For seven days thousands of people go out onto the streets to bring life to one of the most popular religious festivals in Andalucia.
L
o más llamativo de estas jornadas de pasión son las procesiones de las imágenes de Cristo y la Virgen María ya sean en tronos o en pasos, que son grandes altares en movimiento portados por hombres y mujeres. Durante la semana, se puede admirar el amplio abanico de estilos artísticos y grandes obras de la imaginería de todos los tiempos; desde el barroco de Juan de Mesa o Martínez Montañés a imágenes más contemporáneas como las de Mariano Benlliure. También la arquitectura se convierte en un escenario esencial. En Sevilla, todas las cofradías recorren el interior de su Catedral, llamada La Giralda, y que es el tercer templo católico más grande del mundo. de la Mezquita o cuando en Granada las imágenes desfilan junto a la Alhambra. También, son días para conocer la grandeza de los barrios, como el de La Viña en Cádiz, La Almedina en Almería, la judería cordobesa o el barrio inglés de la Reina Victoria en Huelva, declarado Bien de Interés Cultural en el año 2002. Es una celebración multitudinaria como puede verse en la gran cantidad de penitentes vestidos de nazareno que acompañan a las imágenes. Es sinónimo de devoción, tal y como proclaman las más de 10.000 personas que acompañan durante la ‘madrugá’ del Viernes Santo a Nuestro Padre Jesús Nazareno de Jaén, conocido popularmente como ‘El Abuelo’.
THE MOST STRIKING ELEMENT of these days of passion are the processions of images of Christ and the Virgin Mary on floats like enormous moving altars, carried on the shoulders of men and women. During the week, a wide range of artistic styles and great works of imagination from every era can be admired: from the Baroque of Juan de Mesa or Martínez Montañés to the more contemporary images of Mariano Benlliure. Architecture also becomes an essential back-drop. In Sevilla, all the brotherhoods go round the inside of the cathedral, which is the third largest Catholic place of worship in the world. The same happens in Cordoba under the arches of the Mezquita, or in Granada where images are carried in procession beside the Alhambra. These are also days to discover the magnificence of districts such as La Viña in Cadiz, La Almedina in Almería, the Jewish quarter in
Cordoba, or the English Reina Victoria in Huelva, declared a Place of Cultural Interest in 2002. Easter is a celebration of the faithful en masse, as can be seen in the large number of penitents dressed as Nazarenes who accompany the images. It is synonymous with devotion, as proclaimed by the multitude of more than 10,000 who in Jaen during the early hours of Good Friday accompany Nuestro Padre Jesús Nazareno, known locally as ‘The Grandfather’; or the tens of thousands of devotees who walk behind Nuestro Padre Jesús Cautivo on the Monday night of Easter Week in Malaga. A curious scene is played out here in front of crowds of people. With the image of Nuestro Padre Jesús, called ‘The Rich One’, a prisoner in his procession is freed on the Wednesday of Easter Week, thanks to a privilege granted by Carlos III in the 18th century.

O las decenas de miles de devotos que caminan detrás de Nuestro Padre Jesús Cautivo la noche del Lunes Santo en Málaga. También aquí se vive una escena muy curiosa y que congrega a una gran multitud de personas. La imagen de Nuestro Padre Jesús titulado ‘El Rico’ libera a un preso en su procesión del Miércoles Santo, gracias a un privilegio otorgado por el Rey Carlos III en el siglo XVIII. Es también una ventana para contemplar los oficios artesanos nacidos hace siglos. Bordados y filigranas de oro, plata o caoba que envuelven de arte cada escena de la Pasión. Escenas que en localidades como el pueblo malagueño de Riogordo, cobran vida. Desde 1951 más de 500 actores aficionados representan La Pasión y Muerte de Jesucristo, tradición basada en unos pregones que datan del siglo XVII. Esto ha hecho que esta fiesta fuera declarada de Interés Turístico Nacional. Pero como todo gran espectáculo también tiene banda sonora. Una gran variedad de géneros musicales se concentran en estos días.

