Trump ‘modifies’ immigration policy By Ben Cal

MANILA, Nov. 20 (PNA) – The Migrant Heritage Commission (MHC), a United Statesbased non-profit Filipino organization, has welcomed the modified immigration policy announced by President-elect Donald Trump that only criminals would be deported.

Duterte met with Russian President Vladimir Putin on the sidelines of the two-day Asia-Pacific Economic Cooperation (APEC) Leaders’ Meeting (AELM) in Lima, Peru. During the meeting, President Duterte expressed his pleasure of meeting President Putin and his respect for the latter’s leadership. President Putin congratulated President Duterte for winning the May 9, 2016 elections and likewise expressed his pleasure at meeting him. Prior to becoming a mixed martial arts fighter, Folayang was an English and Physical Education teacher in Baguio City. He graduated from the University of Cordilleras, a private university in Baguio City. Recalling his most recent fight, Folayang said while he studied Aoki’s style (his opponent in the world lightweight title match), he did not dwell on the latter’s supposed submission skill. “I concentrated on my own strengths,” Folayang said, adding that he patiently stayed in defensive mode until he had an opportunity to launch his attack. For cases filed after October 7, 1998, Student Loans are only dischargeable if: 1. You can prove that having to repay it would impose an “undue hardship� on you (as defined below), OR, For cases filed PRIOR TO October 17, 2005, 2. If the PROGRAM under which your student loan is issued, insured, administered is a FOR-profit, PRIVATE (non-government) entity, it may be dischargeable. (However, if the program itself, such as LAL, GSL, etc. receives nonprofit funding by participation of nonprofit entities, the loan is not dischargeable in bankruptcy). To obtain a discharge based on undue hardship you must prove all of the following: 1. that you cannot maintain, based on current income and expenses, a ‘minimal’ standard of living for yourself and your dependents if forced to repay the loans; 2. that additional circumstances exist indicating that this state of financial affairs is likely to persist for a significant portion of the repayment period of the student loans; and, 3. that you made good faith effort to repay the loans, for example, by past payments for several years, etc. Making payments is not always required if you didn’t ever have the money to pay the loans. Forbearances may be sufficient. NEW: The Ninth Circuit recently ruled (in April 2003) that courts have the authority to issue partial discharges of student loans, in cases where the debtor shows the ability to repay some, but not all, of the loans. This is a huge improvement in the ability to possibly discharge some of these debts, because before the rule was if you could afford to repay any of the loans, you had to repay it all. HEAL Loans are subject to a higher standard of scrutiny and are much harder to discharge. For other alternatives to dealing with Student Loans, including income contingent repayment plans, and non-bankruptcy methods of canceling the debt, check out the following website: http://www.ed.gov/offices/OSFAP/ DCS/loan.cancellation.discharge.html Can you be denied a student loan because you or your parents file bankruptcy? Section 525 of the Bankruptcy Code prohibits discriminatory treatment by any governmental or other student loan program on the basis of filing a bankruptcy. In other words, a student loan agency cannot deny your loan application based on the filing, by you or anyone you know, of a bankruptcy. Discharging taxes and removing tax liens Certain types of tax obligations, such as income taxes, may be discharged under specific circumstances. Many required factors must be met before any tax can be discharged under Chapter 7 or Chapter 13. In Chapter 7, the minimum requirements for discharging federal or state income taxes are: (1) it has been over 3 years since the returns were last DUE (including extensions), (2) the returns were timely filed or it has been at least 2 years since the returns were filed, (3) there was no fraud involved or attempts to evade the tax, AND, (4) the taxes were not assessed within the last 240 days. If it has been over 3 years since your returns were last due and they have not been assessed in the last 240 days, BUT you have not yet filed the returns or there was some kind of fraud involved in filing them, then they may be dischargeable in a Chapter 13. Again, discharging taxes is an extremely complicated area, and you should definitely consult with a knowledgeable attorney before deciding whether to file based on dischargeability of your taxes and before you take any further steps with your taxes (such as filing past due

returns) Sometimes filing a late return can work against you as far as being able to discharge those taxes in a Ch. 13, so definitely speak to an attorney before doing anything. Tax Liens that have attached to property will survive a bankruptcy. What does that mean? It means that the lien will stay against your property regardless of your discharge of the underlying debt. So, when you ultimately sell that property, if there is extra money available, the lien will be paid first from those proceeds unless you have the lien removed. Discharging fraudulent debts or fraud debt judgements Debts that you incurred which were the results of an intentional or even negligent misrepresentation on your part are not dischargeable in a Chapter 7. Examples of these might be if you misstated your income on a credit card application, made false statements in order to induce someone to give you a loan, ran up your credit card debt shortly prior to filing bankruptcy, used your credit card or obtained a loan without any intent to repay it, or if someone has obtained a court judgment against you based on fraud. However, the news isn’t all-bad. These types of debts may be discharged in a Chapter 13. Retirement accounts and pension plans Whether or not you can exempt amounts held in a retirement account depends on numerous factors, including which set of exemptions you choose to use (you need to discuss this with your attorney – in California, there are two sets of exemptions). According to the United States Supreme Court, if your retirement plans is ERISA approved, meaning that it contains a trust “anti-alienation� provision making it impossible to transfer or withdraw the funds prematurely, and it is automatically exempt. Individual Retirement Accounts may be exempted only up to the amount reasonably necessary for the debtor’s support and maintenance, taking into account all other anticipated and existing sources of income and expenses. Obviously, exempting retirement funds is very tricky and requires the expertise of an experienced bankruptcy attorney. Getting rid of liens, abstracts of judments and trust deeds against your property The bankruptcy code enables a broad range of powers, which can enable you to avoid liens that were placed against your personal property or real property (like a house). It is too complicated an analysis to deal with here, but if you has liens against your property; make sure to discuss this with your attorney. Types of liens you may be able to get rid of include: judgment liens recorded against your home or specific personal property. Also, in a Chapter 13 junior trust deeds against your home may be able to be removed under certain specific circumstances. This is not an option in a Chapter 7, so make sure to discuss this with your attorney. Paying taxes with your credit card Debts incurred on your credit cards to pay taxes to the IRS will usually NOT be dischargeable in chapter 7 but may be dischargeable under Ch. 13. Middle Eastern royal families eyeing to make PHL islands as economic zones By Kris M. Crismundo

