MANILA, March 7 (PNA) – Malacañang on Tuesday bared that there was an attempt to bribe President Rodrigo Duterte. Presidential Spokesperson Ernesto Abella confirmed the bribe attempt when pressed on the matter during a Palace briefing. “Actually that’s really a matter of Cabinet conversation. However, since you have brought it out, he simply was saying…he was not berating Mindanao politicians. He was simply saying that in time past, there was a certain attempt to influence him financially,” Abella told reporters. However, the Palace official declined to provide any other information on who made the bribery at-

Illegal crossings down in 1st month of Trump presidency
MOSCOW, March 9 (PNA/Sputnik) – The number of illegal crossings at the southern US border went down 40 percent in the first month of US President Donald Trump being in office, the US Customs and Border Protection agency (CBP) revealed. “From January to February, the flow of illegal border crossings as measured by apprehensions and the prevention of inadmissible persons at our southern border dropped by 40 percent,” CBP said on Wednesday. The agency specified that usually it registers a 10-20 percent increase
in illegal border crossings in January-February. “Since the Administration’s implementation of Executive Orders to enforce immigration laws, apprehensions and inadmissible activity is trending toward the lowest monthly total in at least the last five years,” CBP said. The agency pointed out that in the last months leading up to Trump’s inauguration, there was a 35 percent increase in the apprehensions of illegal immigrants, as compared to the previous fiscal year. “However, since President Trump
took office on January 20, we have seen a dramatic drop in numbers,” CBP stressed, adding that, in addition, “we are seeing an increase in the fees charged by human smugglers along the U.S. southwest border.” Trump has issued three executive orders aimed at curbing illegal immigration, including measures to increase deportations and build a wall along the border with Mexico. The executive order on the construction of the wall, a plan that was central to Trump’s presidential campaign, was signed on January 25.
Trump admin seeks 60 days to respond to case on H1B visa issue WASHINGTON, March 8 (PNA/ PTI) – The Trump administration has sought 60 days from a US appeals court to “consider” its response in a case challenging Obama government’s decision to allow spouses of H-1B visa holders to work in the US, putting the jobs of thousands of Indians at stake. The H1-B community, which includes a large number of Indians, had welcomed the move by the Barack Obama administration in 2015 to allow H4 visa-holders - mainly spouses of the H-1B visa-holders - to be gainfully employed. But the group ‘Save Jobs USA’ soon took the matter to the Washington DC appeals court after a district court upheld the Obama administration’s decision. Now, the Trump administration has sought a 60-day suspension in
the appeals court proceedings. On February 1, the Department of Justice filed a petition in the court titled ‘Consent motion to hold proceedings in abeyance for 60 days’. The Trump administration sought the freeze to “allow incoming leadership personnel adequate time to consider the issues”. The “abeyance” in court proceedings has led to concern among H4 visa holders, particularly as Attorney General Jeff Sessions is a known critic of the H1B programme. Immigration Voice yesterday announced to intervene in the case for thousands of H4 visa-holders, saying this was the “only option” to protect the rights of its members and their families, including children who are US citizens. The recent statements from the US government present “an unacceptable risk” for Immigration

Sudarshana Sengupta, one of the petitioners, said she has been involved in bio-medical research for the past 13 years in the country, initially as a J2 dependent (work authorization) and later on H-1B visa. “In August 2015, I decided to use H4-EAD work authorization to continue my research...,” Sengupta said, adding that if the H4-EAD is taken away she will not be able to launch her start-up on developing cancer immunotherapy strategies.

Iran vows countermeasure against US visa ban TEHRAN, March 8 (PNA/Xinhua) – Iranian Deputy Foreign Minister for European and American Affairs, Majid Takht-Ravanchi, said that Iran will counter the US visa ban against Iranians, theTehran Times daily reported on Wednesday. “Our earlier countermeasure against Trump’s order (to stop visa issuance for Iranians) is still in place,” Takht-Ravanchi said. “There is no need for a new decision.” On Jan. 27, Trump issued an executive order for a 90-day ban on the entry visa issuance for seven Muslim-majority countries in the Middle East and North Africa, namely, Somalia, Iran, Iraq, Sudan, Syria, Libya and Yemen. However, it was halted later by a federal court. On Jan. 31, Iran said that it had stopped granting visas to US citizens in response to Washington’s travel ban. On Monday, the White House revised the earlier executive order and signed a new order that excludes Iraqi citizens, but keeps the visa applicants from six other countries, still targeting Iranians. The order is to be put into effect on March 16.

China reiterates support to PHL’s ASEAN chairmanship
BEIJING, March 8 (PNA) – Chinese Foreign Minister Wang Yi reiterated on Wednesday China’s commitment to support the Philippines as rotating chair of the Association of Southeast Asian Nation (ASEAN) 2017. “China will support the Philippines in fulfilling his responsibility as the ASEAN chair and we will help ASEAN build its community,” Wang said in a press conference at the side-
lines of the 5th Session of the 12th National People’s Congress here. Wang said China’s support is important considering last year marked the 25th anniversary of China-ASEAN dialogue relation and 2017 as 50th founding anniversary of the ASEAN. “The silver and the golden anniversary are especially auspicious for regional cooperation and we must seize the opportunities,” Wang said.
UN Security Council slams N. Korea for missile launching NEW YORK, March 8 (PNA/Kyodo) – The UN Security Council on Tuesday slammed North Korea for again defying UN resolutions with its latest ballistic missile test. The 15-member council “strongly condemned” the test, carried out Monday morning local time, as a “grave violation” of Pyongyang’s international obligations, according to a press statement. The council also plans to convene an emergency meeting on Wednesday to discuss a further response, as requested jointly by the United States, Japan and South Korea. On Monday, Pyongyang fired ballistic missiles that landed in waters as close as 300-350 kilometers off Japan’s northwest coast. Abe said he had talks with Trump over the phone and also agreed that North Korea’s “threat has entered a new phase.” Japanese Prime Minister Shinzo Abe and US President Donald Trump agreed Tuesday that the test was a “clear challenge” to the international community. In the statement, the council members also “deplore all the Democratic People’s Republic of Korea ballistic missile activities” and “expressed serious concern” over the country’s “increasingly destabilizing behavior and defiance.” North Korea’s official name is the Democratic People’s Republic of Korea. In a slight change of wording from past statements, the council also “emphasized the vital importance” of North Korea “showing sincere commitment to denuclearization.” In following a past pattern, the statement also said that the council members will closely monitor the situation and “take further significant measures” if necessary. North Korean leader Kim Jong Un was quoted by the Korean Central News Agency as saying, “The four ballistic rockets launched simultaneously are so accurate that they look like acrobatic flying corps in formation.”

PHL committed to beefing up defense ties with New Zealand MANILA, March 8 (PNA) – The Philippines is committed in strengthening and deepening its defense ties with New Zealand. This was emphasized by Department of National Defense (DND) undersecretary Cardozo Luna during the Bilateral Defense Talks (BDT) held in Manila last March 6. Present during the BDT was New Zealand Defense Minister Helen Quilter. Both nations have a bilateral defense cooperation agreement signed in 2012. During the meeting, Luna expressed his appreciation to New Zealand’s contribution in the building up the capacity of Philippine defense forces even as he noted that bilateral relations are pursued
within the ambit of multilateral platforms particularly the ASEAN Defense Ministers Meeting (ADMM)-Plus. As this develops, Quilter conveyed that New Zealand looks forward to working with the Philippines once more as co-chair for 2017-2020 of the newly established ADMM-Plus Expert Working Group on Cyber Security. On December 1, 2016, the City of Sierra Madre, truly lost an inspiring, dynamic citizen, a great community leader, a devoted, and faithful wife to Don Reed and a loving mother to: Corinne and Barbee and four beloved grandchildren: Wesley Lewis; Jane, Sara and Henry Collander. greener pastures, so Don decided to pursue his law school studies in Vermillion, South Dakota, thus obtaining a JD certificate, while Jan taught in the local school. Armed with a law diploma, Don convinced Jan to move back to Wayne, Nebraska, where Don became a partner at a law firm and within a couple of years, they became parents to Corinne and Barbee. In 1972, the whole family transitioned in moving to Honolulu, Hawaii but eventually settled West in San Marino, California in 1974. where Jan worked for the local newspaper called “The Tribune.” Jan’s experience with “The Tribune,” encouraged her and Don to buy the Sierra Madre News when it became available in 1980. By 1994, Jan and Don decided to sell the newspaper and this author was hired as Managing Editor by its subsequent owner, Michael De Wees, and during its ownership transition, Jan and I briefly worked together at the paper. The Sierra Madre News was such a great community paper and this author worked there for almost four years, until the paper finally folded, to the detriment of the whole Sierra Madre community due to its historical value. Though Jan stayed very active in the little community of Sierrra Madre upon her retirement, both her and I were active members of the Si-

