Drug problem in PHL now a national security threat – PDEA MANILA, May 2 – The drug problem in the country has now become a national security threat, according to Philippine Drugs Enforcement Agency (PDEA) Director General Isidro Lapena. Lapena spoke before the “RealNumbersPH” forum of the Presidential Communications Operations Office (PCOO), together with the PDEA, Philippine National Police (PNP), Department of Health (DOH), Department of Social Welfare and Development (DSWD) and non-governmental organizations (NGOs) held at Crowne Plaza Hotel in Ortigas Avenue, Pasig City on Tuesday. MANILA, May 2 – National Bureau of Investigation (NBI Director Dante A. Gierran on Tuesday denied the allegations of controversial Filipino-Chinese businessman Charlie “Atong” Ang that the bureau is involved in the alleged harassment and death threats against the latter. ”The NBI is a professional organization that adheres to high moral and ethical standards and its Officials and Agents will not be involved in highly unethical and illegal activities as alleged by Ang,” he said in a statement. Gierran stressed that the alleged death threats against Ang are baseless and without merit and are just a product of his own wild imaginations. ”Baseless and unfounded allegations of Charlie ”Atong” Ang may have something to do with the series of operations conducted by the NBI in Isabela Province,” he noted.
On March 29, 2017, the NBI received a letter from the Philippine Charity Sweepstakes Office (PCSO) seeking the assistance of the NBI in stopping illegal gambling and such other forms of illegal numbers game, including Jai Alai and such other forms of illegal gambling or numbers game using or based on jai alai in the province of Isabela. The letter also stated that the PCSO has gathered information and received reports that illegal gambling, including jai alai and other illegal numbers games using jai alai results, are freely operating in the said province. Under the law, the PCSO is the only authorized agency to hold and conduct lotteries and similar games in the country and Small Town Lottery (STL) is the only legal and authorized numbers game nationwide.
Health chief enjoins ordinary citizens to help prevent drug abuse MANILA, May 2 – Health Secretary Dr. Paulyn Ubial said Tuesday every Filipino can take part in the efforts to address the drug menace in the country. DOT vows improved PHL tourism ranking
MANILA, May 2 (PNA) – Malacañang welcomed the continuing influx of foreign visitors in the country after the Philippines’ hit a four-year high on foreign tourist arrivals. “Foreign tourists chose to ignore the political noise and believe that it’s really more fun in the Philippines,” Presidential spokesperson Ernesto Abella said in a press briefing in Malacañang on Tuesday, May 2, 2017. Abella noted that a total of 579,178 visitors were recorded in February or an increase of 27.81 percent over the past four years, adding that it is 5.36 percent higher than the same period last year.
Abella, meanwhile, assured foreign tourists that more improvements are to be expected in the country, noting the Duterte administration’s Build-Build-Build projects, which include tourism infrastructure such as airports, railways, and road networks. “Millions of jobs will be generated in the transport and tourism sectors as we usher in the Golden Age of Infrastructure within the next five years. Moreover, the DOT has pursued the grant of tax incentives for Tourism Enterprise Zone (TEZ) operators. The non-issuance of Bureau of Internal Revenue (BIR) regulation in the past six years has adversely affected investment interests in TEZ. “…The Duterte administration is certainly taking steps to boost tourism sustainability and inclusivity, by improving business climate and creating jobs with new policies and measures being instituted at both national and local levels,” Teo said. MANILA, May 2 – Secretary Wanda Teo on Tuesday said the Department of Tourism (DOT) is determined to improve the Philippine ranking in the World Economic Forum’s latest Travel and Tourism Competitiveness Report. Teo made this assurance after the Philippines dropped five notches in the latest edition of the report ranking 79th out of 136 countries this year. In Southeast Asia, the Philippines ranked third to the last. The report cited the Philippines’ lower competitiveness performance resulting from the country’s restrictive visa policy safety and security concerns, poor infrastructure and environment policies. Attorney Paul Allen answers questions on creditor harassment and bankruptcy protection. Q: Creditors are harassing me but I lost my job, and cannot pay. How do I stop them calling? A: If you cannot pay your bills, creditors will take steps to collect. Thatâ&#x20AC;&#x2122;s natural, but continued harassment can be emotionally depressing. If you have lost your job, or simply cannot cope, because debts have grown to the point where you have to choose who gets paid this month, and who doesnâ&#x20AC;&#x2122;t, then you need to consider the benefits of filing a bankruptcy. Q: Will a bankruptcy stop collection agencies from calling me? A: Yes, filing a bankruptcy protects you from creditor harassment, and provides peace of mind. Creditors will not contact you if you filed bankruptcy and have an attorney representing you. Otherwise they risk being cited for contempt of federal court, something they will not risk. Another reason to consider a bankruptcy now, even if you do not have assets to protect, is that after a bankruptcy, you can immediately begin the process of repairing your credit. This usually takes between 6 to 12 months, so an early start will get you there faster. Q: I have just received a summons from a creditor. Is it too late to file a bankruptcy? A: No. When you file for bankruptcy, an automatic stay goes into effect immediately stopping any lawsuit filed against you and any action against your property by a creditor, collection agency or government entity. This can be very important, Especially if you are at risk of being evicted or foreclosed on, being found in contempt for failure to pay child support or losing such basic resources as utility services, welfare or unemployment Here is how the bankruptcy filing affects some common emergencies: Utility disconnections. If youâ&#x20AC;&#x2122;re behind on a utility bill and the company is threatening to disconnect your water, electric, gas or telephone service, the automatic stay will prevent the disconnection for at least 20 days. Bankruptcy will also discharge the past due debts for utility service. Although the amount of a utility bill itself rarely justifies a bankruptcy filing, preventing electrical service cutoff might be justification enough. Q: Will filing a bankruptcy stop the foreclosure on my home? A:If your home mortgage is being foreclosed on, the automatic stay temporarily stops the proceedings, but the creditor will often be able to proceed with the foreclosure sooner or later. If you are facing foreclosure and wish to save your home, Chapter 13 bankruptcy is the appropriate
remedy because it provides for a repayment plan on the arrears. Q: Can a bankruptcy stop an eviction? A: No, under the new rules, a bankruptcy will not stop a court ordered eviction, but it will prevent a landlord from seeking to evict you, at least for a while, perhaps just enough time to find somewhere else to live. However, donâ&#x20AC;&#x2122;t file for bankruptcy solely because youâ&#x20AC;&#x2122;re being evicted. Youâ&#x20AC;&#x2122;ll probably be better off looking for a new place to live or fighting the eviction in Municipal court instead. Remember, the main idea behind bankruptcy is to discharge debt. Q: Will bankruptcy protect me; Iâ&#x20AC;&#x2122;m behind in my child support payments? A: If you owe child support or alimony, bankruptcy will not interrupt your obligation to make current payments. And while the automatic stay will temporarily stop proceedings to collect back support you owe, usually the bankruptcy court will permit collection to go forward if the creditor requests it. In any event, these debts will survive bankruptcy intact and will have to be paid once the case is closed. Chapter 13, however, lets you pay the back support as part of the repayment plan. Q: A creditor is garnishing my wages. Will bankruptcy help me? A: Yes. Although no more than 25% of your wages may be taken to satisfy a court judgment (up to 65% for child support and alimony), many people file for bankruptcy to protect their income. For some people, any loss of income is devastating. Your employer may also get angry at the expense and hassle of facilitating a succession of garnishments and take it out on their employees. Although federal law prohibits you from being fired for one garnishment, an employer can fire you for multiple garnishments. Filing for bankruptcy stops garnishments dead in their tracks. PCTO welcomes study that could improve state of communications in PHL MANILA, May 3 â&#x20AC;&#x201C; The Philippine Chamber of Telecommunications Operators (PCTO) has welcomed a new research study on the state of the Philippine telecommunications industry that could help the government further improve mobile services in the country. The study, â&#x20AC;&#x153;Assessment of the Structure, Conduct, and Performance of the Philippine Telecommunications Industryâ&#x20AC;? by University of the Philippines Prof. Emeritus Dr. Epictetus Patalinghug, described the local telco market as highly concentrated and highlighted the barriers to the entry of a third player in the industry. PCTO chairperson Eric de los Reyes said it is the only paper that has presented the real situation of the industry. â&#x20AC;&#x153;The study anchored on economic principles and covered all aspects of the industry which can help our legislators, regulators and policymakers in improving the state of Philippine telecommunications,â&#x20AC;? de los Reyes said in a statement.