MANILA, Nov. 20 (PNA) – Royal families from Middle East countries are eyeing to lease islands in the Philippines and convert them to economic zones, the new chief of Philippine Economic Zone Authority (PEZA) told reporters. In an interview, PEZA Director General Charito B. Plaza said royal families from Qatar and Dubai in the United Arab Emirates are looking into investing in the Philippines by putting up economic zones in the islands. “I had the opportunity to talk to the members of the royal families in Qatar and Dubai. Most of the sheikhs

and the kings are into real estate business. They signified to us that they will be coming over to invest through PEZA. And we offered to them our islands,� said Plaza. “They’re coming over next week and they’re going to do their first exploration of how the Philippine investments are going to be,� she added. DAVAO CITY, Nov. 20 (PNA) – Tourist arrivals in Mindanao are expected to rise by 10 to 20 percent year-on-year if backed with logistic support from concerned government agencies, a tourism official said. Department of Tourism-Mindanao (DOT-Mindanao) Assistant Secretary Eden David noted that she sees this possible with the creation of a Mindanao Tourism Agenda (MTA) to go on a full-blown scale by next year. “The target that has been set is to at least increase it by 10 to 20 percent but it be dependent upon logistic support when it comes to infrastructure,� David said in a press conference in Davao City. DOT earlier said that the MTA is expected to complement the department’s National Tourism Development Plan (NTDP). “The Mindanao plan will have to be started by 2017. There would be a MOA (memorandum of agreement)

that would be undertaken next week and hopefully by end of the year we have initial draft to submit to Malacanang,� David said. Data from DOT Mindanao showed that the island acquired around 8.5 million tourist arrivals in 2015 with the bulk of these arrivals coming from the Davao Region (Region 11) with around 2.8 million arrivals. Meanwhile, the Zamboanga Peninsula (Region 9) acquired around 800,000 arrivals, Northern Mindanao (Region 10) acquired around 2.7 million arrivals, Soccsksargen (Region 12) acquired around 1 million arrivals and Caraga (Region 13) acquired around 1.2 million arrivals. DOT Secretary Wanda Teo vowed to boost Mindanao tourism under her term especially since she herself and President Rodrigo Duterte hails from the same region. “My focus is always Davao and Mindanao because I feel like Davao has been left behind,� Teo said.

AMLC files money laundering charges vs. RCBC execs By Joann S. Villanueva

MANILA, Nov. 22 (PNA) – Six current and former officials of the Rizal Commercial Banking Corporation (RCBC) have been filed with money laundering charges before the Department of Justice (DOJ). According to the Complaint-Affidavit received by the Department of Justice (DOJ) on Nov. 18, 2016, the Anti-Money Laundering Council (AMLC) included in the charges former Retail Banking Group head Raul Victor B. Tan, who resigned last April 20; National Sales Director of the Retail Banking Group Ismael R. Reyes; and Brigitte R. Capiña, Retail Banking Group Regional Sales Director. Also included are Nestor O. Pineda, District Sales Director; Romualdo S. Agarrado, Customer Service Head, Jupiter Business Center; and Angela Ruth S. Torres, Senior Customer Relations Officer of the Jupiter Business Center. Torres was terminated from her job after RCBC investigation showed that she, along with then RCBC Jupiter branch manager Maia Deguito, violated bank policies and procedures and falsified commercial documents that paved the way for the laundering of USD81 million that is part of the money stolen from the Bangladesh central bank’s dollar account with the Federal Reserve Bank of New York last February. The complaint said AMLC investigations showed that the six RCBC officers “facilitated the suspicious transactions” that enabled the remittance of a total of USD81 million to four US dollar accounts owned by Michael F. Cruz, Jessie Christopher M. Lagrosas, Alfred S. Vergara, and Enrico T. Vasquez on Feb. 4, 2016. It said the respondents failed to “conduct the requisite investigations and inquiries into the accounts, their beneficiaries, and the transactions, attributable to their knowledge about the unlawful origins of the funds or their deliberate refusal to know the unlawful origins of the funds.” It said the four accounts, along with that owned by one Ralph Pi-

cache, were opened on May 15, 2015 at the RCBC Jupiter Business Center with initial deposit of USD500 each. These accounts did not have any other transactions until February this year. Peso deposit accounts were also opened by the same five bank account owners on Dec. 8, 2015, it said. Last Feb. 4, payment orders were sent to the Federal Reserve Bank of New York supposedly by the Bangladesh Bank for the transfer of USD81 million to the accounts of Lagrosas, USD30 million; Cruz, USD6 million; Vergara, USD20 million; and Vasquez, USD25 million. The complaint said that from 4:54 a.m. to 5:12 a.m. of the next day, RCBC’s Settlements Department received messages through the Society of Worldwide Interbank Financial Telecommunications (SWIFT) payment system from RCBC’s three correspondent foreign banks, namely Bank of New York Mellon (BNYM), Wells Fargo and Citi, regarding the payment to the four beneficiaries in the Philippines. SWIFT is a 24-hour global communication network that facilitates secure international exchange of payments transactions among banks, central banks, multinational corporations and major securities firms. At about 2:15 p.m. of Feb. 5, one Michael Bautista inquired before RCBC’s Treasury Department about dollar sales and peso purchases, which was initially intended for the account of remittance company WeRQuick but later on settled for the account of another remittance company, Philrem Services Corporation (Philrem). At around 3 p.m. of the same day, Dequito was alleged to have processed the opening of an account by one William (So) Go, which at around 3:16 p.m. of the same day received USD22.735 million from the account of Lagrosas. USD14.2 million was, in turn, transferred from Go’s account to the Philrem account at RCBC-Unimart BC at around 3:27 p.m. of the same day and USD500,000 was transferred to Philrem’s dollar account at Unimart at around 4:48 p.m.

