US WARNS TRAVEL TO PALAWAN
MANILA, May 10 – The Western Command (WESCOM), which is responsible for the security of Palawan and the West Philippine Sea, has deployed ships and personnel to safeguard known tourist areas in wake of the US travel advisory against the province. This was stressed by its head, Lt. Gen. Raul Del Rosario, in an interview Wednesday, and said these units are being aided by various inter-agency task forces. He added that all WESCOM units, ever since the botched Inabanga, Bohol landing of Abu Sayyaf Group (ASG) sub-leader Muamar Askali alias “Abu Rami” last April 10, has been on heightened alert. AFP respects US travel advisory on Palawan, yet to detect any threat MANILA, May 10 – The Armed Forces of the Philippines respects the US government’s decision to issue a travel advisory warning its citizens of possible kidnapping attempts by terrorist groups in Palawan but has yet to detect any threat that could compromise the safety of tourists visiting the island, a military official said Wednesday. “We respect the issuance of (the US) travel advisory. We recognize that it is both an obligation and right of a sovereign state. We do that to our own nationals sojourning
abroad,” AFP public affairs office chief Col. Edgard Arevalo said. In its website, the US Embassy warned its citizens against traveling to Palawan as it has received credible information that some terrorist groups are planning to abduct foreign nationals in the province. Cayetano can be confirmed by acclamation – Lacson MANILA, May 10 – Sen. Panfilo Lacson on Wednesday said that newly-appointed Foreign Affairs Secretary, Sen. Alan Peter Cayetano can be confirmed by the Commission on Appointments (CA) by acclamation. Pres. Rodrigo Duterte confirmed that he had just signed Cayetano’s appointment paper in a pre-departure press briefing before embarking to Cambodia for the World Economic Forum (WEF) on ASEAN. Cayetano is also Pres. Duterte’s running mate in the May 2016 presidential elections. Pres. Duterte had repeatedly stated during interviews that he would offer the Foreign Affairs post to Cayetano once the one-year appointment ban lapses. Lacson, chair of the CA Foreign Affairs
Committee, was hopeful that Cayetano can be easily confirmed as he is a seating Senator and member of the CA. “I hope that we can confirm Sen. Cayetano’s nomination right after he completes the submission of the documentary requirements and the publication rule have been complied with so he can immediately assume office as DFA Secretary,” Lacson said in a statement. “With the permission of the majority of the members of the CA, we can even suspend the rules and waive all the requirements out of courtesy to a sitting member of the Senate as well as the CA itself and confirm him by acclamation,” he added. Ethics complaint filed vs Sotto MANILA, May 10 – An ethics complaint against Senate Majority Leader Vicente Sotto III was filed in the Senate on Wednesday after his controversial remark about single parents in a previous hearing with the Commission on Appointments (CA) last week. During the hearing on the confirmation of Social Welfare Secretary Judy Taguiwalo last May 3, Sotto cracked a joke about her admitting to being a single mother which caused a public stir. DOJ reports to UN: Cases under EJK goes trial in courts
MANILA, May 9 (PNA) = Department of Justice Undersecretary Reynante Orceo said that number of cases of extrajudicial killings are now undergoing trial in various courts. ” The government has an Inter-Agency Committee created under Administrative Order (AO) 35 that works to resolve cases of enforced disappearances, torture, and other grave violations of the right to life, liberty, and security of persons. By domestic definitions, extra judicial killings applies only to victims belonging to any cause oriented groups or to those individual that advocate for similar cause,” Orceo said during his presentation to the United Nations body conducting a review of the country’s human rights situation. The inter-agency is composed of the DOJ, Department of the Interior and Local Government, Department of National Defense, Office of the Presidential Adviser on the Peace Process and the Office of the Presidential Adviser for Political Affairs. It is tasked to resolve cases of enforced disappearances, torture and other grave violations of the right to life, liberty and security of persons. Orceo, who was part of the country’s delegation, said in his report that 1, 089 incidents had undergone validation by an inter-agency created under Administrative Order 35. “Since its creation in 2012, the committee has processed 1, 098 incidents for validation while 30 cases are currently undergoing trial,” Orceo said in his report though he did not mention the nature of these EJK cases.
He explained to the body that by domestic definitions, extrajudicial killings applies only to victims belonging to any cause oriented groups or to those individual that advocate for similar causes. “Hence, any crimes committed outside of these definitions are not included, and therefore, treated as regular crimes and prosecuted accordingly,” Orceo added. Orceo said the mechanism pursues regular case conferences and trainings for those involved in investigation and prosecution. Orceo also assured the body that the Philippine government is doing everything to address the problem of human trafficking, adding that the inter-agency committee has even expanded the coverage by including involuntary servitude. “As of August 2016, there have been a total of 243 convictions involving 272 persons found guilty of trafficking. Its success earned for the Philippines a Tier 1 ranking by the United States State Department, the highest compliance level, in June 2016,” Orceo said in his report. He added that as a sign of its commitment to the global fight against human trafficking, the government has ratified the ASEAN Convention Against Trafficking in Persons as well as the Child Protection Compact partnership with the United States. The official said the government would also continue to search for ways to further improve the witness protection program as part of the overall anti-criminality campaign.

