DAVAO CITY, Sept. 3 (PNA) -- The death toll from the explosion Friday evening at a night market along Roxas Avenue, here rose to 14, authorities said. As of 2:00 a.m. Saturday, initial report said 14 died with dozens wounded, according to Buhangin Police Station Commander Milgrace Driz. She said the latest report came from the hospitals with three others in critical condition. The victims were rushed to the Southern Philippines Medical Center (SPMC), Limso Hospital, Davao Doctors Hospital and Brokenshire Hospital. An earlier statement from Davao City Vice Mayor Paolo Duterte confirmed that 10 victims died on the spot. Communications Secretary Martin Andanar said that Davao City has been placed on high alert and urged residents to cooperate with the police.

Recent press reports now indicate that banks are ready to begin a new push on delinquent mortgages through foreclosures and trust deed sales. Although the recession seems to have bottomed out, and house prices are no longer falling, many home owners are still behind on their payments, or sitting in homes that remain upside down in value versus debt, or both. Bottom line, home values have not yet appreciated to the point where it makes sense to stay, or pay off large delinquencies in order to avoid a foreclosure. Even with the new lower mortgage rates, few home owners will succeed in refinancing under the governmentâ&#x20AC;&#x2122;s Harp 2 program, that provides re-finance options for properties under water. For most, if your credit is compromised, or you do not have at least 40% equity, you are out of luck. Therefore a bank foreclosure may well be unavoidable during this new foreclosure wave thatâ&#x20AC;&#x2122;s about to begin. So how does that work? When you are unable to make your mortgage payments on time, the bank starts a foreclosure process. Foreclosure is a legal procedure that involves mortgaged properties. If a homeowner defaults on his or her mortgage, by either failing to make mortgage payments or failing to follow other terms of the mortgage document, foreclosure may be the result. The homeowner relinquishes all rights to the property, and the mortgage lender takes possession of the property. Usually there is a forced sale of the property at public auction; the proceeds of this sale are applied to the mortgage debt. The most widely used remedy in dealing with foreclosure, is bankruptcy. Bankruptcy is a legal procedure that begins when an individual has a cash flow deficiency caused by debts they cannot manage. It can also protect against judgments, pay garnishments, evictions and buy time in foreclosure situations. For those with little income, a chapter 7 bankruptcy gives debtors a fresh start. All unsecured debts are discharged. If you do have a regular income that is greater than the cost of living index for your area, you can still qualify for a chapter 13 bankruptcy. The U.S. Courtsâ&#x20AC;&#x2122; publication Bankruptcy Basics refers to a Chap-
ter 13 bankruptcy as â&#x20AC;&#x153;an adjustment of debts of an individual with regular incomeâ&#x20AC;? where the debtor works with the bankruptcy court to develop a repayment plan for the debtor to follow over the next three to five years. Upon completion of the repayment plan, the bankruptcy court will discharge any remaining eligible debts. A Chapter 13 bankruptcy filing can stall or derail foreclosure proceedings. Thatâ&#x20AC;&#x2122;s because of bankruptcyâ&#x20AC;&#x2122;s â&#x20AC;&#x153;automatic stayâ&#x20AC;? provisions that force creditors to the sidelines while the bankruptcy court sorts things out. The lender can petition the court to allow it to continue with the foreclosure, depending on where you are in the foreclosure process, but it should buy you some time. The following, is from page 24 of the U.S. Courtsâ&#x20AC;&#x2122; publication Bankruptcy Basics: By virtue of the automatic stay, an individual debtor faced with a threatened foreclosure of the mortgage on his or her principal residence can prevent an immediate foreclosure by filing a chapter 13 petition. Chapter 13 then affords the debtor a right to cure defaults on long-term home mortgage debts by bringing the payments current over a reasonable period of time. The debtor is permitted to cure a default with respect to a lien on the debtorâ&#x20AC;&#x2122;s principal residence up until the completion of a foreclosure sale under state law. 11 U.S.C § 1322Š. Lacson said Thursday he does not believe that the Philippine National Police (PNP) has no capability to wiretap, noting that it was already being done in the late 1990s. Lacson was responding to PNP Chief Dir. Gen. Ronald â&#x20AC;&#x153;Batoâ&#x20AC;? dela Rosaâ&#x20AC;&#x2122;s denial that the police has the capability to secretly listen to phone calls. â&#x20AC;&#x153;I wish (we) had that capability,â&#x20AC;? dela Rosa replied to the seemingly unconvinced senator during the second hearing of the Senate Committee on Public Order and Dangerous Drugs. Lacson said in an interview that when he was PNP chief, the agency was already performing wiretap operations.
He however admitted that if he were in dela Rosaâ&#x20AC;&#x2122;s position, he would also deny it, owing to the sensitivity of the issue and because amendments to the anti-wiretapping law have yet to be passed. He said dela Rosa just might admit it once the proposed amendments become â&#x20AC;&#x153;legalâ&#x20AC;?. Lacson cited the 2004 â&#x20AC;&#x153;Hello, Garciâ&#x20AC;? scandal as proof that electronic wiretapping could already be done. The scandal involved former president Gloria-Macapagal Arroyo who allegedly rigged the 2004 national election results in her favor. â&#x20AC;&#x153;If this happened in 2004, I donâ&#x20AC;&#x2122;t see any reason why (it canâ&#x20AC;&#x2122;t be done) in 2016. Fortun links PNP to Odicta couple slay MANILA, Aug 31 (Mabuhay) - The legal counsel of suspected drug lord Melvin Odicta and his wife Meriam on Wednesday accused the Philippine National Police (PNP) of having a hand in the couple’s killing. Lawyer Raymond Fortun said the Odicta couple has been receiving death threats as early as June not from supposed illegal drug associates but from the PNP. “As early as June 2016, takot na takot ang mag-asawa na may papatay sa kanila and it will come daw from PNP,” Fortun said. “Wala silang pangamba sa mga alleged drug associates kasi alam naman nila, at sinabi naman nila sa akin, na hindi naman daw sila dawit drug activities. May mga bali-balita na ang papatay sa kanila ay ang kanilang mga drug associates, walang katotohanan yan. Gawa-gawa lang yan ng mga pulis yan,” he added. Melvin and Meriam were killed early Monday morning by an unidentified suspect after disembarking from a roll-on, roll-off vessel at the Caticlan Jetty Port, days after they were linked to illegal drug activities in the Visayas region. Malacañang has earlier denied that policemen had a hand in the killing of the couple, saying investigation is ongoing to unmask the killer. “Police have already formed a special task force that would look into the deaths,” presidential spokesperson Ernesto Abella had said. “Director of the Western Visayas Regional Police has said that they do value the life of every individual and respect
due process.” Fortun said although the information he received is speculative, he decided to issue a statement after receiving threats because of reports that the couple’s lawyers allegedly received a copy of a “drug matrix” from them. “The only reason na kailangan ko magsalita kasi ang kumakalat sa Region 6 na ang drug matrix ay nasa kamay ng mga abugado. That makes me a target,” he said. Fortun said a friend has cautioned him against traveling to Iloilo, the home province of the Odicta couple. “Mayroon akong kakilala sa Region 6 na nagparating ng info na ang lumalabas daw na balita nasa abugado ang drug matrix at sinabihan ako na ‘wag pumunta ng Iloilo at ‘wag masyadong lumabas dahil delikado ang buhay ko. For me that is already a threat for my life,” he said. He denied that the lawyers of the Odicta couple have a copy of the supposed drug matrix, but added that in case there is such a document, it is covered by the attorney-client privilege on confidentiality. “Nililinaw ko, walang drug matrix na binigay si Melvin sa mga pulis, walang drug matrix na binibigay sa mga abugado at kung meron mang binigay sa abugado, mayroon kaming attorney-client privilege. Lack of plan to solve traffic crisis delays hearing on emergency powers MANILA, Aug 30 (Mabuhay) – The Senate Committee on Public Services will hold off hearings on the proposal to grant President Rodrigo Duterte emergency powers to solve the traffic crisis pending a detailed plan from the Department of Transportation (DOTr), Senator Grace Poe said Tuesday. The Senate panel, chaired by Poe, was scheduled to conduct its second hearing Tuesday morning on the proposed emergency powers. Poe, however, said the DOTr has yet to submit a draft measure that will detail the concrete projects it aims to implement to address the traffic problems. “The Executive branch is in a hurry to pass the emergency powers bill, but based on our hearings, we have learned that the DOTr and the Metropolitan Manila Development Authority have yet to come up with concrete projects under the emergency powers bill,” Poe said. The Senate has already heard the proposals of urban planners and the transport and commuter groups, and expects the DOTr to incorporate suggestions from stakeholders.

