Statenotifiesseptuplehomicidedefendantitseeksdeathpenalty

AMorganCountyassistantdistrictattorneynotifiedoneoftwoHartselle menchargedwithcapital murderinthe2020slayings ofsevenpeopleinValhermosoSpringsthattheprosecutionwillseekthedeath penalty.

FredericAllenRogers,26, andhisallegedaccomplice, JohnMichaelLegg,23, belongedtoamotorcycle gangcalled“SevenDeadly Sins”whentheywereinvitedtoadrughouseinValhermosoSpringsforadinnerpartyonJune4,2020, accordingtopreliminary

hearingtestimonyfroman FBIspecialagent. There,Rogers“cased”the houseanditsoccupants beforeopeningfireonthree meninthegarage,accordingtotestimony.Inawrittenstatement,hesaidhe killedJeremyRoberts,31,of Athens,JamesWayneBenford,22,ofDecatur,WilliamZaneHodgin,18,of Somerville,andRogerLee JonesJr.,20,ofDecatur,at ahouseonTalucahRoad. ThestatementsaidLegg fatallyshotthreewomen attheresidence:Tammy EnglandMuzzey,45,Emily BrookePayne,21,and DakotaGreen,17,ofValhermosoSprings.

BothRogersandLegg havepleadednotguiltyby reasonofmentalillnessor defect.InFebruary,Rogers’attorneyBrentBurney requestedthattheStatediscloseitsintentandrevealall mitigatingandaggravating circumstances. Incapitalcases,anaggravatingcircumstanceisa circumstancethatindicates

thedefendant,ifconvicted,shouldbesentenced todeath,accordingtothe AlabamaSupremeCourt. Mitigatingcircumstances, ontheotherhand,indicate thattheconvicteddefendantshouldbesentenced tolifewithoutparolerather thandeath.

AssistantDistrictAttorneyGarrickVickerynotifiedthecourtonApril30 thatthestatewillseekthe deathpenaltyforRogers, ifconvicted,andlistedfour aggravatingcircumstances andone“possible”mitigatingcircumstance.

“Thecapitaloffensewas especiallyheinous,atrocious,orcruelcomparedto

othercapitaloffenses,”Vickeryargued.Theotherthree aggravatingfactors,accordingtotheprosecution, includecommittingthe offensewhileinthecommissionofanothercrime, intentionallycausingthe deathoftwoormorepeople byoneact,andkillinga personaspartofaseriesof intentionalkillings.

Rogers’possiblemitigating circumstanceisthathehas nosignificantpriorcriminal history,accordingtoVickery.Burneypreviouslytold TheDecaturDailythathe feelsstronglythatRogers’ mitigatingcircumstances willoutweightheaggravatingones.

Juryselection OnbehalfofRogers,BurneyonApril24filedfour motionsaimedatthejury selectionprocess.Heasked thecourttoremoveany potentialjurorswhomaybe biasedinfavorofthedeath penaltyorwhoknewthe victimsand/ortheirfamilies.Healsoaskedthatthe prosecutionberequiredto discloseanyrelationships withprospectivejurorsand anyinformationaboutprospectivejurorsthatcouldbe favorabletoRogers.

Nowthatitistornado seasoninnorthAlabama, alocalstormsheltercompanyisseeingtwiceasmany callsforinstallations,and anotherlocalcompanysaid theyhaveseenalargeinflux incommercialsales.

“February,MarchandApril Iusuallygetdoublethecalls versustherestoftheyear,” saidSupercellSheltersInc. salesrepresentativeAngie Eaves.“Italways(increases) thistimeofyear.Ithinkit’s anticipation,butanytime there’stornadowatchesor warnings,itseemstobean influxofcalls.” SupercellisbasedinTanner,buttheirsheltersare manufacturedinHartselle. Eavessaidpeopletendto waituntiltherehasbeen tornadicactivitybeforepurchasingashelterunlessitis foranewhomebeingbuilt. Shesaidthereistypicallya shortwaitingperiodfora shelterinstallation.

“Mostofoursheltersare withintwoweeks,”Eaves said.“Itjustdependson whichonetheyorder,which couldbeupto12weeks.”

EavessaidSupercellhas above-groundsaferooms, exteriorundergrounds, whichareinpeople’syards, andsheltersundergarage floors.

