MANILA, Aril 6 (PNA) -- President Rodrigo Duterte on Thursday said he has ordered the Armed Forces of the Philippines (AFP) to occupy all islands of the Philippines in the West Philippine Sea to maintain and strengthen the country’s jurisdiction over uninhabited Philippine islands. “We tried to be friends with everybody but we have to maintain our jurisdiction now, at least the areas under our control. Chinese Foreign Ministry spokesperson Hua Chunying made this appeal during a press briefing when asked to comment on reports that President Rodrigo Duterte has ordered troops to deploy on unoccupied South China Sea islands. ”We expressed concern over it and we hope the Philippines side can continue to properly (handle) the maritime dispute with China and to maintain this stable growth in China-Philippines relations,” Hua said. Often “liquidationsâ€? or “reorganizationsâ€? are the words that are used to sum up the process that unfolds when you file for bankruptcy. The two kinds of bankruptcy that you can file for are Chapter 7 and Chapter 13. There are various factors that would determine whether you should opt for Chapter 7 or Chapter 13. Through Chapter 7 Bankruptcy you liquidate all unsecured debt, providing any assets you may have are exempt under bankruptcy rules. Most people never lose anything, because they don’t have any non-exempt assets. In the event debtor is making too much money, they choose Chapter 13 Bankruptcy,

which is the reorganization type of bankruptcy. The debtor is allowed three to five years over which to pay back a portion of the debts, based on disposable income. Say that you have $100.00 in disposable income. You would have to pay that into a plan for 60 months. After 60 months, the balance of your debts would be discharged in full, even if they are far from being paid off. One should keep in mind that there are intricate details to this legal process that need to be taken into consideration before decisions are made to file for bankruptcy. Who qualifies? Which kind would apply to you? Will you be able to keep all of your property? There are many such questions that arise in such a situation. In this situation, you need to consult with an experienced bankruptcy law firm that can guide you through these complicated decisions and procedures. Filing for bankruptcy may not be the solution to all your financial problems though. In fact, bankruptcy does not cover all debts. Pabasa ng Pasyong Mahal in historic Filipinotown By Abner Galino

Pabasang Pasyong Mahal, arguably the centerpiece of the Filipino Catholics’ celebration of the Holy Week, is unfolding on its third year at the historic Filipinotown in downtown Los Angeles. Bernie Targa-Ganon, president of Philippine Institute of Language, Arts and Culture (PILAC), said the Lenten Week tradition, commonly referred only either as Pabasa or Pasyon, will be held at the Manila Terrace at 2328 W Temple St. “We are inviting everyone to participate in this Lenten Week tradition. It is a unique occasion for Filipino Americans, especially for those who were born and raised to experience Filipino piety. It is also an occasion to experience the Filipino language, music, food and, most important of all, the warmth of our communal hospitality,” Targa-Genon said. The two-day Pabasa, which will take place on Holy Thursday and Holy Friday, is being supported by the Knights of Rizal-Historic Filipinotown (KOR-HFT), United

Pabasang Pasyon Mahal, which literally means “the reading of the beloved passion” (of Jesus Christ) is a 500-year-old tradition that dates back during the Spanish colonial rule. It is a Filipino style uninterrupted recitation of the life, death and resurrection of Jesus Christ. There are many traditional musical tones, passed down through generations of Filipino Catholics, used as accompaniments to the recitations. But younger generations of Filipinos have also used pop music, ballads and other contemporary hymns during the reading of the Pasyon. Generally, the tradition involves more of “singing”than recitations. Communal food sharing forms part of this Filipino tradition. According to historians, the Pasyon’s artistic form – which is in five lines of eight syllables each – was an adaptation of indigenous oral tradition of reciting poems.

Duterte installed as new BSP Chief Scout MANILA, April 3 (PNA) – President Rodrigo Duterte was installed as the new Chief Scout of the Boy Scouts of the Philippines (BSP) during the Baden Powell Day of the World Scout Organization in Malacañan Palace on Monday, April 3. In his message, the President said he was grateful and honored to have been formally installed as the Chief Scout of the BSP signifying his readiness to face challenges and responsibilities that the investiture would bring. “We, in government, see the formation of the Filipino youth as a vital [tool] in nation-building. What becomes of today’s youth will determine what becomes of our country in the future,” he said. He commended the BSP for teaching young boys to become proactive and law-abiding citizens. “The organization has taught them self-reliance, discipline and

scouting movement. It is also inculcated among them the values of [civic] consciousness and courage and love for country,” he added. He likewise underscored the role of the BSP in the country’s fight against corruption, illegal drugs, and criminality that continue to erode the foundations of the nation. He said the BSP helps in the youth’s character formation as he expressed confidence that the organization and all its scouts would remain as partners of government for change. “I call upon the members of this august organization to help uphold the Scout Oath and Law and let us continue to pursue and aspire for what is right, good and just,” he said. $500-M investment pledges up during PRRD’s visit to Middle East By Kris M. Crismundo

MANILA, April 5 (PNA) – Philippine Economic Zone Authority (PEZA) Director General Charito Plaza said some USD500-million worth of investment pledges are expected to be signed during the visit of President Rodrigo Duterte in the Middle East. Plaza, in an interview, said most investment interests of Middle East firms in the Philippines were in agriculture sector and halal industry. The commitments were an offshoot of PEZA’s investment roadshow in Riyadh, Dubai, and Qatar last February.

“During our Middle East visit, we are able to gather USD500 million worth of investment pledges. This will be signed when the President go to the Middle East,” the PEZA chief said. President Duterte plans to visit the Middle East this month. Plaza added that since the interests of Middle East economy were in the agriculture and halal sectors, most of these investments would be concentrated in Mindanao. She noted that this would be in line with the administration’s goal to spur economic growth outside Metro Manila.

Initially, the CMIM is only for the 10-country members of the Association of Southeast Asian Nations (ASEAN) composed of Brunei Darussalam, Cambodia, Indonesia, Lao People’s Democratic Republic, Malaysia, Myanmar, the Philippines, Singapore, Thailand, and Vietnam. China, Japan, and Korea joined in later.

DAVAO CITY, April 5 (PNA) – The slow broadband service and the local government units’ (LGUs) bureaucratic process in granting permits to telecommunication firms are obstructing the government’s goal of improving telecommunications in rural areas and the further growth of impact sourcing industry in the country. According to reports, internet service in the country is improving, but continues to be one of the slowest and most expensive in the world. In the 2016 fourth quarter

report of Akamai, the Philippines has the slowest average fixed broadband speed in Asia Pacific; the second slowest 3G/4G overall speed in the world according to the OpenSignal February 2017; and the third most unaffordable internet service in Asia. Department of Information and Communication Technology (DICT) Secretary Rodolfo Salalima admitted the country’s broadband and internet service are still slow, which impacts the impact sourcing industry and the generation of online job opportunities.

