Russia willing to help PN combat terrorism, piracy MANILA, Jan. 3 (PNA) – Russian Pacific Fleet flotilla deputy commander Rear Admiral Eduard Mikhailov expressed willingness to help the Philippine Navy (PN) in combating terrorism and piracy. MANILA, Jan. 4 (PNA) – With Miss Universe hopefuls expected to arrive in the Philippines starting this week, the Department of Tourism (DOT) on Wednesday said preparations are all set for the pageant’s ancillary events leading up to the anticipated coronation night on Jan 30, 2017. “Everything is in place,” DOT Secretary Wanda Teo said in a press conference after holding an inter-agency meeting with concerned agencies particularly the Department
of Transportation (DOTr) and Philippine National Police (PNP). Teo said that Miss Universe bets will start arriving between January 7 to 13 since the first ancillary event will be held in Boracay on January 14. Marine Colonel implicated in PHP380M drug-bust Philippine Eagle rescued in Sarangani MANILA, Jan. 3 (PNA) – Lt. Col. Ferdinand Marcelino, the Marine officer earlier implicated in a PHP380 million drug-bust in Sta. Cruz, Manila last year, has voluntarily surrendered to the Office of the Provost Marshal of the Armed Forces of the Philippines on Tuesday noon. This was disclosed by AFP public affairs office chief Col. Edgard Arevalo. He said Marcelino, accompanied by his sister, voluntarily surrendered to the military. “We are currently processing all the necessary requirements like fingerprinting, mugshots at physical examination, and then we are filing a petition for custody at the courts so that the AFP will have custody on him,” Arevalo said in Filipino.
This means that the military will have Marcelino in its safekeeping while the custody process in ongoing, he added. “He (Marcelino) is going to be detained at the AFP Custodial Center, he will be detained definetely because he has a standing warrant of arrest, that’s why he voluntarily surrendered,” Arevalo stressed. The Manila Regional Trial Court Branch 49 issued an arrest warrant against Marcelino and Chinese co-accused Yan Yi Shou last Dec. 22 after turning down their motion to dismiss the drug charges against them. MAITUM, Sarangani (January 4, 2017) – A Philippine Eagle (Pithecophaga jefferyi), the country’s national bird, has been found alive in the forest of Barangay Batian prompting the local government unit (LGU) of Maitum to mount a rescue operation to protect the bird and its habitat. LGU staff and personnel of the Davao City-based Philippine Eagle Center (PEC) brought the raptor to the PEC Tuesdaynight (January
3).
“I am thankful with the rescue of the juvenile Philippine Eagle. If your business is in distress â&#x20AC;&#x201C; you owe a lot of money but you canâ&#x20AC;&#x2122;t pay, your creditors will probably threaten legal action against your business and very likely, you personally as well. How much they can collect, and how they can go about collecting it, will depend on how your business is organized, and whether you personally guaranteed repayment of the obligation. To what extent you are personally liable depends on several factors, the most important being, how your business is structured and whether you personally guaranteed or secured the debt. Sole Proprietors and Partnerships If you are a sole proprietor, you and your business are one and the same in the eyes of the law, which means you are personally responsible for all of the businessâ&#x20AC;&#x2122;s debts. If there isnâ&#x20AC;&#x2122;t enough money in the business to pay these debts, creditors can take your personal assets to pay them. Partners in a general partnership have similar personal liability for business debts: Each partner is personally liable for the entirety of the businessâ&#x20AC;&#x2122;s debts (and any partner can usually bind the entire partnership to a business deal -- a scary combination). This means that if there isnâ&#x20AC;&#x2122;t enough money in the business to pay the debts, and your partners are broke, creditors can take your personal assets to pay all of the businessâ&#x20AC;&#x2122;s debts, not just your share. Corporations and Limited Liability Companies If your business is organized as a corporation or a limited liability company (LLC), your personal assets are usually protected from business creditors as a matter of law. Shareholders and LLC members have a form of asset protection called limited personal liability. Creditors cannot take ownersâ&#x20AC;&#x2122; personal assets to pay business debts, unless a business owner specifically gives up that limited liability protection. Unfortunately, most small business owners are forced to give up their right to limited personal liability, at least for some of their business debt. Many creditors require personal guarantees and/ or personal security from small business owners before they will loan money or extend credit to a business. And many landlords require a personal guarantee before they will lease commercial property to a small business. A personal guarantee is a promise by a business owner to hand over the ownerâ&#x20AC;&#x2122;s personal assets to a creditor if the business canâ&#x20AC;&#x2122;t pay its debt and its assets are not worth enough to cover the debt. A creditor can also ask a business owner to secure a business debt by pledging specific personal property, such as an ownerâ&#x20AC;&#x2122;s house, boat, or car. When you sign a personal guarantee or pledge personal property, you give up your protection against personal liability, and creditors can come after your personal assets if your business canâ&#x20AC;&#x2122;t pay. The Bankruptcy Option If your business bank account is empty, a bankruptcy might be a viable option. It would certainly give you some breathing room while working things out, and in the case of personal liability, a bankruptcy will protect your house, your car, and other assets. Business vs. Personal Bankruptcy If you are a sole proprietor, you can file for either Chapter 13 or Chapter 7 bankruptcy. Either type of bankruptcy can be used for personal debts or business debts. If you are a corporate shareholder, LLC owner, or partner in a partnership and you have signed personal guarantees or pledged collateral for business loans, putting your business through bankruptcy will not protect your personal property. If you have placed your personal property at risk, you must file for bankruptcy for yourself and your business separately to protect your personal assets. In this article, we assume you are considering personal bankruptcy -- because only personal bankruptcy will protect your personal assets. Chapter 7 vs. Chapter 13 Bank-
ruptcy If you file for personal bankruptcy, most likely it will be a Chapter 7 or Chapter 13 bankruptcy. In a Chapter 7 bankruptcy, your assets (except for property that is exempt which for the most part, usually includes your home, car etc.) go into a bankruptcy estate to be sold, and the proceeds are distributed to your creditors. At the end of the process, all of your debts that are eligible for discharge in bankruptcy will be wiped out. In a Chapter 13 bankruptcy, you propose a repayment plan where you repay part or all of the debt over three to five years. How Bankruptcy Helps When you file for bankruptcy, something called an automatic stay immediately stops your creditors from foreclosing on your house or any other personal property that is at risk. In some situations, this can be reason enough to file for bankruptcy, because it will buy you time, if nothing else. Unpaid Rent. If your business owes your landlord back rent, you are probably personally liable for the debt. (Sole proprietors and partners are automatically personally liable for rent payments, and most small business corporations and LLCs also get stuck personally guaranteeing the lease payments -- check your lease. If you didnâ&#x20AC;&#x2122;t, give yourself a pat on the back for being a savvy negotiator.) Filing for bankruptcy might keep the landlord from taking your personal property to pay the debt, especially if you file under Chapter 13 and come up with a payment plan. Ordinary, Unsecured Debt If your business owes suppliers, you will be personally on the hook if you operated your business as a sole proprietorship or partnership. Under the Uniform Commercial Code, suppliers of goods usually have the right to take the goods back. Barring that, however, they can come after you personally for the unpaid amounts. If you have a lot of this kind of debt, filing Chapter 13 could help you organize a payment plan (and Chapter 7 might wipe the debt out). If your business is a corporation or an LLC, you may be off the hook for these debts. This kind of debt is typically unsecured and is rarely personally guaranteed. If your business has no money and no assets left, the suppliers may be out of luck -your personal liability protection should protect your personal assets. So if your corporation or LLC has only unsecured, un-guaranteed business debt, thereâ&#x20AC;&#x2122;s no need to file a personal bankruptcy. Does Bankruptcy Make Sense for You? In the real world, just the threat of bankruptcy may be enough to help you work things out. Many creditors will think twice before leaning on you too hard if they think youâ&#x20AC;&#x2122;ll file for bankruptcy. Some creditors would rather work out a payment plan, or settle for partial repayment, than become a creditor in your bankruptcy case. From a creditorâ&#x20AC;&#x2122;s perspective, bankruptcy is an expensive and long process that eats into profits. You can use that to your advantage in negotiations and perhaps spread payments out far enough to be manageable. If you think you are in imminent danger of losing your familyâ&#x20AC;&#x2122;s home or livelihood, and you need help quickly, personal bankruptcy might be a good option for you. DOST-NRCP calls for research proposals for 2017 funding MANILA, Jan. 4 (PNA) â&#x20AC;&#x201C; The Department of Science and Technology - National Research Council of the Philippines (DOST-NRCP) is calling for research proposals from its members in the fields of Mathematics, Chemistry, Physics, Earth Sciences and Engineering. The duration of the project is for one year and the proponent promises as one of its output an ISI or Scopus Indexed publication based on the results of the research. Funding can range from Php300,000 to Php2.5 million. Topics must fall under the National Integrated Basic Research Agenda of the NRCP. Interested parties may submit proposals to the NRCP office (one electronic copy and one hard copy) and they can send an email to nrcpin-

