BATO: WE WILL BARE ALL Senate to probe killings of drug suspects MANILA, Aug 16 (Mabuhay) -- Philippine National Police chief Director General Ronald dela Rosa assured the senators on Tuesday that police officials “will bare all” during the scheduled Senate investigation on the spate of killings of drug suspects next week.

War on drugs tops list of ‘first 50 days’ report of Duterte MANILA, Aug. 17 (PNA) – The aggressive campaign against illegal drugs has topped the list of the achievements of President Rodrigo R. Duterte in his first 50 days in Malacañang. ”The No. 1 achievement of President Duterte is the presentation of 600,000 drug pushers and users,” Presidential Communications Office (PCO) Secretary Martin Andanar revealed duringthe weekly Kapihan sa Manila Bay at the Café Adriatico in Manila on Wednesday. Andanar said President Duterte will mark his 50th day as the country’s 16th President on Aug. 18 in a simple ceremony to be highlighted by a short video presentation containing his achievements in just 50 days in office. ”Of course, there is also the drop of the crime rate by almost 40 percent compared to the same period last year,” Andanar said. He said the Philippine National Police

(PNP), headed by Police Dir. Gen. Rolando ‘Bato’ dela Rosa, is on target to finish the war against drug in six months. Andanar said the signing by the President of Executive Order No. 2 for the implementation of the Freedom of Information also topped the list, followed by the shutdown of irresponsible mining firms and the fight against contractualization. ”We would disseminate the FOI manual templates to the different government agencies that would serve as guide in coming up with guidelines for the FOI implementation,” Andanar said. He said the FOI manual template was designed by the PCO, using the best practices in other countries, particularly in the United Kingdom. ”We are making it professional,” Andanar said. De Lima on Duterte’s ‘foul’ remarks: It’s character assassination By Azer N. Parrocha

MANILA, Aug. 17 (PNA) – A teary-eyed Senator Leila de Lima on Wednesday cried foul over President Rodrigo Duterte’s recent remarks about her, describing them as a form of “character assassination”. Duterte, during his speech at the 115th service anniversary of the Philippine National Police (PNP) in Camp Crame Wednesday, mentioned how a certain senator had a “lover” who accepted drug-money from the Bilibid Prison in Muntinlupa. Though the President did not mention a name, he said that the senator was an “immoral woman” who funded the house of her lover. De Lima said she was taken aback by the statements, which she did not want to dignify. “It’s so foul. It’s character assassination. We’re both professionals, we’re both public servants. Wherever that information is from, he should double-check. He should find the source,” de Lima told reporters. ”I don’t know what their agenda is. It’s a very clear case of character assassination and I did not expect the president to do that,” she added. Majority of US young adults reject Donald Trump: poll WASHINGTON, Aug. 16 (PNA/ Xinhua) – Despite US Republican presidential nominee Donald Trump’s strategy of patching together a bipartisan coalition by appealing to the millions of young supporters of former Democratic candidate Bernie Sanders, a new poll found that his populist play had so far failed among millennials. The latest USA Today/ Rock the Vote poll released on Sunday found

that while 56 percent of voters under 35 say they would vote for Democratic presidential nominee Hillary Clinton, one in five in this age group support Trump. In addition, Clinton trounced Trump among Sanders’ supporters, with 72 percent supporting the former secretary of state and 11 percent backing Trump. The number of the Millennial generation, now 18-34, was estimated to

be 75.4 million, according to US Census Bureau data released in April. While young voters tended to vote for Democrats in recent election cycles, the latest poll by USA Today and Rock the Vote showed that young adults may reject the Republican nominee at an unprecedented rate during this election cycle. Loan Modification vs. Bankruptcy

If you are having a hard time making ends meet and paying your monthly mortgage, you may wondering what to do. People who are having a hard time making their mortgage payments often rely heavily on credit cards, which eventually reach their limit. This of course creates even a bigger problem. While a loan modification may a good option for you, a high debt to income ration can prevrnt you from qualifying. Loan modifications are very desirable for cash strapped homeowners suffering financial hardship. Lenders will often be agreeable to renegotiate the terms of your existing home loan, if they know that would keep you in the home and avoid a foreclosure. This could be a reduction in interest rates, or a change in terms of the loan. Under certain circumstances, it is even possible to obtain a principal reduction of the loan balance. Your lender does not want your home to go into foreclosure, because it will accrue a significant loss if the property value is less than the amount owed. Home owners trying to get their loan modified, frequently consider bankruptcy too. A common scenario arises in this situation. When you apply for a loan modification, the mortgage lender will look at your debt to income ratio. The lender will want to see that if they reduce your mortgage payment you will still be able to make your house payments in full and on time. If you have a high degree of credit card debt, a lender may feel that even with a reduced mortgage, you may not be able to make your house payment. What the lender is saying in this case is that your debt load is so high, you cannot afford to keep your home. The lender in this case could foreclose on the property (assuming that you are behind on your payments). Keep in mind that mortgage lenders do not want to foreclose on a property, and it is usually considered a last resort. However, once a Notice of Default is filed, the statutory period starts running. After 90 days have passed, the lender only has

to give 21 days notice of a Notice of Trustees Sale. These time frames are pursuant to California statutes, each state may vary. Filing for bankruptcy will halt the foreclosure process. A skilled bankruptcy lawyer would be invaluable at this point, and could advise you to file for bankruptcy, which can buy you valuable time to explore other options. He could also tell you that if the current market value of your home is less than the amount of the first mortgage, your second mortgage can be “stripped down,� or removed. If you are preparing to file for a loan modification, it is important to discuss your plans with a bankruptcy lawyer. Together you can analyze your current debt to income ratio, and make adjustments prior to applying for a loan modification. Consolidating or eliminating debt where at all possible may make just the difference in obtaining a loan modification. Your mortgage lender will also want to see that you are employed, and have a steady income so that you will be able to pay your mortgage payment. Your lender will also want to be assured that whatever caused your initial financial hardship has been addressed, and it is behind you. Dealing with financial problems is never easy. Filipina Navy officer makes history at UK’s Royal Naval College MANILA, Aug. 16 (PNA) – Philippine Navy Ensign Maycee Angga was recently recognized as the Best International Student out of 131 naval officers at the Britannia Royal Naval College (BRNC) passing-out-parade in Dartmouth, United Kingdom (UK) on Aug. 11. Angga is the only female international student in a batch composed of naval officers from Albania, the Bahamas, Egypt, Libya, Qatar, the United Arab Emirates (UAE), UK, and Ukraine. Out of 20 foreign cadets admitted to BRNC this year, only 10 made it to graduation. Angga made history as the first Filipino to attend and complete the 30-week training course at BRNC under the support of the Philippine Navy and the UK Government. The said course began in Jan. 4. The intensive training course in-

