MANILA, Aug. 11 (PNA) – Philippine Foreign Secretary Perfecto Yasay on Thursday called on China to “uncompromisingly” respect the rule of law as Beijing continues to beef up its military structures in disputed reefs in the South China despite an international tribunal ruling that invalidated its massive claim in the resource-rich waters. Yasay, who made the statement at a joint press conference with visiting Japanese counterpart Fumio Kishida in Davao City, said the Philippines was one with Japan in expressing “grave concern” in the situation in the South China Sea. “We invoke and urge China to make sure that maritime order and security and the rule

of law must completely and uncompromisingly be respected,” Yasay said. The Philippines and Japan are both embroiled in separate territorial disputes with China. The Philippines is locked in a long-running sea row with China over parts its exclusive economic zone being claimed by Beijing off an area of the South China Sea that Manila calls the West Philippine Sea. Japan and China, on the other hand, are contesting ownership over islands called Senkaku by Japan and Diaoyu in Chinese. Recent press reports now indicate that banks are ready to begin a new push on delinquent mortgages through foreclosures and trust deed sales. Although the recession seems to have bottomed out, and house prices are no longer falling, many home owners are still behind on their payments, or sitting in homes that remain upside down in value versus debt, or both. Bottom line, home values have not yet appreciated to the point where it makes sense to stay, or pay off large delinquencies in order to avoid a foreclosure. Even with the new lower mortgage rates, few home owners will succeed in refinancing under the government’s Harp 2 program, that provides re-finance options for properties under water. For most, if your credit is compromised, or you do not have at least 40% equity, you are out of luck. Therefore a bank foreclosure may well be unavoidable during this new foreclosure wave that’s about to begin. So how does that work? When you are unable to make your mortgage payments on time, the bank starts a foreclosure process. Foreclosure is a legal procedure that involves mortgaged properties. If a homeowner defaults on his or her mortgage, by either failing to make mortgage payments or failing to follow other terms of the mortgage document, foreclosure may be the result. The homeowner relinquishes all rights to the property, and the mortgage lender takes possession of the property. Usually there is a forced sale of the property at public auction; the proceeds of this sale are applied to the mortgage debt. The most widely used remedy in dealing with foreclosure, is bankruptcy. Bankruptcy is a legal procedure that begins when an individual has a cash flow deficiency caused by debts they cannot manage. It can also protect against judgments, pay garnishments, evictions and buy time in foreclosure situations. For those with little income, a chapter 7 bankruptcy gives debtors a fresh start. All unsecured debts are discharged. If you do have a regular income that is greater than the cost of living index for your area, you can still qualify for a chapter 13 bankruptcy. The U.S. Courts’ publication Bankruptcy Basics refers to a Chap-

ter 13 bankruptcy as “an adjustment of debts of an individual with regular incomeâ€? where the debtor works with the bankruptcy court to develop a repayment plan for the debtor to follow over the next three to five years. Upon completion of the repayment plan, the bankruptcy court will discharge any remaining eligible debts. A Chapter 13 bankruptcy filing can stall or derail foreclosure proceedings. That’s because of bankruptcy’s “automatic stayâ€? provisions that force creditors to the sidelines while the bankruptcy court sorts things out. The lender can petition the court to allow it to continue with the foreclosure, depending on where you are in the foreclosure process, but it should buy you some time. The following, is from page 24 of the U.S. Courts’ publication Bankruptcy Basics: By virtue of the automatic stay, an individual debtor faced with a threatened foreclosure of the mortgage on his or her principal residence can prevent an immediate foreclosure by filing a chapter 13 petition. Chapter 13 then affords the debtor a right to cure defaults on long-term home mortgage debts by bringing the payments current over a reasonable period of time. The debtor is permitted to cure a default with respect to a lien on the debtor’s principal residence up until the completion of a foreclosure sale under state law. 11 U.S.C § 1322Š. MANILA, August 10 (PNA) – Chief Justice Maria Lourdes P. Aranal Sereno on Wednesday said that she sees no need to add to what are being said. �Many things have been said. The Chief Justice sees no need to add to what are being said,� Sereno said on Wednesday in a statement read for her by Supreme Court (SC) Public Information Office (PIO) Chief and Spokesman Atty. Theodore O. Te. This was the reaction of the Supreme Court (SC) on the speech of President Rodrigo Roa Duterte on Tuesday saying that the Chief Justice should not create a constitutional crisis which may prompt the President to order everybody in the Executive Department not to honor the orders of the Chief Justice to the Executive Department. President Duterte also warned

the Chief Justice not to impede on the government’s all-out war against illegal drugs, otherwise, he would rather declare Martial Law. Sereno on Monday advised the judges who were named by President Duterte as purportedly involved in illegal drugs not to surrender. In her four-page letter to President Duterte sent through Department of Justice (DOJ) Secretary Vitaliano N. Aguirre II, the Chief Magistrate advised the judges who were included in the list not to surrender to any police officer without a warrant of arrest. Sereno said that this was to protect the judges as the protectors of the rights of the citizens under the Constitution. Sereno also asked President Duterte to allow those judges who were named to continue to carry their licensed firearm for as long as charges are not yet filed against them.

MANILA, Aug. 11 (PNA) – Malacañang on Thursday said the alliance between the Philippines and the United States will remain strong despite President Rodrigo Duterte’s remark calling US ambassador to the Philippines Philip Goldberg a gay. ”Regarding Goldberg statements, this is to assure each and every one that the Philippine-US alliance remains strong,” presidential spokesman Ernesto Abella said in a press briefing.