MANILA, May 10 (PNA) – President Rodrigo Duterte congratulated newly-elected South Korean President Moon Jae-in, who was sworn into office Wednesday. “On behalf of the Filipino nation, President Rodrigo Roa Duterte wishes to extend his warm congratulations to Mr. Moon Jae-in on his election as the new President of the Republic of Korea,” Presidential Spokesperson Ernesto Abella said in a statement. Cimatu calls for solidarity in protecting the environment as he takes over DENR MANILA, May 10 â&#x20AC;&#x201C; â&#x20AC;&#x153;Weâ&#x20AC;&#x2122;re all in this together.â&#x20AC;? Thus said newly installed Environment Secretary Roy Cimatu as he called for solidarity in protecting the countryâ&#x20AC;&#x2122;s environment and natural resources during the turnover ceremony held at the DENR central office in Quezon City on Wednesday. Cimatu, the 16th DENR Secretary since the agency was reorganized in 1987, said environmental protection requires teamwork among those in the DENR, various stakeholders and the general public. â&#x20AC;&#x153;I cannot do this alone, President Duterte cannot do this alone. We need all hands on deck,â&#x20AC;? Cimatu said in a speech after the DENR leadership was formally transferred to him by outgoing Secretary Gina Lopez. The new DENR chief specifically mentioned â&#x20AC;&#x153;the men and women of the DENR from the senior officials at the central office to the rangers, foresters, geologists and even janitors on the ground.â&#x20AC;? He also mentioned the various clients of the DENR, including big and small businesses and all households, as well as agencyâ&#x20AC;&#x2122;s international partners. â&#x20AC;&#x153;We have to work together as a team. With teamwork, we can do so much more in accomplishing the critical responsibilities we carry on our shoulders,â&#x20AC;? he pointed out. Nevertheless, Cimatu said he will try to do his best as â&#x20AC;&#x153;President Duterteâ&#x20AC;&#x2122;s point man in the daunting task of protecting our environment in all its forms.â&#x20AC;? Football player and Heisman trophy awardee, Tim Tebow, proud of his Philippine roots This author’s grandson Marcus, currently plays football in their community’s Little League in San Diego. But it wasn’t really him who informed this author of the story of Tim Tebow and his Philippine roots. Though his dad, son Michael had mentioned it before, it wasn’t until this author received a recent social media posting, where an Upsilon fraternity brother from North Carolina, Bill Arcebal sent his photo along with Tim Tebow and his team, who obliged to take their photo as “kababayans,” at the gym in their small town of Hickory, where they all met. According to Bill, the story was “Tim’s parents - mother, Pamela Elaine (Pemberton) and Robert Ramsey Tebow II, met while they were attending the University of Florida in the late 60’s, when she was a freshman and he was a sophomore. They were married after Pamela’s graduation on June 12, 1971. In 1985, the Tebows served as Baptist missionaries, and they moved to the Philippines to build a ministry. However, prior to becoming pregnant with Tim, his mother contracted amoebic dysentery and she fell into a coma. While recovering, she discovered she was pregnant but due to the lack of medications in treating her, doctors expected a stillbirth and recommended abortion. But the Tebows decided against it, citing their strong faith. (Also, as a Catholic country, abortion is prohibited in the Philippines). The Tebows’ strength in their faith, allowed them to be blessed with the birth of their youngest son Timothy RIchard, on August 14, 1987 in Manila..Along with instilling the family’s Christian beliefs, the Tebows moved back to Jacksonville, Florida, where the Tebow children were home-schooled. In 1996, the school district where the Tebows lived passed a law which allowed Tim Tebow to play football, while attending high school at the Trinity Christian Academy and in 2003, he became eligible to play at the football program of Allen D. Nease High School, where he became a quarterback. Later in his senior years, he was named ‘ Florida’s Player of the Year,’ and he became a quarterback prospect for the University of Florida’s Gators football team. Apparently, on December 8, 2007, Tim Tebow was awarded the Heisman Trophy as ‘outstanding college football player of the year.’ He was the first sophomore to win
such an award. And the following year, on November 1, 2008, playing against the Georgia Bulldogs,Tebow ran for his 36th rushing touchdown, breaking the record previously held by former Florida running back, Emmet Smith. Though he finished 3rd place in the 2008 Heisman Trophy, he won the Maxwell Award the same year. He was only the second player to ever win the award twice. The following year, Tebow graduated from the University of Florida in December, 2009. Subsequently, on July 29, 2010, Tim Tebow signed a five-year contract with the Denver Broncos. However, he was traded to the New York Jets on March 21, 2012 thus, his stint there was short lived because he signed up with the New England Patriots on June 10, 3013, but was later released by the Patriots on August 31, 2013. On May 31, 2011, book publisher, Harper Collins released ‘Through My Eyes,’ an autobiography he cowrote with Nathan Whitaker, which detailed his early life growing up in Jacksonville and in the Philippines. Along with this Christian faith, the term ‘Tebowing,’ became known worldwide as a neologism termed for the ‘act of kneeling on one’s knee in prayer with one’s head bowed and an arm resting on the one knee when kneeling, which signifies genuflecting. This origin of Tebow’s gesture was posted by a fan, Jared Kleinstein on Facebook where he captured the image of Tebow’s pose after the Broncos comeback overtime victory over the Dolphins , on October 23, 2011.’ In the interim, Tebow launched his broadcast career on December, 2013, with the SEC Network , but four months after that, he signed a oneyear contract with the Philadelphia Eagles on April 20, 2015, however, he was released by the Eagles on September 5, 2015 after playing all four games in the preseason with two touchdowns and one interception, while rushing for 82 yards and a touchdown. Finally, last year, on September 8, 2016 he signed a minor league contract with the New York Mets and

Foreign domestic workers in Singapore to be better protected under new rule SINGAPORE, May 8 – Singapore’s Foreign Domestic Workers (FDWs) will be better insured under a new rule which takes effect from Oct. 1, 2017, said Ministry of Manpower on Sunday in a news release. The ministry said it will be making changes to the Personal Accident Insurance (PAI) requirements so that FDWs will be adequately compensated should they become permanently disabled or passes away during their employment in Singapore. In addition, the minimum sum assured will be revised from 40,000 Singapore dollars (USD 28,476) to 60,000 Singapore dollars (USD 42,714). Under the revision, all FDWs will
receive the same protection throughout their employment in Singapore. Currently, different insurers provide different coverage for PAI, with some insurers taking a narrower definition of accidents and imposing more exclusions. Minister of State for Manpower Sam Tan noted that the changes will help employers better protect their maids at a slight increase in premiums, and give maids greater peace of mind. “We trust that these changes will further facilitate a harmonious working relationship between employers and their foreign domestic workers,” he said. MANILA, May 9 (PNA) – The European Union (EU) is gearing up for rollout of a project designed to ensure that former drug addicts do not return to their old habit, as more countries continue to offer support for Duterte administration’s aggressive war against illegal drugs. EU Ambassador to the Philippines Franz Jessen told reporters the project involves constructing half-way houses in barangays across Luzon. “We call it half-way houses where you have people who are out of drugs but you want to make sure they are out of drugs so you work with their families, you work with the neighborhood. (This is) trying to make them understand that being drug-free is important. Imperative to that discussion is the provision of job opportunities, do what they used to do,” he said. If such system becomes effective, Jessen said they would roll-out the project in other areas outside Luzon. Jessen further said the EU is working with the Department of Health
(DOH) and the World Health Organization (WHO) for the implementation of such project, as they incorporate the best experiences and introduce them in the Philippines. “It is also strictly voluntary, if people (who are already out of drugs) are ready to do this, then we are ready to help,” he added. More drug treatment and rehabilitation centers are expected to be completed before the year ends, which were funded through donations from local private sector firms and foreign agencies, including Chinese non-governmental organization Friends of the Philippines, Ministry of China and Japan International Cooperation Agency. For example, somebody might come to the U.S. on a B2 Visitor Visa and get married two weeks later. They might look online to see the forms they need to complete to get a green card based on a marriage petition. Then, at the interview, the case is denied and the applicant is deported. Why? It would have been fraud to get married within 30 days of entry to the U.S under those circumstances. Because it turns out that the company that petitioned the person for the green card went bankrupt prior to actually working at the company. The naturalization officer stated green card should never have been given. 2 bills seek stricter road safety policies
MANILA, May 10 – Two measures were filed by Sen. Joseph Victor Ejercito on Wednesday seeking to impose stricter policies on road safety. One of these was the Child Safety in Motor Vehicles Act of 2017 or SBN 1447, which proposes the use of a child restraint system designed to protect infants and children from effects of the sudden stop of vehicles. Ejercito, vice chair of the Senate Committee on Public Services, said the passage of such law would be timely as more families now prefer to use their own vehicles to get to their destination. He further said that when correctly installed and used depending on the child’s size, height and weight, child restraints are proven to reduce fatal injuries among infants by approximately 70 percent. The senator explained said that while the use of seat belts to reduce death among drivers and passengers is mandatory, the law only protects adults and is not purposely adapted
for infants and children. “The lack of a road safety law that targets children and infants is what I would want to address. This is why I am seeking to pass the use of a Child Restraint Systems in private vehicles,” Ejercito said in filing the measure. Ejercito’s other measure is the Anti-Overloading Act of 2017 or SBN 1446, meant to impose stiffer penalties on public utility vehicle (PUV) operators violating the prescribed maximum capacity of vehicles as stated in the law. He said this will prevent freak accidents, citing the overloaded bus that fell into a 100-feet ravine in Nueva Ecija last month. His bill proposes a PHP50,000 penalty including suspension of franchise for the first offense; PHP250,000 including suspension of franchise for the second offense; and PHP1 million and revocation of franchise for the third offense.