cluded a study visit to France, and a three-week ship acquaint where Angga was assigned to HMS Bulwark, an amphibious assault ship operating in UK waters. Consul Rommel Romato represented the Philippine Embassy during the passing-out-parade. He also conveyed the congratulatory message of Philippine Ambassador to the UK Evan Garcia to Angga. Vice Admiral Jonathan Woodcock OBE, Second Sea Lord and Deputy Chief of Naval Staff, was the guest of honor during the ceremony. BRNC was established in 1863 in Dartmouth, England as the initial officer training establishment of the British Royal Navy. Majority of its cadets come from the Royal Navy, the Royal Fleet Auxiliary, and naval organizations from foreign and Commonwealth countries.

PHL basketball association mourns passing of Coach Baby Dalupan MANILA, Aug. 18 (PNA) – The Samahang Basketbol ng Pilipinas (SBP) on Thursday expressed sadness over the passing of Coach Virgilio “Baby” Dalupan at the age of 92. “We in SBP deeply mourn the passing of Coach Baby Dalupan. He was the most multi-titled coach in elite Philippine basketball – combining his collegiate, commercial, PBA and national team stints into 52 championships,” the SBP in a press statement. “He likewise served flag and country when he coached the national team five times in various international tournaments, including the 1959 FIBA World Championship and the 1970 Asian Games.” It further stated that the SBP will miss Coach Baby “but will fondly

keep him in our hearts and minds, always remembering his immeasurable contribution toPhilippine Basketball.” For his coaching wizardry, the sports media aptly gave him the moniker, “THE MAESTRO”. Coach Dalupan had a 16-year stint in the Philippine Basketball Association (PBA), highlighted with a record-high 52 basketball championships. He was best known for his sterling coaching job with the Crispa Redmanizers. Dalupan held the record for winning the most number of UAAP men’s basketball championship titles -- 12 as coach of the University of the East Red Warriors. The UAAP is the University Athletic Association of the Philippines.

Pinoys win medals in 2 China math Olympiads MANILA, Aug. 16 (PNA) – Filipino students continued their winning streak abroad by bringing home medals from two math Olympiads in China. The Philippine teams won one silver and three bronze medals at the 15th China Girls Mathematical Olympiad (CGMO) in Beijing, and one silver and four bronze medals at the China Southeast Mathematical Olympiad (CSMO) in Jiangxi, two of the toughest math contests in China. In the CGMO, held from August 10 to 14, Tiffany Mae Ong, a Grade 11 student of British School Manila, won the country’s silver medal. Bagging bronze medals were Grade 10 students Angelika Joie Tagupa of Philippine Science High School-Main, Natalia Beatrice Dy of St. John’s Institute in Bacolod City, and Jinger Chong of St. Jude Catholic School, according to

MANILA, Aug. 16 (PNA) – On his first committee hearing as Chairman, Senator Emmanuel “Manny” Pacquiao on Tuesday urged the Philippine Sports Commission (PSC) to nurture the talents of Filipino athletes and end corruption within the committee. Pacquiao, Chair of the Senate Committee on Sports, asked PSC Commissioner William “Butch” Ramirez to present the agency’s grassroots sports program and suggested ways to enhance it such as training athletes at a young age. “If there is talent there, nurture him. After he graduates from school, continue nurturing him. When the time comes, we will be collecting medals,” Pacquiao said in Filipino.) Ramirez for his part reiterated his plan to create a masterplan that will

allow the committee to build more sports training facilities and provide athletes with the best coaches, dieticians and physicians. He said that he targeted the completion of the masterplan before September. The boxer-senator meanwhile urged Ramirez to put an end to corrupt practices within the committee, especially if it would directly affect the athletes. Bello orders intensified campaign vs. illegal recruitment 2 recruiters with fake Swiss job offers nabbed

MANILA, Aug. 17 (PNA) – Labor Secretary Silvestre H. Bello III has ordered the Philippine Overseas Employment Administration (POEA) to intensify its campaign against illegal recruiters after two of them were nabbed offering fake jobs in Switzerland. Citing a report from POEA Administrator Hans Leo J. Cacdac, Bello said the National Police’s Criminal Investigation and Detection Group conducted an entrapment operation that led to the arrest of Wilfrido Liwag David and Jemmalyn Mimis

Barlan for luring 12 workers with false jobs in Switzerland. “The arrest of the two illegal recruiters are part of the government’s intensified campaign against illegal recruitment,” said Bello. The non-existent job offers were for hotel and factory work, involving a supposed Swiss employer named KBR or Kelloggs Brown Root Company. The victims were promised salaries ranging from PHP60,000 to PHP70,000 and ready visas. They were also told that their applications would be processed in 45 days. In his report, Cacdac said no placement fee is needed for overseas

recruitment, but the victims were required to pay medical examination fees ranging from PHP3,500 to PHP6,000 to a clinic in Ermita. The victims reported their recruiters to the POEA, which endorsed the cases to the National Police for an entrapment operation. Police conducted the operation in Robinson’s Manila, where David and Barlan were caught in the act of illegal recruitment. The two will be brought to the Department of Justice for inquest proceedings. Bello ordered an immediate investigation and directed the POEA to monitor the case.

