MANILA, April 25 – Two leaders of the House of Representatives on Tuesday criticized the filing of a case against President Rodrigo Duterte before the International Criminal Court (ICC), dismissing it as another attempt to discredit the government. House Appropriations Committee chair and Davao City Rep. Karlo Nograles said the complaint, which was filed by self-confessed hitman Edgar Matobato’s lawyer Jude Sabio, is part of a “ploy” to put the President in a bad light before the international community. Nograles pointed out that the complaint has no “real legal basis” and “bereft of
any hard evidence” for the prosecution of President Duterte over crimes against humanity. “The case filed against the President in the ICC, as most Filipinos know, is the latest step in the destabilization plot against the Duterte administration. Trillanes: Critics of ICC raps ignoring ‘policy of killings’ MANILA, Apr 26 (Mabuhay) – Senator Antonio Trillanes IV on Wednesday slammed President Rodrigo Duterte’s allies for criticizing the complaint filed against the chief executive at the International Criminal Court (ICC). In a statement, Trillanes said Duterte’s allies choose to “ignore the fact that Duterte himself promoted this policy of killings.” Atty. Jude Sabio, lawyer of confessed hitman Edgar Matobato, accused Duterte of crimes against humanity over the alleged killings perpetrated by the so-called Davao
Death Squad and the current administration’s war on drugs. “The Duterte allies are commenting as if they have actually read Atty. Sabio’s information and they presume to know what the ICC would do,” Trillanes said. “They seem to forget that thousands have already been killed and not a single person has been held responsible for these crimes. There are several issues to consider in answering this question. The most important point is the value of your car. In most cases, you can protect your car using the allowable bankruptcy code exemptions. An exemption allows you to file for bankruptcy relief and protect some of your property. The bankruptcy courts understand you need a car to get to work and to pick your kids up from school. So long as you arenâ&#x20AC;&#x2122;t driving an antique classic car, or an expensive sports car you will likely be able to keep your car. The next question is whether you have clear title to your car. If you have pledged your vehicle as security for a debt, or if you are financing or leasing a vehicle, you have three options for secured car loans when you file Chapter 7 bankruptcy. Reaffirm: A reaffirmation agreement is a contract between you and the car creditor in which you agree to pay the balance owed on your car note, despite the bankruptcy filing. You continue to make payments, and the creditor promises that, as long as payments are made, the creditor will not repossess or take back the property. Reaffirmed debts are not discharged, the debt survives the bankruptcy. If you do not make your car payments after you reaffirm the car loan the car lender can repossess the car and sue you for the deficiency balance. After the finance company repossesses the car they will sell the car at the auto auction. Usually the finance company does not get enough money from the auction to pay off your loan. This shortfall is called a â&#x20AC;&#x153;deficiencyâ&#x20AC;? and you would still be legally obligated to pay the creditor the deficiency balance. As you can see, the decision to reaffirm your car loan is a serious financial matter. Reaffirmation agreements are strictly voluntary. You are not required by the Bankruptcy Code or other state or federal law to reaffirm your car loan. Before entering into such an agreement, you will want to speak to your bankruptcy attorney to make sure that the reaffirmation is in your best interest. Redeem: In Chapter 7, you have the right to purchase or redeem your car from the creditor by making a lump sum payment equal to the carâ&#x20AC;&#x2122;s fair market value. The 2005 bankruptcy code provides that you must pay the creditor the replacement retail cost of the car. The balance of the debt will be discharged. For example, assume you own a car worth $5000.00, but owe the finance company $10,000.00. In this circumstance, you could redeem the vehicle by paying the creditor $5000.00 and the remaining balance will be discharged in your bankruptcy. Your bankruptcy attorney can advise you on the benefits of redeeming your financed car and identifying lenders that will provide the funds for your vehicle redemption. Surrender: If you cannot afford the monthly payments on your car loan, or if you determine that you owe more than the car is worth, you can unload the car and the debt in your Chapter 7 bankruptcy by surrendering the vehicle to the creditor. Car Leases in Chap. 7 Bankruptcy If you are leasing your car when you file Chapter 7 bankruptcy you can choose to either continue making the monthly lease payments, or surrender the car back to the creditor.
If you surrender the leased car, any obligation under the lease will be eliminated in your Chapter 7 bankruptcy case. Car Loans in Chap. 13 Bankruptcy Chapter 13 bankruptcy is a powerful tool to protect your car from repossession. If you have fallen behind on your car payments, you can file a Chapter 13 bankruptcy to stop the repossession of your vehicle and repay any delinquent monies due. If you are not delinquent, you have the choice of just continuing your regular payments, or surrender the vehicle, and discharge the balance as an unsecured debt, much te same way as in chapter 7. 910 Claims: If you bought your vehicle less than 910 days of filing your bankruptcy case, you must repay the entire car loan. The good news is that the interest rate you pay on your car loan may be significantly reduced. For example, if you owed $10,000 on a car loan whose blue book value was only $5000, you would be required to pay the entire $10,000 balance if the car was purchased less than 30 months, or 910 days, of filing. In short, debtors who want to keep their cars must pay the full loan amount, rather than â&#x20AC;&#x153;cram downâ&#x20AC;? the debt to the value of the car. Cram Down: If you bought your car more than 910 days before you file bankruptcy, you will only have to repay an amount equal to the present value of the car. For example, if you owed $5000 on a car that is worth only $2500, upon filing Chapter 13 you would be required to repay the finance company only $2500 over the three to five year term of your Chapter 13 Plan. Car Leases in Chap. 13 Bankruptcy You car lease cannot be paid through the Chapter 13 Plan you devise with your bankruptcy attorney. You can â&#x20AC;&#x153;assumeâ&#x20AC;? the lease and continue making the monthly payments. You can â&#x20AC;&#x153;rejectâ&#x20AC;? the lease and return the car to the creditor. The creditor will sell the leased vehicle, apply the sale proceeds to your lease balance and then file a claim in your Chapter 13 bankruptcy case for the lease deficiency. This deficiency is an unsecured, non-priority claim, which means you will likely only pay the finance company pennies on the dollar. Tycoons attend 2nd ‘DuterteNomics’ Forum
MANILA, April 26 – Tycoons of Philippine business led by Jaime Zobel de Ayala of the Ayala Group and Tessie Sy Coson of SM Investments Corp. took part Tuesday night in the second ‘DuterteNomics’ Forum in an apparent show of support for the unprecedented “Build, Build, Build” agenda of the Duterte administration. Besides Zobel and Coson, the event was also attended by Danel and Sandro Aboitiz of Aboitiz Equity Ventures, Edgar Injap Sia II of Double Dragon Properties Corp.; Kevin Tan of Megaworld Corp.; and Michael Tan of the LT Group Inc. Dominguez said that fortunately, the Philippines has “a leader capable of much audacity,” and with the “vision and intense love for country” who will carry out this ambitious, yet necessary agenda that would free Filipinos from the poverty trap that they find themselves in today. “The Philippine economy, with the decisive leadership of Rodrigo Duterte, is now ready for an economic breakout that will increase the pace of growth, intensify inclusion and reduce poverty,” he said on Tuesday at the second “DuterteNomics” Forum in Manila organized by Malacanang. “Fortunately, we have a leader capable of much audacity. We have a leader of vision and intense love of country. All the favorable factors are present. It is time for the breakout,”
he said. Dominguez said President Duterte’s economic strategy includes an infrastructure buildup that will entail trillions of pesos in investments that are necessary to help ensure that the next generation of Filipinos no longer remain “in the same poverty trap we found ourselves in.” Dominguez said this is why the Duterte administration’s reform agenda focuses on accelerating spending on infrastructure and on human capital by upgrading the country’s educational and health care systems, along with its goal to lower income tax rates to sharpen the Philippines’ global competitiveness. “Dutertenomics,” is President Duterte’s economic strategy to dramatically raise funds--in large part through his proposed Comprehensive Tax Reform Program (CTRP)--and spend big on infrastructure, human capital formation and social protection. This strategy will enable the government to sustain the Philippines’ growth momentum, attract investments and create jobs, achieve economic inclusion and transform the Philippines into a high middle-income country by 2022, by which time poverty incidence will have been reduced to 14 percent. If “DuterteNomics” is sustained over the medium term, the government envisions the Philippines to be a high-income economy in one generation or by 2040. Dominguez said the Philippines is also looking forward “to what has been called a ‘demographic sweet spot.’ “As the populations of some of the more mature economies in Asia begin to age, we are looking forward to the entry of millions of young Filipinos into the workforce. We must invest in them and make them globally competitive. We must prepare the economy to provide meaningful jobs for them or else risk building an alienated and discontented generation,” he said at the forum .

