AT THE TAHOE KEYS PROPERTY OWNERS ASSOCIATION (TKPOA) Board of Directors Regular Board Meeting on Saturday September 19th, 2020, the Board reviewed the proposed timeline for the membership vote to approve “The Amended and Restated Declaration of Covenants, Conditions and Restrictions (“CC&Rs”) and BYLAWS”, also known as the Governing Documents. The Board of Directors has approved SINCE 1991, CALIFORNIA moving forward with a membership vote LEGISLATURE HAS ENACTED on the Amended and Restated BYLAWS starting in October 2020. NUMEROUS NEW LAWS In 2015, the Board of Directors decided WHICH SUPERSEDE MANY OF that it was in the TKPOA’s best interest OUR GOVERNING DOCUMENT to start the process to amend or restate our “Governing Documents” in order to PROVISIONS. properly conform to changes in California Statues that have occurred since the Association’s inception. HOT TUB DISCHARGE REGULATIONS THE FOLLOWING INFORMATION is to help

members understand where they can and cannot drain their hot tub water. You cannot drain your hot tub water into the landscape or lagoons. Below are the TRPA Regulations on discharge. TRPA Code 33.3.2. Discharge Prohibitions The following discharges are prohibited: A. Direct Discharge – Direct discharges to the waters of the region of solid or liquid waste materials, including soil, silt, clay, sand, or other organic or earthen materials, are prohibited unless approved by TRPA. B. Indirect Discharge – Indirect discharges to the waters of the region of solid or liquid waste materials, including soil, silt, clay, sand, or other organic or earthen materials, are prohibited unless controlled by discharge devices approved by TRPA.

TRPA CODE 60.1.3C. Prohibition of Wastewater Discharge The discharge of domestic, municipal, or industrial wastewater to Lake Tahoe, its tributaries, the ground waters of the Tahoe region, or the Truckee River within the Tahoe region, is prohibited, except for existing discharges under alternative plans for wastewater disposal authorized by state law and approved by the state agency of appropriate jurisdiction, and for catastrophic fire protection of the STPUD Luther Pass Pump Station as detailed in subparagraph 4 below. California and Nevada prohibit wastewater discharge through the enactment of the Porter-Cologne Act, and the Executive Order by the Governor of Nevada dated January 27, 1971.

THE REMINDER TO SCHEDULE a breast cancer screening

test comes on strong during Breast Cancer Awareness Month in October. This month, let each splash of pink you see be an encouragement to get screened with a self-exam, physician exam, or a mammogram. It’s also a good time to get a feel for your own unique breast density, and establish a baseline to help identify warning signs of breast cancer, including:

A lump in the breast or armpit Swelling or thickening of all or part of the breast Dimpling or skin irritation of breast skin Localized, persistent breast pain Redness, scaliness or thickening of the nipple or breast skin • Nipple discharge (other than breast milk) • Any change in the size or shape of the breast

Some patients experience one or more of these symptoms, while others experience none. Performing monthly self-checks, talking to your care provider about concerns, and scheduling a screening are ways to be proactive about breast health. Breast cancer screening is the most reliable way to detect the disease, when it's at an early stage and is most treatable. Overall, patients are experiencing better outcomes as a result of advances in medical technology, treatment options, and less extensive surgery. After skin cancers, breast cancer is the most common cancer among U.S. women, according to the American Cancer Society. The average risk of breast cancer for an American woman is about 12 percent, or a 1 in 8 chance. The chance that a woman will die from breast cancer is 1 in 38 (about 2.6 percent). Different factors impact the likelihood of breast cancer, including race, lifestyle, and family history. Because of this, it’s important to speak with your provider about when to start getting mammography screening, and how often. Here at Lake Tahoe, our community has access to the latest in mammogram technology with Barton’s 3D tomosynthesis machine, and Breast Magnetic Resonance Imaging (MRI), which significantly improves the cancer detection rate via increased scanning details and detection capabilities. 3D mammograms provide higher quality images, saving the patient time as well decreasing radiation exposure by almost 50 percent. There are differing recommendations in the medical community for when patients should begin getting mammograms. The Obstetrics & Gynecology team at Barton Women’s Health follows the American College of Obstetricians and Gynecologists (ACOG) guidelines, recommending women with an average risk of breast cancer receive their mammography screening every 1–2 years beginning at age 40. If you have not started screening in your forties, you should begin having mammography no later than age 50 years, and screening should continue until at least age 75 years of age. If you have a strong family history of breast cancer, your screening recommendations may be different. Talk to your doctor to determine your individual risks and a screening schedule that is appropriate for you.