Jannenne Griffith Reed, former publisher of the community paper called, “The Sierra Madre News,” joined her Creator peacefully on Saturday, December 17, 2017 at the amiable age of 87. “Jan” as the whole Sierra Madre community called her, was born the youngest of four daughters to Frank James and Pearl Margaret Griffith, on a farm outside of Wayne, Nebraska on February 8, 1929. According to their family lore, it was 23 degrees below zero the day she was born. As a young girl, she loved to play piano, make up songs, write poems and stories. She later started drawing comic strips which she did constantly, illustrating most stories she studied, as well as various classical stories she read. She also worked at the Wayne Herald while attending Wayne Prep High School, where she was the Homecoming Queen and Valedictorian. Her main job at the newspaper was initially collecting subscriptions, then she went into writing, which subsequently lead her to become the paper’s Features Editor. Further, she attended Wayne State College on a scholarship for free, where she then met Don Reed in her junior year and they were married on April 5, 1953. Subsequently, her husband Don enlisted in the Air Force and they were initially stationed in Madison, Wisconsin, then Sault Ste. Marie, Michigan, and finally, Chicago, Illinois, where Jan had worked as a layout artist for General Telephone Company. After Don left the Air Force, they then moved to Kearny, Nebraska, where Don worked as a News DIrector, while Jan was a copywriter. Eventually, they were both seeking

ASEAN moves to protect the rights of migrant workers ILOILO CITY, March 8 (PNA) -- The ASEAN Socio-Cultural Community (ASCC) Council will craft an instrument that would set in motion the ASEAN declaration on the protection and promotion of the rights of migrant workers that was adopted during the 12th ASEAN Summit held in Cebu City in January 2007. “In ASEAN, everyone agrees that workers, whether in our country or abroad, should be provided with protection. How to go about that has to be fleshed out further in the discussions among our ministers,” explained Social Welfare Secretary Judy Taguiwalo during a press briefing on the sidelines of the 17th ASCC Council Meeting here Wednesday. Under the general principle of the declaration, both the receiving and sending states shall strengthen the political, economic and social pillars of the ASEAN Community by promoting the full potential and dignity of migrant workers in a climate of freedom, equity and stability in accordance with the laws, regulations and policies of respective ASEAN member states. It also declares that for humanitarian reasons, member states should closely cooperate to resolve cases of migrant workers, who, through no fault of their own, have become undocumented and shall take into account the fundamental rights and dignity of migrant workers and family members. ”It is meant to protect documented migrant workers, as well as previously documented migrant workers who have become undocumented because their contract has ended,” Taguiwalo said. The declaration also states the obligations of the receiving and sending states pursuant to the laws, regulations and policies of the respective states. ASEAN member states came up with eight commitments, among them to promote decent, humane, productive, dignified and remunerative employment for migrant workers; and to establish and implement human resource development and reintegration programs for migrant workers in their countries of origin, according to the declaration that was crafted in Cebu City. Taguiwalo expressed hope that the instrument would be done by April and ready for adoption during the 30th ASEAN Leaders Summit.
DOLE to assist 300 OFWs displaced by Qatar fire By Ferdinand G. Patinio
MANILA, March 7 (PNA) – The Department of Labor on Employment on Tuesday said it will provide assistance to more than 300 Filipino workers who were affected by the fire that broke out at a labor camp in Qatar last March 3. With this, DOLE Secretary Silvestre Bello III directed the Philippine Overseas Labor Office (POLO) in Qatar to immediately extend assistance to the overseas Filipino workers (OFWs) affected by the blaze at the UCC Labor Camp of the Elegancia Hospitality Group in Al-Shehaniya, about 33 kilometers north of Doha. He also instructed Labor Attaché David Des Dicang to provide assistance to the OFWs, monitor their conditions, and ensure that they will be able to normally return to their work. In a statement, Dicang also reported that there are no casualties in the incident but a certain Sherwin

According to the authorities, the cause of fire is still being investigated. The POLO-OWWA and the Embassy team composed of the DSWD and the Assistance to Nationals (ATN) section, which coordinates requests for assistance, joined the Filipino community groups in Qatar in bringing emergency aid, such as clothing, food, water, and medicines to the affected OFWs.

MANILA, March 7 (PNA) – Sen. Alan Peter Cayetano on Tuesday filed the committee report on a measure seeking to extend the validity period of the Philippine passport from five to 10 years. Cayetano, chair of the Senate Committee on Foreign Relations, assured that his committee is working to respond to the directive of Pres. Rodrigo Duterte to amend Republic Act No. 8239 or the Philippine Passport Act of 1996. “Let me assure all stakeholders and our colleagues that we are doing all we can to ensure that the President’s legislative agenda, which is rooted in his goal to create real change, will be achieved under our watch,” Cayetano said. He said that the committee’s efforts are in line with the President’s promise during his first State of the Nation Address (SONA) and the campaign promise to promote the welfare of our people, particularly our migrant workers.

The senator also acknowledged the need to make the passport application process more “seamless, convenient, and pro-people.” Cayetano’s committee filed Senate Bill 1365 under Committee Report No. 45 -- with House Bill 4767 as its counterpart bill – that was already approved on the third and final reading last February 13. “Simplifying our passport application system would ease our people’s burden of having to renew their passports every few years. It would also prevent any backlogs in the issuance of passports,” Cayetano said. MMDA mulls ‘Windows 2’ implementation to further ease EDSA traffic By Aerol B. Patena
MANILA, March 8 (PNA) – The Metropolitan Manila Development Authority (MMDA) is proposing the implementation of the modified odd even scheme or “Windows 2” for private vehicles to further improve travel along EDSA and ease vehicular congestion in major thoroughfares across the metropolis. “Based on our projections, the average travel speed at EDSA runs at around 19 kilometers per hour (kph). If we will be able to implement the modified odd even scheme, we expect that we will be able to reduce vehicles by 45 percent, thus average speed will increase to 40 kph,” MMDA General Manager Thomas Orbos said in an interview with reporters Wednesday. “Windows 2” would be implemented through a two- hour period for vehicles with digits ending in odd and even from 7a.m. to 9p.m. daily. “The odd even ban would be every two hours which means from 7a.m. to 9a.m. odd; 9a.m. to 11a.m. even; grace period from 11a.m. to 1p.m.; 1p.m.- 3p.m. odd; 3p.m.- 5p.m. even; 5p.m.- 7p.m. odd and 7p.m.- 9p.m. even,” Orbos explained. He further said the scheme would cover private vehicles and those registered with ride sharing services
such as Uber and Grab while public utility vehicles are to be exempted. Orbos related that Metro Manila mayors have been supportive of the proposal. The MMDA would consult with transport groups, commuter organizations, members of the academe and transportation experts to gather inputs. “The implementation of the modified odd even scheme could be a prelude to the establishment of congestion pricing in EDSA which means motorists can use the roads but not at all times. There would be times where you will not be allowed to use the roads if you still need them, you have to pay,” according to Orbos. Congestion pricing or congestion charges is a system of surcharging users of public goods that are subject to congestion through excess demand such as higher peak charges for use of bus services, electricity, metros, railways, telephones, and road pricing to reduce traffic congestion. He also disclosed that the Department of Environment and Natural Resources (DENR) believes its implementation would not only decongest roads but also reduce carbon emissions in Metro Manila.

MANILA, March 7 (PNA) – The Bureau of Internal Revenue (BIR) and the Bureau of Customs (BOC) have teamed-up to strengthen the tax evasion charges against cigarette manufacturer Mighty Corp., Finance Secretary Carlos Dominguez III on Tuesday said. Dominguez said evidence were now being collected to firm up the tax evasion case against Mighty Corp. In a statement, the Finance chief said the case against Mighty Corp. was airtight and the BIR and the BOC had teamed-up to further cement the charges. Dominguez said “the government needs to first establish strong evidence to pin down this cigarette manufacturer on such charges.” “We must make sure the charges stick not only to haul the guilty par-
ties, including their possible cohorts in the government, into jail but to send a clear message to big-time tax dodgers that the Duterte administration is dead set on putting an end to their nefarious activities and sending all of them behind bars,” he said. “They (BOC and BIR) should speed up their investigations and also look into the possible involvement of bureaucrats acting as protectors of these large-scale tax evasion attempts,” he added. Earlier, the BOC announced that some Php 2.2 billion worth of smuggled and counterfeit tobacco products, shoes and clothes were seized in series of raids in Pampanga and the cities of General Santos and Zamboanga in Mindanao. Part of the items were Mighty Corp. cigarettes that bore fake tax stamps.