Aside from being under-powered, he said the tractors aren’t equipped with attachments needed for these farm vehicles to undertake various work from land preparation to transplanting. “Level of Philippine agmech in 2011 was about 1.23 horsepower/ hectare (hp/ha) only,” he said. He noted such level is lower than Vietnam’s 1.56 hp/ha, Republic of Korea’s 9.38 hp/ha and Japan’s 19.97 hp/ha during the same year. Dr. Alvindia said Philippine agmech must improve since farmers nationwide are aging – averaging around 57 years old. Younger people are increasingly becoming disinterested in farming due to the hard work this requires, however, he noted. The country’s population is increasing so there must be more food production to meet demand, he continued. “We must relieve farmers of farming’s drudgery -- with agmech, we can make agriculture easier,” he said.

MANILA, April 26 – Government aims securing more partnerships on improving agricultural mechanization (agmech) nationwide. “We’re open to partnering with local and foreign entities that can help us achieve such goal for boosting local agricultural production,” said Executive Director Dr. Dionisio Alvindia of Philippine Center for Postharvest Development and Mechanization (PhilMech), the agency tasked with extending and commercializing appropriate and problem-oriented agriculture and fishery post-harvest and mechanization technologies. At a briefing Wednesday, he said such partnerships can help PhilMech better develop capability for locally manufacturing agmech components. Death penalty is dead – Drilon MANILA, Apr 26 (Mabuhay) – Senate Minority Leader Franklin Drilon said the controversial bill restoring death penalty in the country was already dead in the Senate with 13 senators “likely to vote” against it. “By my own estimate, there are at least thirteen senators who will block the passage of the death penalty bill, including the six-member minority group and seven from the majority block,” Drilon said in a statement on Wednesday. “It’s dead and the chances of resurrecting it before we even bring it to a vote are very slim, if not zero, at least in this Congress,” he said. Drilon did not name the 13 senators he was referring to but noted that all six members of the Senate minority bloc, including him, are against the death penalty bill. Aside from Drilon, the five other minority members are Deputy Minority Leader Bam Aquino, Senators Francis “Kiko” Pangilinan, and Leila De Lima, Antonio “Sonny” Trillanes
IV and Risa Hontiveros. Drilon, Aquino, De Lima and Pangilinan all belong to the Liberal party (LP). Drilon said another LP member, Senate President Pro-Tempore Ralph Recto, is also against the controversial measure. We believe that a death penalty law was not and will never be an effective deterrence against crime,” the Minority Leader said. “It will be detrimental to the poor who will be made victims of this cruel and inhumane punishment due to the inefficiencies of our judicial system,” he added. Drilon noted that there are only five senators, who have openly indicated support for the bill through the media led by Senate Majority Leader Vicente “Tito” Sotto III and Senators Manny Pacquiao, Joseph Victor “JV” Ejercito, Win Gatchalian, and Cynthia Villar.
Gov’t ready for Universal Periodic Review of human rights in PHL MANILA, April 25 (PNA) -- The Duterte administration is ready to defend its “comprehensive” approach to human rights in the Philippines as the Periodic Universal Review of human rights records in the Philippines is set to take place next month, a senator said Tuesday. In a Facebook live video, Sen. Alan Peter Cayetano, who was in Malacanang for “official work” said that the cabinet will be meeting to discuss the human rights records in the country. “Ang ating Periodic Universal Review ng human rights records sa Pilipinas ay coming up sa Geneva at ang iban’t ibang ahensya ay nagme-meeting para ipakita kung paano naging very comprehensive ang naging human rights sa ating Pangulo,” Cayetano said via Facebook live. 3 in 5 Filipinos favor death penalty for drug-related crimes -- SWS MANILA, Apr 26 (Mabuhay) -- Three out of five Filipinos favor the reimposition of death penalty for drug-related crimes, according to a latest survey by Social Weather Stations (SWS). The survey, conducted from March 25 to 28, found that 61 percent of respondents “strongly or somewhat approve” of the proposal to revive capital punishment in the country, while 23 percent “somewhat or strongly disapprove.” The latest figures yielded a “good” +38 net approval of the proposed legislation. In March, the House of Representatives voted to pass House Bill 4727 with 217 “yes” votes. Senators are divided on Senate Minority Leader Franklin Drilon on Wednesday said the death penalty bill was “dead” in the Senate

with about 13 senators “likely to vote against it.” The same survey noted that 52 percent of respondents have “either only a little or almost no knowledge” about the death penalty bill, 13 percent have “extensive knowledge” about the proposal, while 35 percent said they had “partial but sufficient knowledge” about it. SWS said the net approval of the death penalty bill was highest in Metro Manila at a “very good” +58, followed by Balance Luzon at a “very good” +39, Mindanao at a “very good” +35, and Visayas at a “moderate” +25. Approval rating was also highest among class ABC respondents at a “very good” +62, followed by class D at a “good” +40, and class E at a “moderate” +21.

The four-day 10th Siargao International Fishing Competition in Pilar town, Surigao del Norte, which kicked off last April 6, was attended by some 75 anglers from across the globe. Contestants and their entourage stayed in homestay houses accredited by the Department of Tourism (DOT) as they have to set sail at the break of dawn. Most of the houses were just a stone’s throw away from San Roque River, the game fishing battlefield. Among the contestants was Siargao sports fishing living legend and homestay patron Marfin Tan who booked in Carmencita Ombos Homestay, the same homestay he availed of since the early stages of the tournament. “Okay ang homestay, makatulong

At the same time, you can find a home and a second family,” Tan said. “You become an adopted son for that matter and build camaraderie with them,” shared the General Santos City native, who bested anglers from 11 countries in the Biggest Giant Tanguige and Giant Dorado category. Norwegian angler Sultan Gyori agreed with Tan sharing that he had stayed in the same homestay for five years now and their host has been kind and helpful from the very start. Tourism Secretary Wanda Teo welcomed the successful hosting of the event noting that she was grateful that foreign visitors chose to experience hospitality in their homestay with host Filipino families. “Foreign and Filipino sport fishers who stayed with accredited homestay units had the tangible experience of our campaign promise that ‘when you’re with Filipinos, you’re with family,” Teo said. “When you’re with Filipinos, you’re with family” is the new tagline attached to the agency’s original “It’s More Fun in the Philippines” slogan.

Drilon hits Arroyo camp for pointing to Aquino on sea row: Blame China instead MANILA, Apr 26 (Mabuhay) – One of former President Benigno Aquino III’s closest allies came to his defense Wednesday after he was blamed by the camp of his predecessor for supposedly “provoking” China into building artificial islands over disputed territories in the South China Sea. At a press conference, Liberal Party (LP) stalwart and Senate Minority Leader Franklin Drilon said the recent statements of lawyer Estelito Mendoza were “misplaced” and have “no basis.” “I would like to think that is misplaced and absolutely has no basis. We should put the blame on China rather than on the Philippines, on President Aquino, for asserting our rights as a sovereign country and asserting our rights under the UNCLOS,” Drilon said. “There is absolutely no basis for laying the blame on former President Aquino,” he added. The United Nations Convention on the Law of the Sea or UNCLOS states that the maritime area of a country is within 200 nautical miles from its baseline. Last week, Mendoza said China’s “island-building factory” was pushed by the case that the Aquino administration filed before the Permanent Court of Arbitration in The Hague. “As it turns out, that turned out to be a very significant event to China. Because China now has stated categorically and explicitly that its island-building factory … was provoked by the arbitral claim in the Philippines,” Mendoza told reporters,
who were invited by former President and incumbent Pampanga Rep. Gloria Macapagal-Arroyo. “So in effect, we were fighting in The Hague—we seemed to be winning in The Hague—but China outflanked us and China made it a point that while we were winning in The Hague, China was winning in the waters of the South China Sea,” he said. Mendoza noted that this is “now going to be the most difficult problem” inherited by President Rodrigo Duterte. Mendoza is a lawyer of Mrs. Arroyo, who is also allied with the Duterte administration. In July last year, the Philippines won its case China in a landmark ruling by the arbitral tribunal that invalidated Beijing’s massive claims in the South China Sea, parts of which Manila refers to as the West Philippine Sea. MANILA, April 26 (PNA) – The Philippines and other member countries of the ASEAN Plus Three Emergency Rice Reserve (APTERR) may now buy rice from the reserve in case of emergency and natural calamities. National Food Authority (NFA) Administrator Jason Laureano Y. Aquino, who headed the Philippine delegation to the APTERR meeting recently held in Bangkok, Thailand reported that an agreement was reached to implement the Tier 1 program which will allow sales of rice between member countries of APTERR from the earmarked rice reserve during emergencies and calamities. APTERR was launched in July 2012 composed of the ten ASEAN nations namely Philippines, Thailand, Myanmar, Vietnam, Indonesia, Malaysia, Singapore, Cambodia,
Brunei, Laos, plus three non ASEAN members namely Japan, China, and South Korea. Originally established as ASEAN Emergency Rice Reserve (AERR) in 1979, APTERR was organized to ensure rice availability during emergencies, stabilize the price of rice, and improve farmers’ income and welfare among the member countries. It aims to improve food security without distorting the international rice market. At present, the total earmarked emergency rice reserve pledged by APTERR member countries is placed at 787,000 MT. The stocks are made available to member countries through a three-tier system: Tier 1 -- through sales; Tier 2 -- through emergency grants and loans; and Tier 3 -- delivery of donated rice in times of acute emergency.

