1st impeachment complaint filed vs Duterte for killings, graft
MANILA, Mar 16 (Mabuhay) – A former soldier turned lawmaker on Thursday filed an impeachment complaint against President Rodrigo Duterte, the first move to oust the Chief Executive just a few months after his election into office. Magdalo Rep. Gary Alejano filed the impeachment complaint before the Secretary General of the House of Representatives, who would determine if the form and substance of the complaint is sufficient to have the President impeached. Among the basis of impeachment are culpable violation of the Constitution,
bribery, betrayal of public trust, graft and corruption, and other high crimes. It remains to be seen if the impeachment complaint would survive the lower house dominated by a supermajority of allies of the administration. Chinese envoy to PHL: Produce, export more products to China By Kris M. Crismundo
MANILA, March 15 (PNA) – Chinese Ambassador to the Philippines Zhao Jianhua has urged Filipino businessmen to produce more products and increase their exports to China, as the East Asian country is keen to boost trade here. Zhao told reporters on the sidelines of Philippine-China Business Talk and Signing Ceremony in Makati City on Wednesday that trade missions of Chinese firms and visits of government officials in the country reflect the strengthening of economic ties between Manila and Beijing. On Wednesday, 18 Chinese firms have signed purchase deal here with nearly 30 Philippine-based companies mostly engaged in agribusiness, chemical and mineral products. Zhao said the aggregate amount of the purchase deal reaches USD1.7 billion. “So, the Chinese market is wide open for the Filipino products, and the demands are insatiable. So, produce more and export more to China,” the envoy stressed. He noted that this effort of increasing imports from the Philippines is to achieve balance of trade between the two countries. “This is a direct response to the President’s (Rodrigo Duterte) request because he cared about involving the farmers. And, this is also an effort to balance our trade. China has been having surplus in bilateral trade. And we’re not seeking surplus, we want to balance it,” Zhao said. Philippine Statistics Authority (PSA) data showed that the country has merchandise trade deficit of USD8.8 billion in 2016, with the Philippines importing more from China. In 2016, China is the country’s top import source with receipt reaching USD15 billion. On the other hand, China ranked as fourth largest export market for Philippine goods in 2016 – only next to Japan, United States, and Hong Kong – with exports revenue to China amounting to USD6.2 billion. On the other note, as Philippine Trade Secretary Ramon Lopez mentioned that production capacity among Filipino companies remains a challenge to cater to the world’s largest market, the Chinese envoy said this is an opportunity for Chinese companies to invest in the country and help local companies to increase their capacity. “As Secretary Lopez said, if you had a capacity problem to produce more, that is also time for bilateral investments that we can encourage more Chinese to invest such as in agriculture, in industries that will enable the Philippines to produce more so you can export more to China,” Zhao noted. PSA data also showed that China only shared less than one percent of total approved investments last year amounting to USD1.52 billion.

Senate concurs in ratification of Paris treaty By Azer N. Parrocha
MANILA, March 14 (PNA) – The Senate on Tuesday officially concurred in ratification of the Paris Agreement on Climate Change two weeks after Pres. Rodrigo Duterte signed it last February 28. This after Senate Resolution 320 was passed on third and final reading with 22 affirmative votes, no negative votes and no abstentions. This treaty seeks to limit global warming to well below 2 degrees Celsius. To recall, Pres. Duterte initially opposed the ratification of the agreement. He changed his mind about the treaty after most of his Cabinet members voted in favor of what has been described as a landmark global deal to cut harmful carbon emissions that are causing climate change. Sen. Loren Legarda, chair of the Senate Subcommittee on the Paris Agreement under the Committee on Foreign Relations, said the treaty shows that “developing and developed nations could pursue climate action together.” “Paris Agreement is a testament of solidarity and a call for global climate action,” she said in her speech at the Senate plenary. She said the treaty is also a “manifesto for climate justice” noting that countries which have contributed the most to global warming must shoulder the greater burden of acting with greater accountability to the environment. The senator said that it also allows the Philippines to acquire support from developed countries for adap-
tation, mitigation, technology development and transfer, and capacity building. Moreover, she said it also strengthens the country’s role in climate talks by exercising governance, oversight, leadership, and decision-making. She also described it as an “embodiment of a legacy” as it will be recognized as one of the Philippines’ “shining achievements.” “The 17th Congress can be regarded as the legislative assembly that championed climate action, environmental protection, and sustainable development,” Legarda said. “The 17th Congress, under the Duterte Administration, will be remembered for paving the way for green jobs and green growth for the Filipino nation,” she added. Legarda, who is also UN Global Champion for Resilience, previously stressed the importance of the treaty for the Philippines being a vulnerable nation to the impact of climate change. She said that the ratification would allow the Philippines to access to the Green Climate Fund. With the treaty fully ratified, the Philippines will become part of the succeeding meetings about the Paris Agreement. She said that it is to the advantage of the Philippines to be in talks to converge with fellow vulnerable nations.

MANILA, March 14 (PNA) – Proponents of the expanded maternity leave bill have called for a great push for the “full birth” of the bill that would benefit the country’s working women and their children. In a press conference held in Max’s Restaurant in Barangay Commonwealth, Quezon City on Tuesday, Akbayan Senator Risa Hontiveros said that while the bill was successfully passed during the third and final reading at the Senate, it now has to hurdle the House of Representatives for it to turn into a law. “Nais po naming uliting muli ang aming panawagan para ipasa na po ng ating kongreso ang Expanded Maternity Leave Bill (We want to repeat our call for the passage of the Expanded Maternity Leave Bill at the House),” said Hontiveros. Last week, the Senate passed the
bill that grants all female workers, regardless of civil status or the legitimacy of their children, 120 days maternity leave with pay, granting them ample time for recovery and bonding with their babies. The passage of the bill coincides with the celebration of International Women’s Day and Women’s Month every March. “The physical demand of pregnancy alone is challenging. A nine-month pregnant woman carries an average weight of 15 kg. This is as heavy as a regular hollow block or mid-sized microwave oven. Yet, this is but a small fraction of the multiple burden of pregnancy,” Hontiveros said, referring to physical, mental and economic burdens. To illustrate her point, the senator and Atty. MANILA, March 15 (PNA) – Speaker Pantaleon Alvarez on Wednesday said he will declare vacant the posts of dissident House leaders who voted against the administration’s priority bill restoring the death penalty when Congress reconvenes in May. In an ambush interview, Alvarez said he will follow through with his hardline policy of stripping anti-death penalty lawmakers holding key House posts such as deputy speakerships and committee chairmanships. “Siguro pagbalik na namin from the (Lenten) break,” Alvarez said. Alvarez said that he is just waiting for the respective political parties to submit their nominees who will replace the House leaders who voted against the death penalty bill. the burden that the Expanded Maternity Leave Bill would help ease when it is passed into a law. “The existing maternity law does not give enough paid maternity leave for working mothers to fully recover from childbirth, properly care for their child and establish a stronger mother-child bond through breastfeeding,” said Hontiveros. ”An expanded maternity leave bill does not mean a vacation for mothers. We want women to have the chance to take care of their children and their health and well-being without worrying about the economic costs of being away from employment.” For her part, Lai called on the House to reciprocate the action of the Senate in passing its version of the Expanded Maternity Leave Bill. “The country’s alarming statistics on child malnutrition are the result of a lack of a progressive maternity leave policy. Data from the United
Nations Children’s Emergency Fund (UNICEF) showed that in 2011, 65.4 percent or 4.3 million of Filipino children were suffering from long-term chronic malnutrition. Malnutrition was also blamed for about one-third of deaths of children below five years of age,” she said, noting that the data prove that the number of days of paid maternity leave granted to working women in the past was not enough for their newborn to be properly fed. “Thus, nursing mothers who need to return to work are often forced to stop breastfeeding and shift to infant formula. Two-thirds of deaths among malnourished children are associated with inappropriate feeding practices,” she said. Meanwhile, Hontiveros said that while it is true that there are some differences in the number of days of maternity leave in the House version of the bill, both the House and Senate could later reconcile the two versions.