You want to help your children go to college and if you’re like most parents, you would do anything to help them get a good education. At some point, you may be asked to co-sign your child student’s loans. That may be fine but my question is: Do you really understand what you are getting yourself into? Would you be willing to risk your retirement, your assets or at the very least your good credit standing if the loans are not repaid? Your child can obtain federal student loans in his or her name alone but if the amount given is not enough, a lot of students end up having to borrow from private lenders. But since most young students don’t have an established credit history that would qualify them to obtain the loan in their name alone, lenders will often ask parents to cosign. Unfortunately, however, many parents don’t understand the consequences of cosigning. I know this because I see it a lot in my bankruptcy practice. Keep reading. Here’s what you need to keep in mind before cosigning your child’s student loan: Cosigning makes you 100% responsible for the entire student loan, just as your child is. In other words, you are taking on the legal responsibility as if you borrowed the money yourself. Thus, if your child is not able to pay the loan back for whatever reason, you’re on the hook and the lender will come after you. Unfortunately, a lot of students graduate but end up not getting that dream job they want so oftentimes they find that they don’t have the income they were expecting in order to afford their student loans. Others quit before they even graduate and move on with their lives doing something else. So what happens to the student loans if this happens? That’s right. They don’t get paid. What happens to you then as the person who cosigned the loan? Unlike federal student loans which offer more flexibility with regard to payments, private student loans are more difficult to handle if you default on the agreement. As a co-signor, you can get sued and if the lender obtains a judgment against you, they can garnish your paycheck, put a lien against your home, levy your bank account and do everything that the law allows them to do in order to collect what you owe them. Don’t get me wrong. I understand that most people enter into a cosign-
ing arrangement with the very best of intentions. But as a bankruptcy attorney, I’ve also seen how this can destroy marriages and family relationships especially when the person cosigning didn’t fully understand the legal consequences of what they were doing when they signed on the dotted line. Remember that most of these loans also have long repayment terms of 5-12 years so until the last cent is paid off, you, as the cosignor, will remain liable to the end. Are you willing to assume that risk? According to a recent article I read, about 57% of parents who cosign said that their credit score has been negatively affected. Keep in mind that if your child is ever late on a payment, that late payment will be on your credit report as well. Any negative effect caused by late payments or delinquency can hurt your ability to qualify for home loans, refinancing, purchasing a car or obtaining any type of credit. So make sure that you understand all of this before making that commitment. If your child ends up not being able to pay, make sure that you can afford to make the payments yourself. You have a right to see the Immigration Judge even if you committed a crime? Question: I committed a crime and have my Green Card. With Trump, I fear that I will be thrown out of the U.S. Is this true? Answer: No. There is a great deal of fear going across the U.S. right now that ICE will come to your door, put you in handcuffs and deport you outside the U.S. without a hearing or without due process of any kind. I have heard of officers actually doing this. Some of the officers seem to want to bypass the law and to try to deport as many people as they can. However, you DO NOT have to sign a voluntary deportation paper. ICE officials cannot force you to do this (no matter what they say or how they
might lie to you.) Rather, in most cases, you have a right to fight your case in front of an Immigration Judge in Removal Proceedings. As long as you have been in the U.S. for at least two years, this is unquestionable that you have this right under the law. Otherwise, if foreign nationals did not have this

In fact, there are Immigration Courts all over the U.S. and foreign nationals in every State fighting to stay in the U.S. - even though they committed a crime. The laws being the Immigration and Nationality Act, Code of Federal Regulations, Foreign Affairs Manual, Board of Immigration Appeals Cases, Circuit Court Cases, Department Memos, and Supreme Court Cases all allow fighting your case in Immigration Court when convicted of a crime. If this were not the case, and if ICE could simply round up a bunch of people and throw them out of the U.S., there would be no need for Immigration Courts and for appeals to the Board of Immigration Appeals. In the United States, the law gives rights to foreign nationals. Some of these rights include Due Process and Appeals. This is why you can fight your case and this is why ICE cannot simply throw you outside of the U.S. ICE officials do not have legal training. Many are relatively new on the job. Many will lie and not tell you the truth. Be sure to call an immigration attorney who has experience with deportation and removal proceedings. Be sure not to sign any papers that ICE puts in front of you. Question: Assuming that I get to an Immigration Court, what can I fight for under the law? Answer: There are many forms of relief you are able to fight for under the law. Each case is different. Some crimes do not actually make you deportable. Other crimes allow you to fight for Cancellation of Removal for Lawful Permanent Residents or Cancellation of Removal for Non-permanent Residents. Other cases allow you to apply for derivative citizenship. Other cases allow you to apply
for asylum, withholding of removal or convention against torture. Still other cases allow you to apply for Waivers. There are many types of Waivers available under the Immigration and Nationality Act. These are not petitions or applications made up by Immigration Attorneys, but rather, they are codified in the Immigration and Nationality Act. They provide you the ability to essentially ask the Immigration Judge to forget about the crime and to permit you to stay in the U.S. Question: If I lose, will I be immediately deported? Answer: No. Along with your right to fight in Immigration Court, you have the right to appeal. First, you can appeal to the Board of Immigration Appeals. Hopefully that will win. However, if not, you can then do a Petition for Review to the Circuit Court of Appeal. If you do not win there, you can do a Motion for Hearing En Banc and then you can do a Writ of Certiorari to the U.S. Supreme Court.There are lots of ways to both fight and appeal your case. 4 ways ďŹ ling for divorce can beneďŹ t your immigration case Couples get divorced for various reasons. California is a no fault state. The reasons why a couple is getting divorced are often irrelevant to the issues of the family law case. Divorce is often a difficult and negative experience for most families. However, getting divorce may have some unintended benefits in the immigration law arena. Four situations in which filing for divorce can be beneficial to your immigration case are as follows: Married Sons and Daughters of US Citizens If you were petitioned for legal permanent residence by your US Citizen parent as a married son or daughter 21 years old or over, you are classified in immigration law under family sponsored third preference (F3) which usually carries a long wait time. The wait time for Filipinos for example is currently 22 years. The priority date is normally the date the petition was initially filed by your US Citizen parents. If you get divorced, you revert back to single status and your category automatically becomes reclassified to first preference (F1) where the waiting time is substantially shorter. For example, for Filipinos the wait time under F1 category is 10 years shorter than F3 category. This means if your parents filed your immigration petition 12 years ago, then you can adjust to a green card now instead of waiting another 10 years. Married Sons and Daughters of Legal Permanent Residents If your parents are legal permanent residents, getting divorced will convert you back single status making you eligible to be petitioned by your legal permanent resident parents under the family based second preference (F2b) category if you
are 21 years old or older or under the family based second preference A (F2a) if you are under 21 years of age. For those who married after they were petitioned by their LPR parents (F2A and F2B), the petition is automatically revoked under operation of law the moment you get married and cannot be reclaimed by a divorce. In theory, it can be argued that filing a subsequent petition after your divorce under the same category inherits the previous petition’s priority date under 9 FAM 42.43 N10 and 8 CFR 204.2(h), Part 205. However, success of such argument is not clear since the old petition was automatically revoked the moment you married. The best thing that can be done in this situation is to have your LPR parent repetition you as an F2A or F2b even if you are unable to reclaim the previous petition’s priority date. Conditional Legal Permanent Residents in failed Marriages For those who obtained their legal permanent residence status through marriage based petition by their US Citizen spouse of less than 2 years marriage, the legal permanent residence status conferred is usually a “conditional legal permanent residence� valid only for 2 years. The couple would need to sign and file a joint petition to remove this condition prior to the expiration of the 2 years or the conditional legal permanent resident spouse would fall out of
status. The problem arises when the marriage is in trouble. Often it becomes difficult to obtain the cooperation of the US Citizen spouse specially when the couple has separated. US Citizen spouse often refuse to sign the I-751 for or appear at the I-751 interview if one is set by the USCIS. Filing for divorce would terminate the marriage and allow you to file a “waiver� of the joint petition to remove the conditional LPR status based on entering into the marriage in good faith. Terminating the marriage by filing a divorce is a requirement in order to file the “waiver.� It is important to time this correctly as soon as the marriage starts falling apart because by terminating the marriage early on, you might be able to file the waiver before the expiration of your 2 year conditional LPR thus allowing you to extend your LPR status in 1 year increments until a final decision is made in your case. Married Aliens in Non-Immigrant Visas and those without Status For those who enter the US as a non-immigrant and are separated from their spouse but still married, filing a divorce would open up opportunities in case they meet a new significant other who is a US Citizen and who can petition them as an immediate relative. This is usually the fastest of process in obtaining legal permanent residence. In countries such as the Philippines where there is no divorce, many people come to the US to start a new life after they have been separated from their old spouse (often still married to them). Even if the alien over stays their status as a visitor, the alien can still adjust to that of a legal permanent residence if petitioned by a US Citizen spouse. If the alien was never inspected, the alien can still adjust to legal permanent residence if they are grandfathered under INA 245(i) and there are no special restrictions on their status. To be grandfathered under INA 245(i), the alien must
have been a beneficiary of a legal permanent residence petition filed no later than April 30, 2001. Finally, a common concern of divorcing immigrants is “What happens if my spouse refuses to sign the divorce papers?� The truth is you do not need your spouse’s signature to obtain a divorce in California. You only need to provide your spouse notice that you filed a divorce by personally serving your spouse the divorce petition and summons. In countries that are members of the Hague Convention, special procedures need to be followed to effect service. So yes it is possible to divorce your spouse even if your spouse is in a country that does not recognize divorce among its citizens such as the Philippines. Notorious Zamboanga Del Sur KFR leader killed in encounter MANILA, March 8 (PNA) – Police and military units shot and killed a notorious kidnap-for-ransom (KFR) syndicate head during operations in Zamboanga Del Sur on Monday morning. Belated reports by Western Mindanao Command (WMC) spokesperson Capt. Jo-ann Petinglay said the incident took place 10:50 a.m. in Barangay Pampang, Lapuyan, of the said province. She identified the slain kidnapping syndicate leader Fahad Andi, head of the Andi KFR Group, which is also notorious for drug pushing, trafficking, and kidnap-for-ransom activities in Dinas, Lapuyan, Margosatubig and other neighboring municipalities in Zamboanga Del Sur. Andi is also listed as the Top 2 “High Value Target� and Number 1 most wanted person in the regional
level. His group is also involved in the series of kidnappings, gun for hire, and extortion activities in Baganian Peninsula. Andi was killed in a 30-minute shootout with Task Force ZAMPELAN (Zamboanga Peninsula) and local police. Witnesses reported seeing the suspect hit by gunfire and afterwards falling into the wharf area of Barangay Pampang. Government forces recovered a .45 caliber pistol; a magazine with two live ammunition; a PRB 423 fragmentation grenade; a scooper; a black bandolier back pack and lighter; a PNP camouflage green uniform with the PRO-ARMM logo; and a camouflage sling bag. Troops are still searching for the body of the slain suspect, Petinglay said.