MANILA, Aug. 17 (PNA) – Traffic gridlock in Metro Manila and public safety are among the major concerns of the Department of Tourism (DOT) in hosting the Miss Universe pageant in the country next year. These were the key issues discussed during the first meeting of the Philippine Host Committee (PHC) recently, which comprises several agencies, in preparation for the highly-anticipated beauty pageant. “The maddening traffic mess is obviously the one single problem that beset our daily economic activities in Metro Manila, and we will find ways so as not to aggravate this with the hosting of Miss Universe,” said Tourism Secretary Wanda Teo in a press release. “Or better yet, the hosting committee might as well come up with a solution to the traffic gridlock,” she added. Considering the possible incon-

venience the holding of pre-pageant would cause to Metro Manila residents, the committee is looking at the provinces of Cebu, Davao, Palawan, Batangas, Iloilo, Isabela and Vigan in Ilocos Sur for these events. The coronation night, however, will still be held in Manila at the Mall of Asia Arena on Jan. 30, 2017. PHL expects more than 100,000 tourists from India by 2017 By Jill Beltran

MANILA, Aug. 17 (PNA) – The Department of Tourism (DOT) is expecting a surge in the number of Indian tourists visiting the country by next year following a successful roadshow in four cities in India recently. A DOT delegation led by Director Verna Buensuceso conducted a series of roadshows in India from August 8 to 11, covering four cities such as Kolkata, Chennai, Bengaluru and Mumbai. Speaking at the “Visit the Philippines Again” (VAP) roadshow, Buensuceso underscored that India is an important source market for the Philippines with 74,824 Indians visiting the country last year. Indian tourist arrivals register a 22.36 percent year-on-year growth, she noted.

“Kolkata, Chennai, Bengaluru and Mumbai are the important feeder markets and hence, we are looking forward to strengthening our relations with local travel partners from these cities,” she said in a statement. World’s longest, highest glass bridge to open CHANGSHA, Aug. 17 (PNA/ Xinhua) – The world’s longest and highest glass bridge will open to visitors Saturday in Zhangjiajie, Hunan Province, central China, the management committee said. The 430-meter long, 6-meter wide bridge, paved with 99 panes of three-layer transparent glasses, hangs between two steep cliffs 300 meters above the ground. The bridge has set 10 world records spanning its design and construction, according to the committee. A maximum of 8,000 visitors are allowed to cross the bridge every day and a reservation must be made one day prior to visiting. Construction was completed in December. In July, a 2-tonne truck was driven across in a show of the bridge’s sturdiness. The unique pillar-like mountain formation in Zhangjiajie appeared in the Hollywood blockbuster movie “Avatar.” The Grand Canyon Scenic Area in Zhangjiajie welcomed more than 1.2 million visitors from home and abroad in 2015.

LTFRB chief warns heads will roll as agency shuns corruption DAVAO CITY, Aug. 16 (PNA) – The Land Transportation Franchising Regulatory Board (LTFRB) has warned of a nationwide movement of officials and employees next month as the agency cleanses its ranks amid corruption accusations. LTFRB Chair Martin Delgra said the board is definitely implementing a movement of employees and directors once he completes consultations and meetings with all regional offices by September. He said he has already visited the LTFRB offices in the National Capital Region, Regions 1, Northern Luzon, 11 and 12 where he discussed various concerns and issues. Delgra, who was among the first appointees of the Duterte administration, had been instructed by President Rodrigo Duterte to rid the agency of corruption. Delgra said there is an ongoing investigation within the LTFRB. He warned that those accused of money-making activities in LTFRB will not go unpunished. He was referring to complaints and information that some of the employees and directors have alliances with fixers inside and outside the agency, especially regarding the application of franchises. Delgra confirmed that the system and money-making activities within the LTFRB is unimaginable that when he asked employees and officials if Duterte’s statement that it is a corrupt agency is true, he only got a long silence for a response. He said even former regional directors have links to fixing activities, such that some operators were granted franchises even though the documents they submitted were in-

complete. “We will be fair. We will be feared,” Delgra said, adding that ”we will break the butter”, referring to alleged SOPs for the processing of franchises and other documents. Lawyer Aileen Lizada-Lopez, a member of the LTFRB Board, said a review of the agency’s work showed spurious decisions made by LTFRB officials. While she would not refer to a particular regional office, Lopez said one regional office would collect as much as PHP200,000 for one franchise. She said they are working on improving the system of the LTFRB to cut processing time. She said they are using log books to pinpoint responsibility in the delay of applications. Review of moratorium The LTFRB will also conduct a comprehensive review of the 10-year moratorium on the issuance of franchises, which Delgra described as a major source of corruption. He reminded operators that a franchise must not be sold to other operators because it is a special privilege granted by the government to a specific applicant. Delgra said a franchise is free and what an operator pays are the administrative costs to apply for franchise. Delgra said the board has already ordered a stop to the sale and transfer of franchises because they are supposed to be returned to the LTFRB if the vehicles are no longer registered. On the lifting of the moratorium, Delgra assured that they will level the playing field and no favor will be given to any particular transport group.

Piñol orders creation of anti-illegal fishing task force in West PHL Sea MANILA, Aug. 16 (PNA) – Agriculture Secretary Emmanuel “Manny” Piñol has ordered the immediate creation of the West Philippine Sea Anti-Illegal Fishing Task Force, in a bid to protect the country’s marine environment. The order came after Piñol received information from a group of fisherfolk in Zambales about illegal fishing activities in the area, including blast fishing and the entry of suspected foreign poachers. The fisherfolk asked the agriculture chief “to apply the full force

of law” to those who will be apprehended. They also requested that radio communication equipment be set up on their boats so they would be able to report violations to the Philippine Coast Guard (PCG). Piñol instructed Bureau of Fisheries and Aquatic Resources (BFAR) national director Eduardo Gongona to lead the task force. “The bureau will utilize its resources to ensure we carry out his directive and enforce Philippine fishing laws,” Gongona said.