AFP: No confirmation yet on Abu Sayyaf leader Hapilon’s death MANILA, Apr 4 (Mabuhay) – Armed Forces of the Philippines (AFP) chief of staff Gen. Eduardo Año said Tuesday they have yet to get confirmation on the supposed death of Abu Sayyaf leader Isnilon Hapilon. “The President said he believes Hapilon might be dead because the latter was seriously wounded and no word from him was heard since then. There are raw reports but we still have no confirmation that Hapilon is really dead,” Año said. President Rodrigo Duterte on Monday said Hapilon could have been killed in an airstike that he ordered weeks ago. Año said the last they heard about the Abu Sayyaf leader was that he was being carried by his men while being transferred to a temporary base in Butig, Lanao del Sur. “Our last information on him was sometime in February and he was being carried by four ASG members transferring from one temporary

base to another in the hinterlands of Butig,” he said. He said military operations against Hapilon’s group will continue in Lanao provinces and Basilan. AFP spokesperson Brig. Gen. Restituto Padilla also said they still have no confirmation of Hapilon’s death. “We have no information as of this date this is why the President said ‘supposes.’ We will continue ongoing efforts to ascertain this,” Padilla said. Last month, the the Philippine Army’s 103rd Brigade said that Hapilon was wounded in the right leg during an encounter with members of the 51st Infantry Battalion and 15th Division Reconnaissance Company in a forested village in Poona Babayao, Lanao del Sur. The military previously claimed that Hapilon was “seriously hurt” during an airstrike in Butig town, a known lair of the Maute group, in January.(MNS)

Escudero: Sueno dismissal no bearing on postponement of barangay polls MANILA, Apr 4 (Mabuhay) – Senator Francis Escudero said Tuesday that the dismissal of Interior Secretary Mike Sueno will have no bearing on the administration’s plan to postpone the barangay elections slated for October and appoint village officials. At a media forum in Manila on Tuesday, Escudero said postponing the elections is a function of Congress and not of the Executive branch. “I don’t think it will have any bearing because this is purely a legislative function deciding whether or not to postpone or push through with the barangay elections,” the senator said. “And if it will be postponed, for how long and will there be a carry over mechanism or system for part or for all? And if at all they will be

appointed, who will appoint them? This will be a function in the next few months of both the House and the Senate,” he added. Citing loss of trust and confidence, President Rodrigo Duterte removed Sueno as head of the Department of the Interior and Local Government (DILG) on Monday following allegations of corruption and abuse of power. Sueno’s dismissal came as Duterte administration is pushing for the postponement of the October elections in the barangay level, where the DILG has administrative supervision. Escudero said he respects the President’s decision to fire Sueno, noting it is the “sole prerogative of the President to hire and fire anyone at any point in time.”

Former Sen. ‘Bongbong’ Marcos open to joining Duterte Cabinet MANILA, Apr 5 (Mabuhay) – Former senator Ferdinand “Bongbong” Marcos Jr. on Wednesday said he is open to joining the Duterte Cabinet but showed no signs of letting go of his electoral protest against Vice-President Leni Robredo. “If the President asks you to serve in whatever capacity hindi mo pupuwedeng tanggihan. Siyempre para sa bansa yan and of course I’d be happy, I’d be proud, I’d be honored to serve in any position in the Duterte administration,” Marcos said in an interview. He added: “I have not spoken to the President for a...few weeks now so, and never pa namin napag-usapan ang kahit na anong klaseng appointment.” Marcos was the rumored choice of Duterte to be Department of the Interior and Local Government Secretary even before Ismael Sueno was dismissed Tuesday. Duterte earlier refuted news reports that Marcos would get the key Cabinet post. “He’s not interested,” the President said. In this age of technology, losing one’s iPhone now becomes an inconvenience Around two weeks ago, on a Friday evening, this author lost an iPhone inside the women’s restroom at Bamboo Bistro Restaurant in Panorama City, just as a friend, MaryAnn Samadi and this author were leaving to go home. It took 10 minutes at the most, when we tried going back to retrieve the iPhone I left on the shelf inside the restroom, but it was gone. When we call the phone, it was ringing; we rang it the second time and apparently, whoever took it must have turned the ringer off. Our performer friend, Malou Toler even announced it at the venue, but no one turned it in. Along with another friend, Paul Mirador, we tried calling this author’s service provider, which was AT&T customer service (1-800-331-0500) and inquired how we can search for the phone through their “Find MY iPhone app” but it didn’t go through, because apparently, this author’s phone didn’t particularly have that app. The following day, still without a phone, this author had to drive 50 miles one way, to Newport Beach to visit a relative. Normally, I would just take the Amtrak to the Irvine station and they would pick me up at the station. But due to not having a way to communicate with the relative, this author just decided to drive all the way there. Another inconvenience also happened on the third day, when a friend

invited this author to lunch, but not having a phone to communicate with them while in transit, this author made sure that they were aware of my incapacity to do so, by calling them from a landline phone before leaving the house. On the fourth day, still without a phone, this author went to another AT & T retail store nearby. The salesperson named Tony repeated taking the same information from us (this author brought son Christian along), and faxed the information to their insurance services, but never gave us a confirmation number on the transaction. Finally, on the fifth day, this author spoke with the iPhone insurance Tech support of Asurion Insurance Services named Aisha at 888/562-8662, who informed us that payment for a deductible is required to enable her to process the replacement order. As soon as this author approved it, she gave me a confirmation number which we can use to follow-up as replacement phones are shipped the following day. True enough, this author finally

received the replacement on the 7th day, but activation took another day and the sad part is losing one’s contact list, along with irreplaceable memorable photos in its photo gallery. Sad to say that it took more than a week to finally enable oneself to communicate with loved ones and friends. As a non-tech savvy senior like us, we have to learn the importance of apps such as “Find My iPhone and iCloud” to enable us to have “find our phones” immediately and have

contact, text messages and photos recorded on a back-up file. However, all these “additional” services now cost $1l.99 per month added to one’s phone usage, calling it “protection plus” which merely escalates one’s monthly telephone service statement. So, my advice to all of you ladies who are currently experiencing random “forgetfulness,” this was a lesson learned. Make sure to put your electronic communications equipment inside your purses wherever you go.