Abella said President Duterte has just made a statement affirming that the relationship between the Philippines and the US remains strong. He said Philippine Charge d’Affaires to Washington D.C. Patrick Chuasoto had made representation for President. ”They have already explained their situation. The explanations have been properly made” Abella said. When asked if everything has been settled, Abella answered: ‘I assume.’

In his speech before the military soldiers in Cebu City last Friday, President Duterte called Goldberg gay for supposedly meddling in Philippine politics. ”First and foremost, it was not meant to be a public statement. It was addressed to a certain audience and the comments are confined specifically to that audience,” Abella explained. MANILA, Aug. 10 (PNA) – Senators on Wednesday urged the public not to take seriously the statement of President Rodrigo Duterte that he will declare martial law if Chief Justice Maria Lourdes Sereno will continue to interfere in his intensified fight against illegal drugs. ”I don’t think people should be alarmed because when you say we might have martial law in the Philippines, there are effects in the market; there are effects on investors’ decisions. So I think, we should not overplay with what I think what was not meant seriously,” Senator Juan Edgardo ‘Sonny’ Angara said in a media interview. Angara said Malacanang explained already that President Duterte was just asking rhetorical question when the President mentioned martial law

while reacting to Sereno’s caution to the judges linked to drugs not to follow the President’s order to report to authorities. ”Sinasabi lang niya bilang isang executive, kailangan mabilis ang kilos para kapag hinadlangan siya ng ibang ahensya, siguro yun ang last resort niya. Pero hindi naman ako naniniwala na he will resort to it,” Angara said. Senator Panfilo Lacson said President Duterte’s martial law statement was just a threat. ”His bullheadedness is epic. Lacson said martial law was not a sole decision of the President. ”It has concurrence already of Congress and it is time-bound, only 60 days. So

Senator Francis ‘Kiko’ Pangilinan agreed with Angara and Lacson, saying “the President may be joking because an order to disobey a legal order or a decision of the Supreme Court is against the Constitution.” In light of the latest exchange of words between President and Sereno, Pangilinan reiterated his call to convene the Joint Judicial, Executive, and Legislative Advisory and Consultative Council (JJELACC).

MANILA, Aug 11 (Mabuhay) – Senate President Pro-Tempore Franklin M. Drilon on Thursday chided President Rodrigo R. Duterte’s chief legal counsel for claiming that the magnitude of drug cases may warrant the declaration of martial law. “Even a freshman law student can easily debunk Atty. Salvador Panelo’s statement as having no legal basis. I do not know which Constitution he has learned in law school but our present Constitution has only provided two grounds for the declaration of martial law – invasion or rebellion. Drug menace is definitely not one of them,” Drilon said. In his media interviews, Panelo has been quoted as saying that “the magnitude of the drug problem that has risen to a crisis proportion may require the application of the provision of the Constitution when it says that the President can declare martial law when the public safety requires it.” “The presidential chief legal counsel would want us to believe that the Constitution allows the President ‘to declare martial law, not only in case of invasion or rebellion, but also when public safety requires it,’” Drilon said. A lawyer and former justice secretary, Drilon explained that the 1987 Constitution only allows the declaration of martial law, upon the concurrence of two requisites: one, when there is actual invasion or rebellion and two, when public safety requires it. These two requisites must be present, which Panelo conveniently disregarded, he noted.

MANILA, Aug. 10 (PNA) – Senate Minority Leader Ralph Recto on Wednesday welcomed the assurance of Department of Transportation (DOTr) Secretary Arthur Tugade that no fare increase will be imposed both in the Light Rail Transit (LRT) and Metro Rail Transit (MRT) without “enhanced quality service.” Tugade made the assurance in the first Senate public hearing on the bills and resolutions granting President Rodrigo Duterte emergency powers to solve the traffic problems in Metro Manila and other highly-urbanized cities for the period of two years. Asked by Recto if his department is inclined to approve the reported petition by LRT 1’s private operators if they could raise fares by 10 percent, Tugade said “any increases must

be predicated on enhanced quality service.” “Sinabihan ko na ho ang aking management that any increases on the rates sa LRT is totally not acceptable to me. Magmumukha tayong katawa-tawa sa matinding problema tapos magtataas tayo ng pamasahe,” he added. Pressed by Recto if there are also plans to adjust fares in the MRT, Tugade replied, “Wala ho kaming planong ganyan.” “Lalabas ho kaming katawa-tawa na magre-rate increase at yung serbisyo mo ay hindi naman maganda,” the DOTr chief said. Tugade said that while he has not received any formal request for any rate increase in any of the three Metro elevated train lines, he has issued instructions that he will not approve such application.

MANILA, Aug. 10 (PNA) – Transportation Secretary Arthur Tugade on Wednesday assured that the department will not abuse emergency powers — which will be used to alleviate the country’s transport problems — if the Congress should decide to grant their request. In a chance interview after a Senate hearing on emergency powers, Tugade assured the public that emergency powers will not be abused as most power-hungry government officials would do. He said that he wants emergency powers to last for only two to three years to ease the country’s transport problems immediately. ”Don’t be bothered by the emergency powers—it won’t be abused.

There is also the oversight-Congress and Supreme Court (watching over us) so don’t be bothered,” Tugade said. ”There are far too many problems that need solutions in a short period of time. So that we have a fighting chance, I am asking for emergency powers,” he added. During the hearing, Tugade stressed that among the department’s priorities was to create a single, synchronized authority to manage the traffic system in Metro Manila. Traffic management is currently shared by the Metro Manila Development Authority (MMDA), the Land Transportation Franchising and Regulatory Board (LTFRB) the Land Transportation Office (LTO) and local government units (LGUs).