MANILA, Aug. 31 (PNA) - The government is encouraged to continue its focus on renewable energy to meet the minimum of 10,000-megawatt power demand in the next 15 years. At the sidelines of Energy Smart Philippines in Pasay City Wednesday, Senator Juan Miguel Zubiri told reporters that renewable energy can meet the country’s energy requirement in the next 20 years with the proper national policy. “I believe in renewable energy. Renewable energy alone can create at least 10,000 megawatts in the future which is enough for energy mix for the next 20 years,” said Zubiri. “It’s proper government policy. If the government gives the direction, if its focuses on renewable energy, then we can (meet the demand). We can put wind turbines all across eastern
seaboard, we can energize the whole Philippines with wind power, hydro power,” he added. The lawmaker said the government should consider a more responsive feed-in tariffs to accelerate investments in renewable energy. “Base load is fine as of the moment. But as the technology gets more efficient and more effective, we can put up a better renewable energy mix,” Zubiri said. He noted that production cost for solar power has “dramatically come down” over the years from USD2.7 million to generate one megawatt solar energy to USD1.0 million per megawatt. He added that with the move of the Department of Environment and Natural Resources to wage war against coal mining, that would mean coal-fired power plants have to import coal to run their facilities which is seen to be costly.

Senators divided on revival of Bataan Nuclear Power Plant
MANILA, Aug 31 (Mabuhay) -Senators have opposing positions on the possibility of the Bataan Nuclear Power Plant (BNPP) being revived to ensure the long-term supply of energy in the country. At the hearing of the Senate committee on energy Wednesday, Energy Sec. Alfonso Cusi said he was in favor of reviving the 620-megawatt nuclear plant, declaring that it was “safe for use.” “I have a bias. If I will make a decision, I will open it but it’s not for me to decide, it’s for the country to decide,” Cusi told the committee. While Cusi assured that we have sufficient supply, reviving the Bataan plant would beef up power reserves, lowering the risk of parts of the country being placed under yellow and red alerts as what happened in recent months. “What we are trying to do is to have that reserve. We have to make that as a policy. Is that 5 percent of the demand, 10, 15 or 20 percent?” Cusi said. “Napakanipis ng reserve. Pag nakuha ‘yun, we would have a stable supply. Yung yellow at red alert, hindi na pangangambahan ngayon ‘yun,” he added. But Sen. Sherwin Gatchalian, chairman of the energy committee, opposed the plan, saying the needed $1-billion investment to refurbish the power plant would be better spent on “more feasible generation projects.” Gatchalian added that the BNPP’s location atop a geological fault makes it a safety hazard for the entire Luzon island group.
He said the plant, built four decades ago, was simply outdated. “At this point our country simply has not developed the necessary technical expertise to operate BNPP or any modern nuclear power plant in a safe and cost-efficient manner,” Gatchalian said. For his part, Sen. JV Ejercito said he was in favor of DOE’s position in seriously considering reopening the plant, with it potentially being the cheapest source of energy. “I was suprised that this is really in a very good condition...It’s owned by the taxpayers. Ang sa akin lang, why don’t we reconsider using it? It’s an asset worth billions and that’s just sitting there,” Ejercito said. Sen. Richard Gordon said that while tapping nuclear power is unpopular, it was still an option worth considering, especially with the possible energy demand that comes with the country’s increasing growth rate. “I don’t care if nuclear is unpopular....Ang importante satin dito, malaman nating mga senador ano ba ng down the line? You have a plethora of options. What are we doing to get power here?” Gordon said. Sen. Nancy Binay said it was high time that the DOE make a final decision on the BNPP, whether or not it should be reopened or completely shut down. Cusi said the DOE was “studying all options” available to them. “The problem is that, what we have now - oil, diesel, natural gas, and coal - that has a limited life. Up to a certain time, the Malampaya, that will be over, that will be depleted by 2022 or 2024,” Cusi said.

Subic Bay is now PHL’s 4th leading tourist spot
SUBIC BAY FREEPORT, Sept. 1 (PNA) – Subic Bay is now the fourth most popular tourism destination in the Philippines, director of Central Luzon’s regional tourism office, Ronaldo P. Tiotuico has said. In a press statement, Tiotuico announced that the Subic Bay Freeport and the rest of Zambales have soared to the fourth spot, bested only by Cebu, Davao and Camarines Sur, among the top 10 tourist attractions across the country. The Subic Bay Freeport, he said, made big strides by hosting some 1.67 million domestic and foreign visitors in 2015, 28 percent higher than the 1.26 million visitors registered a year earlier. The tourism official also cited the Subic Bay Metropolitan Authority (SBMA) as instrumental in
developing Subic as a major tourist destination in Central Luzon. “Such a success is attributed to the collective determination of the entire manpower complement of the SBMA under the leadership of Chairman Roberto Garcia,” Tiotuico said. MANILA, Sept. 1 (PNA) – Tourism Secretary Wanda Teo has stressed that the agency is now focused on developing a highly-competitive tourism industry and an inclusive, and sustainable growth, even as she disclosed a continued increase in revenues during the last six months of the previous administration. “We must shoot for the stars and maintain an upward trend in terms of visitor arrivals and revenues, for the benefit of all stakeholders,” said Teo, who assumed as Department of Tourism chief July 1st. She went on to say, “The DOT and the tourism industry stakeholders
will collectively work to increase revenues from PHP2.8 trillion in 2015 to PHP3.9 trillion by 2022. From the current 8.2 percent share of the country’s GDP, we’ll raise it to 10 percent by 2022.” Teo noted that, despite being endowed with world-class tourist attractions, the Philippines lags behind Thailand, Malaysia, Singapore, Indonesia and even Vietnam in terms of visitor arrivals as of 2015. She said the agency targets to attract international visitors, from a total of 5.4 million in 2015 to 12 million by 2022, as well as generate domestic tourists from 68 million in
2015 to 89 million in 2022. The DOT chief made the assertions as she disclosed that international tourist arrivals generated PHP 127.37 billion in revenues within the first six months-period of the year, a 14.7 percent increase compared to the same period in 2015 of PHP 111.05 billion. At least 2,978,438 overseas visitors came in January to June period, 13 percent higher than the 2,619, 625 arrivals in the first six months last year. There were 459,138 visitor arrivals in June alone before the Duterte administration took office.

