As we anxiously await new updates from the Office of Cannabis Management, many legacy and native entrepreneurs have already begun building the foundations of their businesses. UberEats Now Allowing Orders for Cannabis in Ontario, Canada

s of November, UberEats will allow users to order Cannabis-products to be picked up at local dispensaries in Ontario, Canada. This is their first step towards an ultimate goal of one day delivering cannabis to consumers across North America, along with food and alcohol.

Uber has had its sights on cannabis for a number of years, and has made no bones about their ultimate goal of delivering cannabis across the United States and North America, once the legislative environment takes hold. In short, once cannabis is federally legalized, plenty of big players (Uber very much included) will be racing to be the first major delivery platform. All things delivered right to your door is the wave of the future; cannabis included. Now to be clear, due to current regulations in Ontario, you can only place orders for cannabis through the UberEats app, and then pick the order up at the dispensary yourself. While obviously not the endgame, this gives Uber Technologies a sandbox to test the process as a whole. For now, Uber has partnered with one dispensary, Tokyo Smoke. Users can place orders at one of Tokyo Smoke’s fifty locations across the Province of Ontario and schedule their pick up times in one-hour windows. If the pandemic has taught us anything, it’s that consumers’ demand for at-home delivery (cannabis-related products included) is only going to continue to surge. As a number of clandestine delivery services have popped up to satisfy this current demand, States/Provinces/Local Governments see this as a logical step in combating illicit (read: untaxed) sales and distribution of Cannabis. Expect these local governments to continue pursuing partnerships with major corporations in order to bolster tax revenue through clamping down on the illegal market. And since it’s really not much of a stretch to expect someone to want to order a bowl of ramen, a bag of Sour Diesel and a bottle of Jameson all through one service in their Friday night of the future, UberEats will not be the only player in this game. Regardless of how you feel about big corporations having a hand in your cannabis (at CannaBuff, we aren’t the biggest fans), it’s hard to argue with innovation here. We live in a world of supply and demand, and a quick scroll through Instagram (or at least my feed) gives you a clear view of the massive demand we see for cannabis products at one’s fingertips. A company like Uber is not blind to this notion, nor are small upstarts who see the potential here. When New York State legalized cannabis, they created a category of licensure just for delivery services. This is on everyone’s radar so only time will tell who will become Cannabis Delivery Company #1 in the nottoo-distant future. WINTER 2021 CannaBuff.com

short 35-minute trip to the Seneca Nation territory will tell you one thing: cannabis entrepreneurs have a massive head start.

Back in March, former Governor Andrew Cuomo signed the Marijuana Regulation and Taxation Act into law. Nine months since its passing, regulations remain unclear and delayed. The Office of Cannabis Management has yet to give out licenses, and sales aren’t expected to begin until 2023. Additionally, the rules for medicinal, homegrown cannabis aren’t determined, something that the MRTA set to be ready by Sept. 31.

Upon entry, there are a myriad of cannabis products for sale: plants, whole-flower, seeds, edibles, concentrates, and for the holidays, themed gift baskets. Mike says that customers are the central focus of the experience. On the reservation, entrepreneurs are skipping the inefficiencies of licensing and opening up their own “mom and pot” shops. According to guidance from the Office of Cannabis Management, cannabis sales on federally-recognized tribal lands remain legal. “We have a board here, but it doesn’t prohibit anybody from engaging in the business right now,” said Mike, part-owner of 420 Rez Bud, a newly-opened tribal dispensary in the WNY area. “Nobody really gets shut down around here that is operating fully-cannabis.”

“That’s a big thing in this industry [testing], especially with the non regulated markets, right, especially when you’re in a city that doesn’t have a dispensary,” Mike said. “People have anything that they can basically pull together and put on the shelves or in their backpack.”

Most tribal dispensaries in the Western New York market aren’t taking extra steps to make sure all products are tested, something that is increasingly important as legalization comes to every county in New York.

Mike says that he tries to help local growers improve their craft and create a platform for those already in the industry to get their plants out there. “We ask for the COA (Certificate of Analysis), the test results and the details surrounding it. It’s like our vetting process to make sure we maintain quality,” he said. Rigorous testing standards like this are not often seen in the developing industry on the reservation, yet provide a necessary safeguard against potentially life-threatening hazards. “We have people that come in with COPD and they come here because they went to other places and were like ‘I smoke their product and it made me cough, it made me sick.’”


Aside from cheaper prices and rewards, members also have access to a rosin press, where they can bring in their own cannabis and have it pressed into a concentrate on-the-spot.

Above all else, he sees the business as a way to “recycle the dollars” in the local community.

“It’s a simple service for our members that we offer, as a perk,” he said. “We’re the only cannabis dispensary that’s even offering memberships and promotional discounts and access to, you know, more affordable products and more affordable premiums.” “We’re trying to differentiate ourselves from everybody else. New York State for one, they don’t share any information with you about their test results,” Mike said of the available cannabis in the New York State medical program. “We’re already doing more than them by providing strain genetics and information about how it was grown, and if they want to know who it is grown by we know who they are and we have files for everything,” he said. Mike foresees a future filled with an array of creative endeavors. They already offer promotional shopping days, and discounts for veterans or medical card carriers. As a patient in New York’s medical program himself, Mike saw a need to use his platform to give access.