Embroidery and filigree in gold, silver and mahogany artistically decorate each scene of the Passion. Some of these scenes really come to life. In Riogordo, a village in the province of Malaga, more than 500 amateur actors have, since 1951, been representing the Passion and Death of Jesus Christ in a tradition based on proclamations dating from the 17th century. This has now been declared a festival of National Tourist Interest. As in any grand spectacle in which pride is taken, there has to be music. A large variety of musical genres come together during these days. Musical bands, bands of trumpets and drums, or groups of musicians process behind the images of Christ and the Virgin in perfect harmony.

Su grandiosidad ha dado lugar a que en tres capitales andaluzas como son Málaga, Granada y Sevilla su Semana Santa haya sido declarada de Interés Turístico Internacional.
These are only some of the sounds to be heard in Andalucía in Easter Week: in Cordoba you can listen to Gregorian chant and in Almería the tunas (university student groups). Flamenco, now declared part of World Heritage, is also present when heard in the streets of Jerez. But we must not forget the power of silence. Many brotherhoods walk through the streets without any kind of musical accompaniment, engendering a greater degree of devotion. Easter Week is unique. Moreover, it provides a significant dynamic element to tourist activities in Andalucia.
Bandas de música, bandas de cornetas y tambores o agrupaciones musicales desfilan tras los cristos y las vírgenes formando un binomio perfecto. Pero son muchos los sonidos que se dan cita en la Semana Santa de Andalucía, como es el canto gregoriano en Córdoba o el sonido de las tunas en Almería. Sin olvidar el flamenco, recientemente declarado Patrimonio de la Humanidad, cuando suena en las calles de Jerez. Pero no hay que olvidar el silencio. Numerosas cofradías salen a la calle sin ningún tipo de acompañamiento musical, lo que aporta un mayor grado de recogimiento. Las características de Semana Santa la hacen singular. Y además, un importante elemento dinamizador de la actividad turística de Andalucía. 14

S
alimos de Marbella camino de Jerez. Antes de llegar a Algeciras nos desviamos a la derecha y a partir de Los Barrios, entre alcornoques y encinas, un paisaje idílico se abre ante nuestros ojos. A izquierda y derecha de la autovía, reses bravas pastan con calma en espacios abiertos. Pasado Los Barrios y a la izquierda, la ganadería de Gavira, un clásico en las ferias taurinas de España. A la altura de Medina Sidonia vemos a la derecha, en la finca La Zorrera, reses con pelaje castaño y algunos salpicados de pelos blancos que indican que la ganadería de Cebada Gago se hace protagonista. Animales con mirada retadora y aviesa, pánico para los toreros. El Toñanejo de Torrealta a la izquierda, pasado Medina, 16