MANILA, Nov. 20 (PNA) – A lawmaker at the House of Representatives wants to institutionalize work-at-home programs in government and non-government offices as a means to ease traffic congestion in the metropolis. AKO Bicol Partylist Rep. Rodel Batocabe filed House Bill No. 4291 or the “Work-at-Home Act of 2016,” which offers employees an alternative to work within the confines of their homes with the flexibility of time and the advancement of technology. “By providing at least a one-day respite from the stressful commute, this measure seeks to promote the welfare of workers who will have an extra time to stay at home while still doing some work-related activity,” Batocabe said in a statement on Sunday. “Traffic congestion and overcrowding of buildings in most central business hubs in Metro Manila and other cities continue to take its toll on employees, who waste increasingly more time in their commute to and from work,” he added. Batocabe said an estimated 4.7 million workers are in Metro Manila, while the space and time it takes to transport these people adversely affect the movement of the economy. The longer time employees stay on the road, the fewer tasks they accomplish for their work, he noted. “Adopting work-at-home policies will be beneficial not only for the workers but also the employers. This will decrease the utility costs in the operation of their businesses and at the same time, it will also allow them to maximize and put office space into a more efficient use,” Batocabe said. The work-at-home policies should permit employees at least once a week to perform their duties without their physical presence in the office. Furthermore, they seek to establish clear guidelines on the supervision of employees working at home with the necessary coordination of their schedules and results-based evaluation. “Corollary to the law is the strict inspection of the premises, books of accounts, and record of companies pertaining to their work-at-home programs to ensure that they are really observing the law,” Batocabe added. The Department of Labor and Employment shall facilitate the monitoring of non-government offices by requiring them to submit their policies six months after the effectivity of the law. The Civil Service Commission shall likewise monitor the work-athome efforts of government offices and their subscription to the guidelines brought by the measure.

Josephine Sato called on Monday for a policy review on the issuance of land transportation franchises to improve the public transport system. In a statement, Sato urged the Department of Transportation (DOTr) and the Land Transportation Franchising and Regulatory Board (LTFRB) to jointly assess traffic situations with short-term and long-term solutions to help ease traffic congestion. “When was the last time the DOTr and LTFRB reviewed the franchise issued for public utility buses (PUBs) and public utility jeepneys (PUJs)? It is time to solve the puzzle why private motor vehicle owners continue to bring their cars despite the expected traffic. Are their destinations accessible by public transportation?� Sato said. She also said the DOTr and LTFRB should get an accurate count of franchises it issued as against the number of public utility vehicles and re-engineer their routes. “We should learn to use our secondary roads more to decongest our major thoroughfares,� she said. The NOAA will also specify the witnesses to such actions by the employee. The documents that will support the adverse action will also be laid out. The employee will be informed of the “adverse action,� which is termination. Before the employee is terminated, he/she is offered a Skelly hearing. In a Skelly hearing, the employee has an opportunity to present his side of the story. He can deny the accusations, or he can give justifications. The employee can present witnesses and documents at the Skelly hearing. If the Skelly hearing officer is convinced by the presentation of the employee, then the termination of employment will not be put in place. The employee retains his job. Oftentimes, however, the Skelly hearing officer will decide that the evidence presented to him justifies the termination of employment. In this case, the employee can decide to appeal the termination to the State Personnel Board. The State Personnel Board (“SPB�) is an independent board that makes decisions on employer-employee disputes, primarily among them disputed terminations. Typically, the SPB to an Administrative Law Judge (“ALJ�). The ALJ conducts an evidentiary hearing, then forms an opinion which he submits to the SPB. The SPB then either adopts the ALJ decision, or sometimes, the SPB makes its own decision different from the recommendation of the ALJ. If the decision is unfavorable to the employee, the employee may decide t o seek a Writ of Mandamus from a

superior court. I believe that it is oftentimes necessary and critical to have an attorney experienced in these matters help the employee. There are so many pitfalls that the employee need to hurdle: deadlines for doing tasks, procedures, presentation of the proper witnesses and documents, understanding various standards that apply to alleged wrongdoings, and others. 4 ways ďŹ ling for divorce can beneďŹ t your immigration case Couples get divorced for various reasons. California is a no fault state. The reasons why a couple is getting divorced are often irrelevant to the issues of the family law case. Divorce is often a difficult and negative experience for most families. However, getting divorce may have some unintended benefits in the immigration law arena. Four situations in which filing for divorce can be beneficial to your immigration case are as follows: 1. Married Sons and Daughters of US Citizens If you were petitioned for legal permanent residence by your US Citizen parent as a married son or daughter 21 years old or over, you are classified in immigration law under family sponsored third preference (F3) which usually carries a long wait time. The wait time for Filipinos for example is currently 22 years. The priority date is normally the date the petition was initially filed by your US Citizen parents. If you get divorced, you revert back to single status and your category automatically becomes reclassified to first preference (F1) where the waiting time is substantially shorter. For example, for Filipinos the wait time under F1 category is 10 years shorter than F3 category. This means if your parents filed your immigration petition 12 years ago, then you can adjust to a green card now instead of waiting another 10 years. 2. Married Sons and Daughters of Legal Permanent Residents If your parents are legal permanent residents, getting divorced will convert you back single status making you eligible to be petitioned by your legal permanent resident parents under the family based second preference (F2b) category if you are 21 years old or older or under the family based second preference A (F2a) if you are under 21 years of age.

For those who married after they were petitioned by their LPR parents (F2A and F2B), the petition is automatically revoked under operation of law the moment you get married and cannot be reclaimed by a divorce. In theory, it can be argued that filing a subsequent petition after your divorce under the same category inherits the previous petition’s priority date under 9 FAM 42.43 N10 and 8 CFR 204.2(h), Part 205. However, success of such argument is not clear since the old petition was automatically revoked the moment you married. The best thing that can be done in this situation is to have your LPR parent repetition you as an F2A or F2b even if you are unable to reclaim the previous petition’s priority date. 3. Conditional Legal Permanent Residents in failed Marriages For those who obtained their legal permanent residence status through marriage based petition by their US Citizen spouse of less than 2 years marriage, the legal permanent residence status conferred is usually a “conditional legal permanent residence� valid only for 2 years. The couple would need to sign and file a joint petition to remove this condition prior to the expiration of the 2 years or the conditional legal permanent resident spouse would fall out of status. The problem arises when the marriage is in trouble. Often it becomes difficult to obtain the cooperation of the US Citizen spouse specially when the couple has separated. US Citizen spouse often refuse to sign the I-751

for or appear at the I-751 interview if one is set by the USCIS. Filing for divorce would terminate the marriage and allow you to file a “waiver� of the joint petition to remove the conditional LPR status based on entering into the marriage in good faith. Terminating the marriage by filing a divorce is a requirement in order to file the “waiver.� It is important to time this correctly as soon as the marriage starts falling apart because by terminating the marriage early on, you might be able to file the waiver before the expiration of your 2 year conditional LPR thus allowing you to extend your LPR status in 1 year increments until a final decision is made in your case. 4. Married Aliens in Non-Immigrant Visas and those without Status For those who enter the US as a non-immigrant and are separated from their spouse but still married, filing a divorce would open up opportunities in case they meet a new significant other who is a US Citizen and who can petition them as an immediate relative. This is usually the fastest of process in obtaining legal permanent residence. In countries such as the Philippines where there is no divorce, many people come to the US to start a new life after they have been separated from their old spouse (often still married to them). Even if the alien over stays their status as a visitor, the alien can still adjust to that of a legal permanent residence if petitioned by a US Citizen spouse. If the alien was never inspected, the alien can still adjust to legal permanent residence if they are grandfathered under INA 245(i) and there are no special restrictions on their status. To be grandfathered under INA 245(i), the alien must have been a beneficiary of a legal permanent residence petition filed no later than April 30, 2001.