Returning to the US after months of being outside
Question: I have been outside the U.S. for 8 months and have friends who went back to the U.SA. and were forced to give up their Green Card and then enter on a B2 Visitor Visa. Will that happen to me? Answer: If there is an absence of intent to permanently reside in U.S. coupled with objective circumstances, lawful permanent residents (LPRs) can lose their status even if they visit the U.S. often. An LPR may have multiple residences, but U.S. residence must be the permanent one. In other words, LPR status may be lost if abandoned. Possession of reentry permit does not prevent DHS from inquiring as to whether the holder abandoned his residency; it simply prevents the DHS from relying solely on the duration of the absence as a basis to determine abandonment. Further, a reentry permit does not bar DHS from refusing admission to the holder and placing him in removal proceedings. Question: This sounds scary. What do I do? Answer: First of all, while it is possible to lose your residency, you cannot be forced to sign the paper giving up your right to be a lawful permanent resident. Thus, the first item you want to do is to NOT SIGN ANYTHING. It is your right to not sign and they cannot force you to sign. Additionally, DHS (the officer at the port of entry) cannot force you to take a B2 Visitor Visa instead. You must request to see an Immigration Judge. This will make is so that you will be placed into proceedings to see the Immigration Judge to argue whether or not your residency has been abandoned or not. Question: How can I protect myself? Answer: First, if you will be gone for a while from the U.S., you must keep your assets in the U.S. Keep a lease if you can. Pay U.S. taxes. Hold furniture in the U.S. Keep the bank account, etc. Question: Is there a maximum time that I cannot come back with my Green Card? Answer: Yes. It will allow you en-
try to the U.S. up to 354 days after you have left. Thus, do not leave more than 1 year at a time. Question: Is all lost if I’m gone more than 1 year? Answer: No. You will be able to file an Application at the Consulate to show you did not abandon your residency in the U.S. and to explain the reasons for the lengthy departure (i.e., taking care of your sick mother, testifying in some case, working on estate matters, etc.) and if granted, you will be able to get paroled into the U.S. Question: What is the burden of proof? Meaning how much do I have to prove to win? Answer: Once a colorable claim to LPR status is made, the burden is on DHS to prove abandonment by clear, unequivocal and convincing evidence. Thus, you must just show a reasonable claim that you did not abandon your residency and then DHS has a much higher burden of showing in fact you did abandon your residency. In fact, clear, unequivocal and convincing is an extremely high burden for them to meet. This makes winning on your part easier. Brian D. Judge blocks part of U.S. president’s order on sanctuary cities SAN FRANCISCO, April 26 -- A federal judge Tuesday ruled that U.S. President Donald Trump can not coerce “sanctuary cities” to cooperate with immigration officers by withdrawing federal funds. The temporary ruling by Judge William Orrick, of the U.S. District Court for the Northern District of California, followed a 70-minute hearing on April 14 over San Francisco and Santa Clara County’s lawsuit over the executive order signed by Trump on Jan. 25. The executive order, issued five days after the president took office, directed the attorney general and homeland security secretary to make sure that sanctuary jurisdictions “are not eligible to receive federal grants, except as deemed necessary for law enforcement purposes.” The lawsuit on Feb. 3 in the federal court requested for an injunction to halt the enforcement of the order. “We’re fighting for the United States Constitution and we succeeded after the Trump Administration tried to do an end run around it,” Santa Clara County Supervisor Cindy Chavez said in a statement after the judge’s ruling. “The court’s decision is a win for the neediest people in our nation. Seniors in need of food, foster youth in need of shelter and children who need medical care. We’ll continue being a welcoming, safe and diverse community.” (Xinhua)
Record immigration draws criticism from New Zealand lawmakers
WELLINGTON, April 26 – Migrants continue to come to New Zealand at a record rate in the year to the end of March, stoking calls that the country was unable to cope with the number of arrivals. Migrant arrivals numbered 129,500 in the year to March 31, setting a new annual record, said the government statistics agency Wednesday. Migrant departures were 57,600 in the 12 months to March, leading to a record annual net gain in migration of 71,900, which surpassed the previous annual record net gain of 71,300 migrants in the year to February 28, according to Statistics New Zealand.
Annual net migration has been steadily increasing since 2012. “This was mainly due to the rising number of migrant arrivals to New Zealand,” population statistics senior manager Peter Dolan said in a statement. “Fewer migrant departures also contributed to the increase in net migration.” Almost three-quarters of all migrant arrivals in the past five years were citizens from other countries, led by Britain and India, which each accounted for 10 percent, and China, which accounted for 9 percent. The remaining 26 percent of all migrant arrivals in the last five years were New Zealand citizens.

Becca Godinez set to debut at Catalina Jazz Club (Los Angeles, April 2017) – Becca Godinez – actress, singer/songwriter, producer/director – makes a much anticipated return to the concert stage with “Me, Myself & Music” on Saturday, May 20 in Hollywood. How Courts determine Child Custody in California One of the most emotional aspect of a marital dissolution case is dealing with Child custody issues. Sadly enough, this is an area where most parents play games with each other trying their best to deprive the other parents of their right to maintain relationship with their child. Child custody comes in two parts, 1) physical custody and 2) legal custody. Physical custody may be awarded solely to one parent or jointly. Sole physical custody means that the child will reside primarily and under the supervision of one parent subject to visitation from the other parent upon order of the court. Family Code §3007. Joint physical custody on the other hand means that the child gets to spend frequent and continuing contact with both parents. Family Code §3004. The court would state
specifically the periods of time the child will be under the supervision of each parent. Legal custody on the other hand deals with the right and responsibility of a parent to make decisions regarding the health, education, and welfare of the child. Family Code §3006. Examples would be decisions such as where the child shall attend school, whether the child can travel to another jurisdiction or state, legal decisions involving the child. In cases where joint legal custody is ordered by the court, either parent alone can make decisions concerning the health, education, and welfare of the child unless otherwise specified in the order. In making its determination on child custody issues, the court considers various factors depending on the specific facts of the case. The court usually follows the public policy of ensuring and encouraging the childâ&#x20AC;&#x2122;s frequent and continuing contact with both parents after the divorce unless it would not be in the best interest of the child. Fam. Code §3011. If the court is inclined to order sole custody to one parent, the consideration boils down to which parent is more likely to allow the child frequent and continuing contact with the noncustodial parent. Family Code §3040(a)(1). A major factor that would tilt the courts decision are incidents or history of child abuse and domestic violence. This can be from the part of a parent,
a parentâ&#x20AC;&#x2122;s co-habitant, or other person to whom a parent has a relationship with. The childs amount and nature of contact with the parents is also another factor considered. Fam. Code §3011(c). Other factors that can be considered are the parentâ&#x20AC;&#x2122;s use of controlled substance, prior criminal convictions and registration as a sex offender, and existence of restraining order against a parent. The family code requires that the parties go to mediation and attempt to agree on the custody issue prior to the court hearing the contested case. Family Code §3170(a). If the case is not settled in mediation, it gets decided in court through a contested hearing. At times, the court will order a child custody evaluation if it determines that it would be in the best interest of the child. The court may also appoint a minorâ&#x20AC;&#x2122;s counsel if it feels it would be in the best interest of the child. Family Code §3150(a). The court retains continuous jurisdiction over issues of child custody and support until the child reaches 18. This means the order may be modified all throughout this period if there has been a change in circumstances. Please note that this article is not