MMDA to clear heavily congested areas in Metro Manila before year end MANILA, May 9 – The Metropolitan Manila Development Authority (MMDA) is eyeing to clear other heavily congested areas in Metro Manila before the end of the year. In a news release issued Tuesday, MMDA General Manager and Officer-in-Charge Thomas Orbos said they are now targeting Balintawak, Cubao, Quiapo, Alabang, Monumento and Divisoria, which are known traffic choke points in the metropolis. Orbos said they intend to start towing and impounding illegally parked vehicles in these areas before
December this year. “We want to continue these operations and to strike while the iron is hot, so to speak, and while we have the momentum on our side,” he said, citing the agency’s success in opening up four lanes to motorists after clearing Baclaran’s service road of street vendors and illegal terminals without any untoward incident. “Everyone thought that clearing and cleaning Baclaran is an insurmountable task but nothing is impossible if we work together to achieve a common goal,” said Orbos.

5-year driver’s license validity ‘a done deal’ – Poe MANILA, May 9 – The proposed measure to extend the driver’s license validity from three to five years will soon be advancing to the Senate plenary where its approval is “a done deal”, Sen. Grace Poe assured Tuesday. Poe, chair of the Senate Committee on Public Services, made this remark during the Senate hearing on Senate bills seeking to extending driver’s license validity to five years namely SBN 271, 941 and 1224. These measures were filed by Senate Pres. Pro-Tempore Ralph Recto, Senators Richard Gordon and Joseph Victor Ejercito, respectively. “…Referring it to the plenary is a foregone conclusion. And its approval, I can say with certainty, is a done deal,” Poe said during the hearing. At the end of the hearing, Poe’s committee approved in principle the measures seeking to extend driver’s license validity to five years since there were no opposition proposals. “Our committee shall now be working on a final and consolidated version of the bill and present it to the plenary soon,” she said. In an interview with reporters after the hearing, Poe said her committee is set to prepare a report on the measure and targets its passage before the Senate adjourns.

Grounds for Annulling a Marriage Most couples that want out of a marriage in California usually file for Divorce. There are circumstances though that allow a couple to have their marriage â&#x20AC;&#x153;voidedâ&#x20AC;? rather than â&#x20AC;&#x153;dissolved.â&#x20AC;? There is a big difference between the two concepts. With a voided marriage, it restores the couple to status of unmarried person as if they have never been married before. In a divorce, the couple would always be regarded to as married during the period of the marriage. Unlike Divorce which can be obtained regardless of the reason. Voiding a marriage may only be obtained based on certain grounds. It is void in cases of incest and bigamy. It is voidable in cases of minority, Unsound Mind, Fraud, Force, or Physical Incapacity. Marriages between parents, children, ancestors
and descendants, brothers and sisters, half brothers and sisters, uncles and nieces, and aunts and nephews are incestuous and are void from the beginning. So are bigamist marriages where either party was still married to another person when they entered the marriage. Nevertheless, it is best to obtain a Nullity Judgment to clarify the legal status of the parties under these circumstances. Certain situations does not necessarily make a marriage void but makes it voidable on the parties option. One such circumstance is when the petitioner was under 18 years old when the petitioner married and the parents did not provide their consent. The Nullity petition based on this ground has to be filed within four years after the party turns 18. The parent of the minor may also file the Petition provided it is filed prior to the minor turning 18. Another situation is a bigamist marriage where the first spouse has been absent and not known to be living for 5 years prior to the second marriage or if the party believed the spouse to be dead at the time of the second marriage. A Nullity based on this ground may be filed during the life of the other party. A marriage may be voided if either party was of unsound mind at the time of the marriage. Unsound Mind means a person is incapable of understanding the nature of the marriage contract and the duties and responsibilities it creates which depends on
the degree of mental capacity of the party. This may not be a ground if the party later on came to reason yet continued to freely cohabitate with the spouse. Fraud is another ground for voiding a marriage. The false representation or concealment must relate to a substantive matter and directly affect the purpose of the party deceived in entering the marriage. The fraud must go to the very essence of the marital relation before it is sufficient for an annulment. It is not sufficient simply to contend that your spouse turned out to be a lazy, drunken disappointment. Nullity based on fraud has to be filed within four years of discovering the fraud. Certain marriages that are entered into by force are voidable. Circumstances that meet these standards requires that the forced partyâ&#x20AC;&#x2122;s free will to have been overcome by the spouse such as through the use of threats. These type of Nullity must be filed within four years from the date of marriage. A marriage where the spouse was found to be incapable of physically engaging in copulation may be voided. It can only be filed by the spouse that does not have the physical incapacity and must be filed within four years of the marriage. Before deciding weather a divorce is the appropriate avenue to end your

marriage, parties should evaluate if a Nullity is a viable alternative and weather it serves their best interest. Abandoned wife needs Chapter 7 for $50k debt and Uber driver seeks to discharge $20k credit cards
First client is 48 and married in the last 4 years. Husband was a foreigner who professed his love for her in so many ways. Unfortunately, his love for her was actually for her U.S. citizenship. Client, who had never been married before, fell head over heels for her newfound Romeo whom she met in a party in her hometown. He looked handsome and dashing in his own peculiar way. Never mind that he was height challenged at 4 feet 4 in and had web fingers and toes.He was an athlete and was the fastest swimmer in their town. His nickname was â&#x20AC;&#x2DC;Aqua-Man.â&#x20AC;&#x2122;All of these traits did not bother client; in fact, it was these traits that endeared him to her. She called him my â&#x20AC;&#x153;BBâ&#x20AC;? for baby â&#x20AC;&#x153;belugaâ&#x20AC;?. She reasoned that he would have no problem getting a job in California. Sea world in San Diego would certainly offer him a job to swim with the dolphins and whales. Well you know how the K-1 fiancĂŠe visa works. You have to prove to the INS that you met your loved one at least two years before the petition date with evidence consisting of pictures with dates on them, cards, letters, emails, the works. Itâ&#x20AC;&#x2122;s just too bad that there is no camera that can take a picture of the real intent of the human heart. Client petitioned husband for his green card as soon as they were married. It wasnâ&#x20AC;&#x2122;t a $15M wedding like Kanye and Kimâ&#x20AC;&#x2122;s in 2014. Clientâ&#x20AC;&#x2122;s reception was held in a popular restaurant a block from Trump Towers. All of clientâ&#x20AC;&#x2122;s family, her brothers and sisters attended her wedding, all of them trying to convince her not to marry the guy. â&#x20AC;&#x153;Why him?â&#x20AC;? â&#x20AC;&#x153;Youâ&#x20AC;&#x2122;re better off being single than marrying that human milkfish!â&#x20AC;? said her older brother. Her guest of
