Firstly, what is property development? It is the configuration or the reconfiguration of the constructed environment to meet a demand, be it a single home, multiple residential units, office building or complex, industrial or retail space.
I
n the current South African environment, it is increasingly important for investors, whether the project is a single residential unit or a large commercial, industrial or residential development, to appoint a competent manager/director (the earlier in the process the better). I have, over the years in property development, heard many investors from small to large projects say “property development is not rocket science” and attempting the process themselves. With the single homebuilder it more often than not ends in multiple disputes, excessive stress (I’ve seen many near divorces) and with larger investors it results in projects taking far longer than they should and never reaching their full potential. What is common to both is that the costs end up significantly more than the original estimate. A good development manager is like the conductor of an orchestra that needs to unify the performers, set the tempo, execute clear preparations and beats, listen critically and shape the sound of the ensemble, to control the interpretation and pacing of the music. This appointment is crucial to any successful development and it is most advisable that investors start by securing this position. A good development manager comes with years of experience, good instincts, and a successful projects

record, takes pride in their work, needs to be able to listen carefully to the investor’s brief and completely understand the desired goals. It is important that there is a good connection between the principal and the manager on a project. With experience comes the ability to help with the vision and concept, assist with the site selection and complete a due diligence for the project; be familiar with all legal requirements and zonings; be in a position to evaluate the feasibility and profitability and identify additional opportunities and catalysts. The manager should be capable of putting together the correct team of professionals for the specific development, negotiate reasonable fees, timelines and penalties and then importantly, like the conductor, bring the whole development together, set the pace, execute clear instructions and requirements to ensure that all elements are moving as required with regular reporting to the principal. If this does not happen, just like the players in an orchestra, you might have a great development and the most talented professional team, but if they are not constantly directed and supervised, all you will end up with is expensive noise.

BIRTHDAYS ARE ACHIEVEMENTS TO BE EMBRACED I love birthdays. My family has a long tradition of celebrating birthdays with great flare.

e all wake up at the crack of dawn to prepare treats for the birthday boy or girl. Gifts, candles, balloons and cakes are part of our celebrations. At 5.00 am, we all meet in the kitchen where we prepare a special tray of surprises. We then sneak down the passage, whispering and giggling in anticipation of wakening the birthday-person with song and best wishes. We all gather on the bed to participate in the opening of the gifts bestowed upon the lucky member. During this birthday ritual we talk about the blessing of having this person in our family and how this very special member enriches our family life with their uniqueness, talents and existence.

During the day the celebrations continue and the member is exempted from any household chores, which is a great gift in itself. The day I turned 50 was a day of celebration. We dressed in ocean colours and danced to the rhythm of the waves, which I so dearly love. We celebrated the hurts, the disappointments, the betrayals and the losses that shaped me into the woman I am today. We counted the blessings and gifts bestowed upon my life. We gave honour to the Source of Life, because the greatest gift to be given to any human being is the gift of life and it should be celebrated in honour of the SOURCE.