Finally, a common concern of divorcing immigrants is “What happens if my spouse refuses to sign the divorce papers?� The truth is you do not need your spouse’s signature to obtain a divorce in California. You only need to provide your spouse notice that you filed a divorce by personally serving your spouse the divorce petition and summons. In countries that are members of the Hague Convention, special procedures need to be followed to effect service. So yes it is possible to divorce your spouse even if your spouse is in a country that does not recognize divorce among its citizens such as the Philippines. Widow needs Chapter 13 to handle $40k credit cards Client is 53 and recently widowed. She works as a caregiver and met her now deceased husband through her job. At first, husband was her patient. She provided caregiving services to the man in his house. He was 70, divorced and lived by himself. As part of caregiving, she drove him to eat a various restaurants that he wanted to go to. While they ate at those restaurants, he would talk to her about his life and eventually popped the question saying that if she would marry him and take care of him, he will be a good husband to her. Client was previously divorced but felt an affection towards him so she said yes. Apparently, they were pretty happy living together as husband and wife until he slipped and fell in their house, hitting his head on the floor. He fell into a coma and never recovered. After a week, he died in the hospital. Husband had placed her name as joint tenant on the house, which was almost fully paid. The current fair value of the house was $400K while the unpaid balance of the mortgage was $150K, leaving $250K of equity. Client automatically became the sole owner of the house because upon death of the joint tenant, the surviving joint tenant owns the other half that was owned by the deceased joint tenant. As a result, client now owns 100% of the $250K equity of the house. The adult children of husband complained about being left out in the cold as far as the ownership of the house was concerned, but client’s claim of ownership is clear because husband who was of sound mind, quitclaimed the house to himself and client when they got married. It’s almost impossible for children to prove that it was not their father’s intent to give the house to client. Client’s problem right now is that she has too much debt. She owes $40K of credit card debt. The mortgage on the house is $1,500 a month. Her net income from her caregiving services is not a lot. She nets about $2,500 a month. After paying the mortgage there is $1,000 left before food and other monthly necessities.

But minimum credit card payments alone are $1,200 a month. Obviously, the $40K credit cards have to be wiped out. It’s becoming clear that the choice she has to make is to be able to make the mortgage payment or the credit card payment. The house gives her shelter and has equity of quarter million dollarswhile credit card debt is just a heavy burden to carry forever. Although client wants a Chapter 7 discharge of the $40K of credit cards, I cannot recommend a Chapter 7 for her. In Chapter 7, she would lose the house and keep only her exempt equity of $100K. A chapter 7 trustee has the power to sell debtor’s house if the net proceeds will yield an amount that will yield a distribution to unsecured creditors such as credit cards. In client’s case, trustee can sell her house at least for $400K, pay off the mortgage of $150K, give client $100K, leaving a surplus of $150K of cash. Trustee will use the $150K to pay himself for his trustee services for administering the bankruptcy estate, pay his lawyers and other professional services incurred, and will use the unused balance after these expenses are paid to pay the $40K of credit cards, in exchange for a discharge order for the client. Chapter 7 trustee can rack up trustee, legal and other professional fees in no time. Just to hire a broker to sell the house can cost $10K to $15K in legal fees for the trustee, separate from the selling commission of the broker. The right choice for widow is Chapter 13, which will allow her to pay $40K over 60 months without interest. The plan payment will be about $700/month. After 60 payments, the court will enter a discharge order to wipe out all of her debts. No more minimum payments forever. And her house is protected from

judgment liens by the bankruptcy court as long as she is current on the plan payments. Next client is 66 and a widower. His house worth $400K is almost fully paid, except for $25K of 2nd mortgage. He owes $50K of credit cards. He has been paying $1500 a month on these cards for the last 10 years. He has paid more than $180K to keep them current but still owes the same principal of $50K today. At 66, he is just tired of paying for these cards that never diminish in principal. He cannot file a Chapter 7 because he has the same problem as the widow in the first paragraph. His equity in the house is over $175K, way over it. He sees no problem paying about $900 of plan payment for the next 60 months and looks forward to the last payment on the 60th month when the court enters a discharge order saying that he doesn’t owe any credit card debts anymore. Compare that to $1500 a

month for minimum payments only such that he would pay $90K in the next 60 months but still owe the same $50K. Typhoon Yolanda remembered with ‘Build A Shelter’ project, book launch in New York MANILA, Nov. 19 (PNA) – Three years after Typhoon Yolanda struck the Philippines, the Filipino-American community in New York recalled the impact of the disaster by re-visiting the pioneering Build A Shelter Project (BASP), the Department of Foreign Affairs has said. The BASP, launched on Nov. 26, 2013 in New York, is a community-led project supported by the Philippine Consulate General and undertaken in partnership with the Philippine Jesuit Foundation (PJF) based in New York and the Gawad Kalinga Community Foundation (GK) based in the Philippines, the department said in a press release issued Saturday. The Consulate General, in cooperation with the Assumption Alumni Association, hosted a BASP