y justo después, siempre dirección Jerez, también a la izquierda, está el Marqués de Domecq y Casa de los Toreros. El toro bravo vive rodeado de cuidados veterinarios y en libertad, forjándose como el “samurai” de los animales. A los cuatro o cinco años (el equivalente a un hombre de 35 a 40 años) y sólo los machos, irán a la plaza para desarrollar su genética. Defenderán con su bravura una especie única cuyo cerebro, a través de la selección de las madres más bravas y agresivas y los sementales más fieros y acometedores, está preparado para el combate hasta el punto que las últimas investigaciones serias y rigurosas, realizadas por catedráticos de veterinaria, han descubierto que es un cerebro diferente al resto de bóvidos.
RUTAS DEL TORO
En los tentaderos, una ceremonia de selección de bravura en plazas de toros pequeñas que están en la propia dehesa, los toreros profesionales más famosos muestran al ganadero mediante su toreo las cientos de cualidades de la embestida. El criador observa para elegir a las más bravas vacas y fieros sementales, posteriores reproductores de la casta. Esta Ruta del toro y sus dehesas suponen un ejemplo de la sostenibilidad del medio ambiente y su explotación por el hombre. Se trata de un ecosistema avanzado que ha llegado a convertirse en un referente para la Unión Europea. Recientemente la Junta de Andalucía ha blindado su futuro en una ley de protección de la dehesa brava. Se sabe que en un metro cuadrado de dehesa viven mil especies vivas distintas según trabajos rigurosos de biólogos que han estudiado el medio. Para Andalucía la industria del toro bravo es una fuente de riqueza, de empleo y de cultura. En la Ruta del toro encontramos 32 hierros de primera categoría que lucen por todo el mundo taurino. Son ganaderías emblemáticas de las 152 que componen la flor y nata del campo bravo en Andalucía. Además unas 1200 explotaciones de ganado de casta (en toda España) conforman una extensión de terreno del tamaño de la provincia de Alava en la que la especulación y el deterioro del medio ambiente no tienen cabida. OF THE BULLS A TERRITORY OF FEAR
This Ruta del Toro and its surrounding pastureland is an example of sustainability of the environment and its exploitation by man. WE LEAVE MARBELLA AND HEAD TOWARDS JEREZ. Before arriving at Algeciras, we turn right and after Los Barrios find ourselves among cork oaks and holm oaks. An idyllic landscape opens out before us. On both sides of the dualcarriageway, the fighting bulls graze peacefully over wide open spaces. On the left, after Los Barrios, is the Gavira livestock farm, whose name features prominently 18

in Spanish bullfighting festivals. Nearer to Medina Sidonia we see on the right La Zorrera and their chestnut coloured bulls, some spotted with white indicating that the Cebada Gago livestock have played a major role here. These are animals with a challenging and evil look, ones that inspire panic in bullfighters. After Medina, on the left, is the Toñanejo de Torrealta ranch and a little

Catorce años después de ingresar con sus siete hermanos en la Aldea Infantil SOS de Madrid, Lorena es Licenciada en Magisterio, está en segundo de Psicología, vive independiente y trabaja como educadora en la escuela infantil de Aldeas Infantiles SOS. “Muchos hermanos, poco dinero, mi madre la única que trabajaba...; era difícil.” Eran ocho niños y niñas, con edades comprendidas entre los tres y los quince años. Lorena, de doce, era la segunda y tuvo la oportunidad, junto con su hermana mayor, de permanecer con sus padres mientras los demás hermanos se trasladaban desde su Cuenca natal a Madrid. Decidieron mantenerse juntos. Y un día de julio de 1995 llegaron al que en principio iba a ser su hogar sólo durante unos meses, hasta que sus padres pudieran rehacer su situación económica. “El mayor problema para adaptarnos fue la separación. Adaptarse a nuevas normas y reglas, nuevos colegios y nuevos niños de procedencias muy diversas también requirió esfuerzo, pero no tardaron en hacerse a su nueva vida. A lo largo de esos años, primero en la Aldea, después en la Residencia de Jóvenes y por último en un piso asistido de alta autonomía, Lorena tuvo cuatro educadores. Con cada uno de ellos ha conocido un modelo distinto y piensa que eso le servirá para elegir el que más le guste cuando tenga que educar a sus propios hijos. De momento, después de haberse licenciado en Magisterio, ya practica en su trabajo como educadora en la escuela infantil de Aldeas Infantiles SOS. “Siempre he tenido muy claro que mi vocación son los niños. Ahora trabajo en la escuela infantil. Yo me siento en deuda por todo lo que han hecho por mí y es una manera de devolverlo. Siempre colaboraré con ellos, son mi familia.”
Lorena es consciente de lo afortunada que fue al tener la oportunidad de rehacer su vida en Aldeas. Todas sus necesidades materiales estaban cubiertas, tuvo todo el apoyo necesario para sacar adelante sus estudios, había espacio y tiempo para crecer personalmente y vivió muchas experiencias con personas muy diferentes. “Aldeas Infantiles SOS es un lugar donde se hacen realidad los sueños de muchos niños y donde conseguimos mantener las ilusiones. Cuando llegas crees que lo que pasa en tu familia es lo habitual, pero cuando te dan un hogar descubres lo que es llevar una vida normal. Aquí he sido muy feliz.”