Gov’t to develop universal ID system for Pinoy seafarers MANILA, Aug 16 (Mabuhay) – The government is set to develop a universal identification system for Filipino seafarers, Labor Secretary Silvestre Bello III announced Monday. In a statement, Bello said the new ID system will be “acceptable to all government agencies and port states in compliance with relevant conventions.” The development of the universal ID system for seafarers was formalized by Resolution No. 13, Series of 2016, of the Philippine Overseas Employment Administration’s (POEA) Governing Board that Bello chairs. Under the resolution, the POEA will be coordinating with the Maritime Industry Authority (MARINA) to develop an online registration system for seafarers by September 15, 2016 and will conduct an information dissemination campaign to Filipino seafarers and licensed manning agencies to create awareness of the benefits of the online registration system. At present, Filipino seafarers are given Seafarer’s Registration Certificate with ID numbers for easy access to their POEA records and for the efficient processing of their employment certificate. “The POEA has established a Seafarer’s Registry to maintain a pool of qualified seafarers,” Bello said. “This is essential for policy research and supply and demand analysis.” MARINA, on the other hand, issues Seafarer Identification and Record Book (SIRB) in compliance with the International Labor Organization Convention No. 108, 1958, which serves as the Filipino seafarers identification document while on board ships.

Targeting two shows with different genres:’As Straw Before the Wind’ debuts at Ruby Theatre and Minerva Vier’s Web Series: ‘Wingin’ It’ Scheduled for the next three weeks ending on September 4, 2016 at the Ruby Theatre in Hollywood, the theatrical presentation of “As Straw Before the Wind” had its premier opening night last Saturday, August 13th. The play centered on the story of Nene Santos (Tita Pambid), an entrepreneurial Filipino nurse who survived the perils of World War II, only to find out various other struggles in her family life later on. Nene was the enterprising owner/ operator of a fictionalized San Gabriel Valley convalescent home, who has ambitious plans to expand her business, which she intended to pass on to her only daughter and primary assistant, Pilita, who otherwise had other plans including leaving her mother and marrying her boyfriend. Though as a practicing nurse, Nene had compassion for his patients: Poncing Enrile (Muni Zano), a retired Filipino American Army Captain and Mildred Novak (Anita Borcia), a chain-smoking widowed retiree with Alzheimer’s Disease, her enterprising personality became a stumbling block in her ambitious pursuit for progress hoping for a larger facility. In her quest for progress, she was confronted by the horrendous flashbacks she and her family endured during World War II, when the Japanese occupied her home country, the Philippines. Nene’s flashbacks haunted her through her financial struggle, as well as parental conflicts with her daughter Pilita, who in turn was focused on leaving her to marry her boyfriend. That mother/daughter relationship was juxtaposed by the father/daughter relationship of Maria Enrile (Rochelle Lozano) with her dad, Poncing Enrile (Muni Zano)

The benefits of stipulated judgment in divorce The most common reason why married couples file for divorce is irreconcilable differences. They have arrived at a point in a relationship where they cannot agree on anything. Such being the case, it becomes very difficult, if not impossible to reach an amicable settlement in divorce proceedings. The thing is; agreeing on how to settle things may save divorcing couples a significant amount of legal fees and costs. Getting a final divorce decree through a stipulated judgment may mean savings of several thousands in legal fees and costs as compared to going through trial. In a Stipulated Judgment, the Court adapts the parties’ agreement as the final judgment. If the parties’ cannot agree and the matter goes to trial, it is the court that makes the decision. The judge often admonishes the parties that, he or she prefers that they resolve their own issues but that if they cannot, then that’s the time he or she comes in because he/she is aware that divorce trial is more costly, more stressful and more adversarial. Unfortunately, proceeding amicable or reaching a stipulation in a divorce setting is easier said than done. In property division alone, although everybody seem to know that each party is entitled to half of whatever community asset, several issues and disagreement arise as to what are community assets, what are its values, who should pay who and how should it be divided. In many cases, the house is a major issue. The first issue is usually the valuation of the property. Who gets to keep it? If the wife will keep it, how much should she pay the husband for his share? How will they equalize the party? Same thing is true if the husband gets to keep it. How much should he pay the wife? If only the two of them can agree on who should keep and how much the other one is to be paid for his interest, then resolving the division of the asset becomes easier. If they don’t, then they will have to spend on a lot of things to resolve the issue. They will have to file a motion, make a determination as to value of property, set it for hearing, pay legal fees and other costs. If they can agree, all they have to do is file their agreement in court. It is the same thing when it comes to the issue on retirement. Again, how it should be divided is the problem, although everybody knows that each party is entitled to half, where should the half be drawn if the divorcing couple are in their 40’s, 50’s 60’? What if one of the parties want their share now instead of waiting until he or she reaches the age of 65? What about if one of the parties kept giving gifts to other people while they were married? How should that be resolved, too? Regardless of what the issue maybe, it is more efficient and effective for the parties to try to reach an agreement as to how they See NATIVIDAD, page 11

In our aging society, the need for skilled caregivers is ever-increasing. Providing the best possible care often means working long hours. In the past, many caregivers did not qualify for overtime compensation because they were considered exempt from overtime as “personal attendants.� However, on January 1, 2014, California enacted the Domestic Worker Bill of Rights, which provides that “personal attendants,� including most caregivers working in private households (with limited exceptions), must receive overtime pay for all hours worked in excess of nine per day or forty-five per week. Many caregivers are not aware that they are now entitled to overtime compensation. It is vital that caregivers know and understand their rights under this new law. For example, oftentimes caregivers are improperly paid a daily flat rate of $50.00-$120.00 per day for providing 24-hour care. If you are working as a caregiver and paid a flat daily or monthly salary you are not receiving overtime pay. Under the new law, a caregiver working a 24-hour shift

must be paid at $315.00 per day. If an employer fails to pay overtime, the resulting liability can be extensive. Employees that are not properly compensated for overtime hours are not only entitled to receive their unpaid overtime wages, but are also entitled to interest, penalties, attorneys’ fees and costs. Here are a few things that caregivers should know about overtime in California: - With some exceptions, caregivers must be paid one and one half times their regular rate of pay for all hours worked in excess of nine per day or forty-five per week. - Caregivers that are paid a salary are not exempt from overtime laws. - Caregivers need to be compensated for overnight care in most circumstances.

