4 Tips to Avoid Summer Sports Injuries By Caroline Barichievich, PT, MSPT, CSCS, and Alan Barichievich, MS, PT

Summer sports are a great way to stay active and maintain physical distance while enjoying some fun in the sun. Don’t let common types of injuries like sprains, twists, muscle pulls, or tendon tears keep you from the many outdoor activities Lake Tahoe offers. Here are four tips to set you up for success as you hit the trail, water, or wherever your favorite summer sports take you...

Tip One:

Warm up and cool down. Stretch the muscle groups used in the activity you’re about to pursue, or have just finished. For example, swing a golf club a few times to warm up your hips, or do some shoulder and back stretches before hopping into the kayak. After a long hike, run, or bike ride, wind down with some quad, hamstring, and calf stretches.

Tip Two:

Watch your form. Biomechanics and form are important aspects of sports performance to help prevent injury. Maintain posture, and check in with yourself to ensure your form, range of motion, as well as, hand and foot placement are correct. Know your limits, as many injuries come from participating in an activity while exhausted.

Tip Four: Wear the appropriate gear. Sporting

the proper footwear, clothing, and safety gear for the activity improve performance and make it so much more enjoyable. Stay hydrated, and use a broad spectrum sunscreen while outdoors enjoying your summer sports. Whether you plan to cycle, rock climb, paddle, golf, hike, or run, we hope you have fun and play it safe. Make sure to follow guidelines for outdoor recreation and prevent the spread of COVID-19 in the area. Should an injury or accident occur, don’t hesitate to proceed to the nearest emergency department, or seek care from a medical expert.

Tip Three: Alternate activities. Try to engage

in different types of activities to use different muscle groups. By mixing it up, you can enjoy a variety of outdoor play while avoiding overuse injuries. Be sure to add rest days for recovery to your summer sports schedule.

FIRE PITS As a reminder, the current TKPOA Architectural Control Rules (ACR) for fire pits within the Tahoe Keys are: 15.09 Use of charcoal or wood BBQs on decks or near combustible surfaces within the town home subdivisions is strictly prohibited. 15.10 Fire Pits: Only LP gas or natural gas fire pits are permitted in single-family home subdivisions. CC&Rs Article VIII Section 13. Barbecues. There shall be no exterior fires whatsoever except barbecue fires contained within receptacles designed for such purpose.

The City of South Lake Tahoe (CSLT) provides the following additional information and rules on their website for Fire Prevention:

The City of South Lake Tahoe does not allow any open burning within the City limits. The exceptions to this are gas fireplaces and BBQ’s that use either LP gas or charcoal. Cove Advisors Needed for Bavarian Isle, Aloha Isle, Mount Tallac Village III, and Cove 2 It is important that all TKPOA subdivisions are represented by a property owner living within their subdivision. Per the Advisor rules, any owner in good standing may volunteer to serve as the Advisor to their Subdivision or Cove. Otherwise the property owners may nominate themselves or another owner within that subdivision, confirmed by a vote of the Board of Directors. Each Cove Advisor is responsible for handling the general affairs of the cove including unit/common area facilities; report maintenance, repair and other property owners issues to TKPOA management and follow-up in keeping those property owners up to date with current events, general affairs of projects happening within the Keys, and manage the cove’s budget. DAVIS STIRLING CIVIL CODE § 4041

Property Owners Mailing Address Information By Heather Blumenthal, Operations Manager AS OF JANUARY 1ST, 2017, every California community

association has been required to ask its members to provide their contact information and property status. Civil Code § 4041 has required, starting January 1st, 2017, that each association must solicit the following information from its members and an owner of a separate interest shall, on an annual basis, provide written notice to the association of all of the following: 1. The address or addresses to which notices from the association are to be delivered. 2. An alternate or secondary address to which notices from the association are to be delivered. 3. The name and address of the owner’s legal representative, if any, including any person with power of attorney or other person who can be contacted in the event of the owner’s extended absence from the separate interest. 4. Whether the separate interest is owner-occupied, is rented out, if the parcel is developed but vacant, or if the parcel is undeveloped land.