Leyte town adapts ‘ridge to reef’ ecosystem approach MANILA, March 14 (PNA) – A ‘ridge to reef’ ecosystem approach to rural development has been adapted in the remote town of Inopacan in Leyte, which is now a model of a food-secure town where farmers plant jackfruit, dipterocarps and grow tilapia. Socio-economic development at Inopacan is being approached in a different light by Southeast Asian Regional Center for Graduate Study and Research in Agriculture (SEARCA). Inopacan is a third-class municipality with a population of 20,000 people. Instead of identifying development sites based on political classification, a SEARCA project is developing Inopacan based on its topography farm areas, forests and water bodies. The project focuses more on agro-ecological systems of a potential project site. It is being delineated based on pre-determined ecosystem using the ‘ridge to reef’ approach or landscape continuum, said SEARCA rural development experts. This ecosystem-based concept follows SEARCA’s model called ‘Inclusive and Sustainable Agricultural and Rural Development’ or ISARD. ISARD aims projects in poverty-stricken areas to enable poorest of the poor to get out of poverty, noted SEARCA Director Dr. Gil Saguiguit Jr. At the same time, these communities should contribute to conserving the environment. The ISARD project in Leyte is in partnership with Visayas State
University (VSU), Visayas Consortium for Agriculture and Aquatic Resources Program (ViCAARP) and Inopacan LGU. The ‘ridge to reef’ model raises success potential of a poverty alleviation project as communities may be easily asked to participate in development activities. The activities may be either community organization, nursery establishment, fish pond development, tree planting or farming. Under the ‘ridge to reef’ concept, LGU partners are tapped when these are around a watershed or micro-watershed, lake ecosystem including its tributaries. The concept also determines choice of beneficiaries based on landscape ecologies of upland, lowland, coastal and marine ecosystems including ecotones. SEARCA’s ISARD projects get small grants for technical assistance; institutional development and capacity-building; knowledge management and linkaging and networking support. Geographic Information System mapping and Experts Systems developed by ViCAARP will also be deployed to support the project and growers in their decision making processes. Use of all agricultural, rainforest, dipterocarp species (like ‘lauan’ or ‘yakal’) and fishery resources will be maximized with proximity to each other of factors of production (labor and raw materials, machines, land and management).

MANILA, March 15 (PNA) – Overseas Filipino Workers (OFWs) are now exempted from paying terminal fees at the Ninoy Aquino International Airport (NAIA). This initiative was a result of the Memorandum of Agreement (MOA) that was signed between the Department of Transportation- Manila International Airport Authority (MIAA) and 40 airline companies operating at the NAIA. The agreement is consistent with President Rodrigo Duterte’s directive to ensure a seamless and hassle-free experience at the airport to OFWs. The International Passenger Service Charge (IPSC) or the terminal fee worth Php 550 shall be waived for OFWs, pilgrims, Philippine Sports Commission (PSC) delegates and others authorized by law and the Office of the President traveling outside the country starting April 30, 2017. The exemption shall be honored upon purchase of tickets and will also apply to online purchases effective end of July 2017. Thus, migrant workers no longer need to line up for refund when departing from NAIA.
DFA sets new record on Overseas Voter Registration MANILA, Mar. 15 (PNA) – The Department of Foreign Affairs Overseas Voting Secretariat (DFAOVS) on Wednesday said it has set a new record for first quarter performance. DFA Undersecretary Ariel Y. Abadilla, who is concurrently the chairman of DFA-OVS, said in his report to Acting DFA Secretary Enrique Manalo that the 2016-2018 overseas voter (OV) registration that commenced on Dec. 1, 2016 and will end on Sept. 30, 2018 garnered a total of 67,497 new OV registrants wanted to participate in the 2019 elections. The report claimed that it has surpassed the numbers of the first three months of 2014-2015 OV registration with a total of 64,074 new OV registrants and the previous record of 64,917 that was set in 2009. The overseas voter registration in preparation for the 2016 elections netted a cumulative total of 1,376,067 active registered overseas voters. The 826,881 new registrants for

We hope that after revisiting the integration process earlier implemented in 2015 and instituting changes in the process of exemption, our OFWs will have a seamless airport experience.” The MIAA had imposed the integration of international terminal fee in airline tickets purportedly to ease congestion in Manila airports. You do not have to open the door or let the officers into your home unless they have a valid search warrant signed by a judge. o An ICE deportation warrant is not the same as a search warrant. If this is the only document they have, they cannot legally come inside unless you verbally agree to let them in. • If the officers say they have a search warrant signed by a judge, ask them to slide it under the door or hold it up to a window so you can see it. • If the warrant does not have your correct name and address on it and is not signed by a judge you do not have to open the door or let them inside. • If at any point you decide to speak with the officers, you do not need to open the door to do so. PNP dares VP Robredo to be specific on alleged ‘palit-ulo’ scheme By Perfecto T. Raymundo
MANILA, March 15 (PNA) – The Philippine National Police (PNP) on Wednesday dared Vice President Leny Robredo to be specific and not to generalize the allegations of “palit-ulo” scheme. In a press conference in Camp Crame, Quezon City, PNP Public Information Office (PIO) chief and spokesman Senior Supt. Dionardo Carlos urged the Vice President to point out specific instances of the so-called “palit-ulo” scheme allegedly being implemented by the PNP in its anti-drug operations. Robredo had earlier accused the PNP of allegedly undertaking a “palit-ulo” scheme where a family member of a known drug personality is taken into custody if the drug suspect could not be located. She also accused the PNP of allegedly committing human rights abuse in their practice of herding people from poor communities into an open area in conducting search operation for drug suspects. Carlos said the so-called “palit-ulo” is not proper police procedure, and that the PNP will not tolerate such action in conducting “Oplan tokhang” or “Oplan
taphang”. ”Clearly, if we follow provisions of ‘Oplan tokhang, well if they were referring to ‘Oplan tokhang 1’, maliwanag doon na ang ating ginagawa ay kakatok sa mga bahay-bahay upang hikayatin silang sumuko,” he said. He, however, confirmed that the PNP regularly gathers members of the community in one common area in carrying out “Oplan taphang”, or “gather and plead”. ”So kung ito ay gathering them in one place, (Oplan) ‘ taphang’ ito. We gather and plead kasi malalayo yung mga lugar, nagagawa natin ito sa mga malalayong kabihasnan, yung malalayong bahay-bahay sa kabundukan,” Carlos said. MANILA, March 14 (PNA) – President Rodrigo Duterte on Tuesday said that the government is again engaged in dialogues with the Communist Party of the Philippines-New People’s Army-National Democratic Front (CPP-NPA-NDF) but stressed that parameters for a ceasefire would be clearly set. In his speech before the 1st general assembly of the League of Municipalities of the Philippines (LMP), the President said that back channel talks have been revived despite sporadic clashes between government forces and communists rebels. “We are talking to the communists, I’m still biding my time. There’s a back channeling. I’m not supposed to talk about it because it’s back channeling. But I have certain conditions or demands that we have to agree upon,” Duterte said. However, he said that parameters for a ceasefire should be clearly set in a document that would bind both parties. “I want a ceasefire that is reduced in writing and the parameters clearly shown where we are going and what should be done in case of failure,” the President said. “We have to play fair for everything, but it is still a little vague until now. I cannot expound on it further. But we have some must-do in order to achieve peace,” Duterte said. The President made the statement a day after the government panel led by Secretary Jesus Dureza and NDF leaders agreed to resume negotiations by the first week of April. Negotiations were stalled after both sides lifted their respective unilateral ceasefires in early February, with the NPA making the first move. Last week, Duterte ordered government forces to use all its assets in an all-out war against the rebels following the ambush-killing of four policemen by suspected New People’s Army (NPA) members in Bansalan, Davao del Sur. On Monday, Dureza announced that the government is expected to meet with the communist panel in April after successful back channel talks held last March 10 and 11.