According to Patalinghug, among the barriers to the entry of a new player in the telco industry are the need for a congressional franchise, spectrum availability, huge capital requirements, and the various licenses and permits from different government sectors. De los Reyes reiterated that these entry barriers may be the reasons why no new major telecom company has invested in the country in the past 15 years, although there are those who tried but did not stay long. â&#x20AC;&#x153;From the business perspective, putting up a huge amount of money late in the game may not be viable, considering that there is no immediate profitability due to the huge capital expenditure needed to build up the infrastructure and the high cost to maintain the operation annually in order to be competitive against incumbent players,â&#x20AC;? he said. DOTr inaugurates upgraded Puerto Princesa Airport MANILA, May 3 â&#x20AC;&#x201C; The Department of Transportation (DOTr) on Wednesday opened the newly developed Puerto Princesa Airport that is expected to strengthen the tourism industry of Palawan province. The upgraded international airport is expected to accommodate some 1.9 million passengers annually. The PHP4-billion development project involved the construction of a new passenger and cargo building, apron, taxiways and navigation facilities. The 13,000-sq. meter airport terminal was built by a South Korean contractor, with funding from the Korea Export-Import Bank. It can accommodate two wide-body and four small aircraft at once, servicing Philippine Airlines, PAL Express, Cebu Pacific, Cebgo and Air Asia. Panfilo Lacson said that he would give constructive criticism to Philippine National Police (PNP) chief Director General Ronald dela Rosa because he wanted him to succeed. Lacson, former PNP chief, made this remark after criticizing Dela Rosa for the “arrogant” way he responded to reports about a “hidden cell” at the Manila Police District Station 1 in Tondo after members of the Commission on Human Rights (CHR) made a surprise inspection. Dela Rosa reportedly said that he saw no problem with the setup as long as none of the detainees were hurt or blackmailed. He also challenged the CHR to conduct inspections every day and not just during the ASEAN summit. Lacson, however, said that he found Dela Rosa’s comment arrogant. “I did not say CPNP dela Rosa is arrogant That single act, how he responded to the comments about the
secret cell, what was what I referred to as arrogant. That single act. I want to clarify that. I always wanted him to succeed for obvious reasons,” Lacson said in a mix of Filipino and English. “That’s why when I see or hear something about the way he reacts to certain issues, I cannot help but correct on the spot. Because I want him to succeed,” he added. Lacson said that it was obvious that there was a violation. “You can see there’s a violation, that’s plain view. It is clear in the law that secret prison cells are prohibited. MANILA, May 2 – A resolution was filed Tuesday seeking to look into the reported “hidden cell” which was discovered at the Manila Police District (MPD) Station 1 in Tondo after members of the Commission on Human Rights (CHR) made a surprise inspection. Sen. Paolo Benigno Aquino IV filed Senate Resolution No. 348 seeking to investigate the operation of the cell and at the same time urged the Philippine National Police (PNP) to clean up its ranks. Aquino, in filing the resolution, said the probe is aimed at ensuring that the rights of those under custodial investigation or detention by the PNP are protected. He also stressed that cleaning the police ranks must go hand-inhand with the administration’s war against drugs to earn public trust. “As the government’s enforcement arm in its war against illegal drugs, the PNP should safeguard the public’s trust by ensuring that abusive policemen are investigated and punished accordingly,” Aquino said in his resolution. According to the CHR, the hidden cell was occupied by at least 12 persons who were detained for at least 10 days even without the filing of proper charges and without arrests being recorded. Families of the detainees also claimed that elements of the Drug Enforcement Unit asked for money in exchange for their freedom. Neophyte Sen. Sherwin Gatchalian, for his part, urged PNP Director General Chief Ronald dela Rosa to immediately launch an in-
tensive probe into allegations against police officers involved. Gatchalian, in a statement, also warned that the current administration’s campaign against illegal drugs would “nosedive” if the PNP fails to address reports of police abuses. “The endless string of public scandals concerning the questionable methods employed by police officers in waging the fight against illegal drugs is starting to take its toll on the credibility of the PNP,” Gatchalian said. “Public trust in the institution is fast declining, and the people are losing their faith in police officers,” he added. He also emphasized the importance of the public perception of PNP in the success or failure of the administration’s anti-illegal drug campaign. “The integrity of the PNP and its members must remain unsullied at all times. If the people lose trust in the police, we will lose the war on drugs,” he added. Sen. MANILA, May 2 – The Office of the Ombudsman has ordered the dismissal from service of Baao, Camarines Sur Mayor Melquiades Gaite after he was found guilty of grave misconduct and conduct prejudicial to the best interest of the service. Probe showed that in May 2014, Gaite entered into a 25-year lease contract with Lamvert Consolidated Complex Development Corporation over a portion of the Baao public market building covering 1,704 square meters. Gaite failed to present evidence that the lease deal was made with the prior authorization of the Sangguniang Bayan (SB). The Ombudsman said that under the Local Government Code of 1991, “no contract may be entered into by the local chief executive in behalf of the local government unit without prior authorization by the Sanggunian concerned.” Ombudsman Conchita Carpio Morales said “the act of respondent, a veteran local chief executive with almost two decades of experience, in entering into a contract of lease for a period beyond that in Municipal Ordinance No. 03 amounts to a transgression of some established and definite rule of action more particularly unlawful behaviour or gross negligence by a public officer.”
MANILA, May 2 – The family of slain journalist Larry Que in Catanduanes on Tuesday filed a murder complaint before the Department of Justice (DOJ) against three persons including Catanduanes Governor Joseph Cua. Que’s common-law wife, Edralyn Pangilinan, filed the murder complaint at the DOJ against Cua and two other respondents Prince Lim Subion and Vincent Masagca Tacorda. Pangilinan also filed a complaint before the Office of the Ombudsman last February against Cua, Virac Mayor Samuel Laynes, and Barangay Palta Small chairman Hilario Sarmiento all of whom she accused of graft, grave misconduct and nonfeasance for their failure to crack down on illegal drugs. Pangilinan noted in her complaint before the Ombudsman that Que investigated and exposed the issue in his newspaper before getting killed. “His exposés, unfortunately, went under the skin of one of his subjects, Joseph C. Cua, the governor of Catanduanes province, and were too much to handle for the latter,” read her complaint before the Ombudsman. Que, a columnist and publisher of a local paper in Catanduanes, was shot in the head by unidentified man wearing a bonnet and a raincoat last Dec. 19 in Virac. The gunman fled on a motorcycle driven by an accomplice, according to earlier reports.