Although the statute does not mention how often an association must solicit this information, it does state that each member is responsible for providing this information to the association on an annual basis. The association shall solicit these annual notices of each owner and, at least 30 days prior to making its own required “Annual Disclosure”. TKPOA has previously provided this information request for 2020 to its members via the quarterly assessment mailing for the third quarter. If a property owner fails to provide the notices set forth in requirements (1) and (2) above, the last address provided in writing by the owner or, if none, the property address shall be deemed to be the address to which notices are to be delivered. It’s important to note that as long as the Association requests all of the contact information above, Civil Code § 4041 places the responsibility on the property owners to Keys Breeze

provide their correct and current contact information. Requiring members to provide this information should aid associations in giving notice of meetings or for other required notices as well as with the collection of delinquent assessments as it should help negate the argument that a notice was sent to the wrong address in the future. The Association also utilizes updated information provided on Form 4041 to update the membership list that includes member names, property addresses, mailing addresses, and email addresses that may be requested in writing to the Association. Written requests are submitted to the Association for proper purpose requirements based on Civil Code §5210, §5200 (a) (9). A member of the Association may opt-out of sharing they name, property address, mailing address, and/or email address for these listings by notifying the Association in writing. A membership list opt-out form may be requested from the TKPOA Pavilion Office and is also provided in the Annual Disclosure Mailing. LAGOON CIRCULATION SYSTEM CONTINUED FROM PAGE 4

Pilot Program Goals

During this initial 30 days we have four goals or objectives we are striving to accomplish; 1. We will be starting the #2 pump at the Emerald Drive Pumphouse, this pump is a 150 horse-power pump which moves approximately 8,000 gallons of water per minute. This pump will displace approximately 1,000 cubic-feet of water per minute at the intake. As this displacement of water occurs the water in the Lagoon will begin to move to equalize the displacement creating a current. Simultaneously we will be discharging approximately 1,000 cubic-feet of water into the Lagoon at Aloha Drive which we hope will flow back towards the intake at Emerald Drive, creating a current in the waterway between Alpine and Emerald Drives. We will then evaluate the time and electrical energy we used to create this current through the waterway. Keys Breeze

2. Once the current is established in the waterway between Alpine and Emerald Drives, we will start culvert pumps #3, #5, & #6 and begin moving water through their associated Lagoons toward the intake at Emerald Drive. We will again evaluate the time and electrical energy we used to create these currents. 3. We will have installed a bubble curtain across the lagoon just prior to the Emerald Drive Intake. A bubble curtain creates a wall of air bubbles which should interrupt the flow of debris accumulated as the currents we created move through the lagoons and waterway. If this works as anticipated it will protect the intake from an accumulation of debris and provide a central area for removal. 4. On a regular basis we will be testing and evaluating the currents for; a. Turbidity (suspended solids and sediment in the water which effects clarity)

b. Nutrients (good sources for the aquatic plant life) c. Nitrates and Nitrites d. Clarity of the lagoons (influenced by the movement of the water) e. Weed fragment migration toward the bubble curtain f. Algal bloom formations At the end of this initial phase all the data collected will be analyzed and it will be determined if the benefits of running the circulation system out weigh the costs. It will also be determined if we could have accomplished the same results and limited the time, we ran the pumps, mitigating some of the cost.

The Big Question?

We know some of you are asking yourselves “Why not just turn the system on, it worked in the past, the Lagoons were beautiful?” Well in all honesty, the system was turned off over sixteen years ago and the condition of the Lagoons and the water were significantly different than they are today and we are not sure if the circulation system actually contributed significantly to the condition of the lagoons. We are also aware that the question regarding the clarifier will come up in your discussions and we have determined the clarifier was not the silver bullet it was thought to be. For every gallon of water sent to the clarifier to be treated two gallons of untreated water was sent to the lagoons. Furthermore, when the gallon of treated water was reintroduced to the circulation system it was blended with the two gallons of untreated water before being discharged in the lagoons. The only variable we believe may have had any impact on the lagoons is the alum residual in the treated water which may have affected the PH in the lagoons.

What to Expect During the Pilot Program?

The homeowners adjacent to these waterways and lagoons will see extra activity since Water Quality Personnel will be observing and testing on a regular basis. The pumps will be operating 24/7 but the noise created by the pumps should be barely noticeable since they are all enclosed. Residents may observe fragments and increased turbidity moving through the lagoons toward the waterway between Emerald and Alpine Drives, this is what we are hoping for as one of our objectives.