Eligible debtors should seek BK relief Sometimes debtors cannot decide whether they should seek debt relief through Chapter 7 wipe out of all dischargeable debts or a consolidation and reorganization through a Chapter 13. They usually ask me what they should do in their financial situation. I know after handling thousands of bankruptcy cases in the last 30 years, debtors are often depressed about their lives because of the heavy burden of accumulated debt. The worst case scenario was my client many years ago who killed himself a week before we filed his case. It was unfortunate that he took his own life because he left behind a wife and two minor children and a successful professional career. He was enjoying gross income of $500K annual income from his profession but had borrowed money to set up a business that initially did well. Since the business was doing well, he borrowed more money to expand the business, including putting up his house for collateral for the business loans. When the economy slowed down, his business started losing money. He then resorted to borrowing more money to cover the business loss for 18 months. His business was losing $10K a month. After financing losses for 18 months, he came to see me for bankruptcy relief. He looked pretty calm when I interviewed him. How many times must I say it, “YOU OWE YOUR CREDITORS MONEY, YOU DO NOT OWE THEM YOUR LIFE!� Don’t even dare think of killing yourself to get out of debt. Death does not extinguish debt. When a person dies, there is an estate of the deceased that is created in a probate case. Creditors of the deceased can file in their claims in the probate case. So, if you owe too much debt now, you should look at your financial problems objectively. You should choose the solution that best serves your needs. You should seek to protect your own interest and future. You should not succumb to the pressure of differing opinions from friends or relatives. For instance, I had one client who decided to withdraw
her Chapter 7 petition because her sister did not approve of it. Client had a mountain of debt, which she absolutely had no way of paying unless she could work four jobs, and she was three months behind in her mortgage payments. Objectively speaking, the right solution for her was a Chapter 7 to wipe out $80K of credit card debt and use the money saved from not having to pay $80K of credit cards to update her house payments. Without credit card payments, she would save $2400 a month. She would have paid off her mortgage arrears in 3 months. She would have obtained a fresh start without the burden of accumulated debt. Instead, she wanted to make her sister happy and chose not to protect her own interest, her own future. She was not thinking clearly. After 6 months she returned to me saying that she wanted to go through with her Chapter 7 case because her house was already foreclosed and she still owed the 2nd trust deed holder was still calling her to collect $50K of the 2nd mortgage even though she no longer owned the house, and the $80K of credit cards are calling her night and day. Eligible debtors should consider the following objective reason to seek bankruptcy relief: 1. Based on debtor’s net income and expense analysis, debtor has no ability to pay off his or her unsecured debts. In other words, even if debtor’s intention is to pay off debt, realistically speaking, debtor cannot pay of debts over a reasonable period of time. This means that debtor will be locked in permanent indebtedness, a slave of debt! Therefore, correctly, debtor should find a legal way of getting out of debt as soon as possible.
Here in America, bankruptcy is the legal way of getting out of debt and becoming productive again while you keep most if not all of your assets including your house, cars, retirement accounts etc. The right to bankruptcy is guaranteed by the constitution and even Walt Disney filed for Chapter 7 twice before Mickey Mouse and Disneyland became successful. If Mr. Disney did not obtain a fresh start twice before, we would have no Disneyland to enjoy today. 2. Too much debt destroys the household’s ability to save and invest money to secure the family’s future. If debtor makes $5,000 a month but has to pay out all of the $5,000 for monthly overhead and to make minimum payments on credit card debt of say, $30K, debtor is living a hand to mouth existence. Debtor saves nothing and invests nothing year in and year out. With accumulated debt you condemn yourself to Sisyphean existence. I don’t mean you become a sissy. You become like SISYPHUS. In Greek mythology, Sisyphus was the king of Corinth who was punished for his deceitfulness by the Greek gods (who are of course false gods), to roll an immense boulder up a hill, only to watch it come back to hit him, repeating this action for eternity. So your “Sisyphean existence� means a laborious and futile existence. By the time that debtor realizes that he has worked for 20 years without nothing saved and invested, it will be too late because by that time, debtor will be pushing sixty. Most people save and invest money whilst I their twenties to fifties. Debtors who have too much debt unfortunately are robbed of the ability to save and invest for decades. Thus, a smart person who has too much debt but wants to save and invest must immediately correct the debt situation or else he or she will get old poor. The last thing a senior wants to have at retirement is debt. If you service $30K of credit card debt for 20 years, you would have paid your credit card masters $240K and still owe the same $30K when you retire at 66. If you got rid of these cards with Chapter 7 at the age of 46, you