Que’s case, is the first case of media killing under the administration of President Rodrigo Duterte. The DOJ Secretary assured that justice will be served on Que and other victims of media killings. In his column, Que blamed the negligence of local government leaders for the existence of the large shabu laboratory earlier seized in their province. He said the discovery of the shabu lab brought shame on the province. He also alleged in his column that the laboratory was set up by Chinese nationals to help the Chinese residents in the island province. The incident has reportedly caused fear among local journalists in the province who also reported on the said shabu laboratory, which is said to be the largest in the country. Meanwhile, the task force on media killings is composed of secretaries of the Department of Interior and Local Government and National Defense, the Solicitor-General, the executive director of the Presidential Human Rights Committee, the chiefs of the military and the police and the NBI director. Justice Secretary Vitaliano Aguirre said that the task force on media killing would not only focus on new cases, but will also handle unresolved ones from the previous administrations. Provisional Waiver available EVEN with Deportation Order Question: I have heard that the provisional waivers have expanded. I have a prior deportation order and have been so afraid to have my spouse petition me because I thought I could not file a provisional waiver inside the U.S. I thought I would have to leave the U.S. and ‘hope’ that the waiver was approved. Is it true that this has changed? Answer: Yes, the applicability of the provisional waiver has been expanded. Remember, that the provisional waiver would apply only in the case where you normally would not have been inadmissible on any other grounds other than unlawful presence in the U.S. It allows you to file here in the U.S. while you are here in the U.S. If successful, then it would mean you would actually only have to leave under normal circumstances to the U.S. Consulate for only a few days and then you would return as a lawful permanent resident. The Department of homeland security (or DHS) had adopted changes discussed in the proposed rule.The new modifications include: (1) Clarifying that all individuals seeking provisional waivers, including those in removal proceedings before the Executive Office for Immigration Review (EOIR), must file applications or provisional waivers with USCIS. (2) Allowing individuals to apply for provisional waivers even
if USCIS has a reason to believe that they may be subject to other grounds of inadmissibility. (3) Eliminating the proposed temporal limitations that would have restricted eligibility for provisional waivers based on DOS visa interview scheduling. (4) Allowing individuals with final orders of removal, exclusion, or deportation to be eligible for provisional waivers provided that they have already applied for, and USCIS has approved, an Application for Permission to Reapply for Admission into the United States After Deportation or Removal Form I–212 and (5) Clarifying that DHS must have actually reinstated a removal, deportation, or exclusion order in order for an individual who has returned to the United States unlawfully after removal to be ineligible for a provisional waiver on that basis. PNP-IAS to audit all PNP detention facilities nationwide MANILA, May 3 – The Philippine National Police Internal Affairs Service (PNP-IAS) will conduct a nationwide audit of all PNP detention facilities. PNP-IAS chief Director Leo Angelo Leuterio said this after they found out that the Manila Police District (MPD) Station 1 had been using the so-called “secret jail” for the past five years because of lack of space to accommodate the sheer number of detainees. Leuterio said that the IAS would like to determine if this practice was widespread in other police stations all over the country. In the ongoing investigation of the case, the PNP-IAS found that MPD Station 1 had been using the so-called “secret jail” to temporarily house detainees since it was constructed five years ago. The PNP-IAS chief said that they were trying to ascertain if the facility was really used as a “secret jail” because it’s possible that it was a make-shift extension of their regular detention facilities. He added that any area of a police station may be used to house detainees. The PNP-IAS is currently validating the statements obtained from the 11 detainees housed in the so-called “secret jail”. Earlier, PNP chief Director General Ronald “Bato” Dela Rosa had talked to the detainees, who denied the allegations that the MPD policemen mistreated them and attempted to extort money from them while they were under detention. In an effort to help the Philippine Bureau of Immigration Officers, this author is disseminating the “appeal to give back the benefits taken away from them since the Aquino administration.” Collectively, the BOI’s appeal is as follows: “It is quite disheartening to learn that more and more good men and women of the Bureau of Immigration (BOI) have come to a decision on leaving an institution which they have once called ‘home.’ Perhaps, people who would come to know about the Philippine Bureau of Immigration by what they hear, may not easily understand the relevance attached to their office duties. The Immigration Officers (IO) perform duties and functions which are never boring because they encounter new challenges each day. These IOs are in contact with people of various social, economic, and educational attainments, e.g. investors, professionals, diplomats, the ‘brainy and the brainless,’ the ‘braggart and the faint-hearted,’ the ‘gracious and the punk.’ And so, IOs must be tactful and courteous but firm in dealing with peoples’ various personalities. Moreover, they must be fully acquainted and updated with the numerous memorandum orders and circulars, with emphasis on the numerous categories of admission into our country. Otherwise, any error made could cause irreversible circumstance. Of equal importance too is, they must know how to detect impostors using genuine but illegally acquired passports. All these, they must all learn by heart. But despite the phases and complexities associated with their official functions, they have all learned to love their jobs and are willing to live with it.”
However, most of them are currently leaving the Bureau of Immigration and the big question is why? Is it only because of the low wage earned? Or, the love of country has begun to wane? And their answer is definitely a loud NO! BOI employees are not asking for any additional pay. Their appeal is merely to have the current administration give them back the benefits taken away from them since the Aquino administration. For them, quitting is one of the most difficult things to do, as they need a lot of courage to quit; not because they are confronted with difficult task and duties, but simply because the job might not be meant for them and some of them just didn’t want to waste time seeking for greener pastures. But with no other recourse, many of these IOs have resorted to quitting as their last solution, due to the inability of the government to respond to their needs in its current environment. One of their underlying sentiments is: has the administration taken for granted that these Immigration employees have families, where most of them are the providers for their family’s decent shelter, food, medical expenses, education and necessary utilities included such as electricity, water, telephone, clothing and transportation - all these lumped

into their scrimpy take home pay of P16,000? No wonder some BI employees succumb to corruption? The administration should realize that these uniformed law enforcers of our country, the Philippines are the people responsible in securing our borders. Their meager monthly salaries could barely cope with their monthly living situations. Accordingly, they have emphasized that in the 1987 Constitution, Article II, Section 12, it states that the Philippines recognizes the sanctity of family life and shall protect and strengthen the family as a basic autonomous social institution...The natural and primary right and duty of parents in the rearing of the youth for civic efficiency and the development of moral character shall receive the support of the government.’ Many BI employees who have been employed there for 15 to 20 years are currently in a quandary, because