MANILA, Aug. 10 (PNA) – Beep cards are now being accepted as payment at the Manila-Cavite Expressway (Cavitex) for the toll fees of Class 1 vehicles. Beep card concessionaire AF Payments Inc. (AFPI) said Wednesday the fee costs PHP24 if exiting in Parañaque City and PHP64 if in Kawit, Cavite. The limited public trial began on Aug. 8 (Monday). AFPI CEO and President Peter Maher said that extending the use of beep cards as a payment option at Cavitex is another step towards making the beep card an all-in-one travel card. “We hope that the low cost of the beep card and the wide network of loading options being developed will appeal to drivers who pass along Cavitex and are interested in passing the toll gates more quickly,” Maher said. Cavitex CEO and President J. Luigi Bautista welcomed the partnership saying that the management is proud to be part of the modernization of different aspects of travel in the Philippines. “Now, even private vehicle owners and their passengers can feel the benefit of the beep card,” Bautista said. The Secretary met with Kobkarn Wattanavrangkul, the Thai Minister of Tourism and Sports, who offered collaboration between the two countries in farm tourism, youth development, and women and indigenous

community projects. She also met with the Thai Travel Agents Association President Suparerk Soorangura who announced that his group will visit the Philippines in September for the Philippine Travel Exposition (PHITEX) and tour the cities of Cebu, Davao and Cagayan de Oro. According to Teo, Soorangura said that he looked forward to seeing Mayon Volcano, go deep-diving, shopping

and get a taste of authentic Filipino cuisine. Meanwhile, Teo was invited to promote the Philippines in the Thai International Travel Fair in February next year. As a top travel executive and tourism advocate herself, Teo noted that the department could learn a thing or two from Thai authorities who she said “catapulted Thailand’s tourism to the top.” (PNA)

Off the grid in Negros Occidental’s Danjugan Island By Azer N. Parrocha

MANILA, (PNA) -- Can you survive a vacation without electricity? A marine and wildlife sanctuary within a 43-hectare island situated in the Sulu Sea is encouraging visitors to get as close to nature as they possibly can, minus modern conveniences. Danjugan Island, which is four to five hours away from Bacolod or Dumaguete, is described by its executive director Dave Albao as a private conservation site and marine protected area. In other words, definitely “not a resort”. It is managed by the Philippine Reef Rainforest Conservation Foundation Inc. (PRRCI), a non-government organization led by Gerry Ledesma who bought the island in 1994 for preservation. Ledesma saw how the reefs were slowly experiencing degradation and wanted to prevent further damage. The island has five lagoons and is covered with limestone forests which

is home to over 74 bird species, 10 bat species, 579 fish species and many other wildlife species such as corals, turtles, snakes and the rare coconut crabs. Among the island’s star attractions is its lone Beach Stone-Curlew or Beach Thick-knee, a greybrown shorebird with a massive yellow-based bill and thick knees—thus the name. It can be found across Australia and a few other Asian countries including the Philippines. The Beach Stone-Curlew is a rare bird, so rare that been tagged as ‘near threatened’. Albao said that Asian tourists would even fly to the Philippines on a weekend just to see the bird, take photos and fly back home. Visitors that first set foot on the island will immediately feel peaceful as it only welcomes more or less 50 guests excluding its 10-member staff. It’s the perfect hideaway from the hustle and bustle of city life.

Modern conveniences such as cell service, television and running water will not be part of the Danjugan Island experience, Albao said stressing that people rely solely on natural entertainment and human interaction. If by chance a part of the island does have cell service, visitors will have trouble charging their gadgets as the island uses solar power to run lights while water is usually brought from the mainland, he explained. The island offers simple accommodations in either the Moray Lagoon Camp or Typhoon Beach Camp. Air-conditioning units are inexistent and visitors will also be given just a bucket of water to bathe in. Albao said that the island is heavily dependent on tourism as its source of income, which is used to further preserve its biodiversity. However, he said that the priority was still conservation and not the entertainment of visitors. Of course, visitors will have

enough activities to keep them preoccupied such as boat-trips, island tours, snorkeling, kayaking to name a few. It’s a favorite among yogis and quiet-loving individuals. A number of marine and wildlife summer camps are also held to educate elementary and high school students of Southern Negros communities through its Danjugan Island Environmental Education Program (DEEP). With seven different types of ecosystems— beach forest, mangroves, lagoons, bat caves, coral reefs, seagrass beds and an open sea— students who aspire to be future ecologists and biologists have the best classroom to learn in. Those who have been to the island before would say that it receives far less attention than it ought to receive, but they also agree that it only adds to the mystique that surrounds this hidden gem in the Sulu Sea. MANILA, Aug. 10 (PNA) – After listening for almost five hours to the Department of Transportation officials led by Secretary Arthur Tugade, the senators have agreed that there is a need to grant President Rodrigo R. Duterte and the Executive Branch with emergency powers to solve land and air traffic congestions in the country. ”Nakikita nain dito ang emergency powers, kailangan nila para mas mapabilis ang procurement process,” Senate Committee on Public Services chairperson Sen. Grace Poe told the media after the first public hearing on bills and resolution providing emergency powers to address the transportation crisis. Poe, however, said the emergency powers should be compliant with the Freedom of Information (FOI) executive order to prevent abuses. ”It (FOI) must permeate and penetrate all activities, contracts, projects, biddings, documents, awards,

payments made pursuant to the act of granting emergency powers. Letting the sunlight in construction results in better-built infrastructure,” Poe said. She also said the emergency powers must be fiscally responsible and must have complete details and deadlines for the construction of the infrastructures. ”We will not go for vague powers, or blank checks. In his Senate Bill No. 999, Cayetano said the emergency powers should not only help address the land traffic problem but the air traffic congestion, particularly at the Ninoy Aquino International Airport (NAIA). Tugade said the special powers will authorize the Civil Aeronautics Board (CAB) to redistribute air traffic to Clark, Laoag, Davao and other international gateway. For his part, Senate Committee on Public Services vice chairman Sen. Joseph Victor Ejercito said the traffic woes in Metro Manila is an “economic hemorrhage” that needs serious attention.

