrats will now hold a super-majority in both the upper and lower houses of the State Legislature. With this comes an opportunity for coalition and a theoretical ability to pass taxes, amend political spending laws, move constitutional amendments to the ballot, or enact quick-implementing legislation without Republican support. We’ve included a guide to all your elected officials on page 16. As an organization watching out for the interest of business, we will be actively monitoring proposed legislation and keeping you informed of new regulations which might impact you and your ability to profitably grow. Speaking of laws and regulations, a federal court judge has issued a preliminary injunction, halting the implementation of the Department of Labor’s new overtime rule that was set to take effect December 1. The court’s actions temporarily suspend the new rule from taking effect until it can make a ruling on the merits of the case. The incoming administration will now have more time to make changes, including eliminating the ruling or issuing a new rule. While this regulation is not going into effect, others are. New labor posters are required by every business owner. Failure to properly display the federal and state labor regulations can result in thousands of dollars in fines. The North Orange County Regional Consortium for Adult Education (NOCRC) is a collaboration of eight regional members whose mission is to Rethink and Redesign Adult Education…Together. This mission is accomplished by developing and implementing innovative strategies that combine academic programs and support services for adult learners. The consortium was formed in response to Assembly Bill (AB) 104, which created the Adult Education Block Grant (AEBG) and provides California educational partners with $500 million annually to support adult learners through collaboration. Many of these services include partnering with employers and regional social service providers. NOCRC’s members include the North Orange County Community College District (which is comprised of the School of Continuing Education, Fullerton College, and Cypress College), North Orange County ROP, Anaheim Union High School District, Fullerton Joint Union High School District, Garden Grove Unified School District, Los Alamitos Unified School District, Placentia-Yorba Linda Unified School District, and the Orange County Department of Education.

Coursework is conducted in conjunction with the consortium members’, in particular the School of Continuing Education which incorporates academic skills and technical knowledge allowing students to earn certifications and licenses. This combination of soft and technical skills set the consortium’s AEBG students apart from other job candidates. Regional businesses benefit from hiring NOCRC adult education students who have been vetted and screened by NOCRC staff as they have gone through the AEBG program. By partnering with businesses and determining their needs, NOCRC aims to reduce the time and cost involved in finding and onboarding the right talent while mitigating turnover. Businesses are able to meet their human capital needs, while creating job opportunities for adults in the region. Various tax credits and other wage subsidies are available for companies who hire students from the NOCRC program. In addition to working directly with businesses, NOCRC also collaborates with a vast network of partners such as the workforce development boards, human services agencies, nonprofit organizations, financial institutions, and others through initiatives such as the Workforce Innovation and Opportunity Act, Strong Workforce, Doing What Matters, adult education, and more. These collaborations provide tuition-free academic and training programs for adult learners while connecting them with the services they need to be successful in the workforce. Business leaders can get involved with the NOCRC by volunteering to conduct mock interviews and by presenting on work readiness topics such as workplace ethics and expectations, professional dress, and other industry-specific topics to students. Additionally there are opportunities for hosting job shadowing and career exploration events, or serving as an internship/externship site. NEW STATE LAW REQUIRES ALL EMPLOYERS TO ELECTRONICALLY FILE AND PAY TO THE EDD In August 2015, California passed Assembly Bill (AB) 1245 requiring all employers to electronically submit employment tax returns, wage reports, and payroll tax deposits to the Employment Development Department (EDD). Authored by Assembly Member Ken Cooley and sponsored by Small Business California, AB 1245 extends to all employers the requirement to electronically submit employment tax returns, wage reports, and payroll tax deposits to the Employment Development Department (EDD) beginning January 1, 2017. AB 1245 requires employers with 10 or more employees to electronically submit returns, reports, and payments. All remaining employers are required to electronically submit returns, reports, and payments beginning January 1, 2018. Employers required under existing law to electronically submit wage reports and/or electronic funds transfer to the EDD remain subject to those requirements in addition to this new mandate. AB 1245, Electronic filing and paying offers employers many benefits cited under the law which include: • Increased data accuracy in comparison to paper forms. • Protected data through encryption that is more secure than paper forms. • Reduced cost of printing, mailing, and document storage. • Elimination of lost mail. Over 35 percent of California employers already use E-Services for Business; approximately 20 other states use a similar system for tax reporting obligations. Employers can file and pay electronically by completing a one-time enrollment in the EDD’s e-Services for Business. The online service is available 24 hours a day, 7 days a week. There is no cost to enroll and use e-Services for Business, and no specialized software is required. The EDD is committed to supporting employers as they transition to fulfilling this new state requirement. For employers who may be unable to electronically file and pay, a hardship waiver application will be available. Online video tutorials providing step-by-step instructions for enrolling, filing, paying, and many more are available. “PATH FORWARD” PLAN FOR WEST COYOTE HILLS

ity of Fullerton’s approval of the West Coyote Hills “Path Forward” Plan was recently upheld by Orange County Superior Court Judge William Claster. The Plan was negotiated over two and one-half years with Fullerton stakeholders and approved with a unanimous vote of the City Council. This recent legal victory means the negotiated project benefits can become a reality for Fullerton and the entire North Orange County region. The private property, owned by Pacific Coast Homes, will restore and preserve 60 percent of the property to create the largest nature preserve in North Orange County. In addition, based upon the court ruling, the City can pursue a preservation plan purchasing land currently slated for development and set it aside for open space purposes. The City’s initial goal is to preserve the entire eastern portion of the West Coyote Hills property and expand the nature preserve. The State’s Rivers and Mountains Conservancy recently awarded Fullerton a $2 million grant toward achieving the City’s goal of acquiring additional land. So, is it time to take down the fences surrounding the property and schedule a groundbreaking ceremony? Unfortunately, it is still possible project opponents could delay the project by appealing the court’s decision. We’ll know soon. Here’s hoping our new nature trails are not delayed with another round of litigation.