We often hear the fearful whispers of the big 40, 50, 60, 70… So I’ve been asking myself this question: Where does this fear come from? What makes so many people scared of aging? One explanation I’ve found comes from societal norms and culturally inherited limiting beliefs that influence our way of thinking and don’t serve us well. If you grow up preparing yourself for the aging process as if it will be a burden, that’s exactly how it will feel. It’s all about self-perception and the story we tell ourselves about whom we are becoming with passing time. Is the fear embedded in the perception that youth is the only thing to be celebrated and that growing older is something to be avoided for as long as possible? Maybe this fear is fuelled by the subconscious message that is portrayed in the media. Youthfulness is fresh and desirable and therefor another birthday lurking around the corner should be avoided at all cost. There is beauty in age. his statement rings true for most astute investors who know better than to panic sell in a declining market. Instead, they understand the importance of swimming upstream and seizing opportunities to buy when sentiment is low. Sadly, we often see fearful South Africans, swept up in negative rhetoric, selling their properties in a buyer’s market, instead of waiting for the tide to turn. Of course, this is exactly when the likes of Buffet would be “greedy” and start investing. A good strategy when it comes to investing in property is to aim to be a perpetual buyer and never be a seller - “our favourite holding period is forever” (Buffet). Property is a medium to long-term asset class and if you have the means to hold and weather any volatile storms that emerge along the way, you will end up with a very healthy balance sheet. According to the FNB property barometer we find ourselves in the midst of a buyer’s market: demand is weakening and supply is strengthening. House price inflation for the first quarter of 2019 is nominal at 3.8% and 91.6% of properties are selling below their asking prices. This makes it the perfect time to buy. Furthermore, the lending climate is more favourable than it has been in the past 31 months: mortgage loans have accelerated by 4.1% year on year, according to FNB. What’s interesting is that FNB also notes that the Building Confidence Index is down – having declined by 10% since 2016. People are therefore not renovating their homes or investing in upgrades due to downward pressure on disposable income. FNB states that this decline is mainly concentrated in Gauteng and the Western Cape, and contrary to this, KZN has experienced a surge in building confidence. Perhaps this is testament to the general bubble in the KZN north coast corridor, where investors are seeking to claim their piece of this exciting growth node.

In keeping with this trend of buying in the north, our Pam Golding research department highlighted some interesting buying trends generally: people appear to be investing in the north across all three major metros. Says Andrew Golding: “Johannesburg, Cape Town and Durban all have something in common. Each of these major metros has experienced burgeoning growth with the establishment of huge new nodes to the north of the cities – an interesting trend which continues to gather momentum”. Dainfern is at the heart of what is dubbed Johannesburg’s ‘New North’, a region which is seeing billions of rand being invested into new commercial and residential development. The most high profile of these is Steyn City, where developers have already spent an estimated R7 billion on infrastructure and facilities, including almost R1 billion for a major upgrade of William Nicol Drive. While Cape Town is a globally sought after destination, last year, the demand for property in the Northern Suburbs, complete with extensive infrastructure, easy access via the N1 and every conceivable amenity, has remained high; and secure estate living in everpopular suburbs such as Durbanville, is on an upward trajectory. Similarly, in KZN, the suburbs north of Durban are experiencing excellent growth: in particular, the north coast belt spanning from Durban North through to Umhlanga, Sibaya and Ballito. There is no doubt that the rapidly expanding North Coast region continues to attract local buyers as well as large numbers of upcountry home buyers and is one of the hottest property nodes in the country. Add to this trend a growing movement towards sectional title ownership rather than freehold and it would appear that now is certainly the time for investors to be buying apartments in growth nodes across the country. If we adopt Buffet’s notion that “it’s far better to buy a wonderful company at a fair price than a fair company at a wonderful price” and apply it to the residential property market, we should all be seeking to find great properties in good areas poised for growth and we should be buying now and holding forever. Indeed, in today’s buyer’s market, property investors should be getting “greedy” and snapping up sectional title investments along the coast and in other green shoot areas before the market turns. From humble beginnings to a globally recognised South African brand, Carrol Boyes has been making her mark on the design world for 30 years!
In 1989, then in her thirties and working as an English teacher, she decided it was now or never to do what she loved. She quit her job and began to apply her sculpting skills and fascination with the human form to unusual pewter-handled cutlery and other items, which she sold on Cape Town Greenmarket Square. With no experience other than her art training, Carrol admits that she didn’t have a business plan when she started. She had to overcome many challenges, including her lack of confidence. But she persevered and South Africans quickly fell in love with her quirky and functional products. Within 3 years Carrol was making and selling around 70 000 items a year. She had outgrown her home workshop and decided to build a factory on her father’s farm in Limpopo Province. Here, with the help of her brother Charles Boyes, a farmer and entrepreneur, she trained a local workforce, becoming at the time one of the largest employers in the area. An aluminium foundry enabled her to create much larger sculptures and in 2000 a stainless steel division introduced dishwasher-safe cutlery to the range. In time, Carrol began to work with other specialist manufacturers, and many other new materials were introduced, including wood, leather, glass, ceramics and textiles. 2003 saw Carrol opening the Carrol Boyes store in the V & A Waterfront in Cape Town, giving her the opportunity to present her products as a fully-fledged brand. In 2012 Carrol partnered with her brother John Boyes of Barnardt Boyes Wines to launch the Carrol Boyes Wine collection, which today even features Champagne. 2018 was a bumper year, seeing the construction of an entire confectionary factory within the company’s head office in Cape Town, headed by chocolatier Gary Welgemoed, and the launch of Carrol Boyes Chocolates with their uniquely sculpted shapes. Also in 2018 a much-expanded bath and body range was launched, as well as a new kitchen textiles range. In 2019 the company has over 1000 products in the range, including glassware, crockery, stationery, accessories, and soft furnishings. Carrol has applied her unique style to thousands of different items over the years, from tape measures to a tea trolley, as well as every conceivable form of cutlery. As 2019 races along there is a lot of talk nationally about a current downturn in the residential market and the question will always be about how much of this talk is fact as opposed to sentiment.

