WAR VS REDS ‘OVER’ Duterte declares ceasefire with CPP-NPA
MANILA, July 25 (Mabuhay) – President Rodrigo Duterte on Monday declared a unilateral ceasefire with the Communist Party of the Philippines-New People’s Army-National Democratic Front (CPP-NPA-NDF). Duterte made the announcement before a joint session of Congress during his first State of the Nation Address (SONA). “I am announcing a unilateral ceasefire with the CPP-NPA-NDF effective immediately,” he said. He added: “I expect and call on our fellow Filipinos in the National Democratic Front and its forces to respond accordingly.” Duterte also vowed to
work for a “permanent and lasting peace” before he ends his term in 2022. “That is my goal, that is my dream,” he said. Military at a disadvantage in unilateral ceasefire with CPP: Sen. Ping Lacson MANILA, July 27 (Mabuhay) – The unilateral ceasefire declared by the government with the Communist Party of the Philippines-New People’s Army-National Democratic Front (CPP-NPA-NDF) has put the military in a disadvantageous position especially since the rebels have yet to reciprocate the gesture, Sen. Panfilo Lacson said Wednesday.

Poe to fast-track bill giving Duterte crisis powers to fix traffic MANILA, July 27 (Mabuhay) – Senator Grace Poe on Wednesday vowed to fast-track the passage of a measure that would grant President Rodrigo Duterte emergency powers to address the traffic problem in the country that she said has already “paralyzed our economy and our people.” Poe was elected Tuesday as chair of the Senate committee on public services. “A Senate bill for such emergency powers has been assigned to the public services committee that I will chair and the best course of action is to set it for public hearing as soon as possible so we can engage the Department of Transportation and all other stakeholders and experts to determine its necessity and if so the best terms under which such powers will have to be carried out to achieve its pur-
pose,” Poe said in a statement. The senator was reacting to House Speaker Pantaleon Alvarez’s bill or the “Traffic Crisis Act,” which seeks to grant emergency powers to Duterte for two years to do away with the mandatory bidding on procurement of transportation equipment and take over errant transport franchises to solve the traffic mess on roads and airports in Metro Manila and Cebu. The bill also proposes the creation of a “superbody” that would address the road and air traffic congestion in Metro Manila and Cebu province. Americans are still filing bankruptcy in record numbers, and with good reason. The economic downturn, including the fall of housing prices and the increase in unemployment has wrecked havoc on our finances. The truth is, that in many cases, bankruptcy is a wise decision for many, since it wipes away debt and interest payments that would take years to pay off, if you are only making minimum payments. Unfortunately, many people do not file bankruptcy because of misinformation. One of the most common questions people ask when contemplating bankruptcy is â&#x20AC;&#x153;will I lose my home?â&#x20AC;? However, in todayâ&#x20AC;&#x2122;s economy, where few people actually have much equity, the answer is NO! The bankruptcy trustee will first determine whether your home has equity, and how much. This involves determining the current market value of the home, and subtracting the pay off amount, cost of sale, and any liens. If the equity is below specific homestead exemptions, you keep your home provided of course, you stay current on your monthly mortgage payments. The general rule of thumb is that if you continue to make your payments on time, the lender prefers that you stay in your house. Mortgage lenders, contrary to popular belief, are not anxious to foreclose on a property. It means a loss to them, as they will have to spend money holding the property and preparing it for resale. Bankruptcy is also helpful if you are seriously behind on mortgage payments. IT will stop a foreclosure in its tracks, and through a Chapter 13 bankruptcy, provide you with a plan to amortize mortgage arrearages over a 5 year period. In bankruptcy, there are exemptions, which render certain property outside the reach of bankruptcy. State law provides that the debtor be allowed to keep personal property up to a certain amount, for instance. If the debtor avails himself or herself of an exemption, that property cannot be used by the bankruptcy court to pay creditors. Specific exemptions are provided through both federal and state law that enable most people to keep their home, since these exemptions usually exceed the homeâ&#x20AC;&#x2122;s equity in todayâ&#x20AC;&#x2122;s real estate market. Chapter 7 & 13 There are several types of bankruptcy, each with different sets of rules and criteria. The most common two types of bankruptcy are Chapter 7 or Chapter 13. Two other types, Chapter 11 and Chapter 12, are lesser
known and not used as often. Chapter 11 is used by business owners, and Chapter 12 is for family farmers. Single or married individuals typically use both Chapter 7 & 13. In a Chapter 7, debts are discharged. In a Chapter 13, the debts are reorganized and paid back to the extent that the party is able. What Should I Do? If you are a home owner, filing for a Chapter 7, the first thing to do is find out whether your home has equity. If there is equity, you and your bankruptcy attorney can determine if you qualify for an exemption. Typically, in California, the homestead exemption for a married couple is $75,000.00, with higher limits for seniors. Keeping your home pursuant to an exemption is conditioned on the understanding that you will continue to make your mortgage payments. However, if you still have significant equity, and the exemption is not enough to protect all of the equity in your home; you could still use a Chapter 13 debt reorganization with some partial payments and still protect your home. Duterte eyes more access roads to tourist sites By Azer N. Parrocha
MANILA, July 25 (PNA) â&#x20AC;&#x201C; To make travel to tourism sites easier, President Rodrigo Duterte during his first State of the Nation Address (SONA) on Monday said that he wants more access roads to tourism sites constructed. â&#x20AC;&#x153;We shall construct more access roads and tourism gateways to service centers and tourist sites,â&#x20AC;? Duterte addressed audiences at the Batasang Pambansa. The President said that road development projects should also be able to complement with the government thrust to provide modern agriculture infrastructural which could also be useful to eco-tourism. Tourism Undersecretary for Media Affairs Kat De Castro earlier said that she expected the president to mention the departmentâ&#x20AC;&#x2122;s recent move to remove processing fee in certificate of exemption or entitlement to reduced travel tax rates. The department, through its attached agency, Tourism Infrastructure and Enterprise Zone Authority (TIEZA) last week announced that the PHP200 processing fee imposed on travelers for the travel tax exemption will no longer be paid by travelers starting Monday. Department of Tourism (DOT) Secretary Wanda Corazon Teo, chairman of the TIEZA Board, said that this will be removed since the department believed that the processing fee is â&#x20AC;&#x153;an additional burdenâ&#x20AC;? to travelers. It is also expected to minimize long lines at the TIEZA and travel counters at the airport.