honor, FBI director Comey said, â&#x20AC;&#x153;It just makes me nauseous to see you marry this guy, he looks fishy to me!â&#x20AC;? But despite all of the well-intentioned objections of family, friends and the FBI, client tied the knot. She charged their honeymoon, a 2-week cruise in the Mediterranean, to MasterCard. That was followed by a romantic river cruise at St. Petersburg in Russia and a 3-week Asian tour of China, Japan, Korea and all the Southeast Asian countries. The honeymoon set her back $50K but thanks to MasterCard and visa, she was given the opportunity to make minimum payments of $1500 a month for the $50K of credit cards. Money she thought was well spent. It was her dream come true, to see the world with her prince charming. She was a certified nursing assistant who grossed $3K a month. Her take home pay is $2400. 62.5% of her take home pay or $1500 is for monthly minimum payments on her $50K credit cards. So she has $900 left before rent. They rent a room for $600 so she has $300 left for food. What about her husband? Well, he did not want to work because he said that as head of family, she should be the one working. He decided he would just stay in the room and watch Disney movies the whole day. So, client decided to get a second job to pay for monthly necessities and the immigration lawyer fees for husbandâ&#x20AC;&#x2122;s green card.
Since the petition was filed before the Trump era, husband beneficiary was not fully vetted. He obtained FBI clearance despite Mr. Comeyâ&#x20AC;&#x2122;s objections, and soon enough he became a legal permanent resident of our country which at that time was not â&#x20AC;&#x153;great again.â&#x20AC;? Our country, at that time, was just â&#x20AC;&#x153;so-soâ&#x20AC;?. As it turned out, beloved husband was actually secretly married in his country of origin. So again, the FBI did not uncover this anomaly so the INS allowed a criminal bigamist to become a legal permanent resident. â&#x20AC;&#x153;Bigly Bad!â&#x20AC;? â&#x20AC;&#x153;Thatâ&#x20AC;&#x2122;s a no-no!â&#x20AC;? As soon as he got legalized, he disappeared. Client hired the best private investigator that money, or credit cards could buy. It was finally determined that he had gone to another state. He filed for divorce from client since he already got legalized and client had maxed out her credit cards. No more honeymoons for free around the world. Thus, being now of sound mind and body, client decided to forget her fake husband and start fresh without accumulated debt. She decided to discharge the $50K of credit cards with a Chapter 7 petition. Finally, sheâ&#x20AC;&#x2122;s making the right decision for herself. Second client is 45. He owes $20K of credit cards. He pays $750 a month for minimum card payments. He is self-employed because he makes his living by driving full time for UBER. By full time, I mean 5 days a week. He has a late model SUV, which he pays $400 a month. His gas expense is $125 a week or $500 a month. So, if you are wondering how much you can make driving UBER 5 days a week, you will gross $3500, less $500 for gas.

MANILA, May 9 – Aside from securing the country’s internal and external threats, it is also the duty of the military to help the government stabilize the situation in any disaster-stricken area in the event of a massive calamity. MANILA, May 10 – President Rodrigo Duterte had a dialogue with picketing farmers at the foot of Mendiola bridge Tuesday. The farmers, who belonged to peasant organizations from Tagum, Davao del Norte and other parts of the Davao region, wanted to reclaim the lands that had already been awarded to them but are still controlled by wealthy landowners. The President expressed his disappointment over the courts’ usual practice of issuing temporary restraining orders (TROs) that affect the government’s administrative powers. “Nandiyan iyan palagi iyang TRO, TRO ninyo, hindi nakagalaw ang gobyerno. ‘Wag ninyo gawin ‘yan, kasi mabaho na style ‘yan (These TROs are always there, restraining the government),” he said. He said he is against exerting undue influence that oppresses poor people, stressing he won the presidency through the support of the masses. “Ibalik ninyo sa tao ‘yung lupa nila. Ipagbili ko kasi kailangan ko pang magpagawa ng ospital, magpagawa ng eskwelahan, magpagawa ng bahay kasi nag-agawan na nga itong mga sundalo natin (Return the land to the people. I still need to build hospitals, schools, housing for the military),” he said, referring to controversial properties that remain in the hands of the rich and influential. The President instructed the Department of Agrarian Reform to distribute lands intended for farmers, so long as the properties comply with the requirements of the law. On May 1, 200 banana plantation farm workers belonging to the Madaum Agrarian Reform Beneficiaries Inc. (MARBAI) in Tagum, Davao del Norte set up a picket in Mendiola, demanding the return of land previously awarded to them. They want President Duterte to intervene and direct Lapanday Food Corp. to turn over the lands to agrarian reform beneficiaries, end violent attacks against the farmers, and implement a genuine land reform program. Palawan terror threat serious Letters from Davao: Gina is Mine alone
MANILA, May 10 – Sen. Panfilo Lacson on Wednesday urged the Philippine National Police (PNP) and Armed Forces of the Philippines (AFP) to take terror threats in Palawan seriously and learn from past experiences. Lacson, former PNP chief, made this remark after the US Embassy, on its website, warned its citizens against traveling to Palawan as it has received information that some terrorist groups are planning to abduct foreign nationals in the province. Threatened by purported terrorist activities in Palawan are Puerto Princesa City and areas surrounding the Puerto Princesa Subterranean River National Park. “We should take it seriously. Past experience would tell us that if they have an advisory like that, it’s not just plucked from thin air, they have basis. They have intelligence,” Lacson told reporters in an interview. Lacson, however, said that he was confident that the AFP has been taking the necessary precautions. “...I trust the AFP and the PNP are already doing something about that advisory,” he added. AFP Public Affairs Office Chief Col. Edgard Arevalo earlier said that the AFP respects the US government’s decision to issue a travel advisory warning but has yet to detect any threat that could compromise the safety of tourists. Despite not having monitored threats in Palawan, Arevalo said that the AFP is not taking the report lightly. He said that whether this is a threat or not, the AFP takes all reports seriously and they will continue their monitoring activities and remain vigilant of all eventualities. Lacson said the AFP does not want to unnecessarily cause alarm because it has an impact to tourism. Asked if it was proper for the US Embassy to issue travel warnings before AFP confirms possible terror threats, Lacson said that the AFP withheld information for “obvious reasons.” “(The embassies) are concerned about the safety of their citizens. We have the same information but we’re not sharing it for obvious reasons. Because while we are checking the information, we don’t want to necessarily alarm the international community, specifically tourists that visit our country,” he added. On April, several foreign travel warnings were issued against Central Visayas due to the encounter between security forces and a terror group in Bohol. The Department of Tourism earlier called on embassies to issue “fair” travel advisories against countries that were dependent on tourism. Tourism Secretary Wanda Teo, meanwhile, assured that despite some cancelled bookings, this would not affect the target of achieving the 7-million foreign tourist arrivals by yearend.

