The 2G phones of the 90’s brought us digital mobile communications for the first time, and later added SMS texting with limited internet and email. In 2004 we upgraded to 3G with better internet access, video calling, mobile apps, etc. This gradually became more efficient until 2009 when it was superseded by 4G and then 4G+ (in 2012) with all of the speed and amazing capabilities that we use on smartphones. 5G promises to take this much further by enabling what is called “The Internet of Things”. Very simply stated, this will mean that a very wide range of machines and objects will have the ability to

Los coches inteligentes, los electrodomésticos inteligentes, los edificios inteligentes, las ciudades inteligentes, etc., estarán todos conectados, interactuando entre sí a un nivel mucho mayor que nada de lo que tenemos hoy en día. Por ello, antaño muchos propietarios renunciaban voluntariamente a la inscripción de construcciones nuevas en el Registro de la Propiedad para ahorrarse los gastos relacionados con este trámite. Sin embargo, a partir de la década de los años 90, la declaración de obra nueva empezó a cobrar mayor importancia legal y hoy día existe, además de la regulación estatal al respecto, una ley territorial de las Islas Baleares. En la actualidad es prácticamente imposible utilizar un inmueble sin haber inscrito la declaración de obra nueva. Precisamente en los últimos años se han endurecido las disposiciones legales y administrativas referentes a la declaración de obra nueva. Ésta es, entre otros, un requisito indispensable para conectar un edificio nuevo a la red pública de agua y electricidad. Para formalizar una declaración de obra nueva, en las Islas Baleares hay que presentar la documentación siguiente: la licencia de obra, el certificado de final de obra firmado por el arquitecto, el certificado de coordenadas georreferenciadas presentado por un técnico

For this reason, many owners chose not to register new buildings at the Property Registry in order to save themselves the costs involved. However since the ‘90s, the declaration of new-builds has come under much more legal scrutiny. Today it is regulated by both the general Balearic land-use law as well as local legislation, and it has become almost impossible to use a building without proper registration. In fact, over the last few years the legal and administrative requirements regarding new-builds have become ever more rigorous. This includes the registration of any new building as an essential requirement in order to be able to connect to the public water and electricity grids. To formally declare a new-build on the Balearic Islands you must present the following documentation: the building permit (licencia de obra), the final building completion certificate signed by the architect (certificado final de obra del arquitecto), the geo-referenced coordinates (datos georeferenciados) certificate (presented by a technician who is competent in digital platforms), the final building completion certificate from the Council (certificado final de obra

Viele Eigentümer, welche die mit der Eintragung im Grundbuch verbundenen Kosten scheuten, verzichteten deshalb in der Vergangenheit freiwillig auf die Eintragung der Neubauten. Die Neubauerklärung wurde jedoch seit den 90er Jahren gesetzlich stetig aufgewertet und heute gibt es neben den zentralstaatlichen Regelungen auf den Balearen ein eigenständiges Gesetz. Damit ist es nunmehr nahezu ausgeschlossen, eine Immobilie ohne die Eintragung der Neubauerklärung zu nutzen. Gerade in den vergangenen Jahren sind die gesetzlichen und verwaltungsrechtlichen Anforderungen für die Neubauerklärung zusätzlich erschwert worden. Eine Neubauerklärung ist beispielsweise zwingende Voraussetzung, um einen Neubau an das öffentliche Strom- und Wassernetz anzuschließen. Auf den Balearen sind folgende Dokumente zur Beurkundung einer Neubauerklärung vorzulegen: die ursprüngliche Baugenehmigung (licencia de obra), die Bescheinigung des Architekten mit Unterschriftsbeglaubigung, dass der Bau fertig gestellt ist (certificado final de obra del arquitecto), die GPS Standortdaten der Immobilie (datos georeferenciados), hier muss ein technischer Architekt eine CD-ROM vorbereiten, welche dem Grundbuchamt überreicht wird, die