Duterte pushes for France-type of federal system of government

MANILA, July 26 (PNA) – President Rodrigo Duterte has urged Congress to push for a federal system of government similar to France which follows a federal-presidential model. ”You know my advice to you is maintain a federal system, a parliament, but be sure to have a president. Yasay denies China claim of victory in Asean meeting MANILA, July 27 (Mabuhay) – Foreign Affairs Secretary Perfecto Yasay on Wednesday denied that China “won” when the Philippines reportedly dropped a request to mention, in an Association of Southeast Asian Nations (Asean) statement, the historic arbitral tribunal ruling on the disputed South China Sea. “I am saying this to dispel the reports in being said that China came out victorious…precisely because we did not agree to mention the arbitral award,” Yasay said during a press conference at the Department of Foreign Affairs. “The arbitral award is an issue between China and the Philippines. MANILA, July 23 (Mabuhay) – President Rodrigo Duterte urged the Senate to study the impact of ratifying the Paris agreement on climate change, particularly on the country’s economy that remains reliant on fossil fuels for energy needs. “Mag-decide ang Senate. Bigyan n’yo ako ng clear view anong mangyari kasi may plano ako maglagay ng industrial zones everywhere,” Duterte said in his speech on Friday during an inspection of a biomass power plant project in Buluan town in Maguindanao. The President did not say though if he would submit the Paris Agreement on Climate Change for ratification by the Senate. Duterte’s remarks came after environmental groups and Senator Leila De Lima urged him to reconsider his stance against the agreement, which he said might limit the country’s industrial growth. The President noted the problem on climate change should be blamed on rich nations deemed to be the world’s biggest carbon emitters. The Philippines is among the least emitters of greenhouse gases that cause global warming, yet it is directly hit by the effects of climate change such as droughts and strong typhoons. As part of efforts to curtail the effects of climate change, the Philippines joined nearly 200 countries in a landmark deal in Paris in December last year to cut greenhouse gas emissions to limit the rise in global temperatures to below 2 degrees Celsius.(MNS)

Number of street crimes down in Metro Manila By Christopher Lloyd T. Caliwan
MANILA, July 24 (PNA) – The number of street crimes in Metro Manila has significantly decreased from July 1-19 compared on the first semester of 2016 due to the relentless implementation of ‘Oplan Tokhang’ and ‘Double Barrel’, according to National Capital Region Police Office (NCRPO) Acting Regional Director, Chief Supt. Oscar Albayalde. The Double Barrel strategy, an all-out anti-illegal drugs operational plan is defined as a simultaneous attack on big-time drug lords and street-level pushing, according to PNP Chief Director General Ronald ‘Bato’ Dela Rosa. Under ‘Oplan Tokhang’, station commanders will ask the barangay captains to submit a list of residents who are into illegal drugs, whether these pushers, dealers, users and
couriers. The police intelligence unit will then verify the report and check if these persons are indeed involved in drugs. This is because there are instances where barangay captains themselves are behind the illegal drug trade while some list down names of their rivals. “We are seeing a remarkable reduction of street crimes particularly crimes against property region wide,” he said in 21 days in office. The weekly crime trend data from July 1- 19, 2016 reflected the significant decrease of street crimes compared with the data recorded on the first semester of 2016. Robbery lowered from 85 to 59 incidents, Theft from 176 to 113 cases, Carnapping from 8 to 0, Motornapping from 29 to 10 cases and Physical injuries from 97 to 72 cases.

MANILA, July 25 (PNA) – President Rodrigo R. Duterte, in his first State-of-the-Nation Address (SONA) on Monday, announced that a relaxation of the country’s bank secrecy law is forthcoming. This is part of the current administration’s macroeconomic policies, eyed to encourage more investments, both from local and foreign businessmen, and improve the lives of more Filipinos. Amendments to the country’s bank secrecy law have been proposed in the past and received stronger bids in early 2016 after a major domestic bank was used in the laundering of about USD 81 million stolen from the Bangladesh Bank last February.
After the international bank heist, monetary and finance officials stressed the need for amendments to the Anti-Money Laundering Act of 2001( AMLA), otherwise known as Republic Act No. 9160, particularly on the inclusion of casinos as among the law’s covered institutions. MANILA, July 25 (PNA) – Since global warming is among the top priorities of his administration, President Rodrigo Roa Duterte has directed Environment and Natural Resources Secretary Regina Paz Lopez to review all permits granted to mining, logging and other environment-sensitive activities. “Go ahead. Amend, suspend or revoke environmental permits if warranted,” the President told Lopez during his first State of Nation Address (SONA) Monday. President Duterte stressed the agency’s need to ensure industry compliance with government standards. Likewise, he warned the industries affecting the environment to comply
with these standards. “Addressing global warming shall and will be our top priority, but upon a fair and equitable equation. It must not stymied our industrialization,” he noted. The President has also instructed the military to intensify its support role in anti-illegal logging and anti-illegal mining activities, as well as other destructive practices aggravating the devastation of natural resources. And as part of the government’s environment protection initiatives, President Duterte said Laguna Lake “shall be transformed into a vibrant economy, a zone showcasing ecotourism by addressing the negative impact of watershed disruption, land conversion and pollution.”