“If anybody wears Bill’s stuff in, they get discounts on Bill’s day or anytime they’re playing a game,” he said of available promotions. “Basically, try to help people out and give them an affordable option because the New York State market was giving me substandard care, grinding my flower before I could take it home, and they have really expensive carts that are cost prohibitive to most patients.” On December 1st, 420 Rez Bud launched their membership program. “You have an account set up with us so you have a loyalty member card and for every dollar you spend we have a multiplier effect based on the day of the week or anything that we decide for promotions,” Mike said.

420 Rez Bud is busy thinking up new ways to engage with the community as a cannabis startup. One such idea involves cryptocurrency. “There’s a Bitcoin ATM actually down the road. So I was like, oh, there’s already a Bitcoin ATM that you can withdraw from, but you can’t deposit into…We’re going to have a two-way terminal here. So you could access Bitcoin and any cryptos that you can convert in your wallet,” he said. Another idea involves wheels. “We’re actually working on getting a mobile dispensary next,” Mike said. “We have a food truck that we’re converting into a dispensary, I might call it Miss Daisy, or something like that, just something fun and nice to see around.” The dispensary space is filled with culture and sells artwork from the surrounding native communities. Across the walls, Mike’s mother displays a hand-beaded pot leaf and watercolor warhorse paintings. Another artist uses deer antlers to make pipes with a wampum belt. Tuscarora Woodworks showcase their craftsmanship through engraved wooden coasters for sale by the register. In the future, Mike hopes to expand the square footage of the store to include, “Someplace where you have more of an experience and you could sit down or have someplace to meander and have something to look at and be entertained while you’re waiting to find your selection.”

“Cannabis, and I’ve been noticing this, is a catalyst for other businesses,” Mike said. “Here, the business across the way is doing a lot better because of us and we are doing good because of them. Others said their restaurant picked up or they did more in gas.” As he sets his sights on the future, Mike hopes consumers follow his advice. “I would say for the cannabis industry specifically, support the small guys.”

LEGISLATIVE UPDATE New Jersey Adult-Use Cannabis Legislation, Rules, and Regulations | Part 2

W

ith New York’s adult use program in limbo (with developments afoot at the time of this writing), this quarter’s column focuses on our tri-state neighbor, whose program is a little bit further along. New Jersey is one of eight states that have legalized the recreational use of cannabis in the last year. After New Jersey residents approved a constitutional amendment to legalize, Governor Phil Murphy signed three bills into law that both decriminalize cannabis and create a path for a legal recreational market: (1) The New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (the “Adult-Use Act”), (2) Assembly Bill No. 1897 (the “Decriminalization Bill”), and (3) Assembly Bill No. 5342 (a “Clean-Up Bill,” which rectifies some contradictory language in the first two bills). The Adult-Use Act legalizes sale

and possession of regulated cannabis—in other words, cannabis you buy at a licensed store in New Jersey. Those stores have not been set up yet. Possession of up to six ounces of unregulated cannabis is decriminalized, like a parking ticket. Buying and selling cannabis is not legal in New Jersey until licenses are awarded to those businesses that will make up the new legal market. The Adult-Use Act also created the Cannabis Regulatory Commission (“CRC”) as the regulatory entity governing the personal use of cannabis. The Adult-Use Act creates six classes of licenses: Grower, Processor, Wholesaler, Distributor, Retailer, and Delivery. In addition to a “full” license for each of those classes, New Jersey also contemplates a “conditional” version and a “microbusiness” version of each class of license. A “conditional” license has a shortened application process, so it allows licensees to begin

operations sooner. These licenses are designed to help ease the burden for smaller businesses to enter the market. Following issuance of a conditional license, the holder has a limited period of time to become fully licensed by satisfying all remaining conditions for full licensure that were not required for the conditional license. The “conditional” process is only available when any person with decision-making authority for the licensee has an adjusted gross income no higher than $200,000 (or $400,000 if their taxes are filed jointly). Conditional licenses will make up 35% of the total licenses issued for each class. A “microbusiness” is a license to operate on a limited scale. To qualify, the licensee must have no more than 10 employees, and comply with caps on the amount of cannabis cultivated and sold, along with other restrictions. A microbusiness license can convert to a full license. At least 10% of the total licenses issued for each license class, and at least 25% of the overall total number of licenses issued, will be issued to microbusinesses. On-premises consumption licenses will also be available. A licensed cannabis retailer, medical cannabis dispensary, or clinical registrant may apply to the CRC to operate a cannabis consumption area, which will need to comply with all ventilation requirements applicable to cigar lounges under New Jersey law. Potential applicants should carefully consider which type of license to obtain. Like New York’s legislation, New Jersey prohibits vertical integration and limits the number of licenses that can be held by the same person. For the next two years, a licensed cultivator, manufacturer, wholesaler, distributor, or delivery service cannot also be a licensed retailer—and vice versa. A cultivator or manufacturer may