here is no doubt that 2018 was a challenging year for the residential sector with sales volumes being down from 2017; in some areas by as much as 20 - 30%. The question that many have is how the market will perform for the rest of 2019.
In light of LUXE expanding nationally we have looked at specific areas within Gauteng and KwaZulu-Natal to establish how the residential market within estates, has performed in the first quarter of 2019 versus the first quarter of 2018. The objective was to gain some insight into how 2019 is performing thus far and to predict what kind of performance can be expected within gated residential estates, for the rest of the year. In assessing 2019 to date, versus the same period in 2018, we looked at Ballito, Umhlanga, Sandton and Midrand.
Midrand is an example where freehold transfer volumes within estates, only increased by 4% - from the same period in 2018 - but the average sales values increased by an encouraging 8,6%. For Umhlanga the volume of sectional title transfers, from the same period in 2018, decreased by 36% however the growth in sectional title prices continues to grow year-on-year with the average sectional title price increasing by 4,4% from the same period in 2018. What all buyers want to see is capital appreciation. This is always going to occur within sought-after areas, and the key is not to confuse a decrease in sales volume within an area, with a decrease in value. In high demand areas prices will continue to appreciate even in periods where sales volumes don’t.
Ballito is a good starting point as it’s consistently one of the best performing areas in the country based on the growth of the area, great amenities and an abundance of top estates. For the first quarter of 2019 the average price of freehold properties, within gated estates, has increased by 18% from the same period in 2018 whilst the sectional title prices have increased by 3,9%. What is also significant is that 77% more freehold properties, within estates, transferred within the first quarter of 2019 whilst sectional title transfers were up by a massive 148%.
It’s a known fact that over the last 10-years over 3,000 high-net-worth South Africans have moved abroad. The biggest beneficiaries have been the UK, Australia, USA, Mauritius and Portugal. The reality is that this is only a small fraction of the residential market in the country, and that the number of highnet-worth individuals moving abroad has a negligible impact on the residential market. The reality is that most of us will not relocate abroad. Either we cannot afford to, do not want to leave existing jobs or families, don’t have the right qualifications or largely just don’t want to because we love the SA lifestyle way too much!
The insight from the Ballito stats is that the highly sought-after areas continually provide good appreciation for investors and that these areas will continue to perform. In a stat that was recently released, the population on the eastern side of the N2 – between Ballito and Palm Lakes – has grown from 17,000 in 2011 to 32,000 in 2018 which is an 83% increase in 7 years. This is a key factor that underpins why Ballito is arguably the best performing residential area in the country.
We predict that the number of those investing overseas, in order to diversify their portfolios, will continue to grow. We see that the big destinations for this will be Mauritius and Australia. Mauritius for its tax benefits, and ease of business, and Australia for the excellent rental yield, high rental demand locally and the ability to hedge against the Australian Dollar. These are mostly people who will continue to live and work in South Africa.