Volunteer lawyers seek endorsement of impeach rap vs Robredo MANILA, May 2 (PNA) – A group of volunteer lawyers and professors on Tuesday submitted an impeachment complaint against Vice President Leni Robredo to a congressman’s office for proper endorsement. In a press conference, lawyer Bruce Rivera, spokesperson of the so-called “Impeach Leni Movement” initially intended to file the impeachment complaint before the Secretary General of the House of Representatives at 1 p.m., but was later instructed to “send it to a congressman’s office”. Bifurcation and status only divorce The decision to terminate oneâ&#x20AC;&#x2122;s marriage typically brings to the forefront many issues all at once. Issues pertaining to property, support, and child custody need to be addressed in a divorce proceeding. In a long term marriage especially, these issues are often heavily litigated between the spouses, and can take a significant amount of time to resolve. Frequently, a spouse would like to â&#x20AC;&#x153;move on,â&#x20AC;? and re-attain single status as soon as possible, but has a perception that to become divorced, issues concerning property, support, and child custody first need to be resolved. Many erroneously believe that getting a divorce prior to resolution of property, support, and custody issues is like putting the â&#x20AC;&#x153;carriage before the horseâ&#x20AC;?â&#x20AC;&#x201D;an impossibility. Under the Family Code, a spouse can â&#x20AC;&#x153;bifurcateâ&#x20AC;? the issue of marital status and terminate the marriage without having to
wait until the issues pertaining to property, support, and child custody are resolved. A judgment dissolving the marriage need not resolve all issues raised in the divorce petition. If there are issues set forth in the petition with regard to property, support, and custody, the Court may nonetheless separate the issue of dissolution of marriage status and grant an early trial on that issue (a â&#x20AC;&#x153;status onlyâ&#x20AC;? judgment). Obtaining a â&#x20AC;&#x153;status onlyâ&#x20AC;? judgment is most beneficial to those persons who want his or her marriage terminated as soon as possible. Through a â&#x20AC;&#x153;status onlyâ&#x20AC;? judgment, a person is restored to single status more quickly, enabling a person to remarry even if other issues concerning the marriage have yet to be resolved. It is important to note, however, that a judgment terminating the marriage itself also brings with it the consequence of terminating rights associated with marriage. To address the foregoing, the Court may impose conditions on a â&#x20AC;&#x153;status onlyâ&#x20AC;? judgment, to preserve rights which normally would exist if an early dissolution of marriage status were not granted. These conditions are contained in Family Code Section 2337. The Court may require a spouse seeking early dissolution of marriage status to do any of the following, all designed to protect the interests of the spouse who is not seeking early dissolution: 1) indemnify the other spouse for adverse tax consequences resulting from the early termination of marital
status, 2) maintain the other spouse on existing health insurance, 3) indemnifying the other spouse from loss of rights to a probate homestead or probate family allowance, 4) indemnify the other spouse for loss of benefits under employee benefit plans, 5) joinder of an employee benefit plan, and 6) any other condition that the court determines is just and equitable. With a â&#x20AC;&#x153;status onlyâ&#x20AC;? judgment, the Court reserves jurisdiction to adjudicate any other issues concerning the marriage, including division of property, award of support, and custody issues. BEIJING, May 3 -- China is willing to work with members of the Association of Southeast Asian Nations (ASEAN) to fully implement the Declaration on the Conduct of Parties in the South China Sea (DOC), a Chinese Foreign Ministry spokesman has said. In his regular press conference Tuesday, Chinese Foreign Ministry spokesperson Geng Shuang said China is also willing to deepen maritime practical cooperation to arrive at a code of conduct (COC) â&#x20AC;&#x153;based on consensus at an early dateâ&#x20AC;?. â&#x20AC;&#x153;According to the work plan, China and ASEAN countries will finish consultation on the draft framework of the COC in the first half of this year,â&#x20AC;? Geng told the media. Store manager needs bankruptcy relief; Separated debtor needs Chapter 7 relief Client no. 1 is 50 years old and the manager of a big retail store. Heâ&#x20AC;&#x2122;s been working there for 30 years. Spouse got into an accident and is now on disability. He owns a house with $200K of equity. He has believe it or not, 11 children from age 2 to 18. Just imagine his food expense every month! He owes $60K of credit card debt. Since his wife became disabled, he applied for a loan modification of his first mortgage. His first mortgage payment is $2800. His gross income is $80K. With wifeâ&#x20AC;&#x2122;s disability pay, they gross $100K a year. But with 11 kids, and $60K of credit card debt, something has to give. He canâ&#x20AC;&#x2122;t pay the minimum credit card payments of $1800 anymore. So he wants a Chapter 7 to get rid of the $60K credit cards. But does he qualify for a Chapter 7 discharge? Well, in terms of the means test, there certainly is no presumption of abuse because he has 11 kids. But in a Chapter 7, there is going to be a problem with the residence. The homestead exemption for client is $100K but his equity is $130K. So, there is $30K of nonexempt equity. Theoretically, Chapter 7 could work for client because there is almost no viable nonexempt equity to speak of if you factor in the cost of sale of 6%. The house is current valued at $500K. 6% of $500K is $30K, which is the amount of nonexempt equity. A Chapter 7 trustee would have nothing to administer and theoretically client should be able to keep his house in Chapter 7. The problem is that real estate prices in Los Angeles are still going up. An aggressive Chapter 7 trustee can file an adversary proceeding to have the house sold because of the $30K nonexempt equity. The adversary case may take 18 months to reach trial. By that time, the house value could have increased
by another $50K. The increase in value is justification in favor of the trusteeâ&#x20AC;&#x2122;s argument that there is viable equity for him to administer. Nobody wants this kind of problem in bankruptcy but it happens. I have this exact situation with another client whose case was filed two years ago. The trustee filed an adversary complaint to get his house because the nonexempt portion, according to the trustee was $100K. Our defense was that there was no viable equity for the trustee to administer because there was a judgment lien for $97K. This adversary was due for trial on April 26, 2017. But a week before trial, trustee offered a settlement to enable client to keep his house. Trustee argued that the value of the house had increased â&#x20AC;&#x153;substantiallyâ&#x20AC;? in the last 18 months resulting in viable nonexempt equity. So this kind of problem does happen in Chapter 7 although not often. To avoid this situation, it is the better part of caution to file for Chapter 13. Why? The Chapter 13 trustee, unlike the Chapter 7 trustee, does not have the power to sell debtorâ&#x20AC;&#x2122;s house. So, in Chapter 13, there is no risk of losing debtorâ&#x20AC;&#x2122;s house. But in Chapter 13, client must pay at least $30K over 60 months, or $500 a month. After 5 years, client would have paid the trustee $30K. Upon completion of the last payment, the court will discharge the other $30K. So, in 5 years, debtor will not owe any more credit cards as the entire $60K will be gone. Client no. 2 is 64 years old. He is
married but separated. He does not have his own children but he helps his nephews and nieces who live abroad with money for the monthly expenses, which include college tuition abroad. He makes a gross of $90K a year as a scientist. He does not own a house. He owes $50K of credit card debt, which is using up $1500 a month of his net income. Client also likes to gamble. He seems to be good at it because he had $40K of gambling winnings last year. Client wants a Chapter 7 discharge of his $50K of credit cards. Will he qualify for a Chapter 7 discharge given the fact that he is practically single with $90K of gross income a year? Thatâ&#x20AC;&#x2122;s a good question. After doing the means test analysis, it appears that there is no presumption of abuse with Chapter 7. On the other hand, if some deductions we claim are disputed by the trustee, there could be some disposable income that will indicate that client has the ability to pay off a portion of his $50K credit card debt. But note that this case is significantly different from the first case because in this case, client does not own a house. So, even if itâ&#x20AC;&#x2122;s a borderline case, i.e. client can file Chapter 7 or 13, client can file for Chapter 7 relief as long as the IRS deductions are kosher. Kosher means in this

If he can justify that expense, it can be argued that the nephews and nieces are his dependents even though they do not live with him. Under the worse case, he can convert his case to Chapter 13. However, he has very good chances of getting a Chapter 7 discharge. This is a no brainer for a gambler like client, so he opts for Chapter 7. Meanwhile, Legarda expressed hope that the next Environment Secretary would have the same political will as Lopez. Ejercito, for his part, said he believed Lopez is “highly qualified” for the position of DENR Secretary because of her “commitment to serve the country and her unwavering advocacy to save our environment.”