LOS BAÑOS, Laguna July 27 (PNA) – A new breed of the country’s home-grown duck called “Itik Pinas” has been developed through science, research and technology innovations that could produce 50 more eggs per duck than the traditional Pateros duck breeder. The Philippine Council for Agriculture, Aquatic and Natural Resources Research and Development of the Department of Science and Technology (DOST-PCAARRD) in partnership with the National Swine and Poultry Research and Development Center-Bureau of Animal Industry (NSPRDC-BAI) has developed the new breed which could boost the country’s “balut” industry. DOST-PCAARRD will launch “Itik Pinas” during its fifth anniversary
slated on Thursday (July 28) as one of the highlights,along with the Council’s leading R&D initiatives in the agriculture, aquatic, and natural resources (AANR) sectors, during the National Science and Technology Week (NSTW) from July 25 to 29 at the Council’s complex here. This year’s NSTW adopts the theme “Juan Science, One Nation.” The DOST-PCAARRD said “Itik Pinas” is a genetically superior breeder duck which has a higher average productive period of 70 percent per year compared with the 55 percent for the old breed. Duterte to DSWD: Give rice subsidies to poorest families MANILA, July 25 (PNA) – Poorest families in the country will soon have monthly rice subsidies. “I have decided to direct the Department of Social Welfare and Development (DSWD) to provide rice subsidies to poor families every month para makakain sila (on regular basis),” President Rodrigo R. Duterte said in his maiden State-of-the-Nation Address during a joint session of the Senate and the House of Representatives in Quezon City on Monday afternoon. President Duterte said that while their long-term intention is to eventually enable the poor families benefiting from the Pantawid Pamilyang Pilipino Program (4Ps) to attain self-sufficiency level, he knows that there is a need to connect the said poor to different forms of assistance that will empower and sustain them once they attain the level of self-sufficiency or be identified to be graduates from the program. The poor families identified under the “Listahanan” (Talaan ng Listahan ng Mahihirap na Pamilya), formerly called National Household Targetting System for Poverty Reduction (NHTS-PR), are receiving assistance from the government through the 4Ps being implemented by DSWD. The assistance is in the form of monthly cash grants as an investment on the health and education of poor children. The cash grant is PHP500 for every household beneficiary plus educational assistance of PHP300 (elementary) or PHP500 (high school) each for a maximum of three children. The ultimate goal of 4Ps is to allow the children to graduate or finish high school so that they can be the ones who will help their families to pass the bridge of poverty.

MANILA, July 25 (PNA) – President Rodrigo Duterte announced the strengthening of the Reserved Officer Training Corps (ROTC) in his first State of the Nation Address (SONA) on Monday. The President said the program can help a lot in instilling love of country among Filipinos. “The reservists will be mobilized for information campaign against drug use and the dissemination of information regarding drug rehabilitation programs being offered by the government,” President Duterte noted.
The President also added that they will create an inter-agency committee which will integrate efforts and foster partnership of all stakeholders in order to win the fight against illegal drugs. He also said that they will prioritize the rehabilitation of drug users. “We will increase the number of residential treatments and rehabilitation facilities in all regions of the country. In doing so, he added that Armed Forces of the Philippines (AFP) will also be involved through the use of military camps and facilities that can be converted for drug rehabilitation.

MANILA, July 28 (PNA) – As part of its intensified anti-drug campaign, the Philippine National Police (PNP) on Thursday said it will look into affluent people and celebrities involved in illegal drugs. Southern Police District (SPD) Acting Director Sr. Supt. Tomas Apolinario said from the PNP’s anti-drug operations also aims to curb the prevalence of party drugs such as ‘ecstasy’. He recalled the five fatalities at the Closeup Forever Summer concert in Pasay City last May 21 who used methylenedioxymethamphetamine (MDMA) and alcohol. MDMA, commonly known as ecstasy, is a psychoactive drug used pri-
marily as a recreational drug. Desired effects of MDMA include increased empathy, pleasure, and heightened sensations. With the incident, Apolinario said party and concert organizers are now coordinating with the police to ensure that their events will not be used as a venue for illegal drug trade as these are usually attended by wealthy youth and celebrities. Despite the deployment of civilian-clothed and uniformed policemen during concerts or parties, Apolinario admitted that is difficult to track down people who used drugs before going to an event. As a precautionary measure, Apolinario said that they will deploy drug-testing kits in the entrance of the
event to test the suspicious actions of an individual. Meanwhile, Apolinario has ordered two police officers who initially tested positive for illegal drugs and later failed a confirmatory drug test to explain their side on the matter within 15 days. Apolinario did not identify the two police officers but said they were detailed in Makati and Pateros, respectively. Earlier, PNP Chief Police Director General Ronald ‘Bato’ M. Dela Rosa said the drug test aims to show transparency in the organization and ensure the public that high-ranking PNP officials are capable of being role models in leading the fight against illegal drugs.

Filipino math wizards place 2nd overall in Thailand
MANILA, July 27 (PNA) – The Philippines bagged 240 medals to wind up second overall in the final standings in an international math contest in Bangkok, Thailand. Filipino elementary and high school students took home 34 gold, 74 silver and 132 bronze medals, and 87 merit awards in the 2016 Inter-
national Mathematics Wizard Challenge (IMWiC) to grab second place behind China in the contest that was participated in by nine nations and territories. “Our delegates showed a very good performance in the contest and we are very happy,” said Dr. Archieval Rodriguez, president of the Mathe-
matics Development Academy of the Philippines (MathDAP), adding that there were 350 Filipino math wizards who joined the the contest. Besides the Philippines and China, other participating countries and territories were Thailand, India, Indonesia, Malaysia, Hong Kong, Macau and Vietnam.