Client seeks chapter 13 relief for massive default on mortgage; senior seeks chapter 7 relief for $19k credit cards Client is 55 and single. He appears to have no problems to worry about. He is self-employed and makes about $5K monthly teaching people a special skill. He has no dependents. He owns a house that has no equity. The house is worth $400K but he owes $420K on it. He has not paid the mortgage for at least 3 years and has massive arrears on his mortgage of $88K. He has applied several times for loan modification. Unfortunately, all attempts to modify were denied by the bank. I would surmise that his income is not easily verifiable. He filed another loan modification package three months ago (looks like he won’t take no for an answer) and the bank has yet to respond. Despite his pending loan modification request, the bank proceeded with a notice of default to start the foreclosure process. As you probably know, the bank is not supposed to proceed with foreclosure if there is a loan modification pending. However, the reality is that most banks don’t follow this law. Why should they? All you have to do is keep on resubmitting a loan modification package after each denial. As a result, the bank will never be able to foreclose on the house and you get to stay in your house without paying the mortgage forever. They’re not that dumb. So, with a week before the foreclosure sale date, he comes to see me because he says he wants to stop the foreclosure. Well, the only sure way to stop the foreclosure is with a Chapter 13. Foreclo-

sure stops upon filing of the Chapter 13 petition. The default amount gets frozen and client is given 60 months to pay the default in equal monthly installments without interest. However, the current mortgage payment must be resumed a month after the case is filed. I said, “Are you sure? Because your default is $88K and this means that your monthly plan payment to cure the default will be at least $1,466, and you have to resume your regular mortgage payment.� This means that in addition to your regular mortgage payment, you have to produce another $1,466 to save your house from foreclosure. Considering that the house has no equity isn’t it more productive to just abandon the house and rent somewhere since client is still single with no dependents. I mean, he lives by himself, so he can actually go buy a mobile home and live in it for less than $600 a month, plus rent of the space. That’s even less than the estimated plan payment. Or, he can just rent a room and pay $300 a month. There’s more than one way to skin a cat.

How to prepare to buy a house Every time a first time home-buyer comes to us to have them prequalified, we provide them these following factors that we consider important to determine how much the price range they should consider looking into when house-hunting. We ask about how much monthly mortgage payment will be comfortable for them. Normally, it would be slightly higher than the current rent they are paying. We ask about what kind of work the buyers do? The financial and income situation is very important for us to be able to find the best suitable loan program for you. We also ask about how much cash you have available for down payment and for closing costs. But do not worry, there is a wide range of loan programs right now, some of which include 99.5% loan financing with almost no down payment, and we advice to have the seller pay for closing costs. We also have the newest 97% conventional loan financing which includes the 3% for seller or lender paid closing cost. Should the seller be unwilling to pay for closing cost, we can finance the closing cost thru the rates for you. For those who have some savings as down payment, there are programs for you with the best prevailing interest rates with as little as 3.5% down. We also ask about your credit and,

what kinds of debts you owe in credit cards, car loans and/or, student loans. too. This would help determine your debt ratio. For those who do not have good credit, the good news is that we have programs that do not look at the credit score. You, can now qualify for a mortgage loan without having good credit. For first time homebuyers, our requirement for you is to have a minimum of 3 (trade lines ( credit) with ) for over 2 years history.. We no longer allow. Non-traditional credit means, these companies do not report your payment history to the bureaus. Employment verification - We, normally require a two year history of employment and it has to be in the same line of work. The gray area is you could

So he is willing to pay through his nose to save his house. Maybe it’s a matter of pride? Whatever the reason is, and I’m no psychiatrist, he is willing suffer a pyrrhic victory to save his house. A pyrrhic victory is one where the victor suffers a devastating loss to achieve victory. Of course, if the loan modification comes through, then the mortgage will become current again as the $88K default will just be added to the principal. There’s another problem that has just reared it’s ugly head. He has an adjustable rate mortgage that will reset next month by adding $500 to the monthly mortgage payment because of higher interest. When it rains it pours. On the other hand, client has no credit card debt, but he does pay for two new cars, total of about $900. Why not just abandon the house and live in the brand new van? That’s something to think about. The van has all the amenities of a house except a toilet and a kitchen. He doesn’t cook anyway. Maybe he can just buy one of those tiny houses? You can buy one for $20K. It has everything that a normal sized house has, except it’s smaller, like 200 sq. ft. We just came back from the first hearing. Client paid the plan payment plus the first mortgage payment. I guess he could be hoarding a lot of cash since

he hasn’t paid the house for two years. Next client is 80. Finally, someone older than I. Would you believe, my oldest client for Chapter 7 was 92 years old! He did his first Chapter 7 case when he was 60. He had four wives and outlived all of them. He just retired last month. His social security benefit is $1,000. His wife’s social security is $400. They migrated here just ten years ago. He had to work for ten years to qualify for social security. Rent is $900. He owes credit cards of $19K requiring minimum monthly payments of $700, which is 70% of his social security. Obviously, it’s high time to get rid of the $19K with a Chapter 7 petition. Client agrees and decides to file for Chapter 7 immediately. If you had just graduated with a degree, for example in Nursing and going into a job, with proper documentation of your schooling certificate that will be sufficient for you to qualify based on your income. Cash down payments - We, would like to see your bank statements for the previous two months and prefer that you have an average savings of what is needed to close escrow. Keep in mind that we would also like for you to have cash reserves after closing, meaning you should have some more money leftover after paying all the cost of the loan after closing. This, could be in the form of a retirement accounts, stocks, mutual funds or certificates of deposits. For FHA loans we allow 100% gift funds. Credit scores requirement - A good rule of thumb is that if you want a minimal down payment loan, you should have at least a 620 credit score. With a 580 credit score your debt to income ratio should be no more than 43%. There are varieties of programs with different credit scores requirements, to be discussed further upon request. Some cities will offer you a 5-10%