It is vital as it defines what DENR will be under Gina had she won the nod of the Commission of Appointment (CA). Sad that the heated exchanges focused solely on the incendiary issues of conflict of interest of members of the CA but even that, had it been impartially scrutinized, would reveal whose interest was really at work and why. We have heard it all. The passionate repartee of Gina including her swan song “I believe I can fly”. In the faraway nook in Mindanao, I listened to the speeches and watched the unfolding drama following the verdict of the CA. I cringed each time mouths wag in an outburst of emotion and condemnation why Gina was rejected. The social media was up in smoke. Gina is a personification of an environment guardian and a nominee of President Rodrigo Duterte so why reject her as DENR Secretary? Amidst the furor I had wanted to raise some issues of concern but, apprehensive I will sound irrelevant to the popular outcry, I hedged. In the first place President Duterte had been rooting for her. Now that the dusts had settled and the noise is but a whimper allow me to bring these matters out. I have been receiving some disturbing information shortly before and after the CA made their final deliberation on the fate of Gina. Please check these out: Is it true that then Secretary Gina Lopez granted authority to San Roque Metals Inc. (SRMI) to continue with their mining operations in Tubay, Agusan del Norte? The mining firm, which is classified as small scale obviously to skirt some mining laws and regulations, was facing a number of cases for enumerable violations and even caught the ire of candidate Rodrigo Duterte. Being small scale it can only mine not more than 50 tons of ore monthly. The area being located in an ancestral domain, SMRI is supposed to give the Indigenous Peoples their share. Eric Gutierrez, the owner and his partner Congressman Egay Erice are all familiar names. It is also known that they provide the jets needed by Liberal Party Presidential bet Mar Roxas, so we were told. An insider told me last week that SRMI actually exports four Panamax shipload of nickel every month. In the miners lingo one Panamax ship loads about 50,000 to 55,000 tons of nickel ore. At the height of its operations during the Aquino regime, the price of Nickel was at 5 per ton. Nickel demands and value during Aquino administration were that high because Indonesia imposed a ban on nickel ore exports. If you think that is huge, it is actually a pittance compared to a virtually unknown nickel mining operations in faraway Tawi-Tawi. Al Tawi-Tawi Nickel Corporation is allegedly owned by unknown Filipino Chinese. The mine site, is in Langguyan, Tawi-Tawi. ATNC production output is not less than 600,000 metric tons per month. The Nickel content is high-grade at 1.8. By simple math, that’s 2-million annually. SRMI averages about 6-million per year. The operations of ATNC dated back during the time of President Gloria Macapagal Arroyo when Lito Atienza was DENR

Secretary. The MPSA was awarded to the Sali family who later farmed out their concession the current operators who in turn facilitated the processing of Environment Clearance Certificate. ATNC enjoyed the same extra-ordinary privilege when President Benigno Aquino III took over. Anybody who was/is somebody enjoys the bonanza so nobody complains. When she assumed as DENR Secretary, Gina Lopez surprisingly hired a confidant, Engr. Leo Jazareno, a close ally of Aquino and Roxas. She also hired 50 consultants along with Jazareno. Known as ìLJî in the mining circle, he was appointed National Director of Mines and Geosciences Bureau (MGB) by then DENR Secretary Ramon Paje. It was during the regime of Aquino that MGB under LJ and Paje removed from the local government the authority to issue Ore Transport Permit (OTP) and Mineral Ore Export Permit (MOEP). With that consolidation of power one can just imagine what the “Daang Matuwid” had achieved. It is mind-boggling and my poor-man’s standard and cheap calculator cannot handle that. Gina had every student activist and environmental NGOs (non government organizations) under her spell. She flew over mining area with a coterie of reporters and backed up by - of course ABS-CBN. When she return to her office she issued, left and right, suspension and closure orders that alarmed Finance Secretary Sonny Dominguez! Her reason was that it is her prerogative to do so. But mystery of mysteries, not only was SRMI given authority to continue operating, Gina, I recalled, even referred to SRMI as a model mining company. ATNC does not need that accolade, it is comfortable with its anonymity. I learned there was a perceptible attempt on the part of the owners to wiggle its way inside the Duterte Santo Santorum but this was rebuffed. Another information I got was that ATNC, during the Aquino regime, wanted to buyout AMCOR interest in Mati, Davao Oriental but this was pre-empted when the World Heritage declared Hamigitan Mountain Range as a World Heritage Site. From these enumerations one can only deduce why the Liberal Party members of the CA to the man voted in favor of Gina. The two mining firms were footing the bills not only for Marís campaign but for the entire LP political machinery. Could this be the reason why Greenpeace is so enamored with Gina they locked themselves in the gates of DENR? Certainly, contrary to the emotional mantra that Gina Lopez is the passionate fighter for environment, there are others who can better serve the government as DENR secretary. Besides, DENR is not about mining alone. My gosh, a senator and a congressman may have ties with miners but hardly do we know that a cabinet member and the pillars of the Liberal Party were protecting the interest of the worst violators of our mining laws. All this because she thought it was her prerogative. In hindsight, when President Duterte hinted that ìmoney influencedî the decision of the CA he is actually telling us the bald truth. Thorough PDAF probe needed The Department of Justice (DOJ) said it will re-open the probe on the alleged misuse of the Priority Development Assistance Fund (PDAF) amounting to billions of pesos. The new probe is expected to start next week or sooner, according to a DOJ press release. It is but fitting that a new probe on the PDAF scam should be undertaken as a result of “selective justice” done on the previous investigation conducted by former Justice Secretary and now jailed Senator Leila De Lima. And to speed up the prosecution of erring officials and lawmakers involved in the scam, Aguirre was right to announce that charges should be filed with the DOJ instead with the Ombudsman. It should be recalled that he Ombudsman under Justice Conchita Carpio Morales has been hesitant or reluctant to file any charges against former public officials who served under the previous administration of former President Aquino. Take the case of former Budget Secretary Butch Abad, the alleged mentor of PDAF scam mastermind Janet Napoles. He was indicted by the Ombudsman for unlawful implementation of the Disbursement Acceleration Program (DAP) to lawmakers worth billions of pesos. After the Ombudsman found Abad guilty of Usurpation of Legislative Powers for the unlawful disbursement of of DAP funds amounting