PNP mulls reality TV show to highlight anti-drug, crime drive MANILA, July 24 (PNA) – In line with efforts to bring Philippine National Police (PNP) closer to the public, a ranking police official is mulling the possibility of creating a reality television program about law enforcers. PNP Community Relations Group (PCRG) Director Police Sr. Supt. Gilbert Cruz said the show will cater the PNP programs, campaigns and even operation to give the public ideas on what is happening inside the organization which will be broadcast through the country’s state television network. Cruz said the theme of the show will be like reality TV where police operations against crime and illegal drugs will be shown. He added that the PNP is now in the process of completing the plan to be able to show to the public that the PNP is serious in fulfilling its mandate to serve and protect the people. He said the show will be pattern to COP, an American TV program that shows how policemen arrest criminals. In the said TV show, Cruz said they will use the 600 CCTV placed in strategic areas in Metro Manila to get the actual scene of the crime. Breaking the glass ceiling is every working woman’s dream The unprecedented Democratic Party nomination of former Secretary of the State Hillary Rodham Clinton for President of the United States, truly defines every working woman’s dream of breaking the glass ceiling. And during her nomination acceptance speech on Thursday, July 27, 2016, she validated the fact that if “there are no ceilings, opportunities are limitless.” This author has particularly drawn a parallel connection with her and her family. Her mother, Dorothy Emma Howell used to live in the San Gabriel Valley area, City of Alhambra, where she graduated High School in 1937. She moved back to Illinois where she was born and lived in Park Ridge, Illinois. Similarly, this author now live in the same neighborhood she once lived and went to school in Evanston, Illinois, which was the city next to Park Ridge. Likewise, Dorothy’s daughter, Hillary Rodham was born on October 28, 1947 at Edgewater Hospital in Chicago, Illinois near Weiss Memorial Hospital where this author’s first-born son was also born. Hillary’s school activism in the Chicago, Illinois neighborhood where she was raised gave her the opportunity to meet Martin Luther King, during his civil rights speech at Chicago’s Orchestra Hall in 1962. Hillary Rodham then enrolled at Wellesley College, where she majored in Political Science and on her freshman year, she served as President of the Wellesley Young Republicans. She later on stepped down from her position and changed her views after meeting Dr. King. Her political views changed subsequently and she described herself as “a mind
conservative and a heart liberal.” She graduated with a J.D.from Wellesley College in 1969 and she went on and graduated with a law degree from the Yale School of Law in 1973, where she met Bill Clinton and the rest of her political career we now know from her husband’s speech during recent Democratic convention, where she broke the glass ceiling being the unprecedented first woman nominated as the official candidate of the Democratic Party to the highest office of the land, as President of the United States. From historical accounts, as we all know in Israel, a woman named Golda Meir was elected.Prime Minister on March 17, 1969. She was the first woman elected after serving as Minister of Labour and Foreign Minister. She was known as the “Iron Lady” of Israeli politics and dubbed as the “ strong-willed, straight-talking, greybunned grandmother of the Jewish people..” She was elected three times but resigned before her tenure as Prime Minister ended in 1974. The term “Iron Lady,” was similarly applied to Margaret Gilda Thatcher, who was a British stateswoman and politician and elected as the “first woman Prime Minister of the United Kingdom from 1979 through 1990. She was the leader of the Conservative Party from 1975 to 1990 and she was the longest-serving British Prime Minister of the 20th century and the first woman to have
held the office. After she retired in 1990, she was given a life peerage as Baroness Thatcher , of Kesteven in the county of Lincolnshire , which entitled her to sit In the House of Lords.” She withdrew from public speaking after a series of ailments in 2002 and passed away at the age of 87 in 2013. Caregivers are presumptively disqualifiedto be named as beneficiary in a patient’s will or trust with ‘certain exceptions’ Caregivers are presumptively disqualified from being named as beneficiary of a patient’s Will or Trust. Probate Code Section 21350, subdivision (a) provides: “Except as provided in Section 21351, no provision, or provisions, of any instrument shall be valid to make any donative transfer to any of the following: …… (6) A care custodian of a dependent adult who is the transferor.” A “disqualified person” under the statute “means a person specified in subdivision (a) of Section 21350, but only in cases where Section 21351 does not apply.” (§ 21350.5.) Other presumptively disqualified donees under section 21350(a), include: the drafter of the instrument; the drafter’s relative, domestic partner, cohabitant, or employee; the drafter’s law partner or shareholder; an employee of the law partnership or corporation in which the drafter has an interest; one having a fiduciary relationship with the donor (including a conservator or trustee), who transcribes or causes the instrument to be transcribed; such fiduciary’s relative, employee, domestic partner, or cohabitant; and a relative of, domestic partner of, employee of, or a cohabitant with, a care custodian of the donor who is a dependent adult. (§ 21350(a).) The statute defines the terms “dependent adult” and “care custodian” as follows: “For purposes of this section, the term ‘dependent adult’ has the meaning as set forth in Section 15610.23 of the Welfare and Institutions Code and also includes those persons who (1) are older than age 64 and (2) would be dependent
adults, within the meaning of Section 15610.23, if they were between the ages of 18 and 64. The term ‘care custodian’ has the meaning as set forth in Section 15610.17 of the Welfare and Institutions Code.” (§ 21350, subd. ©.) “ ‘Instrument’ is broadly defined in Probate Code section 45 as ‘a will, trust, deed, or other writing that designates a beneficiary or makes a donative transfer of property.’ ” (Rice v. Clark (2002) 28 Cal.4th 89, 97, fn. 4, 120 Cal.Rptr.2d 522, 47 P.3d 300.) However, there is an exception to the presumptive disqualification of care custodian as beneficiary in a Will or a Trust. The presumption of invalidity of donative transfers to specified individuals under section 21350(a)-including transfers to care custodians of dependent adults-does not apply, , where “[t]he instrument is reviewed by an independent attorney who (1) counsels the client (transferor) about the nature and consequences of the intended transfer, (2) attempts to determine if the intended consequence is the result of fraud, menace, duress, or undue influence, and (3) signs and delivers to the transferor an original certificate ... with a copy delivered to the drafter.” (§ 21351(b).) This “Certificate of Independent Review” must state that the attorney: reviewed the instrument; counseled the client/ transferor concerning the nature and