MANILA, April 5 (PNA) – Malacañang on Wednesday stressed that the results of a recent poll just showed that a large majority of Filipinos still trust President Rodrigo Duterte despite all the ‘vicious noise’ orchestrated by his fiercest critics. According to the “Ulat ng Bayan” survey released by Pulse Asia Research Inc., the performance rating of Pres. Duterte dropped five points nationally, from 83 percent in December 2016 to 78 percent in March. The President’s trust rating also dropped seven points, from 83 percent last December to 76 percent in March. The survey was conducted from March 15 to 20, 2017. “The continued high approval of PRRD et al, as validated by the latest survey results, proves that the majority appreciate the decisiveness of President Duterte,” Presidential Spokesperson Ernesto Abella said in a statement. “The people continue to embrace the President’s vision of a nation that works for the prosperity of all; a trustworthy government; and lasting peace, considering that the survey coincided with vicious noise

Second Executive Order by Trump is halted Question: I know that Trump issued a second executive order. What is happening with this one? Answer: The District Judge in Hawaii has ruled for Plaintiffs. In other words, that Judge has ruled that the brief Temporary Restraining Order is now converted to a Preliminary Injunction, and therefore, is both nationwide and issued for a much longer period than would have been the time span of the temporary injunction. Question: Why did the Judge rule against Trump? Answer: There were several reasons: 1, The Judge basically said that this is a watered down version of the first executive order and that just taking out some language which was blatantly inflammatory and unconstitutional in the second executive order does not change the basis for the executive order itself. Essentially, Trump said many times in the campaign trail how he was going to ban muslims. He stated many derogatory statements against muslims and essentially attacked a gold star family whose muslim son died defending the U.S. The Judge stated he was not going to close the shutters, turn out the light and go hide in a corner as though those statements and actions were never taken. Thus, the Judge ruled that the words in the executive order cannot simply be taken at their face value and that he needed to look at Trump’s past statements to see the real intent behind the executive order. Since the real intent is the ‘muslim ban’ and not the watered down words of the executive order, the preliminary injunction was issued. 2. It was a violation of the Establishment Clause of the United States Constitution. This particular clause is in the First Amendment to the U.S. Constitution and it prevents the government from either endorsing a religion or prohibiting the practice of a religion. Thus, in the first executive order, Trump has specifically stated that anyone coming into the U.S. claiming ‘Christian persecution’

would be given priority. This was clearly a violation of the Establishment Clause as it gave preference by the government to one religion over another. In the second executive order, the Court basically said that this ‘Muslim Ban’ is really meant for a prohibition of one particular type of people who practice a certain religion from entering the U.S. Thus, it violated the Establishment Clause on the other side of the spectrum by the government essentially prohibiting practice of a religion in the U.S. Question: Why is the Establishment Clause so important? Answer: It is critical to our democracy that there is a separation of church and State. Thus, the government must both stay out of religion as well as do anything to promote religion. Otherwise, you start having a government that starts making decisions based upon religion and not law. The government starts giving preference to one religious sect over another. The government essentially starts discriminating. This is why the founding fathers put the Establishment Clause in the First Amendment to the U.S. Constitution. Brian D. No vacation leave for BI employees this April – BI chief Morente By Ferdinand G. Patinio

MANILA, April 5 (PNA) -- The Bureau of Immigration (BI) will not allow its employees to take vacation leaves this month. In a statement, BI Commissioner Jaime Morente has ordered the cancellation of all approved leave applications of employees during the month. “Pending and would-be filed leave applications will also be disapproved,” he said. With this, the BI chief noted that the deployment of immigration officers currently assigned at the main office and other field offices to the Ninoy Aquino International Airport (NAIA) terminals and other airports in the country, is only temporary as they will be recalled to their old units after the Lenten break. Some 170 bureau employees have been deployed in all airports to assist in the immigration processing of arriving and departing international passengers. The additional manpower were installed in an effort to address the problem of long passenger queues in immigration counters at the

airports as the Holy Week holiday break approaches. Morente admitted that the employees’ reassignment will cause a slight slowdown in operations of the offices that they will temporarily vacate. “I appeal to our rank and file to remain patient and focused on their responsibilities as everything is being done to address their financial plight that resulted from the loss of their overtime pay,” he added. Earlier, Morente and Justice Secretary Vitaliano Aguirre appealed to President Rodrigo Duterte to reconsider his decision stopping the use of the BI’s express lane collections in paying the overtime services of the bureau’s organic personnel and the salaries of its contractual employees. They both proposed that the overtime pay be temporarily reinstated until Congress enacts a new immigration law that will upgrade the salary scale of BI employees. Meanwhile, BI Spokesperson Antonette Mangrobang noted that those who have approved leaves are ordered to report to work.

President’s men clash over Immigration pay mess MANILA, Apr 5 (Mabuhay) – Several members of the Duterte Cabinet appear at loggerheads over who is to blame for the long queues at the country’s main airport caused by a lack of Immigration officers. Immigration officers (IOs) have resigned or taken leaves from work en masse after President Rodrigo Duterte vetoed the use of express lane charges for their overtime pays. Presidential Spokesperson Ernesto Abella on Tuesday said the Department of Budget and Management (DBM) approved the opening of 887 plantilla positions to solve the shortage of IOs, but the Bureau of Immigration (BI) allegedly rejected the proposal. Immigration Commissioner Jaime Morente however denied on Wednesday that he opposed the creation of additional plantilla posts. “Very welcome po ito. Hindi po namin, hindi ko tinanggihan ito. It only came last Thursday,” Morente said. The Bureau of Immigration, he said, can only start accepting IO applicants 10 days after the Civil Service Commission posts a notice of the job vacancies. Morente also insisted that the use of express lane fees for overtime pay has legal basis under the Immigration Act. Nonetheless, he said BI is “not fighting” Duterte’s veto on overtime pay, but is merely asking for a transition period as it searches for alternative sources of the overtime pay and pushes for a salary increase for IOs. DBM Secretary Benjamin Diokno has said it is illegal for workers to receive overtime fees that are double their regular pay. IOs, he claimed, received overtime pays that are up to 5 times their regular wages. Diokno also warned that IOs can be be easily replaced if they insist on their overtime perks since they hold “contractual” positions. Morente contradicted Diokno’s statement, saying IOs are not contractual workers, but are part of the BI plantilla. “Gusto ko lang po i-correct. May narinig po kasi ako na JOs (job order) at contractual [workers] daw are the ones manning iyung counters namin. Mali po, inaccurate po ang statement na iyun kasi only IOs are vested by law to admit or exclude passengers,” he said. “Regular plantilla positions lang po ang pwedeng umupo sa counter.” The use of express lane fees as overtime pay was initiated as an anti-graft measure in 1998 by the late former senator and Immigration chief Miriam Defensor-Santiago. Classes in all levels were suspended Wednesday and students were advised on extra safety precautions and stay alert due to intermittent aftershocks. Local governments also reported that roads remain passable as well as sea trips to the province’s tourism island destinations remain open but travel advisories have been issued from time to time. Mandanas also said that the southern portion of the Southern Tagalog Arterial Road (STAR) tollway has sustained further damage and

