MANILA, July 13 (PNA) – The Bureau of Immigration (BI) has alerted all international and local ports against the five Philippine National Police (PNP) generals allegedly involved in illegal drugs trade. According to BI Spokesperson Atty. Antonette Mangrobang, BI personnel in ports around the country have been alerted in response to the lookout bulletin order (LBO) issued by the Department of Justice (DoJ), which they received on Wednesday. SUBIC, ZAMBALES, July 12 (PNA) – Police operatives raided and seized a suspected floating shabu laboratory disguised as a fishing vessel and arrested four Chinese crews on-board while entering Subic Bay in Barangay Calapandayan this municipality. PNP Chief Director General Ronald “Bato” dela Rosa, with Subic Mayor Jay Khonghun, led operatives from the PNP Anti-Illegal Drugs Group and boarded the vessel while it was cruising between Subic Freeport and Barangay Calapandayan in the town of Subic before Monday midnight. Khonghun, over local radio station Brigada News FM, said that authorities began suspecting about the real use of the vessel after they found it very clean and “fresh.” Suspicions proved to be true after the recovery inside See FLOATING, page 10

After a debtor receives a discharge in bankruptcy, creditors whose debts are discharged are required to report that the account has a zero balance. The fact of the filing itself can remain on the credit report for 10 years from the date it was filed. A debtor interested in re-establishing credit after bankruptcy should obtain credit reports from the 3 largest credit reporting agencies, (Experian, Equifax, and Trans Union) and ensure that the account balances have all been zeroed out. If not, the debtor should contact the credit reporting agencies and ask that the record be corrected Methods of Re-Establishing Credit A debtor seeking to re-establish credit should consider applying for a secured card, usually a Visa or Master Card. This is a credit card issued by a bank to a customer who is required to establish a savings account at the bank, which is used as security or collateral for the card. Typically, the limit on the card is based on the amount of collateral put up in the form of the savings account. Often, the bank will have an annual fee. The benefit of the secured card is that banks will issue them to persons with poor credit reports in the past, but who have the ability to pay the deposit to secure the account. Major store cards are also a good addition to building credit. Once you have a major credit card, even a secured card, itâ&#x20AC;&#x2122;s usually all thatâ&#x20AC;&#x2122;s required to open an account at a major store, such as JCP, Kohls, etc. Other methods include buying a car from a local car dealer who advertises that it specializes in making car loans to persons with bad credit or recent bankruptcies. Also, a debtor with a personal relationship with someone at a local bank should not hesitate to seek assistance from that source. There are also financial institutions that target recent bankruptcy people seeking credit. This also includes mortgage companies. Several major companies will consider a mortgage within 1 to 2 years from the bankruptcy discharge. The reason these companies are interested in bankruptcy discharge consumers, is because they cannot file a bankruptcy again for 8 years, do not owe money, have a good debt to income ratio (Income from employment, all debts discharged in bankruptcy), and finally, they get to charge more than regular financial institutions. Bottom line â&#x20AC;&#x201C; itâ&#x20AC;&#x2122;s a business, and a good business at that. Caution in Rebuilding Credit Ultimately, however, debtors emerging from bankruptcy should use their experience to avoid getting into the same financial traps, which snared them before. All too often, this was the easy availability of unsecured credit in the form of unsolicited, pre-approved, credit cards. Debtors should take steps to budget properly, not spend beyond their means, and resist the temptation to incur debt beyond their reasonable ability to repay just for the purpose of re-establishing credit. Debtors should avoid being enticed by so-called â&#x20AC;&#x153;credit repairâ&#x20AC;? agencies. These are often simply unregulated rip-offs, who prey on the financially-distressed, and who do nothing more than what debtors themselves can do by exercising their legal right to have their reports properly list their outstanding obligations.