Senior seeks Chapter 7 relief for $60k credit cards but what is the status of residence? Client is 57 and recently divorced with two children, one in high school the other in college. She makes $40K yearly in middle management for a large corporation. She has $50K of credit cards accumulated while she was still married. Ex husband had good income. So, when she was still married, her husband paid for her credit cards. The minimum monthly is $1,500 to keep them current. That’s almost $20K a year, which is half of her $40K annual gross income. Needless to say, there is no way that she can keep on paying for these cards. Fortunately for her, she lives in a house that, shall we say, doesn’t belong to her but all she has to do is pay the mortgage of $800. The mortgage also is not in her name. It is not her debt. Who is the owner of this house that she lives in? Her parents are on title to the house and the mortgage is also in the name of the parents. In addition, parents have been paying the mortgage for the last twenty years. Mother died five years ago. Father died two years ago. Parents gave the house to her son seven years ago by grant deed. However, son has no income right now because he is still in college. As a result, client paid the mortgage for the last two years and claimed the mortgage interest as her deductions in her tax returns. Since this house is almost fully paid, the ownership of the house makes a big difference in client’s bankruptcy. If client owns this house, then she won’t

be able to qualify for a chapter 7. She would have to file under Chapter 13. In Chapter 13, client will be required to pay $1,000 a month for 60 months; a 100% payment of the credit cards without interest because the non-exempt equity is more than $60K. Let’s analyze this case more. Although client is now paying for the mortgage, she has only paid that for two years. In addition, she doesn’t own the house. Both legal and equitable title to the house belongs to her son who is in college because her parents gave the house to her son, not to her. Under this analysis, client would have a proportionate ownership share equivalent to two years, which is not much. That’s probably about 10% because two out of twenty years is 10%. Her homestead exemption is at least $100K, which is more than enough to cover 10%. But what if her mortgage payment for the last two years is considered rent, because her son owns the house. This analysis is also plausible and has legs to stand on. If those payments were considered rent, she would have zero ownership interest in the house. Either way, client would qualify for Chapter

7 without worrying about losing a roof to live under. Next client is 72. He looks slim and younger that his age. He has no health problems but his wife is sick and he takes care of her. He owns a house with non-exempt equity of about $25K. He owes $50K of credit cards. He actually wants a Chapter 7 discharge. However, I cannot recommend it. I can only recommend a Chapter 13 where he will pay $450 a month for five years. If he files Chapter 7, there is a chance that he may lose the house because of the non-exempt equity of $25K. Of course, in a Chapter 7, the trustee has to give him his exemption of $175K when the house is sold. But he still wants to live in the house. So, there is no sense in assuming this kind of risk. He now pays $1,500 a month for $50K of credit cards. That eats up 40% of his household income, which consists of a combination of social security and pensions. It would have been better for him to file for Chapter 7 in 2010, when he was 66. At that time, the fair market value of his house would have been at least $50K lower than today such that his homestead exemption would surely cover all of his homestead equity then. Had he filed a Chapter 7 then, he would have discharged all of the $50K without any problems about the house. How much money would he have saved if he filed for Chapter 7 in 2010? Well, let’s do the math. $1,500 a month is $18,000 a year of minimum credit card payments. Six years of that is $108K saved! But he says that he’s been paying for

the $50K credit cards for 15 years. Therefore, he would have saved, if he filed for Chapter 7 at the age of 66, the grand total amount of $162K! He says he paid for 15 years at $1,500 a month, but right now, he still owes the very same $50K! What can I tell you? Client should have filed his Chapter 7 in 2010 because $162K is a lot of money. $162K saved up in your pocket and invested in a diversified fund giving you a 5% return or $687 a month of dividend income certainly gives you more security than $50K of credit cards eating up $1,500 of your social security at the age of 72. This is like voting Hillary or Trump. Do you want to have Trump using the nuclear triad of the U.S.A. to destroy the whole world, just because he’s in the mood to do so? This man is very dangerous. Vote for Hillary, I’m with her and so should you. Marcos’ remains transferred into coďŹƒn; mausoleum closed to public MANILA, Aug 11 (Mabuhay) – After the transfer of the remains of late strongman Ferdinand Marcos into a coffin, the mausoleum in Batac, Ilocos Norte that used to house his body for years has been closed to the public. LA Philharmonic musicians wowed local community with classical music A free concert was recently shown at the Alhambra Library with Baroque and classical masterpieces performed by members of the Los Angeles Philharmonic Orchestra. The Alhambra Community Library is a hidden treasure of culture in the San Gabriel Valley area, whose various ongoing events encourages pleasurable involvement for its event-oriented community. LA Philharmonic members: Paul Stein, Violinist and Paul Viapiano, guitarist and mandolin player, both performed during the event. Though this author was a little late for the concert, the first part of the programme started with Mr. Stein, performing the violin solo of composer Johann Sebastian Bach’s “Partita No. 3 in E Major” with violin pieces such as “Loure,” “Gavotte en Rondeau,” and “Gigue.” Born in Dallas, Paul Stein started playing violin when he was 8 years old. His prowess in music stayed on until he graduated in high school, thereafter receiving a Bachelor of Music degree from Southern Methodist University and a master of Music from Yale University. In 1985, he created the Chamber Music Express ensemble, introducing classical music to audiences at schools and libraries. His stories for those programs include: Galileo’s “Metronome,” “The Magical, Musical Mini-Mall “ and the “Voyages of the Viola.” For five years, Paul Stein has been the director of chamber music series at the Pasadena Jewish Temple and Center. He has been a soloist and a performer with the Los Angeles Philharmonic Orchestra for 35 years and has brought his musical experience into many educational and chamber music venues.