CAGAYAN DE ORO CITY, March 14 (PNA) – Religious leaders, government officials and non-government organizations in Misamis Oriental welcome the resumption of the peace talk between the government and the Communist Party of the Philippines (CPP). Provincial Governor Yevgeny Vincente Emano of Misamis Oriental said on Tuesday that he was glad that the government and the CPP have agreed to return to the negotiating table to end the more than 40-year-old insurgency in the country. “Every one of [us] believed that an enduring peace is the only ingredient that could propel this country to a new height of progress and development,” Emano said. Bishop Felixberto Calang, an influential leader of the Iglesia Filipiniana Independiente (IFI) and CoChair of the Philippine Ecumenical Peace Platform (PEPP) Northern Mindanao, said that the religious
sector is elated of the positive development. He said that the government and the CPP made a joint statement that both parties had agreed to continue the formal peace talks on the first week of April. Calang said that the peace talk is not merely the absence of war, but should also focus on socioeconomic reforms that would address the roots of the civil war, especially on genuine land reform, national industrial development, the welfare of the workers, social services and ecological protection. He said that the religious leaders, NGOs, and stakeholders held a Mindanao wide gathering for a “just and lasting peace” in Davao City on Tuesday to Wednesday. Jomorito Goaynon, the Chairperson of the Kalumbay Lumad Organization in Northern Mindanao, said that the indigenous people in Northern Mindanao have welcomed the resumption of the peace talk with enthusiasm.

Time to speak up against gun sales to mentally ill people As soon as this author learned about a bill called “the Veterans Second Amendment Protection Act” sponsored by Representative Phil Roe, a Republican from Tennessee, who is Chairman of the House Committee on Veterans Affairs and currently being backed by the National Rifle Association (NRA), is currently being sent to the U.S. House of Representatives for approval. This bill, “prohibits the Department of Veteran Affairs from submitting to the federal criminal background check system, the records of veterans with severe mental illnesses, without judicial rulings,” I was practically appalled. I felt that, it is our duty as citizens of this country to take the opportunity to now speak up against this bill , which earlier on the news this week, was supported by “14 retired admirals from all branches of the military sending a letter to congressional leaders urging them to oppose the bill. Veterans, they argued, are at a higher risk of suicide compared to the U.S civilian population. Among the retired officers who signed the letter were: Generals David Petraeus, Michael Hayden and Stanley McChrystal, Admiral Thad Allen, as well as a former CIA Director.” Upon further research, this author has also learned that last year, the Department of Defense published a 2014 Suicide Defense Report, where it stated “an average of 20 veterans commit suicide each day, two-thirds of whom do so by using a firearm.” Apparently, under the Obama administration, veterans deemed “mentally incompetent” by the VA are placed on the list of individuals who could be denied weapons permits. However, if this current bill
being lobbied by the NRA, passes in the House and Senate and if President Donald Trump signs it into law, according to the article written by Michele Gorman, “the measure would enable the FBI to retroactively delete the records of more than 174,000 veterans who suffer from mental problems such as: long-term post traumatic stress disorder (PTSD), schizophrenia or are mentally unable to manage their finances, is also blocked by the National Instant Criminal Background Check System (NICS) from purchasing firearms.” The NICS is the national database that gun sellers are required to check before selling a firearm. Backed by the NRA, Representative Roe from Tennessee, currently has five other co-sponsors for this bill, which states the VA’s longtime practice, which “arbitrarily” denies some veterans their right of protection. Further, the NRA argues that “only veterans designated as danger to themselves or others, should be blocked from purchasing guns.” According to some news reports,”most Democrats disagree with Roe’s bill, saying it would allow easy access to firearms.” Representative Elizabeth Esty (D-Conn.) a member of the House Veterans Affairs Committee, who represents the district where the Sandy Hook massacre took place, describes the bill as “ hastily crafted, overboard bill,” which won’t
help veterans or communities at all. Though she introduced a “substitute amendment” which would call for a study to examine the effectiveness of the current information-practices between the VA and the NICS, the committee unfortunately, voted down her proposed amendment. Earlier on, during the Bush administration, in the wake of the April, 2007 shooting tragedy at Virginia Tech, Congress passed and President George W. Bush signed legislation “requiring all federal agencies, including the VA to submit the names of individuals who, because of mental incompetence are legally prohibited from possessing guns. Since then, the VA has submitted more than 174,000 mentally incompetent veteran’s names, according to the Veterans’ Coalition for Common Sense, (VCCS) a group established by former Representative Gabrielle Giffords (D-Arizona), who became a gun violence prevention activist after being shot. VCCS claimed that there were 19,000 servicemen and women who
suffer from schizophrenia and another 15,000 have severe post traumatic stress disorder (PTSD). Apparently, Roe’s proposed bill, is the Republicans’ second attempt in the current two-month-old Congress, “to rollback existing federal gun laws. The House and Senate voted to revoke a regulation that prevented certain Social Security recipients with mental health conditions from purchasing guns.” Finally, this author has also learned that earlier this month, President Trump has “signed off on revoking the regulation, which was put into effect after the 2012 Sandy Hook Elementary School shooting.” Now is the time for us to be vigilant and speak up, write to our Representatives in Congress to block this bill, in order to protect our loved ones from experiencing the sad memories of the Virginia Tech massacre and the Sandy Hook shootings, brought about by mentally incompetent people who are allowed to have the permission to purchase these lethal firearms.