Income Taxes in Bankruptcy As a general proposition, older income taxes (more than 3 years old) can be wiped out in bankruptcy; newer income taxes (less than 3 years old) cannot. A debtor/employer can wipe out the employerâ&#x20AC;&#x2122;s portion of older, but not newer, payroll taxes. The discharge ability of state and local, such as sales and use taxes, will depend upon their true nature, i.e., whether they are excise or withholding taxes. The trust fund portion of payroll taxes is generally not dischargeable. Prior to filing bankruptcy, the debtor should have his own particular tax situation assessed. Test for Wiping Out Income Taxes The Test for wiping out income taxes in bankruptcy include: The tax return was due more than 3 years prior to the filing The tax return was filed at least 2 years prior to the filing The tax has been assessed for at least 240 days prior to the filing The tax is not based on a fraudulent return There was no willful tax evasion by the debtor. In Chapter 13, income taxes can be wiped out if the return was due more than 3 years prior to the filing, and was assessed at least 240 days prior to the filing. In some cases, the tax may be dischargeable even if not assessed prior to the filing. Income Tax Liability Under the Internal Revenue Code, as a general rule, forgiveness of indebtedness constitutes income to the debtor. However, there is an exception where the debtor receives a discharge in bankruptcy. Can Utility Debts Be Discharged in bankruptcy? Public utilities, such as the gas and electric company, are not permitted to discontinue service because of a bankruptcy filing. However, if the utility bill is included in the bankruptcy and not paid, then the utility has the right to demand that the debtor pay a deposit within 20 days to ensure the continuation of service. Sometimes, the requested deposit is several times the amount of the bill, so it often makes sense for a cashstrapped debtor to simply pay the bill. Utility bills for service arising after the bankruptcy filing is not included in the bankruptcy, and must be paid. Does the Bankruptcy Code prohibit discrimination based on a bankruptcy filing? The Bankruptcy Code contains an â&#x20AC;&#x153;anti-discriminationâ&#x20AC;? provision, stating that government units and private employers may not discriminate against a person solely because that person has filed bankruptcy or was insolvent. Also, if a debtor has lost his driverâ&#x20AC;&#x2122;s license solely because of his inability to pay damages resulting from an accident, then a bankruptcy discharge will allow the debtor to get his license back. MANILA, July 13 (PNA) – With the Philippines winning its arbitration case, Department of National Defense (DND) Secretary Delfin Lorenzana hopes China will comply with the ruling for the good of the entire region. “I hope China will abide (with the ruling) because it will be good for the whole region if everybody will follow the rule of law, nobody can just cherry pick the laws that we are going to abide by it. MANILA, July 13 (PNA) – The militant fisherfolk group Pambansang Lakas ng Kilusang Mamamalakaya ng Pilipinas (Pamalakaya-Pilipinas) on Wednesday urged President Rodrigo Duterte to tighten control and claim on the disputed West Philippine Sea (WPS) even as it insisted that asserting Philippine rightful claim in the disputed area should be in any peaceful way possible. Salvador France, vice chairperson of Pamalakaya-Pilipinas, said that engaging in a violent war against China is the last thing the country wants. “Our fishers have been devastated as it is, and our natural resources in distraught. Active diplomacy through bilateral and multilateral talks with China and other claimants of the disputed waters is the best chance we have, provided these are founded upon the framework of the United Nations Convention on the Law of the Sea (UNCLOS) and the recent Hague decision, and advanced in mutual respect,” he said. On Tuesday, the International Permanent Court of Arbitration favored Philippines against the claim and actions of the Peoples Republic of China with respect to the South China Sea or West Philippine Sea. It ruled that China has no legal basis to claim historic rights to resources within the sea areas falling within its claimed nine-dash line. Through its 9-dash line assumption, China is aggressively claiming 90 percent of the South China Sea, through which about USD 5 trillion worth of ship-borne trade passes every year and is a home to abundant marine products endowed with untapped oil and gas reserves The international tribunal also found China in violation of the 1982 United Nations Convention on the Law of the Sea (UNCLOS), specifically with respect to the Philippines’ sovereign rights in its Exclusive Economic Zone (EEZ), by interfering with fishing and petroleum operation, constructing artificial islands, and failing to prevent Chinese fishermen from fishing in the zone. “It is official, the West Philippine Sea is our and ours alone. This is a victory not only for us fisherfolk but also for us as a nation. We have stood up against the bullying and garnered support in the process,” France said. “The international tribunal’s decision is an initial victory for the Filipino people who have tirelessly fought for the national sovereignty and territorial integrity. We call on the Filipino people to remain steadfast on patriotism and nationalism in the name of defending the country from any aspects of foreign domination,” he said. However, the fisherfolk group said that the Philippines should also remain vigilant for possible aggressive responses from China as Beijing has repeatedly said that it won’t comply with the International Tribunal Court as it maintains its claim that South China Sea is an indisputable sovereignty.