Housing forecast for the remaining 2016 The best housing markets forecast for the next five years are composed of 10 cities scattered from Washington State to Florida. These 10 U.S. cities are projected by Housing Predictor to have the highest probability of appreciating the most for all cities in the nation through 2016. Unfortunately, California is not on that list. I think our California economy is sustainable and will evolve sooner and we will see appreciation in the double digits within the next five years. Most of the best real estate markets are centrally located to attract a large number of sizeable employers, and are likely to produce better regional economic conditions as a result. A few are exceptions to this rule, including Miami, which tops the list with the highest projected housing inflation. Miami is an international designation for vacationers and has become a world class resort community, attracting home and condo purchasers from all over the world. If there’s ever been a time to buy housing in Miami in this decade, chances are this is it. Across the nation, San Francisco ranks second on the list. A rich diverse cultural mix of people has transformed the greater Bay Area into a world class city to make home. Further south on the San Francisco Peninsula, Los Altos ranks third. Ushered in by the rich high tech business, more millionaires are busting out on the peninsula than anywhere else in the U.S. and the majority of buyers are paying cash for homes. Seattle has weathered the housing downturn better than the majority of the nation, despite a sizeable decline in home values. The city has a reputation for getting more rain than most other places and it’s an anchor for major employers, including Microsoft, Amazon and Boeing. Higher salaries paid to workers should bol-
ster the housing market. Medford and Eugene, Oregon should also lead the nation out of the housing downturn, with higher home values than most of the rest of the country over the next five years, a necessity to be named to the list. As a recognized leader in the wine industry, Napa is forecast to see more economic growth than ever before in its history, pushing new home construction and values much higher. Naples, Florida has been a vacation destination for old time east coast residents for decades and shouldn’t have much of a problem re-establishing itself over the next five years. Austin, Texas is a technological hub attracting a younger sector, and lots of growing companies supplying jobs to bolster the housing market. Lastly, Tucson, Arizona should be re-energized over the period to reemerge as a growing boom town in the new decade. Home prices will keep climbing, but homes remain affordable across the U.S. Last quarter, more than six in 10 U.S. homes were “affordable” to households earning the national median income, assuming that household used a 30-year conventional mortgage to finance the home, made a modest down payment on the property, and carried good credit scores. The second quarter of 2016 was defined by low mortgage rates. New 3-year lows were achieved, and rates came within a breath of all-time lows set in November 2012.
This kept affordability in check. But as it stands, affordability is highly dependent on continued low rates. Prices keep rising, and hit the highest level since the second quarter of 2007. For buyers wanting to maximize their home-buying dollar, then, the next few months may be an opportune time to purchase a home. After that, home affordability may become much worse. 62% Of U.S. Homes “Affordable” For Typical Buyer The National Association of Home
Builders (NAHB) has released its Housing Opportunity Index (HOI) for this year’s second quarter. The Housing Opportunity Index is a quarterly gauge of home affordability which tracks the typical U.S. household’s ability to purchase the typical U.S. home. Data is collected across more than 225 metropolitan areas. Donnie “Ahas” Nietes, the longest reigning Filipino boxing champion, is set to lead two other Pinoy boxers in match ups with Mexican opponents at the Stubhub Center in Carson City on September 24. The event, dubbed as Pinoy Pride 38: “Philippines vs. Mexico,” will headline Nietes debut in the 112 lbs 12-rounds World Boxing Organization (WBO) Inter-continental Flyweight Championship against Mexico’s Edgar Sosa, a former World Boxing Council (WBC) champion. In press conference at Max’s Restaurant in Glendale on Tuesday (August 30), Nietes promised an explosive battle with Sosa. “Pag may tsansa po, patutulugin natin,” Nietes told mediamen. Nietes has successfully defended his WBO and The Ring Light Flyweight titles (108 lbs) against five Mexican boxers since surpassing the record by Filipino boxing icon Gabriel “Flash” Elorde. Also expected to bring action on fight night is Mark “Magnifico” Magsayo who will be facing Ruben Garcia for the WBO International Featherweight (126 lbs) Championship. Magsayo, ranked number 9 in WBO, has been earning the admiration of boxing fans because of his impressive wins. He knocked out American boxer Chris Avalos in Cebu City last April as an undercard to the Nonito Donaire-Zsolt Bedak title fight.
The rising star fighter is 14-0 (WL) with 11 knockouts. Meanwhile, the fight night is also going to be a return bout between Filipino boxer “King” Arthur Villanueva and Mexico’s Juan “El Penita” Jimenez. Villanueva and Jimenez fought in Cebu City last May. The boxers accidentally clashed heads in the fourth round. The referee apparently saw a punch hitting Jimenez before the accident and counted out the Mexican fighter. During an interview in Glendale, Edito Villamor, ALA Promotions matchmaker, insisted that Villanueva indeed managed to sneak a right cross into Jimenez head before the heads of the boxers clashed. “Tinamaan naman talaga ‘yung kalaban. Client files adversary against debtor for $370k; senior files chapter 7 to discharge $40k credit Client is a foreign company doing business with a California company since 2012. Client is one of the worldâ&#x20AC;&#x2122;s largest manufacturers of a certain kind of equipment, which CA Company sells and distributes in the United States. Business was good reaching low million dollar figures until CA Company was sued by a person whose relationship to the CA company is am not clear on. But this plaintiff was able to get a judgment against the CA Company for $1.0M and proceeded to levy the bank accounts of the