MANILA, Jan. 3 (PNA) â&#x20AC;&#x201C; A senator on Tuesday sought for the creation of an agency which will develop space science in the Philippines to make the country more â&#x20AC;&#x153;space-capableâ&#x20AC;? within the next 10 years. In filing Senate Bill No. 1259 or the Philippine Space Act, Sen. Loren Legarda wants the creation of a Philippine Space Agency (PSA) and a National Space Development and Utilization Policy (NSDUP). Legarda said that the agency will be an attached agency of the Office of the President for purposes of policy and program coordination to ensure alignment in national policies and priorities. The agency will focus on space applications that can preserve and enhance the countryâ&#x20AC;&#x2122;s national security and promote development that is beneficial to all Filipinos. It is also meant to conduct research and development endeavors in vital areas of space science, technology and allied fields. Moreover, it will also help develop and utilize space science and technology applications to enhance its hazard management and disaster mitigation strategy as well as ensure the nationâ&#x20AC;&#x2122;s resiliency to climate change. MANILA, Jan. 4 (PNA) â&#x20AC;&#x201C; Just like last year, signal jammers will be installed along the route of the procession and the vicinities of Quirino Grandstand in Luneta and the Minor Basilica of the Black Nazarene located in Quezon Boulevard, Manila during the celebration of the annual feast on January 9. 4 Filipino women recruited as surrogate moms nabbed at NAIA MANILA, Jan. 3 (PNA) – Bureau of Immigration (BI) agents intercepted four Filipino women bound for Cambodia to become surrogate mothers for foreign clients in exchange for a fee close to PHP500,000 at the Ninoy Aquino International Airport (NAIA) Terminal 1 on New Year’s Day. Immigration Commissioner Jaime Morente said the four victims and their female recruiter were barred by the bureau’s travel control and enforcement unit personnel from boarding a Thai Airways flight at the NAIA 1 terminal last Sunday.
During interrogation, the women admitted that after arriving in Bangkok, Thailand, they would proceed to Phnom Penh where they will be fetched by a Cambodian who arranged the deal with the foreigners who were supposed to be fathers of the babies they would bear. “This is a new modus operandi of a human trafficking syndicate that preys on our Filipino women who are enticed to bear children of strangers for a fee because of their poverty. We cannot allow this to happen,” said Morente in a statement.
Foreigners given until March 3 to report for alien registration
MANILA, Jan. 4 (PNA) – The Bureau of Immigration (BI) has reminded registered aliens in the country to report in person at its offices nationwide, as provided for under Republic Act 562 or the Alien Registration Act. In a statement Wednesday, BI Commissioner Jaime Morente said registered foreigner nationals have until March 3 to report and pay the annual fee, to its head office in Intramuros, Manila or any of the bureau’s field offices. “The annual report of registered aliens is required by RA 562 and they have to do this within the first 60 days of every year,” he said, noting that the annual report period has no extension.
With this, the BI chief warned that “failure to comply shall result in imposition of administrative fine and/or imprisonment at the option on the commissioner.” Upon personally reporting to the bureau offices, registered foreign nationals have to pay an annual report fee of PHP300.00 and legal research fee of PHP10.00. They shall also present their original and valid alien certificate of registration identity card (ACR I-Card) and a confirmation number issued to them via the bureau’s annual report 2016 online system. For foreigners who are less than 14 years of age, Morente added that it is the duty of their parent or legal guardian to report on their behalf.
Caregivers are often overworked and underpaid. Thankfully, California has enacted strong laws to protect caregivers and make it easier for them to recover unpaid overtime. Still, many caregivers choose not to pursue valid claims. Here are some of the most common concerns we hear from caregivers and the reasons why these concerns should not prevent caregivers from seeking the overtime compensation that is legally due. 1. I Feel Obligated to My Patient By nature, caregivers are typically caring people. Many private employers take advantage of a caregiver’s compassionate nature and do not pay a fair wage. Many caregivers feel a sense of loyalty or obligation towards their employers that make them reluctant to pursue valid claims. While these are noble sentiments, it does not change the fact that caregivers who are paid less than the legally required wages are victims of wage theft. In fact, many people who hire in-home caregivers are financially able to pay for caregiving services as required by law, but simply choose not to because they want to save money. We often see the children of elderly patients making efforts to preserve their own inheritance by taking advantage of caregivers. 2. I Fear The Legal Process Many private employers refuse to pay caregivers overtime because they believe caregivers are unsophisticated and will not be able to file a legal claim. The legal process can be intimidating and confusing. But that is why the lawyers at Chaleff Rehwald are here to help. We know the law and stand ready to help. 3. I Signed a Document Stating I am an Independent Contractor. It is unlikely that an in-home caregiver is an independent contractor even if there is a signed a document saying so. Still, it is common for private employers to try to convince caregivers they are independent contractors because it is much less costly and much more advantageous for them. The reality is that many private employers misclassify caregivers as independent contractors to avoid paying overtime. 4. I Did Not Pay Taxes on The Wages I Did Receive. While we recommend that our clients pay all taxes owed for the wages received, if a caregiver has not paid taxes on wages, the caregiver still has the legal right to seek the overtime
wages due. It is the employer’s obligation to properly classify the employee and withhold state and federal income taxes. If this has not happened, the employer has also violated the law. 5. I Do Not Have A Social Security Number. You do not need a social security number to recover overtime wages from your employer. If you succeed in your unpaid overtime claim, Chaleff Rehwald can help you get an ITIN that can be used to pay the taxes owed. 6. I Am Concerned About Immigration Status. California law permits undocumented workers to recover unpaid overtime. In our experience, our undocumented clients have not suffered any serious adverse effect from presenting an overtime claim. While we cannot guarantee no problem will arise, we believe the benefit in recovering unpaid overtime outweighs the risk. Also, we have a relationship with an Immigration attorney that can review and possibly assist with the specific immigration situation. 7. I Do Not Want A Long Court Battle, and May Leave the Country. Most cases settle without going to court, and many cases settle within a matter of a few months to a year. Because the laws are so strong in favor of the caregiver, most employers seek an early settlement of claims. Department of Motor Vehicles (DMV)/CHP have new driving laws for 2017 This author recently visited the Department of Motor Vehicles (DMV) for a driver’s license renewal and leaned that there are new driving-related and traffic safety laws for 2017. One of the new laws that most of us who are currently using our wireless electronic devices is AB1785, which changes the way we use these devices to become hands-free while driving in California. These electronic devices, particularly smartphones should now be mounted in their vehicles while in use. This means that people can no longer drive with their phone in their hands while driving. According to the DMV, “this bill targets the deadliest cause of distracted driving-related crashes, through the use of an electronic device while driving.” The author of AB1785, Assemblymember Bill Quirk added that “the accidents, injuries and deaths associated with this form of distracted driving are completely preventable; thus the ultimate goal is to save lives.” Another law that has received the most publicity this New Year is the major change in the way “chil-
dren must be strapped into their car seats. Until December 31, 2016, parents could let their children sit forward-facing in their safety seats at the age of 1. However, at the start of the New Year, AB 53’s new law explains that “parents are now required to strap their children rear-facing in an appropriate passenger safety seat. Children weighing 40 or more pounds, or standing 40 or more inches tall. are exempted. This new California law continues to require that all children under the age of eight, be properly restrained in an appropriate child safety set in the back seat of a vehicle.” This is a part of the continued mission of saving lives,” according to the California Highway Patrol (CHP). MANILA, Jan. 4 (PNA) – The Department of Agriculture (DA) has committed an initial Php335.05 million assistance for farmers affected by typhoon ‘Nina’. In a report, the DA said farmers in Bicol region will receive Php217.55 million of the total amount. Repair of six irrigation facilities and 135 flatbed dryers will also be provided worth Php80.5 million. In order to facilitate clearing and de-silting operations as well as land preparation and other farm activities, the DA will extend farm machineries costing Php50 million. It will also provide certified and hybrid palay seeds, hybrid corn, urea fertilizer, assorted vegetable seeds, planting materials, restocking of animals, vaccination of animals and livestock, animal care, feed assistance, carabao and farm tools worth over Php87 million.