Fisherfolk calls for peaceful resolution on sea issue
Palace on ruling: ‘Top priority will be national interest’ MANILA, July 12 (Mabuhay) -- The government’s next step in dealing with the territorial dispute in the South China Sea after the arbitration court issues its ruling will be based on the premise that national interest is the administration’s priority, a Malacañang spokesman said Tuesday. At a media briefing, presidential spokesperson Ernesto Abella said “everything will be subject to a discussion” after the Permanent Court of Arbitration releases its decision on the territorial dispute case filed by the Philippines against China. The court earlier said the ruling will be handed down at approximately 11 a.m The Hague time, 5 p.m. in Manila.

Lacson defends ex-QCPD chief linked to drugs MANILA, July 13 (Mabuhay) – Senator Panfilo Lacson on Wednesday defended former Quezon City Police District (QCPD) Director, Chief Superintendent Edgardo Tinio, one of the five police officers implicated by President Rodrigo Duterte in illegal drugs cases. Lacson said Tinio went to him and explained his side after he was mentioned by the President as one of the coddlers of drug lords. He said Tinio told him about a
drug case involving a judge who was already dismissed from government service. He added Tinio also narrated how “ninja” policemen may have operated in the Manila Police District. “The way he narrated, I would tend to believe him rather than not believe him,” said Lacson. MANILA, July 13 (PNA) – The Department of Justice (DOJ) on Wednesday conducted inquest proceedings against the four Hong Kong nationals who were earlier arrested in a drug raid by the Philippine National Police-Anti-Illegal Drugs Group (PNP-AIDG) in the so-called “floating shabu laboratory” in the waters off Subic, Zambales. Facing a case for violation of Sections 8 and 11 of Republic Act No. 9165, or the “Comprehensive Dangerous Drugs Act of 2002”, are the accused, namely, Shu Fook Leung, Kam Wah Kwok, Win Fai Lo and Kwok Tung Chan. The suspects were on board a fishing vessel in Subic Bay when they were apprehended by authorities and seized half-kilo of shabu worth PHP2.5 million from their possession. During the inquest proceedings, Senior State Prosecutor Juan Pedro Navera examined the passports of the four foreigners. Navera discovered that one of the accused had entered the Philippines four times already as a tourist while the other one it’s already his second visit to the country as a tourist, but on his first visit to the country, his passport had no stamp. Since the four accused have waived their rights, Navera said, the case is now submitted for resolution. After the inquest proceedings, the four were immediately brought back to the detention facility of the PNP-AIDG in Camp Crame, Quezon City.

MANILA, July 13 (PNA) – As a result of PNP Chief Director General Ronald M. Dela Rosa’s all-out war against illegal drugs and criminality through ‘Oplan Tokhang’, thousands of suspected drug pushers and dependents in Metro Manila surrendered to police authorities, National Capital Region Police Office (NCRPO) Acting Regional Director Chief Supt. Oscar Albayalde said on Wednesday. Under ‘Oplan Tokhang’, station commanders will ask the barangay captains to submit a list of residents who are into illegal drugs, whether these pushers, dealers, users and couriers. The police intelligence unit will then verify the report and check if these persons are indeed involved in drugs because there are instances that barangay captains themselves are behind the illegal drug trade and list down names of their rivals. Albayalde noted from July 1-12, the NCRPO have knocked 12,037 houses of suspected drug personalities that resulted to the surrender
of 8,808 illegal drug suspects, arrest of 362 including two Chinese Nationals, and neutalization of 43 drug suspects. He noted the authorities also confiscated 298.301 kilograms, 571 sachets and six packs of shabu, 0.81 kilogram, four rolls and 33 sachets of marijuana with a total estimated value of PHP1,846,200,000, confiscated 20 assorted firearms, one hand grenade, and three bladed weapons. He said that personalities include 4,898 illegal drug users who are now referred to the Local Government Units (LGUs) and Dangerous Drug Board (DDB) for rehabilitation, while 3,547 illegal drug pushers including 348 illegal drug pushers surrendered with illegal drug paraphernalia. Ombudsman files graft raps vs. ex-VP Binay By Perfecto T. Raymundo
MANILA, July 14 (PNA) – The Office of the Ombudsman (Ombudsman) filed graft charges against former Vice President Jejomar “Jojo” Binay before the Sandiganbayan on Thursday. The Ombudsman filed charges for graft, falsification of public documents and violation of the Government Procurement Reform Act against Binay. The charges were in connection with the alleged overpriced Makati City Hall Building II amounting to
PHP2.28 billion. In October 2015, the Ombudsman found probable cause to file the cases before the Sandiganbayan against Binay and his son, former Makati City Mayor Jejomar Erwin “Junjun” Binay, Jr. Likewise charged were the 22 other local officials of Makati City. Ombudsman Conchita Carpio Morales earlier said that they can already file the cases against Binay once he is not anymore covered by immunity from suit as Vice President.