Currently, he is the Artistic Director of the “Classical Kaleidoscope” chamber music series at the Arcadia Library and occasionally performs as a soloist at Glendale and Pasadena Community Orchestras, The Rio Hondo Symphony and the Crown City Symphony. He has also been a faculty at the University of La Verne, Pasadena City College and Glendale College. He teaches Violin and Viola from his home studio. Paul Viapiano, on the other hand, has played guitar and mandolin with the Los Angeles Philharmonic and the Los Angeles Philharmonic New Group since 1984. He has worked with well-known conductors such as: Esa-Pekka Salonen, Pierre Boulez, John Adams, Sir Simon Rattle and Gustavo Dudamel. He is a charter member of the Hollywood Bowl Orchestra and frequently performs with the LA Opera as well. IBP urges probe on drug killings MANILA, Aug 11 (Mabuhay) – The Integrated Bar of the Philippines (IBP) has called for a probe into the killings of suspected drug dealers amid President Rodrigo Duterte’s vow of relentless campaign against illegal drugs. “It must not be forgotten that regardless of whether or not the victim is a drug offender, unjustified killing is murder nonetheless,� the IBP said in a statement, adding those responsible for the killings must be held accountable. While the IBP praised Duterte for opening the eyes of the nation on the severity of drug menace, the country’s mandatory organization of lawyers said the rule of law must prevail when dealing with the problem. “It is at times such as these, when the temptation to take extralegal measures is at its height, that our conviction to abide by this principle must likewise be at its strongest,� the group said. The IBP then warned that “the abuse of authority is equally criminal.� After taking power on June 30, Duterte unleashed an intensified campaign against illegal drug syndicates that saw him naming in public more than a hundred government officials, policemen and judges allegedly involved in the trade. He also threatened drug lords and their protectors with death, raising concerns among several quarters including human rights groups. Police file charges vs. Albuera town mayor, son over illegal drugs MANILA, Aug 11 (Mabuhay) – Police have filed charges against Leyte province’s Albuera town mayor Rolando Espinosa and his son Kerwin over alleged possession of illegal drugs and illegal possession of firearms. The PNP Criminal Investigation and Detection Group has filed the charges against the drug suspects after the police seized over 11 kilos of suspected shabu and a cache of firearms and explosives components in one of the houses of the mayor in Albuera town on Wednesday. Authorities estimated the value of the shabu seized on Wednesday

at P88 million. Operatives also seized ammonium nitrate, blasting caps, firing wires and black powder in the raid. Chief Inspector Jovie Espenido, chief of the Albuera police, said they were able to secure a search warrant on Espinosa’s ancestral home after receiving positive information that kilograms of shabu are being stored in the compound. What immigration benefits are available to same sex marriages post DOMA? On June 26, 2013, the US Supreme Court struck down section 3 of the Defense of Marriage Act (DOMA) as unconstitutional in the landmark case US. V. Windsor. The BIA shortly thereafter issued a decision in Matter of Zeleniak holding that DOMA is no longer an impediment in recognizing same-sex couples under the immigration and Nationality Act. Matter of Zeleniak, 26 I&N Dec. 158 (BIA 2013). This means a same-sex marriages are now valid for immigration purposes as long as the marriage is recognized in the “place of celebration.� This means a same- sex marriage is valid for immigration purposes as long as it was valid in the place of celebration. The same-sex marriage is valid even if the applicant is applying in a country in which same-sex marriage is illegal. On June 26, 2015, the United States Supreme Court ruled in Obergefell v. Hodges that state-level bans on same-sex marriage are unconstitutional. The court ruled that the denial of marriage licenses to same-sex couples and the refusal to recognize those marriages performed in other jurisdictions violates the Due Process and the Equal Protection clauses of the Fourteenth Amendment of the United States Constitution. In the area of immigrant visas, a same sex US Citizen spouse or legal permanent resident spouse may now petition for an immigrant visa for their spouse as long as the marriage was valid in the place of celebration. Validity of the marriage is not based on the place of domicile. Stepchildren acquired through the same sex marriage can also qualify

under the same requirements as stepchildren acquired through opposite sex marriages. Same sex spouses and qualified children or step children can also qualify as dependents of employment-based categories and family-preference categories as derivatives. Same-sex partners of US citizens may also apply for K-1 fiancĂŠ non-immigrant visa the same way opposite sex partners may petition for a fiancĂŠ visa. The same sex US Citizen spouse may then file an immigrant petition and adjustment of status after the fiancĂŠ enters the US and marries the US citizen spouse. Widows and widowers of same-sex spouses can also qualify for immigration benefits under INA 204(l). Generally, this is done by filing a self-petition within two years of the death of the US citizen same sex spouse. In the area of non-immigrant visas, same-sex spouses and their children are now eligible for non- immigrant visa as a derivative. Same sex spouses and their children can qualify as derivatives in non-immigrant visas including H , E , L , O , R visas, etc. For aliens with final removal orders issued prior to the Windsor decision, the recognition of the validity of same sex marriage makes available new relief for their case. It may be possible to file a motion to

Caregivers: are you receiving overtime pay? Under California law most caregivers must be paid overtime compensation when working 24hour shifts. With the increase in California’s minimum wage to $10 an hour on January 1, 2016, that means a 24- hour caregiver must be paid $315 a day to comply with the current law. Many caregivers are working under a day rate or monthly salary. A day rate or monthly salary does not compensate for the overtime hours worked and results in a substantial unpaid overtime claim for the caregiver. Oftentimes, employers attempt to avoid liability by claiming the caregiver is an “independent contractor.”