The DA also committed Php17.3 million support for typhoon-affected farmers in Mimaropa. It is ready to provide palay, white corn and assorted vegetable seeds, lanzones and calamansi planting materials, and banana tissue culture costing Php10.45 million to farmers in Oriental Mindoro. For Occidental Mindoro, certified palay seeds, OPV corn and hybrid corn seeds will be provided worth Php5.92 million. DA will likewise extend Php925,000 production support such as certified palay seeds and OPV and hybrid corn seeds to farmers in Marinduque province. It also committed Php2.2 million assistance for farmers in Mulanay, Quezon; Php28 million for fisherfolk in the province of Quezon; and Php70 million for affected farmers in CALABARZON (Cavite, Laguna, Batangas, Rizal and Quezon).

This law requires a bus company to ensure the driver of the charter bus provided oral and written, or video instructions to all passengers on safety equipment and emergency exits on the bus prior to any trip. Finally, AB 1677 is the new CHP law which develops protocols for entering into a memorandum of understanding with local governments to increase the number of inspections for tour buses operated within their jurisdiction. I was in the wrong place at the wrong time during ‘Nina’ onslaught – Robredo MANILA, Jan. 3 (PNA) – Vice President Leni Robredo on Tuesday admitted that she was in the wrong place at the wrong time when typhoon “Nina” (international name: NockTen) walloped Bicol Region, her bailiwick and several parts of the country on Christmas day. She said that she “felt really bad” while she was in the Unites States while Nina battered Visayas and Bicol Region. Robredo said her family decided to cut short their trip and decided to return to Manila, but they run out of luck when they found it hard to book return tickets on peak season. Armed men attack Cotabato jail; 158 inmates escape MANILA, Jan 4 (Mabuhay) – A total of 158 inmates escaped from the North Cotabato District Jail (NCDJ) after a two-hour firefight when more than a hundred armed men attacked the facility early Wednesday morning. The jail facility’s officials initially reported that 132 inmates escaped. In an interview, NCDJ officer-in-charge Superintendent Peter Bongat said that they learned of the actual number of inmates who escaped after conducting a headcount.
He said they had 21 jail personnel guarding a total of 1,511 inmates at the time of the attack. Bongat said at least three of the escaped inmates have been captured in the ongoing manhunt operations. One jail guard identified as Jail Officer 1 Excell Ray Vecido was killed while an inmate was injured in the incident. Bongat said in an earlier interview that armed men attacked the facility in Barangay Amas at past 1 a.m. He said that as they were busy

Alver Caasi who happened to visit Batian on Monday was informed by residents that they were selling the bird but he advised them not to. “I told them they will face the full force of the law if they do that,” Caasi said. Caasi said he saw the bird at 9 a.m. and fed it with live chicken. The eagle consumed half of it and the other half was eaten the next day. Edgar Calderon, park maintenance foreman of the Community Environment and Natural Resources Office, said the eagle could be one year old with a nest probably within a 5-km radius from where it was found. “From the initial video and pictures sent to us by Carol Arguillas, which was sent to her by Beth Ramos, the bird is confirmed a Philippine Eagle,” said Dennis Joseph Salvador, executive director at Philippine Eagle Center. OFW family reunites on Christmas time after 7 years By Abner Galino
(Part 1) Here’s a merry Christmas story. On a rundown sofa inside a two-bedroom apartment in Buena Park sits Lester, 41, his wife Rudilyn, 38, son Lance Daniel, 11, and daughter Leah Anne, 8. Beside them is an amply decorated five-foot Christmas tree. It is the first time, says Lester, that his family has made a Christmas tree and, more so – a Christmas tree fashioned out of a freshly cut pine tree. Surreal, specially for Lester who has not spent Christmas time with his family the last seven years – during which he was on his own, living the challenging life of a so-called “TNT” or an overstaying alien in the United States. In October 2009, Lester and eight other Filipinos, after paying huge sums of money to their recruiters, arrived in the US with big hopes that they would get good jobs and that their H2-B visas would be adjusted months later after they started working. They ended up cramped in a dilapidated house in a remote town in Alabama and were obliged to work in a fastfood restaurant where they earned a measly $450 a month. For a couple of months, under the punishing Alabama winter, Lester and his fellow workers, walked two miles every day to report for work. They layered themselves with whatever clothes they had because they didn’t have winter jackets yet. Well, that was just snippets of Lester’s story of survival in the US of A. We will tell you all about that later on.