CA Company. The company appealed the judgment saying that the state court judgment was based on fake documents then filed a Chapter 11 case to shield itself from the judgment levy on its bank accounts so that it could continue operating. Clientâ&#x20AC;&#x2122;s interest in the case is that client gave CA Company a credit line of $3.0M for trade financing of itâ&#x20AC;&#x2122;s shipments to the CA company. When CA Company filed for Chapter 11, it owed client about $400K unpaid. Client continued to do business with CA Company despite itâ&#x20AC;&#x2122;s being on Chapter 11 andcontinued shipping it merchandise. The CA Company continued paying client until the trustee forced the conversion of the Chapter 11 case to Chapter 7. When the case was converted to Chapter 7, client was still owed $250K, and CA Company had not yet executed the transfer documents for a trademark that client had bought and paid for in the amount of $120K. So, we filed two claims against the Chapter 7 trustee. One claim was for $250K of unpaid merchandise, which we claimed was secured because there was a title retention agreement for unpaid merchandise, and a claim for ownership of the trademark, or $120K. A lot of litigation ensued between client and the Chapter 7 trustee, and the plaintiff who had a $1.0M judgment against the debtor. The Court eventually ruled in favor of client on the issue of the trademark
ruling that since client had bought and paid for it, client owned the trademark. Trustee agreed to not challenge this, and considered it as a final disposition of that matter. So, the trustee transferred the trademark to client. However, the unpaid inventory is still at issue and the trial is next month. There are specific steps that a creditor can take to protect itself in bankruptcy. The first is to make sure that your claim is secured because secured creditors are treated differently from unsecured creditors. Secured creditors have priority over unsecured creditors in bankruptcy. If there is money left in the bankruptcy estate, secured creditors get paid in full first; then, if there is money left, unsecured creditors share equally proportionately. The legal problem that normally surfaces a secured creditor is whether or not its claim is actually secured in the legal sense of the word. For instance, a mortgage that is signed by both parties but not recorded is not a secured debt. It is an unsecured debt. But if the mortgage is recorded, the mortgage becomes a secured debt. Even if there is a bankruptcy, the mortgage holder can ask permission from the Court to proceed with foreclosure on the property if the post-petition mortgage payments are not being made. So, in Chapter 13 if the post petition mortgage payment has not been made, the creditor can file a motion for relief from the automatic stay. This motion is normally heard in 30 days. If debtor does not pay the post petition default on or before the hearing date with certified funds, the Court will grant the relief motion and
allow the creditor with State law foreclosure remedies. Next client is a 62. He still works as a radiology technician and makes about $70K a year. He is single and doesnâ&#x20AC;&#x2122;t own a house. He has several dependents; his sister and two nieces. He also sends money abroad to another sister who has a large family because his brother in law does not work. In other words, client has a good heart and all his income is spent to care for his family. The choice now is there is a conflict between money that has to be sent to his sister abroad, or to pay for minimum payments on his $40K credit cards. He sends $1,200 a month to his sister abroad, while he also needs $1,200 a month to keep his $40K credit cards current. Itâ&#x20AC;&#x2122;s hardly a choice is it? The right choice is to continue sending $1,200 a month to his sister with the large family because they have to continue having a roof over their heads and food to eat. Some of the money sent goes to the college education of his nieces and nephews, which is also good. On the other hand, $1,200 a month to keep $40K credit cards current is a luxury that client can no longer afford. He has paid it for at least ten years, which is a grand total of $144,000. $144K is more than enough to pay off $40K of credit cards, isnâ&#x20AC;&#x2122;t it? But thatâ&#x20AC;&#x2122;s not how it works. After paying $144K for ten years, clients still owes the very same $40K of credit cards! Itâ&#x20AC;&#x2122;s totally unfair. But who ever said that the world has to be fair? Instead of paying for credit cards, client could have bought a house instead, here or abroad so that the house can be used as a family home for his relatives. Client wants to continue working until forever. I can understand that. As long as one is healthy, one will feel the same even in the sixties, one still feels young. Itâ&#x20AC;&#x2122;s all in the mind. I started counting backwards a long time ago. Truth be told, I donâ&#x20AC;&#x2122;t feel a day over 28 but that was a long time ago, yet
it feels like that was only yesterday. So this is life. We are only here temporarily and only for a short period of time. To live for eternity in paradise, we have to believe in Jesus Christ who said that â&#x20AC;&#x153;I am the way, the truth and the light; No one gets to the Father, except through me.â&#x20AC;? Thatâ&#x20AC;&#x2122;s pretty simple and clear, isnâ&#x20AC;&#x2122;t it? Grounds for annulling a marriage Most couples that want out of a marriage in California usually file for Divorce. There are circumstances though that allow a couple to have their marriage “voided” rather than “dissolved.” There is a big difference between the two concepts. With a voided marriage, it restores the couple to status of unmarried person as if they have never been married before. In a divorce, the couple would always be regarded to as married during the period of the marriage. Unlike Divorce which can be obtained regardless of the reason. Voiding a marriage may only be obtained based on certain grounds. It is void in cases of incest and bigamy. It is voidable in cases of minority, Unsound Mind, Fraud, Force, or Physical Incapacity. The front-end debt-to-income ratio is calculated as (total housing payment) divided by (total monthly income). To qualify a lender can go up to 45% back end debt ratio. The index also assumes conventional financing via Fannie Mae or Freddie Mac, plus a ten percent home