Recto urges Duterte to buy firearms for 16,140 ‘gunless’ cops By Jelly F. Musico
MANILA, July 13 (PNA) – Senator Ralph Recto on Wednesday urged the administration of President Rodrigo Duterte to include to its maiden national budget proposal the funds for the purchase of firearms for the 16,140 ‘gunless’ policemen. Recto suggested this proposal after learning from the 2015 Commission on Audit (COA) report that out of 147,041 actual Philippine National Police (PNP) uniformed personnel, only 124,738 have been issued short firearms as of end of last year. ”The official reports point to a manpower and material lack which call for more boots on the ground and more guns for policemen,” Recto said. According to the PNP audit for 2015, the PNP has not attained a 100 percent issuance of short firearm to PNP uniformed personnel required. Recto noticed that some 623 officers were using donated handguns while 3,654 officers could not be accounted for or have no record of having been issued service firearms, the audit body said.
COA said the PNP’s failure to achieve a 100 percent “arming rate” for its personnel violates a 1993 National Police Commission order mandating a one-gun-one-police ratio. Recto said the PNP’s gun shortage would have been eased if it did not divert in 2012 a Php336 million budget for gun procurement. According to the same COA report, the amount was instead used to buy 20 patrol jeeps, one “Crime DataProcessing System” and an “Automated Fingerprint Identification System” costing Php270 million. The original procurement plan was to acquire 12,268 units of caliber 9-millimeter pistols costing Php296 million, the COA said. Recto said government should resume its gun acquisition plan because “the situation in which gunless policemen account for 11 percent of the force should not be allowed to continue.” The senator also called for inclusion in the reported Php 3.3 trillion 2017 national budget funds for the “recruitment, salary and equipment” of 23,820 vacant positions in the PNP manpower table.

9 summary execution victims found in Manila in 6 six days MANILA, July 9 (Mabuhay) – In six days, a total of nine summary execution victims, believed to be involved in illegal drugs, have been found in Manila, police said Saturday. The Manila Police District’s homicide division said that the latest summary execution victims were found Saturday morning near the Metropolitan Theater in Lawton and Intramuros areas. The bodies were found around 5 a.m. and 7 a.m., respectively. Both bodies were stuffed in boxes, wrapped with packing tapes. The first box had the message, “Pusher holdupper ako, huwag tularan” and the second box had a similar message “Pusher ako, huwag tularan.” The MPD’s homicide division is investigating if the two killings are connected with the seven other cases they recorded since July 4. The homicide division said that the seven other bodies found in Manila were also left the similar messages. Police suspect that the summary executions are effects of the Duterte administration’s campaign against drugs. They believe the victims were killed by their fellow members of drug syndicates. Meanwhile, the MPD said that its policemen have killed at least 10 drug suspects in operations since July 4.