PROPOSITION 64

STAYS OUT OF THE WORKPLACE

n November 8, California joined several other states in legalizing recreational use of marijuana by adults.

Proposition 64, also known as the Adult Use of Marijuana Act, legalizes the recreational use of marijuana for adults 21 years old and over, imposes a 15% excise tax on marijuana sales and establishes a regulatory framework for the sale of marijuana. The provisions related to legalizing marijuana and workplace protections took effect November 9, the day after the election. Legalization of marijuana for recreational purposes will be a significant change to current law. Even with the passage of Proposition 64, however, several things will not change. For example, smoking or ingesting marijuana in public will remain unlawful, as will smoking or ingesting marijuana in places where smoking tobacco also is prohibited. Similarly, driving under the influence of marijuana will remain illegal. But what about smoking weed at work? When it comes to the workplace, California employers can take a deep breath of fresh air, because Proposition 64 intends to maintain the status quo for employers seeking to maintain a drug and alcohol-free workplace. In other words, employer policies related to drug possession, use and impairment as well as testing should not be compromised with the legalization of marijuana use under Proposition 64. Proposition 64’s Workplace Protections With the passage of Proposition 64, adult recreational use of marijuana will be permitted, but such use will stop short at the workplace. Proposition 64 states explicitly that it is intended to “allow public and private employers to enact and enforce workplace policies pertaining to marijuana.” The initiative also provides that it will not be construed or interpreted to amend, repeal, affect, restrict or pre-empt: “The rights and obligations of public and private employers to maintain a drug and alcohol free workplace or require an employer to permit or accommodate the use, consumption, possession, transfer, display,

transportation, sale or growth of marijuana in the workplace, or affect the ability of employers to have policies prohibiting the use of marijuana by employees and prospective employees, or prevent employers from complying with state or federal law.”(Section 11362.45 (f)) These provisions set Proposition 64 apart from the failed 2010 initiative, which did not protect employer policies concerning the use of marijuana in the workplace. Moreover, these provisions demonstrate that the intent of the initiative is not to disrupt the status quo concerning workplace safety and drug prevention. Maintaining a Drug-Free Workplace Although the enactment of Proposition 64 will legalize recreational use of marijuana in California, marijuana still will remain an illegal Schedule I substance under the federal Controlled Substances Act. Therefore, even with the passage of Proposition 64, employers may continue to prohibit use, possession and impairment at work, as well as continue to test for use when appropriate. Similarly, both federal and state laws require employers contracting with the government to maintain a workplace free from drugs and certify that the business is drug-free. Both federal and state drug-free workplace acts prohibit use of “controlled substances,” as defined under the federal Controlled Substances Act. Finally, both state and federal law impose strict drug testing and other related requirements on employers and operators engaged in commercial transportation. As such, employers must continue to comply with these drug-free workplace laws. California employers may conduct pre-employment drug testing of all applicants before hire and deny employment if the drug test comes back positive, even if the applicant was legally using marijuana under the state’s Compassionate Use Act, as affirmed by California’s high court in the 2008 decision of Ross v. RagingWire, 42 Cal. 4th 920 (2008). Proposition 64 does not intend to interfere with these workplace policies or practices. In short, these rights and practices aimed at maintaining a safe and drug-free workplace may continue even after marijuana is legalized for

recreational use. The challenges facing employers won’t be maintaining their drug-free policies and practices, but rather communicating and enforcing these policies and practices if adults are permitted to use marijuana for recreational purposes. Don’t Let Workplace Policies Go Up in Smoke Employers should use this time to review existing policies and remind employees not only about the company’s drug-free workplace policy and practices, but also specify that marijuana is also prohibited. Employees also should be reminded that impairment on the job will not be tolerated, even if impairment was due to a morning smoke before leaving the house for work. When reviewing existing policies or creating new ones, make sure your policy clearly states the company’s position on drugs in the workplace, including marijuana.

In addition, if you conduct pre-employment drug testing, inform all applicants of this policy and clarify that they will also be tested for marijuana use. Finally, once your policy is reviewed and distributed, be sure to follow the policy and steer clear of any exceptions because making an exception for one person could undermine the policy and set your company up for future litigation.

A few other things to consider when developing a drug-free workplace policy: • Establish a policy banning the use, possession or sale of drugs in the workplace and on company property as well as being under the influence of an illegal or controlled substance, including alcohol and marijuana, while on the job. • Train all supervisors about the company’s drug-free workplace policy, emphasizing the seriousness and importance of the policy. • Train your supervisors to identify signs of drug or alcohol use. • Clearly communicate your policy and consider redistributing the policy on an annual basis.