One such circumstance is when the petitioner was under 18 years old when the petitioner married and the parents did not provide their consent. The Nullity petition based on this ground has to be filed within four years after the party turns 18. The parent of the minor may also file the Petition provided it is filed prior to the minor turning 18. Another situation is a bigamist marriage where the first spouse has been absent and not known to be living for 5 years prior to the second marriage or if the party believed the spouse to be dead at the time of the second marriage. A Nullity based on this ground may be filed during the life of the other party. A marriage may be voided if either party was of unsound mind at the time of the marriage. Unsound Mind means a person is incapable of understanding the nature of the marriage contract and the duties and responsibilities it creates which depends on the degree of mental capacity of the party. This may not be a ground if the party later on came to reason yet continued to freely cohabitate with the spouse. Fraud is another ground for voiding a marriage. The false representation or concealment must relate to a substantive matter and directly affect the purpose of the party deceived in entering the marriage. The fraud must go to the very essence of the marital relation before it is sufficient for an annulment. It is not sufficient simply to contend that your spouse turned out to be a lazy, drunken disappointment. Nullity based on fraud has to be filed within four years of discovering the fraud. Certain marriages that are entered into by force are voidable. Circumstances that meet these standards requires that the forced party’s free will to have been overcome by the

spouse such as through the use of threats. These type of Nullity must be filed within four years from the date of marriage. A marriage where the spouse was found to be incapable of physically engaging in copulation may be voided. It can only be filed by the spouse that does not have the physical incapacity and must be filed within four years of the marriage. Before deciding weather a divorce is the appropriate avenue to end your marriage, parties should evaluate if a Nullity is a viable alternative and weather it serves their best interest. The case of the night security guards I had been practicing law for almost two years when several Filipinos met me in my office. They came to consult about what was seemingly an unfair labor practice by the company they worked for. That company happens to be the biggest provider of construction security guards in California, if not in the entire United States. The company they worked for employed security guards who watched over construction sites at night and on the week-ends, when the construction workers have gone home, and the construction site have to be guarded against thieves and vandals. On each construction site was small portable home (&quot;trailer&quot;) where the guard could cook, sleep, watch television, and other things when he was not on duty. The guards were oftentimes called &quot;trailer guards&quot;. The trailer guard duty started at 5:00 p.m. and ended at 7:00 a.m. Close to 9:00 p.m., the guard activates sensors that go around the construction site. He then is supposed to be &quot;off the clock&quot; and goes to his trailer home at 9:00 p.m. At 5:00 a.m., he is back on duty. He goes around and de-activates the sensors. He clocks out at 7:00 a.m., when the construction crew start working. He is thus &quot;on duty&quot; for six hours total - 4 hours from 5:00 p.m. to 9:00 p.m., and 2 hours from 5:00 a.m. to 9:00 a.m. The guard is paid for seven hours of work per day. If there is a commotion (i.e. the sensor detects movement, and the alarm is triggered), the guard investigates. He is paid for the time he investigates. The trailer guards who came to me believed that they should be paid for the time from 9:00 p.m. to 5:00 a.m. After a little research, I too, believed that those hours were work hours, and the security guards were entitled to full compensation for those hours. I agreed to represent the security guards. I decided to file a class action in behalf of all the night security guards employed by the company. A Class Action is different from a regular civil lawsuit. In a class action, several individuals who have substantial similarities in their claims are grouped together in a single lawsuit. It is more efficient and economical for parties and courts to litigate the matter as a single proceeding than as several individual cases. For example, there about two thousand trailer guards employed by the same company. These guards have substantially similar, if not exactly similar claims. They were harmed by their company employer in the same way; they were not paid for work done from 9:00 p.m. to 5:00 a.m. So, instead of several individual cases, a class action will allow numerous claims to proceed in a single lawsuit. A court decision on the said class action is typically binding to the defendant/ company and members of the class, even

those who did not actually participate in the litigation. Those guards who came to my office and who signed the retainer agreement with me acted for the entire â&#x20AC;&#x2DC;classâ&#x20AC;&#x2122; of trailer guards. They were called â&#x20AC;&#x153;class representativesâ&#x20AC;?. When I talked to the attorney for the security guard company, he laughed and said he previously handled seven individual cases by night security guards involving the same issue, and for every one of those cases, the security guard company prevailed. That meant that the courts had ruled that the time from 9:00 p.m. to 5:00 a.m. were not &quot;work hours&quot; and were not compensable. I was probably naive, and didn&#39;t think much about the difficulties. After doing research, I was totally convinced that the law favored the night security guards. So I drafted and filed a class action complaint against the security guard company. I bought several books on how to litigate a class action. Me and my associate went to the Superior Court and reviewed the case files for several class actions involving unpaid wages and overtime. In a civil lawsuit, there is a stage of the litigation called &quot;discovery .&quot; In discovery, the parties to the lawsuit gather the evidence that can be used during the litigation, and ultimately, at trial. The trial is the process where the parties, thru their lawyers, present evidence to a jury. The jury then make a decision on whether the plaintiffs or the defendants win. I took the deposition testimonies of several executives of the security guard company - the person who headed the operations, the person who headed their finance department, the person who was head of their marketing department. A deposition is a procedure where a witness testifies under oath by answering questions by an attorney. I also took the deposition testimony of an operations supervisor, who happened to be a Filipino. I gathered lot of documents: the security guards&#39; daily reports, the agreements with the company, the company&#39;s contracts with the construction sites, the time cards and payroll, the procedures manual of the company, and many others. The case took several years. Several motions were filed and argued upon. Along the way, I asked another attorney to work with me on the case. Police have reported that close to 800 drug pushers and users have been killed in legitimate police operations and more than 10,000 drug addicts have been arrested. ”I’m trying to catch up with time,” President Duterte said. He said the more than three million Filipinos addicted to drugs is enough proof that there is a crisis in the country, requiring drastic actions from the government. President Duterte told the repatriated OFWs to avoid drugs and instead help him fight the menace, along with graft and corruption, and criminality. ”Avoid drugs at all costs because it could cost your life too. That’s the reality because we have three million plus affected. That is a crisis for the country,” Duterte said.
To help the OFWs displaced by the financial crisis, President Duterte said the government has shouldered their plane tickets and is handing them PHP5,000 each. The government will also enroll them temporarily in the 4Ps or Pantawid Pamilyang Pilipino Program. President Duterte was joined by Labor Secretary Silvestre Bello III and Foreign Affairs Secretary Perfecto Yasay in welcoming the repatriated OFWs.

Caregiver law requires overtime pay Under California law many caregivers must be paid overtime compensation when working more than 9 hours a day or 45 hours a week. In my experience, very few 24-hour caregivers are paid correctly. With California’s increase in the minimum wage to $10 an hour, many 24-hour caregivers must be paid a minimum of $315 a day to comply with the current law. If you are working as a caregiver and paid a day rate less than $315, under California law, you are not being paid any overtime and may have a substantial unpaid overtime claim. Oftentimes, employers attempt to avoid liability by claiming the caregiver is an “independent contractor.” In most circumstances, this argument will fail as typically employers

many issues that had to be litigated along the way: the interplay of Federal and State laws regarding wages, the proper application of the California Wage Orders, the extent of control for on-call employees for hours to be considered work hours, whether the trailers were work stations or residences, etc. Towards the end, the trial court ruled that the night security guards were indeed entitled to compensation for the hours from 9:00 p.m. to 5:00 a.m. This meant that the company owed a lot of money. Not only were the guards entitled to payment for those hours, but the laws regarding overtime kicked in once those hours were treated as work hours. The security guard company appealed the trial court decision, and they lost in the court of appeals. They then asked for a review by the California Supreme Court. But the Supreme Court refused to review the decision. What followed afterwards were extensive negotiations on how much the
maintain significant control over the caregiver. The change in the overtime rules for caregivers became effective on January 1, 2014, whenthe Domestic Worker Bill of Rights (DWBR) became law. Previously,employees who qualified as “personal attendants,” including caregivers, nannies and babysitters who worked in private householdsdid not qualify for overtime.
The DWBR eliminated the overtime exemption for personal attendants and provides that personal attendants “shall not be employed more than nine hours in any workday or more than 45 hours in any workweek unless the employee receives one and one-half times the employee’s regular rate of pay for all hours worked over nine hours in any workday and for all hours worked more than 45 hours in the workweek.”Now, caregivers, nannies and babysitters (withlimited exceptions) must be paid overtime compensation. Unfortunately, this law does not cover IHSS workers and those caring for close family members. Under Labor Code§ 1194, caregivers are not only able to recover their unpaid overtime in