Lester kept himself connected to his family through the Internet as he moved from Alabama to Illinois and eventually to California where his fortune slowly turned for the better. When Rudilyn was told about the possibility of Lester being able to get US visas for her and their children, she thought it was too good to be true. “Hindi nanga ako umaasa noon. Maski ‘yung mga kakilala namin ‘di naniniwala. Paano daw kami makukuha nga sa wari ko eh wala naman siyang papel?” recalls the wife, Rudilyn Rudilyn kept it low (to avoid getting into the rumor mill) when she and their kids went to the US embassy to process their visas. It was quick, she recalls. She and her kids were recipients of T visas as a positive consequence of a human trafficking case that Lester filed against his recruiters two years ago. “Wala naman po silang tinanong,” Rudilyn narrates. But the fast-paced progression almost hit a snag just as Rudilyn and her children were about to fly out from the Philippine airport. For whatever reason, an immigration officer supposedly held them at the line. “Kung anu-ano po ang hinahanap. Kinabahan talaga ako. Kasi kung hindi kami nakaalis. Pagtatawanan kami tiyak ng mga tao,” Rudilyn recalls. Fortunately, a call prompted the said immigration officer to leave his post. During the lull, an immigrant rights advocate from Migrante switched the Ramos family into another line. Rudilyn and her kids arrived at

the Los Angeles International Airport on November 14. Lester’s lawyer was able to get the Salvation Army to put the Ramos family in a transitional housing. The charity group also provided them with some pieces of furniture, beddings and kitchen utensils (including the Christmas tree and the decorations on it) – mostly hand-me-downs but still useful. But Lester is not bothered. “Ok lang. Hindi ko nga akalain na mangyayari ito. I am so happy,” says Lester, adding that he believes that they would be able to be solely on their own in a short time. “Hinihintay lang ni misis ‘yung work authorization niya para makapag-trabaho,” adds Lester. “May swimming pool po ba ang
mga school dito?” asks the eightyear-old Leah Anne when she has the chance to butt in. Her action draws laughs from her parents who consequently reveal that the girl has been quite “bored.” “Hindi pa kasi sanay. Sa atin kasi puwede siyang basta na lang lumabas at maglaro. Sabi ko kanya, dito hindi niya puwedeng gawin ‘yun. Sabi ko makukulong ako kapag ginawa niya ‘yun,” Lester narrates, giggling. Lester admits life is not going to be easy despite the reunification of his family. “Lahat naninibago pati ako. I used to be by myself here,” he adds. Bright lights around the Christmas tree, and just as a new year is onset, hope springs for one family.

Keep your hopes up in this uncertain time Question: I donâ&#x20AC;&#x2122;t know what to do. Trump will become President and Iâ&#x20AC;&#x2122;m afraid he will deport everyone who is not here legally? What can I do? Answer: First of all, while the President certainly has a lot of power, he cannot simply order that 11 million people be deported. In fact, there are many laws and procedures which have been passed by Congress and signed by prior Presidents as to the rights of foreign nationals here in the U.S. Question: What is they just take me out of my house? Answer: First of all, under most circumstances, you will have the right to fight your case in front of an Immigration Judge. This means you will have the opportunity to deny or admit the allegations against you; the right to a contested hearing on those allegations and the right to ask for all kinds of relief you might qualify for under the Law. The Im-
migration Judge may very well find you deportable, but ask what relief are you going to seek. Question: Assuming the Immigration does ask this type of question, what can I answer? Answer: Each case is different and that is the reason to make sure you have a qualified Immigration and Naturalization Attorney helping you. However, some of the more popular forms of relief would be Adjustment of Status, Fraud Waiver, Criminal Waiver, Registry, Asylum, Withholding of Removal, Cancellation of Removal for Lawful Permanent Residents, Cancellation of Removal for Non-residents, Con-
vention against Torture and others. You can see that in fact there are numerous forms of relief and assuming qualification, the law permits you to fight for these and to obtain status EVEN if the Immigration Judge rules you are removable and EVEN if you are here illegally. Question: How long will it take? Answer: Removal proceedings will take longer in the more popular States such as California and New York. However, much will depend on the type of case and the facts of each case. However, typically, a case in Immigration Court will take up to 2-3 years. Question: What if I lose? Answer: You will then have the opportunity to appeal the case to the BIA (Board of Immigration Appeals) which will normally take 1-2 years. Question: What if I lose there? Answer: You will then have the opportunity to appeal the case to the Circuit Court of Appeal. I can contin-
ue letting you know, but suffice it to say, that you cannot just be thrown out of the country as Trump and/ or his people might have you think. This brief Q&A should at least notify you that there are plenty of ways to fight and unless all the laws themselves are simply changed, you will have plenty of opportunity to fight your case. Atty. MANILA, Jan. 4 (PNA) -- The start of the Duterte administration boded well for the education sector. From the start of her term as education secretary, Leonor Briones recognized the challenge of delivering quality services in education with a budget that is â&#x20AC;&#x153;inadequate in terms of international standardsâ&#x20AC;?. In her message when she accepted the post from Bro. Armin Luistro, Secretary Briones said the Department of Educationâ&#x20AC;&#x2122;s (DepEd) 2016 budget allocation for education was small at PHP400 billion compared to international standards, which require that six percent of the GDP be spent on education. Apart from the budget, the new
education chief also saw the challenges of speeding up and cleaning up the procurement process, monitoring the progress of the newly launched Senior High School (SHS) program, expanding the Alternative Learning System (ALS), and ensuring that the department is â&#x20AC;&#x153;not infested with â&#x20AC;&#x2DC;anayâ&#x20AC;&#x2122; (termites) and weakened by rotâ&#x20AC;?. â&#x20AC;?Admittedly, we still lack school buildings, computers and tools, furniture and fixtures and additional teachers,â&#x20AC;? she said. DBM won’t recommend use of taxpayers’ money to fund SSS pension hike – Diokno MANILA, Jan. 3 (PNA) – Department of Budget and Management (DBM) Secretary Benjamin Diokno said on Tuesday that he won’t recommend the use of taxpayers’ money to fund the proposed PHP2,000 pension hike of the Social Security System (SSS) pensioners. “Historically, it is not being done. We don’t burden the taxpayers to support a private fund,” Diokno said in a press Palace press briefing. “It is unfair for us to call on everybody to increase pension of a few. Our tax system is such that even the
jobless, they pay taxes in the form of value added tax. Why should you burden them to give benefit to a private pension system,” he added. Diokno said the job of looking for the source of PHP2,000 monthly pension increase should not be given to President Rodrigo Duterte. “To me, it’s unfair to give the problem to him. In fact, it’s unfair for Congress to have passed that law which, as you know, (former) President (Benigno) Aquino vetoed,” Diokno said. “It should not have reached
the President’s desk. The Board of Trustees should have exercised leadership,” he added. The DBM official said the SSS Board of Trustees can find solution to fund the proposed pension hike such as increase the collection efficiency. “I understand some corporations have been indebted to SSS. Maybe they could call on them. But you know, when you pass the buck and give it to the President, that to me, is unfair for the President,” he explained. He said another solution could
be to adjust the contribution of the SSS members. “What we are proposing is a contribution adjustment, a higher pay but we are not recommending it right now,” Diokno said. “What we’re recommending is maybe to do it after tax reform because in the tax reform, you get more money in your pockets and therefore you are now in a position to contribute a small amount for the pension of those who are already receiving pension. So that’s our solution,” he added.