SEPTEMBER 12TH – ANNUAL MEMBERSHIP MEETING BOARD ACTIONS • Approved the June 2020 Financial Statements. • Approved Mapes Enterprises for the Pavilion Parking Lot BMP Project for $66,500 plus a contingency of $6,650 for a total of $73,150 to be funded out of the Common Reserve Fund. • Authorized the Tahoe Keys Project Manager to procure/purchase Bulkhead Steel for the East Channel East Bulkhead from L.B. Foster Steel per the plans/specifications for the East Channel East Bulkhead Replacement Project plus offloading of approximately 10 truckloads of steel sheet pile and walers at the site of the East Channel East Bulkhead for $378,665 plus a 10% contingency of $37,866 for a total of $416,531 to be funded from the Channels and Lagoons Reserve Account and to authorize Director Steve Shepherd to assist Staff in finalizing the purchase contract. • Appointed Peter Grant, Joy Curry-Norem, Nate Summer, Arlene Olsen, and Connie Haverty to the TKPOA Visions Ad Hoc Committee. • Temporarily appointed Board Director Dave Peterson as the Board Vice President.

Per the Advisor rules, any owner in good standing may volunteer to serve as the Advisor to their Subdivision or Cove. Otherwise the property owners may nominate themselves or another owner within that subdivision, confirmed by a vote of the Board of Directors. Each Cove Advisor is responsible for handling the general affairs of the cove including unit/ common area facilities; report maintenance, repair and other property owners issues to TKPOA management and follow-up in keeping those property owners up to date with current events, general affairs of projects happening within the Keys, and manage the cove’s budget. developed an implementation plan for the required TKPOA property owner communication and membership voting.

The Process of Amending Governing Documents

CALIFORNIA LAW REQUIRES THAT ANY AMENDMENT TO THE GOVERNING DOCUMENTS BE CONDUCTED BY SECRET BALLOT IN ACCORDANCE WITH THE CIVIL CODE AND ASSOCIATION'S ELECTION RULES AND VOTING PROCEDURES.

The last time that TKPOA’s “Governing Documents” were updated and amended are as follows: the BYLAWS June 8th, 2020 1990, with Amendments September 4th, 1992 and August 31st, 1996, and the CC&R’s June 11th, 1991. They were in dire need to be revised again in order to comply with California’s constantly changing legal landscape. As a common interest development (CID), the TKPOA is governed by many provisions of California law, including the Corporation code and the Civil Code (Davis –Stirling Common Interest Development Act). In addition to state, local and federal laws, any CID development is governed by its governing documents. Like state and federal laws and municipal ordinances which govern its citizen’s conduct, our “Governing Documents” are the foundation for governing this association. Since 1991, California Legislature has enacted numerous new laws which supersede many of our governing document provisions. In addition to the DavisStirling Act, there have been significant revisions of other state and federal laws, resulting in our existing “Governing Documents” being outdated, incomplete, or inaccurate concerning important aspects of our operations. The following Governing Document “Drafts” have been updated and posted since 2018: the “Third Draft” of “The Amended and Restated Declaration of Covenants, Conditions and Restrictions (“CC&Rs”) dated June 15th, 2019 and the “Fifth Draft” of BYLAWS” dated May 5th, 2020 on the TKPOA website at www.tkpoa.com, for TKPOA property owners review. Also provided is the “Fifth Draft” of the Summary of Proposed Keys Changes to the Governing Documents .

Why Conduct a Membership Vote?

California law requires that any amendment to the Governing Documents be conducted by secret ballot in accordance with the Civil Code and the Association’s election rules and voting procedures. Members will be receiving the entire revised CC&Rs and BYLAWS as required by Davis Stirling Civil Code Section §5515 (e) in an election to approve an amendment of the governing documents, the text of the proposed amendment shall be delivered to the members with the ballot. Based on this requirement this Voting Ballot and mailing will collectively cost up to $15,000 for the TKPOA to conduct the entire voting process. Keys Breeze

To Vote on Adoption of Amended and Restated BYLAWS

The owner of each Lot is entitled to cast one vote per Lot owned on this measure. A yes vote from a majority of a quorum of the eligible voting membership (quorum being 33 1/3%) of the members or a minimum of 510 members) is required to approve the Amended and Restated BYLAWS.