If the company filed for bankruptcy, it would have taken a long, long time before the security guards were paid, if at all. Finally, a settlement amount was reached. The night security guards were compensated for the work done from 9:00 p.m. to 5:00 a.m., although they did not get the full amount. The security guard company agreed to change their practices. • Years later, some night security guards for the same company came to me and complained about what they thought were unlawful practices of the same company, with similar allegations as before. Again, the company did not pay the security guards for the time 9:00 p.m. to 5:00 a.m. Since the end of the first litigation, the company instituted procedures where the night security guard can leave the construction site premises if they ask permission to do so.
This time, the company reasoned that since the security guards can leave the premises if they ask permission to do so, they were not entitled to payment for those hours even if they did not leave the premises. Just like the complaining trailer guards, I thought the trailer guards were entitled to compensation for the hours they were at the work site from 9:00 p.m. to 5:00 a.m. I filed another class action complaint against the company. Again, the security guard company lost in the trial court. In the court of appeal, the security guard company lost again. This time, the California Supreme Court agreed to review the matter. The California Supreme Court ruled in favor of the night security guards. The decision of the California Supreme Court in this case certainly makes the workplace landscape better for all workers in California, not only for the night security guards. Caesar S. MANILA, Aug 30 (Mabuhay) – The chairman of the government’s negotiating panel with the National Democratic Front on Tuesday blamed the Aquino administration for the five-year impasse in the peace talks with the communist movement. Government peace panel chair Silvestre Bello III did not name former President Benigno Aquino III but pertained to the administration of the “immediate past president.” “Noong nakaraang administration ng immediate past president, hindi nila in-honor yung mga agreements na ito kaya nagkaroon ng impasse sa talks,” said Bello, who is also the secretary of labor. “Siguro alam naman natin, hindi na lang ako magbanggit baka makasakit ng damdamin, pero maliwanag naman na kaya hindi umusad at nagkaroon ng impasse ang talks ay dahil sa issue na ayaw kilalanin ng ating gobyerno noong nakaraang [administrasyon] yung nilagdaan nating agreements,” he added. Bello said 10 signed agreements were not honored by the Aquino administration including those on humanitarian and human rights laws. Senators divided on revival of Bataan Nuclear Power Plant MANILA, Aug 31 (Mabuhay) – Senators have opposing positions on the possibility of the Bataan Nuclear Power Plant (BNPP) being revived to ensure the long-term supply of energy in the country. At the hearing of the Senate committee on energy Wednesday, Energy Sec. Alfonso Cusi said he was in favor of reviving the 620-megawatt nuclear plant, declaring that it was “safe for use.” “I have a bias. If I will make a decision, I will open it but it’s not for me to decide, it’s for the country to decide,” Cusi told the committee. While Cusi assured that we have sufficient supply, reviving the Bataan plant would beef up power reserves, lowering the risk of parts of the country being placed under yellow and red alerts as what happened in
recent months. “What we are trying to do is to have that reserve. We have to make that as a policy. Is that 5 percent of the demand, 10, 15 or 20 percent?” Cusi said. “Napakanipis ng reserve. Sherwin Gatchalian, chairman of the energy committee, opposed the plan, saying the needed $1-billion investment to refurbish the power plant would be better spent on “more feasible generation projects.” Gatchalian added that the BNPP’s location atop a geological fault makes it a safety hazard for the entire Luzon island group. He said the plant, built four decades ago, was simply outdated.
2,500 more soldiers sent to fight Abu Sayyaf MANILA, Aug 30 (Mabuhay) – Malacañang on Tuesday revealed that five more battalions, equivalent to about 2,500 soldiers, will be deployed to Sulu to fight the Abu Sayyaf Group. Clashes between government troops and the bandits since Thursday have claimed the lives of at least 15 soldiers and more than 20 Abu Sayyaf bandits, after President Rodrigo Duterte ordered the military to destroy the bandit group which recently beheaded its teenage captive. “It is unfortunate that a number of troops lost their lives. However, as Defense secretary [Delfin] Lorenzana said, we are going full force and have an all-out operation. We are adding 5 battalions. That will be only in Sulu,” Presidential Spokesperson Ernesto Abella said. The Armed Forces reported skirmishes between government forces and the bandits on Monday. In one of the clashes which occurred in the afternoon, Abu Sayyaf sub-leader Jamiri Jawong Jauhari was wounded. The Abu Sayyaf, known for kidnapping and beheading captives, has dogged succes-

Dead men tell no tales We’ve heard of it before. Dead men tell no tales This is exactly what happened to Iloilo top drug lord Melvin Odicta. For those who missed it, he and his wife Meriam were shot dead early Monday morning by unidentified assailants after exiting from the Port of Caticlan in Aklan. The assailants, according to the police, managed to escape under the cover of darkness. The couple were on their way home to Iloilo when the shooting occurred. The Odictas came from Manila where they had a meeting with DILG Secretary Ismael Sueno, where they denied their involvement in the illegal drugs business. The Odictas, police reports revealed, have been on the watchlist of the Philippine Drugs Enforcement Agency (PDEA), however. Despite being in the watchlist for so many years, the Odictas were never invited for questioning by law enforcement agencies regarding their alleged links with drug syndicates or their involvement in the proliferation of illegal drugs in the Western Visayas region. This angle should be “looked into” by the police – to find out who among the top politicians of Iloilo as well as high ranking police officers might have shielded the Odicta couple from being harassed by law enforcement agencies. President Duterte said recently Iloilo is the most “shabolized” province in the country. I don’t know why Senator Frank Drilon, who is from Iloilo and one of the most outspoken politicians in the country today, is surprisingly silent on this matter. Maybe the senator is just busy gloating on the now completed multi-billion peso Iloilo Convention Center. By the way, the contractor who built the convention center, which is a pet project of Drilon, is the same builder who constructed the overpriced controversial Makati Car Park building. Critics of President Duterte are saying that the Odictas were killed either by the police or by a vigilante group responsible for the deaths of so many suspected drug peddlers and addicts all over the country. Police, on the other hand, are saying that there is a strong possibility that Odicta and his wife were killed by drug syndicates to prevent him from implicating government officials and ranking police generals involved in the illegal drugs trade. Secretary Sueno is not saying if the Odicta couple mentioned any names or if they implicated anyone involved after what turned out to be their last trip to Manila. After the death of Odicta, who’s next? Maybe Pangasinan Congressman Amado Espino Jr or Albuera town Mayor Rodolfo Espinosa of Leyte? Both Congressman Espino and Mayor Espinosa were tagged by President Duterte as having been involved in the illegal drugs. Mayor Espinosa has already admitted being a drug coddler. Police said the mayor is also engaged in illegal drugs, together with his son “Kerwin.” He earlier executed a sworn affidavit linking Senator Leila De Lima and Pangasinan Congressman Amado Espino Jr as well as former Justice Undersecretary Francisco Baraan III as having a hand in the protection of drug lords as well as the proliferation of narcotics in the country. The mayor also detailed in his affidavit that De Lima, Espino and Baraan were responsible for the rise of his son, Kerwin, to be the top drug lord in Eastern Visayas. While Espinosa has surrendered to authorities and has sought police protection for fear of his life, Espino continues to deny any involvement in the narcotics trade. Police said Espino is worth P4 billion. How he acquired so much wealth in so short a time is unbelievable. Among the many properties he owns include an island in Pangasinan, and a 20-hectare fishpond located also in Pangasinan and a fleet of imported cars and vans. If found guilty, President Duterte
should order the seizure of all of Espino’s property and auction them. The proceeds should be given to indigents or to finance the construction of health centers in the rural areas of the country. • Embattled Senator and suspected drug lords coddler Leila de Lima is slowly but surely sinking into a quagmire with no hope of being extricated by her fellow Liberal Party senators for her alleged involvement in the narcotics business. The Ethics Committee of the Senate is expected to deliberate on the merits of the complaint filed recently by one Abelardo de Jesus, a lawyer, regarding the alleged involvement of De Lima in the Narcotics trade. De Jesus wants the Senate Ethics committee to look into the possible involvement of De Lima while she was the Secretary of Justice. Everyone knows that illegal drugs flourished during her reign in the Justice department during the administration of President Benigno Aquino. More and more people are demanding that De Lima resign from the Senate, or at least take a leave of absence, until such time that the allegations about her being a drug coddler are proven to be untrue. They said De Lima has lost her moral authority to discharge her duties as a lawmaker. Her loyal party mates and supporters, on the other, are encouraging her not to step down from the Senate since she was duly elected by some 12 million Filipinos. But if I were De Lima, the very least that I will do is to take a leave of absence until such time that all charges leveled against her will be proven to be false.