down payment for the house that you will be buying. You , have to call the city of your interest and ask for the planning and development department and ask to see if they have “CITY ASSISTANCE PROGRAM�. Provisional Waiver of Unlawful Presence expanded to cover more Immigrants The USCIS announced the final rule expanding the existing provisional waiver to allow certain family members of US Citizens and lawful permanent residents to apply for the provisional waiver of unlawful presence. 8 CFR Parts 103 and 212. The final rule goes on effect on August 29, 2016. Prior to this expanded rule, only immediate relatives of US Citizens were eligible to request provisional waiver of unlawful presence before departing the United States for the processing of their immigrant visas. This was a limited to only a subset of all individuals statutorily qualified to request a waiver of unlawful presence. The final rule expanding the provisional waiver of unlawful presence makes eligibility for the provisional waiver available to all individuals who are statutorily eligible for a waiver of the unlawful presence grounds of inadmissibility. 8 CFR Parts 103 and 212. These individuals are the parents, spouse, and son or daughter of US Citizens and spouse, sons or daughters of lawful permanent residents. The provisional waiver will also extend to the spouses and children who accompany or follow to join principal immigrants. To qualify for a provisional waiver, applicants must establish that their US citizen or lawful permanent resident spouses or parents would experience “extreme hardship” if the applicants are not allowed to return to the United States due to the unlawful presence bar. Applicants must also establish that his or her case warrants a favorable exercise of discretion and meet all other regulatory requirement. Obtaining a conditional approval of a provisional unlawful presence

waiver of inadmissibility is particularly helpful for individuals present in the United States without having been inspected and admitted or having been inspected or paroled since they are ineligible to adjust status inside the United States. The provisional waiver would also be helpful to individuals who entered the US under certain non-immigrant visa that has restrictions to adjusting to lawful permanent resident inside the US such as crew men who entered on a C-1/D visa. In addition, this is also helpful to spouse, sons or daughters of lawful permanent residents who overstayed their status while waiting for their visa priority dates to become current. An individual who entered the US on a fiancé k-1 visa based on a different US citizen fiancé/spouse will also benefit from the provisional waiver. These individuals would have to obtain their visa through the US consulate overseas but without an approved provisional waiver, would run the risk of not being able to return to the United States due to the unlawful presence bar. INA section 212(a)(9)(B)(i); 8 USC 1182(a) (9)(B)(i); In addition, the expanded final rules provided for the following: 1) All individuals seeking provisional waivers, including those in removal proceedings before the EOIR must file applications for provisional waivers with USCIS. 2) Individuals are allowed to apply for provisional

waivers even if USCIS has reason to believe that the individual may be subject to other grounds of inadmissibility. 3) Eliminated the proposal for temporal limitations that would have restricted eligibility for provisional waivers based on DOS visa interview scheduling. 4) Allows individuals with final orders of removal, exclusion, or deportation to be eligible for provisional waivers provided that the individual have already applied for, and USCIS has approved, an Application for Permission to Reapply for Admission into the United States after Deportation or Removal, Form I-212. However, an individual will be ineligible for a provisional waiver if ICE or CBP, after service of notice under 8 CFR 241.8, has reinstated the removal, deportation, or exclusion order prior to the individual filing the provisional waiver or while the provisional waiver application is pending. Bankruptcy: Should you file Chapter 7 or Chapter 13? If you’ve made the decision to file bankruptcy in order to get a fresh financial start, here are some things to consider in choosing between Chapter 7 or Chapter 13. Be aware, however, that your income and expenses have a lot to do with which chapter you will be able to file because the courts do consider your ability to pay when you’re applying for debt relief. For starters, below are some of the basic things you need to know. Under Chapter 7, you receive a fresh start by having most debts wiped out (“discharged”). This includes most unsecured debt except student loans, alimony, child support, most taxes and debts incurred by fraud. If you have non-exempt assets, you may possibly have to sell them in order to pay creditors. However, most filers do not. For example, almost 100% of my clients

keep everything and lose nothing at all by filing Chapter 7. Under Chapter 13, you must still pay off all or some of your debts over a 3-5 year period. Priority debts must be paid in full while unsecured debts are paid either a percentage or in full, depending on how much you can afford. The discharge of debt under Chapter 7 usually occurs within 5 months, as opposed to the 3-5 year repayment plan under Chapter 13. Chapter 7 stays on your credit report for 10 years while Chapter 13 stays on it for

7 years- both from the date of filing. Most people are able to rebuild their credit, however, much sooner than 7-10 years from their bankruptcy case filing date by timely paying debts that are reported to the major credit bureaus. There is no limit on the amount of debt you may have if you are filing Chapter 7. However, Chapter 13 does have limits for both secured and unsecured debts. The important thing to remember is that not because you want to file Chapter 7 necessarily means that you can do so. Not everyone is eligible. If the court thinks that your income is sufficient to fund a Chapter 13 repayment plan, then your Chapter 7 petition will be denied. Under current law, you can only file a Chapter 7 once every 8 years so if you’ve had a recent bankruptcy and you find

Duterte has urged the United Nations not to dip its fingers in the investigation of deaths allegedly committed by policemen aside from telling Senator De Lima to stop making stories about him. President Duterte said “United Nations (UN) does not have any business investigating human rights violations of the police. Duterte’s allegations against the supposed ties of De Lima with wealthy and influential drug lords came out in the open days before the neophyte senator is scheduled to conduct a senate investigation on extrajudicial killings as well as the police method of shooting suspected drug pushers and addicts. Duterte dismissed De Lima’s forthcoming senate investigation against extrajudicial killings as mere posturing and politicking It is well known in public that Duterte has a long standing feud with De Lima, particularly during his term as chief executive of Davao city. De Lima has accused Duterte of ordering the execution of criminals in Davao city and the head of the Davao death squad. I will not be surprised if one of these days a prominent drug lord will finger Senator De Lima as one of former government officials who coddled drug lords and benefitted from the huge sales of illegal drugs during the