would have invested $240K starting at $12K a year and growing at $12K a year. Properly invested, you could have $400K saved when you retire at 66 and zero debt. Even if you made the mistake of carrying these cards into retirement, you must get rid of them now because now you depend on social security, which is just enough to cover basic monthly necessities. Whether you are 40 or 60 or 70, you must get rid of credit cards now and become productive again! 3. Re-establishment of credit can start immediately. Debtors are able to begin reestablishing credit by paying their car and housing loans timely. Debtors will be able to get new credit cards soon after they obtain discharge. There are banks that give new credit cards to debtors who have completely their bankruptcy because these debtors are actually very good credit risks. They still have good income, have no more debt, and are now more careful in their financial affairs. BK filers qualify to buy houses again on the second or third year after BK filing if they have been paying their new loans on time. Buying a new car is no problem. On the day of the discharge, you can bring your discharge order to the car dealer. If worries about your credit cards or a pending foreclosure are keeping you awake at night, you probably already know youâ&#x20AC;&#x2122;re in over your head. Just cruising along, juggling credit cards, taking from one to pay the other is not the answer. If this describes your situation, then doing nothing just makes the hole bigger and your position more desperate. Here are 12 signs that that could indicate financial stress. 1. You routinely spend more than you earn. 2. You make only the minimum payment required on your credit cards. 3. Your credit limit is maxed on most of your cards. 4. Youâ&#x20AC;&#x2122;re unsure about how much you owe or what may be on your credit report. 5. You skip payments on some bills in order to pay others, or use cash advances on one credit card to pay off another. 6. You find yourself arguing with your spouse about money. 7. Youâ&#x20AC;&#x2122;re thinking lately about filing for bankruptcy. Though it is a common enough word, what exactly does bankruptcy mean? And what are its implications? As is to be expected, filing for bankruptcy is a complicated process but before such a step is taken it is essential to understand exactly what it is all about. Simply put, bankruptcy can be defined as the legal process thorough which individuals or businesses in financial trouble are able to work out their debts and pay them out under the protection of the bankruptcy court. Often â&#x20AC;&#x153;liquidationsâ&#x20AC;? or â&#x20AC;&#x153;reorganizationsâ&#x20AC;? are the words that are used to sum up the process that unfolds when you file for bankruptcy. The two kinds of bankruptcy that you can file for are Chapter 7 and Chapter 13. There are various factors that would determine whether you should opt for Chapter 7 or Chapter 13. Through Chapter 7 Bankruptcy you liquidate all unsecured debt, providing any assets you may have are exempt under bankruptcy rules. Most people never lose anything, because they donâ&#x20AC;&#x2122;t have any non-exempt assets. In the event debtor is making too
much money, they choose Chapter 13 Bankruptcy, which is the reorganization type of bankruptcy. The debtor is allowed three to five years over which to pay back a portion of the debts, based on disposable income. Say that you have $100.00 in disposable income. You would have to pay that into a plan for 60 months. After 60 months, the balance of your debts would be discharged in full, even if they are far from being paid off. One should keep in mind that there are intricate details to this legal process that need to be taken into consideration before decisions are made to file for bankruptcy. Who qualifies? Which kind would apply to you? Will you be able to keep all of your property? There are many such questions that arise in such a situation. In this situation, you need to consult with an experienced bankruptcy law firm that can guide you through these complicated decisions and procedures. Filing for bankruptcy may not be the solution to all your financial problems though. In fact, bankruptcy does not cover all debts. For example, debts related to child and spouse support, or taxes are not covered in bankruptcy. Do you have a Co-signer? Before filing for bankruptcy it is important to know that your co-signer might be held liable for the co-signed debt. However, a Chapter 13 bankruptcy may protect your co-signer, since it offers a partial repayment plan. With a Chapter 7 bankruptcy, only the debtor is protected and the co-signer would be liable for the debt. In this case, the creditors have the right to demand that your co-signer pay off the outstanding payments. Under chapter 13 bankruptcy, as long as the bankruptcy plan is active the co-signers will receive a stay for the duration of the debtors payment plan. At the end of the plan, a co-signer could once again liable to pay any outstanding payments, even though the debt is discharged in favor of the bankruptcy debtor. MANILA, March 7 (PNA) â&#x20AC;&#x201C; Chinese government will finance some USD3.4-billion infrastructure projects in the Philippines, an offshoot of the signing of the 28th Joint Commission on Economic and Trade Cooperation (JCETC) held here on Tuesday. Philippine Trade Secretary Ramon Lopez and Chinese Minister of Commerce Zhong Shan jointly announced after the signing of the 28th JCETC, that three infrastructure projects in the country would be funded through credit facility. â&#x20AC;&#x153;To date, three priority projects have been identified mainly for the Chico River Pump Irrigation project, New Centennial Water Source (NCWS)-Kaliwa Dam Project and the North-South Railway â&#x20AC;&#x201C; South Line as the first batch of projects,â&#x20AC;? said Lopez. In a joint press conference, Trade Undersecretary Ceferino Rodolfo said that the largest funding would go to North-South Railway Project (NSRP)-South Line amounting to USD3.0 billion.

Palace hits US show’s negative portrayal of PHL president MANILA, March 7 (PNA) – Malacañang on Tuesday twitted an American television series that negatively depicted a Philippine president and said that the show should have instead used a fictional US president. “I think they are confusing their images. I think they are projecting something that they really would like to say about their own situation. Really, I think they should use a fictional US president,” Presidential Spokesperson Ernesto Abella said during a Palace briefing. The Palace official was referring to a CBS network’s TV series titled Madam Secretary. Based on the show’s trailer posted on Youtube, fictional new Filipino President Datu Andrada was punched after making inappropriate advances towards lead character US Secretary of State Elizabeth McCord. In the US, President Donald Trump has been criticized for his remarks and inappropriate advances against women. However, Abella did not make a categorical comment when pressed if the Palace found the show’s trailer insulting. “Well, they engage in something that they would like to... It’s their business. It’s their craft. You cannot deny them their craft. Their taste, perhaps,” Abella said. The Philippine Embassy in Washington has already written to CBS Corporation to strongly protest the negative depiction. “While Madam Secretary is a work of fiction, it tracks and mirrors current events. It is, therefore, inevitable that its depiction of world leaders will have an impact on how its audience views the real personages and the countries they represent,” the embassy wrote. Network officials and producers of the show have yet to comment on the issue.
Dean Logan, reported that Tuesday’s election “is likely to break another record for low voter turnout in an L.A. mayor’s race.” “Logan expects the final turnout will fall 1 or 2 percentage points below the record low of 17.9% of registered voters in 2009, when Mayor Antonio Villaraigosa won reelection,” the LA Times reported. The City Council incumbents also posted lopsided leads over their respective opponents. Among those expected to retain their posts were Gil Cedillo, Paul Koretz, Curren Price, Mike Bonnin, Mitch O’farrel and Joe Buscaino. According to the LA Times, “the city’s elected officials normally serve four-year terms. But because of a shift in the election calendar, winners of this year’s elections will serve 5½ years. Starting in 2020, city elections will coincide with state and federal elections.” City Attorney Mike Feuer and Controller Ron Galperin both ran unopposed.

CBCP saddened by passage of death penalty bill at lower house By Ferdinand G. Patinio
MANILA, March 7 (PNA) – The Catholic Bishops’ Conference of the Philippines (CBCP) is standing firm on its opposition to the death penalty. In a statement, CBCP president Archbishop Socrates Villegas said they were saddened by the decision of the House of Representatives to approve on third and final reading the bill reviving the death penalty. “The House of Representatives has given its consent for the State to kill. We, your bishops, are overcome with grief but we are not defeated, nor shall we be silenced,” he said. “In the midst of Lent, we prepare to celebrate the triumph of Life over Death, and while we grieve that the Lower House has voted for death, our faith assures us that Life will triumph.” At the same time, Villegas urged Filipinos to continue to express their opposition to the proposed measure. “We call on all Catholic faithful and all Filipinos who stand for life to continue the spirited opposition to the death penalty,” he said. He likewise called on the judiciary to support the Gospel of Life. “We urge Catholic lawyers, judges and jurists to allow the gentleness of the Gospel of Life to illumine their reading and application of the law, so that their service to society as teachers and agents of the law and of justice may bring life,” the CBCP chief said. On Tuesday, 216 members of the House said ‘yes’ to the reimposition of the capital punishment, while 54 lawmakers said ‘no’ and one abstained.
3rd reading approval of death penalty bill violates Constitution – lawmaker
MANILA, March 7 (PNA) – The scheduled third reading approval of the death penalty bill on Tuesday violates the three-day notice rule prescribed in the 1987 Constitution, an opposition lawmaker at the House of Representatives said. In a press conference on Tuesday, Albay Rep. Edcel Lagman said the third and final reading on House Bill No. 4727, seeking to restore death penalty, is “premature” since it violates Section 26 (2) of Article VI of the Constitution. “No bill passed by either House shall become a law unless it has passed three readings on separate days and printed copies thereof in its final form had been distributed to its Members three days before its passage, except when the President certifies to the necessity of its immediate enactment,” the Constitution read. Lagman likewise said that the schedule of the bill’s approval is unlawful under the House rules, which provides that: “no bill or joint resolution shall become law unless it passes three readings on separate days and printed copies thereof in its final form are distributed to the Members three days before its passage”. Lagman said that the printed copies were reportedly distributed to the congressmen’s offices last Thursday and Friday, noting that such distribution was “unavailing and not compliant” with the constitutional provision.