Here are 4 ways to get out of debt
Are you seriously in debt and don’t know what to do about your situation? Are you afraid that unless you do something about it, thing will just continue to get worse every day? When people are going through financial difficulty and are unable to pay their bills, their first reaction is often to ignore their debts and avoid contact with creditors. They think that by doing this, somehow the creditors will simply give up and go away. Then one day the problem blows up in their face. They either get served a wage garnishment at work or they find out that their bank account has been frozen by a judgment creditor that they have ignored. I see this happen all the time. That’s when they rush to see a bankruptcy attorney to find out what can be done to protect themselves. This is when they realize that they should have done something about their debt problems sooner in order to avoid the unpleasant consequences of their inaction. Most states have a statute of limitations- this is the period of time in which a creditor must file a lawsuit in order to collect on an unpaid debt. In California, that is generally 4 years from the time you stopped paying. A debt can go unpaid for years and you may not hear anything about the debt at all. Well, don’t hold your breath. When the collection accounts gets close to the 4-year mark for the creditor to file suit, that’s when you often get served a lawsuit before the statute runs out. If a creditor does sue you and obtains a judgment, the judgment is good for 10 years in California and can be renewed thereafter. That’s a pretty long time for a creditor to be chasing you and your assets, if you have any. If you
own a home and a judgment lien is filed against it, the debt becomes a secured debt and it must be paid in full plus accrued interest when you sell your property someday. Filing a bankruptcy doesn’t automatically remove a lien but under certain circumstances, there is a procedure by which it can be removed. This will depend on the value of your home, outstanding loans on the property and your homestead exemption amount. Your homestead exemption is the amount of the equity in the property deemed protected by law if the house is your primary residence. An attorney can explain to you how this works. OK, so before any of the above happens, what are the ways to get out of debt before things take a turn for the worse? The key to your success is to be pro-active instead of being reactive. In other words, take action now instead of waiting until something bad happens. There basically only 4 ways to get out of debt if you’re on the verge of insolvency: (1) increase income so you can start paying larger amounts on your debts to hopefully avoid filing bankruptcy, (2) reduce expenses so that you can increase your disposable income and have more money available for debt repayment, (3) Convert assets you don’t need into cash and use the money to negotiate with creditors, and (4) File bankruptcy to wipe out debts or consolidate your bills
(This requires filing either a Chapter 7 or a Chapter 13). MANILA, April 26 -- Aside from Abu Sayyaf Group (ASG) leader Radullan Sahiron, there are other lawless personalities in Sulu who have expressed willingness to surface and surrender to authorities. This was bared Tuesday by Armed Forces of the Philippines (AFP) chiefof-staff Gen. Eduardo Año who said that “feelers” were actually sent by the bandit leader. “According to (Western Mindanao Command head) Lt. Gen. Carlito Galvez and Joint Task Force Sulu commander Brig. Gen. Cirilito Sobejana, there are some personalities in Sulu who are reaching out and saying that Sahiron is wanting to surrender because of health reasons but as of now, there are still no talks (on the actual surrender of the ASG chief), only ‘feelers’,” he added in Filipino. Aside from the ASG chief, Año believes there are still a lot of lawless elements and ASG members in Sulu interested in giving themselves to authorities, adding that this opportunity only needs to reach the right people.
“We believe there are also many others who may just want (to surrender), (we only need to reach the right people), As you know, there are lot of ASG surrendering in Tawi-Tawi, Sulu and Basilan. They are seeing now that their fight against the government is useless, the long arm of the law eventually catch up with you,” he added. The AFP chief also disclosed that now is the proper time for ASG members, tiring of the fight, to surrender as the military will not stop its campaign against them until they are all eradicated. Sabio said that with the case filed, the Office of the Prosecutor is set to determine whether the case is within the jurisdiction of the ICC and if it is proper to file criminal charges against the accused, before investigating the case and issuing Warrant of Arrest against them. Clients seek Chapter 7 and Chapter 20 bankruptcy relief First client is 45 and single. His gross income last year was $98K, which is good. It reached $98K because of bonus. Without bonus, his gross income is $72K. This year started out for him with nothing to expect by way of bonus. So his last four months gross income was $6K a month, net of $4,500. His rent is $1500. He lives by himself but claims his 70-year old dad as his dependent. For a household of 2, his gross income is $10K of $72K is $10K over the median income of $62K for California. This fact complicates the means test analysis because a presumption of abuse may arise if there are insufficient IRS allowable deductions. So, this is what I call a borderline Chapter 7 case. It can be filed as a Chapter 7 case assuming client has enough allowable deductions so that the presumption of abuse does not arise, but if the trustee objects to the reasonableness of deductions taken, then a conversion to Chapter 13 is required. Of course, client prefers a Chapter 7 discharge where he pays nothing to creditors. On the other hand, Chapter 13 would require a partial payment of debt at least. Client has $60K of credit card and payday loans. Of that amount, $50K is credit card debt and $10K is payday loans. These are both high-interest debt but payday loan interests are sky-high. Once you start using payday loans, you know youâ&#x20AC;&#x2122;re in a deep hole that you cannot get out of. So itâ&#x20AC;&#x2122;s really time to get rid of these debts. Itâ&#x20AC;&#x2122;s time to get a fresh start in life without accumulated debt. This is a no brainer. Client pays $2000 a month for minimum monthly interest payments on his unsecured debt from his net income of $4,500. Thatâ&#x20AC;&#x2122;s almost half his net income every month! No one should be under the yoke of so much debt. Wise up and get rid of these debts now and be productive again. Even Walt Disney filed for Chapter 7 twice before Mickey and Disneyland became successful. Now his business is multibillion and worldwide. Shanghai Disney just opened and its so successful that they are expanding the park. Thereâ&#x20AC;&#x2122;s Hong Kong Disney and one in Japan too. Before all of this success, Mr. Disney had to file for bankruptcy twice. His second fresh start from Chapter 7 led to business success beyond imagination! Milton Hershey also filed for Chapter 7 once before Hershey chocolate products became successful. Now, his business is probably the biggest chocolate business in the world. Iâ&#x20AC;&#x2122;m sure you must have brought your family to Disneyland and you must have bought Hershey chocolate products for yourself and children at some time in your life. These businesses were borne from successful fresh starts after Chapter 7 bankruptcy! President Trumpâ&#x20AC;&#x2122;s businesses filed for bankruptcy 4 times during the nineties. He nuked his business debts with reorganization under bankruptcy law. Argentina filed for sovereign bankruptcy in 2000. It could not pay back even the interest on its loans and bondholders were left holding the bag. Greece is has been under bankruptcy reorganization for the last 3 years. I was in Athens last year and I could feel the depression of the people there. The city has no vitality because it has too much debt; same thing happening to debtors with too much debt. They have no vitality
because their income goes mostly to debt service. They are debt slaves who practically work for nothing because they have lost the ability to save money and cannot be productive. If you are a debt slaves, get rid of your debt ball and chain now with a Chapter 7 discharge. Who knows, you might become the next Walt Disney, Milton Hershey or Donald Trump. Pick your choice of who you want to be. You can become the next billionaire or the next president of the USA with your fresh start. Second client is 58. His is going through a divorce. Wife filed for divorce after 10 years of marriage, and now asks for alimony or spousal support. Why 10 years, you might wonder. Well, in California, after 10 years of marriage, if you make less than your spouse, you are legally entitled to ask for spousal support. So, you see a lot of divorces filed by the spouse making the lesser income once the 10-year qualification has been reached. Your spouse is not as dumb as you think. Or, you may not be as smart as you think. In this case, client makes about $100K a year in his profession, while his younger wife makes $20K a year. This means that wife can and surely will ask for $1600 spousal support. Now, where did all the love go to? It all went to alimony. So think twice and thrice before you make the big jump. If you do make the jump, make sure your clock yourself and if you are the higher income spouse, if you think you made a mistake, better end the marriage before you reach your 10 year mark. Otherwise, you will be on the hook for alimony. Client had a previous Chapter 7 discharge in 2012. He now owes $50K of credit card debt. I guess he used these cards to pay for travelling the globe with his younger wife. Wife is 10 years younger. Whatever the reasons are, his situation now is he only has one amount of $1600. He can use this to pay alimony or pay the minimum on $50K of credit cards. Either way, itâ&#x20AC;&#x2122;s not a pretty sight because instead of saving $1600 a month, heâ&#x20AC;&#x2122;s paying that out to a person who no longer is his wife. Between paying alimony and credit cards, the choice is clear. He has to pay alimony. Client is however fortunate that the current value of his house does not exceed the balance of his first mortgage. This means that Chapter 13 will allow him to strip the 2nd mortgage of $76K. The $76K was discharge in his 2012 Chapter 7, but the mortgage lien survived. Although creditor cannot legally collect on the note because it is discharged, the fact that the mortgage survived the discharge leaves creditor with the legal remedy of foreclosure, which it will not do because foreclosure will yield zero for payment of the 2nd mortgage. Chapter 13 now plus Chapter 7 in 2012, makes this case a Chapter 20. This works only in Riverside. Fortunately for client, he lives in Riverside. So he loses his wife and has to pay alimony of $1600 but he gets to strip his 2nd mortgage and make
a partial payment on his $50K credit cards over 60 months. As the 2nd mortgage is stripped, client doesnâ&#x20AC;&#x2122;t have to pay the mortgage because the note has been discharged in Chapter 7 previously. Bicol police chief orders probe on 121 shooting cases in 4 months By Jorge Hallare
LEGAZPI CITY, April 26 (PNA) â&#x20AC;&#x201C; The head of the Police Regional Office in Bicol (PRO5) on Wednesday ordered the Regional Investigation Division or R7 to investigate the cases of shooting incidents in the Bicol region, that to date have reached 121 from January to April this year, said an official of PRO5. â&#x20AC;&#x153;Chief Supt. Melvin Ramon Buenafe, director of PRO 5, has ordered the Regional Investigation Division or R7 headed by Sr. Supt.Ronald Briones to investigate the 121 shooting incidents recorded in the region from January 1 to April 26,â&#x20AC;? according to Sr. Insp. Ma. Luisa Calubaquib, PRO5 spokesperson. She said part of the investigation would find out if the incidents were drug-related or if loose firearms were used. Of the 121 cases, 108 involved male victims while 13 were female, according to Calubaquib. â&#x20AC;&#x153;There were 71 killed, 38 wounded while 12 others were unharmed in the shooting incidents,â&#x20AC;? she added. Calubaquib said Masbate province topped the list with 43 cases, followed by Albay-28, Camarines Sur-22, Sorsogon-15, Camarines Norte-10, Naga City Police Office-2 and Catanduanes-1. She said probers are also looking into those hours when when the shooting incidents occurred.