One isolated example is Elaleni Coastal Forest Estate where the average value of land has appreciated in excess of 40% since its release in 2016. Sandton in comparison did 77% more sectional title transfers than Ballito in the same period but saw a 43% decrease in it’s sectional title transfers from the same period in 2018. This could be as a result of an over-supply in new sectional title opportunities in the area. More significantly, the average price of sectional title properties within the area has increased by a very healthy 22% from the first quarter of 2018, whilst the average price of freehold homes has increased by 8% from the same period last year. The volume of freehold transfers has also increased by 4,7%.
There are enough positives in the market already this year to suggest that the second half of 2019 will be a very good one within key areas (For KZN this would be Umhlanga, Sibaya or greater Ballito). There is no doubt that the recent elections are having an impact on the residential market in the sense that many have waited to assess the outcome before deciding where and when they invest in residential property. The key is not to wait too long, as the residential market will continue to be underpinned by people who want secure, gated addresses within key areas of SA. Although these opportunities will continue to appreciate, they don’t come around all the time and if you wait too long, you’ll run the risk of missing out.

he Elaleni entrance represents a fresh look into gate house design and arrival experiences. To achieve an emotional arrival, vehicles are directed over a contemporary look of old time course way with water on both sides and connecting strips of water in-between. To reduce the vehicular speed, islands of palm clusters divide the road into visual spaces. Once you reduce your speed you experience a gallery of 2m tall Bonsai trees exhibited on podiums in reflective water. Planters on the building’s first level are planted with waving grasses and beach creepers trailing down to create a curtain of ‘green’ for office privacy and sun protection. The structural element of the circle is inspired by the succession of the different tree species in one of
In nature, in a new forest, trees in succession from pioneer trees to climax trees take more than 70 years. Therefore the structure has 3 rings interacting differently from horizontal to angled supporting the delicate balance we find in nature. The trees in the forest are like living generators, exchanging carbon to oxygen, the most important element for all living creatures. To promote succession we have made provision to house a series of solar PV panels to generate the power for the landscape lighting in the area. The rings are made from Aluminium Magnesium Alloy. The external diameter is 12m - and the internal ring at 10m diameter. These rings are at 15 and 40 degree angle respectively, with the inner circle facing north to achieve maximum solar exposure to the internal PV panels. The rings will be planted with trailing species, a combination of pioneer and climax creepers witch will green the circles and celebrate the forest. The bottom hedge will be covered in mostly

This plant species is significant as it delivers per volume the highest carbon oxygen exchange in nature. Spekboom (aka Portulacaria afra) is a succulent that helps fight air pollution. It has the ability to ‘sequestrate’ or capture four to ten tons of carbon per hectare! Essentially, it acts as a carbon sponge, absorbing carbon from the atmosphere and turning it into plant matter. Excess carbon in the atmosphere is responsible for global warming, so the more carbon we can remove from the air and return to the ground, the better.

An issue of Focal Point and not Afterthought
Isabel Roos, owner of Imbizo Gallery talks to Edmund Franklin Markham, art lover, owner and CEO of Cumulus Design & Decor based in Morningside, Durban.