ctualmente, el paseo se extiende desde el Puerto de la Bajadilla en el este de Marbella hasta Puerto Banús. dines frondosos. Sin contar con la gran variedad de chiringuitos, heladerías y restaurantes. Este punto de encuentro es el favorito de todas las edades. Los entusiastas de mantenerse en forma lo utilizan para practicar el power-walking, footing, ciclismo o patinaje y los corredores y ciclistas serios se entrenan.
Las máquinas de ejercicio situadas estratégicamente a lo largo del paseo marítimo ofrecen un entrenamiento muscular añadido. Sin embargo, para la mayoría, la mejor manera de disfrutar del paseo marítimo es de pasear por el y contemplar las vistas. THE PROMENADE currently stretches from the Puerto de la Bajadilla on the east side of Marbella all the way to Puerto Banús. Work is underway to join Puerto Banús to San Pedro and when it’s finished later this year, the promenade will be 17km long. A walk along the promenade takes in plenty of landmarks including three marinas, the attractive pedestrian bridge spanning the River Verde, luxury hotels and beautiful gardens. Not to mention numerous beach bars, ice cream parlours and restaurants. This meeting point is popular with all ages. Children learn to ride their bikes or skates here and teenagers meet and hang out. Keep fit enthusiasts use it to power walk, jog, cycle or skate and serious runners and cyclists train along it. Exercise equipment placed strategically along the sea front offers extra muscle workouts. But for most people, the best way to enjoy the promenade is to stroll along and take in the views. On the one side, you look across the Mediterranean to Gibraltar and Morocco, and on the other up to the Sierra Blanca mountains. And few meeting points come better than that.

• Un barra de pan del día anterior • Vino Pedro Ximénez • Miel de abeja • Aceite • Huevos
• Se colocan las rebanadas de pan en una fuente, se empapan de vino y se deja reposar durante unas horas. Pasado ese tiempo, se pasan por le huevo batido y se fríen con aceite abundante y muy caliente. Una vez fritas se colocan en una fuente y se le echa la miel por encima. Es importante moverlas para que la miel las cubra por delante y por detrás.

a gastronomía andaluza se caracteriza por lo natural y tradicional de sus platos. Muchas de estas delicias son recetas que han ido pasando de generación en generación a lo largo de los años, e incluso siglos. Es el caso de las torrijas, ya que las primeras referencias se encuentran en el siglo XV cuando eran consideradas el reconstituyente perfecto para las parturientas, debido a su alto nivel energético. En general, la repostería de Andalucía está basada en su gran mayoría en la herencia que dejaron judíos y árabes. En ésta intervienen productos como la canela, la naranja agria, los frutos secos o el ajonjolí. Pan, miel, vino y azúcar son los ingredientes principales de este típico dulce que puede servirse tanto como desayuno o como postre. La vida de este sabroso pastel está unida estrechamente al tiempo de Cuaresma, los 40 días antes de la Semana Santa, y a la necesidad de aprovechar el pan sobrante, ya que en esta época del año el consumo de carne disminuía. Durante estos días también comparte protagonismo con otros platos andaluces como los pestiños, los buñuelos, la leche frita, los roscos de Semana Santa, las tortas de masa o el hornazo. Su receta es muy sencilla para elaborarla en casa, lo que permite poder disfrutar de ellas en cualquier época del año. Consiste en una rebanada de pan (habitualmente de varios días) que es empapada en leche o vino y, tras ser rebozada en huevo, es frita en una sartén con aceite; finalmente, se aromatiza, a gusto, con diversos ingredientes: canela o algún licor, y se endulza con miel, almíbar o azúcar.