Appreciation and book launch event to update the Filipino-American and international community who donated to the project on the project’s latest developments at the Kalayaan Hall of the Philippine Center in New York on November 15. Consul General Ma. Theresa Dizon-de Vega reported that the BASP was able to build 108 houses in three villages in Eastern Samar and one in Leyte. She also apprised the community on the total donations that BASP received, amounting to a gross of USD395,944.01 or a net of USD384,591.11. The remaining BASP funds, as determined by the Convenors Group composed of Filipino community members, will be used for the installation of jetmatic water pumps and the repair of multipurpose halls in

beneficiary communities. De Vega, thanked the BASP convenors Vivian Talambiras-Cruz, Nimfa du Tinana, Roger Alama, Zultan Bermudez and Atty. Ferdinand Suba for all their work. The Consulate likewise acknowledged the invaluable assistance of the PJF and Gawad Kalinga, represented by Sonny Ramirez and donors. “The BASP community of donors pitched in and sustained this worthwhile project, proving that in times of need, ordinary people can come together and do extraordinary things,” remarked the Consul General. Former OC teacher in sex tourism case found guilty of traveling to PHL to molest young girls and filming the abuse SANTA ANA, California – A former teacher with the Santa Ana School District who traveled to the Philippines to engage in sex with two girls and produced videos of the abuse has been convicted in federal court of seven child exploitation offenses. Robert Ruben Ornelas, 65, of Santa Ana, a onetime school teacher and girl’s softball coach, was found guilty yesterday afternoon of seven counts – two counts of engaging in sexual conduct in a foreign place, three counts of producing child pornography, and two counts of possessing child pornography. As a result of the guilty verdicts, Ornelas faces a statutory maximum penalty of 190 years in federal prison when he is sentenced by United States District Judge Cormac J. Carney on February 27. At sentencing, Ornelas will face mandatory minimum 15-year prison terms for each of the three child pornography production charges. The evidence presented during a six-day trial showed that Ornelas traveled to the Philippines on multiple occasions. He was convicted in relation to three specific trips – in 2006, 2008 and 2012 – where he sexually assaulted two girls who were as young as approximately 8. During all three trips, Ornelas took videos of the molestation and brought the images with him when he returned the U.S.

The two victims travelled to the United States to testify during the trial about the sexual assaults. “Pedophiles in the U.S. will not escape prosecution by traveling to foreign lands to victimize children,” said United States Attorney Eileen M. Decker. “Federal law contains provisions designed to protect children, whether they live in the United States or abroad. This case serves as a lesson and warning to any other person considering trip to engage in sex with minors. American law enforcement is adept at investigating this crime and will pursue a criminal case that could lead to a very lengthy prison sentence.” The investigation into Ornelas began in 2013 when federal authorities received a tip that he possessed a large quantity of child pornography. During the execution of a search warrant, investigators found images, videos and information on Ornelas’ computer and digital media. The federal charges are the product of an investigation by the Orange County Child Exploitation Task Force, which includes special agents with U.S. Immigration and Customs Enforcement’s Homeland Security Investigations (HSI), the Federal Bureau of Investigation, the Newport Beach Police Department and the Orange County Sheriff’s Department. “This conviction should serve as a warning to every sexual predator who

mistakenly believes they can evade justice by violating the innocence of children overseas,” said Joseph Macias, special agent in charge of HSI Los Angeles. “There can be no place for the abuse of foreign children by our citizens, and HSI will seek to

defend the rights of those victims no matter how far they live from our shores.” This case is being prosecuted by Assistant United States Attorneys Sandy N. Leal and Anne C. Gannon of the Santa Ana Branch Office.

Foreign affairs chief holds town hall meeting with Filipino community in Hawaii MANILA, Nov. 19 (PNA) – Foreign Affairs Secretary Perfecto Yasay Jr. held a town hall meeting with the Filipino-American community in Honolulu. The town hall meeting was an opportunity for community leaders and members of the media to ask questions about recent developments in the Philippines. The town hall meeting, held on Nov. 12, was organized by the Philippine Consulate General in Honolulu and moderated by Allan Alvarez, radio talk show host of Honolulu Radio KPHI. In attendance were Hawaii’s Senator Donna Mercado Kim and Vice Speaker John Mizuno, state representative Romeo Cachola, Kauai Mayor Bernard Carvalho, media personalities and leaders of the Filipino-American community. Yasay said that the Philippines is pursuing an independent foreign policy because it is provided for in the Philippine Constitution. He quoted Section 7 of the 1987 Philippine Constitution, which states, “The state shall pursue an independent foreign policy. In its relations with other states, the paramount consideration shall be national sovereignty, territorial integrity, national interest, and the right to self-determination.” He also replied to questions on the anti-drugs war of President Rodrigo Duterte, saying that the Philippine government is serious about fighting the drug war since it affects many sectors of the society, that the government does not and will not allow extrajudicial killings, and that the police follow strict rules on engagement in their police operations. The chief envoy of the Philippines allayed concerns of US citizens about visa requirements. He said there is no change in the current practice allowing US citizens to travel to the Philippines for a period of 30 days or less without visa.

Let us, therefore, remain vigilant. Let us guard our rights and our liberties. We will join other groups to achieve results, because truly, ‘there is strength in numbers’.” Benefit of the Doubt “Having said this, let us give President-elect Trump the benefit of the doubt. Indeed, we at MHC express our warmest congratulations to our next President and set of leaders. Consult only Licensed U.S. Immigration Attorneys and respectable Non-Governmental Organizations (NGOs) with in-house immigration attorneys to help them navigate the complex immigration options available. Notary Publics and so-called Immigration Consultants are not authorized to give legal advice. In fact, doing so is considered unauthorized practice of law and a criminal act. Immigration Scenarios under the Trump Administration MHC also pointed out some immigration scenarios under the Trump administration, and what they would mean to Filipino migrants, as well as to Filipino Americans sponsoring their families. It said there is a need “to keep in mind that there’s always the possibility that things can change in the months ahead.” 1. If President Trump adopts his campaign’s immigration rhetoric as