Signs that you will you need bankruptcy relief in 2017; Best wishes to all readers for the New Year! Mr. Trump has made filing for bankruptcy relief as a sign that heâ&#x20AC;&#x2122;s smart. Heâ&#x20AC;&#x2122;s smart he says because his companies filed for bankruptcy 4 times using applicable law. Bankruptcy allowed his businesses to get rid of debt, a lot of it, and bankruptcy allowed him to keep his ownership over these businesses, which emerged from bankruptcy leaner and more productive. So, since we are now in Trump Land, filing for bankruptcy to get debt relief is smart. American bankruptcy laws exist to help debtors become productive again, allowing debtors to keep exempt assets while getting rid of accumulated debt. Hence, if you think filing for bankruptcy when you need it, is dumb, you are wrong. Just ask Mr. Trump. He got away with not disclosing his tax returns and not paying income tax for the last 20 years. And still becoming president elect for our great country. The man is a genius. What are the signs that you will need to be smart next year by filing for bankruptcy? Letâ&#x20AC;&#x2122;s go over the common red flags that you have to watch out for: 1. Mortgage default or car default: If you are behind in your house or car payments, you have serious cash flow problems. This means that your income is not enough to pay for your most important asset that puts a roof over yourself and your family. Your first instinct might be to blame every one else and everything else. But seriously, you have to analyze your financial situation to determine what the cause is. You might be paying $1K just to service $30K of credit card debt at the expense of paying for your house or car. Chapter 7 or 13 will get rid of the $30K credit
card debt, or allow you to reorganize your financial affairs to get rid of your credit card debt with nominal payment while giving you time to cure the default on your house or car. 2. Borrowing from A to pay B: If you borrow from Peter to pay Paul, you are living the illusion that your finances are ok but in truth, you are not paying down your debt. If you borrow $50K from Peter to pay Paul $50K, you owe the same $50K, except you now owe it to Peter instead of Paul. Maybe the $50K loan from Paul matured today so you got a new loan of $50K from Peter, which matures in 12 months. Yes, you bought yourself 12 months but admit to yourself that you have serious debt problems you are not able to pay down the $50K from your own money. 3. Raiding your retirement account to pay debt: Never ever use retirement money to pay debt. Retirement money is for retirement. Is that clear enough? Thatâ&#x20AC;&#x2122;s why its called a retirement account. Letâ&#x20AC;&#x2122;s say your IRA or 401K is $70K. You want to pay off your credit card debt of $30K. Donâ&#x20AC;&#x2122;t make the mistake of using the retirement account to pay off the credit card of $30K. First of all, there is a penalty for withdrawing early. Second, you can wipe out the $30K credit card debt while keeping all of your $70K retirement account intact with a Chapter 7 or Chapter 13, so why sacrifice your financial
security when you retire? 4. You sacrifice necessities to pay debt: Letâ&#x20AC;&#x2122;s say you owe $40K of credit cards that require $1,200 of monthly minimum payments. Your net income is $3,000. You only have $1,800 for necessities. Necessities are food, shelter, transportation, insurance etc. If you feel the constant tug between necessities and credit card payments, you may need bankruptcy relief to get rid of the $40K credit cards. Itâ&#x20AC;&#x2122;s pretty hard to have your family eat less or not pay the rent. 5. Refinancing your house to pay down credit card debt: If you are really tempted to refinancing your house to cash out $50K to pay off $50K of credit card debt, think again. Adding $50K to your mortgage now means adding $200 to your mortgage. When you retire, $200 more for the mortgage is an amount that you cannot afford. When you retire, every dollar from social security and other sources is critical to survival. It can mean the ability to keep your house when you retire. You can actually keep your house and get rid of your $50K with Chapter 7 or 13 so why pursue refinance? Be smart, thatâ&#x20AC;&#x2122;s the name of the game now in Trump Land. 6. Your savings account doesnâ&#x20AC;&#x2122;t exist: All of my clients, without exception, answer this when I ask them do you have $5K in your savings account? They always answer: I wish I had $5K in it. I have practically nothing in my savings account. If you have extra money at the end of the month, your instinct will be to stash it away into a savings account. If you have no savings, this means all your
income is being used up to pay all your monthly expenses. If you owe $20K of credit cards, you need $600 a month. Instead of saving $600 a month, or $7,200 a year, you use the $7,200 to keep your $20K of credit cards current. Thatâ&#x20AC;&#x2122;s why you have no savings and thatâ&#x20AC;&#x2122;s why you need bankruptcy relief. 7. You have maxed out your credit cards: If you have maxed out your credit cards, you are in bad shape financially. Need I say more? You need bankruptcy Chapter 7 or 13 to get rid of your credit cards and start fresh without accumulated debt. Be productive again. Be smart! Best wishes to all readers for the New Year!! SSS says pension hike may be tied to tax reform MANILA, Jan 4 (Mabuhay) â&#x20AC;&#x201C; A P2,000 increase in pension for the Social Security Systemâ&#x20AC;&#x2122;s two million retirees might not be given until Congress approves a proposed income tax cut, the head of the pension fund said Wednesday. The SSS had planned to give the increase in two equal tranches, the first originally scheduled this month. President Rodrigo Duterte promised the adjustment during the campaign but his economic managers warned that it should not compromise the fundâ&#x20AC;&#x2122;s viability. Aside from increasing contribution rates by 1.5 percent and raising
the minimum salary used to compute contributions to P20,000 from P16,000, SSS Administrator Amado Valdez said he would also ask Congress to allow the fund to condone delinquent members to encourage them to pay. â&#x20AC;&#x153;Hopefully win-win ang manyayari diyan (there will be a win-win) with all these discussions,â&#x20AC;? Will incorporating a separate property business during marriage make it community property? You own a successful business, as a sole proprietor, prior to marriage. You later meet the love of your life and decide to marry her. Years into the marriage, you decide to incorporate the business. A common question when the couple later divorces becomes 1) did your separate property business become community property by virtue of incorporating it during the marriage? 2) Was your separate property business “transmuted” to community property by incorporating it during the marriage? No Community Property Presumption Family Code §760 defines Community property as Except as otherwise provided by statute, all property, real or personal, wherever situated, acquired by a married person during the marriage while domiciled in this state is community property. However under Marriage of Koester, the Court held that the community does not “acquire” a separate property business simply because the business is incorporated during the marriage. The mere incorporation of a business operated by spouse is not a change in its character, for purposes of division of community estate following divorce. In Koester, the Court stated that he incorporation simply effects a change in the legal form under which the business is conducted and property does not change its character merely because of a change in form or identity. Marriage of Koester (1999) 73 CA4th 1032, 1035, 1038, 87 CR2d 76, 79, 81. The Court in Koester also stated that “In contrast with the way title is taken when a married couple own residential property, the incorpora-
tion of a sole proprietorship business is typically done for reasons extrinsic to the marital relationship. To say ... that an asset was ‘acquired’ by the community ... because some aspect of corporate formation took place during the marriage is to elevate semantics over substance” No Transmutation Incorporation of a sole proprietorship business during the marriage can trigger a family code § 2640 tracing right of reimbursement only when it is also accompanied by an unambiguous express written transmutation of the business to community property as required by Family Code § 852. Marriage of Koester, supra, 73 CA4th at 1036–1037, 87 CR2d at 79–80 & fn. 5. Under Family Code §852, a transmutation of real or personal property is not valid unless made in writing by an express declaration that is made, joined in, consented to, or accepted by the spouse whose interest in the property is adversely affected. In Koester, the act of changing the legal form under which a business is conducted does not meet the requirements of family code § 852 for a valid transmutation. Marriage of Koester (1999) 73 CA4th 1032, 1037, 87 CR2d 76, 80 & fn. 5. Incorporation of a sole proprietorship business is typically done for reasons extrinsic to the marital relationship. Although the mere act of incorporating a separate business during the marriage does not change the
character of the business to community property, the community may still acquire an apportionment interest if the value of the business substantially appreciated during the marriage due to the labor and hard work of the managing spouse during the marriage. The apportionment calculation is done using the formula in the Pereira or Van Camp case where the contributions of effort and return on capital are separated from the value of the business. DOJ files urgent motion seeking hold order vs Marcelino, Chinese companion MANILA, Jan. 3 (PNA) – The Department of Justice (DoJ) on Tuesday filed an urgent motion before the Manila Regional Trial Court (RTC) which seeks the issuance of a hold departure order against of Marine Lt. Col. Ferdinand Marcelino and his Chinese cohort Yan Yi Shou over the drug case filed by the DOJ against them last September. “It is most respectfully prayed of his Honorable Court that the urgent motion for the issuance of hold departure order be granted and a HDO be issued against accused Lt. US on PHL-Russia bilateral defense relations: Foreign relations are not binary By Sammy F. Martin
MANILA, Jan. 4 (PNA) – The United States on Wednesday stressed that every country has the right to pursue bilateral relations of its own choosing. “I’ve said many times – and this is a good example of it – that foreign relations aren’t binary. Right? And these choices that countries have to make are not binary choices, and every nation-state has the right to pursue bilateral relations of its own choosing,” John Kirby, US State Department spokesperson when asked about their reaction on the planned joint military exercises by Russia and the Philippines. “And so again, I would leave it to both of their governments to discuss it. What it – what I can promise you is that it won’t affect how we view the importance of our bilateral relationship with the Philippines,” he added. This after the deputy commander of Russia’s Pacific fleet who is now in Manila announced plans to hold joint military exercises with thePhilippine Navy. The Russian Navy made a port call Tuesday. He said the Russian Navy is more than willing to show and demonstrate the use of its various combat systems to its Filipino counterparts once an agreement is inked, allowing the joint training of Philippine and Russian maritime forces. “Maybe in the future, we’ll have exercises with you maneuvering and use of combat systems,” Deputy Commander Rear Admiral Eduard Mikhailov, Russian Pacific Fleet Flotilla was quoted as saying during a press briefing. Mikhailov said Russia, the Philippines, China and Malaysia can participate in one big naval exercise in the South China Sea at a proper time. He added that this is possible as all the above-mentioned countries are concerned with the safety and security of the region. Mikhailov is the head of the Russian naval delegation which is on a six-day goodwill visit to the country which will end on Saturday. However, Kirby reminded that “the defense relationship between the United States and the Philippines remains very, very strong.” “We do have security commitments, alliance commitments that we take very, very seriously,” he pointed out. “And that defense cooperation has always been provided at the request of Philippine administrations, so our overall mil-to-mil relations remain robust, they remain multifaceted, and that’s the way we want to see it continue. I think the Russian Navy is open to have joint exercises with its Philippine counterparts,” he concluded.