consequences of the subject transfer of property to the presumptively disqualified person under section 21350; was disassociated from any interest in the transferee; and concluded that the transfer to the presumptively disqualified person was valid because it was “not the product of fraud, menace, duress, or undue influence.” (§ 21351(b).) The intent of section 21350 was “to prevent unscrupulous persons in fiduciary relationships from obtaining gifts from elderly persons through undue influence or other overbearing behavior. [Citation.]” Bank of America v. Angel View Crippled Children’s Foundation (1999) 72 Cal.App.4th 451, 456, 85 Cal.Rptr.2d 117. In 1997, the Legislature amended section 21350(a) to include care custodians of dependent adults as presumptively disqualified donees. (See Stats.1997, ch. 724, § 33; Conservatorship of Davidson (2003) 113 Cal.App.4th 1035, 1051 [6 Cal.Rptr.3d 702] [1997 amendment to section 21350 “was intended to apply to gifts made ‘to practical nurses or other caregivers hired to provide in-home care. If an elderly patient intends to create a Will or a living trust naming a caregiver as one of the beneficiaries, it is important for the elderly donor to retain an attorney that can advise the elderly of the proper procedure for drafting the Will and the Trust and avoiding having the gift to the beneficiary caregiver held invalid by the court after the donor’s death. When an unpaid credit card debt turns into a lawsuit Have your credit card debts become so large that you can’t even afford the minimum payments? Or perhaps you’re already behind and your accounts have been turned over to collections? What do you do to get out of this financial mess? If you are in this situation, maybe you’ve wondered about what the legal repercussions might be once you get to the point where you can no longer continue paying your creditors. Can credit card companies sue you for what you owe? And when they do, what happens when they get a judgment against you? These are the questions I’m often asked by people who seek legal advice regarding their debts. Of course, credit card companies don’t make it easy for you to catch up once you fall behind. They are quick to add on additional fees and demand that you bring your account up to date immediately by paying the current amount due, all past due payments as well as late fees. And if allowed by the agreement that you signed when you first applied for the credit card, your interest rate can also go skyhigh upon default. Before you know it, your debt problems have become a financial nightmare and your phone starts ringing off the hook with bill collectors harassing you at home and at work. What do you do at this point? If your credit card debts have escalated beyond your control, perhaps you are getting nervous about what your creditors will do next. Can you be sued? Yes, you can be sued once your creditors are convinced that they have exhausted all other options to force you to pay. Of course, the benefit to be gained by suing you must outweigh the costs so the creditor will take that into consideration as well. But most delinquent accounts
are turned over to collection agencies in high volumes which significantly reduce the creditors’ litigation costs. Smaller companies like credit unions will also sometimes sue you in small claims court and they don’t even need an attorney to file the lawsuit. I often see people who ignore their debts for a long time until one day they receive a summons at home or at work and only then do they realize the seriousness and urgency of their situation. If you are sued by a creditor, it is very important that you do not ignore the lawsuit or you will definitely regret the consequences once the creditor takes the next step of garnishing your wages, seizing funds out of your bank account, filing a lien against your real property or a combination of the above. If filing bankruptcy is your best and only option, it is best to seek legal help right away before your debt problems get worse. Spare yourself the suffering and the agony caused by debt if at all possible. In choosing a bankruptcy lawyer, remember that not all bankruptcy lawyers are created equal and may have different ideas on how to help you. It is important to choose a knowledgeable and experienced attorney who has your best interests at heart. Most debt problems are solvable but often they get worse if ignored. Labor chief tells companies: ‘Endo’ not good for business MANILA, July 27 (Mabuhay) – Labor Secretary Silvestre Bello III has belied claims that employees will lose jobs if “endo” is stopped, saying regularization of employees should not cause a drop in hiring. He said it’s a “very wrong notion on the part of management” that once the employees are regularized, they will become unruly and may join unions, or be more costly as the company will have to pay for more benefits. “They should look at an employee as a partner in the business – that the more an employee is motivated, the more he performs well; and when the employees perform well, the business will definitely improve,” he said. This comes as Bello assured companies they have no reason to fear government’s memorandum that mandates the investigation on companies that practice ‘endo.’ Bello said labor inspectors will only be checking the employment records of the companies to check if they re-hire or fire employees before six months are over. “Gusto naming masiguro na ito ay mga regular employees na kasi kadalasan, may mga employees who are hired only for a period of five months, after which nawawala na sila, then they’re re-hired,” he said. The records will then be validated by speaking with the employees and asking about their length of stay in the company. “Pag sinabi nila na, let’s say, they say ‘I have been here for about one year, pero putol-putol,’ that’s an example of endo system,” he said. Under ‘endo’ practice, contractual work lasts only five months without security of tenure, monetary, non-monetary, and social protection benefits. Food chains and malls, said Bello, practice ‘endo’ the most. Bello said the Department of Labor and Employment will talk with the employers found to be practicing ‘endo’ to push for the employees’ regularization. “After all, you need them; you have trained them for five months, and another five months, so they’re already good in the business. Why don’t you hire them regularly?,” he said. While they do not want to go to the extent of penalizing companies that practice ‘endo,’ Bello said they will be ready to impose sanctions on those that refuse to comply. (MNS)