The driver was hired by the suspected ASG members to ferry them to buy PHP400 worth of bread. The driver, whose name was not disclosed for his own safety,
reported directly to the police after he brought the suspected ASG members to the hinterlands of Clarin, Bohol. Government troops quickly responded and the skirmishes that followed resulted in the death of Joselito Milloria, an Inabanga, Bohol native who had joined the ASG and the other bandits. TaliĂąo said drivers of motorcycles-for-hire were familiar with the residents of the area where they operate.They are also the ones most likely to spot new faces in the area. NY Times editorial: ICC must promptly open preliminary probe into killings MANILA, Apr 26 (Mabuhay) – President Rodrigo Duterte, criticized for his deadly was on drugs, is “a man who must be stopped,” a New York Times editorial said. In its editorial titled “Let the World Condemn Duterte” on Wednesday (Tuesday in the US), the publication urged the International Criminal Court to immediately start preliminary investigation based on the complaint filed by lawyer Jude Sabio. “A Filipino lawyer formally asked the International Criminal Court on Monday to charge President Rodrigo Duterte and 11 officials with mass murder and crimes against humanity over the extrajudicial killings of thousands of people in the Philippines over the past three decades. The I.C.C. should promptly open a preliminary investigation into the killings,” the editorial said. It said that the ICC “might be reluctant to go after” Duterte, who was elected into the presidency by 16 million Filipinos, because he of his popularity among Filipinos. The editorial said that the ICC was created to prosecute cases of genocide, crimes against humanity and war crimes only when its member country’s courts refuse to do so. “Those conditions might be met if the Philippines House of Representatives, dominated by Mr. Duterte’s allies, quashes, as expected, an impeachment motion filed by an opposition lawyer,” it said. Duterte’s top allies in Congress, including Speaker Pantaleon Alvarez and Senate President Aquilino Pimentel Jr., had said that the impeachment complaint filed by Magdalo party-list Rep. Gary Alejano is “doomed to fail.” The impeachment will be tackled by the House of Representatives when it resumes from the Lenten break next month. Even without the junking of the impeachment, the editorial said “there is already enough evidence” that may prompt the ICC to start its preliminary investigation. Aside from the findings cited by Sabio in his complaint, which alleges that 9,400 people have been killed in the ongoing war on drugs and the alleged operation of the Davao Death Squad, the New York Times editorial also cited the findings of the Human Rights Watch, Amnesty International and statements of confessed Davao Death Squad members Edgar Matobato and Arturo Lascañas. The editorial added that if these findings and the statement of Matobato and Lascañas are not enough, it reminded the ICC of Duterte’s statement, “Hitler massacred three million Jews. Now, there is three million drug addicts. I’d be happy to slaughter them.” The editorial said the immediately conduct of a preliminary investigation on the complaint filed by Sabio will “send an unmistakable signal to Mr. Duterte that he may eventually have to answer for his crimes, and would encourage governments to take measures against him, such as imposing tariffs on Philippine goods.” Other top officials of the government, including senators, are included as respondents in the ICC complaint. Malacañang on Tuesday said it would be “deeply disappointing” if the ICC would entertain the complaint based on the statements of confessed killers. (MNS)

Calida: Case vs Duterte in ICC baseless
MANILA, April 25 – Solicitor General Jose C. Calida, the government’s top lawyer on Tuesday said that there is no need for the International Criminal Court (ICC) to probe on the complaint filed by Jude Jose Sabio, the lawyer of self-confessed hitman Edgar Matobato against President Rodrigo Duterte and 11 senior government officials. Calida said the suit was baseless and should be dismissed by the ICC for lack of jurisdiction. On Monday, Sabio filed a complaint before the ICC in The Hague, Netherlands, accusing President Rodrigo Duterte and 11 other government officials of crimes against humanity. “At this stage, based on the communication, the ICC has no jurisdiction to take cognizance of the case,” the solicitor general said. “The case will not progress beyond the filing of the communication as it is utterly bereft of merit,” Calida said in a statement. Sabio filed a criminal case for crimes against humanity noting that President Duterte allegedly violated the Articles of the Rome Statute through commission of mass murder or extrajudicial executions during his term as Davao City mayor and now President of the Philippines through his aggressive campaign against illegal drugs. Reports showed thousands of drug suspects in Davao City and nationwide have been killed in the administration’s drug campaign. “There is no State policy, express or implied, directing an attack against any civilian population or the sanctioning of extrajudicial killings on drug-related cases. This basically removes this case from the purview of crimes against humanity under Article 7 of the Rome Statute,” Calida explained. The solicitor general said that the important element of mens rea to commit crimes against humanity does not exist in this case. “To satisfy the requisite element of mens rea in these crimes, an accused must be aware that his acts are part of a widespread or systematic attack on a civilian population and that these acts are pursuant to some kind of policy or plan,” the solicitor general said. According to Calida, President Duterte has openly condemned the killing of innocent
civilians in the pursuit of legitimate law enforcement operations. “The apparent image of widespread and systematic extrajudicial killings is belied by the concrete actions initiated by the President and the sanctions imposed against erring law enforcers,” Calida said. Calida also said that the case must meet the gravity threshold set forth in the Rome Statute to justify further action by the ICC. According to Calida, the ICC normally considers the scale, nature, manner of commission of the crimes, and their impact in determining whether a case meets the gravity threshold. “As to the element of the manner of commission, since there is no State-sponsored plan or policy, the situation does not fall within the scope of the ICC’s mandate,” Calida explained. “It must be stressed that the ICC does not replace the national courts of a particular country,” Calida said. “The principle of complementarity underpins the creation of the ICC. The ICC may only exercise jurisdiction where national legal systems fail to do so,” he noted According to Calida, there are adequate laws and remedies available in the Philippines to address the issue of alleged extrajudicial killings. “Early this year, a survivor and relatives of alleged drug suspects killed in anti-illegal drugs operations in Quezon City were able to obtain a Writ of Amparo from the Supreme Court against the Philippine National Police,” Calida said. On 31 January 2017, the Supreme Court, upon petition by Efren C. Morillo and the relatives of victims allegedly killed during “Oplan Tokhang” operations in Barangay Payatas, Quezon City, issued a Writ of Amparo directing the PNP to produce and permit the inspection and copying of intelligence and surveillance reports, police blotters, coordination, video, and all other official and unofficial documents and materials pertaining to the police operations conducted against the aggrieved parties. The Supreme Court also issued a Temporary Protection Order (TPO) prohibiting the respondent police officers from entering within a radius of one kilometer from the residences and work addresses of the petitioners.