In a speech he delivered at the 115th anniversary of the Philippine National Police (PNP) in Camp Crame, Duterte made a blunt evisceration of the performance of De Lima as former Justice Secretary. Duterte even went as far as branding De Lima as being immoral for having a “very sordid personal and official life.” Senator De Lima is also being accused by Duterte of committing adultery with her driver/lover. Duterte is also claiming that funds derived from the sale of illegal drugs bankrolled the successful 2016 senatorial bid of the neophyte senator. De Lima was the Justice secretary during the term of President Benigno Aquino. He said De Lima’s driver/lover also acted as her “bagman” in soliciting campaign funds from wealthy drug lords, particularly those incarcerated at the National Bilibid Prison (NBP) in Muntinglupa city. Duterte said De Lima also funded the construction of the house of her driver lover. PNP Chief Rolando De La Rosa said he will conduct a thorough investigation on the alleged lover of De Lima, who wants to be known as the “conscience of the country.” For her part, De Lima, who used to be the “Iron Lady” during the term of President Aquino as Secrertary of Justice, was reportedly teary-eyed in telling the media that Duterte’s accusation against her alleged ties with drug lords was baseless and a clear case of character assassination. She gave assurance to the media that she will not back off and will pursue aggressively who were responsible for the executions of so many drug pushers and addicts since Duterte assumed the presidency. Duterte, on the other hand, continues to take potshots at politicians, particularly De Lima, who are protesting about the increasing deaths of drug lords, peddlers and addicts in the government’s campaign against drugs. The feisty Duterte told police officers not to be intimidated by the threats aired by DE Lima or by the statements of the United Nations (UN) statements on human rights. He urged police officers to remain vigilant and to redouble their efforts in the fight against all forms of criminality and take a more aggressive stance against drug peddler.

Palace welcomes Joma Sison’s statements to Duterte MANILA, Aug. 17 (PNA) – Malacañang on Wednesday welcomed the remarks of Communist Party of the Philippines (CPP) founder Jose Ma. Sison thanking President Rodrigo Duterte for assuring the release of jailed National Democratic Front (NDF) consultants ahead of the formal resumption of formal peace negotiations. Communication Secretary Martin Andanar said that Sison’s remarks just showed that the idea of having a peaceful resolution between the Philippine government and the CPP-NPA has become larger than the personalities involved in making this peace deal happening. “The conflict between the government and the CPP has been going on for 40 years. The positive statements coming from Joma Sison is a welcome development because it means that there is a greater chance for the two sides to agree in Oslo, Norway,” Andanar said during the Kapihan sa Manila Bay forum held at the Café Adriatico in Malate. To be sexy, bubbly and sophisticated, all at once on stage,requires more than talent. In other words, not an easy feat – except if one is endowed with a face (which is a toss between a teenager and a full-blown woman) and a charisma such that of Anna Maria Perez de Tagle. Escorted to the stage by no other than Maestro Robert “Bob” Shroder, the principal conductor of the Filipino-American Symphony Orchestra (FASO), Anna Maria was stunning in a purple figure-hugging mermaid-type gown. Accompanied by the 60-piece FASO ensemble, Anna Maria went on to sing two Broadway songs “On my own” (Les Miserables) and “I enjoy Being a Girl” (Flower Drum Song), both ofwhich enthralled the crowd. But she left the stage to give way to her Lola Sylvia La Torre who sung two Kundiman songs (Diyos Lamang ang Nakakaalam and Nasaan Ka Irog) in an operatic style of singing that she has been known for. Anna Mariakept the energy going when she returned to do her own an operatic style rendition of an archaic treasure titled “Bituing Marikit.” A duet between Sylvia and Anna Maria to the bouncy melody of “Sa Kabukiran,” another Filipino music heirloom,unhinged all the happy emotionsthat have been building up. The duo got the loudest standing ovation of the night. As expected, Sylvia provided the humor to a night of sophisticated music, adroitly inserting the wits during

breaks between songs – with Anna Maria showing off her own prowess on humor in a brief exchanges of gags with her Lola before they sung together. Sylvia rose to prominence as of the mainstays of the popular 1960s comedy TV sit-com titled “Tang-tarang-tang.” FASO’s summer family concert last Saturday at the John Wayne Performing Center in Glendale was anchored on a 1936 musical for children titled “Peter and the Wolf” which written by Russian composer Sergei Prokopiev. Joan Almedilla brilliantly narrated the text while the symphony orchestra played along, providing musical representations to sounds of animals, movements and emotions. FASO’s executions of the compositions were brilliant. In fact, if it was any indication of the musical’s potency: siblings Ezekiel and Elliana Nicdao; aged 6 and 5; respectively – who tagged along with their newshen and Moonlighter Lola Mylah de Leon – were both kept at bay, still on their seats and obviously spellbound. THE public reception area of the Philippine Consulate in Los Angeles was filled to the brim on Wednesday night (August 17) as Filipino-American community leaders and members of the media welcomed incoming Consul General Adelio Angelito S. Cruz. Cruz, who is embarking on a four-year term, will be serving areas in the US with the biggest concentrations of Filipino- Americans. He replaced Leo Herrera-Lim. In a simple, “standing room” only reception, Cruz assured Filipino-American community leaders that the Philippine Consulate General will keep on working to provide quality services to its constituency. The Consul General also called on the Filipino-American communities to help the administration of President Rodrigo Duterte achieve the goals that it has set forth. He mentioned the success of the administration’s anti-illegal drug campaign, citing the estimated 500,000 drug users who supposedly surrendered in only three months since Duterte assumed office. But Cruz said the government has to do more to keep the country marching into progress. “The President (Duterte) cannot do it alone. Each of us, needs to do our part. In other words, we have to walk the talk,” Cruz told the crowd. The event started promptly at 6 p.m. and because the building air-conditioning system has been turned off at the close of the office hours, the temperature at the reception area rose up and caused many of the guests, some of them even wearing suits, to perspire and comment