Clients choose Chapter 13 to avoid risk of losing house to Chapter 7 trustee on steriods The first case involves clients who are still young. By young, I mean less than fifty, late forties. They have teenage children, one son, and two daughters. Their household income is about $75K a year. Husband used to work two jobs as a technician, while wife used to own a retail business, now defunct. She still makes some money but hardly enough to pay for her $68K of credit card debt. She racked up this debt when she used these cards to support a failing business, just to keep the business afloat for two more years. Husband owes only $20K of credit cards. Together, clients owe about $90K of credit cards. Minimum monthly payments are almost $3k a month. Needless to say, wifeâ&#x20AC;&#x2122;s cards are now all past due, while husbandâ&#x20AC;&#x2122;s cards are still current, as a last ditch effort to hold the fort, the same thing that Gen. Custer did. Thinking he could protect the fort, the Indians won and Custer died. Three Indian tribes, the Lakota, Cheyenne and Arapaho decimated the 7th cavalry of Gen. Custer, which had 700 men. Custer and his two brothers died in the battle of â&#x20AC;&#x2DC;Little Big Hornâ&#x20AC;? in 1876. So, Iâ&#x20AC;&#x2122;m not so sure if itâ&#x20AC;&#x2122;s a good idea to take a last stand to try to pay $90K of credit card debt when clientsâ&#x20AC;&#x2122; household income, although decent at $75K a year, because there is no way mathematically for clientsâ&#x20AC;&#x2122; to pay $90K of credit card debt with minimum payments. These cards will never get paid in clientsâ&#x20AC;&#x2122; lifetime, unless they win the power ball lottery. Dream on. The chance of winning power ball is 1 in 292 million. You have a better chance of getting hit by lightning, twice, than winning power ball. After a little probing, I determine that clients want a Chapter 7 to wipe out all of the $90K credit cards. The problem is that their residence has about $130K of equity. It has a current fair market value of $450K and they owe about $320K on it. It this was four years ago, they could easily sail through a Chapter 7 without the risk of losing their house to an aggressive Chapter 7 trustee. Of course, their homestead exemption is $100K plus about $25K for cost of sale of the house, so there is no viable equity for the trustee to take, so there is minimal risk to the house. But there is a five percent chance that the trustee that gets assigned to clientsâ&#x20AC;&#x2122; case is the
most aggressive Chapter 7 trustee when it comes to non exempt assets, particularly houses. If this misfortune should befall clients, this is just the worst thing that can happen to a Chapter 7 debtor with â&#x20AC;&#x153;borderlineâ&#x20AC;? exempt equity in the house, having to deal with a Chapter 7 trustee on steroids who is hell bent on selling your house for $1 of non-exempt equity. And even though debtors have the right to convert to Chapter 13 anytime, to escape the clutches of a Chapter 7 trustee who wants to sell their house, the right to convert is not absolute. This trustee will certainly oppose the conversion to Chapter 13. His trustee and legal fees to fight the conversion to Chapter 13 can easily reach $25K, and all of that $25K must be paid in full the Chapter 13 as priority Chapter 7 administrative fees. So even the trustee loses on the opposition, he still wins, because he still gets paid $25K in the Chapter 13 case. It doesnâ&#x20AC;&#x2122;t pass the smell test for fairness, but in reality, thatâ&#x20AC;&#x2122;s the way it works. I have one case now and we are fighting to keep debtorâ&#x20AC;&#x2122;s house in Chapter 7 (no conversion to Chapter 13) because debtor owes more than $1.0M of unsecured debt. We are fighting the trustee in an adversary case because this house doesnâ&#x20AC;&#x2122;t even have non-exempt equity but the trustee is making it appear that debtor lied under oath and now asks for denial of discharge to debtor. I just canâ&#x20AC;&#x2122;t believe what is going on in this case. But we are fighting it 100%, and in this case, we are the Indians. To avoid this kind of scenario altogether, it is safer for clients to choose Chapter 13. In Chapter 13, they can pay a small amount, maybe $300 a month for sixty months. After having paid $18,000 in sixty months with no interest, the difference between $90K and $18K, $72K will be discharged with the last payment on the 60th payment. This means that clients will pay 20% of their $90K credit cards over 5 years with no interest, the court will discharge 80% of $72K on the 60th
payment. In Chapter 13, there is no risk of clientsâ&#x20AC;&#x2122; losing their house to the trustee because Chapter 13 trustees do not have the power to sell houses. On the other hand, Chapter 7 trustees have the power to sell your house if there is viable non-exempt equity. To avoid the hassle of dealing with an over aggressive Chapter 7 trustee and risk losing their house, clients chose to file Chapter 13 and pay 20% of their credit card debt. And may I add, this is the right choice because there is no risk to the house which they want to keep, and $300 plan payment is certainly a lot less than $3K a month for minimum payments that never end, with a bright light at the end of the 60th payment when $72K is discharged by the court! In 5 years, clients will owe zero unsecured debt, and they will still have their house, which may then have $200K of equity if Hillary Clinton becomes president. Iâ&#x20AC;&#x2122;m with her. We are stronger together. Second client is a young senior. She is only 55. Divorced ten years ago. Now lives by herself. She used to be a happy camper with a $40K yearly salary. But she lost that job last year. She is stuck with $22K of credit card debt. She pays $900 a month for these cards to keep them current. But her savings are quickly diminishing. When itâ&#x20AC;&#x2122;s a choice between paying $900 of rent
which lets her have a roof over her head for a month, or $900 to mastercard and visa, given the fact that she now has no income, itâ&#x20AC;&#x2122;s really a no brainer. The $22K of credit cards has to be discharged. She chooses Chapter 7 to achieve this goal. Her credit score will go up pretty fast since she still pays for a car. In two years her credit score will be about 620. Within a couple of months of getting her discharge, she will get new credit cards mailed to her. Some credit cards specialize in giving credit to people who have come out of Chapter 7. Chapter 7 is the best choice for client. â&#x20AC;&#x153;Give unto the Lord the glory due to his name; worship the Lord in the beauty of holiness.â&#x20AC;? Duterte’s SONA first in history without violence
MANILA, July 26 (Mabuhay) – The National Capital Region Police Office (NCRPO) on Tuesday morning said President Rodrigo Duterte’s first State of the Nation Address (SONA) was the first in history without violence. “The SONA was peaceful. No violent incident bet the police and rallysts. Traffic was handled well,” NCRPO director Chief Superintentend Oscar Albayalde said. “First time in the history and without violence!” he added. Albayalde also noted that the “rallyists were very happy” with the Duterte administration’s decision to allow them to hold their program near the Batasan Pambansa Complex. Armed Forces spokesperson Brig. Gen. Restituto Padilla also declared that Duterte’s SONA was “generally peaceful.” Padilla also cited the activist group’s cooperation with the authorities. Before the SONA, PNP chief Director General Ronald “Bato” dela Rosa went to the crowd of activists and met with Bagong Alyansang Makabayan secretary-general Renato Reyes Jr. Reyes and Lumad leaders met with Duterte after the SONA. Among the highlights of Duterte’s first SONA was his declaration of a unilateral ceasefire with the Communist Party of the Philippines-New People’s Army-National Democratic Front. He also said that administration’s campaign against drugs will continue despite criticisms against the killings of several drug suspects. (MNS)