To Vote on Adoption of the Amended and Restated Declaration of Covenants, Conditions and Restrictions (CC&Rs) The owner of each lot is entitled to cast one vote per unit owned on this measure. A yes vote from sixty-six and two thirds percent (66 2/3%) of the eligible voting membership (a minimum of 1020) is required to approve the Amended and Restated CC&Rs.

It’s our responsibility to make these “Governing Documents”: the BYLAWS, CC&R’s, Articles of Incorporation, Architectural Control Rules and TKPOA Operating Rules as understandable as possible, so if there’s anything you don’t understand, please let us know. We’ll be glad to clarify any confusing language or give you other materials that will further answer your questions. It’s very important to have copies of these “Governing Documents” because you are expected to know and comply with all rules and regulations of the TKPOA. You will also want to stay informed by reading all materials provided by the TKPOA through the monthly Keys Breeze, “Email Eblasts”, Association mailings, and website information. In 2020 the Board of Directors formed the BYLAWS and CC&Rs Communication – “Ad Hoc” Committee, of property owners. The purpose of the committee is to assist the Board with the communication efforts for the restated and amended BYLAWS and CC&R’s through the voting and approval process. Your past Board of Directors has found being in compliance with state statues important enough to justify investing some of your assessment dollars in this process. The 2020–2021 Board of Directors and TKPOA staff will work toward moving this project and a membership vote forward in the next few months for both the BYLAWS and CC&Rs. The proposed timeline for the BYLAW membership voting is as follows, the CC&Rs voting timeline will start in January 2021.

Bear Awareness in the Tahoe Keys By Gregory J Hoover, TKPOA Water Quality Manager/ AIS Management Coordinator THE AMERICAN BLACK BEAR, Ursus americanus, is the most common bear

native to North America. The coat of a Black Bear is shaggy and usually black, but it can also be dark brown, cinnamon, yellow-brown, greyblue, and white depending on location. The black bear is approximately 4 to 7 feet from nose to tail, and two to three feet high at the withers. It has small eyes, rounded ears, a long brown snout, a large body, and a short tail. Adult females weigh 100–200 pounds whereas adult males are larger, at 150–350 pounds, though individuals over 600 pounds have been taken by hunters in California. The first thing a bear thinks about, and their prime motivation is FOOD! These animals have a tremendous sense of smell, which guides them on their search for food. Bears are attracted to residences in the quest for an easy meal. Black Bears are smart. They learn rapidly and know where they have found food in the past. Once they have hit the “jackpot” they may damage property to get back at the food source again. Bears can pry open doors, windows, dumpsters, or other structures if they can get their claws or teeth into a crack or opening. Normally they will do this only if they smell food inside or have ‘been lucky’ before. They can easily tear through screens. What you as a homeowner can do:

Eliminate or Mask Garbage and Food Odors

• Deodorize garbage cans with bleach, unscented ammonia, or unscented Pine Sol. • Separate “wet garbage” and keep it in an air and odor tight container. Use garbage disposal whenever possible. Freeze meat bones or other smelly items until pick-up day. • Deodorize soil or other porous surfaces where garbage has been stored and other areas where the bear may have spread garbage around. • Burn off BBQ grid after cooking and clean the drip can.

Eliminate the Source • • • •

Utilize a ‘Bear Proof’ garbage container. Make sure that trash cans and dumpsters are properly secure. Put garbage out on the morning of pick-up, NOT the night before If you cannot be there to put it out, ask a neighbor to help or take it with you for disposal elsewhere.

• Do not feed pets outside and do not leave pet food outside. • Do not leave food or air-fresheners in vehicles. Roll up windows and lock car doors. • Clean baby seats. Leave NO diapers, clean or soiled, in vehicles. • Remove freezers, refrigerators and ice chests stored in open porches, garages, and breezeways. • Compost piles can be a serious attractant. • Rinsing recyclables is not enough, they recognize this as garbage and will still forage through it. • Bring bird feeders and suet in at night or whenever there is no one at home. Bears will climb trees to reach an upper deck feeder. • DeCon attracts bears and LOTS of rodents! • For those homes that have fruit trees, please harvest, and remove all fallen fruit from the tree vicinity and the surrounding area. • Bears that have “learned” the likely locations of food storage will continue to make attempts to access those areas such as vehicles, dumpsters, garages, etc. • More aggressive strategies such as electric mats may need to be employed. • The TKPOA Architectural Control Committee (ACC) will consider applications for other storage facility designs on Single Family Homes (SFH) Properties if the storage structure is incorporated within the architectural design of the primary residence building. No stand-alone garbage storage structures are authorized by ACC on SFH properties. Bear boxes for a SFH can be purchased for between $800.00$1500.00 from several different vendors around the Lake Tahoe Basin.