needs retrofitting. He said that portions of the tollway incurred damage during “Typhoon Nina” which hit the province on Christmas day last year and is still undergoing repair when the earthquake struck and further stalled the rehab works. According to Mandanas, alternate routes in Batangas were opened to motorists and commuters as the southern tollway underwent repair but with the new damage, assessments require retrofitting and rehabilitation to ensure the southern tollway’s structural integrity. Lito Castro, Batangas provincial disaster risk reduction and management officer (PDRRMO), said they are now conducting rapid structural assessments although minor damages have been reported so far. Castro said slight damages were reported in centuries-old churches like Taal Basilica and the Batangas City cathedral, where walls incurred cracks and there were some fallen debris about the size of a clinched fist. Getting around the six month residency requirement to ďŹ le a divorce in California Generally, you must have resided in California for at least six months in order to file a divorce in this case. Under Family Code Section 2320, a judgment of marriage dissolution (divorce) may not be entered unless one of the spouses has been a “residentâ€? of California for six months and of the county where the proceeding is filed for three months immediately preceding the filing of the petition. This poses a problem for divorcing couples that has not resided in California for at least 6 months. Couples that moved to California from other states or other countries are faced with this problem because they cannot get divorced until they satisfy the residency requirements. Even a bigger problem is when they need immediate temporary orders from the California Court regarding child custody, child support, management and control of community businesses and property. The solution for this type of problem is filing nullity or legal separation petition rather than a divorce

and amending the petition later on to convert it to a divorce once the residency requirement has been met by one of the parties. Millar v. Millar. Unlike a divorce, there is no residency requirement to filing an Annulment or a legal separation. The advantage of this strategy is you would immediately have access to the courts and can ask the court for immediate temporary orders needed to maintain the status quo or preserve the marital assets. If domestic violence is involved in the case, the domestic violence issue can be heard in the same court room by the same judge that would be hearing the divorce case. In addition, service on the legal separation petition (to be amended later to a

divorce) will also start the clock on the six-month “waiting period� for finality of a judgment terminating marital status, optimizing the timeframe within which the parties will be legally restored to “single� status. As far as the county where to file the legal separation or nullity, venue is proper in the county where either party resided at the time the petition was filed pursuant to CCP 395(a). Once the parties have satisfied the residency requirements, the Petition may be amended from legal separation to Dissolution without permission from the Court as long as notice is provided the opposing party under Marriage of Dick. The Petitioner would also be in a safer position if the intent to amend from legal separation/nullity to a divorce is stated in the initial Petition. Sandiganbayan defers arraignment of ex-LRTA chief Robles for graft case MANILA, Apr 5 (Mabuhay) – The Sandiganbayan has deferred the arraignment of former Light Rail Transit Authority (LRTA) administrator Melquiades Robles and some of his co-accused for their graft case over the alleged anomalous implementation of the system’s janitorial contract in 2009. The arraignment, scheduled on Wednesday, was canceled after some of the respondents filed motions for judicial determination of probable cause and to quash the case. The court gave the prosecution 15 days to file their reply to the said

motions. One co-accused, Dennis Acorda, meanwhile, proceeded with his arraignment. He pleaded not guilty to the crime. The arraignment for accused Marilou Liscano, meanwhile, is set on April 26. Robles, along with former LRTA officials Liscano, Federico Canar Jr., Dennis Francisco, Evelyn Macalino, Elmo Stephen Triste, Eduardo Abiva, Nicholas Ombao, Roger VaĂąo, Maynard Tolosa and Juliet Labisto, and private respondents Lilia Diaz and Acorda, were charged with violation

of Section 3(e) of the Anti-Graft and Corrupt Practices Act. In its charge sheet filed with the Sandiganbayan, the Ombudsman said the respondents gave “unwarranted benefit, advantage or preference� to Joint Venture of COMM Builders and Technology Philippines Corp. The Ombudsman claimed the respondents paid Joint Venture P3.37 million per month to deploy 321 janitors. They, however, allowed the reduction in the number of janitors to be deployed from 321 to 219.

This, the Ombudsman said, modified “the terms of the Contract with the Joint Venture for the Maintenance of the LRT Line 1 System, causing undue injury to LRTA in the amount of P1,072,051.30 per month or P12,864,615.63 in 2009 alone.�(MNS)

Common misconceptions about Bankruptcy Part 2

Here are some more misconceptions about bankruptcy that we did not discuss last week: 1. Will I lose my house? Normally, debtors get to keep their residence as long as their equity in the house does not exceed the applicable homestead exemption. If the equity of the house is within the limits of the homestead exemption, then the house does not become part of the bankruptcy estate that is subject to trustee administration for the benefit of creditors. In other words, there is no risk of losing the house to the trustee in a Chapter 7 case. Real estate values are high now after losing half their values between 2007 and 2009 during the mortgage crisis created by Wall Street greed with their bundle mortgages. If you recall, it was easy to buy a house for a couple of years before the mortgage crisis. You could buy a house with zero down with no income qualification. All you had to do to buy a house then was have a name and social security number. You did even have to be alive. Even if you were buried six feet underground, as long as you had a social security number, there was a house of your dreams waiting for you to move into. In fact, a lot of dogs with fake social security numbers were able to buy houses too. I kid you not. I had many clients back then with minimum wage jobs who were able to buy $1.0M mansions. The idea was to keep the house for a few months then sell it for a profit. Since house prices kept on going up, the $1.0M mansion that you bought with zero down would be worth $1.2M in 3 months. After deducting holding costs of $30K, there was a cool profit of $170K to be made in 3 months. Practically everyone and their mothers became mini Trumps. Some would buy ten rental properties with the intention of selling them in a couple of months for a profit of $50K each. With ten rentals, you could make $500K in 6 months. Do it twice in a year, and you could be a cash millionaire in one year. I had clients with rentals in Texas, Arizona, Florida, and of course here in California. They all became landlords. Then, the bubble exploded and real estate lost more than half their values at their peak. Well, real estate values are now back up even surpassing their peak just before the bubble burst. So debtors now have to pay attention to what the current value of their houses are. It’s easy to get an appraisal of the current value of your house. You can