Hi-tech education critical for women’s economic empowerment: UN UNITED NATIONS, March 8 (PNA/ Xinhua) – Hi-tech education for women and girls is a critical means to ensuring women’s participation in current digital economy, said UN Women Deputy Executive Director Lakshmi Puri. In a recent interview with Xinhua, Puri said women need to be educated with ICT (information and communications technology)-related skills to have access to decent jobs and stay competitive in the labor market. Education in science, technology, engineering and math can equip females to meet the demands from labor market and thus to be economically empowered, she added. To advocate women’s economic empowerment is the major focus of the upcoming International Women’s Day which falls on Wednesday. The UN will celebrate the Day with a theme “Women in the Changing World of Work: Planet 50-50 by 2030” to call for changes across the world. Puri said economic empowerment means that women can have equal access to land, property, productive assets and resources, essential services and infrastructures. It also means women can be given the same opportunities for decent jobs, occupational training, as well as full and productive employment, she added. “If we don’t have women’s economic empowerment, we can’t enable them to enjoy their equal rights in other areas,” said Puri. She noted that women worldwide are faced with multiple challenges at workplace, including gender pay gap, gender stereotypes, occupational segregation as well as obstacles
in promotion. World Bank statistics show that globally, women are paid less than men. Women in most countries earn on average only 60 to 75 percent of men’s wages. In addition, women bear disproportionate responsibility for unpaid care work: women devote 1 to 3 hours more a day to housework than men; 2 to 10 times the amount of time a day to care for children or the elderly. Puri mentioned that flexible working for women such as Uber-type working can help them find work-life balance. But she also noted new forms of working may yield conditions that deepen gender disparity which need to be avoided through well-designed policies. In this regard, she said the private sector needs to bear the major responsibility to integrate gender equality into practices, and the public sector shall provide with corresponding support. Puri said women entrepreneurship is what the UN agency has been advocating to overcome gender gap in labor market. “We hope that women entrepreneurship becomes a key driver of employing other women and creating jobs for women,” she said. To achieve this, countries need to create an enabling environment with better financial and technical support to help females to start their own businesses in all sectors, said Puri. By doing this, “we hope the current economy can be transformed in a way that is more favorable for women, more adaptive to women’s needs and talents, thus creating equality worldwide,” she added.
Duterte to study EO On Smoking Ban MANILA, March 7 (PNA) – President Rodrigo Roa Duterte said he needs more time to study the proposed executive order banning smoking nationwide as he eyes to reach a compromise on the designated smoking areas. The President said that he was still weighing expected resistance to the initiative and possible areas for compromise, citing as an example designated smoking areas inside a building. In a media interview on Tuesday, March 7, at the Rizal Hall of the Malacañan Palace, the President explained that, “there are a lot of dynamics there. So just give me enough time to study.” The Chief Executive said he was supposed to sign this week the draft executive order submitted by Health Secretary Paulyn Jean B. Rosell-Ubial, who was pushing for the approval of the order. “I have to be very careful in trying to navigate the way how I can present it to the public,” the President said, noting that the smoking ban in Davao is a different case. “For example, I’d need the pronouncements, not really the opinion, the pronouncements of our medical sector and they should be also in the forefront of this because they know the benefits of totally banning smoking inside..,” he said. In the same interview, the President said he had ordered the arrest of the owner of Mighty Corporation who used fake cigarette stamps. He also confirmed the appointment of former Armed Forces of the Philippines (AFP) Chief of Staff Ricardo Visaya as the new head of the National Irrigation Administration (NIA). Meanwhile, Duterte said he wants to “strike a happy compromise” between the
government and mining industry with a view to “protecting the public interest.” He also appealed to lawmakers to allow Environment Secretary Gina Lopez, whose confirmation is pending at the Commission on Appointments, to present her case. “If you’d listen to Gina present her case… but you have to concede something to (her). Talagang nagtatrabaho, and she has pointed out the so many factors that would eventually affect the environment of Mindanao,” he said. “We cannot be allowing diggings forever in the every nook and corner of the mountain ranges. It would spell disaster,” he warned. The President also announced that he had met with Zhong Shan, the Minister of Commerce of the People’s Republic of China, “who brought with him a windfall.” “He just brought in… one billion dollars, agri products, they’re coming next month and they have scheduled something like 10 billion for the present --- o ‘yung ano, 10 billion dollars all-in-all, hopefully coming our way,” he said. The Chinese government, the President said, has also allotted one million dollars for the rehabilitation of Surigao, which was hit by a 6.7-magnitude earthquake last month. On another note, the President asked local government officials to timely and effectively use the powers of the local government to restore order in their respective areas. “In some areas in Mindanao, there’s a near-anarchy in the sense that they just throw grenades there at houses and whatever... So may I just plead to you, for those local officials who are in governance, kindly make use of the powers of government to restore order,” he said.

No probative value
The much-ballyhooed testimony of retired Davao city police officer Arthur Lascañas linking former Davao City Mayor and now President Rody Duterte to a clandestine hit squad turned out to be a dud. Senator Panfilo Lacson, chairman of the Senate committee on public order and dangerous drugs, branded Lascañas testimony as having no “probative value.” Senator Lacson was right in saying that Lascañas would no longer return to the Senate to continue his “fairytale” stories. Lascañas is the second person to testify before lawmakers in an effort to link President Duterte in numerous summary executions. The first was Edgar Matobato, the so called “star witness” of jailed Senator Leila de Lima. Both Lascañas’ and Matobato’s testimonies were found by most senators to be dubious and hard to believe since they cannot find any other witnesses to back up their stories. The recent testimony of Lascañas was just a waste of time. It never accomplished anything to ferret out the truth about the existence of a death squad in Davao city. Is there really a Davao death squad or it is only a myth created by the media to sensationalize crime stories in the news. This is what the public wants to find out. Too bad, the people were left hanging in the air. I guess we will never know for sure if the Davao Death Squad (DDS) really existed during the reign of Duterte as city executive for 22 years. PNP Chief Brig. Gen. Ronald De la Rosa, on the other hand, dispelled rumors about the existence of the DDS. General De La Rosa, a former Davao City police chief, denied that there is such DDS existing in the premier city of Mindanao. He claimed that numerous investigations have found no proof of President Duterte to those “salvaged” killings, nor the existence of the DDS. General De la Rosa attributed the unsolved killings of criminals and drug addicts to vigilante groups or drug gang members out to “silence” informants. *** I hope that in future investigations or inquiries on matters of public interest, Senators will be more
prudent and careful in screening their witnesses who will testify in the Senate. If they persist to allow anyone to walk in and testify and spread lies just to get publicity mileage, no one will ever take Senate testimonies seriously anymore. Senators should not allow anybody to just walk in, commit perjury and get away with it. As a result of the apparent sham testimonies of both Lascañas and Matobato, the Senate’s credibility and integrity have been tarnished. I do not know how long will the other hardworking Senators allow this stupid and power-tripper Senator Antonio Trillanes in making them look like fools and converting the Senate as his own personal playground. *** With both Edgar Matobato and Arthur Lascañas discredited by most lawmakers as credible witnesses, Liberal Party (LP) Senators are now looking for other witnesses they could ‘coax’ to tell more lies about President Duterte’s links to death squad. Due to unlimited supply of financial resources at their disposal, the LP and the yellow army will have no trouble finding a willing liar witness to testify, even under oath, but for the right price, to peddle more lies to help undermine the government’s success on its drive against illegal drugs and corruption. I hope Senator Trillanes will allow Senator Franklin Drilon to prep the witness to make him more credible in the eyes of the public as well as to their fellow lawmakers. Trillanes and the sex-starved Senator Leila De Lima (now in jail) did a poor job of coaching Matobato and Lascañas on what to say in their testimonies. No wonder, both of them were discredited as reliable witnesses. As least Drilon, as a lawyer, will be able to polish and coach the witness as to what he will say in his testimony based on what Drilon and his allies want their witness to say on the Senate floor.