Where did you start with your career in Interior Decorating? It has been a long journey to get to this point. I have lived and studied around the world in the museums and galleries of Europe and the USA. A passion for travelling and love of art became one when I landed a position to work for a large corporation as an auctioneer after living and working in Los Angeles. Through my work I travelled to 99 countries, sold art and loved every moment. It was educational in dealing with art, artists and art lovers from all walks of life and it was here that I learned how to tap into the psychology of collecting art for a large art buying collective. I was fortunate to live and work in Florida where I created a position as a coordinator of Fine Art collecting events aboard cruise ships. I marketed these events to a client base that I built up during my years as an auctioneer. We sailed around the world to exotic destinations with artists and sold art! It was amazing! So I had to find artworks that appealed to collectors for homes that I had never seen or been to. I have delivered artwork to homes in New-Zealand, Australia, China, Saudi-Arabia, Europe and Russia during my days as an International art dealer. Where do you focus your work? I focus on apartment living in and around the new developments being built in Mhlanga and the North-Coast of KZN. My clients are predominantly here to create a space to escape the hustle and bustle of their busy corporate lives from Johannesburg and as far away as San Francisco. 29
What is your design process? We are so close to the Indian Ocean and that is always reflected in my design solutions. With the beauty of the ocean visible from almost every space that my team and I work in, we create a habitat that reveals the mindset of the owner when they will be inside the property. The ocean creates a stunning backdrop and this is nurtured in the interior design elements that I select. I channel the surrounding typography when designing and selecting these items. Selecting artwork for the spaces that you work in is… The start of something inspiring! I walk past Imbizo Art Gallery almost every day while I am working. I really enjoy incorporating the works of Nicolaas Roos in my projects for their beautiful tranquility and the fact that the colours are calm, the composition is open and the emotions are truly what we go through on a daily basis. Light and lighting plays a very important part of how we feel and his work plays well with our emotions. How do you select the art for a room? As a designer of a habitat for a client, we have to step into the shoes of our client. I get to know the inhabitants. I ask a lot of questions and then listen. It’s the process of listening and feeling what senses you activate with the placement of an item that it will create. Some of my clients just want calmness. They lead very busy corporate lives and want to come home to relaxing colours, shapes and textures where they can enjoy the fruits of their labour and spend time with their families. Others want to be challenged, to be motivated. Most of my clients want their line of sight to be relaxing, evolving with their mood to remain uplifting and accomplished for their successes. Art is perceived as an expensive item. How do you overcome this objection?
What rules do you go by when creating spaces?
Original art has been used in homes and public spaces for as long as we have been able to interpret our imaginations to visual renderings. As humans, we decorate, we create visible emotions for others to see and appreciate and then put them on display, not just always for others to see, but for the owner to appreciate. They create a snapshot of where you were in life when you bought it and made it part of your life. Once you tap into that, these objections find other areas to attach themselves to. I love history and the evolution of what we do with our homes as a place to come home to and live in.
I like to mix functionality with form. It has to be comfortable to live in. When space is at a premium, each addition to the design solution has to stand its own ground when inserted. So that’s when we mix colour and texture with fabrics to complement the ultimate product.
I approach artwork as the jewellery of your home. You don’t have to overdo it. Less is more and finding one work of art is often far more impactful than a wall laden with frames and images… same as jewellery.
Fabrics nowadays are so vast that my number one rule is to not rush the design process. The design process is very organic. When you change one element here, that can affect something across the board. So, there is a lot that goes into creating harmony with texture, colours, shapes and size. There are certain rules that apply, but they don’t always reveal themselves from the start. You have to, as a decorator, understand the architecture of a room to make a design comfortable. Harmony is the key. We want to come home to a harmonious environment after a busy day. I really enjoy working with the exciting wallpapers that we have access to. In the instance where I cannot find wallpaper that my team and I feel that will work, then we design our own. What do you recommend to your clients wanting to start an art collection? Buy what you like. If you are working with a decorator, they have ideas of what will look good with your ultimate design, but stay true to yourself; us as decorators can adapt. Spend time with your loved ones over weekends and tour galleries. It is very inspiring to see ideas and thoughts and memories being made into visual realism. Have a budget in place for your artworks. Original art becomes part of your assets. Keep that in mind as you tour these representations of what and where the human psychology is today and how they will lead you to make them part of your life. Work Done: My main focus at this stage is the beautiful Pearls of Mhlanga Luxury Apartments. The Pearls complex have been around for a good 10 years recently some of the units have come back into the market for some upgrades and renovations and this is extremely exciting as I take the designs and decor that was relevant a decade ago and bring it into the new and upgraded truly ocean-front styling that my clients are looking for.
The unique architecture and floor pans of these units make is interesting in that it calls for truly bespoke designs and manufacturing. I use predominantly local manufacturers for furniture installations as I like to give back to the community in KZN as this is such an addition to the local economy. I work with local bed manufacturers to give my clients a very good rest down to creating designs in their rugs and off course commissioned artworks to really complement the choices of fabrics. The new Pearls Sky towers high above the coastline of Mhlanga and it is a pleasure to work in this incredible development with sweeping views reaching North and South. It is with this in mind that I create habitats that are relaxing, comforting and uncomplicated for my clients who want to enjoy the calm that this location affords them. There is also the stunning North-Coast developments’ being tapped into where Coastal forest architecture presents the structure for oversized living spaces. The open outdoor-to-indoor builds deliver opportunities to work with nature as your backdrop.