Senior scammed out of $100k by Internet ‘boyfriend’ needs Chapter 7 relief Client is 65 and a widow. Wanting some male attention, I guess, she posted her picture on the Internet. She looks much younger in the posted picture. She showed me the picture. She looked like she was 48. But she said that the picture was taken only last year. If her purpose was to get some male attention to her picture, she certainly got it. Ah, the wonders of the Internet where romance can bloom without people actually physically meeting each other. I asked her if she ever met the guy. She said she could not believe how stupid she was. I asked her if the guy was American. She said she doesn’t even know if the picture he sent was really he. It started with him asking her for money for legal expenses, then money for this, and money for that. So, I asked her how long has it been going on? It started about 9 months ago. Then I asked her how much she had given him. She said she had given him $100K in 9 months. I said, “Are you serious, you must be kidding!â€? She said she was not kidding. She admitted that her children told her not to do it, as did her friends and other relatives. So I said, “so, why did you do it? How can you give a guy that you have never met, $100K?â€? And her explanation was “I was crazy, I was insane‌â€? It really looks like she went nuts for a while there. Then I asked her where she got the $100K. She said I borrowed from credit cards, banks and relatives for a grand total of $100K. So now she wants to have the guy arrested. Even if she files a police report, it’s next to impossible to find who the guy really is, much less arrest him. This guy could be anyone in the world who he lives in Timbuktu but pretends that he is a good-looking
American guy. I asked her how come she never met the guy in person. She said that he was working, as a seaman so he would be in port for a short time, then would be out at sea for a long time. I asked her for a picture of the guy. She showed it to me. I said, “I think I’ve seen that guy somewhere before. Wait, that’s the most interesting guy in the world, the guy who is the spokesman for some European whiskey brand. Well, obviously, that’s not his real picture. The real guy could be somewhere in Nigeria laughing his way all the way to bank. I asked her if she’s ever heard of the Nigerian scams where you get a call telling you that he is some kind of royalty from Nigeria whose assets have been frozen by the bank. If you wire him $1K, he will be able to unfreeze his bank accounts and send you $1.0 M immediately. It’s so unfortunate that senior women fall for the oldest trick in the gigolo book. I had another client who was 50 but she actually had a real boyfriend who asked her to bring him around the world. The guy treated her as a ‘sugar mommy’. You know how that works, right? The woman being older, the man is younger. He professes that he loves her but that love has to be “sugared� with cash and exotic trips around the world. Well, the easiest way to sugar this love is to use credit cards. My other client maxed out her credit cards at $180K for so many trips around the

DPWH warns public anew vs. scammers posing as gov’t oďŹƒcials MANILA, March 14 (PNA) – The Department of Public Works and Highways (DPWH) has warned anew the public against unscrupulous individuals using the name of top officials for personal or financial interests. DPWH Secretary Mark Villar, earlier issued a memorandum cautioning officials and employees of persistent attempts of solicitation by people posing as high-ranking officials. The warning was issued based on reports that unidentified individuals are claiming to be Senior Undersecretary Rafael Yabut and looking for contractors for imminent projects of the agency while some pretend to be staff of Undersecretary Karen Olivia Jimeno. The DPWH noted that invitations to bid for the procurement of goods, infrastructure projects and consulting services are being published
on national newspaper and DPWH official website and in no way being announced through phone call or text message. At the same time, the department reminded its internal and external stakeholders that a streamlined procurement process is strictly being followed to ensure competitive and transparent bidding. It also stressed that solicitation, by way of selling raffle, fundraising, event, sponsorship tickets and the like among DPWH stakeholders that include contractors, suppliers and consultants including its endorsement, is absolutely prohibited. With this, the DPWH urged the public not to easily believe such communication and should verify its authenticity to the Stakeholders Relations Service at telephone number (02)304-3077 to prevent fraudulent practice of solicitation.