Inspect your property

• Close and lock your windows at night (or when out of the room) on accessible ground floors and decks. • Do not leave food in or near a windowsill or on a counter where visible. Sights and smells will be an invitation to bears. • Securely block any access to potential hibernation/ den sites, i.e. under decks, houses or sheds before a bear decides to take up residence. • Strengthen or fortify outside doors and windows on sheds, cellars, workshops, garages, or any place where food or garbage is kept. • Install Electric door & window protection, it solves the break-in problem very quickly! Government Policy for Nuisance Bears • The is NO bear relocation program in the state of California & Nevada. • The California & Nevada Dept of Fish and Game WILL NOT relocate bears. • When a complaint is registered about a ‘problem’ bear that involves a threat to personal safety or property damage, a depredation permit is issued. A trap is set and ANY bear who enters the trap is killed. If she is a nursing mother, her cubs are also killed. • People who create situations where bears get food begin a cycle, which usually results in the death of a bear. Do not let this happen, follow ALL the guidelines! TKPOA has bear proof dumpsters at the Pavilion parking lot that is available to homeowners and long-term renters for disposal of up to two bags of household trash per week. Trash may also be taken to South Lake Tahoe Refuse located at 2140 Ruth Ave., South Lake Tahoe, CA 96150. Their hours of operation are Monday through Saturday 8:00 am to 5:00 pm and are closed on Sundays.

Meetings and Approvals

At the September 19th, 2020 Board of Directors Meeting, the TKPOA Board of Directors approved the July 2020 Financial Statements. These Financial Statements can now be located on the TKPOA website. The Board of Directors also reviewed homeowner delinquent accounts and conducted scheduled disciplinary hearings on delinquent accounts. There were no approvals for lien notices for delinquent homeowners to review. Disciplinary hearings are generally held when a homeowner is delinquent on two quarterly assessments. Keys Breeze

On September 22nd, 2020, the Finance Committee reviewed and approved the July Financial Statements. The Finance Committee also reviewed the 6th draft of the 2021 Budget. Member ID Card and Recreational Pass Policy AS A REMINDER TO OUR MEMBERS, their renters, and guests,

the following are provisions of TKPOA’s Member ID Card and Recreational Pass Policy for access to the Associations amenities and facilities as revised by the Board of Directors on May 22nd, 2015:

• Owners & Long Term Renters (LTR) must have a current valid

VACATION RENTERS NEED TO PROVIDE A COPY OF THEIR LEASE TO THE FRONT DESK— EITHER HARD COPY OR DIGITAL COPY.

Member ID Card with a valid photograph of the member and/ or LTR in their possession when using any of the Association’s facilities. This includes, but is not limited to, swimming pools, spas, tennis courts, parks, playground, beaches and volleyball court. • Up to three guests per Member ID Card and Long-Term Renter ID Card can get access to the association facilities when accompanied by the ID cardholder. • The fee for replacing lost, stolen, or damaged ID cards will be twenty dollars ($20). The TKPOA will take current digital photographs with the issuance of ID cards. • Property owners or their rental management company should direct their rental guests to the TKPOA Pavilion office to purchase Short Term Recreational Passes for use of Association amenities. Vacation Renters need to provide a copy of their lease to the front desk—either hard copy or digital copy (for 2020 there is a daily per person fee of $10. Weekly passes are also available). The complete text of the Member ID Card and Recreational Pass Policy can be found on the TKPOA website, www.tkpoa.com or a copy can be requested from the office. TKPOA staff is tasked with enforcing TKPOA’s Operating Rules for Association amenities which includes enforcement of the Member ID Card and Recreational Pass Policy in order to correct violations. Please contact the front desk at (530) 542-6444 if you have questions on the Member ID Cards assigned to your property or on how to obtain recreational day use passes for your renters and guests. The Pavilion Office is open Monday-Sunday from 8:30 am– 4:30 pm.