go on line and have an e-appraisal done in less than two minutes. The homestead exemptions in California are $75K for a single person, $100K for a person with a qualifying relative who lives in the house, and $175K for seniors who are at least 65, or 55 but who earn less than $35K with the spouse. For instance, your house is now worth $500K and the balance of your first mortgage is $325K. You just turned 65 yesterday. Then, your house is exempt because the entire equity of $175K is covered because you are 65. If you the equity of your house in just in excess of the homestead exemption, the better part of caution requires that you file a Chapter 13, not a 7. Chapter 13 trustees do not have the power to sell debtor houses but Chapter 7 trustees do have that power. 2.What happens to the cars? There are two systems of exemption. You choose one of them. You cannot mix them both. System one allows $3,050 for the equity of one car while system two allows $5100 for the equity of any number of cars. Let’s say you have a 2015 Mercedes Benz E 350 with a loan balance of $38K while the current value of that car is $35K. You also have 2015 SUV Land Rover with a loan balance of $45K. That SUV is currently valued at $40K. Will you be able to exempt these two luxury vehicles if you filed for Chapter 7? Of course you can. Why? Because both cars have zero equity. In order to keep these two cars, you have to continue making timely payments even if you filed for bankruptcy and you may have to reaffirm the car loans. Some creditors do not require reaffirmation. Some do. For creditors who require reaffirmation, even if you are current on the car payment, they have the right to repossess if no reaffirmation was timely filed and approved by the Judge. 3. Can you keep your retirement accounts? Generally speaking, retirement accounts are exempt up to $1.0M. So most debtors do not have any problem exempting their retirement accounts. Most people do not have $1.0M of retirement funds. I tested the retirement exemption once a

couple of years ago when client had almost $920K of retirement funds. He was given an early retirement at the age of 55 and he opted for a lump sum retirement of $920K. His retirement account had ballooned into $920K because the stock market was on the rebound from the 2007 market crash. Once the money was paid to him he had 60 days to roll it into an IRA. Since the money was large and was had not yet been rolled into an IRA, I was concerned that the trustee might dispute the status of the funds as not being retirement funds since the $920K had not yet become an IRA, although debtor’s intent was to make it an IRA. He was still in the process of looking for a financial advisor. Fortunately, the trustee did not dispute the applicable exemption that we used to cover the $920K. 4. Can you continue operating your business? In Chapter 13, operating a business is absolutely no problem. In a Chapter 7, you can continue operating your business if certain conditions are met. If the business is a sole proprietorship, debtor must exempt the net worth of the business and must have liability insurance for the business that is enough to satisfy the trustee that the insurance is big enough to cover any potential liability from a third party. If the business

Prosecutors oppose Jinggoy’s request to attend dad Erap’s 80th birthday MANILA, Apr 4 (Mabuhay) – Ombudsman prosecutors expressed opposition to former Senator Jose “Jinggoy� Estrada’s request to allow him to attend the 80th birthday celebration of his father, former President and now Manila Mayor Joseph Estrada. In their seven-page opposition, the prosecutors argued that the former senator failed to substantiate that his father will indeed celebrate his birthday on April 19. “Inasmuch as accused Estrada has not provided sufficient basis to support his assertion in the form of certificate of birth of former President Estrada, his claim that the latter will celebrate his birthday on April 19, 2017, thus, remains unsubstantiated and self-serving,� the opposition read. Accused Estrada asked the Sandiganbayan Fifth Division to grant him a furlough “starting April 18 up to 12 hours from 5 p.m. of April 19� so that he can participate in the preparation and organizing of his father’s birthday celebration.

But the prosecutors argued Estrada’s current situation and the existing laws go against his request for furlough. “[T]o grant his request would unduly create an impression to the public that accused Estrada, being a high-ranking public official, is a favored detainee and above other similarly situated detainees,� the prosecutors said. The prosecutors also cited the court’s earlier rulings denying Estrada’s furlough requests, one of which was for the 86th birthday of his mother, former Senator Loi Ejercito Estrada. “As this Court has long adverted to only emergency or compelling temporary leaves from imprisonment are allowed to all prisoners at the discretion of the authorities or upon court orders. Philippines Air Lines (PAL) executives, joined by Philippine-based tour operators, recently unfurled a bundle of incentives for US-based travel agencies to market Philippine tourism through the employ of the beefed up fleet of the country’s flag carrier. Allan Q. Coo, PAL regional manager for North America, announced during product update in a Los Angeles suburb last Friday (March 31) that PAL has continue to strengthen flights connections all over the Philippine to serve both the local consumers and prospective travelers. At the heart of Coo’s presentation were 30 local destinations being serviced by PAL. Flights for most of these destinations have been increased. Since March 26, according to Coo, flights from Cebu-Butuan and vice versa have been increased to 14 weekly flights from the previous seven weekly flights. On the same date, the routes Cebu-Clark, Cebu-General Santos, Cebu-Puerto Princesa and Cebu-Surigao earned their daily flights. For those travelling to Bohol, the Manila-Tagbilaran route has been upgraded to 14 weekly flights. There are daily flights from Caticlan to Cebu. Davao, another favorite southern

MANILA, Apr 5 (Mabuhay) – Peace panels of the government and the communists are forging a draft agreement for the release of prisoners of the New People’s Army and the suspension of operations of the Armed Forces of the Philippines (AFP). Both panels have initially made an agreement to push through with the release of NPA prisoners and the suspension of military of operations despite the absence of ceasefire declarations from both sides. Officials of both panels said that the pending agreement is one of the main issues that have been resolved during the first day of the fourth round of talks in The Netherlands. The talks opened on Tuesday, a day delayed from the original schedule due to President Rodrigo Duterte’s conditions before the government agrees to a bilateral ceasefire with the Communist Party of the Philippines-New People’s Army-National Democratic Front. The release of the NPA’s prisoners is one of the four conditions set by Duterte. Labor Secretary Silvestre Bello III, the government’s chief negotiator, said both parties are still discussing the terms that will be included in the draft agreement. He said both sides have come up with their own drafts, which are now subject for consolidation. “Mayroon silang draft, mayroon kaming draft so ‘yun ang pag-uusapan namin, pag-aasawahin namin ‘yun,” Bello said. He said that among the other issues to be discussed by the peace panels are the revolutionary tax collection of the communist rebels, hostile acts, and strength of military forces and the NPA. The communist insurgents earlier expressed its willingness to release its POWs from March 27 to April 6, among them a policeman from Bukidnon and three soldiers from Surigao Del Norte and Sultan Kudarat. The release failed to push through due to the continued offensive operations of the military. Both parties are still discussing the suspension of military operation. “There should be a SOMO at SOPO (Suspension of Offensive Police Operations) on the part of the AFP (Armed Forces of the Philippines) and the PNP (Philippine National Police) respectively so that the safe conduct of the release will be at hand,” Bishop Felixberto Calang, one of the resource persons in the peace talks, said. NDF panel senior adviser Luis Jalandoni, meanwhile, assured that the fourth round of talks is already moving forward. “Moving forward, agreement toward a more stable ceasefire,” Jalandoni said. Both panels also agreed to discuss the Comprehensive Agreement on Socio-Economic Reforms (CASER) before they end the fourth round of peace talks on Thursday.