In most circumstances, this argument will fail as typically employers maintain significant control over the caregiver such that that California law will find the caregiver to be an employee. This change in the overtime rules for caregivers became effective on January 1, 2014, when the Domestic Worker Bill of Rights (DWBR) became law. Previously, employees who qualified as “per-

This is especially true when the applicant either has no prior credit history or the credit score is not high enough for other reasons to warrant an approval. This happens every single day- on loan applications to purchase a car, a home, personal property or even for a credit card. So what does the applicant often do in order to get approved? He or she will usually call Mom or Dad, a brother, sister, friend or maybe even a co-worker asking them a “favor” by acting as a cosigner on the loan. I see this happen a lot with my Filipino clients. They are all so willing to help at any costs and if they have better credit than the applicant, they will not hesitate to sign on the dotted line. The question is: Do they really understand what they are signing? Listen to me! More often than not, this could be one of the biggest mistakes you can make in your life especially if the person you are cosigning for is likely to default on the obligation! Think about this for a minute. Ask yourself this question before cosigning for anyone. Why do you think the bank or lender is asking you to guarantee the loan in the first place? Answer: Because they believe that the applicant has a high likelihood of not being able to pay, that’s why! That means in the eyes of the lender, they are a credit risk. So what do they do? Well, they don’t want to carry that

risk themselves- so they want to pass it on to you! The cosigner is fully legally responsible for the entire debt, just as the main borrower is. Let me put it bluntly: When you cosign, you are not just being “nice”. What you’re essentially doing is you’re saying to the lender: “I take full legal responsibility for this debt. You can come after me to collect as if I borrowed this money myself.” Question: Are you really prepared to do that? As a bankruptcy attorney who has filed more than 6,000 bankruptcy cases over the years, I often feel bad for cosigners because in a lot of cases that I’ve handled, the only reason they are filing for bankruptcy is because the person they cosigned for defaulted on a debt, and now the creditor is after them. The cosigner is usually a well-meaning dad, mom, spouse, boyfriend, cousin or friend who simply wanted to help the borrower purchase a car, a home or get a loan to pay bills or whatever. The borrower usually promises the cosigner “not to worry about it” because they will “pay on time.” Guess what? The sad reality is that many times, that’s not what happens. For whatever reason, the borrower doesn’t pay the bill so the

MANILA, Aug. 10 (PNA) – Malacañang on Wednesday allayed fears that President Rodrigo R. Duterte would declare martial law amid the intensified campaign against illegal drugs. Presidential Communications Office (PCO) Secretary Martin Andanar said President Duterte was merely asking a rhetorical question when he hit back at Supreme Court (SC) Chief Justice Maria Lourdes Sereno for interfering in his campaign against the drug menace. ”Ikaw [Sereno] ang kingpin sa judiciary. Ako, presidente. Ako may trabaho, ikaw wala. Walang mga judges na nagpa-patrol ng daan. Walang mga sheriff ninyo na naghuhuli. ‘Yan ang mabigat na problema ko, na-inherit ko sa dumaan (na administrasyon), pati ‘yung gobyerno na naglagay sa ‘yo diyan... If this continues, pigilan mo ako eh ‘di sige. ‘Pag nagwala na... or would you rather that I will declare martial law?” Duterte said in his speech in Cagayan de Oro City Tuesday night. Andanar also defended the inclusion of the seven judges in the drug list that President Duterte announced early Sunday morning. ”When the President referred the named judges on his consolidated list to the Supreme Court, he was acknowledging the jurisdiction of the Supreme Court over the judges. He recognizes the separation of powers, and even asked the Chief Justice of the Supreme Court not to create a constitutional crisis,” he said. ”By calling out the names of the judges on the list, he is giving them every chance and opportunity to be prepared to defend themselves, clear their names if they are innocent, and alert the community of their involvement in drugs if they are guilty,” he added. Andanar said not every Filipino would agree with the way President Duterte addresses the drug problem “but the President is putting his life, his honor, and the presidency at stake.”