The forum dubbed as “Pioneer Cordillera Champions Coming Together” held at Mount Data Hotel in Bauko, Mountain Province was attended by 200 participants including representatives of various Cordillera rebel factions and other groups. Aside from CPLA, other attendees were Cordillera Bodong Association (CPLA-CBA), Cordillera Peoples Alliance (CPA), Cordillera Broad Coalition (CBC), Cordillera Regional Consultative Commission (CRCC), and North Luzon Coalition for Good Governance (NLCGG), civil society, local government units and national government agencies. It was organized by the Cordillera Regional Development Council and NEDA-CAR in partnership with the Office of the Presidential Adviser on the Peace Process as a venue for continuing dialogue with Cordillera peace stakeholders. The Cordillera groups together with the local chief executives and representatives

In the same event, OPAPP Undersecretary for Peace Accords Nabil Tan, who was part of the initial efforts in the establishment of the Autonomous Region on the Muslim Mindanao (ARMM), shared the initial challenges of transformation into an autonomous region. He advised that the CAR people should understand and support the movement for autonomy prior to the conduct of a plebiscite. Baguio City Mayor and CAR Regional Development Council (RDC) Chair Mauricio Domogan said that the new proposed bill reiterates the Cordillera people’s united stand for genuine regional autonomy. “We had been totally neglected by the national government for a long period of time and so it is time to support and pass the bill,” said Mayor Domogan. Was it Marcos or Robredo? After more than one year of waiting, the Supreme Court (SC) will finally tackle the election protest of defeated vice presidential candidate and former Senator Ferdinand “Bongbong” Marcos Jr. The case is expected to move faster after the High Court granted Marcos Jr’s motion to set a preliminary conference on June 21 to set in motion hearings on his electoral protest. The Supreme Court can set the date for the start of the audit recounts of votes once Marcos Jr and Vice President Leni Robredo have submitted to the SC, acting as Presidential Electoral Tribunal (PET), their respective preliminary conference briefs. However, for the recount to proceed, both parties are required under PET rules to present at most three provinces “best exemplifying the fraud or irregularities as alleged by the complainant. Once irregularities are found in the three provinces submitted by Marcos, then the audit recount will proceed in all the questioned polling precincts in. However, if there are no fraud or irregularities found, the protest will be dismissed outright without further consideration to the other areas cited in the protest. Marcos Jr is questioning over 39,221 clustered precincts which is composed of 132, 446 established precincts. Robredo’s counter protest involves 8, 042 clustered precincts consisting of 31,278 established precincts.
The SC’s decision to grant Marcos Jr’s motion to set a preliminary conference is good news not only to the camp of Marcos Jr but as well as to millions of Filipino voters who trooped to the polling precincts last year to elect the person they deemed best to serve them as their Vice President. This means that the electoral protest of Marcos will finally move, despite Robredo’s best effort to delay the case. However, the people will have to wait for a couple of months to find out who indeed really won in the hotly contested vice presidential race last year. The election protest will cost Marcos Jr about P88 million. He already paid a downpayment of P36 million as required by the Supreme Court. Robredo, on the other hand, was required by the Tribunal to pay P15 million in her counter protest. She is being required by the High Court to pay P8 million as downpayment for the service charge on the case. As of this writing, Robredo has not come up with the P8 million, claiming that she does not have the amount of

The SC has given Robredo five days or until April 30 to comply or her counter protest will be dismissed. *** I do not understand why Vice President Robredo is so paranoid and skeptical on the prospect of a vote recount to be done by the PET to determine who legally won in the VP race during the national elections last year. If she believes of what she has been saying from time to time during interviews by news media outlet sympathetic to her and to the “yellow party’” that she won “fair and square” against Marcos Jr, then there is no reason for her to be worried about a recount. Robredo defeated Marcos by a little more than 200,000 votes based on the tabulation of votes conducted by the controversial Smartmatic. If she continues to make dilatory tactics to delay further the electoral protest case, then people will likely tend to believe in the rumors that she is indeed a beneficiary of the “dagdag bawas” scheme adopted by the Liberal Party (LP) of former President Noynoy Aquino. Her claim of not having an P8 million for her downpayment is questionable. I’m sure she and her battery of lawyers are using this as an excuse to delay the case and prolong her stay in office. If I were Robredo, I will welcome any audit or recount of votes cast on her favor to remove any doubt as to the legitimacy of her winning the VP race. Robredo needs a total makeover on her political image. She should make full use of her woman’s charm to endear herself not only to the people but as well as to President Duterte. Problem with Robredo now is she
is self destructing herself. She has become her worst enemy. Robredo should learn to control her temper and tone down her statements against Duterte who, up to this time, remain popular and loved by millions of Filipinos. I think Robredo is just being used by the LP in a bid to oust Duterte, similar to what they did to President Erap Estrada. If I were Robredo, I will be very wary about this scheme hatched b y the LP. Look what happened to Senator Leila De Lima and former Senator Teofisto Guingona III. Both were abandoned and left on their own after the LP members have no more use for them. As of now, I think Robredo has no other alternative but to agree for a recount of votes to preserve the integrity of the election process. This, I think, is the best way for Robredo to tell everyone, in the event that she wins in the recount, “I told you so. I won fair and square.” However, if Marcos Jr wins in the recount, then there could indeed be some semblance of truth to the rumors that Smartmatic rigged the outcome of the elections and colluded with Comelec Chairman Andres Bautista and some of his officials to favor Robredo in the counting of votes. There has also been numerous documentation presented by the camp oif Marcos Jr on the alleged cheating so in the 2016 elections, particularly the way Smartmatic manipulated the vote count, with the alleged connivance of Comelec in committing the fraud. No wonder, Robredo and LP leaders are worried that if there were cases of fraud and irregularities they could be uncovered. Let us wait and see.

PHL coffee recognized at Global Coffee Expo WASHINGTON, D.C. – Philippine Department of Agriculture Undersecretary for High Value Commercial Crops Development Evelyn Laviña led the Philippine delegation to the Global Specialty Coffee Expo hosted by the Specialty Coffee Association of America in Seattle, Washington on 20-23 April 2017. For the first time in Philippine Coffee History, Philippine coffee varieties from different production areas were cupped and graded by certified Q graders from across the globe following the cupping protocol of the Specialty Coffee Association of America. These included the winning Robusta and Arabica coffee varieties in the recently concluded Kape Pilipino Coffee Competition held in Cavite State University, Philippines. The said winning varieties were produced by two members of the Philippine delegation, namely, Imelda Mendoza of Kape Maramag Association and Bai Adelina Tarino of Inhandig Tribal Multi-Purpose Cooperative, both coffee farmers from Bukidnon. Through the joint efforts of the Philippine Coffee Board and the Agricultural Cooperative Development International and Volunteers in Overseas Cooperative Assistance (ACDI/VOCA), and in cooperation with the Department of Agriculture and the Department of Trade and Industry, Philippine coffee farmers are now being prepared to compete with the world market. “This ‘cupping’ at the Global Cof-
fee Expo in Seattle, Washington is a prelude to making the world know of Philippine coffee,” said Undersecretary Laviña. Cupping is important for coffee farmers to know the value of their coffee produce and for them to know the right price for their coffee. The Coffee Quality Institute also showcased Philippine coffee in its booth and recognized the Bukidnon-based coffee farmers during its 19th Annual luncheon held on 23 April 2017. After the Coffee Expo, the Philippine delegation will participate in the “Port-to-Cup Coffee Tour” supported and organized by Atlas Coffee and the Coffee Quality Institute, to visit facilities in Seattle, Washington and Portland, Oregon. Activists want to stop oil refinery expansion in Carson By Abner Galino
A broad coalition of local organizations, forming part of a nationwide movement against environmental racism, will launch a so-called People’s Climate March this Saturday (April 29) at Banning Park in Wilmington at 11 a.m. As a particular issue for local activists, the mass action will demand the elimination of a proposed expansion of the nearby Tesoro Oil Refinery in Carson. The Tesoro Corporation is reportedly planning to transform its facility into the largest petroleum refinery in the West Coast. The plan would substantially increase the plant’s refining capacity and would add 3.4 million barrels of oil to its storage capacity. The climate activists claimed that the expansion of the Tesoro Oil Refinery would open“the door to large quantities of dirty and volatile Dakota and Canadian crudes.” In a press statement, the activists claimed that the “highly toxic and corrosive oil would be refined and stored right in the backyards of some of the most polluted and economically disadvantaged communities in the state – Wilmington, West Long Beach, and Carson.” They added that such a development would “significantly increase the exposure of the residents to sizable health and safety risks.” The People’s Climate March is a nationwide mobilization to push forward a clean energy economy that will focus more on environmental
health and social justice. About 100,000 people have already signed up to march in Washington, D.C., and some 250 sister marches are being planned around the country. Participants in the march insist that elected officials lead the way toward an economically and ecologically sustainable future guided by the following goals, namely; phase out fossil fuels in a way that prioritizes community health and worker safety; prevent the Tesoro refinery expansion and its dangerous switch to the most toxic crude on the market; stop Tesoro’s proposed Bakken & Tar Sands crude oil invasion to the West Coast and cut off its connection to Dakota Access; create a just transition to a new green energy economy; commit to cross-coalition engagement in environmental justice for frontline communities. Alicia Rivera of the Communities for a Better Environment pointed out that many of the residents are not even aware that the expansion of Tesoro Corporation is happening. She demanded more public hearings. White House blasts federal judge for blocking Trump’s executive order on sanctuary cities WASHINGTON, April 27 – The White House on Wednesday blasted a federal judge for blocking an executive action ordering cities to comply with federal immigration regulations. “The rule of law suffered another blow, as an unelected judge unilaterally rewrote immigration policy for our nation,” the statement said. The statement said, according to US federal code, “a federal, state or local government entity or official may not prohibit, or in any way restrict, any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regrading the citizenship or immigration status, lawful or unlawful, of any individual.” The federal judge, who blocked the executive order Tuesday, “has ignored federal immigration law to set a new immigration policy for the entire country,” the statement said. The White House said it will “pursue all legal remedies to the sanctuary city threat that imperils our citizens, and continue our efforts to ramp up enforcement to remove the criminal and gang element from our country.” Judge William Orrick III of the US District Court for the Northern District of California on Tuesday ruled that US President Donald Trump cannot coerce “sanctuary cities” to cooperate with immigration officers by withdrawing federal funds.