immigration policies, then the more than 500,000 undocumented Filipinos across the nation have a reason to be alarmed. Expect disruptions and strict regulations on immigrant visas allocated for the Philippines, whether they are family-based or employment-sponsored visas. 2. If the campaign promise to ban the entry of citizens of countries with terrorist groups (extreme Islamic groups) – which the Philippines has with the Abu Sayaf in Mindanao – becomes policy, it means immediate suspension of visa processing and strict vetting at the U.S. Embassy in Manila, if not a complete halt while the U.S. government figures out a more concrete immigration policy towards the Philippines. 3. If President Trump fulfills a campaign promise and scraps the 2012 and 2015 Deferred Action for Childhood Arrivals (DACA) program under his Executive powers, the undocumented would face the worst nightmares of their lives. After experiencing a sense of normalcy, getting out of the shadows and starting to build their future with their temporary work permits and their own Social Security numbers, once again they could be facing a return to “immigration limbo.” Under the 2012 DACA, an Executive Memorandum and not a law, some 700,000 undocumented immigrants, including Filipinos, who entered the U.S. as children have been granted temporary work authorization, Social Security numbers and relief from deportation. Republican National Party Chairman Reince Priebus told MSNBC-TV the day after the election, referring to President-elect Trump: “He’s not calling for mass deportation,” or the mass rollback of Obama’s Deferred Action for Childhood Arrivals program. (President-elect Trump has since then picked Priebus as his White House Chief of Staff.) House Speaker Paul Ryan of the U.S. Congress told CNN on Nov. 13, “We’re focused on securing the border...we are not planning on erecting a deportation force…Donald Trump’s not planning on that.” MHC said that “these are encouraging news, for starters. Still, we should withhold judgment – until a complete immigration policy is made official in the Trump Administration, one which is sound and humane and with all the Big Picture and nuances addressed.” 4. Removals and Deportations can be done administratively and before the Immigration Courts. Because we observe the rule of law and there are fundamentaldue process requirements, an undocumented immigrant cannot be simply removed or shipped out from this country. But there are certain types of immigrants that can be administratively removed without going to the Immigration Courts, especially those who have committed crimes classified as aggravated felonies. 5. There are mechanisms in place where the undocumented can challenge immigration actions of President Trump because they are illegal, unfair or violate due process and equal protection clauses of the U.S. Constitution. We should remember that our democracy is strong and intact and we follow the principles of checks and balances and separation of governmental powers: Legislative,Executive, and Judiciary.

Other Cabinet members who oppose the burial include Social Welfare Secretary Judy Taguiwalo and Agrarian Reform Secretary Rafael Mariano. Taguiwalo, who was a political detainee during Martial Law, maintained her opposition on

Maguindanao massacre: Justice Facebook founder Zuckerberg calls on APEC members to join global connectivity revolution remains elusive, 7 years later By Allen Estabillo

AMPATUAN, Maguindanao, Nov. 21 (PNA) – Editha Tiamzon’s eyes welled up with tears as she stepped into a fenced plot at a hill in Sitio Masalay of Barangay Salman here where white headstones stand in remembrance for the 58 people who died in a gruesome massacre seven years ago. The site was one of the two spots where the remains of some of the victims, 32 of whom were media workers, were found hours after the Nov. 23, 2009 killings. Editha, widow of victim UNTV driver Daniel Tiamzon, visited the site for the first time on Sunday afternoon along with around 80 family members and colleagues of the slain journalists to commemorate the seventh year of the carnage. “Napakasakit. Bumabalik sa akin ang mga alalala at nakikita ko ngayon kung gaano ka-brutal ang nangyari (It’s very painful. The memories were coming back and I can see now how brutal it was),” she said. She finally agreed to visit the site after setting it aside these past years due to some concerns from her family, which is based in Metro Manila. She joined a convoy from General Santos City, where some of the slain journalists hailed, to the massacre site to also retrace the events that took place during the incident. The group held a mass, lighted candles and offered flowers at the headstones that carried the names of the victims. The visit was part of the ongoing commemoration of the seventh anniversary of the infamous massacre, which had been dubbed as the single deadliest event for journalists in history. The activity was organized by the National Union of Journalists of the Philippines (NUJP) and the Justice Now Movement, which is composed of the relatives of the massacre victims. In his homily, Passionist priest Fr. Rey Carvyn Ondap scored the country’s “compromised” justice system for the long-drawn trial of the massacre’s alleged masterminds led by members of the family of the late Maguindanao governor Andal Ampatuan Sr. “After seven years, this is no longer an Ampatuan massacre. This is a judicial massacre,” he said. He noted that while the “Ampatuan kingdom” in Maguindanao is “gone already,” justice remained elusive for the victims due to apparent lack of “delicadeza” of those running the justice system. The priest cited reports of maneuverings and manipulations of court proceedings as well as some rulings through supposed payoffs. Ondap urged colleagues and the families of the victims to remain united and not lose hope in their continuing quest for justice even if it would take years or centuries. He said everything in this world is temporary and “God will give us justice when we all face Him in heaven.” “It should console us that someday, somehow, Christ -- who rules everything -- will give justice for this,” he said. Ryan Rosauro, NUJP national chairperson, said the country should draw lessons from the grisly massacre and the ongoing trial of the suspects. He said the killings showed the tendency of influential political families, like the Ampatuans, to abuse their power.

LIMA, Nov. 20 (PNA/Xinhua) – In a keynote address to the APEC CEO Summit in Lima on Saturday, Facebook Chairman and CEO, Mark Zuckerberg, challenged the world to connect all people to the Internet and reap the economic benefits of doing so. With the speech titled “The Connectivity Revolution,” Zuckerberg said that, as an engineer, his mindset was to view any system in the world, whether hardware and software, healthcare and education systems, or even governments. “With the accelerating progress in science and technology, our generation has the potential to do even more great things that at any other time in history,” he said. As an example, Zuckerberg looked at education. “For the last century, education has worked in more or less the same way. Students sitting in a classroom, with a teacher, learning the same material, in the same way, at more or less the same pace,” he laid out. “Today, we know that personalized learning is way better. If you can give teachers the tools and software to help students learn in the way that suits them best...results show students can learn as much as 50 percent more each year and that can compound.” According to the social media guru, schools that integrate such personalized learning feel like start-ups and that more of the education

system should work like this. To tap into this, Facebook created a dedicated engineering team to create personalized learning that teachers could use for free. In the first year, 20 schools signed up to Facebook’s program for personalized learning. The second year, 100 schools signed up and many hundreds are expected to do so in the third year, Zuckerberg pointed out. He added that Facebook intended to spread this program around the world, clearly providing an opportunity for APEC countries. Zuckerberg also gave examples of how connectivity helps to keep people safe, such as Facebook building AI that can scan and flag content which could be a sign of violence, or the Safety Check tool allowing people to check in online and say they are safe after a natural disaster. “I am optimistic...but also realistic about how hard this is going to be,” he said. “In order to do all these things, we first have to connect people...We need to make connectivity and connectivity infrastructure a much higher priority on each of our agendas.” Listing three major challenges to connectivity, availability, affordability and awareness, Zuckerberg said governments had more to do to invest infrastructure and recognize that connectivity is the path to achieving any goals they might have.