Disclosure of text messages, e-mails, and facebook info of a spouse or signiďŹ cant other may constitute domestic violence Domestic violence is abuse perpetrated against a spouse, former spouse, cohabitant, former cohabitant, a girlfriend, a boyfriend, the mother or father of your child, your child. Family Code Section 6211. Abuse is not limited to the actual infliction of physical injury or assault. Family Code, § 6203(b). A court may issue an order enjoining specific acts of “abuseâ€? (§ 6218, subd. (a)), which are defined as, among other things, behavior that could be enjoined under section 6320. (§ 6203, subd. (d).) Section 6320, in turn, permits a court to enjoin a party from engaging in various types of behavior, including “disturbing the peace of the other party.â€? (§ 6320, subd. (a).) “[T]he plain meaning of the phrase ‘disturbing the peace of the other party’ in section 6320 may be properly understood as conduct that destroys the mental or emotional calm of the other party.â€? (In re Marriage of Nadkarni (2009) 173 Cal.App.4th 1483, 1497, 93 Cal.Rptr.3d 723 (Nadkarni ).) The phrase includes “destroying the mental or emotional calm of [a former spouse] by accessing, reading and publicly disclosing her confidential e-mails.â€? (Id. at p. 1498, 93 Cal. Rptr.3d 723.) The expansion of the term “disturbing the peaceâ€? to cover accessing, reading, and publicly disclosing electronic communication has profound effect in every divorce and family law case. In Nadkarni, a former wife alleged that her ex-husband had accessed her private e-mail account while she was away on a business trip, then attached copies of the e-mails to documents filed in proceedings regarding custody of their teenaged children. In re Marriage of Nadkarni (2009) 173 Cal.App.4th 1483, 1497, 93 Cal.Rptr.3d 723. She sought a permanent restraining order, but the trial court denied it without a hear-
ing after finding that the DVPA did not cover situations in which there was no physical harm alleged. The appellate court reversed and remanded the matter to the trial court for a hearing. It held that the definition of abuse under the DVPA is not limited to the infliction of physical injury or assault. Id. at pp. 1498, 1501, 93 Cal. Rptr.3d 723. In Marriage of Evilsizor and Sweeney, husband’s actions in releasing and threatening to release personal data downloaded from wife’s cell phone constituted “disturbing the peace of the other party� and thus “abuse� which warranted restraining order. I’m sick to my stomach. My friends are mad at me, embarrassed as if I let him. I didn’t know he was even doing any of this. My parents are upset, you know. Why did I marry him? I didn’t know that things were going—I didn’t know. Yeah. It’s been incredibly challenging to live with.� She further testified that she had suffered shock and embarrassment and feared for her safety because of the disclosure. Evilsizor also was concerned about Sweeney’s threats to reveal information to the Internal Revenue Service about “things [she] didn’t do.� The court concluded in the Evilsizor case that even if Sweeney legally obtained Evilsizor’s information, an issue left unresolved, it was authorized under the DVPA to enjoin the disclosure or threats of disclosure of the information to protect Evilsizor’s peace of mind. The court ordered Sweeney be “prohibited from using, delivering, copying, printing or disclosing the messages or content of [Evilsizor’s] text messages or e-mail messages or notes, or anything else downloaded from her phone or from what has been called the family computer except as otherwise authorized by the court.� Sweeney also was prohibited from trying to access or otherwise interfere with Evilsizor’s internet-service provider accounts or social-media accounts. Text messages, E-mails, Social media, and other electronic communication has become a common and inseparable part of today’s lifestyle.
Accessing, reading, and publicly disclosing electronic communication of an ex, spouse, or sgnificant other has profound effect in every divorce and family law case. After a debtor receives a discharge in bankruptcy, creditors whose debts are discharged are required to report that the account has a zero balance. The fact of the filing itself can remain on the credit report for 10 years from the date it was filed. A debtor interested in re-establishing credit after bankruptcy should obtain credit reports from the 3 largest credit reporting agencies, (Experian, Equifax, and Trans Union) and ensure that the account balances have all been zeroed out. If not, the debtor should contact the credit reporting agencies and ask that the record be corrected Methods of Re-Establishing Credit A debtor seeking to re-establish credit should consider applying for a secured card, usually a Visa or Master Card. This is a credit card issued by a bank to a customer who is required to establish a savings account at the bank, which is used as security or collateral for the card. Typically, the limit on the card is based on the amount of collateral put up in the form of the savings account. Often, the bank will have an annual fee. The benefit of the secured card is that banks will issue them to persons with poor credit reports in the past, but who have the ability to pay the deposit to secure the account. Major store cards are also a good addition to building credit. Once you have a major credit card, even a secured card, itâ&#x20AC;&#x2122;s usually all thatâ&#x20AC;&#x2122;s required to open an account at a major store, such as JCP, Kohls, etc. Other methods include buying a car from a local car dealer who advertises that it specializes in making car loans to persons with bad credit or recent bankruptcies. Also, a debtor with a personal relationship with someone at a local bank should not hesitate to seek assistance from that source. There are also financial institutions that target recent bankruptcy people seeking credit. This also includes mortgage companies. Several major companies will consider a mortgage within 1 to 2 years from the bankruptcy discharge. The reason these companies are interested in bankruptcy discharge consumers, is because they cannot file a bankruptcy again for 8 years, do not owe money, have a good debt to income ratio (Income from employment, all debts discharged in bankruptcy), and finally, they get to charge more than regular financial institutions. Bottom line â&#x20AC;&#x201C; itâ&#x20AC;&#x2122;s a business, and a good business at that. Caution in Rebuilding Credit Ultimately, however, debtors emerging from bankruptcy should use their experience to avoid getting into the same financial traps, which snared them before. All too often, this was the easy availability of unsecured credit in the form of unsolicited, pre-approved, credit cards. Debtors should take steps to budget properly, not spend beyond their means, and resist the temptation to incur debt beyond their reasonable ability to repay just for the purpose of re-establishing credit. Debtors should avoid being enticed by so-called â&#x20AC;&#x153;credit repairâ&#x20AC;? agencies. These are often simply unregulated rip-offs, who prey on the financially-distressed, and who do nothing more than what debtors themselves can do by exercising their legal right to have their reports properly list their outstanding obligations. Income Taxes in Bankruptcy As a general proposition, older
income taxes (more than 3 years old) can be wiped out in bankruptcy; newer income taxes (less than 3 years old) cannot. A debtor/employer can wipe out the employerâ&#x20AC;&#x2122;s portion of older, but not newer, payroll taxes. The discharge ability of state and local, such as sales and use taxes, will depend upon their true nature, i.e., whether they are excise or withholding taxes. The trust fund portion of payroll taxes is generally not dischargeable. Prior to filing bankruptcy, the debtor should have his own particular tax situation assessed. Test for Wiping Out Income Taxes The Test for wiping out income taxes in bankruptcy include: The tax return was due more than 3 years prior to the filing The tax return was filed at least 2 years prior to the filing The tax has been assessed for at least 240 days prior to the filing The tax is not based on a fraudulent return There was no willful tax evasion by the debtor. In Chapter 13, income taxes can be wiped out if the return was due more than 3 years prior to the filing, and was assessed at least 240 days prior to the filing. In some cases, the tax may be dischargeable even if not assessed prior to the filing. Income Tax Liability Under the Internal Revenue Code, as a general rule, forgiveness of indebtedness constitutes income to the debtor. However, there is an exception where the debtor receives a discharge in bankruptcy. Can Utility Debts Be Discharged in bankruptcy? Public utilities, such as the gas and electric company, are not permitted to discontinue service because of a bankruptcy filing. However, if the utility bill is included in the bankruptcy and not paid, then the utility has the right to demand that the debtor pay a deposit within 20 days to ensure the continuation of service. Sometimes, the requested deposit is several times the amount of the bill, so it often makes sense for a cash-strapped debtor to simply pay the bill. Utility bills for service arising after the bankruptcy filing is not included in the bankruptcy, and must be paid. Does the Bankruptcy Code prohibit discrimination based on a bankruptcy filing? The Bankruptcy Code contains an â&#x20AC;&#x153;anti-discriminationâ&#x20AC;? provision, stating that government units and private employers may not discriminate against a person solely because that person has filed bankruptcy or was insolvent. Also, if a debtor has lost his driverâ&#x20AC;&#x2122;s license solely because of his inability to pay damages resulting from an accident, then a bankruptcy discharge will allow the debtor to get his license back. Donâ&#x20AC;&#x2122;t just take our word for it but the World Economic Forum in Davos, Switzerland just announced that Canada ranks as the second best country globally in March 2017. Germany was first, Canada second, the United Kingdom third, the United States fourth and Sweden fifth. Canada ranked number one for quality of life for the second straight year. New air route to Nueva Viscaya launched in Berlin MANILA, March 14 (PNA) â&#x20AC;&#x201C; A local airline has launched a new flight to Nueva Vizcaya, home of the world-famous Banaue Rice Terraces during a recent tourism trade fair in Berlin, Germany, the Internationale Tourismus Borse (ITB). The Department of Tourism (DOT) said the new flight of Wakay Air Services from Clark International Airport to Bagabag

DFA: Benham Rise part of PHL’s EEZ under 2012 UN ruling By Sammy F. Martin
MANILA, Mar. 14 (PNA) – The Department of Foreign Affairs (DFA) on Tuesday reiterated that Benham Rise is part of the Philippines’ continental shelf and Exclusive Economic Zone (EEZ). In a press briefing, DFA Spokesman and Assistant Secretary Charles Jose said Benham Rise is part of our marine territory “that is why we exercise our marine rights and jurisdiction.” “We recognize freedom of navigation including the right of innocent passage of other countries passing our EEZ,” he told reporters. As we exercise sovereign rights and jurisdiction, Jose pointed out that the Philippines has the sole right to explore, exploit and manage the natural resources of Benham Rise. “I think it is our responsibility to conserve and protect what is ours against anyone who want to enter our EEZ without our permission,” Jose said. The spokesman said that Benham Rise is part of our maritime territory within the EEZ, including the extended continental shelf. He emphasized that no country can claim Benham Rise because it is very clear that it is within our territory under the 2012 United Nations ruling on this issue. “I think yung sinasabi ng China is may karapatan yung ibang bansa dito dahil tayo naman ay nag-aadhere sa rule of law, sinasabi nga sa UNCLOS that any country have the right to pass by our maritime territory under the principle of freedom of navigation and right of innocent passage. We recognize those principles,” he noted. Asked about the note the Philippines sent to China, he said the Philippines is asking clarification why their ship passed by at slow pace which is not normal. The Philippines’ claim to Benham Rise, a 13-million-hectare area located east of Luzon island and believed to be rich in gas, was approved by the United Nations in 2012. China’s foreign ministry spokesperson Geng Shuang had acknowledged the 2012 ruling of the United Nations but said “it does not mean that the Philippines can take it as its own territory.” Geng confirmed Chinese vessels for “marine research” passed through Benham Rise, but insisted this was only in exercise of the principle of “freedom of navigation” and “right to innocent passage.”