He also pointed out that Lopez should be recognized for having the guts of going against “brazen violations of big time miners.” “This feat is admirable, and I share her conviction that no amount of income contributions to the country’s GDP can compensate the environmental destructions and negative impacts of the mining operations,” he added. He further said that the CA should have to look “beyond certain qualifications before individuals can serve the country and be a catalyst for change” but respected the decision of the body. Bankruptcy can offer hope when life doesn’t seem fair We’ve all been there. Those moments when almost anything that could go wrong DOES go wrong in our finances. As human beings, we all want to be safe and secure but life doesn’t provide any assurances. Perhaps you are going through financial and debt problems through no fault of your own. Aguirre asks BIR to investigate Atong Ang’s tax liabilities MANILA, May 3 (Mabuhay) – Gambling operator Charlie “Atong” Ang and the Meridien Vista Gaming Corporation now face a tax-evasion probe, this after Justice Secretary Vitaliano Aguirre II wrote a formal request to the Bureau of Internal Revenue to do so. In a letter on Tuesday, Aguirre requested BIR Commissioner Cesar Dulay to look into the matter, citing the latter’s power to initiate investigations for possible violations of the Tax Code. “I trust that greater cooperation and confidence between the Department (of Justice) and the BIR will be forthcoming in our government’s efforts to curb corruption and criminality in the country, particularly in cases of tax evasion,” Aguirre said. Aguirre had said that Ang was running a gambling business without paying the proper taxes to the government. Also, he said that Meridien has no franchise to operate as a small town lottery (STL) unit by the Philippine Charity Sweepstakes Office (PCSO),
and that it had been targeted for closure. Ang and Aguirre have been engaged in verbal tussle after the businessman accused the DOJ chief, National Security Adviser Hermogenes Esperon, and some retired generals belonging to the Philippine Military Academy Class of 1982 of plotting to kill him over his virtual Jai alai numbers game operations through Meridien. The businessman claimed that the PCSO wants Meridien’s operations stopped because it was competing with government-sanctioned STL. Ang is consultant and general manager of the Cagayan Freeport-based Meridien. He further alleged that Aguirre had directed the National Bureau of Investigation (NBI) to “liquidate” him, and that the Cabinet official’s involvement in STL was through his engineer brother Ogie Aguirre. Ang also said that Esperon was demanding a cut from proceeds of STL operations in Pangasinan.
House panel OKs comprehensive tax reform bill MANILA, May 3 (PNA) – The House ways and means committee on Wednesday approved the comprehensive tax reform package, which seeks to lower personal income tax (PIT) rates while raising excise taxes on certain commodities. Members of the House panel approved the unnumbered substitute bill with 17 votes on the affirmative, 4 negative, and 3 abstentions. This after the technical working group submitted the draft of the bill
to the mother committee for approval. Under the bill, workers earning no more than PHP250,000 annually will be exempted from paying personal income taxes (PIT). To compensate for the revenue losses from the lowering of the PIT rates, some of the offsetting measures include increasing excise tax rates on all petroleum products and automobiles; expanding the value added tax (VAT) base, among others. OC man guilty of healthcare fraud worth millions of dollars LOS ANGELES – A former resident of Aliso Viejo has been found guilty of 15 counts of health care fraud for submitting bills to insurance companies that sought millions of dollars in reimbursement for tests and services that were never performed. Michael Mirando, 40, who currently resides in Portland, Oregon, was found guilty yesterday by a federal jury that needed to deliberate for less than half an hour to reach its verdict after a weeklong trial. Mirando was an owner of Holter Labs, which provided cardiac monitoring services using an ambulatory electrocardiography device known as a Holter monitor. The evidence presented during the trial in United States District Court showed that Mirando engaged in a fraud scheme in which he was responsible for the submission of millions of dollars in claims for services that were never performed. Holter Labs provided the Holter monitor to physicians, who prescribed the devices to patients to monitor their heart rates for one to two days. Mirando then billed the patients’ insurance companies for the prescribed 24- or 48-hour tests, but he also submitted bills for services never ordered – such as 30-day tests – and for services the device could not perform – such as brain scans and oxygen studies. From 2005 through 2016, Mirando submitted tens of thousands of claims
to dozens of private health insurance companies. Mirando submitted bills that sought approximately $10 million, which included $7 million for services never performed and another $1 million for duplicate dates of services. The victim health insurance companies paid at least $2.5 million on these fraudulent claims. After being free on bond since he was charged in this case last year, Mirando was remanded into custody on the first day of his trial after having contact with potential jurors in the case. After learning that Mirando spoke with two potential jurors outside of the courtroom, United States District Judge Percy Anderson revoked the defendant’s bond after finding that he engaged in jury tampering and had attempted to obstruct justice. At the conclusion of the trial, Judge Anderson released Mirando on a $1 million bond and ordered him placed under home detention. Mirando is scheduled to be sentenced by Judge Anderson on August 21, at which time the defendant will face a statutory maximum sentence of 10 years in federal prison for each of the 15 counts of health care fraud. Following his conviction yesterday, Mirando signed a stipulation in which he admitted that he purchased his house in Portland with proceeds generated by the fraud scheme. As a result, that residence could be the subject of a forfeiture action.

S&P rating reflects PHL growth prospects – Palace MANILA, May 2 (PNA) – Malacañang on Tuesday said Standard and Poor’s decision to maintain its investment grade score on the Philippines reflects the country’s prospects in sustaining its economic momentum under President Rodrigo Duterte. “The country seems to have indeed sustained its economic momentum,” Presidential Spokesperson Ernesto Abella said during a Palace briefing. The Palace official said the New Yorkbased global debt watcher’s stable outlook on the country resonates the satisfactory effects of the country’s policy in fiscal and debt metrics. In addition, S&P has also upheld the Philippines’ “BBB” long-term credit rating, which Abella said “reflects the country’s strong external position and adequate capacity to meet financial commitments,” he said. “The stable outlook on the Philippine economy also shows that policies continue to provide a favorable environment for sustained growth,” Abella said. On Friday, S&P retained the investment grade rating of the Philippines on the back of the country’s robust external position. The debt watcher affirmed its ‘BBB’—a notch above investment grade—rating on a stable outlook on the Philippines. “The ratings on the Philippines reflect our assessment of its strong external position,
which features ample foreign exchange reserves and low and declining external debt,” S&P said in a statement. S&P expects the country’s gross domestic product (GDP) per capita to reach around USD 2,950 this year. S&P also sees the GDP per capita growth of the Philippines averaging 4.9 percent per year from 2017-2020, reflecting the balance of a strong domestic economy and a modest collective outlook for the Philippines trading partners. S&P is the second debt watcher to affirm the country’s investment grade credit rating under the Duterte administration. Last March, Fitch Ratings also kept the country’s investment credit rating with a positive outlook on the back of strong indications of continued economic growth and manageable debt levels. In its latest credit report released March 29, the credit rating agency affirmed the Philippines’ Long-Term Foreign- and Local-Currency Issuer Default Ratings (IDRs) at “BBB-“ with a positive outlook. “The Philippines’ rating reflects its continued strong and consistent growth performance, a robust net external creditor position, and government debt levels that are lower than the median of peers in the ‘BBB’ Ratings category,” Fitch Ratings said in its report. Pimentel on De Lima’s request to join Senate sessions: Let the court decide MANILA, May 2 – Senate Pres. Aquilino Pimentel III on Tuesday said that it us up to the court to decide on whether to allow detained Sen. Leila de Lima to participate in Senate sessions particularly in the deliberations of measures. “Nasa court na yung issue (The issue is already in the court), so let the court decide. Let her lawyers work,” Pimentel told reporters in an interview. “The court can ask, or the Senate President can initiate as an amicus curiae if the court would ask but I don’t think it’s the case so it is not important. It is only done if it is a difficult question of constitutional law,” he added. However, Pimentel said that according to Senate rules, De Lima had to be present to be able to interpellate, debate and vote. On the other hand, she did not need to be present to file resolutions and bills. “Ang rules kasi namin (According to our rules), you must be present to be able to interpellate, to debate, and to vote, but you
need not be present to file resolutions, to file bills,” he explained. “Yung mga need not be present na things (The things you need not to be present), we can still do, but those that need your presence, what can we do? You must be physically present,” he added. Sen. Panfilo Lacson, in a separate interview, said De Lima’s request has yet to be discussed. “Pag-uusapan namin sa majority (We at the majority will have to talk about that),” Lacson said, however, noted that he was in favor of maximizing the participation of all Senators. “Kung ako tatanungin, kasi ginawa namin kay Sen. MANILA, May 3 – Malacañang on Wednesday said Filipinos must have a deeper appreciation of the importance of expanding ties with other countries other than traditional Philippine allies as the country charts its own course in the international community. This was highlighted by Presidential Spokesperson Ernesto Abella in reaction to a recent poll which showed majority of Filipinos expressing distrust towards China and Russia, two superpowers that President Rodrigo Duterte has reached out to. In a Pulse Asia poll conducted on March 15 to 20 this year, 63 percent of respondents said they distrust China while 56 percent expressed distrust to Russia. This despite the Philippines enjoying warming relations with the two superpowers as a result of President Duterte’s move
towards a more “independent foreign policy.” “As the President charts an independent foreign policy, the public needs a deeper understanding of the need for expanding our diplomatic horizons,” Abella said. The Palace official said that enhancing diplomatic ties with China and Russia provides the country with more room for growth. “The Duterte administration is charting the path of broader diplomatic relations with the international community, and the renewed ties with Russia and China provide a healthy opportunity to appreciate and understand these two countries,” he said. “Our enhanced relations with China and Russia will bolster our international relations and give us more room to grow, expand, and become more rooted as we get to know ourselves better as a nation in a community of nations,” Abella said.