Mortgage deferred loans being forgiven thru the ‘Mortgage Settlement Servicing Act’ I have been recently seeing a few Modified Loan that are completely forgiving Deferred Balances that where suppose to be due and payable at time of sale or restructuring of loan terms. I went and researched their situation and found out that lenders, were given funding by the Obama Administration between 2012-2015 to fund and help these homeowners that are in these situation. Under the terms of the settlement, the bank should contact you if you are eligible. Banks will be conducting a vigorous search to identify eligible borrowers and this may take six to nine months. Because of the complexity of the mortgage market and this agreement, which will be performed over a three-year period. The company that you make your monthly payment to is your mortgage servicer. A mortgage servicer administers mortgage loans, including collecting and recording payments from
borrowers. A servicer also handles loan defaults and foreclosures, and may offer loss mitigation programs to assist delinquent borrowers. Your mortgage servicer may or may not be a lending institution and may or may not own your loan. Many of the loans administered by servicers are owned by third-party investors. To mitigate losses suffered by homeowners victimized by deceptive practices during the mortgage and foreclosure crisis, the Attorney General obtained broad-ranging settlements from three major banks in 2013-2014. While each cases are different, all of the settlements provided reduction in principal balances,
reductions in interest rates and other relief to qualified homeowners. The settlement also appointed monitors to oversee the banks to make sure they comply with the settlement terms. Unfortunately, no every homeowners qualified for the relief under the settlement program. Those who qualify may have been contacted by their servicers and may received one or more forms of relief depending on their circumstances. So, if you have a Loan Modified between those years, check all your mails and see if you got a relief letter. With this letter you can refinance your existing loan without having to settle your deferred balance. Attorney General Harris also secured significant relief for Californians under the National Mortgage Settlement, which involved five major banks. The settlement created a new servicing standards that remain in place until 2015, provided cash
payments to many homeowners who were wrongly foreclosed upon, provided loan modification relief, short sale opportunities, and other relief to many distressed homeowners, and appointed a monitor to oversee the banks to ensure they complied with the settlement terms. I do believe that a big number of homeowners that have modification packages are seeing their payments go up due to adjusting loan terms and they would love to refinance those to a permanent fixed rate mortgage. A lot of Home Equity Lines of Credit (HELOC) are coming due to adjust to amortize for full 20 years, these homeowners will want to change those terms also to a permanent fixed rate mortgage to consolidate. PEZA eyes industrial estate in Camiguin province CAGAYAN DE ORO CITY, April 25 (PNA) – The government is planning to establish an industrial estate in the island province of Camiguin, a tourist hub in Northern Mindanao, an official of a business organization here said Tuesday. Robertino Pizarro, Oro Chamber president, the host of the Mindanao Business Conference (Minbizcon) this year, said that officials of the Philippine Economic Zone Authority (PEZA) have conferred with them regarding the government’s intention to develop Camiguin as an emerging industrial hub. He said that PEZA is actively involved in the creation of new industrial estates as part of the government’s effort to develop more economic zones in every city and
province in the country. Without disclosing the city or province, Pizarro also disclosed that an industrial estate would be created in the Caraga region. PEZA’s current director general is former Butuan City Rep. Charito Plaza. Pizzaro said that PEZA wants to develop industrial estates in Mindanao because of the ample power supply in the island. ”Mindanao now has an excess energy power of 1,000 megawatts, more than enough to fuel two new industrial estates,” Pizarro said. Lawmaker urges DOTr to cancel MRT build-lease-transfer contract MANILA, April 26 – A militant lawmaker at the House of Representatives urged the Department of Transportation (DOTr) to cancel its build-lease-transfer (BLT) agreement with the Metro Rail Transit Corporation (MRTC) for its inefficient maintenance of the MRT-3 system. In a statement on Wednesday, Bayan Muna Rep. Carlos Isagani Zarate slammed the “onerous” contract between the DOTr and the MRTC, which basically bleeds the government dry with its poor maintenance and alleged financial losses. While it had been the MRTC’s responsibility to provide maintenance under the BLT agreement, the train company passed a Board Resolution transferring the maintenance responsibilities to the DOTr in 2010. “Then and even now, we continue to pay millions of dollars monthly to MRTC which practically does nothing,” Zarate said. “Yet, despite the government shouldering what is otherwise the MRTC’s responsibility under the BLT agreement, we will be paying MRTC approximately PHP75 billion to PHP100 billion in Equity Rental Payments (ERPs) until 2025, mainly because it is our supposed obligation under the disadvantageous agreement,” he added. The Davao-based solon noted that the ERPs were used by former
Transportation Secretary Joseph Emilio Abaya to pass on the financial burden to commuters through unwarranted fare hikes. He added that fare rates prior to the hikes could already more than cover for the operations and maintenance of the MRT-3. In its 2014 audit report, the Commission on Audit said that the Department of Transportation and Communication (now known as DOTr) assumed the maintenance responsibility over MRT-3 and failed to sanction MRTC for failing to comply with its contractual obligations. The current maintenance contractor of the line, Busan Universal Rail, Inc., is also in hot water after a series of train glitches despite a four-day maintenance check during the Holy Week break. Single State payer health plan wins support from Senate Health Committee SACRAMENTO, CA – California took a major step Wednesday toward universal health coverage when the Senate Health Committee approved the Healthy California Act (Senate Bill 562). The final vote is pending but a majority of members approved. Sens. Ricardo Lara (D-Bell Gardens) and Toni G. Atkins (D-San Diego) have proposed to cover all California residents with a publicly run plan. “With today’s vote we are closer to being able to say, once and for all, that healthcare is not a privilege, it’s a human right,” said Senator Ricardo Lara. “Every family, every child, every senior deserves healthcare that costs less and covers more, and California has a chance to lead the rest of the nation toward universal care.” “I want to thank Senate Health Committee Chairman Dr. Ed Hernandez and the committee members who voted for SB 562 today,” said Senator Toni G. Atkins. “They see clearly that the time is right for us to give all Californians the peace of mind that comes with knowing that they and their families will have access to quality healthcare, no matter who they are, how much money they have or who’s in power in Washington, D.C.” Hours before the vote, nearly 1,000 people rallied in support of the Healthy California Act at the Sacramento Convention Center
and marched to the Capitol for the hearing at the Senate Health Committee. Supporters thronged the John Burton Hearing Room to support the bill. The Healthy California Act will be heard next by the Appropriations Committee, which Sen. Lara chairs. A fiscal study is underway. Highlights of the Healthy California Act: – Covers Californians for all medical care, including inpatient, outpatient, emergency care, dental, vision, mental health, and nursing home care. – Eliminates co-pays and insurance deductibles – Californians can choose their doctor from a full list of health care providers, not a narrow network chosen by insurance companies. – Referrals are not required for a member to see any eligible provider. – Californians are covered when they travel. – Physicians and nurses will make decisions about care, and have the ability to override computers or clinical practice guidelines in the best interest of the patient. – Healthy California will be governed by a nine-member, unpaid board appointed by the governor and Legislature and a public advisory committee of doctors, nurses, other health care providers, and consumers.