Speaker on replacing anti-death House leaders: ‘A policy is a policy’ MANILA, March 8 (PNA) – Speaker Pantaleon Alvarez remains resolute in his decision to replace dissident House leaders who voted against the revival of the death penalty, saying that ‘a policy is a policy’. In an ambush interview on Wednesday, Alvarez said he will discuss with Majority Leader Rodolfo Fariñas the move to declare the deputy speaker and committee chair posts vacant as he pursues his earlier vow to strip anti-death penalty lawmakers of their leadership titles. With 217 votes on the affirmative, 54 negative and one abstention, majority of the congressmen on Tuesday passed House Bill No. 4727, or an act imposing the death penalty on drug-related crimes. Former President and Pampanga Rep. Gloria Macapagal-Arroyo was the only deputy speaker who thumbed down the measure restoring capital punishment. It was during her term as president when the death penalty was abolished back in 2006. When asked if Arroyo will be replaced as deputy speaker, Alvarez replied that “it is as good as day follows night”. Other House leaders who voted against the death penalty bill include: Batangas Rep. Vilma Santos-Recto chairing the committee on civil service and professional regulation; Quezon City Rep. Kit Belmonte chairing the committee on land use; Dinagat Islands Rep. Arlene Bag-ao chairing the committee on people participation; Sorsogon Rep. Evelina Escudero chairing the committee on basic education and culture; Buhay Partylist Rep. Aguirre unfazed by Trillanes motion to probe ‘fake news’ from gov’t officials MANILA, March 8 (PNA) – Justice Secretary Vitaliano Aguirre II on Wednesday that he will appear on any probe once he is summoned by the Senate. Aguirre made the statement in response to Senator Antonio Trillanes IV’s filing of a resolution seeking to investigate “misleading” information peddled by government officials, as he cited the supposed “fake news” of Aguirre and Presidential Communications Secretary Martin Andanar. ”If called to appear before any probe on this issue, (I) will be there the truth as always,” Aguirre said in a statement sent to reporters covering DoJ. But Aguirre asked that the probe
must include government officials who present fake and lying witnesses before Senate investigations. Aguirre has earlier named former Senator Jamby Madrigal and Laguna Rep. Marlyn Alonte-Naguiat as the ones who offered PHP100 million to high profile inmates at the New Bilibid Prison in exchange for their retraction of their testimonies against detained Senator Leila De Lima. Prior to this, the DOJ chief has also tagged Trillanes, along with Liberal Party Senators Leila De Lima and Francis Pangilinan, as those who are plotting to implicate him in the PHP50-million bribery scandal at the Bureau of Immigration.

MANILA, March 8 (PNA) -The House of Representatives on Wednesday approved on second reading a bill seeking to impose stiffer penalties upon hospitals with policies of refusing to provide basic emergency services to patients who cannot make advanced payments. Through voice voting, the lower chamber passed House Bill No. 5159 or the Anti-Hospital Deposit Bill. Akbayan Rep. Tom Villarin, one of the authors of HB 5159, said the bill aimed to ensure that all private and public hospitals would admit patients in emergency situations â&#x20AC;&#x201C; including women in active labor and at risk of miscarriage â&#x20AC;&#x201C; without requiring a deposit fee. â&#x20AC;&#x153;We want to save more lives. Villarin said Upon conviction in court, hospital owners can face from four to six years of imprisonment, and/or fines ranging from Php 500,000 to Php 1,000,000, aside from damages that may be awarded to the patient-complainant. Violating the proposed law for three times may lead to suspension or revocation of erring hospitalsâ&#x20AC;&#x2122; license to operate. In addition, the president, chairman, board of directors or trustees, and other officers of the health facility will be held solidarily liable for the damages that may be awarded by the court to the patient-complainant. Under the bill, the Department of Health is directed to create a mediation board to initially settle complaints before formal and legal charges are filed against hospitals.

MANILA, March 8 (PNA) â&#x20AC;&#x201C; Some 844 new HIV-positive cases were reported to the HIV/AIDS & ART Registry of the Philippines (HARP) last January, the Department of Health (DOH) said Wednesday. â&#x20AC;&#x153;This is 5 percent higher compared to (the figure in) the same period last year, which is 804,â&#x20AC;? the HARP said in its report. It is also the highest so far since 1984, when the first case of HIV was reported. According to HARP, 96 percent of the cases were male and that the patientsâ&#x20AC;&#x2122; ages ranged from 3 years to 66 years, with a median age of 27 years. More than half belong to the 25 to 34 age group and 31 percent to
the 15 to 24 age bracket. The National Capital Region (NCR) registered the most number of cases with 307 (36 percent), followed by Calabarzon with 151 (18 percent); Central Luzon with 91 (11 percent); Central Visayas with 62 (7 percent); and Davao with 50 (6 percent). Some 826 of the patients contracted the virus through sexual contact, while 16 caught it through needle-sharing with injecting drug users (IDU). There were two cases of mother-to-child transmission. A total of nine pregnant women were among those who tested positive for HIV, seven of whom were from the NCR, one from the Ilocos region, and one from Central Visayas.
Public urged to lead healthy lifestyle to prevent obesity, kidney disease MANILA, March 7 (PNA) â&#x20AC;&#x201C; A kidney that fails does not regenerate. The warning came from Dr. Victor Doctor, president of the Philippine Society of Nephrology (PSN), as he and PSN board member, Dr. Ronald Perez, encouraged the public to help raise public awareness on the link between obesity and Chronic Kidney Disease (CKD), during a health forum held at Annabelâ&#x20AC;&#x2122;s Restaurant in Tomas Morato Ave. Tuesday. The forum marks the celebration of World Kidney Day on March 9, which is a joint initiative of the International Society of Nephrology and International Federation of Kidney Foundations, in cooperation with PSN, under the Philippine College of Physicians. According to the two doctors, obesity, which often starts during early childhood, leads to â&#x20AC;&#x2DC;hyperfiltrationâ&#x20AC;&#x2122; or the overworking of the kidneys. Obesity is the result of taking more food or calories that are more than needed for physical activities and growth. With obese bodies, kidneys tend to overwork in an effort to meet the metabolic demands of the increased body weight, resulting in premature kidney aging. Dr. Doctor pointed out that diabetes and hypertension are also risk factors of Chronic Kidney Disease. He explained that these non-communicable diseases start during early childhood but go undocumented until adulthood because the child doesnâ&#x20AC;&#x2122;t show symptoms. â&#x20AC;&#x153;Early on in the life of an individual, the kidneys are already subjected to stress, and wear and tear. This does not show until you are at early adulthood. More so, chronic kidney disease occurs, manifests during adulthood,â&#x20AC;? he said. Increased food intake, too much sugar, salt, fat or proteins in food, as well as an inactive lifestyle are the primary culprits of obesity, which increases the risk of developing major risk factors of CKD, Doctor said. The proliferation of different fast-food chains in the country, which leads to poor diet, as well as the advent of technology and gadgets resulting in inactive lifestyle among children nowadays are also to blame, said Dr. Perez. Some 22.3 percent of Filipino adults are overweight and 6.1 percent are obese, according to a 2011 survey conducted by the Food and Nutrition Institute (FNRI).

Obamacare replacement plan update Controversies surround the replacement plan. The Democrats claim that the Republicans do not have a replacement plan. Speaker Paul Ryan countered that the bill is being debated in the House committees (where it should emanate in the first place) so the debacle that happened with Obamacare will not be repeated. Remember then Speaker Nancy Pelosiâ&#x20AC;&#x2122;s famous quip: â&#x20AC;&#x153;You have to approve it to know what is in itâ&#x20AC;?? And, then, there is Senator Rand Paulâ&#x20AC;&#x2122;s rant that he does not have a copy of the bill being debated. He, together with some House members who belong to the House Freedom Caucus, is opposed to refundable tax credits and further expansion of MedicAid as these may take the form of entitlement like Medicare and Social Security which are having enormous problem with their funding. President Trump claims that he inherited a mess that is Obamacare. He realized in his admission that repealing and replacing the law is not easy after all. For instance, how will he tell the 11 million MedicAid beneficiaries under Obamacare that they will be losing their coverage in the new plan? No way. In his shoulders, now, rest the gigantic responsibility of coming out with a plan that addresses the various, oftentimes opposing, concerns of the legislators and one that will be loved by all Americans. My take: Ignore the political noise. Medicare and Social Security will be safe for now. Congressional leaders and Health and Human Services (HHS) officials are working together
to deliver to President Trumpâ&#x20AC;&#x2122;s table a document (bill)that he will sign into law probably by the end of March. And, based on the principles laid down by President Trump himself in his recent address to Congress, the following will be found in the new law: State governors will have the â&#x20AC;&#x153;resources and flexibilityâ&#x20AC;? with MedicAid (MediCal in CA) to make sure no one is left behind. Those with pre-existing conditions will continue to have access to coverage and will experience smooth transition to a new plan. Americans may choose their coverage plan and make use of tax credits and expanded Health Savings Accounts (HSA). Americans will have the freedom to purchase health insurance across state lines. There will be provisions that will make child care accessible and affordable. There will be a mention of womenâ&#x20AC;&#x2122;s health, too. Overall, the new plan will address reforms that expand choice, lower costs, increase access and provide better health care. 41 Antipolo kids receive free surgery for cleft palates, lip deformity ANTIPOLO CITY, Rizal, March 9 (PNA) â&#x20AC;&#x201C; The Antipolo City government reported on Thursday that 41 children with cleft palate and lip deformity have undergone successful surgical operations for free. The city government said in a news release that it conducted the free Joint Cleft Care Surgical Program in partnership with physicians of the Antipolo City Hospital System â&#x20AC;&#x201C; Annex I and volunteer doctors of the Philippine Band of Mercy. Antipolo City Mayor Casimiro Ynares thanked the doctors and the Philippine Band of Mercy for the free