Former Agriculture Undersecretary “Joc-Joc” Bolante flew here to the US as he tried to avoid plunder charges in a Philippine court in connection with the P728 million fertilizer scam. It took the Philippine Senate to request the US government to cancel his visa which led to his arrest and detention here in America. Ultimately he was deported to Manila after his petition for asylum was rejected by an American immigration court. The same case with Police Superintendents Cesar Mancao and Michael Ray Aquino. Both fled here to escape prosecution. Aquino and Mancao were suspected of having a hand in the murder of Bubby Dacer, a high profile public relations practitioner (PR) and his driver, Emmanuel Corbito in 2001. Both were eventually arrested in the US also after their visas were cancelled and eventually extradited to the Philippines to face criminal prosecution. She said there was a flash report on television stating that Ronnie Dayan, Senator Leila de Lima’s suspected lover/driver/bodyguard and bagman, was arrested by the Police in San Juan, La Union, Tuesday at 11:30am. According to my sister Corazon Vintayen, Dayan “voluntarily” surrendered to police authorities. The Volunteers Against Crime and Corruption offered last week a P1 million bounty for Dayan’s capture or information of his whereabouts. The P1million price tag on his head must have made it difficult for Dayan to move around without being

Your home is your retirement and go-to piggy bank The initial good news for home-equity wealth building – particularly for those who have managed to hold onto their homes – is that in most of the country prices have generally recovered since the 2008 financial crisis. With the hope of the new government’s promises of Jobs creation, we hope that the Real Estate Market/Values will slowly but surely continue to appreciate. But building home equity will largely depend on where you live, when you bought your home and if you tap that equity for retirement income. The wide regional differences in home appreciation are worth noting for those still trying to use real estate to increase their nest egg. Homeowners always turn to their home equity for home improvement needs, college tuition, and excessive credit card debts and for retirement income. Homeowners who have been in their homes the longest will probably see the greatest increase in home equity. Homeowners 62 years and older now have more equity in their homes than at any time since early 2008. Home equity held by persons 62 and older has grown by more than 22 percent since the second quarter 2012, to a total of $3.73 trillion. Everyone knows if you had bought a property after 2010 for sure your value has appreciated substantially. This also means that if you’re an older, longtime homeowner, you’ve probably regained the equity you lost during the housing bust of 2007-9. You may be able to tap that equity for retirement or other purposes through a loan, refinancing or downsizing. In most areas property values has surpassed the 2007-09 prices and some area prices have actually gone higher. Yet is home equity a reliable piggy bank? Home equity creation used to be seen as a forced savings plan. Whatever you invested in mortgage principal appreciated roughly at the rate of inflation. And we should treat it like that again now. The housing credit crisis changed that perception for several generations of Americans. The bust devastated home prices in some of the most desirable areas — Arizona, California, Florida and Nevada. The tide may have turned, though. Demographic changes in society — especially baby boomers downsizing or moving to warmer places — mean

some coastal areas may once again prove to be good locations for building home equity, especially if building is restricted or climate change policies make development more expensive. We most definitely have the warm area pinned down. Some of the most robust growth projections for housing appreciation are for the coasts. According to the Local Market Monitor, which tracks housing prices in more than 300 markets in the United States, California had the best performance over the last 20 years and is projected to grow a cumulative 30 percent over the next three years. Despite high taxes and the state’s well-publicized budget and water woes, demand is still strong for the Bay Area and parts of Southern California. Technology start-ups and mature businesses want to be around Silicon Valley and Stanford University. And the Los Angeles area is a cultural and business mecca. The key to home equity growth is a combination of strong local economies, building and jobs. People have to find an area desirable and want to move there from other places — the kind of mobility that virtually came to a standstill during the recession years. And as land for development becomes scarcer and demand grows for new retirement housing, home prices will benefit. Those markets with the best expected home price appreciation have strong economies that attract in-migration. Its population growth from migration that has the strongest effect on home prices, especially now. Los Angeles is not running far behind Northern California High Tech communities, with the Football Stadium in Inglewood and the Mega Outlet in the City of Industry in the books, our city will be fostering jobs for the guaranteed next few years. Other regions will not be as fortunate as retirees move to warmer locations with lower living costs. Because housing prices have proved to be volatile – and may not return what they did in the past — you may be better off concentrating on financial assets. As the financial

crisis demonstrated, home appreciation is far from guaranteed. Areas can be overbuilt, and speculators can drive up prices with cheap financing. As I have mentioned long time ago, moving out of the area just to be able to buy a house or an investment have to be seriously considered. While reverse mortgages can be complex and expensive – they leverage equity for current cash needs — homeowners can also get access to home equity through a “cash out” sale, selling their home and buying or renting a less expensive dwelling. Home ownership, building home equity is a smart financial step for the overall net worth picture of individuals, yet it should not be a primary driver as a source for retirement income. For most retirees, being debt-free can be a better financial strategy

than using home equity for income or expenses. Having a mortgage in retirement reduces your monthly income, which is a growing problem. Nearly a third of those 65 and older had a mortgage in 2011. That’s up from 22 percent in 2001, according to the Consumer Financial Protection Bureau. Building equity in a home is another way of approaching a debt-free status for retirement, which should be the primary goal when it comes to homeownership. Best way to retire is to not have a mortgage payment with another source as your retirement income. Senators give additional PHP5-B to PNP for its equipment MANILA, Nov. 20 (PNA) – Senators have crossed party lines to boost the Philippine National Police’s equipment budget next year by PHP5 billion, so that the PNP, in the words of Senate Minority Leader Ralph Recto, “will be able to meet its guarantee of a 15-minute maximum response time to all distress calls in urban areas.” Recto made the proposal during the Senate plenary debates on the 2017 budget of the Department of Interior and Local Government last Friday. It was accepted by Sen. Loren Legarda, chair of the Senate Finance committee. The PHP5-billion additional

fund for PNP logistical modernization will be lodged in the PHP67.5 billion Unprogrammed Fund in the PHP3.3-trillion 2017 national budget. Recto said the Senate moved to hike the PNP’s capital outlays (CO) after noticing that it will be cut from PHP3.82 billion this year to PHP3.37 billion next year, or by PHP500 million, “which could slow down its momentum in battling crime.” Several documents submitted to the Senate tell of an across-theboard shortage in equipment in the national police, “in all aspects of police work, from shoot-move-communicate to offices and data bases.”