Malacanang: Robredo capitalizing on disaster for political gain MANILA, Jan. 4 (PNA) – Malacañang on Wednesday said Vice President Leni Robredo’s statement that relief operations in typhoon “Nina” affected areas were “slow” is baseless. In a statement, Presidential Spokesperson Ernesto Abella berated Robredo over her “cynical political mindset” to take advantage of disaster. Abella said the Vice President should have instead appreciated the efforts done by the government and volunteers to mitigate the effects of the typhoon. “The remark Ms. Robredo made saying that the relief operations were ‘slow’ suggests a cynical political mindset willing to capitalize on disaster,” Abella said. “One wished she displayed more appreciation of the work of our disaster officials, our social workers, and other volunteers who were on Ground Zero even before ‘Nina’ made a landfall,” Abella said. The Palace official said that as of Wednesday, a total of PHP182,473,574 worth of relief assistance have been provided to affected families in Calabarzon, MIMAROPA, and regions V and VIII, including those who
were stranded in various ports in Regions V and VIII. “The DSWD provided assistance worth P166,976,473 while LGUs and non-government organizations (NGOs) provided a total of P4,225,832 and P11,271,270, respectively,” he said. “The Department of Energy (DOE) with support from local government units and private institutions, on one hand, has brought back electricity to priority areas in Bicol and Southern Tagalog regions before New Year,” he also said. Abella also said “full restoration of NGCP (National Grid Corporation of the Philippines) transmission services in typhoon Nina-affected areas is expected today.” “For transmission facilities in the on-grid area, the NGCP, after deploying 500 technical personnel, reported that as of December 31, the Naga-Daraga 230 kV line and the Naga-Pili-Iriga line have been restored servicing the provinces of Albay, Sorsogon and Camarines Sur,” he said. Full restoration of NGCP transmission services in typhoon-affected areas is expected Wednesday.
Palace appeals for calm after Cotabato jail attack MANILA, Jan. 4 (PNA) – Malacañang appealed on Wednesday for calm and sobriety after around 100 inmates escaped when more than 100 armed men attacked the North Cotabato District Jail in Barangay Amas, Kidapawan City. “We assure our people that manhunt operations on the escapees are now underway,” Presidential Spokesman Ernesto Abella said in a press statement. Abella said the Bureau of Jail Management and Penology (BJMP) units in Region 12 and nearby provinces are now on heightened alert. He said authorities have yet to identify the armed group that attacked the Cotabato jail that also resulted to the death of Jail Officer 1 Excell Ray Vicedo. “Some sources claim the group was headed by a certain Commander Derbi. However,
General Almanzor, chief of staff of the Bangsamoro Islamic Armed Forces of the Moro Islamic Liberation Front (MILF) has denied that they have any member bearing that name,” Abella said. Abella said the Armed Forces of the Philippines (AFP) and the Philippine National Police (PNP) are now working closely to capture the escapees. “Hence, we appeal for calm and sobriety,” he said. According to reports, the inmates took the opportunity to escape through the back portion of the facilities while the rest of the personnel were retaliating to hold their ground and to protect other inmates during a firefight that lasted for two hours. Six of the escapees were killed during the operations while two surrendered to the authorities.
BJMP: BIFF behind North Cotabato jail attack KIDAPAWAN CITY, Jan. 4 (PNA) – Military and police authorities here said outlawed Bangsamoro Islamic Freedom Fighters (BIFF) were the culprits in the daring attack on the North Cotabato provincial jail facility in the early hours of Wednesday. Supt. Peter John Bungat, provincial jail warden, said three of those “rescued” were members of the outlawed armed men involved in bombings in North Cotabato. Many of those who fled were also facing charges of illegal drug pushing. The three inmates of Cell No. 8, later known as Tamayan and Salic brothers, were the prime object of rescue, Bungat said. Abu Misry Mama, BIFF spokesperson, denied his group was involved but admitted some of those who fled belonged to the BIFF. Only 21 jail officers are guarding 1,511 inmates on shifting basis. It was not clear how many guards were on duty during the attack. Supt. Emmanuel Peralta, North Cotabato police director, said joint police and military operations are ongoing in the borders of Kidapawan City and the towns of Matalam and M’lang. One jail officer was killed and an inmate was wounded. Numbering about 100, the armed men first shot a power transformer that sent the
jail facility in darkness. It was followed by a series of gunfire, according to Felix Capalla, one of the inmates’ leaders. Among those who fled were followers of big time drug lords Renz Tukuran and Mox Masgal, former Moro Islamic Liberation Front (MILF) members engaged in illegal drugs in North Cotabato. “It was not a jailbreak. It was a planned rescue of high profile detainees,” he told reporters. The jail facility, also known as the Cotabato District Jail, is located at the back of the provincial capitol compound in Barangay Amas in Kidapawan City. Before the raid, Capalla told Bungat of what he heard among the inmates - a plot that they will be rescued on New Year’s Eve. This led to the deployment of Army and police forces as augmentation force on December 31. However, the reinforcement was recalled on January 1 when no attack happened on New Year’s Eve. A village official was killed by government forces when he was seen transporting two inmates in Matalam, North Cotabato. Mayor Joseph Evangelista of Kidapawan City has ordered the suspension of classes in public schools in Barangay Amas to ensure safety of children during manhunt operations.