REGIONAL PRODUCTS GASTRONOMY IN ANDALUCIA is characterised by its natural, traditional dishes. Many of these delights are recipes which have been handed down from generation to generation over the years, and even the centuries, as is the case of torrijas (slices of fried bread soaked in wine). The first references can be found in the 15th century when, because of their high energy level, they were considered the perfect tonic for women who had just given birth. In general, the confectionary of Andalucia is largely based on the legacy left by the Jews and the Moors, including products such as cinnamon, bitter orange, dried fruits and sesame seeds. Bread, honey, wine and sugar are the main ingredients of this typical sweet which can be served for breakfast or as a dessert. This tasty sweet is closely associated with Lent, the 40 days prior to Easter, and also with the necessity of using up left-over bread, especially when at this time of the year consumption of meat declines. During these days it shares prominence with other typical sweet pastries such as pestiños, buñuelos, leche frita, roscos de Semana Santa, tortas de masa or hornazo. It is very easy to make torrijas at home, so they can be eaten and enjoyed at any time of the year. They are made of slices of bread (usually several days old) which are soaked in milk or wine and then coated in egg and fried in a pan with oil. Afterwards, they can be covered with cinnamon or a liqueur and sweetened with honey, syrup or sugar.

Preparation • Place the slices of bread in a dish, soak them in wine and leave for several hours. Then dip both sides in the beaten egg and fry in abundant, very hot oil. Úbeda, la resistencia de la historia
C
onserva en sus calles y edificios la grandeza que alcanzó durante los años del Renacimiento, cuando en el siglo XVI, en los reinados de Carlos V y Felipe II, numerosos hombres influyentes de la ciudad ocuparon puestos decisivos en el gobierno del Imperio. Los aristócratas que en aquella época vivían en Úbeda quisieron imitar a las familias italianas del Renacimiento haciéndose construir sus casas por el arquitecto y humanista Andrés de Vandelvira, del que se encuentran numerosas obras en la ciudad. Úbeda representa la arquitectura privada y el poder civil. Muestra de esto es el insigne palacio Vázquez de Molina, obra también de Vandelvira. Construido hacia la mitad del siglo XVI, es un punto estratégico de la ciudad. Hoy, este palacio alberga el Ayuntamiento, el Archivo Histórico de la ciudad y el Museo de Alfarería. Se sitúa frente a la colegiata de Santa María de los Reales Alcázares, cuyo recinto formaba parte integral del aparato defensivo del viejo alcázar, y en línea con la Sacra Capilla del Salvador. Su construcción vino a reforzar a este enclave, considerado uno de los lugares más significativos del Renacimiento español.

CLOSE TO ANDALUCIA ITS STREETS AND BUILDINGS still maintain the heights of grandeur reached during the Renaissance when, in the 16th-century reigns of Carlos V and Felipe II, numerous influential men of the city occupied important posts in the Imperial government. Aristocrats living in Ubeda at that time, and wanting to imitate Italian Renaissance families, had their houses designed and constructed by the architect and humanist, Andrés de Vandelvira, many of whose works can be found in the city. Ubeda is representative of private architecture and civil power. One example is the renowned Vázquez de Molina Palace, another of Vandelvira’s masterpieces. Built towards the middle of the 16th century, this palace is a focal point of the city and now houses the Town Hall, the city’s Historic Archives and the Pottery Museum. It is located in front of the collegiate church of Santa María de los Reales Alcázares, whose grounds formed an integral part of the defences of the old fortress, and in a direct line with the sacred chapel of El Salvador. Its construction reinforced an area considered to be one of the most significant places for the Spanish Renaissance.