Stock market rally affirms optimism over PHL economy – Malacañang

MANILA, April 5 (PNA) – Tuesday’s stock market rally which saw shares rising to a fivemonth high affirmed investors’ confidence in the soundness of the macroeconomic goals of the administration of President Rodrigo Duterte, a Malacañang official said Wednesday. “The market affirms the Duterte administration’s short, medium and long-term goals by voting with its feet,” Presidential Spokesperson Ernesto Abella said in a statement. The Palace official noted that “optimism in the Philippine economy is on a five-month high,” capped by a stock market rally that reflected a total volume turnover of PHP 12 billion on Tuesday. The Philippine Stock Exchange index (PSEi) rose 1.42 percent or 104.84 points to close at 7,446.49. It was the PSEi’s best day since October 26 last year when it finished at 7,494.41. All shares also grew by 1.07 percent, or 47.14 points, to 4,460.56. But while Philippine stocks have rallied in the past two days, stocks have fallen elsewhere in Asia -- largely due to anxiety over a possible tense meeting between US President Donald J. Trump and his Chinese counterpart Xi Jinping later this week. MANILA, Apr 4 (Mabuhay) – President Rodrigo Duterte dismissed Ismael Sueno as Interior secretary due to loss of trust and confidence, Malacañang said Tuesday morning. Presidential Spokesperson Ernesto Abella said Duterte announced the sacking of Sueno after the 14th Cabinet meeting Monday. “President Rodrigo Roa Duterte has dismissed Department of Interior and Local Government Secretary, Mr. Ismail Sueno, citing loss of trust and confidence.,” Abella said. Abella said the dismissal is a warning to members of the Cabinet that Duterte will not countenance any questionable or legally untenable decisions that they make. The spokesperson said Sueno’s role in convincing Duterte to run for election did not stop the President from pursuing his drive for a trustworthy government. Duterte removed Sueno from office amid allegations of corruption and that the secretary was enriching himself in office. Sueno has denied allegations of corruption against him. He has reportedly been having a rift with three of his undersecretaries. Sueno reportedly even asked the President

to remove the undersecretaries over “irreconcilable differences.” In a separate interview, Justice Secretary Vitaliano Aguirre II said the Cabinet meeting opened with the topic on allegations against Sueno. “Sa umpisa pa lang po ng Cabinet meeting eh yun ang aming nabuksang topic ng ating? pangulo. Rodrigo Duterte remain high despite a slight dip, two senators said Wednesday noting that this meant Filipinos are still confident of his ability to lead the country. According to the “Ulat ng Bayan” survey released by Pulse Asia Research Inc., the performance rating of Pres. Duterte dropped five points nationally, from 83 percent in December 2016 to 78 percent in March. Pres. Duterte’s trust rating also dropped seven points, from 83 percent last December to 76 percent in March. The survey was conducted from March 15 to 20, 2017. Sen. Sherwin Gatchalian stressed that Pres. Duterte’s ratings remained high even after he has been subjected to international criticism and negative publicity over the past months.

“…Despite all of the attacks launched against him, a commanding super-majority of the Filipino people remain confident in President Duterte’s ability to lead our country,” Gatchalian, an ally of the President, said. “If anything, these results illustrate how deeply the Filipino people trust the President and how much they believe in his vision for the Philippines,” he added. He said that the results do not reflect a “significant” drop in the ratings. Sen. Francis Pangilinan, Liberal Party (LP) acting president, said that it “not unusual” for presidents to experience a dip in ratings. “All Presidents before him also experienced very high trust ratings at the start of their terms and eventually these ratings all dipped so there is really nothing unusual with the five-point drop,” Pangilinan said.

President Duterte has clemency powers to grant conditional or absolute pardon to anyone convicted of a crime. However, I think it would be better for him to wait and let the justice system takes its course before he makes his decision. The idea of giving pardon to the police officers involved in shootings or extra judicial killings (EJK) against drug lords or addicts will only embolden other rogue cops to commit crimes with impunity to advance their nefarious activities on the pretext of performing their duties as peace officers. Take the case of those police officers who kidnapped and later killed a South Korean businessman in Angeles City, in Pampanga, whom they allegedly tagged as a drug lord . I have no objection if ever President Duterte will take up the cudgels for honest cops involved in shoot-outs with drug lords or kidnappers or other criminals, but not rogue cops. In myopinion, granting pardon to the 19 police officers responsible for the death of Mayor Espinosa will

I just don’t know if the CPP, particularly its armed wing New People’s Army (NPA) are willing to give up their weapons to ensure lasting peace in the country. The NPA is believed to have 4,000 fighters all over the country. These armed rebels, branded as bandits by local executives, were responsible for numerous assassinations of policemen and army troopers, murders, kidnappings, as well as collecting “revolutionary taxes” from businesses in areas they have full control. The rebels are still trying to force President Duterte to free and pardon political prisoners languishing in jail. In exchange, they promised to release several policemen and army troopers they have kidnapped or captured during firefights between government forces and the NPA Duterte, on the other hand, want the NPA to stop their extortion and arson activities . He is also asking the rebels to surrender their firearms as a prelude to lasting peace as desired by everybody in the country. Let us wait and see who will blink first or who will give in as far as their respective demands are concerned.