about the room temperature. Later on, during a brief huddle with the media, Cruz said the friendship between the United States and Philippines will remain strong despite what he called “challenges” that have transpired between the two countries -- - one of them happened just recently. “Honestly, I don’t think it will have a negative impact on our bilateral relations (with the US),” Cruz added. The Philippine consul general was pressed to comment on the spat between President Duterte and former US Ambassador Philip Goldberg which caused the US State Department to summon Philippine charge d’affaires Patrick Chuasoto last week. Elizabeth Trudeau, director of the State Department press office, said Chuasoto was called to explain Duterte’s “inappropriate comments.” Duterte has openly called Goldberg “gay” and “a son of a bitch.” The Philippine president got mad at Goldberg when the diplomat, together with other members of the diplomatic community, called him out for making a joke about the rape and murder of an Australian missionary during a 1989 Davao City prison riot. Among those who called out Duterte was Australian Ambassador Amanda Gorely who posted on Twitter that rape and murder should never be trivialized. ‘It Could Go Global’: Yellow fever outbreak spreads across Africa MOSCOW, Aug. 17 (PNA/Sputnik) – A yellow fever outbreak has killed some 400 people in Angola and the Democratic Republic of The Congo, and has spread to other parts of Africa, exacerbating the continent’s largest outbreak in years. The mosquito responsible for transmitting yellow fever is the same that carries the Zika virus. Symptoms can be relatively mild, a general fever or jaundice, which is where the term “yellow� comes from, but can also be as extreme as severe liver disease, with bleeding. There is a preventative vaccine for yellow fever, but there is no treatment once the disease has been contracted. Some health groups worry that a vaccine shortage will mean an insufficient number of doses to adequately address the outbreak. Heather Kerr, country director of the Democratic Republic of Congo (DRC) for the charity Save the Children, said in a statement, “We’ve got to urgently reach as many children and families as we can with the supplies that are left, and this is the only way we are able to do that right now,� adding, “There is no known

cure for yellow fever and it could go global.� The World Health Organization (WHO) launched a vaccination campaign Tuesday to vaccinate more than 14 million people in areas of need. WHO supplies are limited, and it takes some six months to manufacture additional vaccines. The organization plans to compensate for this deficit by using a fifth of a dose per person, which would help stretch the vaccine supply, but would also only be effective for a period of about one year. Emily Baumgaertner, writing for the Scientific American, reporting from the DRC, noted that regional hospitals were not testing patients to see whether they had yellow fever. Baumgaertner stated that it had been over a month since a yellow fever diagnostic test had been conducted. The WHO is racing against the clock as the approaching October rainy season will bring more mosquitoes to breed and infect more people. Some 10 million people are at risk for yellow fever in the DRC capital city of Kinshasa.

No dengue outbreak yet though number of cases up 15.8% By Leilani S. Junio

MANILA, Aug. 16 (PNA) – The Department of Health (DOH) said Tuesday it recorded 84,085 dengue cases from Jan. 1 to Aug. 6, 2016, 15.8 percent more than the 72,627 during the same period last year. DOH Spokesperson Dr. Eric Tayag in a press briefing held at media relations unit in Tayuman, Sta. Cruz, Manila, expected the figure to increase further as the country experiences rainy conditions. Tayag said that from just 43 dengue declared hotzones (yellow alert) barangays, the number is now almost double—80 in total. Dengue alert zone is being declared if a barangay in a municipality/provinces recorded occurrences of dengue cases in four consecutive weeks. He said that when a barangay was place under dengue hotzone, government hospitals there were also automatically alerted to implement re-activation of dengue express lanes to immediately respond to needed treatment and monitoring of the patient suspected of dengue cases. He clarified that there was no outbreak yet so far. With the expectation of upward movement of dengue cases, the Spokesperson called on Local Government Units (LGUs) leaders to take part in curbing the cases in line with their expectation that people could still do something to beat it. “We still have the chance to do our part to prevent an increase of the cases,â€? he said. He reminded anew of the DOH’s “4S Campaignâ€? — Searching and destroying breeding sites of mosquitoes, use of Self-Protective Measures, Seeking Early Consultation and Saying No to indiscriminate fogging. “Let us search together the portions where clear stagnant water are being stored‌we have to cover them

so that mosquitoes will not be able to lay their egg there,� he said. He also said wearing of dengue uniform in the schools were also one of the ways to get protected against dengue. For this year, a total of 372 deaths due to dengue were recorded. Meanwhile, the Spokesperson noted that the number of dengue cases recorded this year was much lower than the number of cases recorded in the last three years. Tayag attributed the “reduction� to possibility that the serotype of dengue that inflicted a person last year which still circulated in the next year/s that followed cannot anymore be inflicted with that same serotype due to immunity. On the other hand, in places where there were serotypes of dengue recorded, that can mean that a change in the sero type of dengue circulating therein is happening (other strain). There are four serotypes or strains of dengue that can inflict a person in a lifetime. When a person gets inflicted with serotype one he/she will not be inflicted with that same serotype anymore. Another reason is that some LGUs probably had been actively participating in the call of DOH to fight versus dengue. Among the provinces that are listed in the dengue hotzones are Pangasinan, Pampanga, Zambales, Batangas, Laguna, Rizal, Oriental Mindoro, Antique, Negros Occidental, Cebu, Negros Oriental, Southern Leyte, Bukidnon, Lanao del Norte, Misamis Oriental, Davao del Norte, Davao del Sur, Davao Oriental, Apayao, Benguet and Metro Manila. He clarified however that when provinces were mentioned, it does not necessarily follows that all the municipalities and barangays therein were automatically included in the list.

You may save money for a long, long time. And, do not unnecessarily, carelessly terminate your enrollment on an employer-sponsored, or a union-sponsored plan. You may not be able to reacquire such plan if you wish to in the future. Under Medicare Part B, you will have $166 deductible, after which you will pay 20% coinsurance. To illustrate: if your total Part B bills is $10,000 (doctor’s fees = $6,500; CT scan = $2,800; pneumonia shot=$700), you will pay out of pocket $1,966.80 ($10,000$166=$9,834x.20). If you have a MediGap plan, your plan will pay some or all of your share of cost, depending on which plan you are enrolled in. If you are enrolled on a Medicare Advantage plan, your plan may

have a different plan term for you altogether; and, depending on the private carrier you are enrolled in. If you are just turning 65, you may enroll on Part B 3 months before, during, or 3 months after your birth month – a 7-month window. If you enroll outside of this period, unless you have a “creditable� coverage, you will pay a penalty. And, if you decide to enroll later, you will be allowed to enroll only during the period January 1 to March 31 with an effective date of July 1. Do not put yourself at risk, without Part B coverage, by becoming aware of your Medicare options.