to P72 billion, the Ombudsman ruled that Abad was only guilty of “Simple Misconduct” and suspended for just three months. Unbelievable, but it’s the truth. And since Abad has already stepped down as Budget Secretary, the suspension was converted into a fine equivalent to his three months’ salary. It was alleged that part of the DAP fund was used by former President Aquino to bribe lawmakers to oust Renato Corona from office, as Supreme Court Chief Justice. Corona incurred the ire of the former President after the High Court ruled in favor of the farmers seeking full ownership of the controversial Hacienda Luisita, the sugarland they tilled for so many years. The DAP fund, amounting more than P10 billion, became more of a scam since it involved “ghost” or non-existent government projects on the local levels. So far, out of so many lawmakers believed involved only Senators Juan Ponce Enrile, Jingoy Estrada and Bong Revilla, were accused of pocket-

ing part of their pork barrel fund. This, despite strong public clamor to expand the culpability of other lawmakers believed involved in the scam. But the former president and former Justice Secretary De Lima refused to heed the public uproar for a more thorough investigation. Their refusal to conduct a wider probe, many believed, was to save their political allies from prosecution and embarrassment. The pork barrel fund is a lump sum discretionary fund given to lawmakers to enable them to fund small scale infrastructure or community projects outside the scope of the national infrastructure program. Since 2008, members of the lower house received an annual allocation of P70 million while senators get P200 million annually. *** Now that the alleged scam mastermind Janet Napoles has been acquitted by the Court of Appeals of kidnapping and illegal detention of her whistleblower cousin, Benhur Luy, I expect her to cooperate with the Duterte government regarding the scam. I am pretty sure that Napoles is ready to sing like a canary to implicate lawmakers and former government officials who we’re perceived to be close to the former President. Meanwhile, jailed Senator De Leila De Lima claims that Napoles is an unreliable witness and has “zero” credibility. But
what about Benhur Luy, the prosecution witness of De Lima against the three former senators? Luy claimed that he was illegally detained by Napoles to prevent him for testifying against her, which was rejected by the court. Does it mean that all his previous testimonies against Enrile, Estrada and Revilla will also be in question? Also, if Napoles is indeed unreliable, how come that De Lima and her office used Napoles extensively in prosecuting Enrile, Estrada and Revilla for allegedly conniving with Napoles to defraud the government of millions of pesos? When she was DOJ chief, De Lima aggressively pushed for the arrest and conviction of the three opposition senators, while she was still investigating the so called P10 billion pork barrel scam. Now, De Lima claims that the list of other lawmakers involved in the scam as claimed by Napoles will be dismissed by the court since there are no credible and verifiable accounts of transactions to support the claim of the scam mastermind. Lacson said a new round of investigation may be good for the country to ferret out the truth as to how many other lawmakers and former government officials who worked for the former President benefitted from the scam. If they indeed made millions from the scam, they ought to be jailed without the possibility of getting a parole.
Caregivers: Are you a victim of wage theft? If you are a caregiver, providing care to an individual inside their private home, special laws exist to protect you from wage theft. Wage theft occurs when an employer fails to pay an employee the legally required overtime and minimum wages. In 2013, the California Legislature passed the Domestic Workers’ Bill of Rights (“DWBR”). This law means that in-home caregivers are entitled to receive overtime payments for all hours worked in excess of 9 in a day or 45 in a week. Most 24-hour caregivers must be paid a minimum of $315 per day. The first 9 hours of work can be paid at the minimum wage of $10, for $90. Then, the law requires overtime payments of $15 per hour for the remaining 15 hours, for an additional $225. This equals $315 per day. Most caregivers receive
far less than that, often earning as little as $100 to $150 per day. A caregiver who is earning less than $315 per day likely has a very valuable claim, and should consult a lawyer experienced in wage theft actions for caregivers. In fact, the reason that the DWBR was passed was to make it easier for caregivers to stand up to abusive and exploitative employment practices in the caregiving industry. The Legislative History of the DWBR discusses studies conducted into the in-home caregiving
industry. These studies found that wage theft is prevalent and that caregivers are often invisible to the law, in part because many are undocumented or unsophisticated and not able to stand up for their right to a fair wage. It has also been our experience that caregivers, many of whom come from the Philippines, are taken advantage of because they genuinely care for the ones for whom they are caring and do not want to see these individuals impacted in any way. Others fear the legal system and others are hesitant to come forward because they are undocumented. In California, undocumented workers are still entitled to overtime and have equal access to justice through the legal system. Also, even if a caregiver agreed

Centennial celebration of the Marian pilgrimage From LAX, the first stopover of the pilgrimage was in Lisbon, Portugal where they were met by Jose-Carlos Colorado, their European Civilization and Culture tour guide. Carlos arranged for a big bus to carry the group to their hotel which was walking distance to the Shrine of Our Lady of Fatima. Tess Gonzales reminded her companions that they should consider themselves primarily as “pilgrims” and not as tourists. It is here in Portugal that Our Lady of Fatima appeared in 1917 to three children, Lucia, Jacinta and Francisco. Thru the children, the Virgin Mary relayed the message that mankind must return to God, repent for their sins and to pray for world peace. The group heard mass at the Chapel of the Apparitions in the morning, then later, on joined in the evening procession. There were thousands of attendees from all over the world who attended the masses and the evening ceremonies. From Portugal, the group proceeded to Salamanca in Spain. Along its route to Salamanca, we went to the walled city of Avila, the birthplace of St. Therese where she spent many years of her life. After breakfast, the group proceeded to Madrid, the capital of Spain. We made a stopped at the Valle de Los Caidos (Valley of the Fallen) where we viewed the Basilica and the monument to those who died