la grandeza de la diversidad
A
demás de ser reconocida, junto a Úbeda, como uno de los ejemplos del Renacimiento en España, Baeza alberga en su casco histórico monumentos que muestran recuerdos de otras épocas. En el corazón de la ciudad se encuentra la plaza de Santa María con la famosa fuente del mismo nombre y cuya construcción conmemora la traída de aguas a la ciudad en 1564. Es una ciudad por la que han paseado personajes ilustres como los poetas Jorge Manrique o Antonio Machado. Éste último da nombre a la sede de la Universidad Internacional de Andalucía que se asienta en dos edificios de gran importancia artística. Por un lado el Palacio del Jabalquinto que data del siglo XV y que combina la fachada gótica, la escalera barroca y el patio renacentista. Por otro el Antiguo Seminario Conciliar, de estilo barroco. Cerca de allí, se encuentra la iglesia de San Pablo, gótica, con portada renacentista y retablo barroco. Todo un conjunto históricoartístico que está coronado por su imponente Catedral, que puede divisarse desde lejos. Es un precioso edificio de estilo renacentista que posee una gran torre gótica. Su altura rompe la línea del horizonte que forman los extensos valles de olivares que hay que recorrer hasta llegar a la ciudad monumental de Baeza.

Baeza – diversified grandeur APART FROM BEING RECOGNISED, together with Ubeda, as an example of Renaissance in Spain, Baeza has monuments in its historical centre that recall other eras. In the heart of the city is the Plaza de Santa María with its famous fountain of the same name whose construction commemorates water being brought to the city in 1564. This is a city where eminent figures, such as the poets Jorge Manrique and Antonio Machado, have walked. The latter gives his name to the headquarters of Andalucia’s International University which is housed in two buildings of great artistic importance. One is the Palacio del Jabalquinto, dating from the 15th century, with its Gothic façade, Baroque staircase and Renaissance patio; the other, the Baroque-styled Old Council Seminary. Nearby is the church of San Pablo, Gothic with a Renaissance porch and Baroque altarpiece. The whole historic area is crowned by its imposing cathedral, seen from miles around, which is a beautiful Renaissance-style building with a tall Gothic tower. i las paredes del emblemático Café Gijón, situado en una de las arterias más importantes de Madrid y testigo del desarrollo de la cultura española, hablaran no tendríamos líneas para superar a la novela nacional por excelencia, El Quijote. Allí se fraguaron las tertulias más envidiadas y representativas de literatos históricos como eran los de la Generación del 98 (Miguel de Unamuno gran revolucionario de la teoría del positivismo, Azorín, Antonio Machado, Pío Baroja, Valle-Inclán monopolizador de la palabra…) y de la emblemática Generación del 27 (Rafael Alberti, Federico García Lorca, Vicente Aleixandre…). Poco a poco se fueron instaurando las tertulias en sus típicas mesas de mármol donde se hablaba de política, de toros, y de sucesos truculentos. Desde sus inicios con Benito Pérez Galdós, como un alumno del momento que ya destacaba con diferentes dotes que sólo los grandes despejan en sus acciones, pasando por