ES competente en soporte digital, el certificado de final de obra del Ayuntamiento, la cédula de habitabilidad, la licencia de primera ocupación que hay que solicitar en el Ayuntamiento correspondiente en cuanto se tenga la cédula de habitabilidad, el Libro de Edificio, el seguro decenal y el certificado de eficiencia energética. Se deben presentar los documentos originales ante notario y éste incorporará una copia de todos ellos en la primera copia de la escritura. Una vez escriturada la declaración de obra nueva hay que obtener los así llamados boletines. Se trata de los documentos expedidos por los técnicos que hayan realizado los trabajos con los que se certifica que las instalaciones eléctricas, de agua, etc. estén en buenas condiciones. Son indispensables para la contratación de los distintos suministros. La escritura de la declaración de obra nueva está sujeta al Impuesto de Actos Jurídicos Documentados, imputándose el 1,2% del valor que figure en la escritura. Un caso especial es la declaración de obra nueva en construcción, para la que es necesario que el arquitecto certifique que la descripción de la obra concuerda con el proyecto para el que se otorgó la licencia. Ya no se trata de una simple declaración voluntaria del propietario de un inmueble, sino que se tienen que aportar una serie de pruebas y cumplir varias condiciones. Summing up, you can see that the requirements for officially declaring a new-build have continually increased over time. What used to be a simple declaration by the owner of a building, now requires you to provide numerous documents, and to prove compliance with various regulations. To manage all of these legal hurdles it is a good idea to get the advice of an expert who can guide you to create a new-build declaration deed that can be legally inscribed at the Property Registry.
Zusammenfassend kann man feststellen, dass im Laufe der Zeit die Anforderungen an die Protokollierung einer Neubauerklärung ständig ausgeweitet wurden. Es handelt sich von daher keineswegs mehr um eine einfache, freiwillige Erklärung des Eigentümers einer Immobilie. Es müssen vielmehr eine Reihe von Nachweisen erbracht und Bedingungen erfüllt werden und für die Vorbereitung der notariellen Neubauerklärung und ihrer Eintragung im Grundbuchamt sollte man den Rat eines Fachmanns hinzuziehen.

Se cree que los cartagineses trajeron caballos por primera vez a las costas de Ibiza hace ya 2.300 años. Aquí se libraron de una vida de dura labor en el campo gracias al tipo de tierra agrícola, que generalmente se repartía en pequeñas terrazas pedregosas. Los burros y las mulas, al ser más ágiles con sus patas, y más resistentes, eran mucho más adecuados para el trabajo en las granjas ibicencas y para la tarea de hacer girar los molinos. Los caballos se usaron casi exclusivamente como medio de transporte y por su potencia en operaciones militares en tiempos de conflicto. Es por ello que eran vistos como símbolo de estatus, y tan solo los isleños más acaudalados podían permitirse tener uno.
It’s believed that the Carthaginians first brought horses to Ibiza’s shores as far back as 2300 years ago. Here they were spared a life of labour in the fields due to the character of the agricultural land that was generally made up of small stony terraces. Donkeys and mules, being more nimble-footed and hardy, were much better suited to Ibizan farm work, and the toil of turning the mills. Horses were used almost exclusively as a means of transport, and for their power in military operations during times of conflict. It’s for this reason that they were seen as a status symbol, and only the wealthier islanders could afford to keep a horse.

ES Durante gran parte de la historia de Ibiza, los carros tirados por caballos y burros eran un modo de transporte perfectamente adecuado a la compleja red de polvorientos caminos. Incluso hoy en día, un domingo cualquiera por la mañana, puede que veas a algún campesino local trotando alegremente por los tranquilos caminos con su preciado caballo tirando de un carro. En días de fiesta especiales, y en particular el primer domingo de mayo en Santa Eulalia, los locales celebran con orgullo sus caballos, decorándolos con campanillas de colores, cintas y lazos, para pasearlos por toda la ciudad en alegre procesión. Las razas tradicionales que puedes encontrar aquí son el fuerte y sensato caballo español junto con la única raza autóctona de las Islas Baleares, que es el poderoso caballo negro Menorquín. Sin embargo, en los últimos 50 años, con la diversificación de la población humana en la isla, también se ha diversificado la comunidad equina. Hoy en día pueden encontrarse pequeños ponis de pelo duro procedentes de las distantes Islas Shetland de Escocia conviviendo con caballos campeones de polo argentinos.
EN For most of Ibiza’s history, horse and donkey carts were a very common form of transport that was perfectly suited to the complex network of dusty caminos. Even today, on lazy Sunday mornings, you may catch a glimpse of a local farmer happily trotting along quiet roads with his prized horse and cart. On special fiesta days, particularly the first Sunday of May in Santa Eulalia, the locals proudly celebrate their horses by decorating them in colourful bells, ribbons and bows, while parading them through the town in a lively fanfare. The traditional breeds that you find here are the strong and sensible Spanish horse along with the only breed specific to the Balearic Islands, the powerful black Menorquin. However, over the past 50 years, as the island’s human population has diversified, so has the equine community. These days you’ll find thickcoated little ponies from the far-reaching Shetland Islands of Scotland living alongside champion polo horses from Argentina.

Denn sie passen perfekt zu diesem Freiheitsgefühl, das auf Ibiza existiert und das so viele von uns auf die Insel gezogen hat. Obwohl der Tierschutz auf Ibiza einen relativ großen Stellenwert hat, gibt es dennoch einige Fälle von Tierquälerei oder Vernachlässigung. Glücklicherweise gibt es eine Frau namens Svabodhi, die sich seit 22 Jahren unermüdlich um misshandelte Pferde kümmert, sie rettet und ihnen Liebe schenkt.