The $56,000 worth of medicine and boxes of toys collected by Philippine Children’s Charity Inc., (PCCI) chaired by Darna Umayam. After thanking PCCI’s leadership, its ambassadors of goodwill and the 2016 Outstanding Filipino American awardees for the noble undertaking, the consul general went on to remind everyone about ongoing projects of the Philippine Consulate in Los Angeles for Filipinos, particularly for exploited workers and the homeless, whether they were legal or undocu-

The US-DOL-WHD has said that residential care facilities, group homes, and board-and-care facilities are all covered under the Fair Labor Standards Act (FLSA) and should follow the mandate on minimum wage and overtime pay.

“Half-full, half-empty”. That’s how psychologists tell us about our outlook in life. This too applies with the oceans. It can be seen as waters that bridge or divides nations. The recent launch of a Ro-ro (rollon, roll-off) service between Indonesia and the Philippines bridges two nations and peoples with so many commonalities using the sea as a means to reach out to each other. But what is that makes this bridge significant to the two nations. Indonesia has so many islands so close to Davao and General Santos cities in the Philippines than to mainland Indonesia. While the Roro services make goods move easier between the two countries, it will be now easier for citizens from both sides to travel the route armed only with passports. Islanders from Indonesia would prefer to buy goods from Davao or General Santos City and avail of medical services too. In the 1950s, not a few Indonesian nationals would travel the rough seas to get to Davao in search of opportunities. They do odd jobs and because they are made of sterner stuff they go about their chores uncomplaining and were happy and contented with what they have. In time they learned the language and had been assimilated. Because they belong to the same Malay race like we do, there is no way one can distinguish them from the rest of those who dwell in the coastal barangays of Davao City for example.
Looking at the leaders of both nations stand side by side and various ASEAN ceremonies, one cannot escape their physical similarities. Then later we discovered that their similarities go beyond their physical attributes. They too have practically the same background in upbringing, political fortunes and perhaps destinies. President Rodrigo R. Duterte and President Joko Widodo give premium to sovereignty and condemn terrorism and drugs and strong advocates of rule of law. Their common attributes are as stark as the waters where both nations share. Sometimes fishermen from either side stray in each other territories but civility and understanding always reign supreme between the two. Among the ASEAN nations, Indonesia and the Philippines are the closest allies. The launching of the Ro-ro service is still another manifestation of the ties that binds, of the sincere bilateral relations that the two countries had nurtured since 1949 when diplomatic relations between them was established. Not a few quarters condemn Muslim nations for the rise of terrorism not realizing that Indonesia which is the most populous Muslim country in the world suffered the most from this. This is the reason why Widodo, a strong advocate against terrorism, was voted into power by his people. It is in the same vein that Filipinos, tired of the rising tide of drug menace and criminality, elected Duterte (as) President.

Visayas 12.4% economic growth in 2016 is highest in PHL TACLOBAN CITY, May 4 – The Eastern Visayas Gross Regional Domestic Product (GRDP) grew by 12.4 percent in 2016, the fastest growing region in the country, offsetting economic losses incurred from super typhoon “Yolanda” in 2013. The regional economy accelerated by 7.7 percent between 2015 to 2016, gaining PHP172.14 billion. Eastern Visayas or Region 8 bested six other regions in the country with positive economic performance last year. “This is the first ever double digit growth in Eastern Visayas. The region continues to improve its performance since 2014,” said Philippine Statistics Authority (PSA) Regional Director Wilma Perante in a press briefing on Thursday. The services sector, with a share of 44.3 percent, posted a 8.6 percent, a slight increase from 7.9 percent from the previous year. This was due to the strong performance of financial transactions, transport, storage and communication sub-sectors. “The increased financial transactions brought about by booming economic activities and wider reach of banks induced the accelerated growth of the financial intermediation sub-sector at 11.1 percent,” said National Economic and Development Authority (NEDA) Regional Director Bonifacio Uy. Industry sector, which accounts 44.3 percent of the regional economy, its growth accelerated from 4.9 percent in 2015 to 20.2 percent growth last year. Its performance is largely driven by excellent performance of construction and manufacturing sub-sectors. Construction went up by 44.5 percent in 2016 from 12.3 percent a year ago while manufacturing rebounded from negative 3 percent to positive 19.6 percent. “The construction sub-sector peaked due to the intensified implementation of public construction projects such as road widening and flood control projects, among others, on top of the remaining post-Yolanda reconstruction projects,” Uy explained. Private construction also contributed to the sector’s growth, precipitated by investments such as the opening of hotels, malls, and other establishments – largely seen as spillover from the gains in the services sector, according to Uy. Agriculture, hunting, forestry and fishing (AHFF) also recovered from 3.5 percent decline in 2015 to 2.4 percent growth in 2016. Farming and forestry rebounded from negative 3.6 percent to positive 1.9 percent. Fishing also managed to improve from 3.2 percent decrease to 4.3 percent increase, according to the PSA.