only hold two licenses at the same time. And a wholesaler cannot hold any other license except distributor. There are demographic requirements which potential applicants should keep in mind. For all licenses, New Jersey’s legislation has rules which require licensees to include a person who has lived in New Jersey for at least two years. The CRC will also rank applications with a point system based on a variety of criteria— such as an applicant’s operating, environmental, and safety and security plans. Applications will be prioritized using several factors, such as whether the applicant is a certified minority, woman, and disabled veteran-owned business. The CRC will also prioritize awarding licenses within municipalities negatively impacted by unemployment, poverty, or past marijuana enforcement activity. Unlike New York (and every other state that has passed adult-use legislation), New Jersey does not allow growing marijuana plants at home. Possession of 10 or more plants at home still carries a potential 10 to 20-year prison sentence. While bills have been introduced to allow those ages 21 years and older to grow a set amount of plants on their own, no law has been passed in New Jersey to date. New Jersey’s CRC has also promulgated proposed regulations which spell out further specifics of the program. That puts New Jersey at least a step ahead of New York. And the New Jersey CRC’s rules are likely indicative of what we can expect at some point from New York’s Office of Cannabis Management. Stay tuned next quarter for analysis of those regulations, and how New Yorkers can use them as a guidepost.

Neuropathy CAN ONE FIND RELIEF WITH CANNABIS? BY DR. LASZLO MECHTLER

t is estimated that over one billion people globally suffer from neuropathy and its associated symptoms, making this condition an undeniable problem. Affecting approximately 30% of the US population alone, chances are you or someone you know will be diagnosed with neuropathy at some point during their lifetime. While most prevalent in those over the age of 50, neuropathy affects people of all ages.

I

Tell-tale signs of this condition include tingling, numbness, pain, and muscle weakness. The underlying causes of neuropathy may be a result of trauma/ injury, prolonged nerve pressure, compression, inflammation, continuous/repetitive motions, use of certain medications, and/ or other diseases. The wide variety of underlying causes of neuropathy can make it challenging to treat, especially since these etiologies or causes tend to overlap. However, even if a cause is identified, successful pain management varies from individual to individual, requiring trials of various pharmaceutical interventions such as anticonvulsants (gabapentin), antidepressants (amitriptyline), opioid analgesics (oxycodone), analgesic lotions to find the most optimal multimodal therapeutic option. While these pharmaceuticals are often successful in treating the patient’s symptoms they can also come with a host of undesired side effects that may deteriorate the patient’s quality of life including but not limited to fatigue, cognition issues,

and worst yet addiction. As such, patients and physicians are increasingly looking for other options that both treat the underlying symptoms and avoid the potential side effects associated with current pharmaceutical interventions. This quest has led many physicians to depart from these so-called standard pharmaceutical interventions in favor of medical cannabis products (inclusive of marijuana and hemp preparations). This is possible as the more than 1,200 chemical substances found in/ on the cannabis plant, like other analgesics, act on receptors that lead to the perception of pain. In acting on these receptors cannabis is able to

Some of its known mechanisms of action include the inhibition of the cyclooxygenase-2 enzyme, increase in serotonin, inhibition of L-type calcium voltage-gated channel, and an increase in GABA, all mechanisms targeted by widely used analgesics today. As a result cannabis, ie. THC and CBD and the other 142 cannabinoids within the cannabis plant can provide therapeutic benefits by modulating various pathways of pain in the body. Though with its many chemical components the impact of cannabis goes far beyond just pain signaling and impacts the body in ways that are not yet fully understood. With limited clinical information regarding the use of medical cannabis in the treatment plans of those diagnosed with neuropathy, my team and I undertook a study evaluating clinical outcomes of more than 900 patients aged 22-90 in our clinic suffering from neuropathy who were using cannabis as part of their comprehensive treatment plan. The results were rather impressive with 85.0% of patients reporting symptom improvements. Furthermore, 25% of patients who were utilizing opioids were able to reduce their consumption. Of note was the low rate of side effects associated with cannabis use at 28% with the vast majority of these minor in nature. Only two patients discontinued cannabis therapy due to side effects which as a provider indicates not only do patients find clinically meaningful benefits, but that side effects associated with medical cannabis are well tolerated. I should also note that cannabis therapy was added to the patient’s current treatment plan, thus many were already established on standard

pharmaceutical interventions. Initiation of cannabis therapy did allow for some patients to reduce or completely discontinue standard interventions such as gabapentin and pregabalin (Lyrica®). The vast majority of patients achieved these results using a single cannabis product which was typically a 1:1 (THC:CBD) tincture. When coupling these results with the many anecdotal reports of benefits, it is clear that cannabis therapy has a place in the comprehensive treatment plan of those suffering from neuropathies. Impacting patients of all ages and walks of life, the potential of this plant in this population is extremely promising, though randomized placebo-controlled trials are needed to fully elucidate how this therapy can be used in widespread clinical practice. Should one be interested in pursuing cannabis therapy as part of their care plan it is vitally important that they consult a knowledgeable clinician who is able to help guide their treatment decisions.