ICC case vs Pres. Duterte doomed to fail – solon
MANILA, March 15 (PNA) – Kabayan Partylist Rep. Harry Roque on Wednesday said the case to be filed against President Rodrigo Duterte before the International Criminal Court (ICC) is doomed to fail. In a statement, Roque cited the principle of complementarity which states that Philippine courts have primary jurisdiction in any complaint for crimes against humanity. Roque further explained that the ICC as a “court of last resort” will only exercise jurisdiction when Philippine courts are unwilling or unable to do so. “It (ICC) was intended to complement, not replace, national courts in ending the gravest crimes against the international community,” Roque said. “The present threats to have President Duterte indicted in the ICC are not simply political threats against him and his campaign against drugs and criminality -- they are also threats that question Philippine
sovereignty,” he added. Roque said the Commission on Human Rights (CHR) is already conducting its own investigation on the matter. Roque expressed doubt that the administration’s relentless drug war would qualify as a crime against humanity. “Primarily, to constitute a crime against humanity, it must be shown that there are acts of murder, persecution, or other prohibited acts, committed as part of a widespread or systematic attack directed against a civilian population,” Roque said. Roque said he does not see the drug war as a “systematic plan to kill drug personalities”. “The fact that over a million people, including drug surrenderers, have been peacefully placed under the jurisdiction of the State shows that the primary intention has always been simply to end the propagation of illegal drugs in the country,” Roque said.
DBM: Rightsizing Bill to cut red tape ‘But not a forced retirement or separation scheme’ MANILA, March 16 (PNA) -- The Department of Budget and Management (DBM) welcomes the support of legislators for the bill Rightsizing the National Government Act of 2017. Senator Loren Legarda, Chairperson of the Committee on Finance and Sub-Committee on Senate Bill Nos. 1339, 1337, 1162, and 1167 of the Committee on Civil Service, Government Reorganization and Professional Regulation, said in her sponsorship speech that the passage of the bill would further enhance the government’s institutional capacity and give more value to taxpayer’s money and be responsive to the changing demands of the public. The National Government’s Rightsizing Program has a function-based approach that would abolish executive agencies with overlapping or redundant operations and functions that result in ineffective and inefficient in the delivery of public services. “Aside from these budgetary implications, a big bureaucracy has a negative impact on government performance and efficiency. For example, the overlapping jurisdictions and redundant functions of several agencies result in confusing regulatory rules, duplicating requirements, red tape and inefficient delivery of public goods and
services, which could be detrimental to the Filipino people,” Legarda said. Legarda added that funding these redundant and outdated agencies is a waste of the country’s limited resources. In the 1st Joint Meeting of the House Committee on Government Reorganization and Committee on Appropriations yesterday, the House representatives have also expressed support for the proposed measure. Addressing the concerns of some legislators, Budget Secretary Benjamin Diokno emphasized that the Program is not about forced retirement or separation of affected regular employees. Regular personnel whose positions would be affected in the implementation of the Program shall have the option to (1) avail of retirement benefits and separation incentives, or (2) be placed by the CSC in agencies needing additional personnel. A Committee on Rightsizing the Executive Branch will be created to oversee the implementation of the Program, composed of the Executive Secretary as Chairman, and the Secretary of Budget and Management as Co-Chairman, with the Secretary of Socio-Economic Planning, Chairperson of the Civil Service Commission (CSC), and the Head of the Presidential Management Staff, as members.
France hails PHL Senate for Paris Agreement on Climate Change ratification MANILA, March 15 (PNA) –The Embassy of France in the Philippines on Wednesday hailed the Philippine Senate for the ratification of the Paris Agreement on Climate Change. In a press statement, French Embassy said the Philippines now joins 133 other parties to the Paris Agreement, representing more than 80 percent of global greenhouse gas emissions. The road to the Paris Climate Conference (COP21) started in the Philippines when the Manila Call to Action on Climate Change was launched during French President François Hollande’s state visit to the Philippines in February 2015. “This call to the international community symbolized our shared commitment in the fight against climate change. The road to Paris continued in Manila through our Climate Week celebration in October 2015, where we were joined by policymakers, artists, the academe, civil society and the gen-
eral public in supporting the conclusion of an ambitious, universal and legally-binding agreement at COP21,” the statement said. According to the French Embassy, the Philippines’ contribution to the positive outcome of COP21, as well as the eventual ratification of the Paris Agreement by the Philippine government, was the result of the invaluable and collective efforts of the country’s climate champions-- Senator Loren Legarda, chairperson of the Senate Oversight Committee on Climate Change whose advocacy on environmental protection and climate change issues is well-known locally and internationally, the Climate Change Commission, which has been committed to its mandate, and the numerous climate advocates in civil society. ‘We also recognize the commitment demonstrated by the previous and current administrations in addressing climate change,” it stated.