Homeowner files last minute Chapter 13 without credit counseling Client is 59 and single. He has a decent job where he makes $4K a month gross. He doesnâ&#x20AC;&#x2122;t owe any credit card debt. He only owes 3 secured debts. He owes a mortgage on his house for $400K plus he has arrears of $83K on this mortgage. His mortgage payment is $2K a month, which means that he has not paid his mortgage for 41 months or 3 ½ years. He tells me that he has been working with a non-profit consumer advocacy group (whatever that means) to get the bank to give him a loan modification on his mortgage. Apparently, heâ&#x20AC;&#x2122;s been trying to get the loan modified since 4 years ago and received multiple prior denials. This explains why he hasnâ&#x20AC;&#x2122;t paid his mortgage for 4 years. Finally, the bank sets the foreclosure sale date for July 6, 2016. Whoever he is talking to at the non-profit consumer advocacy group tells him that he has to file a Chapter 13 to stop the foreclosure on July 6. Unfortunately, he is not told that he has to do credit counseling first before he can file for Chapter 13. On July 1, without a lawyer, he files his incomplete emergency Chapter 13 petition. The clerk looks for the credit counseling certificate and he says he doesnâ&#x20AC;&#x2122;t have one. Nevertheless, the clerk accepts the incomplete petition, which doesnâ&#x20AC;&#x2122;t have credit counseling, and has no schedules and gives him a list of deficiencies that have to be filed within 14 days otherwise his case will be dismissed. So today, he ends up in my office and asks me to take over the case as his lawyer. Although I agree to help him out, I had to explain to him that he has to give a satisfac-
tory explanation to the court why he did not do credit counseling before he filed his case. If the court believes that the facts he alleges amount to exigent circumstances, the court may let him proceed with the case. Otherwise, his case will be dismissed for lack of pre-filing credit counseling. On the other hand, if client had a disability that prevents him from taking credit counseling, he would be exempt from requirement. Although client is legally blind, that may not qualify as a disability to exempt him from the requirement to take the course because this course is also given over the phone. To be sure, many judges do not consider a foreclosure an exigent circumstance because the foreclosure process takes at least four months to complete before the house can be auctioned off in a nonjudicial foreclosure proceeding. In any event, aside from explaining why he did not do credit counseling within 14 days from filing date, client still has to do credit counseling within 30 days from filing date assuming the court agrees that he was faced with exigent circumstances that prevented him from doing credit-counseling pre-filing. As you can see, you have to go through a lot of hoops if you donâ&#x20AC;&#x2122;t do credit counseling pre-filing so why even get into this dire situ-
ation in the first place. Therefore, make sure you do credit counseling first before you file for bankruptcy, any kind of bankruptcy so you donâ&#x20AC;&#x2122;t have this kind of problem to deal with. And avoid filing incomplete petitions. If you fail to file in one missing document, your case will be dismissed on the 15 th day. So why even assume this kind of risk by filing an incomplete petition. The other client is 70. He owes $35K of credit card debt. According to him, he is â&#x20AC;&#x153;sickâ&#x20AC;? of paying for these cards. He has been paying for 20 years. He has been paying $1K a month for 20 years. He has paid only $240K in the last 20 years! But he still owes the same $35K! But he is now 70 and living on social security, which is less than half of what his salary was. I told him that he should have filed at least ten years ago and saved $120K. And he would still have perfect credit now at 70. I mean, file at 60, at 67 credit score will be 730 and on year 10, at 70, the credit bureaus remove the fact of filing from their credit reports as required by law; but better late than never. With Chapter 7,
client will have peace of mind at 70, because all of his $35K credit cards will be discharged. Who wants to have credit card debt when you now rely on social security? With social security income, credit card payments are a big drain on your budget. Getting rid of credit card debt with Chapter 7 is like surgery to remove a cancerous growth. It has to be done as soon as possible. Filipinos’ love for dancing abloom in Vogue Dance Club’s 5 th year The Filipinos are naturally gifted race of people in many aspects and we can include dancing as one they indulge in with natural grace and expressiveness. Dance is a major part of Philippine culture and a natural part of a universal form of self expression. From the traditional movements attributed to regional origins to modern West-inspired repertoires, the Filipinos’ love for dance deep is deeply rooted in their natural appreciation and recognition of rhythm and beats. It’s embodied in the physiology to be “in beat and attuned”. Some attributes could explain why Filipinos have in their hearts soft spots for dancing. Filipinos are by nature into the arts and as such dancing has drawn them to the artful movement and expression of the medium. Filipinos are fun-loving bunch and any merriment is never complete without the dance portion (and of course the ever present Karaoke machine which expresses their other passion that goes with dancing). Their skills easily adapt to popular dance hits and latest dance craze which make it easier for them to satisfy their fun-loving nature in engaging in wholesome group activities. While individually, Filipinos tend to be graceful and expressive in showing their natural talents on the dance floor, many consider it more fun in a dance form called line-dancing which was ushered to the Filipino American communities a few years back. Line-dancing, is a term coined in the 1980’s although it was in the disco floors of the 1970’s that many