7,205 dogs vaccinated under San Pablo City’s anti-rabies drive SAN PABLO CITY, Laguna, April 26 (PNA) – Around 7,205 dogs in the city have been vaccinated as part of the anti-rabies and responsible pet ownership drive as of mid-April, a report from the City Veterinary Office said Wednesday. Dr. Fara Jayne Orsolino, city veterinarian, said that they expect more pet dogs to be vaccinated next month as they intensify their “Rabies-Free San Pablo City” drive during the summer months. Orsolino said they posted some 6,407 vaccinated pets in various barangays from January to March this year and an additional 798 were injected with the anti-rabies vaccine by mid-month, bringing the total to 7,205. Health authorities have cited rabies as a fatal yet preventable disease, prompting local governments especially veterinary, health and agricultural offices to implement measures to eradicate rabies. The City Vet Office also told
residents here that while rabies awareness months are declared in March and September each year, local governments have since mobilized a year-round program to curb rabies which poses a public health problem. The city veterinarian is informing the public of their continuing pet vaccination schedules on Labor Day (May 1) in Barangay II-B and on May 2 in Santessimo Rosario; May 3-4 in San Mateo; May 5 - Sta. Maria Magdalena; May 8-9 in Sta. Monica; May 11-13 in Barangay I-A; May 16 in Barangay 5-C; May 18 and May 26-27 in Barangay San Rafael. She said that the City Veterinary Office also accepts walk-ins at the vet office for vaccination of pets especially for pet owners who missed the schedules in their barangays. W. Visayas posts declining cases of undernutrition for 6 consecutive years

ILOILO CITY, April 26 -- Cas of undernutrition among pre-school children in Western Visayas have been declining for six consecutive years, according to the National Nutrition Council (NNC) 6. Data of NNC-6 shows that undernutrition in the region in 2011 was 7.59 percent and it consistently dropped to 7.05 percent in 2012; 6.38 percent in 2013; 6.21 percent in 2014; 5.58 percent in 2015 and the recent five percent in 2016. NNC-6 regional director Nona B. Tad-y attributed the consistent decrease in the malnutrition rate in the region to the initiatives of the concerned government agencies especially the Department of Health (DOH). She mentioned the DOH programs and projects that contributed to the reduction like infant and young child feeding, promotion of breastfeeding, campaign on the first 1,000 days, among others. Also, the collaborative efforts of the Department of Agriculture (DA) for its campaign on food security and preventive hunger and the supplemental feeding program of the Departments of Social Welfare and Development and of Education (DepEd). In 2016, NNC here weighted a total of 987, 272 pre-school children in the region or almost 80 percent of the 1.2 million estimated number of pre-school children in the region. A total of 927, 686 or 93.96 percent of the weighted children have normal nutrition status higher than the 914,873 children with normal nutrition status in 2015 while 40,038 or 4.06 percent of them are underweight, lower than the 44,163 number of underweight children in 2015. Number of severely underweight children also dropped from 10,465 children in 2015 to 9,328 this year. However, number of above normal children grew to 10,220 in 2016, higher than the 9,110 in 2015. NNC noted that prevalence of undernutrition in all the six provinces in the region has dropped when compared to 2015.

Solon calls for stronger sports program for youth amid Palaro staging MANILA, April 26 – A partylist lawmaker at the House of Representatives has called for the strengthening of the country’s sports development program for the youth as the country stages the annual sports fest, 2017 Palarong Pambansa, in Antique this week. In a statement on Wednesday, Buhay Partylist Rep. Lito Atienza said it was high time to revert the original name of the Department of Education (DepEd) to the Department of Education, Culture and Sports (DECS). Atienza explained that since the devolving of the DECS into the DepEd back in 2001, sports development and the learning of Philippine culture and arts “became virtually non-existent”. “It is high time that we bring back sports and culture in the basic curriculum of our schools, both public and private,” Atienza said. “The Palarong Pambansa is one way of promoting and encouraging our youth to get into sports but sports should not be a once a year event but a daily habit that we should instill in our children specially in their growing years,” he added. Atienza has filed House Bill 2628, which seeks to restore the original functions of the DepEd back to the DECS. The lawmaker pointed out that the country was a powerhouse with Filipino athletes dominating various competitions in the 1970s and 1980s. He stressed that the government should acknowledge the role of schools in developing young athletes.
“We cannot produce champion swimmers and runners even when thousands of Filipino children grow up near the sea and rice fields. How can we produce champion athletes when we have no sports development program that should start from the grassroots and from grade school?,” Atienza said. Furthermore, Atienza said improving the sports and cultural programs could also help curb drug use among the youth. “We believe that the right approach to this problem should be a comprehensive program that would involve the development of sports and cultural programs to keep our youth away from drugs,” he said. More than 12,000 young athletes from 18 regions in the country are competing in 21 regular sporting events in this year’s Palarong Pambansa. The games began on Sunday and will last until Saturday. Sancho Mau Ilustre and Jerald Jacinto the Big City’s onslaught in the pool, each captured two golds including a record smashing performances. Ilustre’s two golds came in the elementary boys’ 200 meter butterfly and 400 freestyle, respectively, while Jacinto’s smashing victories were recorded in the secondary boys’ 100 meter back and 200 meter medley relay, respectively. Ilustre, clocked 2:07.28 in the 200 meter butterfly for a new meet

2017 Civic Type R Claims Title as World’s Fastest Front-Wheel-Drive Production Car with Record Nürburgring Lap Time Civic Type R – America’s first Honda Type R model – goes on sale late spring. Less than two months before its U.S. launch, the 2017 Honda Civic Type R has claimed the title of world’s fastest production front-wheel-drive (FWD) production car, setting a new benchmark lap time at Germany’s legendary Nürburgring. On April 3, 2017, a Civic Type R lapped the 12.9-mile Nordschleife (north loop) in a record 7 minutes 43.80 seconds. This new benchmark time represents an improvement of nearly 7 seconds compared to the previous-generation (European market) Type R, and over 3 seconds faster than the previous FWD record. Multiple factors contribute to the new Civic Type R’s benchmark time including its high-performance 2.0-liter VTEC TURBO engine – with peak output of 306 horsepower (hp)1 and 295 lb.-ft. of torque2. The engine, which makes the new Civic Type R the most powerful Honda ever sold in America, is manufactured in the U.S. at Honda’s Anna, Ohio engine plant3. The Type R’s six-speed manual transmission with new, lower gear ratios further improves the car’s acceleration, while the new Type R’s comprehensive aerodynamic package delivers outstanding high-speed stability with an optimal balance between aerodynamic stability and
drag. The highly rigid body of the allnew Civic Type R is over 35 lbs. lighter than the previous-generation (European market) model, and boasts a 38-percent gain in torsional stiffness. The 10th-generation Civic platform’s new multi-link rear suspension enhances stability under braking and reduces the total roll movement of the car, enabling later braking into corners and helping to achieve higher cornering speeds during the lap. Ryuichi Kijima, the lead chassis engineer for the Honda Civic Type R development explains the model’s most significant improvements around the Nürburgring compared to the previous-generation car: “The cornering speed achieved in the new Type R is higher because the car features a wider track and tires, a longer wheelbase, a new multi-link suspension in the rear and optimized aerodynamics that improve stability. For example, drivers typically enter the corner after Metzgesfeld at around 150 km/h (93 mph). Even at this medium-speed corner, the speed
is around 10 km/h (6 mph) higher due to the new Type R’s excellent stability. So, with improved cornering performance, we can increase the speed throughout the lap, helping the new Type R to achieve a much quicker lap time.” The pre-production development Civic Type R that achieved the lap time was technically representative of production specification. A full floating roll cage was installed for safety reasons, but did not provide any additional rigidity to the body frame. The extra weight of the cage was compensated for by the removal of the Display Audio system and rear seats. The car was using street legal, track-focused tires. The new Civic Type R, the very first production Honda Type R model for America, is the final piece in the 10th-generation Honda Civic launch that began in the fall of 2015 with the Civic Sedan, named 2016 North American Car of the Year. The Civic lineup, featuring the most ambitious and extensive remake in the model’s 44-year history, includes
the premium and sporty Civic Sedan and Coupe; the versatile and Euro-inspired Civic Hatchback; the fast and agile new Civic Si Sedan and Coupe, launching next month; and the ultimate representation of Civic performance, the new Civic Type R.