Conclusion

This ‘Strategic Management Strategy’ manipulating the currents through the waterways and lagoons has not been done in the Tahoe Keys before, not to mention the system has not been operated in over a decade, so we may have some hick-ups but we will work through them. Keys Breeze

The Board of Directors two year terms that are ending this year are Bob Meyers, Vice President; Jim Siegfried, Treasurer; Michael Keller, Director; and Steven Shepherd, Director. Board members which still have one year left on their two year term are Joe Sherry, President; Sean Ward, Secretary; and Melvin Meyers, Director and their terms end in 2021. The balloting period for this election will close at 9:05 am on Saturday, September 12th, 2020. If you elect to return this Secret Ballot by mail, the ballot must be received no later than 3:00 pm on Thursday September 10th, 2020. If you elect to return this ballot in person at the Pavilion Office, the Secret Ballot must be inserted into the ballot box prior to 3:00 pm on Friday, September 11th, 2020. If you elect to return this ballot at the board meeting, it must be turned into the Inspector of Elections no later than 9:05 am on Saturday, September 12th, 2020. Four Board of Directors seats are up for election. Please do not vote for more than four candidates. If you vote for more than four candidates, none of your votes in the director election will be counted. Once your Secret Ballot is cast, it cannot be revoked. A Secret Ballot is “cast” when it is received at the location designated by the Inspector of Elections. A Board of Directors meeting will be held Saturday September 12th, 2020 at 9:00 am at the TKPOA Pavilion located at 356 Ala Wai Blvd, South Lake Tahoe, CA. The election ballots will be opened and counted at this board meeting by the Inspector of Elections and designated volunteers. The Director Election Results will be announced and during this board meeting, directors will be seated. How long will it be out?

How do I get outage information? LET’S FACE IT, a power outage is an inconvenient disruption regardless the time of day, the day of the week, the cause of the outage or the duration. Even a brief outage in the middle of the night will at a minimum require you to reset the clocks in the house or worse, render your alarm clock useless. What’s worse than a power outage? A power outage without any communication or information. It doesn’t matter if the outage was planned for maintenance upgrades, or if it was caused by a fallen tree. When the power goes out, customers want and need to know what to expect. Liberty takes power outage communication seriously and provides outage information for both planned outages and unplanned outages through various channels in an attempt to reach all affected customers. The following outlines what customers can expect, how to receive, and where to obtain outage information.

Routine Planned Power Outages (for maintenance upgrades or repair work) • Affected customers receive a minimum of 48 hours advanced notice. • Liberty calls, sends a text, and/or sends an email message to the contact information on each affected customer account. • Sign boards are placed in affected neighborhoods and/or door hangers are affixed on the front door of homes/businesses. • General details about the timing and location of the planned outage are posted on the Liberty Utilities website in the Planned Outages.

each affected account as soon as the location of the outage has been confirmed and an affected customers can be identified. • Outage information and outage map is updated on the Liberty Utilities website, located in the Outage Map section as soon as the information can be obtained from the field crew. • Outage information is posted on social media, Twitter @LibertyUtil_CA and Facebook @ LibertyUtilitiesLT as soon as the information can be obtained from the field crew. • Updates are distributed to all communication methods if/when they become available The best way to stay informed about any type of power outage is to be sure the contact information on your account is up to date. Customers are able to add more than one phone number and email to the account which can help in receiving critical information. Also, utilize the website and/or social media if you have not received a direct communication to find information when the power is out.

has continued to complete monthly publications of the Keys Breeze for over five years. I would like to thank TKPOA staff members and TKPOA board members for all of their diligent efforts, writing, and editing each issue. I have personally received very positive and insightful feedback from many TKPOA members. Many members have commented they now read the Keys Breeze cover to cover. Of course, if you miss an issue you can always catch up online via our TKPOA website: www.tkpoa.com where each monthly issue of the Keys Breeze is posted. The Keys Breeze publication meets the requirements of a California Homeowners Association for a Common Interest Development “Official Communication” method to its members; especially now that we have continued the monthly publication of the Keys Breeze. The Davis-Stirling Act Civil Code §4040 and §4045 and §4050 indicates Association documents shall be delivered by one or more of the following methods:

1. Personal delivery. 2. First-class mail, postage prepaid, addressed to a member at the address last shown on the books of the association or otherwise provided by the member. Delivery is deemed to be complete on deposit into the United States mail. 3. Email, facsimile, or other electronic means if the recipient has agreed to that method of delivery. The agreement obtained by the association shall be consistent with the conditions for obtaining consumer consent described in Section 20 of the Corporations Code. If a document is delivered by electronic means, delivery is complete at the time of transmission. 4. By publication in a periodical that is circulated primarily to members of the association. [The Keys Breeze would qualify for this definition]. 5. If the association broadcasts television programming for the purpose of distributing information on association business to its members, by inclusion in the programming. 6. A method of delivery provided in a recorded provision of the governing documents. 7. Any other method of delivery provided that the recipient has agreed to that method of delivery. A document may be included in or delivered with a billing statement, newsletter, or other document that is delivered by one of the methods provided in the method list above 1–7. For the purposes of this section, an unrecorded provision of the governing documents providing for a particular method of delivery does not constitute agreement by a member of the association to that method of delivery. The Keys Breeze publication also meets the standards of the Corporations Code §5016. Notices and Reports via Newsletters, that applies to California Homeowners Association for a Common Interest Development. Code §5016: A notice or report mailed or delivered as part of a newsletter, magazine or other origin regularly sent to members shall constitute written notice or report pursuant to this division when addressed and mailed or delivered to the member, or in the case of members who are residents of the same household and who have the same address on the books of the corporation, when addressed and mailed or delivered to one of such members, at the address appearing on the books of the corporation. Please make sure you have your current address on file with the Association. On January 1st, 2017, Senate Bill 918 went into effect and Keys Breeze

now every California community association is required to ask its members to provide their contact information and property status. Civil Code §4041 now requires, that each association must solicit the following information from its members: 1. The mailing address where notices from the association are to be delivered; 2. Any secondary address where notices from the association are to be delivered; 3. The name and address of each member’s legal representative, if any, or other person who can be contacted in case of the member’s extended absence; and 4. Whether the member’s property is owner-occupied, rented, vacant, or undeveloped land. Although the civil code statute does not mention how often an association must solicit this information, it does state that each member is responsible for providing this information to the association on an annual basis. If a member does not provide this information, the member’s onsite mailing address is deemed to be the proper mailing address for the association to deliver notices to the member. It’s important for associations to note that as long as they request all of the contact information above, Section 4041 places the responsibility on members to provide their correct and current contact information. Requiring members to provide this information should aid associations in giving notice of meetings or for other required notices as well as with the collection of delinquent assessments as it should help negate the argument that a notice was sent to the wrong address. TKPOA provides members with a copy of Form 4041 each year with the Annual Disclosure mailing and a copy can be requested from the TKPOA Office at info@ tahoekeyspoa.org. Second, the bill requires associations to “solicit” these annual notices of each owner and enter the date into the association’s books and records at least thirty days prior to making its annual disclosures required by Civil Code §5300. In meeting these “Official Communication” requirements, TKPOA has utilized the Keys Breeze for Civil Code §4360 Notice and Approval of Rule Change by Board of Directors. Ideally this method will be utilized for limited rule changes of no more than a page of copy, but occasionally could be longer. In doing so, the TKPOA has saved money on mailing and staff costs to prepare rules change mailings.

Notice of Proposed Change. Before adopting or amending an operating rule or changing a fine schedule, the Board must “provide written notice of a proposed rule change to the members at least 28 days before making the rule change.” The notice must include the text of the proposed rule change and a description of its purpose and effect. Notice is not required if the board determines that an immediate rule change is necessary to address an imminent threat to public health or safety or imminent risk of substantial economic loss to the association. Civil Code §4360. Method of Notice. The method of providing notice of a rule change is described in Civil Code §4360 as the methods approved by Civil Code §4040, §4045 and §4050. TKPOA gives notice to TKPOA members of proposed changes to the rules by publication in a TKPOA Keys Breeze monthly magazine that is mailed to all members of the association or through a direct mailing. It is during this 28 day time period once the Notice of Proposed change is posted that the TKPOA Board of Directors would like to hear TKPOA members questions on concerns on the proposed rule change through attending regular monthly TKPOA Board meetings, emails, phone calls, attending the corresponding TKPOA Committee Meetings that the rule change may have originated with, or through contacting the TKPOA Administrative Assistant. 1. After the 28 day review period, the proposed change will go back to the Board for approval to be adopted. Any member feedback that has been provided during the review period is considered by the Board before a decision is made. 2. If the Board approves the proposed change, the adopted rules is published in the Keys Breeze, or sent as a member mailing a second time as a notification to the membership that the rule has been changed along with its effective date. Notice of Adoption. Within 15 days of voting on the rules, the board must notify the membership of the results of the vote. Civil Code §4360. Once adopted the new rule or rule change is added to the Association Rules and is enforceable. The TKPOA Rules and Governing Documents are enforceable by the TKPOA Board of Directors, through TKPOA member discipline process, suspension of privileges, fines and in some cases El Dorado County Ordinances and Codes. Based on ongoing updating and adding to our rules, the TKPOA Board of Directors, Architectural Control Committee (ACC) and TKPOA Community members are all looking to improve the Tahoe Keys for all of its members. Meetings and Approvals