MANILA, July 25 (PNA) – Recalling how he barely had any supporters from the Congress during the recent presidential campaign period, President Rodrigo Duterte during his first State of the Nation Address (SONA) on Monday assured them that he would not aim for ‘much ambition.’ ”Do not worry about me. I don’t aim that much ambition,” Duterte said addressing the Congress at the Batasan Pambansa Complex at the House of Representatives. The President made this statement after reiterating again his desire to maintain a federal form of government, which he said he was aware would probably take effect after his term. “Hindi ko nga alam bakit nandito ako ngayon. Noon nandoon lang ako. (I don’t even know why I’m even here, I used to be there),” Duterte quipped eliciting both laughter and applause. Duterte made several striking statements, starting with the importance of “moving forward” and not allowing the past to pull progress back. “Finger-pointing is not the way. That is why I will not waste precious time dwelling on the sins of the past or blaming those who are perceived to be responsible for the mess that we are in and suffering from,” he said. The President, however, assured that government officials who may have “betrayed the people’s trust” will “not go unpunished” and will “have their day in court.”

NPC lauds President Duterte’s signing of EO on Freedom of Information
MANILA, July 24 (PNA) – The National Press Club of the Philippines (NPC) today joins the Filipino people in commending Pres. Rodrigo Duterte for signing the executive order on freedom of information (FOI). While limited to the Executive Branch, still, this is one concrete step towards the promotion of transparency in all levels of government. This new law can go a long way in empowering our people to make the right decisions in the future which was previously hampered by the culture of ignorance of government transactions and decisions perpetrated by past administrations. By this act, Pres. Duterte has accomplished, in less than 30 days as Chief Executive what previous administrations have promised—but deliberately failed to deliver—since the restoration of our democracy in 1986. By this decision, Pres. Duterte is also sending a strong message to the other branches of government, Congress and the Judiciary in particular, that it only takes political will and sincere commitment to the tenets of democratic rule, anchored on openness and transparency, to accomplish this fact. It is now time for Congress and the Judiciary to follow the lead of Pres. Duterte — without recourse their own bureaucratic methods in addressing the call for transparency by our people in their respective spheres. Change, indeed, is the order of the day. Heartened by this development, the NPC is now more brimming with confidence that also true to Pres. Duterte’s previous pronouncement, the problem of media killings and giving justice to our murdered colleagues, would be his administration’s next surprise gift to our people. Senators commended on Sunday President Rodrigo Duterte for signing a landmark Executive Order on Freedom of Information for the executive branch of the government. ”Let me say in the first place that we thank the President for starting this at least in the executive branch. This is already indeed a milestone,” Senator Grace Poe said in a cable ANC television interview. Poe, a presidential candidate in the last May 9 election, vowed to push for an actual FOI law that will cover all branches of government, including legislative.
”There are a lot of things that we need to continue with regard to the FOI in other branches of government but we wait with much anticipate that full implementation in the executive branch,” Poe said. As chairperson of the Senate committee on mass media and information, Poe co-authored and sponsored the FOI bill that was passed by the Senate in the 16th Congress. The FOI bill, however, did not reach Malacanang after the House of Representatives failed to pass its own version, marking the three decades of failed effort of the legislative branch to pass FOI law. Senator Paolo Benigno ‘Bam’ Aquino IV said the FOI in the executive branche would be a welcome development in the fight for transparency and good governance. ”We believe wholeheartedly that this Executive Order will aid in the fight against corruption,” Aquino said. ”A number of us supported the FOI in the previous Congress, but it did not come to fruition. This is a bold step in the right direction, and hopefully, the legislature can follow the President’s lead and institutionalize this into a law as well,” he added. Senator Francis ‘Koko’ Pangilinan described the EO as landmark but agreed with Poe that there is still a need for FOI legislation “so that we can ensure transparency at all levels of the bureaucracy.” ”We commend President Duterte on his commitment to uphold the constitutional right of our people to information through his Executive Order. It is a first step on our vision of a more transparent government,” Pangilinan said. Senator Ralph Recto said the FOI order signed by President Duterte should cut red tape in public offices and lead to “shorter periods and simpler processes” in accessing government services. “There’s one important benchmark by which this FOI order should be measured, on how fast government permits can be secured,” Recto said. “Clear, concise, cheaper way of getting government documents like passports and licenses,” Recto added. Recto recalled that the FOI bill passed by the Senate in the past Congress clearly mandated offices “to describe frontline services they deliver and the procedure and length of time by which they may be availed of.”
Etta Rosales: ‘Let Marcos rest in peace’ MANILA, July 23 (Mabuhay) – Former Commission on Human Rights (CHR) Chairperson Etta Rosales believes it is now time for the late dictator Ferdinand Marcos to be buried – only not at the Libingan ng mga Bayani. Speaking to reporters on Saturday, Rosales said Marcos, who died in exile in the United States in 1989, should already be laid to rest in his hometown Ilocos Norte. Marcos’ body remains in a glass coffin in a mausoleum. Rosales, herself a martial law victim, called on President Rodrigo Duterte not to allow Marcos’ burial in the heroes’ cemetery. “Sa Ilocos Norte, dun na lang kaya sa Batac, ako, sumasang-ayon din ako dun,” said Rosales. “Isipin din natin. Alam niyo, si Marcos patay na siya, matagal na siyang namatay. Sana igalang na natin ang katawan ni Marcos. Let him rest in peace. Huwag natin siyang gamitin bilang parang propaganda na pang-kuwan di ba? Hindi maganda yun,” she added. “Patay na siya. Igalang natin siya. Pero ilibing natin siya sa Batac sa Ilocos Norte