President Duterte has already given the “green light” for the burial of former President Ferdinand Marcos at the Libigan ng mga Bayani next month despite strong indignation coming from anti Marcos organizations and human rights activists. The “yellow ribbon” allies and boot lickers of the Aquino/Cojuango clan are threatening to hold protest rallies hoping that they may still be able to convince President “Digong” to reconsider his decision to have the late president be interred at the heroes’ cemetery. As I was writing this column, President Duterte seemed to be unperturbed to the threat of massive protest rallies by various anti Marcos and human rights groups. Duterte even encouraged the protesters to hold their protest rallies, promising them a month’s permit to hold such protest action, provided they don’t commit crimes and impede the flow of vehicular traffic. I think it is about time that the corpse of the former “strongman of Asia” be buried at the Libingan ng mga Bayani. The former president’s corpse has been preserved for so many years now at his home province of Ilocos Norte. As a former president and a soldier who served during World War II, Marcos deserved to be buried at the Libingan ng mga Bayani, even though his 20-year rule was marked by widespread corruption and alleged human rights violations. As far as being a war hero, that is another matter that can be debated upon, depending on your political affiliation or ideology. It is about time that the nation put closure to this controversy and let history judge him for what he did in the past. I think the Marcos family has suffered enough humiliation from the public and the media for years. I also think that the people’s hatred for the late President Marcos, as well as his family, has waned through the years. Just think of how many voted for Sen. Bongbong Marcos, who may have won, according to him. If majority of the Filipinos still hates the Marcos family, how come former Senator Bongbong Marcos garnered more than 13 million votes during the May 9 vice presidential election? • Supreme Court Chief Justice Lourdes Sere-

Duterte also apparently didn’t take well the four-page letter he got from Sereno, which stated that the revelations of the names of judges implicated in illegal drugs was “premature” and could endanger their lives. Sereno has also cautioned the judges not to surrender in the absence of an arrest warrant. This must have angered Duterte who warned Sereno not to create a constitutional crisis since he will be forced to instruct the entire executive branch to ignore the high court’s orders. The feisty Duterte also questioned Sereno’s credibility, as well as the Aquino administration, for being inutile for the past six years in addressing and ignoring the continued proliferation of illegal drugs in the country. It was former President Benigno Aquino who appointed Sereno, the most junior among Supreme Court justices, after the sitting Chief Justice was removed through impeachment. If Sereno has any plans of engaging a word of war with President Duterte, she should think twice since she is expected to lose. Besides, Duterte knows that Sereno has lots “skeletons in the closet” being hidden from the public. Majority of the people are also backing up the campaign of President Digong against illegal drugs. They are apparently overjoyed that President Digong is doing what other past presidents have not done or have failed to address regarding the menace or danger of illegal drugs to our youth.

Duterte to Sereno: No winner in a ‘constitutional war’ MANILA, Aug. 10 (PNA) – President Rodrigo R. Duterte has dared Supreme Court Chief Justice Maria Lourdes Sereno to undergo a reality check, urging her not to create a constitutional crisis over his naming of judges allegedly involved in illegal drugs. “Please go to reality. Huwag ka masyado dun sa itaas… I have my oath. I will defend the Constitution, I will honor the flag, but do not create a conflict there because hindi tayo magkasundo… (we would disagree...) Please, please, please do not create a confrontation, a constitutional war, talo tayong lahat diyan (we will all lose there),” the President said on Tuesday. In his speech before more than 400 soldiers of the Fourth Infantry Division (4ID) of the Philippine Army, Duterte said naming the judges implicated in illegal drugs is the duty of the chief executive as lead implementor of the law. “It was not an accusatorial utterance but rather it was in consonance with my duty as president of the Philippines to let everybody know sino yung mga tao sa tabi-tabi mo (who are the people linked to narcotics near you), to spare you the agony and greed of a child being raped,” Duterte said about his remarks last Sunday. Sereno, in a letter dated Aug. 8 and sent

through Justice Secretary Vitaliano Aguirre II, said Duterte’s revelations last Sunday was “a premature announcement of an informal investigation on allegations of involvement with the drug trade” and that the President’s action leads to “the unwarranted effect of rendering the judge veritably useless in discharging his adjudicative role.” “It would be very helpful if the investigators who included the names of Judges Dagala and Gonzales inform the Court how these MTC judges can be considered as influencing the drug trade,” the Chief Justice said. Sereno disclosed that the high court is “currently investigating a report on a judge who may be so involved” but is not on the list the President revealed. “To safeguard the role of the judges as the protector of constitutional rights, I would caution them very strongly against ‘surrendering’ or making themselves physically accountable to any police officer in the absence of any duly-issued warrant of arrest that is pending,” Sereno said. President Duterte said he never ordered anybody to be arrested and that his statement was for judges to report to the Supreme Court, and for the police to report to Philippine National Police (PNP) Chief Director General Ronald dela Rosa.

Why Sarah didn’t watch Matteo compete at Ironman Actor Matteo Guidicelli admitted competing in this year’s Cobra Ironman 70.3 Asia-Pacific triathlon in Cebu was “super tough� for him, as he only had two weeks to prepare for the race. In an interview after finishing the race on Sunday, Guidicelli shared that he found all three legs of the competition very challenging. “It was a tough race. Despite the increasing importance of AAPIs, there is a significant gap in what is known about these communities, with problems ranging from invisibility to mistaken assumptions that all Asian Americans are self-sufficient, well-educated, and upwardly mobile. continue to rise. A friend of ours who is a real estate agent said we should get pre-approved for a mortgage loan. I’ve started researching this, and now I’m even more confused than I was before. What does the pre-approval process involve? How is it different from pre-qualification?” Start the Pre-approval Process Online You’re not alone in wondering this. Last month, more than 4,000 people reached out on website asking about “pre-approved” and “pre-approval” phrases. It’s also one of the most common questions I get from mostly first time buyers and would be buyers now a days. Here are the questions related to this subject: How do I get pre-approved for a home loan? What kind of documents do I need? Is there a no income verification loan yet? My credit might not be good enough yet due to my pass history? Is it free, or do I have to pay an application fee? I’ll answer each of these questions in detail later on. But first, I want to give you a basic definition. Mortgage Pre-Approval Defined Pre-approval is when a mortgage lender reviews your credit and financial situation to determine how much they are willing to lend you. Normally, you would do this before shopping for a home. The idea is to get a rough idea what you can afford, and then shop within those parameters. Later, after you’ve made an offer to buy a house, you would go back to the same lender for final approval. This is usually how it works, anyway. A good interviewer will ask you a lot of questions to really get down to your financial status, you also should help by volunteering all information correctly and accurately. There is no point to hide anything, trust me we will find out sooner or later. In a sale situation it’s better to find out things upfront in order to find ways to resolve them. Otherwise you will might drag yourself and everyone involved into a very stressful failed transaction and loose time and money in the process. Note: Getting pre-approved for a mortgage loan is not a guarantee. It does not obligate the lender in any way. You’ll face a secondary review process later on, in order to get your final approval. There’s a lot more underwriting involved with the final approval. How It Benefits You, as a Home Buyer In my opinion, every home buyer should get pre-approved for a loan (unless you’re paying cash for the house). It only makes sense when you think about it. You could spend days or weeks looking at houses in a certain price range, only to find out that you’re qualified for a lesser amount. What a waste of time. But when you start with the pre-approval, you’ll have a pretty good idea what you can afford—or what the lender says you can afford, anyway. Also this will tell you how to prepare to buy in the future in case you are not quite ready at this moment. Sellers will take you seriously. Put yourself in the seller’s shoes for a moment. Imagine you get two offers from potential buyers. One has been pre-approved already and has a lender lined up. The other buyer