consider to have birthed the social dancing phenomenon. The early disco line-dances as known today were truthful to the line-dances whose appearance spurred the birth of line-dancing. Although group dancing in many cultures of the world had their earlier origins, the derivative art of group or community dancing had its profound influence in the early 70’s line dances where styles and more movements evolved on the dance floors. The Philippines’ “ work diaspora” of many years ago where hundreds of thousand of Filipinos had to leave their country for job opportunities abroad had them take their dancing skills with them which they put to go use to ease the loneliness and boredom of being away from their country. In the dance floors of many halls and locations, they were able to meet and mix with their like-minded countrymen and dancers of other nationalities who needed satiate their psychological and social needs while at the same time enjoy the benefits of physical exercise to meet the demands of their work in their adapted country. MANILA, July 10 (PNA) – Interior and Local Government Secretary Mike Sueno has ordered the conduct of a lifestyle check among the members of the Philippine National Police (PNP) in order to identify and remove officials involved in illegal activities. With this, Sueno instructed PNP Chief Ronald Dela Rosa to check first the three active police generals namely, Police Regional Office (PRO) 6 Director Chief Supt. Bernardo Diaz, former National Capital Regional Police Office (NCRPO) Chief Police Director Joel Pagdilao and former Quezon City Police District (QCPD) Director Edgardo Tinio, who were named by President Rodrigo Duterte as protectors of drug lords. He added that a public servant must possess honesty, integrity and professionalism in serving the country. He noted that if a police or a civil servant amassed questionable wealth, they must explain how they acquired their assets. The DILG Chief said the National Police Commission (Napolcom) has started its investigation on the case of the three active police generals. Lawyers from the agency have also started gathering information regarding the case of former police general and now Daanbantayan, Cebu Mayor Vicente Loot. Duterte publicly named the five PNP officials including retired Director General Marcelo Garbo as involved in illegal drugs and ordered them relieved from the posts. Pagdilao, Tinio, Diaz and Loot already talked to Sueno, saying they are willing to face probe in order to clear their names.

Do I need a premarital agreement before getting married? In the absence of a premarital agreement, the general community property presumption under California family code section 760 controls which provides â&#x20AC;&#x153; â&#x20AC;Ś.all property, real or personal, wherever situated, acquired by a married person during the marriage while domiciled in this state is community property.â&#x20AC;? Family Code §760. This becomes a problem if you are the spouse that has the substantially higher income or the one who accumulates the majority of the assets during the marriage. You are called in family law lingo â&#x20AC;&#x153;the in spouse.â&#x20AC;? The other spouse (or in our lingo also called the â&#x20AC;&#x153;out spouseâ&#x20AC;? gets a half interest on everything accumulated during the marriage even if the asset is under your name alone or it was accumulated solely due to your sweat and hard work. The out spouse, who stayed at home most of the marriage, gets a one half interest on all the accumulations during the marriage under California community property law. For example, if you opened a savings account during the marriage under your name alone for which you religiously and diligently stash away 25% of your earnings during the marriage while your spouse blows away his/her salary during the marriage, your spouse still gets a half interest in the money you saved in your savings account. Another example would be if you purchase a piece of real property during the marriage under â&#x20AC;&#x153;your name aloneâ&#x20AC;? and have your spouse sign a â&#x20AC;&#x153;quit claimâ&#x20AC;? deed, your spouse may still have a claim

(2) The party against whom enforcement is sought had not less than seven calendar days between the time that party was first presented with the agreement and advised to seek independent legal counsel and the time the agreement was signed. (3) The party against whom enforcement is sought, if unrepresented by legal counsel, was fully informed of the terms and basic effect of the agreement as well as the rights and obligations he or she was giving up by signing the agreement, and was proficient in the language in which the explanation of the party&#39;s rights was conducted and in which the agreement was written. The explanation of the rights and obligations relinquished shall be memorialized in writing and delivered to the party prior to signing the agreement. The unrepresented party shall, on or before the signing of the premarital agreement, execute a document declaring that he or she received the information required by this paragraph and indicating who provided that information.(4) The agreement and the writings executed pursuant to paragraphs(1) and (3) were not executed under duress, fraud, or undue influence, and the parties did not lack capacity to enter into the agreement.(5) Any other factors the court deems relevant. Cash out to pay off debts or do home improvements LA Times had a article recently about how the world debt is higher than prior to the mortgage crisis. Personal and Business debts are skyrocketing and the analysts are worried that that would be the cause for another recession. The solution seems to be pretty obvious if you own a house and do have some equity, REFINANCE AND CASH OUT. Rates are ridiculously low, you are better off paying off 17+% credit card interest rates, you are better paying off 8-10% student loans with these low rates being offered now for home mortgages. I seriously think if you have not considered this and have the option to, please knock yourself in the head and do so! For homebuyers, Stocks and Bonds are still red hot this year and it might spill over to the next year. More obvious signs are that Real Estate listings in some parts of town have actually gone up, meaning if there are more listings, the buyers will have more choices to buy. We have had numerous clients cashing out on their equity and looking into buying another real estate. My most valuable advise for investor is that if you are to buy now, you have to get into a property with positive cash flow. New investors always donâ&#x20AC;&#x2122;t factor in payments for taxes and insurance and remember to always include a 15% vacancy and maintenance factor when calculating your payments. If you were to buy a Real Estate as