What’s new for you in 2019 and beyond? I am branching out into challenging renovations of existing living spaces where we do complete re-designation of furniture placement and layout of spaces. Kitchens are as we know the heart of a home and the bathrooms are a strong focus in these projects. So I work with a group of artisans to make sure ease of use and a feeling of homeliness is present always. We are also turning towards yacht decor and design. This is a whole different aspect of designing and decorating as once again, space is at a premium and that is what I really enjoy being challenged in‌ to make use of every inch of space available to the inhabitant. ABSOLUTE INDULGENCE Years ago, I wanted to go to a spa when I was new to KZN and a friend of mine immediately said “Indigo Fields, it is like heaven!!! It is the best place in the world.”
I
only got to go to Indigo Fields in March this year and oh my word! Heaven it is… and this is obviously their standard, as this was 8 years after my initial conversation about Indigo Fields.
My 18 year old son and I were booked for an overnight breakaway, lunch, dinner and breakfast included. I thought this might be a good introduction to a spa experience for him. Read to the end to see his response… So imagine this, on arrival at Indigo Fields (a 90 minute drive from Durban along the N3), we were welcomed, while signing in, with ice cold champagne. Then we were shown to our amazing double storey “piece of heaven” where we were greeted by the sound of falling water (my most favourite relaxing sound in the world). Upon inspection it was a fountain overlooking the dining area (where supper was later served). There were also 2 en-suite bedrooms (one upstairs and one downstairs) from where we could look out over the amazing fields of lavender. And then last, but not least, a lounge area with huge glass doors leading to another private seating area outside. After getting dressed in our robes, we went to the main area where we had lunch in our own private dining room. Lunch consisted of wraps and chicken kebabs (the most tender chicken you have ever tasted) and we were offered some more champagne! After our delicious lunch we were taken to a secluded area (walking into the bush) where the next “angels in waiting” welcomed us. My son opted for a full body massage and I chose the hot stone massage to sooth my tight sore muscles. This tented area was warmed by a fireplace and fully protected from the wind. My son was snoring halfway into the massage (the biggest compliment to any massage therapist).
Trying to keep our eyes open after the massage, we were first given the opportunity to wait on a patio overlooking the beautiful countryside, just taking in nature, before being taken back to the main house. On arrival there, yes you guessed it! We were welcomed with truffles and Amarula. Absolute and total indulgence….. We then had the option to enjoy the Jacuzzi, but rather opted to take some serious nap time before supper. Our 3-course supper served was a choice of carpaccio, chicken, steak and pork belly, finishing off with chocolate desserts. We enjoyed this in our own private nook and totally relaxed, we could chat, have lots of laughs, bringing us to the perfect ending of an absolutely amazing day. With refreshments, even sherry in our cottage, we did not want for anything. And, of course, we had to sleep after all of that. The next morning we woke up to complete peace and quiet. Breakfast was served in the communal area and we opted for Salmon and Egg. So yes, we did gain at least 2 kg each, but left relaxed, loved, cared for and in absolute bliss….. My son’s words on the way home summarised this whole experience….