DFA says 3 Pinoys in China death row for drugs
MANILA, Aug 30 (Mabuhay) – Foreign Affairs Secretary Perfecto Yasay Jr., on Tuesday said as many as three Filipinos are facing the death sentence in China for illegal drugs. “We have for instance in China , two to three are facing death sentence. They have not been scheduled for execution,” he said. Yasay also revealed that there are 2,492 Filipinos across the world facing cases for drug-related offenses. But in the Philippines, President Rodrigo Duterte wants to restore the death penalty for illegal drugs offenses. Yasay also confirmed there are seven Filipinos in Saudia Arabia who are in detention for murder charges and are in need of assistance. Yasay told lawmakers at the House Appropriations Committee that the agency has a legal defense fund of P100M. He said, this amount is accumulated annually since the allocation doesn’t get exhausted. “We have 7 Filipinos detained in KSA for murder. They continue to require legal assistance. This amount will also be made to answer for such a contingency this amount so far has been adequate in terms of the needs of our legal defense.” The Department of Foreign Affairs was told to submit a list of Filipinos linked to cases of illegal drugs and how many of these are on death row. Gov’t revenue down in July, deficit widens by 57% MANILA, Aug 30 (Mabuhay) – Government revenue fell in July from a year earlier as non-tax income slowed while expenditures rose on strong public spending. It was the Duterte administration’s first month in office. “The total revenues for July declined 5 percent year-on-year owing to reduced non-tax income from the operations of the Bureau of the Treasury and other offices, while expenditures grew 5 percent as a result of strong public spending,” the Department of Finance (DOF) said in an emailed statement. According to the Finance Department, the budget deficit widened by 57 percent to P50.7 billion from P32.2 billion. This brought the seven-month
fiscal gap to P171.0 billion—still less than half of the year’s P388.87-billion deficit program, but higher than the P18.5-billion shortfall in the same period last year. Total revenues amounted to P1.27 trillion as of end-July, up 1 percent from the P1.26 trillion. Excluding the one-off transfer of coconut levy assets in May 2015, revenue growth in the first seven months would have been 6 percent. Disbursements grew by 12 percent year-on-year to P1.44 trillion from P1.28 trillion. Tax collections of the Bureau of Internal Revenue (BIR) and the Bureau of Customs (BOC) – which account for about 90 percent of government revenue, along with other offices – increased by 9 percent to P1.132 trillion in January to July.

DOH advice to travelers: Take extra precautions against Zika virus infection By Leilani S. Junio
MANILA, Aug. 31 (PNA) â&#x20AC;&#x201C; The Department of Health (DOH) called on Filipino travelers on Wednesday to take extra precautions while staying in Zika-affected countries wherein there is an active local transmission. The Health agency, at the same time, advised pregnant women to avoid traveling to Singapore and other neighboring countries where cases of Zika are reportedly on the rise. â&#x20AC;&#x153;It is very risky for pregnant women to get infected with the Zika virus,â&#x20AC;? said DOH Secretary Dr. Paulyn Jean B. Rosell-Ubial. She said Zika virus infection has been linked to birth of babies with severe brain and other neurological defects, including microcephaly. Microcephaly is a rare condition wherein a baby is born with a small head. Secretary Ubial said that because Zika virus is also sexually-transmitted, women and their partners and others who plan for pregnancy should observe safe sex precautions or use condoms to avoid infection. She also said that they continue to have close coordination with the Bureau of Quarantine for continuing screening of arriving passengers in airports and seaports for signs of fever. â&#x20AC;&#x153;These passengers are reminded to fill out a health declaration checklist upon arrival and to report or visit any government health facility if they become ill with unexplained fever within seven days from arriv-

These mosquitoes are the same type of mosquito that spread dengue and chikungunya. These particular mosquitoes are existing in the country. Signs and symptoms of Zika usually begin three to seven days after being bitten by an infected mosquito. Common symptoms include fever, skin rash, joint pains, and conjunctivitis. The illness is usually mild. Not everyone who gets infected display symptoms -- meaning someone could have been infected and become a carrier without knowing it. The danger with this is if a male carrier will have sexual contact and transmit the infection to the partner who, once becoming pregnant, there is a probability of giving birth to a baby with birth defects. â&#x20AC;&#x153;That is why it is important to avoid mosquito bites. Hence, it is very important to clean the surroundings in order to prevent the multiplication of Aedes aegypti mosquitoes that serve as vectors of the said virus,â&#x20AC;? the Health Chief explained. In line with this, she again issued the call for the conduct of the â&#x20AC;&#x153;4Sâ&#x20AC;? campaign. The 4S means â&#x20AC;&#x153;Search and destroy mosquito breeding places; use Self-protection measures; Seek early consultation for fever lasting more than two days, and Say no to indiscriminate fogging.â&#x20AC;?

Press reports had said that the number of confirmed cases of Zika virus in Singapore rose to 82 on Tuesday, with some of the latest infections detected beyond the area of the initial outbreak. The mosquito-borne Zika virus was detected in Brazil last year and has since spread across the Americas. It poses a risk to pregnant women as it can cause severe birth defects. It has been linked in Brazil to more than 1,800 cases of microcephaly, a rare birth defect where babies are born with abnormally small heads and brains.