a Residence, that might be different. If you were to put some money down and would live in it. There is really no good or bad time as long as you get a good stable loan and plan to stay for a minimum of 5 years. Medicare enrollment periods Switching plans because your doctor suddenly lost his contract with your network? Or, your plan does not respond immediately to your urgent, pressing and important needs? Well, Medicare has rules with regards to enrollments. There is the Annual Enrollment Period. This year â&#x20AC;&#x201C; itâ&#x20AC;&#x2122;s October 15 up to December 7. Enrollments during this period become effective January 1 the following year. For one reason or another, if you feel you enrolled on a plan that does not fit your needs, January 1 to February 14 is the Disenrollment Period. You may leave your plan during this period. MANILA, July 12 (Mabuhay) -- The government’s next step in dealing with the territorial dispute in the South China Sea after the arbitration court issues its ruling will be based on the premise that national interest is the administration’s priority, a Malacañang spokesman said Tuesday. At a media briefing, presidential spokesperson Ernesto Abella said “everything will be subject to a discussion” after the Permanent Court of Arbitration releases its decision on the territorial dispute case filed by the Philippines against China. The court earlier said the ruling will be handed down at approximately 11 a.m The Hague time, 5 p.m. in Manila. “Everything will have to be subject to a discussion. After all, it’s going to be a lengthy decision and there will be a number of details that need to be properly threshed out before any statement – any decision is made publicly,” Abella said. “The top priority will be national interest. Definitely, national interest,” he added. President Rodrigo Duterte earlier cautioned his Cabinet members not to use the arbitration court’s decision to “taunt or flaunt,” saying he doesn’t want to “put the country in an awkward position.” “We will study progressively kung paano natin magagamit yun. Of course, it would be a moral victory but we can’t put country in an awkward position,” Duterte said. Abella said Duterte will likely call for a meeting with his Cabinet and the security cluster once the decision is released. He will be the one speaking for and in behalf,” Abella said. Although probably stung by the recent UN decision, I do not think Chinese leaders will ever surrender its hold on the disputed island, thinking that it’s theirs. To avoid straining further the country’s relations with China, President Rodrigo Duterte should start diplomatic negotiations with China, including backdoor negotiations to settle the issue amicably, despite the recent favorable ruling the Philippines got from UN. Duterte, however, should be firm in his dealings with Chinese leaders and point out that he has no plans of giving up the disputed territory, especially now that our claim has been upheld by the UN. President Duterte may have the balls, but he should be wary and careful in his negotiations with Chinese leaders regarding the disputed territory. Years ago, China had serious border issues with Russia and Vietnam. It took them 30 years of constant negotiations before they were able to hammer out a decision beneficial to Vietnam, Russia as well as to China. According to facts, China was forced to settle the issue because Russia and Vietnam would not budge on the issue. I am sure Duterte will learn more on this issue once he starts negotiating with Chinese leaders regarding the disputed territory. • President Duterte has received a favorable 79 percent approval rating from Filipinos all over the country on the manner of how he was running the affairs of the government, particularly on his campaign against illegal drugs. The survey was conducted recently by the Social Weather Station (SWS). Senator De Lima should be investigated for her reported closeness with some big time drug lords. It is a well known fact that drug money financed the senatorial candidacy of De Lima. Her constant “lightning” raids at the National Bilibid was just a publicity stunt to get her to land in major dailies as well as on television. Despite those raids, the sale, distribution of banned substances as well as the presence of guns, cell phones and money, continue to exist in the penitentiary in large numbers and amounts. Reports are now unraveling that General Pagdilao, one of the five accused PNP generals implicated in the illegal drugs business, was the subject of a “silent” investigation done by the late DILG Secretary Jesse Robredo shortly before his ill-fated airplane crash. Pagdilao and former DILG Undersecretary Puno were rumored to be close associates of President Noynoy Aquino. Despite being linked to illegal drugs and “jueteng” both Pagdilao and Puno were never investigated throughout the incumbency of President Noynoy. The government should start looking into the bank accounts of former Undersecretary Puno as well as the five generals implicated in the illegal drug business. Their assets and their unexplained wealth should be confiscated in favor of the government. President Duterte can make use of this money to build more jails for drug lords and their peddlers to be arrested in the days to come.