The average rates for most varieties of home loans dipped by 1 or 2 basis points (a basis point equals 1/100 of a percent) Though fixed rates inched downward, adjustable rate mortgages (ARMs) bucked the downward trend, rising by 1 basis point. The slow but steady increases in rates for most of last week were seen by some as a precursor of what was to come following February’s 0.25% increase in the Federal Reserve’s benchmark fed funds rate. But today’s declines make it two in a row, so Fed-related concerns can be put to bed—for now. Don’t hold your breath though. For homeowners considering tapping into their home’s equity, there was not much change today in home equity lines of credit (HELOC) or home equity loans. Both rates remain above last month’s 5.16% and 5.28%, but at 5.30% and 5.29% are still relatively This Year the Social Security Administration has quietly increased the tax liability for high-income taxpayers. Will your own paycheck be affected? If you take a look at your pay stub, you’ll see a number of wage withholdings that go to pay various taxes. The withholding for Social Security is 6.2% of your wages, but only for the first $118,500 for the year. However, that limitation has changed starting in 2017. The Social Security Administration has raised the Social Security wage cap from $118,500 to $127,200. That’s a tax bump of 7.3% for high earners. As a result, the maximum amount of Social Security tax you can pay for the year will increase from $7,347 to $7,886.40. This is the largest one-year increase in the Social Security taxable earnings cap since 1983. For Wage earner, it just means you are supposedly putting away more money for your future and that also means its taking it away from your paycheck today. The new Social Security Tax Withholding percentage is 6.2%. That 6.2% tax withheld for Social Security from your wages isn’t the only tax money that goes to the Social Security Administration. Your employer also has to pay 6.2% of your salary out of its own pocket for Social Security. If you’re self-employed, you have to pay both sides yourself, resulting in a 12.4% Social Security tax—and an even more significant tax bump in 2017. The IRS does sweeten the self-employed taxpayer’s deal somewhat by allowing them to deduct half of their self-employment taxes from their taxable income. Is that withholding being withheld for your future retirement, yes and no! Contrary to common belief, the Social Security taxes from your paycheck aren’t set aside for your own benefit. The taxes that the Social Security Administration collects today pay for the benefits of current retirees. Any money that’s left over goes into the Social Security trust funds for future use. Because its forever being collected by the time you will be retiring, it will be the future employees withholdings that will be used to pay for your Social Security Retirement Income. Which make sense, we just hope that it does not
run out and go negative balance. In January 2017, retirees received a 0.3% cost-of-living increase to their Social Security benefits. That works out to around $5 extra per month for the average recipient. The maximum Social Security benefit has also gone up slightly for workers who retire at full retirement age, from $2,639 to $2,687. These increases are part of the reason for the taxable-income bump. How the new tax might affect you If you make more than $118,500 a year, your take-home pay will go down slightly because of the additional Social Security tax. Because your employer will also be paying more, it will have to make up for the increased expense somehow, perhaps by cutting wages or deciding not to provide raises in the near term. Thus the increase to the employer’s side of the tax equation may affect you indirectly. What you should do about it If your employer offers you access to a 401(k) plan, consider bumping your contribution to lower your taxable income. Because 401(k) contributions are made with pre-tax dollars, the more you contribute, the less money there is to be hit by that Social Security tax (or any other tax, for that matter). If you don’t have a 401(k) plan, the next best option is to maximize the tax deductions that lower your adjusted gross income. These deductions are valuable because the lower your AGI, the lower your income tax bracket. On top of that, a lower AGI may help you qualify for other deductions and credits that have income caps. These deductions include the traditional IRA contribution deduction, the tuition deduction, the student loan interest deduction, and the health savings account deduction, among others. An experienced tax advisor can work with you to help maximize these and other deductions and generally reduce your tax liabilities. With some careful planning, you can likely cancel out the effects of your increased Social Security tax bill. BuCor-TADECO land deal illegal: DOJ, COA
MANILA, May 3 (PNA) – Initial findings from the Department of Justice (DOJ) and the Commission on Audit (COA) reveal that the land deal between the Bureau of Corrections (BuCor) and the Tagum Agricultural Development Co. (TADECO) is illegal. The DOJ sent a summary of the Preliminary Fact-Finding Investigation Report to House Speaker Pantaleon Alvarez, who requested a review of the 25-year joint venture agreement (JVA) between BuCor and Floirendo-owned TADECO for allegedly being anomalous and disadvantageous to the government. Justice Undersecretary Raymund Mercate said the initial report of the fact-finding panel was “without prejudice to the final review and approval of the Secretary of Justice.” According to the report, the BuCor-TADECO deal failed to comply with legal requirements, noting that: – there is no community of interest in the business by both parties; – no categorical indication of a true and realistic sharing of the profits and losses; – and that BuCor’s participation in the operation and management of the banana plantation is substantially minimal. The DOJ panel further pointed out that the present BuCOR-TADECO JVA has a contract area of 5,308 hectares, which exceeds the limitation of 1,000 hectares under the 1987 Constitution. The BuCor-TADECO deal also violates Commonwealth Act No. 141 or the Public Land Act as the present and earlier agreements since 1969 were never subjected to any public action or bidding, and the contract, covering 1969 to 2029, is more than 10 years the maximum 50 years allowed. “Under the BuCor-TADECO JVA, the production and profit share of the BuCor in 2016 amounted to only PHP44,854,726, or a rate of PHP8,449.83 per hectare per year,” the DOJ panel said. “Compared to the prevailing lease rates of PHP10,000-PHP18,000 per hectare per year of Tanglaw and Cooperative leaseback rates located in the general area where the DPFF lands are located, the BuCor-TADECO JVA appears to be disadvantageous in terms of per hectare rate,” it added. Meanwhile, the COA conducted its own investigation on the BuCor-TADECO deal and sent an Audit Observation Memorandum to BuCor Director General Benjamin Delos Santos. In the memorandum, the audit team said the 1969 deal between BuCor and TADECO is unconstitutional since it did not comply with the 1935 Constitution that only allowed a maximum of 1,024 hectares of public lands to be leased. The COA memorandum noted that BuCor allowed the lease of a 3,000 hectare-public land to TADECO in its 1969 deal. Similarly, the May 21, 2003 JVA is also unconstitutional because the “5,308.36 hectares landholding of TADECO over an agricultural land”, exceeded the limitation of 1,000 hectares provided under the 1987 Constitution, the COA noted.

