Acquittal ‘not the end of our nightmare’

T
hree young Londoners cleared this month of stabbing a Northern Ireland youth during a holiday in Playa de Las Américas are piecing back together the lives they were forced to suspend for the 19 months spent behind bars on remand in the island’s prison.
Although relieved to have regained their freedom after an experience they “would not wish on anyone”, brothers John (22) and David (19) Heyfron and their friend Cagkan ‘Chucky’ Guvener (20), along with several legal experts, are at a loss to understand how things went so badly wrong when they were mistaken by police for the gang that attacked the
Belfast teenager. In particular, they want to know why those responsible for bringing the case did not rectify long ago and admit “they had simply got it wrong”. In exclusive interviews, published in this edition of Island Connections, given during and after the trial the families narrate their feelings about their ordeal since that fateful night in the summer of 2009. When the case eventually came to trial after multiple delays (as far back as November 2009 Arona court was urged by a higher court in Santa Cruz to speed up its handling of the uncomplicated formalities and issue the required indictment) and what the families say was “a suspicious mislaying of documents”, the Criminal Court in
Santa Cruz freed the defendants within hours of the end of the proceedings and returned their passports to them, recalling them a week later to give them the long-awaited news that they had been acquitted. All three immediately caught planes to leave the island that should have provided memories of a happy vacation but instead brought them a nightmare whose effects, in their words, “only people who have gone through something similar can even begin to comprehend”. Some might argue, simplifying matters to the extreme, that justice was done, albeit at its own pace, but the Heyfrons and Guveners are demanding to know why it all took so long, particularly now that they have discovered that not a shred of ‘evidence’ was offered at the trial other than that put together by the police and prosecution in the days immediately after their arrest on Troya Beach in the early hours of 1 August 2009. The youths were held in Playa de Las Américas police station for almost three days before learning that they were to be charged with the stabbing because their appearance matched the description of the culprits and police felt the towels they were wearing around their shoulders at the beach may have been what the victim and his friends had described as “scarves” used to hide their attackers’ faces. *Full story on pages 4 & 5

count on the support of the tourism sector since the success of the Elton John, Rod Stewart and Simply Red concerts have proved the effectiveness of events of this nature, and they have asked that we continue with this kind of initiative”. The group’s Jordi Esplugas said that already Adeje and Arona councils had given firm commitments to support the event and they were expecting similar support from the Cabildo as well as the regional government. He said that experience shows that big name concerts attract millions of people around the world as well as bringing pleasure to those who live in or visit the location, not to mention the positive repercussions for the concert location on the press, radio, television, internet and social networks.