Finance Secretary Carlos Dominguez III told Senators in a presentation on Tuesday. Junk food and softdrinks are expected to be part â&#x20AC;&#x153;fatty foodsâ&#x20AC;? category. Dominguez said the Finance Department is scheduled to submit
before Congress the specific tax reforms it recommends. In July, the DOF revealed plans to submit its proposed reforms to the Congress by September. Among the reforms set to be proposed include the lowering of corporate tax, and the widening of the tax base. According to Dominguez, tax collections reached P1.1 trillion during the first six months of the year, up by 1.4 percent from the same period in 2015. For the full year of 2016, the government expects to collect P2.2 trillion.(MNS)
Medicare Part D In 2003, then President George W. Bush signed into law Medicare Part D. Part D takes care of prescriptions medications. You may acquire it either as stand-alone or as part of a Medicare Advantage Plan. Part D benefits, or their actuarial equivalent, are provided by private insurance companies. Medicare pays a share of the program cost. There are 2 requirements for eligibility: 1) One is entitled to Medicare Part A and/or enrolled on Part B, and 2) lives on the planâ&#x20AC;&#x2122;s service area. In 2017, Part D will work as follows: During the Initial Coverage phase, beneficiary pays a $400 deductible out of pocket. During this phase, the plan pays 75% ($2,475) and the beneficiary 25% ($825). If total expenses reach $3,700 (plan plus beneficiaryâ&#x20AC;&#x2122;s expenses), beneficiary enters the Coverage Gap or what is commonly known as the Doughnut Hole. During this phase, the plan pays 49% of generics and 10% of branded products; drug manufacturers provide a 50% discount which is counted as beneficiaryâ&#x20AC;&#x2122;s out-of-pocket cost; and, beneficiary pays 51% of generics and 40% of undiscounted branded products. If beneficiary has spent $4,950 out-ofpocket, beneficiary enters the Catastrophic Coverage phase. During this phase, the plan pays 95% and beneficiary pays the greater of 5% or Branded -$8.25/Generics -$3.30. Alternative Part D plan benefits may differ from standard benefits under Medicare rules. In all cases, however, the value of benefits must
be the same. Some Part D plans may also include enhanced coverage for an additional monthly premium. Under the law, Part D plans are prohibited from including the following under Part D benefits: Drugs for Weight loss/gain Fertility Cosmetic Drugs Cough and Colds Vitamins Medical foods under Section 505 of Federal Food Drug and Cosmetics Act Erectile dysfunction drugs (when used for sexual dysfunction) Non Rx drugs Some off label use drugs Part B covered drugs Medicare Open Enrollment starts October 15 and ends on December 7, 2016 for an effective date of January 1, 2017. Duterte names Paynor as PHL envoy to US MANILA, Aug 30 (Mabuhay) – President Rodrigo Duterte said Monday evening that he will appoint Marciano Paynor, the Palace chief of protocol, as the Philippine
Ambassador to the United States. Paynor will replace outgoing ambassador Jose Cuisia. As chief of mission, Paynor’s appointment must be confirmed by the Commis-
sion on Appointments. Paynor, an alumnus of the Philippine Military Academy, previously served in diplomatic posts in San Francisco, Washington D.C.,

In honor of former Philippine Heritage Institute International’s (PHII) founder, Naomi Palma-Armada, the Annual Youth Congress was held last Saturday, August 27th at the Rosemead Community Center. This event is held annually to keep Naomi’s legacy and to “rekindle interest in the youth movement and its role in nation-building.” As a foundation, PHII’s mission is to: “stand for health and education as key factors for advancement. It is only when communities are healthy and knowledgeable can they fully achieve their goals.” PHII was founded in 1989, as a non-profit organization, “focused on the advancement of Filipino Americans through Youth Development Programs.” For the past 27 years, it has promoted Philippine culture and has gained progress in bridging the cultural gap for more understanding through its numerous educational and outreach programs such as: Art exhibits, cultural shows, media symposiums and various other community-related events. Speakers during the event included welcome remarks by current PHII executive Director, Dr. Anna L. Armada-Chickey and Arthur “Jojo Armada, PHII Vice-President/Trustee, followed by keynote speaker, City of Claremont Councilmember, Corey Calaycay, who
was introduced by PHII Trustee, Willy Leano. Corey Calaycay’s message to the youth attendees was for them to “first of all not to forget their Filipino heritage and to find leadership in the community, though it is important to earn their education, this will enable them to be effective individuals over time. He suggests that they should pursue their studies through Community colleges and not necessarily aim for the Ivy League. They should also find the profession that motivates them. Self-evaluation is key, to make them realize their potential. He related the story on his involvement with the government which has brought him to where he is today. You’re never too young to get involved in your community. Jed Leano, an Immigration Law Attorney in private practice, presented a very engaging and encouraging video overview on preparing for law school admission and how to pursue a legal career. This young lawyer, who’s father Willy was this author’s colleague with the then Fil-Am Bayanihan Jaycees during the mid-80’s, has not only acquired the great leadership of his Dad but has earned a name for himself as a successful Immigration Law specialist, who has “won deportation cases on behalf of numerous refugees seeking protection in their home countries, as well as defending numerous victims of religious persecution and victims of domestic violence in deportation proceedings before the United States Immigration Court.” Finally he encouraged the youth to see if they’re up to the challenge. Other significant speakers were: Freya Nishimura, Program Manager of Asian American Professional Association, who is a Certified Professional Coach. Ms. Nishimura has an extensive experience in promoting leadership, symposiums and outreach programs geared for the youth. Jose Relson Banas, Vice Principal of Rosemead High School, on the other hand, spoke about “Blending In,” and how the youth can program themselves to reach their goals in order to be successful in life. Finally, in her closing remarks, Josie Estaris De Jesus, PHII President/Trustee, encouraged all the youth attendees to not only pursue a good education but also to start getting involved in the community they live in. Thus ends this year’s PHII Youth Congress with its theme: “Blending In, Standing Out: The Filipino American Youth.”

Sunshine Dizon maintains good relationship with in-laws Sunshine Dizon has refused to let the legal battle between her and Timothy Tan affect the relationship that she and her children have with her husband’s parents. Speaking to reporters, Dizon explained the recent photo which she posted on Instagram of her and her two children with Tan’s father. “I never had a problem with the family of Tim, especially my fatherin-law. Hindi na lang napag-uusapan [’yung gulo] pero ayaw ko ring umabot sa point na maapektuhan ‘yung relasyon ko sa father-in-law ko, or ng mga anak ko sa father-in-law ko because he is a very decent and good man. He is truly like my second father,” she said. Dizon said she feels her father-inlaw’s concern when it comes to their marital woes but stressed that he actually does not meddle with it. “We just avoid talking about it. Sabi nga ng father-in-law ko, he is praying and hoping na maaayos pero hindi para diktahan niya ako kung anong dapat kong gawin because may sarili akong decision and hindi rin para mangunsinti sila dahil may maling nagawa,” she said. Nonetheless, Dizon said she understands where her father-in-law is coming from when he expressed that he is hoping she and Tan could still fix their marriage.