Ejercito, who chairs the Senate committee on the urban planning, housing, and resettlement, has set the probe on April 18. “Regardless of the President’s decision, the Senate probe on Kadamay’s occupation will still push through on April 18,” he said in a statement. “On these particular projects in Bulacan, we want to know those accountable for the neglect of the housing projects and where the funds were funneled,” the senator added. The inquiry, he said, will also tackle issues as to why a number of housing projects by the National Housing Authority (NHA) remain “substandard in quality, unoccupied, and fragmented.” On Tuesday, President Rodrigo Duterte announced that he would just give away to members of Kadamay the housing units they occupied as he promised the police and the military a better housing project by December. While he appreciates the President’s “heart for the poor and homeless,” Ejercito opposed holding any government projects hostage just to justify anyone’s need for shelter. “Resolving housing woes should not be as complicated as this,” he said. “While I appreciate President Duterte’s heart for the poor and homeless, as chair of the Urban Planning, Housing, and Resettlement Committee, this should not be the means for anyone to become a recipient of housing projects.” “I am against any form of a government project being held hostage in order to justify anyone’s need for shelter, unless in times of calamity. We have to do things right,” added Ejercito, who initiated the probe on the issue. And despite the President’s decision, the senator believes that the recipients should still go through the proper process in the turn-over and awarding of the projects. “We want them to comply with the process so that their occupation would not become a precedent for other groups demanding housing from the government,” he said. Ejercito said Kadamay’s occupation of the housing projects should serve as a wake-up call for the government to address the massive housing problem in the country. “By now I believe we are convinced that government housing projects are no longer about structures, but should also cover a comprehensive and strategic plan in addressing other basic needs of beneficiaries such as access to livelihood, transportation, education, and health facilities,” he said. To effectively map this out and to address the housing backlog, the senator urged the creation of a Department on Human Settlements and Urban Development and the passage of the In-City Relocation Bill. Shareholders get nothing. But if the rates are raised higher like what is happening now, I believe they will be targeting a much higher dividend yield to be able to pay off the government loan and its shareholders. Ultimately get privatized. I strongly believe that Fannie and Freddie needs to be back to Main Street ( private firms) less scrutiny and much more flexibility. What I am saying is that when rates do go up slowly it is actually good for the economy, it is good for investors and it will be overall good for everyone. Banks, fund manager, mutual accounts will have to offer you better yields for your parked monies. Although the borrowing rates will be higher it should have the trickledown effect where at the end of the day everyone benefits. In the end, sales will come down to buyer confidence, affordability and mortgage rates. Even if that last one moves higher, rates are still historically low and confidence is gaining steam despite the rising prices. I still feel optimistic about the economy and Real Estate, I think that if you can afford to pay 1/3 of your gross income towards a mortgage payment, you should explore the idea of becoming a home owner. Real estate market have slow down towards year end which is usually the case, so aggressive buyers can take advantage of other serious buyers taking a small break for the holidays. PHL readies 3 priority infra projects for Japanese financing By Leslie D. Venzon

MANILA, March 30 (PNA) -- The Philippine government is seeking Japanese funding of three priority infrastructure projects worth USD 8.82 billion, including the Mega Manila subway line which will run from Taguig City to North Edsa to Ortigas. Socioeconomic Planning Secretary Ernesto Pernia told reporters the feasibility study for the USD 4.3-billion subway project will be completed in September and it is intended for signing when President Rodrigo Duterte meets Japanese Prime Minister Shinzo Abe during the ASEAN Summit here in November. Pernia said construction works for the subway project is expected to begin next year and will be completed in about three years. He said the other two projects lined up for Japanese financing are the USD 2.67-billion commuter line running from Tutuban in Tondo to Los Banos, Laguna; and the USD 1.9-billion speed train from Malolos to Clark, Pampanga. “Except for the subway in Metro Manila, the railways are expected to disperse development away from Metro Manila. There are 11 more (projects) in our list that will follow the (three) flagship projects,” said

Tungpalan said the other 11 infrastructure projects targeted for Japanese funding include those in the transportation sector, irrigation and water supply. ”We would like to get a larger portion of the 1 trillion yen. Several projects are lined up, not just a wish list but a list that we will be working on with the Japanese within the plan period 2017-2022,” he added.

Demi Runas, a young and stunning Filipino-American golfer, was among the 24 talented Ladies Professional Golf Association (LPGA) members who saw action in the 11th Annual Kore Pro-am Golf Tournament at the Journey at Pechanga Resort & Casino on April 2 and 3, 2017. Runas, who lives in Torrance, California, said it was her second time to play at the Journey. The Filipino-American beauty said she finds the Journey as a wonderful place to play golf, adding that the ongoing expansion at the property would make it even more attractive to both amateur and professional players. “It is hard to miss those developments. We can see them from our hotel rooms. It is really amazing what they are trying to do,” Runas added. The 5’6” Filipina-American golfer said that while she could no longer speak Tagalog fluently, she “still understands all of it” because her mother still speaks to her in the language. Runas recently played in a ladies golf tournament at the Alabang Country Club in Muntinlupa, Philippines. She gamely admitted that she did not fare well in the said tournament but added that she enjoyed “every moment of the experience,” especially because her mother came to watch her. “She got to see me play in her home soil, so it was really exciting for us,” Runas narrated. Runas, who tucks a degree on Communications from the University of California-Davis, is currently on her fourth year as a professional golfer. If you have made at least 40 quarters of contribution, you will get Medicare Part A premium-free for life. You will have to decide if you will get Part B. If you are currently under your or your spouse’s employer-sponsored or union-sponsored health plan, compare the premiums. Will it cost you less to get Part B, or continue with your current plan? 2. Part D takes care of your prescription medications. Decide if you want to enroll on a stand-alone plan where you pay monthly premiums or enroll on a Medicare Advantage plan where Part D benefits are embedded. While at the SSA, inquire on EXTRA HELP. This is a government program that reduces the cost of your prescriptions if you qualify. Furthermore, pay attention to the formularies and ensure that the prescription medications you are currently taking are on the list. 3. Consider a Medicare Supplement plan if it is right for you. Remember that Medicare does not pay for everything. You have your share of cost (deductibles, copays, co-insurance). Enrollment on this plan may require underwriting. 4. Dengue cases dip 67.9 % in Caraga BUTUAN CITY, March 29 (PNA) – Dengue fever, the dreaded mosquito-borne disease, has dipped in the region to almost 70 percent according to the recent data released by the Department of Health (DOH) Regional Office 13. The Department of Health Regional Office 13 Epidemiology and Surveillance Unit (RESU), based on its Disease Surveillance Report during the 10th Morbidity Week from the first week to the middle part of this month, gave its dengue fever update trend that a total of 674 cases were admitted to the different disease reporting units region wide from the first week of January to the mid-part of this month. Accordingly, this is 67.9 percent lower than the 2,097 cases in the same period last year. From the first week to the middle part of March of this year, according

to the regional health office, 38 cases came from the different disease reporting units in Caraga Region. Reported cases were mostly coming from Surigao del Sur (16 cases), Agusan del Sur (9 cases), Tandag City (7 cases) and Surigao City (2 cases). There was no barangay identified as hotspot (Morbidity Week 6-7). Clustering of cases was noted in Brgy. Washington (Poblacion), Surigao City and Mabua, Tandag City. DOH lauds JICA assistance for govt drug rehab program MANILA, April 3 (PNA) -- The Department of Health (DOH) on Monday lauded the Japan International Cooperation Agency’s (JICA) 1.85 billion-yen (PHP826-million) support for the department’s drug rehabilitation program. �We are glad that the Government of Japan, as well as many other international partners, has stepped in to help the Philippines in its continuing effort to address (the rehabilitation of) an estimated 1.6 million drug surrenders as of the end of February,� Health Secretary Dr. Paulyn Ubial told reporters during a press briefing held at the DOH media relations unit in Tayuman, Sta. Cruz, Manila. The assistance was sealed in an agreement signed by Ubial and JICA Representative Susumu Ito through the program Consolidated Rehabilitation on Illegal Drug Users (CARE), which is aligned with the government’s priorities against illegal drugs. “As a long-standing friend and development partner of the Philippines, JICA supports the DOH