A robust Philippine economy The recent strides achieved by the government against illegal drugs and corruption have contributed to the remarkable economic growth of the Philippines in the first six months of President Rodrigo Duterte. The Philippines Statistics Authority (PSA) data showed that the country’s gross domestic product for the last six months grew by 7.1 percent, making the Philippines one of Asia’s fastest growing economies. With a 7.1 percent GDP growth rate for the last three quarters of the year, Duterte’s economists are saying they are sure the country will achieve if not surpass the 6.5 to 7.5 target for next year. I hope this surprising economic surge the country is experiencing will continue for the whole six-year term of Duterte. We should congratulate the President and his economic advisers for implementing various programs geared towards ensuring a robust Philippines economy. Economists are predicting that the country will continue to grow because of the government’s success in addressing poverty, by allocating more funds to improve the lives of millions of underprivileged Filipinos in the rural areas. Government data also showed that investments in construction and public infrastructure were major factors in the economic growth as well as recovery in
the agriculture industry, which has been on the decline for the past five years. Hopefully the trust and confidence of businesses on Duterte will continue to remain high for the remainder of his term in office as well. So far, Duterte has been able to fulfill some of his promises to his supporters he made during his 2016 presidential campaign. His promise to launched an all out war against illegal drugs has been successful so far as well as his hope to have a corrupt-free government until the last days of his presidential term If Filipinos want their visions of change on how the government should be run, they have to close ranks with President Duterte achieve that goal. It is not only the sole responsibility of the President to create a better Philippines for everybody. It is also the responsibility of every Filipino to contribute by changing on how they live and think. The only negative thing that is very
evident under a Duterte presidency is the unabated killings of suspected drug addicts and peddlers all over the country. However, crimes against property went down to as much as 42 percent, while rape cases declined by 11.6 percent. President Duterte has sent a strong signal to his subordinates that he will not condone any form of corruption in his administration by terminating recently two deputy commissioners of the Bureau of Immigration for allegedly accepting a P30 million bribe from Jack Lam, a big time Chinese gambling operator. Duterte’s swift decision to fire BI deputy commissioners Al Argosino and Michael Robles and two others must have sent chills to his cabinet secretaries and other government officials thinking on how to make a “fast buck” without getting caught. Argosino and Robles were Duterte’s election lawyers during the last year’s presidential election. They were also Duterte’s fraternity brothers at San Beda College of Law’s Lex Tallonis Fraternitas Inc. President Duterte has promised to his supporters during the election campaign that none of his relatives, friends, fraternity brothers nor political allies involved in corruption will be spared from prosecution. This is exactly the opposite of what former President Noynoy Aquino did during his six-year term in office. President Aquino did not only condone his

friend and associates from ransacking the Philippine treasury but also protected them from being prosecuted. Noynoy’s sister, Balsy-Aquino Cruz and her husband Eldon Cruz, were at one time implicated in the $30-million alleged extortion attempt on a Czech company contracted to undertake a multi billion peso MRT expansion project in EDSA. “Balsy” and her husband Eldon and former DOTC Secretary Pete Prado, even flew to Prague on invitation of Czech businessmen involved in the MRT expansion project. Prado was the DOTC Secretary during the presidency of Cory Aquino, President Noynoy’s mother. Balsy and her husband, under mysterious reasons, were cleared of any involvement in the alleged extortion attempt. Instead, Al Vitangcol, the MRT general manager at that time, was made the “fall guy.” Vitangcol at present is facing criminal charges at the office of the Ombudsman. Recently, former DOTC Secretary Joseph Abaya has also been charged with graft in connection with the purchase of P3.8 billion worth of license plates during “Noynoy”’s administration. It was alleged that Abaya and other government officials connived to tap an unqualified private supplier to manufacture license plates for vehicles and motorcycles in the Philippines. I won’t be surprised if more will face corruption charges in the coming months.
How will higher federal fund rate benefit home buyers? The recent Federal Reserve’s hike in its benchmark of short-term interest rate – combined with rate increases the next few years – is likely to cause ripples across the U.S. economy, nudging up rates on everything from mortgage to bank savings rates and corporate bonds. But Fed policymakers have stressed that they intend to move gradually and in small increments, and will pull back if the economy falters, tempering the impact on consumers and businesses. Mortgage rates have gone up almost three quarters of a percent since after the November election, due to the positive perception of a better government, more jobs to be created, easing up on regulations and better taxation. With higher interest rates, banks will take in more profit, bank stocks are up high so as the overall DOW, S&P and NASDAQ. Good for investors, soon to be good for savers with bank money market rates set to go up. What is it doing to HOUSING? Perhaps no sector has benefited more from ultra-low rates than housing; the recovery can at least partly be traced to 30-year fixed mortgage rates that remained below 4%, down from about 6% in 2008, keeping borrowing costs low for buyers. But today’s housing market is supported by far more than low mortgage rates — namely steady job and economic growth. What’s more, 30-year mortgages are priced off 10-year Treasury note

yields, which do rise as short-term rates climb, but not as steeply. Expects 30-year mortgage rates to drift from 4.1% to 4.35% by summer. That would boost the monthly cost of a typical $325,000 mortgage by $47 to $1,617 — is this enough to deter most buyers. Slightly higher borrowing costs for projects is unlikely to alter that dynamic. More new listing, more incentives if there should be an over building of new homes. Commercial builders have concentrated on thousands of rental units, that rental prices should stabilized and come down by the end of this year. The nation’s banks are among the few winners spawned by a Fed rate hike. Low rates have forced banks to make do with smaller margins between the interest rate they offer depositors and the rates they charge consumers and businesses for loans. The most immediate impact of a Fed move will be on the credit cards and home equity loans offered by the nation’s largest banks. Those rates are variable and so should rise quickly in response to a higher fed-funds rate, which is what the Fed charges banks for overnight loans. In other words, banks will pass along their higher borrowing costs to consumers and businesses. Currently, banks are flush with deposits from risk-averse consumers and businesses and so don’t need to lift savings rates immediately to attract more deposits for lending. Mortgage lending guidelines should be easing very soon; more aggressive programs will come out to help first time
buyers and Self Employed borrowers. They have been left behind and could not buy due to the tough guidelines put in place by Fannie Mae and Freddie Mac. Some callers have been asking if they should buy now and wait. I think for buyers that intend to occupy the house, it’s always a good time. Mortgage interest write offs benefits homeowners and that is a big refund for homeowner paying high rental fees. I can’t think of a reason for the housing market to crash like it did in 2008? The limited inventory of home in some areas will keep demand high. Although location is still key to your purchase decision. Some property location has a limit on how high a buyer will pay so be very careful. Condos should also concern buyers, because when home prices increase and level off, condos tend to rise due to affordability. MMFF revokes ‘Oro’ prize over alleged animal cruelty Following days of intense controversy, the executive committee of this year’s Metro Manila Film Festival (MMFF) have stripped “Oro” of one of its awards while they conduct their investigation as to whether a dog has been slaughtered for use in the Alvin Yapan-directed drama. The committee, which included Film Development Council of the Philippines (FDCP) chairperson Liza Dino, said that they had rescinded the film’s Fernando Poe Jr. Memorial Award for Excellence after a meeting with Senator Grace Poe, the daughter of the late action star whom the award was named after. The decision came a day after the senator urged the committee to investigate whether the film was guilty of animal cruelty. Poe stressed that artistic license “does not justify the violation of our laws.” “If in fact that were the case, I condemn such act and would move for the invalidation of the FPJ award given to the film. ...Though I am not part of the jury that decided on the award, it is my responsibility to uphold the values of FPJ. He would never condone an act of animal cruelty.” “Aside from the possible criminal liability, if indeed proved, the MMFF should also consider applicable administrative sanctions against the producers and/or film makers for any misrepresentation before the MMFF selection committee on this matter which in itself may already justify the movie being stripped of any and all awards it received among other sanctions,” Poe said in a statement. The controversy surrounding the film erupted early this week after animal welfare group Philippine Animal Welfare Society (PAWS) penned a complaint to Tim Orbos, Metropolitan Manila Development Authority chief and chairman of the