during the Spanish Civil War. The next stop was in the city of Madrid, the capital of Spain. We visited the Royal Monastery of El Escorial which was constructed as a residence for the king of Spain with a monument to commemorate Spain’s victory over France in the battle of Saint Quentin on August 10, 1557. In Madrid, we visited the Prado museum, which contained the masterpieces of El Greco, Velazquez and Goya. From Madrid, we proceeded to Zaragoza, the great city of Aragon and the birthplace of the famous Spanish painter, Goya. We also visited the Shrine of Our Lady of the Pillar. From Zaragoza, we crossed the Spanish – French border to reach Lourdes. It was here in Lourdes that Our Lady appeared to Bernadette and proclaimed herself as the “Immaculate Conception.” Here at Lourdes, we participated in candlelight procession of the Blessed Sacrament. We also had the opportunity to immerse in the separate cubicles of the men and women, receive the penance of reconciliation and to do the stations of the cross. We also had the opportunity to fill our bottles with the holy water. From Lourdes, we drove over the Pyrenees to Andorra La Vella to view the Romanesque churches and stone houses. From Lourdes, we proceeded to Barcelona, the capital of Catalonia to explore the colorful markets before

We visited the Black Madonna of Monserrat which reflects Spain’s fervent piety and devotion to the Blessed Mother. The following day, it was back to the airport at Bar-
celona for our return trip to USA. It was the consensus of the participants to this Marian Pilgrimage that despite long walks, climbing of stairs and sore legs, it was worth the experience. At the start of the pilgrimage, the participants did not know each other but by the end of the trip, there was the close camaraderie and new friendship formed among themselves. (Del Molo Intia)
Fake visa documents result in prison time for 2 in Florida TAMPA, Fla. — U.S. Citizenship and Immigration Services (USCIS) assisted in an investigation that led to U.S. District Judge Charlene E. Honeywell sentencing Rosa Cingari to 12 years and 7 months in federal prison and Domenico Cingari to 8 years and 1 month in federal prison for conspiracy, making false statements in immigration applications and petitions, and mail fraud. The Court also ordered the Cingaris to forfeit real property located at 130 West Park Street in Lakeland, which was used to facilitate the offenses. As part of their sentence, the Court also entered a money judgment in the amount of $740,880, the proceeds of the charged criminal conduct. A federal jury found Rosa and Domenico Cingari guilty on November 9, 2016. They were indicted on July 9, 2015. According to evidence presented at trial, Rosa and Domenico Cingari owned and operated R.E.P.C. Accounting and Translations out of their home on West Park Street in Lakeland. They assisted illegal aliens in obtaining Florida driver licenses by filing fraudulent immigration documents. Specifically, they filed I-589, Applications for Asylum and Withholding of Removal forms; I-130, Petitions for Alien Relative forms; and I-765, Work Authorization forms. Most of the applications and petitions submitted to USCIS by the Cingaris contained materially false information. The Cingaris filed the fraudulent immigration documents in order to obtain USCIS I-797C Notices of Action. The Cingaris put their mail-
ing address on all of the fraudulent forms so that USCIS would mail the Notices of Action to their business. They then sold the Notices of Action to their alien clients. The Cingaris charged their clients between $500 and $1,300 for the fraudulent immigration applications. They collected at least $740,880 from their clients during the fraud scheme. “In maintaining the integrity of our immigration system, USCIS has zero tolerance for fraud,” said Katherine Baranowski, USCIS Tampa Acting District Director. “Justice has been served with this sentencing, and we remain vigilant in detecting and bringing to prosecution any immigration fraud.” “Immigration fraud subverts the orderly process of citizenship and compromises the security of our homeland,” said Ivan J. Arvelo, acting special agent in charge of HSI Tampa. “HSI will move aggressively to investigate those who corrupt the integrity of our nation’s immigration system.” This case was investigated by U.S. Immigration and Customs Enforcement’s Homeland Security Investigations (HSI) and USCIS. It is being prosecuted by Assistant United States Attorneys Stacie B. Harris and Simon Gaugush. ‘Surviving’ a hail storm on the freeway (by someone who hasn’t been in one) By Abner Galino
I’ve seen so much pictures and video of people delighting over hail dumped on yards, houses, cars and roads. And so I have this warped notion of hailstorms – which I primarily associate with thrill and fun. Well, now I know better. At about 3:20 p.m. while driving along the 110 freeway near Vernon in south Los Angeles, a drizzle that was foretold by a dark cloud suddenly turned into pea-sized hail. Immediately, ear-piercing thuds inundated my car. For a moment, I didn’t know what it was until I saw hail bursting as they hit my windshield. They turned into fine grains of ice as they burst. (Probably, finer than the shaved ice that my people use on our popular dessert called halo-halo). I felt my windshield tremble at the impact of the relentless bashing of hail. Simultaneously, moist was building up on all the glasses, blurring my view of the road. Fears were racing in my mind. One was about the dread of my windshield breaking from the onslaught of hail. (Because I understood that if they were anymore bigger, they could certainly break the glass). And second, I dread about the prospect of crashing onto a car in front of me, or being rear-ended. (It didn’t help that about a month ago, someone crashed his car into my year-old Honda Odyssey and I dread going through those processes again.) Fortunately,I was about a mile away from an overpass when the
hail happened. I turned my hazard lights on and sought shelter under the bridge until I thought the worst part of the hail was over. And there were many of us under that bridge by the Vernon exit. We were looking at each other, awkwardly smiling at each other as we sized up the situation. I rushed out of the freeway as soon as the hailstorm stopped. I could see the flood rising and the traffic beginning to stall as I leave the freeway. I stopped by at the nearest commercial plaza. Parked my car, got out and began shooting my camera. People were rushing out from a grocery --- some of them were taking videos (through their cellphones) of the hail dumped on cars and the pavement, some were picking up the hailstones, some were excitedly walking over them and a couple of kids made snowballs. One woman smiled at me and said: Well, I’m not so thrilled. I’m from the Midwest and I’ve been to all kinds of weather. I smiled back. Well, I said to myself, that’s just one mighty reason why I must not leave Southern California where hailstorms are far and few. I turned back and dropped a scheduled coverage of an exhibit of Filipino-American artists, dubbed as Buklod, at the Croatian Cultural Center of Greater Los Angeles in San Pedro. I decided not to take anymore risk as the clouds were still dark and foreboding. Meanwhile the Associated Press (AP) reported that the spring storm

Kathryn won’t join Daniel in movie with Vice Ganda, Pia?