‘Proud’ Americans slips to new low: poll WASHINGTON, July 10 (PNA/ Xinhua) -- The percentage of US citizens who feel “extremely proud” to be Americans has slipped to a new low at 52 percent, finds a newly-released Gallup poll. This was down from 57 percent in 2013 and 70 percent in 2003, an indication that American patriotism keeps declining in the past two decades, according to the June 14-23 poll. Americans’ patriotism spiked af-
ter the Sept. 11, 2001 terror attacks, peaking at 70 percent in 2003, but has declined since, including an eightpoint drop in early 2005 and a fivepoint drop since 2013, Gallup said. “Americans’ declining patriotism is likely related to broader dissatisfaction with the way things are going in the US,” Gallup said in a report. In January 2004 when 69 percent of Americans were “extremely proud,” 55 percent were satisfied with the way things were going in the US, but

Robredo warns against ‘growing culture of vigilantism, violence’ MANILA, July 12 (Mabuhay) – Vice President Leni Robredo on Tuesday urged government authorities to look into the rising number of extrajudicial killings cases as she expressed concern on the “growing culture of vigilantism” in the country. But at the same time, Robredo reiterated her support for President Rodrigo Duterte’s war against drugs and criminality. In a carefully-worded statement, Robredo said she trusts that the President, her fellow lawyer, will abide by the law. “We support President Duterte’s declaration that the fight against drugs and crime must be done with an uncompromising exercise of the rule of law,” Robredo said in a statement. “However, there have been over a hundred cases of drug-related reported killings in less than a month. While we are one with the fight against drugs, we are concerned with the growing culture of vigilantism and violence,” she said. Robredo urged authorities should investigate the summary executions happening in different cities and provinces lately. “We hope that the war is not done at the expense of the innocent and defenseless. We encourage authorities concerned to look into these cases. If there is really culpability, then justice requires that appropriate cases be filed and that those proven to be accountable be punished,” she said. “Since the President is a lawyer and former prosecutor, we trust that he will do what is appropriate,” Robredo added. Cars 911, other dealers make smart moves in bullish auto market (NewsUSA) - Indications are rosy for U.S. auto sales now that the recession is far in the rearview mirror. According to analysts – who are bullish on the industry – new vehicle sales will hit their highest level since 2006, as consumers look to replace aging cars and trucks. In fact, estimated sales are expected to land somewhere between 16 million and 16.5 million, near pre-recession levels, which would mean an increase of around 5.8 percent. The takeaway? Automakers can afford to be cautiously optimistic about sales for the remainder of the year, but also need to understand that as growth sales slow, they will have to be diligent with their marketing and incentive offerings. Rick Baranski, director of publisher relations for U.S. Suburban Press (USSPI), maintains that the most effective auto-marketing strategies use local news-
paper and targeted email to increase sales. USSPI is an advertising network of community newspapers around the U.S. and is now a recognized leader of nationally aggregated email campaigns delivering targeted quantities of 50K and under through its eZIPs program. “Local newspapers are the primary information source used during the car-buying process,” says Baranski. “The eZIPS email program that we offer complements the print ads by reaching individuals who are most likely to be shopping for a vehicle at the moment.” Scott Slobodnik, brand manager of eZIPs, cites a case study of a dealership that sent out almost 39,000 emails at a cost of just over $3,800 using its eZIPs program. “That dealership sold 31 vehicles, for a return on investment of almost $52,000,” says Slobodnik.