asiduos a las tertulias y al local como Federico García Lorca o un Valle-Inclán fraguando los inicios del fin de la Generación del 98 y marcando los inicios de la Guerra Civil española hasta los comienzos de un nuevo cambio político con el principio de una fresca e ilusionaste democracia continuando las famosas tertulias de la mano de un joven Francisco Umbral. Todos ellos se caracterizaban porque movieron el pensamiento y a las generaciones, se formaron y formaron a los demás para ser diferentes y conseguir resultados distintos… Esa es la esencia de un grupo de formadores que con valores como la generosidad, la sensación al logro, el esfuerzo o el crecimiento personal “fraguan” en sus formaciones las bases hacia un profesionalismo empresarial diferente, dirigido a un sector inmobiliario en constante evolución. The famous gatherings continued under the guiding hand of the young Francisco Umbral. They were all influential in changing the way of thinking and generations were shaped that were different and which achieved different results. This is the essence of a group of people whose formative influences and values, such as generosity, a sense of achievement, effort and personal growth, establish the groundwork for specialised business professionalism directed towards a constantly developing real estate sector. WHEN MARBELLA RESIDENTS Ruben and Maria decided it was time to swap renting to invest in their very first home, they knew that acquiring a 100% mortgage would be a challenge. Their property search began online and they contacted RE/MAX Eralia to arrange a viewing. They fell in love with one property immediately and made an offer which was subject to mortgage approval. To Ruben and Maria’s disappointment, their request for a mortgage to cover the full property purchase price and buying costs was rejected. TAX & LEGAL SOLICITORS SOME OF THE MOST IMPORTANT SOLICITORS ON THE COSTA DEL SOL EXPLAIN THE PROCESS OF PURCHASING A PROPERTY IN SPAIN AND THE COSTS INVOLVED. N.I.E. NUMBER The N.I.E number Número de Identificación de Extranjero is the Identification Number for Foreigners. It is imperative that all foreigners who purchase a property in Spain have one as this is needed in all fiscal and legal matters. You can obtain a N.I.E. number from the Police Station or if you prefer you can obtain a legalised photocopy of your passport and sign a Power of Attorney so that your solicitor can act on your behalf and obtain one for you. You will need to have your N.I.E. number before completing the purchase of your property. In fact the N.I.E. number is also required for buying a vehicle, employment, inheritance of assets in Spain, insuring property, paying taxes and even for signing onto the national social security health scheme.
OPENING A BANK ACCOUNT IN SPAIN Owners of properties in Spain need a bank account in a Spanish Bank in their name for the purpose of meeting ongoing costs, utilities (such as electricity and water), mortgages, local taxes and duties. The Bank or Savings Bank will draw up a contract to open the account and ancillary documentation, and will require from the client the necessary information to complete that documentation (passport). On the “Costa del Sol”, most of the Bank offices have at their customers’ disposal English versions of the above mentioned documentation, as well as employees fluent in various languages. One important point: Remember to ask the Bank about their charges and commissions for keeping the account operative, for cheque clearing, international transfers, etc.
RESERVATION CONTRACT Normally the purchase is initiated with a reservation contract called Contrato de señal o arras, the deposit that will be paid on signing the reservation contract is approximately e6,000, which is normally kept by the Real Estate company. The main purpose of the reservation is for the purchaser to be assured that the property has been taken off the market (usually for a limited period of time) and for the vendor to know that the purchaser is really interested in proceeding. The reservation contract implies that the “purchase agreement” contrato de compraventa will be signed within a specific time period and if for any reason this does not take place, the property will be again placed on the market. The deposit is usually non-refundable. The reservation contract must be dated and signed by both parties and should include the personal details of the parties and the identification of the property. It should also define the amount to be paid upon signing the contract, the total price, payment conditions and the period of time in which the Title Deed will be signed. The amount paid on reservation is deducted from the total price to be paid by the purchaser. The contract should also establish the consequences if a) the purchase agreement is not signed or
b) if either of the parties withdraw from the transaction. If the potential buyer does not go ahead, he would lose the deposit unless this is due to irregularities found on the Title Deeds of the property. If the seller refuses to go ahead the buyer is entitled to claim a compensation of double the amount of the deposit. Once the reservation document has been signed the Lawyer will begin to check the property to make sure that everything is in order including the proper ownership, if there are any charges on the property and that all Licences have been obtained.
PRIVATE PURCHASE CONTRACT According to Spanish law, the Private Purchase Contract is used to reflect the agreements reached between two parties in the transaction of the sale of a property, for both new build and resale property. In order for the Private Purchase contract to be valid and of use to both parties it must include a series of compulsory requirements. Apart from these requirements, both parties can freely agree all the terms they consider should be reflected in the private purchase contract. However there are three different types of Private Contract: These are known as the Purchase Deposit Contract, the Option Contract, and the actual Private Purchase Contract. All three have the same requirements mentioned above, but each binds the parties legally in a different way to the agreement reached.
TITTLE DEED ESCRITURA The registered title deeds of the property are always signed at a Spanish Notary. This is the official document that certifies that the property has been sold and it includes the details of the buyer and the seller, description of the property that has been sold and its price. Once the title deeds are signed they must be registered at the Property Registry.
MORTGAGE HIPOTECA
Stamp Duty: 1% of the mortgage liability.
LOAN MORTGAGES are most useful for financing the purchase of your Spanish property. For a non-resident buyer, a mortgage is usually limited to around 70% of the valuation of the property. Our advice is to go for a variable rate mortgage, The lender’s rate will be a margin over Euribor (March 2009, Base lending rate by Central Bank of Europe @ 1,99%), generally Euribor +1.25 %, but certain lenders may fluctuate on this. Fixed rate mortgages are available at slightly higher interest rates. Note that re-mortgages are not common practice in Spain.
BUYING A PROPERTY There are many different types of properties (apartments, villas, garages, storerooms, building plots, rustic “fincas”, etc), but below we refer in detail to the purchase of apartments or villas including garages or a storeroom.