It seems Daniel Padilla has not yet been formally offered a role in the upcoming movie of comedian Vice Ganda and Miss Universe 2015 Pia Wurtzbach. Last week, Vice Ganda confirmed in an interview that he will be doing a movie with Wurtzbach and that Padilla will also be part of the project. But on Tuesday at the thanksgiving party for the Star Cinema film “Can’t Help Falling In Love,” Padilla said they haven’t discussed the movie yet although he is open to it. “Wala pa namang nabanggit (pero) why not?” said Padilla. At the same time, Padilla also hinted that the comedy might be an entry to the Metro Manila Film Festival (MMFF) in December. “MMFF masaya ‘yan comedy,” he said. Meanwhile, the actor’s love team partner, Kathryn Bernardo, revealed that she probably won’t be part of the movie. “Alam ko sa kanila ‘yon kasi ang tagal nang hindi natuloy. Pero if ever (matuloy) suporta tayo kahit nandoon ako or wala,” she said. “Ilang beses na hindi natuloy ‘yung project nila ni Vice, so I’m sure excited lahat for that, lalo na MMFF, gusto ‘yon ng lahat. But Angelica Panganiban on Tuesday stood by an Instagram post she shared where she said that she and Angel Locsin are in for a “happy ending.” Panganiban opened up about the difficult start their relationship had in a story conference held to announce her newest movie with Locsin. Angel Locsin, Richard Gutierrez reunite for new movie When it was announced that a spine injury forced Angel Locsin to exit the planned “Darna” adaptation, many were left disappointed. But fans of the actress can take comfort in knowing that she isn’t done with making movies altogether. Star Cinema revealed that she will headline an upcoming flick with former onscreen partner Richard Gutierrez, whom she last worked with in the 2007 drama “The Promise.”
One of the popular love teams of the mid-2000s, Locsin and Gutierrez topbilled six other big screen outings from 2004 to 2006. The currently untitled movie from Star Cinema is their first in a decade. The movie also stars actress Angelica Panganiban. Locsin and Panganiban, last seen together onscreen in the 2012 Metro Manila Film Festival entry “One More Try,” recently struck a close friendship following their respective breakups.

Special loan program for home improvement projects Since there where not many move up buyers and sellers in the market the past few years, a lot of homeowners then made minor to major home improvements to upgrade their homes. Most of you paid for these home improvements thru a cash out refinance, but some of you made special loans with the “Hero Program” or an older version called “Pace”, these home improvement loans primarily where offered for major improvement and solar installations. They seemed to be fairly easy to obtain and looks like it was a great deal at the time. Low and behold, unless you have paid off these loans! The lenders and changing guidelines oon re-subordinations if you decide to refinance both loans and combine them into one loan. Most home owners did not read thru the fine lines of these contracts that they are paying about 8-10% in interest rate and upfront fees upwards of about 10% of the loan they take. We are almost to the time when it I get itchy to make some improvements to my house - I’m thinking that I might too. And I’m not just talking about some solar panels to fight the high electric bills that we are all experiencing. So, I decided to look into these options and here is what I found. So, over the past few years, sales people have likely been banging your door in trying to sell you anything from solar to windows to siding, on this magical new program called the HERO program. No down payment, no payments at all - it’s all in your property taxes...Right there when they say no payment at all, I started to become skeptical. Let’s define what the HERO program is - how does it work? What does “HERO” mean anyway? HERO stands for: Home Energy Renovation Opportunity It provides financing for any energy improvements made to your house, solar, windows, plumbing, etc. The HERO program is a financing plan, where repayments are paid through your property taxes, 100% financing is available. The mechanics are relatively simple - the cost of the renovation is under the HERO program attached to your property as a tax lien, the payments (5-20 years) are then added to your annual tax payment. If you have your taxes impounded, your mortgage servicer will adjust your payment to match. The big benefit is that the lien is held against your equity. And no credit score is needed. This all sounds good and fine - right? But what happens if you decide to sell your house before the payments are up? This is where the rub is... So, you put up a solar panel installation and save on your power bill (although you are probably paying those saving out towards the payment through your taxes), 3 years later, your company relocates you and you need to sell your house! When I look at your taxes (Any good Realtor should review this with you to see if there is anything going on), I will redline that HERO program as it is now a lien on your
property. And it is not just ANY lien, it is in first position, so it takes priority over your mortgage - as you can imagine there are a couple of banks who don’t think this is a great idea. To the tune of FANNIE and FREDDIE MAE will not purchase loans with a higher ranking lien - this effectively means that at the moment, FHA financing is not available on a home with HERO financing attached. So, the sales pitch goes like this: You can transfer the tax to the new owner! Great... But, did the sales guy ask the new owner if they want that extra tax? HUH? Reality on the other hand is not quite what was sold. Now that HERO has been around for a few
years, we are seeing some results of this. When a buyer learns of the HERO tax that is added on, they are not too happy. In many cases, they are demanding that the owner pay it off, or at least pay off a big part of it. Now - they are left with no choice as their FHA financing does not qualify the property. In the current market where homes are sitting 2-4 months waiting for a buyer, sellers are often forced to pay for some of this. Hero now becomes a negative line item on your net results after a sale. I’ll leave it up to you to decide what is best for your specific situation, I am all for improving our homes efficiency, that said, maybe not through my taxes?!?! For those who tried to refinance their first mortgage with a HERO second lien, they are in for a delight because if you have done it already, good for you hopefully you have combined them together and you are out of the HERO loan, but if you are just in the process now! Fannie Mae and Freddie Mac are changing the guideline for re-subordinating
these second liens. They now must be paid off and combined into one loan. So, why did you have to pay those high rates and fees before just to start your project immediately without waiting for a 30 day refinancing? I believe in this case the Sales Person again got you for a nice pocket change commission. When it comes to taking your equity out of your home, a refinance “Cash-Out” is the most inexpensive way to do it. Trust me I have seen too many of these smooth talking Sales Person dealing and wheeling for themselves. I encourage your thoughts on this - I am interested in hearing if anyone have had good/ bad experiences with the program. Having sold roughly 2,500 cars in his lifetime – and only with Mercedes-Benz – the man clearly has car-selling down to a fine art. He won “Salesman of the Year” numerous times and is known for going above and beyond the norm of client service. “I deliver cars...pick up their cars for service...I’d lease a car so that when I pick up their car they’d have a loaner car – I do things differently,” Orosa adds. Orosa’s face lit up when he spoke about his favorite thing about the job. “(It’s) the people,” Orosa uttered in a heartbeat. “I love helping people. You help as many people as you can and the rest keep on. There’s one rule I follow: you don’t think about the money you make. It will come.