At the July 18th, 2020 Board of Directors Meeting, the TKPOA Board of Directors approved the 2020 April and May Financial Statements. These Financial Statements can now be located on the TKPOA website. The Board of Directors also reviewed homeowner delinquent accounts and conducted scheduled disciplinary hearings on delinquent accounts. There were no approvals for lien notices for delinquent homeowners to review. Disciplinary hearings are generally held when a homeowner is delinquent on two quarterly assessments.

At the July 21st, 2020 Finance Committee Meeting, the Committee reviewed and approved the May Financial Statements. The Finance Committee also reviewed the Legal Expense analysis provided by staff and updated the 2021 Budget Development Schedule. ON BEHALF OF THE TAHOE KEYS PROPERTY OWNERS ASSOCIATION (TKPOA) I would like to thank all the TKPOA members

that submitted a ballot for the 2020 East Channel East Bulkhead Replacement Project Vote. A total of 621 ballots were returned representing over 40% of TKPOA members that were eligible to vote. To achieve a quorum for the vote we needed 509 valid ballots (33 1/3 of eligible owners), which was clearly achieved, and the minimum number of YES votes required was 256. Member approval was needed because our Bylaws prohibit the Board from entering into a contract in excess of $250,000 without approval of a majority of a quorum of the association membership by vote or written assent [TKPOA Bylaws Article IX, Section 2, subsection (a)]. The Board of Directors has authority to enter into a primary construction contract in an amount not to exceed $1,476,644 plus spending authority of up to an additional 10% for contingencies. No change in quarterly assessments will be required to fund this project during the remaining 2020 and 2021 fiscal years, and no special assessment is required for this project. Keys Breeze

The TKPOA is obligated by court order (1991 Superior Court of California – Stipulation Agreement No: 1225) to perform such repair, maintenance, and replacement of the East Channel East Bulkhead as is reasonably required to keep it in good and serviceable condition. All reasonable costs the TKPOA incurs performing that duty are court ordered shared between TKPOA (30%), Tahoe Keys Beach and Harbor Association (TKB&HA) (30%), and the Tahoe Keys Marina and Yacht Club (TKM&YC) (40%). However, the judgment also obligates the TKPOA to first pay the costs of this work through to project completion and then, after rendering an accounting, we are entitled to obtain reimbursement from TKB&HA and TKM&YC for their respective share of the total reasonable costs the TKPOA incurred. On behalf of TKPOA I would like to thank Tania Green – Notary Public, Inspector of Elections, who supervised the election and the tabulation of the result, as well as the election volunteers Lynett Elliot, Joanne Donmoyer, Liz Hansen, Renee Landau, Keiron McCammon, and Kerry McCammon, that donated their time on July 29th, 2020 to open and count ballots.

Notice of Change in Operating Rules TEXT OF PROPOSED CHANGES THE TKPOA BOARD OF DIRECTORS approved to adopt the following changes to

Association Operating Rules at the July 18th, 2020 Regular Board of Directors Meeting. These changes were noticed for a 28 day member review period in the June 2020 issue of the Keys Breeze. Purpose and Effect of Proposed Rule Change To further clarify wastewater rules and protocols within the Tahoe Keys Properties that require maintenance on hot tubs are authorized to dispose of the water by one of the following methods: • Have a servicing company remove the wastewater via a pump truck • Wastewater may be discharged into the internal sewer system within their property (i.e. bathtub or sink) • Sewer Cleanout, if available Vehicle/Vessel Washing • Within TKPOA waterways, watercraft of any type may not be washed with any product other than water. • Within streets, roadways, driveways, or yards only products that are environmentally safe, biodegradable, phosphate free, and water based may be used to wash vehicles or watercraft.