The amount of the registration cost is also calculated on the mortgage liability, copies of the land search note, authorised copies and the application of the notary fees in force at the time of registration.
BANK ARRANGEMENT FEE Bank expenses for handling documents. Base the total expenses of the mortgage at around 2,5% of the amount of the mortgage.
TAXES ON HOLDING PROPERTY Council Tax is currently calculated on a percentage of the rateable value. For example, a 200.000e property with a rateable value of say e100.000 may attract around 450e in tax. Non-residents property Income Tax: The base rate is 2% of the rateable value and the applicable tax is 25%. Non-residents property Wealth Tax: No longer applicable.
New property, with garage and storeroom: VAT 7%, Stamp Duty 1%. Total 8% Re-sale properties: Transmission Tax: 7%. No Vat.

LEGAL COSTS A percentage of around 1% is to be expected or a fixed rate (eg 2,000e).
There isn’t a fixed percentage or fee for these two costs. Between 600e and 800e should be set aside for the Notary’s costs and 500e for Land Registry.

TIPS: Before signing the property title deeds the Lawyer will make sure that the seller has no debts with the Town Hall with unpaid IBI (Property tax) and garbage fees as well as no debt with the neighbours’ community, mortgages and that the property has a valid habitation permit.
Many small expenses must be borne in mind such as bank charges or commissions for transferring money, Power of Attorney to your lawyer, etc. The amount you should expect to pay is in the region of between 300e and 400e. In addition to the above mentioned, you must allow approximately 10% on top of the property price to cover the conveyancing expenses. Loans and / or mortgages have not been considered.

TAXES AND EXPENSES ON MORTGAGE
The Property Registry/ Registro de la Propiedad, is the authority where all properties and their title deeds are registered. This is an extremely important office for the purchaser of a property in Spain, because this is where you will be able to find all the information about the property with a true description of it detailing area and owner and more importantly if there are any charges, liens or mortgages against the property. You can check all of this with the nota simple who will supply a report provided by the Property Registry.
The purchase of a property in Spain can sometimes involve the setting up of a mortgage. It is important to establish the costs and expenses involved in setting up a mortgage, in order to avoid any possible misunderstandings or difficulties.

LAND REGISTRY COSTS
MORTGAGE TITLE DEED The fee is calculated depending on the amount of mortgage liability, copies, pages of the original document and the application of the notary fees in force at the time of completion.
CAPITAL GAINS TAX This is based on the difference between the purchase and selling price. Purchase price is not only the net property price but also the taxes, fees or any other costs incurred on the purchase. On the selling price any selling costs (commissions, fees, etc) can be added. The difference, once indexed according to inflation rates, is taxed at a flat rate of 18%. If the vendor is a NON RESIDENT, the buyer must withhold 3% of the price to be deposited at the Revenue as part of the final 18% of the benefit.