Dengue cases in Taguig down by 15% MANILA, Nov. 20 (PNA) – The Taguig City Health Department on Sunday reported that dengue cases in the city had dropped by 15 percent this year compared to the same to the years 2013-2015. According to the City Health Department, dengue cases this year reported to 403 cases have been down by 15 percent compared to 2015 there were 474 cases. The reported cases this year were also lower by 15 percent than the previous three-year average (20132015). The City Health Department and

the Sanitation Office have devoted the entire month of November to misting and larviciding operations. City Health Officer Dr. Isaias Ramos said the activity is part of their year-round Dengue Prevention and Control Program at the same time a preventive approach against the Zika virus and the Chikungunya virus. “We are thankful as dengue incidents have been low in Taguig this year and we have zero Zika virus and Chikungunya virus. The mayor wants to keep the numbers down, thus, we will exert more effort to

achieve it,” Ramos explained. Earlier this year, Mayor Lani Cayetano issued a directive to execute an information campaign and a massive clean-up drive to destroy potential breeding sites of dengue, Chikungunya and Zika virus-carrying mosquitoes. Cayetano is happy with the negative 15 percent drop in dengue cases but not satisfied due to the two deaths reported this year. “I am happy with the result, the dengue incidents are down as well as the flooding. I have directed the City Health Office; Liga ng mga Barangay; CENRO, City Engineering Office; and the Solid Waste Manage-

ment Office to continue what they have been doing. Although the numbers are down, there were fatalities. We need to do something about it. I also would like to appeal to my constituents to do your share by being responsible and cleaning your surroundings,” she noted. The misting and larviciding operations had started and it will continue on until November 29. The priority areas are schools and high population areas in the city. A lecture on Dengue Prevention and Control will be conducted on Nov. 21 with the Philippine Coast Guard personnel stationed in the city as beneficiaries.

MANILA, Nov. 18 (PNA) – The sooner the executive order banning smoking in public places nationwide is signed, the better, an official of the International Union Against Tuberculosis and Lung Disease has said. “If he (President Rodrigo Duterte) can do that, that will be a huge tobacco control step in the Philippines,” Dr. Ehsan Latif, director of the Union’s Department of Tobacco Control, said in a recent interview with the Philippine News Agency (PNA). “And we are hoping, he does it soon,” Latif said, noting that signing the order takes political will, which the President has shown, especially

when he was mayor of Davao City. He said that once the EO is signed, it can be considered a huge step for tobacco control in the Philippines and this could lead to a reduction in the harms caused by tobacco use among Filipinos. “It’s not just about smokers. It’s about saving the future generations, the young people,” he said, pointing out that it is disturbing to see kids in the streets, holding a cigarette and even lighting it on their own. The EO expects the local government units to promote the no smoking policy in public places across the country by passing local ordinances applicable to their respective cities and municipalities.

Population commission warns of shortage of contraceptives if Supreme Court does not lift TRO By Leilani S. Junio MANILA, Nov. 21 (PNA) – The Commission on Population on Monday warned of a possible shortage of contraceptives starting 2018 if moves to hamper the implementation of the Responsible Parenthood and Reproductive Health (RPRH) Law continue. The commission’s executive director, Dr. Juan Antonio Perez III, issued the warning during the first National Family Planning Conference, held at the Novotel Hotel in Araneta Center, Cubao, Quezon City. Perez called the Temporary Restraining Order (TRO) imposed by the Supreme Court (SC) a major setback in carrying out the RPRH Law as it will affect the availability of family planning commodities “The TRO has caused the disappearance of one third of contraceptives in the country. By next year,

another third will be taken out of the market,” Perez said, noting the glaring effects of the TRO, especially on the poor. He cautioned that if the scenario continues, it is likely that by the end of 2018, only four or five kinds of contraceptives would be available in the market which the health department and the local government units could procure, and their prices would soar. This, he said, would “curtail the couples’ and an individual’s right to plan their families”. “This is not only injustice to our mothers but to our children, as well,” he said, pointing out that teen pregnancies nationwide have reached 209,000. “That’s more than 500 a day, and the situation has been the same since 2011. So for the last four or five years, we have been having over a million teen pregnancies in this

country,” he said, noting its social and economic impact, especially on the poorest sectors of society. Citing a UN Population Fund (UNFPA), he said pregnancy affects the productivity of teenage mothers and limits their chance to become economic contributors. Given the right choices and with the implementation of the RPRH, teenagers would have the opportunity to return to their studies and be contributors to economic development, he said. “This conference can rally us together to put a stand and collective action to reclaim such right, and protect Filipinos from the denial of the widest range of family planning services,” Perez said. The conference will also be an opportune time to regroup, rethink and refocus strategies to strengthen the national family planning program to empower the Filipino families,

he added. Perez meanwhile said they are looking forward to President Duterte’s signing of an executive order that would address the issue, as the Chief Executive has included the strengthening of the RPRH in its 10-point socioeconomic agenda. The TRO of the High Court focuses on the certification and recertification of modern methods of contraceptives requiring Food and Drug Administration (FDA) and the DOH to come up with guidelines, procedures in the screening, evaluation, approval, purchase and distribution of contraceptive drugs, hormonal contraceptives, intrauterine devices, injectables and other safe, legal, non-abortifacient family planning products and supplies. The DOH, the Solicitor General, Population Commission and the FDA filed for a motion for reconsideration last October.

Health dept. set for a stronger direction in first family planning conference MANILA, Nov. 21 (PNA) – The Department of Health (DOH), together with the Commission on Population and the Forum for Family Planning and Development, Inc., will gather one million signatures so that the Supreme Court would lift the temporary restraining order (TRO) on contraceptives. The department made the unified Call to Action as it spearheaded the first National Family Planning Conference in Novotel, Quezon City on Monday. The conference carried the theme, “Accelerating Progress in Family Planning: Policies, Good Practices and Future Directions”. According to the health department, based on the National

Demographic and Health Survey (NDHS) 2013, 81 percent of women of reproductive age in the country either want to delay or prevent childbearing. Meanwhile, 18 percent of these women are not using any contraceptive method, putting them at risk of unwanted pregnancy and neglecting their need for family planning. The conference aims to reduce the unmet needs for family planning, which is one of the expressed guarantees of the Philippine Health Agenda. “The relevance of this gathering is fueled by the critical challenges we are facing every day to promote the rights of couples and individ-