hasn’t even spoken to a mortgage lender yet. If the offers were for the same amount, which one would you take? It’s sort of a no-brainer. This is especially important in an active market, where multiple offers are a reality. How Do I Get Pre-Approved for a Home Loan? Your first step is finding a mortgage lender or broker. Do you know someone who has purchased a home recently? If so, ask them what lender they used (and if they would recommend them). If you have an existing relationship with a bank, you could start there as well. The same goes for a credit union. If you use a mortgage broker, you’ll probably have access to a handful of lenders the broker works with. There’s certainly an advantage to this. I believe finding the right person is most important, you want someone with experience who knows the typical lending guidelines in getting a loan approved. Again, someone who will ask you a lot of questions, be doubtful about lenders who just willingly give out Pre-Approval Letters without properly conducting a thorough interview. Ready to Get Started? What Documents Do I Need? What documents are needed for mortgage pre-approval? This is another common question among first-time home buyers. The list of documents will vary, depending on which lender you use. But most of them will ask for some or all of the following items: a. 2 years complete federal taxes with your W-2’s to show history of your income. Determining whether you are self employed or salaried. b. 2 recent paystubs to prove recent employment and current income. c. 2 months of banks statements to show your ability to put a down payment on a house and to show reserves after a purchase transaction. d. A credit report will show all your credit history and current liens and debts. This will give the lender an accurate measure to calculate for debt to income ratios. Your lender will give you a complete list of the documents they need, at the time you submit an application. For Self Employed borrowers there could be more documents required. This Service should be free except for the credit check. Do not pay anyone for this Pre-approval letter or a Commitment to buy a house. SANTA ANA, California – A Brea man pleaded guilty this morning to federal charges related to his role as the owner and operator of a multi-million dollar fraudulent mortgage modification scheme that posed as a successful law firm to defraud struggling homeowners. Bryan D’Antonio, 50, pleaded guilty to one count of conspiracy to commit mail and wire fraud for his role as owner and operator of Rodis Law Group (RLG) and America’s Law Group (ALG). D’Antonio pleaded guilty before United States District Judge David O. Carter, who is scheduled to sentence the defendant on January 30, 2017. “D’Antonio preyed on vulnerable victims – struggling homeowners,” said United States Attorney Eileen M. Decker. “Pretending to offer legal assistance to their victims, D’Antonio and his cohorts actually offered nothing but false hopes and empty promises. Now, he will be held accountable in federal court for the damage he has caused so many victims.” D’Antonio admitted that, between October 2008 and June 2009, he participated in a scheme that induced homeowners to pay as much as $5,500 for the services of RLG and its successor entity, ALG. RLG and ALG advertised on radio stations across the country and urging struggling homeowners to call a toll-free number. The companies purportedly consisted of “a team of experienced attorneys” who were “highly skilled in negotiating lower interest rates and even lowering your principal balance.” In fact, RLG and ALG were telemarketing operations that never

had teams of experienced attorneys. During much of the scheme, one man – co-defendant Ronald Rodis – was the only attorney at RLG. In a plea agreement filed in federal court, D’Antonio admitted that the RLG and ALG schemes fraudulently obtained approximately $9 million from more than 1,500 victims. “At the height of the mortgage crisis, this defendant, a convicted felon who was prohibited from any business engaged in telemarketing, created two fake law firms that promised struggling homeowners assistance saving their homes and modifying their mortgages,” said Principal Deputy Assistant Attorney General Benjamin C. Mizer, head of the Justice Department’s Civil Division. “Despite the many promises, these were telemarketing sales operations that took homeowners’ money and provided no meaningful assistance.” D’Antonio was previously convicted of mail and wire fraud and sentenced to four years in federal prison for his participation in a medical billing scheme. He was also subject to a permanent injunction prohibiting him from having any involvement with any business that engaged in telemarketing or misrepresented the services it would provide. In conjunction with his guilty plea today, D’Antonio admitted that he started RLG while he was still on supervised release from his prior conviction. In violation of D’Antonio’s permanent injunction, RLG and ALG sold their services through an extensive telemarketing operation and employees routinely misrepresented the services RLG and ALG would provide.