Yoga may help combat depression: study BOSTON, March 8 (PNA/PTI) â&#x20AC;&#x201C; Participating in yoga and deep breathing classes twice a week along with home practice may effectively reduce the symptoms of depression, a new study claims. The findings provide support for the use of yoga-based interventions as an alternative or supplement to pharmacologic treatments for depression, researchers said. â&#x20AC;&#x153;This study supports the use of a yoga and coherent breathing intervention in major depressive disorder in people who are not on antidepressants and in those who have been on a stable dose of antidepressants and have not achieved a resolution of their symptoms,â&#x20AC;? said Chris Streeter, associate professor at the Boston University School of Medicine in the US.
Major depressive disorder (MDD) is common, recurrent, chronic and disabling. Due in part to its prevalence, depression is globally responsible for more years lost to disability than any other disease, researchers said. Up to 40 percent of individuals treated with antidepressant medications for MDD do not achieve full remission. The study, published in the Journal of Alternative and Complementary Medicine, used lyengar yoga that has an emphasis on detail, precision and alignment in the performance of posture and breath control. Individuals with MDD were randomized to the high-dose group, three 90-minute classes a week along with home practice, or the low-dose group, two 90-minute classes a week, plus home practice.

New mortgage guidelines might be coming soon The regulatory regime constructed under the Dodd-Frank Act is in the process to be wiped out, it will mean chaos in the financial sector. Lenders have spent untold millions working to comply with new regulations and guidelines, and that can’t be reversed quite so easily. However, an administration (including a Department of Justice) that takes a more moderate position on enforcement and litigation may have the effect of loosening up lending a bit. Fannie Mae And Freddie Mac: New Rules For 2017 Mortgages During late 2016 and early 2017, Fannie Mae and Freddie Mac made some changes to their processes. Since these two organizations back about half of all mortgages in the US, it’s a big deal. Here are some important things to know about conforming 2017 mortgages. You May Not Need An Appraisal For some refinances, you may not need a property appraisal. Your lender may give you a PIW, or Property Inspection Waiver. To qualify, the loan must be underwritten electronically through Fannie Mae’s Desktop Underwriter (DU) system. DO/DU is a common online approving tool that most lenders use to comply with Fannie Mae and Freddie Mac guidelines. Fannie Mae possesses appraisal information for millions of properties. It uses this data to check your home value. If the software decides your home value is acceptable, you’re good to go. No appraisal needed. DU issues decisions within minutes, so you know right away if you qualify for a waiver. Freddie Mac has a similar program called Home Value Explorer. It’s available for refinance loans underwritten by its Loan Prospector (LP) program. Loan Limits Are Higher
More homebuyers can get 2017 mortgages without paying higher jumbo interest rates. Because of rising property values, the Federal Housing Finance Agency (FHFA) raised standard conforming loan limits from $417,000 to $424,199. This is the first increase in a decade. The standard loan limit applies to most of the US. However, in designated “high cost” areas, the FHFA set limits at 115 percent of the local median home value. That maxes out at 150 percent of the standard limit, or $636,150. Solar Panels Get Special Treatment Starting in March 2017, Freddie Mac mortgage guidelines will be kinder to homes with solar panels, whether owned by the borrower or leased from a third party. Its guidelines are being updated to allow underwriters to exclude solar panel lease payments from applicants’ debt-to-income ratios. New updates will indicate how the lease must be structured to qualify. HARP Extended And Replaced In 2017 The HARP program was created to allow eligible borrowers with Fannie Mae or Freddie Mac loans to refinance, even if their loan balance exceeds their property value. Those eligible for the Home Affordable Refinance Program (HARP) have until September 2017 to complete it before the program terminates. However, in October 2017, HARP
DICT urged to present approved nat’l broadband plan to stakeholders MANILA, March 7 (PNA) – Sen. Paolo Benigno Aquino IV on Tuesday urged the Department of Information and Communications Technology (DICT) to present the newly-approved National Broadband plan to stakeholders, experts and other concerned groups for suggestion and scrutiny. Aquino, chair of the Senate Committee on Science and Technology, made this call after Pres. Rodrigo Duterte on Monday approved the National Broadband Program which seeks to improve Internet connectivity and speed particularly to remote areas of the country during the 13th cabinet meeting. “We are glad that the government approved the national broadband plan which can help improve the quality of internet in our country,” Aquino said. “Now that the plan is approved, we call on DICT to present it to stakeholders, experts and other concerned organizations for scrutiny and suggestion to ensure that it will be an effective one,” he added. Aquino said that his committee will conduct a hearing where the DICT can provide details of the plan. The DICT previously presented three options to implement the PHP75-billion plan during last year’s committee hearing including its preferred way of investing in Internet infrastructure, like fiber optic
cables, especially in underserved and hard-to-reach areas. Under this option, the government will also use the existing infrastructure of current players and encourage new players to develop new internet infrastructure. The senator previously sponsored Senate Bill No. 1277 or the Free Internet Access in Public Places Act, which is being currently tackled in the plenary. If enacted into law, free internet access will be provided in all national and local government offices, public schools, public transport terminals, public hospitals and public libraries. DICT is expected to rollout the groundwork for the national broadband network within the first half of the year and could be accomplished within the term of the President. The department is opting for a hybrid system wherein the infrastructure could be rented out and services of the telcos including their physical components could be tapped as part of the network if it would be more cost-efficient to the government. This would enable the government to save costs and would not duplicate infrastructure in areas already covered by telcos. DICT Secretary Rodolfo Salalima said the cost of the national broadband plan is estimated to be at around PHP77 billion to P200 billion.

Inflation rises but within PHL target in February 2017 MANILA, March 7 (PNA) – Inflation in February 2017 rose to 3.3 percent from 2.7 percent in the previous month due to upward price adjustments in both food and nonfood items, according to the National Economic and Development Authority (NEDA). “The inflation outlook for 2017 remains within the government’s target of 2.0 to 4.0 percent However, risks to the inflation outlook appear to be tilted to the upside. This could drive inflation towards the higher end of the target,” said Socioeconomic Planning Secretary Ernesto M. Pernia. Faster price increases in rice, meat, fish, and vegetables pushed up the food subgroup inflation to 4.3 percent in February 2017 from last
month’s 3.6 percent. For meat products, the country’s temporary ban on poultry imports from South Korea, Germany, France, Netherlands, Czech Republic, and Kuwait in response to the Avian Flu outbreak may have contributed to the limited supply. Also, the higher rice prices can be attributed to lower rice stock inventories, which fell by 17.9 percent in January 2017 to December 2016, due to the contraction in palay production in the fourth quarter of 2016. In addition, the price increases of housing, water, electricity, gas, and other fuels drove the non-food subgroup inflation to 2.5 percent in February 2017 from last month’s 2.0 percent.

with her father, and to know more about the country. The 19-year-old said she decided to go back to the Philippines after her last vacation. “When I came last July for a holiday, I was really drawn to the idea of coming here, and my mom was kind of the one who planted the idea in my head. She saw how much I was enjoying myself and how much I felt at home, so she said, you can come here if you want, nobody’s stopping you,” Leila said.
The move was difficult for the two, especially since Leila considers her mother as her best friend. “It was difficult for her because she was going to miss me, and I was going to miss her. We’re not used to not seeing each other everyday. It was difficult in that way but in terms of letting me go and encouraging me to go, she had no difficulty because she was being supportive,” Leila said. Leila is currently studying Filipino and having voice lessons to improve her singing voice. (MNS)