“Wecutaholeintheconcreteinthegarageanddrop themin.Youcanparkover themanddoanythinglike that,”shesaid.“Itdoesn’t takeupspace.It’sgoodif youhavelimitedgarage space.”

Dependingonthetype ofshelter,theycanrange insizefrom4-by-4feetto 5-by-8feetandholdfiveto 13people.Thepricesrange from$5,850to$10,990.

DustinMitchell,Safe-TShelterchiefoperatingofficer,saidhisHartselle-based businesshasbeensteadyfor residentialshelters,buthas seenanincreaseincommercialsheltersales.

“Thisiswhatwecallour busyseason,”hesaid.“Itgets backoneverybody’smindas farasgettingashelteras severeweatherstartsrampingup.Peopleshowmore interestanddecidethatit’s timetobuyone.”

Mitchellsaidhethinksthe reasonresidentialsaleshave beensteadyratherthana largeincreaseisduetothe economy.

“We’vebeenbusy,butwe justhaven’thadthemajor influxthatwetypicallysee thistimeofyear,”hesaid. “Wesawamuchbigger influxthelastfewyearsin salesthistimeofyearthan wedidthisyear.”

Anotherreasonfornotseeingalargeinflux,Mitchell said,ishowtheweatherhas been.

“We’vehadaprettyquiet seasonthisyearsofar,”he said.“Someotherareasof thecountryhavebeenhit, andthat’swherewe’veseen alotofinterestinourcommercialside.”

Asamilitarybrat,Todd’s childhoodwasfilledwith travelandexcitement. Hemovedaroundthe world,finallygraduating highschoolinthePanama CanalZone.Hisacademic journeythenledhimto theprestigiousKingsPoint MerchantMarineAcademyinNewYork,wherehe earnedabachelor’sdegree afterfourtransformative years. Eventually,in2021,Todd movedtoElkmont,Alabamatobeclosertohis family.Itwasherethat hemettheloveofhislife, Marla(Fuqua)Huinker. Itwasloveatfirstsight, andthecouplemarriedsoonaftermeeting, dedicatingtheirremainingyearstoeachother. Toddissurvivedbyhis belovedwifeMarla,his sonBrian,hisdaughter Britney,andfivecherished grandchildren. Asachildgrowingupin Texas,Crossneverdreamed ofafuturewhereshewould beleadingpeopletoChrist, especiallythroughagym.

“Igrewupinahomewhere Iwastaughttherewasno God.Therewasachurcha blockawayfrommyhome andIcouldn’thelpbuthear thechurchbellseverySundaymorning.Something justdrewmethere,”the51–year–oldCrosssaid.

Bytheageof8,everySundaymorning,Cross,alone, walkedfromherhometothe church.

“Iwentthereasanescape. IhadmyfirsttasteofJesus there.Iwassavedat8.I knewIwantedwhatthey saidJesusgave,butIdidn’t haveanyonetotalkwithme aboutitathome,soInever reallygottoknowJesus,” Crosssaid.

Twentyyearswouldpass beforeCross’faithjourney,

whichledtoestablishing theYouareEnoughbyJane ministry,tookthenextsteps. “Ididn’treallygettoknow GoduntilIwasinmylate 20s.MyhusbandandIwere havingseriousmarriage issues.Wewerestruggling. AndwefoundhopeinGod. Duringthattime,myhusbandfoundtheLordand ourfamilystartedgoingto church,”Crosssaid.

In2018,asawaytolose weightandlookbetter,Cross startedworkingoutat3D Fitness.Soonshebegan teachingclasses.

“Theclassesstartedout asnormalfitnessclasses. Iplayednormal,secular music.Thensomeoneasked forprayer.Irealizedwewere prayingandworshipping morethanwewereexercising,”Crosssaid.