Fact or fiction? President Rodrigo Duterte has disclosed plans of imposing a total nationwide ban on mining because of alleged reports that some mining operators have been funding destabilization plots against the government. The mining industry in the country is generating close to P70 billion annually in government revenues. Once a total ban is imposed, the government will be hard pressed to find other ways to generate revenues needed to finance government expenditures and projects needed to spur economic growth. Aside from using illegal explosives in their operations, mining operators were accused by the government of, among others, environmental degradation, denudation of forest and lack of funds for progressive rehabilitation. The feisty Duterte is claiming that some mining operators are conspiring with his political opponents, spearheaded by the yellow party, to remove him from Malacañang. He even urged those who are behind the ouster plots to “bring it on” if they want to create havoc and turmoil in the government. Duterte disclosed that executives of San Roque Metals Inc (SRMI) based in Agusan del Norte had bankrolled the candidacy of former President Noynoy Aquino in 2010 as well as the failed presidential run of Liberal Party (LP) bet Mar Roxas. Throughout the presidential campaign last year, Roxas, it was reported, was using the planes of SRMI owned by Eric Gutierrez. Congressman Egay Erice, an LP member, used to be the chairman of the board
of SRMI and a major stockholder. Senator Panfilo Lacson said there are reasons to believe that the opposition are indeed aggressively doing destabilization plots to oust Duterte. Lacson fingered fellow Senator Antonio Trillanes as being part of a sinister attempt to destabilize the Duterte administration by being the media tour guide of former Davao city police cop Arthur Lascañas. Trillanes, who now handles the security of Lascañas, is also the one organizing press conferences for Lascañas in the Senate and in other media forums in Metro Manila. Lascañas claimed that Duterte is part of a vigilante group responsible for the killings of numerous criminals and drug addicts during his stint as Mayor in Davao city for 22 years. As usual, the poker-faced and publicity-seeker Trillanes denied being part of any plot to oust Duterte., claiming he only wanted to expose the truth about the existence of the DDS. Lacson said he does not believe Trillanes’ claim of just finding the truth. He said he knows a destabilization activity when it is taking place because he was once part of it during former President Gloria Arroyo’s time. The LP, as expected, also denied any ouster plot being hatched by the
opposition against Duterte. They instead blamed Duterte’s appointees who are creating problems and embarrassment for the President. Opposition leaders are one in saying that Duterte made a bad choice in appointing the people to head the Philippine National Police (PNP) National Food Authority (NFA), Department of Foreign Affairs (DFA), Burerau of Immigration (BI) National Irrigation Administration (NIA) and the Tourism Promotions Board (TPB). Since he assumed office, President Duterte has been hammered by the opposition with all kinds of accusations – a murderer, lunatic, womanizer, plunderer and head of the dreaded Davao Death Squad. All these accusations, I believe, were made by the opposition to divert public attention away from the illegal drugs involvement of Senator De Lima during her stint as Justice Secretary. I also believe that the opposition will exhaust all efforts to continue to find ways on how to topple the Duterte presidency if only to save some of their key members involved in either illegal drugs transactions, corruption and in gambling. One of these days, the alleged illegal involvement of some key officials of the Aquino administration will surface and all of them will be held accountable by the courts for all the bad things they did during their time. It is up to the Filipino people what to believe if there is such thing as Davao Death Squad headed by Duterte when he was the Mayor of the most progressive city in Mindanao. ation? Is it a fact or just fiction? *** It is good to know that Malacañang created an anti-graft unit to look into complaints against officials appointed by Duterte in the executive branch. The anti-graft unit would investigate government officials and personnel accused by ordinary citizens for alleged corrupt practices through complaints filed with the Presidential Action Center, including complaints of some employees of the Tourism Promotions Board (TPB) against their chief, actor Cesar Montano. The employees accused Montano, an appointee of Duterte, of entering into sponsorship deals without sanction of the board. He was also accused of appointing his brother, relatives and household help to work in the TPB after his appointment as chief of the TPB . When informed about the case, Duterte urged the TPB employees to file charges against Montano if they have the “goods” on him. He, however said that he still trusts actor. The anti graft unit should also look into the allegations made by critics of DENR Secretary Gina Lopez that a mining firm has paid her round trip plane ticket to Paris as well as her five other companions. If this is true, the Commission on Appointments should have all the reason to reject her confirmation as DENR Secretary. President Duterte should waste no time in defending Lopez since I think there is a slim chance of her being confirmed by the commission because of the numerous complaints filed against her.

Joseph Vicente Ejercito said Wednesday describing the dinner he and fellow senators from the majority bloc had with Pres. Rodrigo Duterte last Tuesday night. Ejercito said this was the first dinner with Pres. Duterte were most of the majority bloc -- 15 of them -- were present. He said that previous dinners only involved around seven to nine people. Cash out refinancing to open up great opportunities
It’s not too late to refinance now, rates are still low for you to cash out to do home improvements or pay off debts. Refinancing is a booming opportunity for home borrowers to either borrow at these low rates to buy a home, invest in another home or refinance their existing mortgage to lower their payments. These rates have fallen so much that people are calling these “Cheap Money” Remember when getting a loan the term “Points” should not be in any way part of your closing cost. Nowadays, you are only charged “Points or Origination” is if you are not really aware of what is going on or you are being talked into it. Points and Origination are fees the lender will charge you to buy down the rate, but with these rates so low and the dollar amount you pay to lower your rate is almost not worth it. For Example: would you pay an extra $3,500 for your closing cost just to be able to save $25/month. ing the situations where getting a refinancing loan is not such a good idea, you can better understand when you should look into the home refinance process. What are some of the reasons why you should not refinance your home? Caregiver Rights Update 2016 was a sensational year for caregiver rights. In January 2016, when California raised the minimum wage to $10 an hour, the minimum daily rate of pay for many 24-hour caregivers was raised to $315. The calculation of the daily rate is as follows: Under the Domestic Worker Bill of Rights (DWBR) law, the first 9 hours of work must be paid at minimum wage (9 hours x $10 an hour = $90), and the next 15 hours of work must be paid at the overtime rate (15 hours x $15 an hour = $225) making the total daily rate due caregivers for 24-hours of work $315 in 2016. This wage increase, along with other changes to California’s labor laws that went into effect at the start of the year, truly set the stage for an eventful year in the world of caregiver law. To raise awareness of the plight of caregivers, who are all too often ignored, Kevin Rehwald, a partner at Chaleff Rehwald, wrote a 5000-word article examining caregiver rights. The editors of the magazine were so impressed with Kevin’s work that he was asked to appear on the cover of the November issue of Los Angeles Lawyer, the magazine of the Los Angeles Bar Association. Inside the issue, Mr. Rehwald had the honor of analyzing the DWBR, a law that made in-home personal caregivers eligible for overtime. Duterte OKs national security guidelines for bureaucracy
MANILA, March 14 (PNA) – President Rodrigo Duterte has approved the enhanced National Security Policy 2017-2022 (NSP) that serves as guide for the government bureaucracy in the efforts to safeguard national security interests. “This version of the NSP now directs the national security sector to be aligned with and in tandem with the recently approved Philippine Development Plan,” Presidential spokesperson Ernesto Abella said in a press briefing on Tuesday, March 14, in Malacañang. Abella said the NSP was approved by the President during the National Security Council meeting last Monday, March 13. Among the matters discussed during the National Security Council meeting include the peace process with the CPP-NPA-NDF, the West Philippine Sea issue, and the anti-illegal drugs campaign, among others. On the peace process, Abella said the President acknowledged the joint statement of the government peace panel and the National Democratic Front (NDF) on the intent to resume formal peace talks. “To ensure that genuine peace talks are realized, the President asked both panels to agree on clear parameters for ceasefire and the talks,” Abella explained. In addressing illegal drugs, meanwhile, Abella said President Duterte has directed the National Intelligence Coordinating Agency (NICA) and the National Bureau of Investigation (NBI) to be more actively involved in the PDEA-led anti-drug operations, together with the Armed Forces and the Philippine National Police. In the same briefing, Abella cited Mastercard Index of Women Entrepreneurs, which says that the Philippines has become an ideal business environment for women to prosper. “The Philippines ranks eighth among top 20 markets in the world, gaining an overall index of 68.4 on the Mastercard Index of Women entrepreneurs in 2017,” Abella said. Citing the continued policy of breaking the glass ceiling, Abella said the Duterte administration continues to support endeavors of Filipino women.
Abella also announced that barely nine months in office, the Duterte administration has seen an increase in exports. “The Palace is pleased to announce that the Philippine merchandise exports reached 5.13 billion in January, surging 22.5 percent, the highest growth posted in three years,” Abella said. He said garments and clothing accessories exporters saw a 270 percent increase, followed by coconut oil products, which grew 230 percent; and chemicals, which saw a 105 percent growth. Japan is still the top Philippine export destination. Palace echoes importance of climate change pact Meanwhile, in the same briefing, Climate Change Commission (CCC) Vice Chairperson Frances Veronica Victorio said the country’s accession to the Paris Agreement would enable the country to get access to financial and technical support, as well as in capacity building. “Ang Paris Agreement po ay may goal po sila na you’ll be able, we’ll have about USD 100 billion per year. So starting 2020. So pag kasama po tayo sa Paris Agreement ay makaka mas access tayo dito sa mga financial support na available for us, lalo na as a developing country,” Victorio said. “Ang plano po natin is that we want to make sure na naka-incorporate po dito ang mga goals ni Presidente also, of really poverty eradication, mga sustainable development. So pwede po ‘to under the Paris Agreement,” she added. Victorio noted the impact of warmer temperatures to food production. “Tayo po ay like 5th most vulnerable country when it comes to climate change, all over the world. So kung ngayon pa lang, ngayon nasa 1.2 degrees Celsius po tayo. Dati pa nagka-Yolanda na tayo, nagka-Ondoy and these are all at 1 degree Celsius,” Victorio explained. “Right now, last year, 1.2 degrees Celsius na po tayo. So this is something we’re continuously advocating at kailangan po natin i-lead ang ating mga iba’t ibang bansa kasi hindi po natin ito kakayanin na mag-isa,” she added.
DOF eyes government-issued identification cards as benefit cards MANILA, March 14 (PNA) – The Department of Finance (DOF) is considering to tap biometric-capable identification cards issued by government agencies as benefit card for people who will be given unconditional cash transfer. Finance Undersecretary Karl Kendrick Chua said the plan will be implemented once lawmakers approve the proposed Comprehensive Tax Reform Program (CTRP), which calls for a one-year cash transfer to people who belong to the lower 50 percent of the social bracket. The cash transfer was proposed to mitigate the impact of higher fuel prices on the poor since under CTRP impact on government revenue of the proposed cut in personal income tax will be offset by hikes on the excise tax on fuel and vehicles and the value added tax (VAT). Chua said they have not considered an amount for the issuance of a benefit card but admitted that it will be expensive compared to when the cards issued by the Social Security System (SSS) and the Government Service Insurance System (GSIS) will be tapped. He said that since these government-issued identification cards already have the necessary details of the holders and has security features then its use may still be maximized by using it as benefit card. ”So what we are going to do is turn the national ID into a social welfare card, a benefit card. Wherein as a senior you’ll have benefits, as an indigent you’ll have benefits. That card will determine exactly what kind if benefits you’ll get, so that is our plan to reform it,” he said.