towards working for a common vision of a drug-free society,� said Ito. Ubial said the assistance will be used to improve the facilities of rehab centers and train DOH health workers involved in drug rehabilitation. The department said that of the 4 million drug users estimated by the Dangerous Drugs Board (DDB), 2.4 million drug surrenderers are waiting to be assessed to determine their drug rehabilitation needs. It said some 12,000 patients are being treated in 44 drug rehab centers across the country, and more are receiving treatment in barangay health centers. Of the 44 drug rehabilitation centers, 14 are run by the government, the newest of which is in Nueva Ecija, which is currently treating 179 patients. JICA is a partner of the DOH. Back in 2013, following the devastation left behind by ‘Yolanda’ (Haiyan), JICA provided assistance for the rehabilitation of health facilities damaged by the supertyphoon in the Visayas.

ILOILO CITY, March 26 (PNA) – A research grant that looks into the viability of honey, particularly those coming from Iloilo, for wound-healing is now being undertaken by the University of San Agustin (USA) research laboratory based in this city with Ilongga scientist Dr. Doralun Dalisay as chief investigator. The study was aimed at increasing the marketability of honey as a pharmaceutical raw material, she said on Monday. “We are looking at the science; the chemistry and biology to validate the claims that honey is a good agent,� she added. After working for three and half-months, they were able to find interesting, promising activities from the Iloilo honey compared with samples taken from other parts of the country. Honey samples were taken from Benguet, Baguio and Laguna in Luzon; Palawan in Visayas and Bukidnon and Davao. A comparison was made to determine which among the honey types was of superior quality. It was also compared with the New Zealand-standard honey called “manuka,� which is very expensive at around Php5,000 per 100 grams, she added. “We have found that honey in the Philippines, particularly the one in Iloilo, has a more anti-microbial activity compared to the rest, that’s the biology. With the chemistry we are still looking into it but there are promising compounds present in the samples,� Dalisay revealed on Monday. After the validation, the plan is to have the honey commercialized as a new product for wound-healing. Maridan Industries a pharmaceutical firm in based in Iloilo and specializing in galenical products, has been tapped as partner for the study.

USCIS creates avenue for US workers to report abuse WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) today announced multiple measures to further deter and detect H-1B visa fraud and abuse. The H-1B visa program should help U.S. companies recruit highly-skilled foreign nationals when there is a shortage of qualified workers in the country. Yet, too many American workers who are as qualified, willing, and deserving to work in these fields have been ignored or unfairly disadvantaged. Protecting American workers by combating fraud in our employment-based immigration programs is a priority for USCIS. Beginning today, USCIS will take a more targeted approach when making site visits across the country to H-1B petitioners and the worksites of H-1B employees. USCIS will focus on: – Cases where USCIS cannot validate the employer’s basic business information through commercially available data; – H-1B-dependent employers (those who have a high ratio of H-1B workers as compared to U.S. workers, as defined by statute); and – Employers petitioning for H-1B workers who work off-site at another company or organization’s location. Targeted site visits will allow USCIS to focus resources where fraud and abuse of the H-1B program may be more likely to occur, and determine whether H-1B dependent employers are evading their obligation to make a good faith effort to recruit U.S. workers. USCIS will continue random and unannounced visits nationwide. These site visits are not meant to target nonimmigrant employees for any kind of criminal or administrative action but rather to identify employers who are abusing the system. Employers who abuse the H-1B visa program negatively affect U.S. workers, decreasing wages and job opportunities as they import more foreign workers. To further deter and detect abuse, USCIS has established an email address which will allow individuals (including both American workers and H-1B workers who suspect they or others may be the victim of H-1B fraud or abuse) to submit tips, alleged violations and other relevant information about potential H-1B fraud or abuse. Advancing Justice-LA joins brief seeking stay of sanctuary city executive order LOS ANGELES - Today, a federal district judge in San Francisco will hold a hearing to consider the County of Santa Clara’s request to block President Donald Trump’s January 25 executive order threatening to defund sanctuary cities. Sanctuary cities include those that enact policies that protect immigrant communities from unwarranted targeting based on race, ethnicity and immigration status. Asian Americans Advancing Justice - Los Angeles (Advancing Justice-LA), together with three of our affiliate organizations, the Southern Poverty Law Center, and over thirty other organizations, signed onto an amicus curiae brief filed in support of Santa Clara’s request. The brief was also filed in support of a similar request brought by the City and County of San Francisco. The briefs argue that attempts to defund sanctuary cities is unconstitutional and could unjustly coerce jurisdictions into expending scarce resources on federal immigration enforcement. Santa Clara and San Francisco are two of a growing number of local governments that have brought legal challenges against the executive order. Just last week, Seattle filed suit alleging that the order was unconstitutional. Two Massachusetts cities have also taken legal action. California is home to 2.6 million undocumented immigrants, 417,000 of which are Asian American. Studies have shown that crime is lower and economies are stronger in sanctuary counties compared to non-sanctuary jurisdictions. Despite

this evidence, the executive branch has offered nothing but baseless, anti-immigrant rhetoric to explain its order. “The executive order itself seeks to entangle local police with immigration enforcement, which will only erode trust in local law enforcement and undermine public safety,” says Christopher Lapinig, Registered Legal Services Attorney at Advancing Justice-LA. “The administration’s actions have already created a palpable sense of fear among community members, discouraging individuals in crisis from going to courts to seek restraining orders against their domestic abusers, attending appointments to continue immigration petitions, seeking medical treatment, or calling the police.” Already, Los Angeles has seen a 25 percent drop in the number of sexual assaults reported by Latinos. Further, in response to concerns about immigration officials making arrests in courthouses, the U.S. Department of Homeland Security said that undocumented individuals may still be subject to arrest, even if they report that they have been a victim or witness to a crime. Advancing Justice-LA is actively working to monitor, resist, and combat the misguided, anti-immigrant actions by the Trump administration. We are working with community organizations, state and local governments, and other stakeholders to protect noncitizens and other vulnerable communities and to advise them of their rights in the face of these xenophobic actions.