Duterte earlier said he will allow the burial of Marcos at the Libingan ng mga Bayani “not because he is a hero...but because he was a Filipino soldier.” “Yang issue na yan has long created a division amongst our people. Breaking traditions, Richard Yap fought to marry a Filipina After six years, “Mano Po” is back. Actor Richard Yap will top-bill the seventh installment of the film franchise, which aims to return to its roots as a dramatic alternative to an industry currently ruled by romantic-comedies. “I am very proud and very honored na na-consider ako dito sa project kasi very successful iyong mga ‘Mano Po’ dati. I really want to give this role justice for the franchise,” said Yap. The 49-year-old Yap, who shot to fame after his role as a wealthy Filipino-Chinese businessman opposite Jodi Sta. Maria in “Be Careful With My Heart,” added that he wants the movie to become a way for locals to better understand Chinese-Filipinos. “We’re not here to take away their jobs. We are here because we are Filipinos at heart and we want to help the Philippines also,” he explained.
Yap, as well as producer Regal Entertainment, has refused to divulge other details about the film. However, it was revealed that the film is intended to be part of this year’s Metro Manila Film Festival, and that parts of the film will be shot in China. The film will also star teen actress Janella Salvador. Meanwhile, Yap also opened up about his past fallout with his parents, whom he described as “very traditional and strict” when it came to him choosing a partner, saying that his experiences with his family and relatives will help him prepare for his starring role. “My dad wanted me to marry someone that he chose,” he shared. “Kaya lang matigas talaga ulo ko, hindi ako sumunod. Kaya hindi talaga ako ang naging favorite niya.” “But I think you really have to

Larry Zabala, diplomat, journo, writes 30 Los Angeles – Laurencio “Larry” De Venecia Zabala, Jr., 85, passed away Thursday, 21 July 2016, at 1pm in the Intensive Care Unit of the Los Angeles Community Hospital. During the 1960s, Zabala reported and wrote for the Philippine nation’s leading newspaper, the Manila Daily Bulletin, and during the 1970s and 1980s served as press attaché for the Philippine consulates in Singapore and Honolulu, Hawaii under former Philippine president Ferdinand Marcos. Born on January 9, 1931 in Manila, Zabala grew up in poverty in the provincial city of Dagupan, Pangasinan. Through talent, intellect, and hard work, he rose above his meager beginnings to become an award-winning Philippine journalist and was eventually appointed as consul by then Secretary of National Defense, Juan Ponce Enrile, Sr. In 1982, Zabala left the diplomatic service and returned to his first love as a journalist when he relocated to Los Angeles from Hawaii. In Los
Angeles, he edited and wrote for a number of major publications, including the Los Angeles Herald Examiner, a William Randolph Hearst publication, and was Editor-in-Chief of several Filipino-American newspapers and magazines. Throughout his illustrious career as a journalist, Zabala wrote stories exposing corruption by Philippine government officials and about issues affecting the Filipino-American community. Well-known and respected by his fellow journalists, Zabala served as President of the National Press Club of the Philippines and President of the Filipino American Press Club of Los Angeles. Equally recognized and esteemed by his fellow countrymen, Zabala also served as president of the Greater Dagupan Association of California. “My Dad was a humble man; he simply did what he thought was right. And love for his family was the core of his being,” said Laurie Zabala, Zabala’s daughter. A beloved husband and father, Zabala is survived

Trump threatens to leave WTO over proposal on punishing US firms for moving overseas WASHINGTON, July 25 (PNA/ Xinhua) – US Republican presidential nominee Donald Trump on Sunday threatened to pull the US out of the World Trade Organization (WTO) if his proposal on penalizing US companies for moving overseas is blocked. Trump said in an interview with the NBC “Meet the Press” that he, if elected president, would impose a tax on US com-
panies that shift production overseas then sell the products back to the US. “If they’re going to fire all their people, move their plant to Mexico, build air conditioners, and think they’re going to sell those air conditioners to the United States, there’s going to be a tax,” Trump told the NBC host Chuck Todd. Trump said the tax rate could
be 15 percent, 25 percent or 35 percent, and could be different for different companies. When told that such tax would not get through the WTO, Trump said he would then renegotiate “or we’re going to pull out.” “These trade deals are a disaster, Chuck. World Trade Organization is a disaster,” the brash US billionaire said. In the interview, Trump reiterated his support to the United
Kingdom for its exit from the Europe Union, which he said he foresaw before it happened. He said a fractured Europe is not necessarily bad for the US because the primary reason that European countries got together is to defeat the US on trade. “I’m just saying, the reason that it got together was like a consortium so it could compete with the United States,” Trump aid.

Filipino-American nurse educator, Donald Laurino, who takes pride with various designations such as: MSN, CCRN, CMSRN, PHN, and RN-BC, recently received the 2016 Elsevier Master Teacher Award, along with being selected as Item-Writer for NCLEX.