MANILA, March 14 (PNA) – Homegrown Jollibee Foods Corp. (JFC) is increasing its first purchase option in American fast-food chain Smashburger by 10 percent in a bid to capture bigger slice of the USD 100-billion United States (US) burger market. JFC told the local bourse its wholly owned subsidiary, Bee Good! Inc. (BGI), and Smashburger Master LLC have amended their agreement to enable the former to buy more shares in SJBF LLC –the operator and franchisor of Smashburger- between the years 2018 to 2021. With the amendment, BGI shall be entitled to purchase from Master an additional 45 percent of SJBF LLC during the four-year period, from just 35 percent under the original agreement. BGI will acquire the remaining 15 percent in the operator and franchisor of Smashburger between the years 2019 to 2026, thus achieving full buy out by that period. The purchase price for the remaining 60 percent will be based on the achievement of certain financial performance targets agreed between BGI and Master. BGI bought 40 percent of the Smashburger for USD 99.47 million in October 2015. “This acquisition will make the US one of JFC’s most important markets and drivers of long term growth along with the Philippines, China and the Filipino markets abroad,” JFC said. Smashburger, with headquarters in Denver, Colorado, currently has 374 restaurants mostly in the US. Smashburger estimates system wide sales of about USD 339 million in 2015, an amount equivalent to 12 percent of JFC’s estimated worldwide system-wide sales for the same year. Its system-wide sales have been growing at an annual rate of around 30 percent between 2011 and 2015, while its store network has been increasing annually by about 20 percent.

The AALDEF also said the Justice Department’s reliance on the “plenary power doctrine” to defend the new executive order is based on a “string of overtly racist and outdated cases, including discredited precedents allowing the World War II incarceration of Japanese Americans by executive order.”
Jury convicts ex-Sheriff Lee Baca LOS ANGELES – Former Los Angeles County Sheriff Lee Baca was found guilty on Wednesday of leading a conspiracy to obstruct justice by overseeing a scheme designed to impede a federal investigation into corruption and civil rights abuses at county jail facilities. Baca was also convicted of lying to federal investigators when he denied knowledge of key aspects of the obstruction plot. After about two days of deliberations, a federal jury found that Baca authorized and condoned a scheme that now has resulted in the conviction of 10 former members of the Sheriff’s Department. During the trial, prosecutors described Baca as being the top figure in the conspiracy, which also involved his right-hand man and deputies who implemented orders from the Sheriff. The jury convicted Baca on three felony counts: conspiracy to obstruct justice, obstruction of justice and making false statement to federal
investigators. As a result of today’s guilty verdicts, Baca, 74, faces a statutory maximum sentence of 20 years in federal prison. United States District Judge Percy Anderson, who has presided over several trials involving members of the conspiracy, is expected to schedule a sentencing hearing during a status conference on Monday. The obstruction plot began in August 2011 after LASD officials discovered a cell phone in an inmate’s cell at the Men’s Central Jail, linked the phone to the FBI’s Civil Rights Squad and learned that the inmate was an FBI informant. The cell phone had been smuggled into the jail by a corrupt deputy who took bribes. The FBI developed the informant as part of an investigation into the county jail system, which for years had been the subject of allegations of inmate abuse and subsequent cover-ups. The evidence presented at trial showed that the Sheriff wanted to avoid federal scrutiny of his troubled jails.

Janella Salvador loses more than P100,000 from bank account Actress Jenine Desiderio was surprised after sorting out the bank statements of her daughter, Janella Salvador. It showed there was a debit card transaction in Tokyo Disneyland in August last year, amounting to almost P110,000. But both of them were not in Japan at that time. “Ang kaduda-duda dito ay same amount, same date, same name tapos paulit-ulit ng tatlong beses. In one date parang tatlong transactions,” Desiderio said. But Desiderio admitted she only discovered the transactions last week, saying her bank failed to promptly deliver her statements of account. Desiderio wasn’t also alerted by the bank of the big transactions because she was not enrolled in online banking. “Hindi ko alam na kahit pala maingat ka pwede pa lang mangyari yung mga bagay na ito,” she said. Janella for her part said, “I got sad when I saw it because first of all, I find it really disappointing and sad that people nowadays can just steal big amount of money that other people worked hard for of course.”

Sunshine refuses to comment on allegations vs Cesar Actress Sunshine Cruz refused to comment on the allegations made against her estranged husband, actor Cesar Montano, as the chief operating officer of the Tourism Promotions Board (TPB). Cruz, however, said that she is hoping Montano will get past this as he is, after all, the father of her children. “Sana malusutan niya ‘yan. Kasi kahit ano namang mangyari, tatay pa rin siya ng mga anak ko,” she said. Employees of the TPB, an attached agency of the De- Sunshine Cruz partment of Tourism, have filed a complaint against Montano for entering into alleged questionable contracts. Montano, however, dismissed the complaint as “baseless and untrue,” saying no one knows who the said “TPB employees” are. He added that none of them have come forward to present evidence to support their claims. Meanwhile, Cruz said she does not understand why the court still has not decided on the annulment case she filed against Montano. “Lahat naman tayo [naiinip], pero patience lang.