MMFF, over a scene where an alleged dog was shown being gutted as it was being prepared to be cooked. The group, which pointed out that the law prohibits the use of animals killed for the purpose of film production, has since called for “Oro” to be pulled out from the film fest and all its awards, including a Best Actress nod for lead star Irma Adlawan, revoked. Alvin Yapan, the director of “Oro,” has said that he deemed it fit to use a real animal as it “was within the bounds of culture in that area where dogs are eaten as food.” He also stressed that no one from his production team, including the film’s cast, participated in the slaughter. “Hindi ko inimbento ang metapora ng aso dito para lang pumatay ng aso sa loob ng isang pelikula para lang pag-usapan. My EP said: Gagawin po naman ang kailangan huwag lang mabahiran ng masama ang pangalan ni FPJ.” “Narinig niyo na ang panig ng MMFF, ng PAWS, at ng ORO. Nirerespeto namin ang lahat ng panig. At patuloy namin rerespetuhin ang MMFF. This so-called ‘trial by publicity’ should stop. If PAWS wants to take a legal action, we will respect it. Hontiveros vows to keep campaign promise of prioritizing health bills MANILA, Jan. 3 (PNA) – Sen. Risa Hontiveros has vowed to keep her campaign promise of pushing for the passage of a measure meant to stop the practice of hospitals asking for advance payment before admitting patients in emergency situation among other health bills. Hontiveros, chair of the Senate Committee on Health, earlier filed Senate Bill No. 216 or the Amendments to the Anti-Hospital Deposit Act that seek heavier penalties on hospitals that continue to violate the law while providing tax incentives to those that will admit indigent or poor patients in cases of emergency. She said the Senate is set to conduct another hearing on the issue, submit the bill to the technical working group (TWG) and release a committee report as soon as possible as the Senate resumes sessions on January 16. “The Anti-hospital deposit bill is part of my priority legislative bills this new year. We cannot allow the lives and health well-being of our people to be sacrificed any longer in the name of profit,” Hontiveros said. Hontiveros, who also chairs the Senate Committee on Women, said that she will also be pushing for longer maternity leave for women this year. Under Senate Bill No. 215 or the Extended Maternity Leave Act, Hontiveros seeks to extend the maternity leaves of working women from the current 60 days to 120 days and 150
days for solo mothers. The neophyte senator said that her committee is already in the process of preparing its committee report on the different versions of the bill. President Rodrigo Duterte earlier expressed support for a longer maternity leave saying mothers should have a longer rest period to give them more time to breastfeed their babies. Hontiveros also vowed to push Senate Bill No. 935 or the Anti-Discrimination Bill which she filed to penalize discrimination against sexual orientation and gender identity (SOGI) in schools and workplaces, and offer equal protection to members of the lesbian, gay, bisexual and transgender (LGBT) community. At present, the bill has already made its way to the plenary and is ready for second reading. LGBT advocates have said that Hontiveros’ proposed measure is the first anti-discrimination bill to reach the Senate plenary.

German research says chili pepper an effective weapon against cancer MOSCOW, Jan. 4 (PNA/Sputnik) – Recent research conducted by German scientists has revealed that the active component in chilies, capsaicin, can cause cancer cells to self-destruct. Capsaicin is the compound that gives chilies their special kick, but while it can easily make some people cry from its fiery taste, it could also be used to cure various types of cancer, including that of the breast, colon or pancreas. Scientists from Ruhr-University, in Bochum, Germany, carried out experiments to find out how human samples of breast cancer reacted
when affected by the spicy molecule. It was determined that capsaicin can attach itself to the membrane of a diseased cell and switch on specialized receptors controlling what substances enter and exit the cell. By triggering these channels, capsaicin can send a cancer cell into overdrive, prompting it to self-destruct. By causing cancer cells to die, tumor growth is halted. “In our experiments, a significant reduction in cell proliferation after capsaicin stimulation was observed,” said Dr. Lea Weber, a member of the scientific group that organized the experiment.

New York – John Ablaza, the Filipino international eco-fashion designer, once again delivered a fascinating gala fashion show experience where couture and culture from the Philippines and Zimbabwe were unveiled. The show was put up in collaboration with the lovely Mithi Aquino-Thomas, wife of US Ambassador to Harare Zimbabwe Harry K. Thomas, and Zimbabwean designer Yvette Ndaba. Ndabamade her New York debut with her impressive collection of Zimbabwean traditional and modern creations. Simultaneously, Jhenny Morales Evans, an acclaimed Southern California photographer,held a photo exhibit in the same place where she shared her meaningful experiences in Harare and Bulawayo, Zimbabwe – places that she visited with Ablaza early in the year 2016 where they
were hosted by the Thomas couple. The photographs showcased local artisans, designers and the fashion show for charity conducted in Harare and Bulawayo, Zimbabwe early on this year. PASADENA – For the regular supporters, the placards saying “Thank You,” carried by members of a marching band, signaled the end of the 128th Rose Parade on Monday (January 2). But for activists and politically responsive audience, the hastily built native Americans’ float “Water is Life” that trailed the parade still counted. Well for one, just like the rest of the parade floats, the “Water is Life” float and its complementary 150-foot-long replica of an oil pipeline were also warmly applauded as they trailed the parade throughout its 5.5 mile route that begun in Orange Grove Boulevard and Colorado Boulevard. Hundreds of native Americans, activists, veterans and their supporters chanted “Water is Life” and “We are water protectors” as they marched. Fe Koons, a southern California writer and activist, said the protest was organized by the Bernie Sanders Brigade and the Native American Movement of Southern California. “It (trailing the Rose Parade) was announced last December 10 during a rally in downtown LA,” Koons disclosed. A number of Filipino Americans were seen in the demonstration. Apparently, the protest was in connection with the ongoing standoff on a federal land in southern North Dakota, near the Standing Rock Sioux Reservation, over the construction of a 1,200-mile pipeline (popularly known as Dakota access pipeline). Native Americans and allies said the infrastructure threatens drinking water and cultural sites in the area. The Army Corps of Engineers has recently denied a permit for the pipeline to cross under the Missouri River. Still on 128th Rose Parade, marching bands from Mexico and Japan were considered by kibitzers as among the highlights of the event. The presentation by the Escuela Secundaria Tecnica Industrial No. 3’s Buhos Marching Band from Xalapa, Veracruz, Mexico and by the Gifu Shogyo High School Green Band from Gifu, Japan, got the crowd fervently cheering and dancing. Booms, ticker tapes and smoke from fireworks spewed from the National Hockey League’s (NHL) float jolted the audience and sent them up on their feet. The NHL is celebrating its 100th anniversary this year while the Los Angeles Kings are celebrating their 50th anniversary. Twenty-four of the 42 floats that participated in the “Echoes of Success” 128th Rose Parade received honors in a variety of categories.

(Jan. 5, 2017) – The American Red Cross has a severe winter blood shortage and is issuing an emergency call for blood and platelet donors to make a donation appointment now and help save patient lives. Hectic holiday schedules for many regular blood donors contributed to about 37,000 fewer donations in November and December than what was needed. Snowstorms and severeweather have also impacted donations. Nearly 100 blood drives were forced to cancel in December, resulting in more than 3,100 blood donations going uncollected. “Blood and platelet donations are critically needed in the coming days so that patients can continue to receive the lifesaving treatments they are counting on,” saidJay Winkenbach, Donor Recruitment director of the local Red Cross Blood Services Region. “We encourage donors to invite a family member or friend to donate with them to help meet patient needs.