LA City Council declares May 2nd as Fresh Off the Boat Day By Abner Galino
The Los Angeles City Council has declared May 2nd as “Fresh Off the Boat Day” in recognition of the show’s positive portrayal of Asian Pacific Americans (APAs) in mainstream media. The recognition of the ABC’s successful comedy show was part of the celebration of the Asian Pacific American Heritage Month (APAHM). Los Angeles Mayor Eric Garcetti, during his turn to commend the Fresh Off the Boat’s cast and producers at City Council plenary hall, said he and his wife were big fans, adding that the show plays out the “American story that we all can connect to … the voices and faces that are often written out in Hollywood.” City Council president Herb Wesson, who called the show hilarious and classy, recalled that he couldn’t see anyone who looked like him on TV when he was a boy. “And it was disturbing. So to me, it is important that when we watch television, we try to depict the real world and the real issues,” Wesson said. For his part, Council member David Ryu, said Fresh Off the Boat “is milestone for Asian American and immigrant communities,” bring together audiences in this way and tell the unique plight of an Asian American immigrant family is a show worth celebrating.” “It is the first Asian American comedy sitcom in over 20 years,

For the first time in the history of the City of Cerritos, two Filipino-American politicians (one of them actually a Japanese-Filipino-American) are going to serve together in the five-member City Council. The election of Frank Aurelio Yokoyama as council member apparently empowered incumbent fellow Filipino-American council member Mark Pulido who became mayor pro tem. Yokoyama’s ascension also resulted in the appointment of Grace Hu as city mayor. Hu and Yokoyama both won the elections held last April 11 to fill up two vacant seats in the city council. After the program to give commendations and recognitions for outgoing mayor George Ray and council member Carol Chen was over, Hu and Yokoyama were swore in as new members of the city council. And then, the atmosphere in the chamber suddenly became explosive. As soon as City Clerk Vida Barone declared the mayoral chair vacant;Yokoyama quickly nominated Hu. The nomination was seconded by Pulido. Council member Jim Edwards nominated for mayor NareshSolanki who was then the mayor pro tem. In nominating his peer, Edwards averred that“the natural progression is for him (Solanki) to be our next mayor.” However, Hu defeated Solanki in a 3-2 vote. After being declared mayor, Hu opened the nomination for mayor pro
tem. Acting swiftly again, Yokoyama nominated Pulido this time. Pulidoalso beat Edwards in a 3-2 vote. Edwards later went on a long rant against the appointment of his peers. According to him, it has been a tradition in the city council for the mayor pro temp to succeed the outgoing mayor. “I feel this is a sad day in many respects. What are we saying about tradition and respect? What has been done this evening is wrong. It is not about personalities. What are we telling our children? The natural progression has been interrupted and Solanki has not been given his fair opportunity. This is not the Cerritos I have lived in. I am very disappointed in what has transpired tonight,” Edwards said. But new mayor Hu quickly rebutted Edwards. “Things have changed, Hu said, “it is not a it is a great day for the City. We have new council members to work for the City and work for the people, we were elected and received the majority vote to be Mayor and Mayor pro-temp, I congratulate Mark as Mayor pro tem. Mark is a very experienced council-member who works very hard for the City, this is not a sad day.” Pulido for his part, said that the real “sad day” was when he received an email from a former council member that supposedly contained “a spread sheet ….dictating who should become mayor and mayor pro tem, outside of the public interest.” “What you have seen here today may not be pretty or comfortable, but

It turned out that in 2013, Pulido – reportedly as a matter of right as a council member – appointed Yokoyama to the Planning Commission. However, then Cerritos Mayor Bruce Barrows and council members Carol Chen and George Ray denied Yokoyama’s appointment to the Planning Commission. Yokoyama cited this incident as a
reply to Edwards’ insinuation that the bypassing of Solanki was disrespectful. “Mark was disrespected. He wanted to place me on the Planning Commission, his council right was disrespected, your right to appoint was denied. DOH urges local execs to help sustain immunization MANILA, April 25 – The Department of Health (DOH) has called on local chief executives (LCEs) and international partners to help ensure that immunization is available and sustainable across all administrative levels in the country for the benefit of Filipino mothers and children. “All LCEs are being called (upon) to support vaccination activities through the provision of funds and social mobilization,” Health Secretary Dr. Paulyn Ubial said Tuesday as the department joined the rest of the global community in observing “World Immunization Week” on
April 24-30. This year’s theme is “#VaccinesWork to Protect Individuals and Communities”. DOH spokesperson Dr. Eric Tayag likewise stressed the importance of access to and use of vaccines to guard against preventable illnesses. “While we have the vaccine and we are making them accessible, awareness should be further increased also,” Tayag said. Current data on fully-immunized children show a declining trend in immunization coverage in the past three years from 74 percent in 2014,
US researchers eliminates HIV infection in ‘humanized’ mice WASHINGTON, May 2 – U.S. researchers said Monday they have successfully removed human immunodeficiency virus (HIV) deoxyribonucleic acid (DNA) from the genomes of living animals using a gene-editing tool, giving scientists a boost in confidence to eventually eliminate the acquired immunodeficiency syndrome (AIDS) virus infection in human patients. In a new study published in the journal Molecular Therapy, researchers at Temple University and the University of Pittsburgh reported performing the feat in three different animal models, including a “humanized” model in which mice were transplanted with human immune cells and infected with the virus. The team is the first to demonstrate that HIV-1 replication can be completely shut down and the virus eliminated from infected cells in animals with a powerful gene editing technology known as CRISPR/Cas9. The new work followed a previous proof-of-concept study that the team published in 2016, in which they used transgenic rat and mouse models with HIV-1 DNA incorporated into the genome of every tissue of the animals’ bodies. “Our new study is more comprehensive,” Wenhui Hu, associate professor at Temple University, who led
the study, said in a statement. “We confirmed the data from our previous work and have improved the efficiency of our gene editing strategy. We also show that the strategy is effective in two additional mouse models, one representing acute infection in mouse cells and the other representing chronic, or latent, infection in human cells.” In the new study, the team genetically inactivated HIV-1 in transgenic mice, reducing the RNA expression of viral genes by roughly 60 to 95 percent, confirming their earlier findings. They then tested their system in mice acutely infected with EcoHIV, the mouse equivalent of human HIV1, and found the excision efficiency of their strategy reached 96 percent in these animals. In the third animal model, latent HIV-1 infection was recapitulated in humanized mice engrafted with human immune cells, including T cells, followed by HIV-1 infection. “These animals carry latent HIV in the genomes of human T cells, where the virus can escape detection,” Hu explained. Following a single treatment with CRISPR/Cas9, viral fragments were successfully excised from latently infected human cells embedded in mouse tissues and organs, he said.
Active video games good for brain health of elderly people: study LONDON, May 3 – Older people should play active video games to boost their brain health, a study by academics at the University of Manchester showed Wednesday. A study found that active gaming is good for brain health and memory and video games that involve physical activity significantly boost brain health as people get older, experts found. Study authors Dr. Emma Stanmore and Joseph Firth say systems that use physical activity for gaming, such as Wii and Xbox Kinect, can boost brain functioning in people with neurological impairment, as well as keeping minds healthy and active as people age. In the first-ever analysis of all published evidence, the researchers studied data from 17 clinical trials, examining the effects of active gaming on cognitive functioning among almost 1,000 people. Their results have been published in the journal Neuroscience and
Biobehavioral Reviews, describing what was a collaboration between the University of Manchester, King’s College London, KU Leuven and ETH Zurich. Firth said, “As people age, their brain functioning, such as memory, concentration and spatial awareness naturally decline. “Various neurological conditions such Alzheimer’s and Parkinson’s disease, mild cognitive impairment, and dementia can also impede people’s cognitive functioning and reduce their ability to function day to day. “Recently, there has been much interest in using active video games in the rehabilitation of these conditions, and to promote healthy aging. “So we were fascinated to learn that the available evidence shows how these sort of games can significantly improve overall cognitive functioning, and is particularly beneficial for attention, executive functioning and visuospatial abilities.

Young Ilocanos donate blood for the first time to save lives LAOAG CITY, April 26 – When a medical staff started to clean her arm with antiseptic and inserted a needle into her vein, 20-year-old Sharie Mae Tabuyo of San Jose village in San Nicolas town felt a little discomfort until she saw her blood running into the container bag. A few minutes later, a smile of relief marked her face as she took pride of herself, saying, “I am a blood donor, I save lives.” Tabuyo is among the first time blood donors in Wednesday’s blood letting activity organized by the Sirib Ilokano Kabataan Association (SIKA) for the first time in partnership with the Ilocos Norte Youth Office and the Philippine National Red Cross. Held at the Provincial Capitol auditorium, most of the participants are youth volunteers and young professionals aged 18 to 25. Arjay Rumbaoa, 21, admitted he was hesitant at first to donate blood but when he heard a representative of the PNRC discuss the benefits of donating blood, he was convinced to give it a try. “Whenever I see blood, I get nervous. Now, I know it is safe to donate blood. I’m happy because my blood will go a long way to help others,” said Rumbaoa as he opined, “It’s about time that we do something to effect change in our country. I promise that I will continue to donate blood whenever I can.”