“Thatyearwasinthedarkest ofthedarks.Butinthemiddle ofthat,theministryandmy faithgrew.Icouldn’tnotturn toJesusandleanonmyfaith, that’sallIhad,”Crosssaid. Thissummer,Crosswilltake herministrytoAfricafora four-daywomen’sconference andvacationBibleschool inZambia.Acookingclass scheduledforSaturdayat CaveSpringBaptistChurch inDecaturwillraisefundsfor themission.Duringthe10 a.m.class,participantswill learnhowtomakebreadand strawberryjam.Costis$50. “Thatwaythere’snostairs, they’reaccessiblebyanybody,wheelchairaccessible, handicapaccessible,”Mitchellsaid.“There’snoriskof watercomingdowninthe shelterwithyou.” Mitchellsaidtheirshelters startata4-by-5footandthe largestonesare6-by-8feet or5-by-10-feet.Theycanfit betweensixand16people. Hesaidthemostpopular isthe4-by-6-footmodel, whichholdseightpeople. “Wesellmoreofthose,” Mitchellsaid.“Peopleare puttingthemintheirgarage, carport,anewlyconstructed house.”

Morgan rabies clinic to be held June 1

Morgan County residents are urged to mark their calendars for the upcoming Rabies Clinic scheduled for June 1. It is mandatory for all owners and caretakers of cats and dogs aged three months or oldertohavetheiranimals inoculated against Rabies annually. Failure to comply with this requirement mayresultinpenaltiesand poses significant risks to

both pets and the community at large. The clinic, organized by local veterinarians, will be conducted at two primary locations: Berry Animal Clinic at 1651 S. Bethel Road, and Osborne Animal Clinic situated at 914 Beltline Road, both in Decatur. Drs. Zach Berry and Steven Osborne will beonsitefrom8a.m.until noon to administer vaccinationsatacostof$14per animal. Please note, only cash or check payments will be accepted. In addition to the main cliniclocations,discounted vaccines will be available at various stops along designated routes. Local unemployment rates just over 2%

Morgan County had the second lowest unemployment rate in the state in April and Lawrence and Limestone counties were notfarbehind,accordingto data released this past FridaybytheAlabamaDepartmentofLabor.

Morgan County’s rate was 2.1%, up from 1.4% a year ago but down from the March rate of 2.5%. Only Shelby County, at 2%, had a lower unemployment rate inApril.

Limestone County’s April ratewas2.3%,upfrom1.5% a year ago and down from

theMarchrateof2.6%.The city of Athens had a 2.1% rateinApril.

In Lawrence County, the April unemployment rate was 2.4%, up from the year-ago rate of 1.5% but down from the March rate of2.7%.

Statewide the seasonally adjusted April unemployment rate was 3.1%. Mot seasonally adjusted, and thus comparable to the county rates, the statewide rateinAprilwas2.6%.

The number of people employed in Alabama increasedby20,117overthe year to a record 2,263,393. The civilian labor force also reached a record high, increasing to 2,335,450,

with 40,170 more people joiningovertheyear.

Alabama’sAprillaborforce participation rate increased by 0.1 percentage points to 57.5%. The percentage of prime-age workers

increased by 0.2 percentage points over the month to 79.1%. Over the year, this number increased by 1.7 percentage points from 77.4%. Prime-age workers arethoseaged25-54years.

Mytwoolderbrothershadsigned withtheAirForce.Joemadeasuccessfulcareerandservedtwentythreeyearsbeforeheretired.Pete followedinJoe’sstepsandserved fouryears.

IwasnotdraftednordidIvolunteer.Iwastooyoungtobecalled upduringtheKoreanconflict.But asthehostilitiesinVietnamwere heatingup,Ireceivedmydreaded “DearSir”letterinformingmemy draftnumberhadbeendrawn. Itwaslatein1957andIwasin mythirdyearofcollege.Iwould eventuallybeordainedtoChristian ministrybuthadnotlookedinto

State seeking death penalty for Fort Payne woman of pushing victim off cliff

Prosecutors are seeking the death penalty against a Fort Payne woman accused of pushing a Hartselle woman off a cliff in Little River Canyon National Preserve, according to a notice filed Friday in Dekalb County Circuit Court.

Loretta Kay Carr, 45, along with her daughter, Jessie Eden Kelly, 22, are both charged with capital murder-kidnapping in the October 2021 death of Mary Elizabeth Isbell. Ninth Judicial Circuit District Attorney Summer Summerford said in her notice that the death penalty is warranted against Carr after evaluating the aggravating and

mitigating circumstances of the case. Isbell had been reported missingbyherex-husband

almost two years before her body, with the help of information provided by one of the suspects, was discovered in the preserve and identified on what would have been her 39th birthday: June 30, 2023. When Isbell was reported missing in December 2021, Hartselle police investigators determined through phone records that she had been living