Remember we wanted to visit Table Mountain and Kruger National Park when my brother comes to visit later this year! Let’s forget all that and just book in at Indigo Fields again, but like a week this time..” Zander van der Merwe 41

hankfully, your skin can be very forgiving and is perfectly equipped to care for itself…So why all the focus on cleansers, serums and creams? Well mostly because using skincare helps us to protect and minimise the effects of extrinsic and intrinsic factors. So let’s take a look at the most common issues you may be experiencing with your skin, and how you can get back to fabulous flawlessness. #1 Waking up with areas that pull tight that may be flaky. If you are experiencing this, especially evident in the morning, after you have cleaned your skin or after a day in extreme weather then you may have dehydrated skin. Yes, skin that lacks surface water moisture. These skins respond well to Milk Cleansers or even Cream Cleansers. Here’s why! Cleansers are widely recommended by beauty therapist and dermatologists alike. Unlike soap, cream & milk cleansers can effectively wash off makeup & daily pollution, while protecting the delicate oil to water balance. Be mindful of using foaming cleansers if you do not have skin that is oily by the end of the day. These can contribute to dehydrating you skin, leading to flaky, red and irritated patches. #2 Another common complaint my clients bring to me are those little red ‘gems’ that glisten under the skin. These are pimples that lie under the skins surface. The main factors contributing to this are stress and hormonal imbalances, both intrinsic factors, meaning coming from within. Managing your stress with exercise, to boost your happy hormone endorphin for the day, can help. Using breath through-out the day can also help to centre you, while reducing adrenal hormonal spikes. …elevation of these stress hormones cause inflammation throughout your body, including your skin. #3 Your skin is suddenly looking and behaving differently? Look closely at your products that you apply to your skin. Especially be very critical of your foundation, any new products you may have recently added to your routine and be wary of products that contain petroleum based ingredients/heavily fragranced/too many preservatives. To eliminate if it is indeed your products, and then further which products may be the causing a reaction test a little on the inside of your arm, and then wait and watch. Petroleum based ingredients tend to cause blockages, that a very resistant to daily cleansing. A good, A.H.A based facial will safely and gently lift the first layer of your epidermal skin, exposing the offending blockage so that it can be removed safely by your skincare specialist. It may be that your foundation is expired and simply needs replacing. Any time you are going to use something new, seek the advice of a beauty therapist, skincare therapist or dermatologist. These are trained professionals that deal with skins daily and can call on their wealth of knowledge and experience. #4 Exercise! Ah what, exercise should be good for me? While exercise is good for your overall health, including your skin as it increases circulation; little bad habits may have to be looked at by your critical eye. Anytime you exercise it produces sweat. This mixed with makeup or heavy moisturiser is a skin disaster. Always make sure you have no make up on while exercising, and only use light moisturiser with a layer of sunblock, to avoid rashes and breakouts. #5 How do you dry your skin? Is there even a wrong way? Well, no, but if you have an infected acne prone skin or just regular pimple breakouts then consider swopping out your hand towel for disposable tissue that you can throw away after each use. This way you cannot cross infect your skin from other members of the family, and furthermore the tissue is guaranteed to be germ free.

Are the Road Rules within Estates legitimate/enforceable?
T
he question whether a residential estate’s roads may or may not be controlled by it’s governing homeowners association has finally been answered. On 28 March 2019, the Supreme Court of Appeal handed down judgement on the appeal in the matter of the Mount Edgecombe Country Club Estate Management Association II (RF) NPC v Singh & Others (323/2018) [2019} ZASCA 30 (28 March 2019). The matter concerned the lawfulness of certain of the “road rules” of the homeowners association which empower it to police the road network within the residential estate, including the issuing of penalties for speeding.
The relevant “road rules” which two aggrieved residents/members had sought to have declared unlawful were the following: “7.1.2 The speed limit throughout the Estate is 40 km/h. Any person found driving in excess of 40 km/h, will be subject to a penalty. The presence of children and pedestrians as well as many undomesticated animals such as buck, monkeys, mongoose, leguans and wild birds means that drivers need to exercise additional caution when using the roads.” and “7.3.2 Operating any vehicle in contravention of the National Road Traffic Act within Estate 2 is prohibited.” When the matter had first come before the Kwazulu-Natal High Court, Topping AJ, dismissed the application to set aside the rules however on appeal to a Full Bench of the Kwazulu-Natal High Court the judgement of Topping AJ was set aside and the aforementioned rules of the homeowners association, were declared invalid. The declaration of invalidity of the road rules was however suspended for a period of twelve months to afford the homeowners association an opportunity to obtain the necessary authorisations and/or consents under the National Road Traffic Act, 93 of 1998. The homeowners association was granted leave to appeal the matter to the Supreme Court of Appeal. In what is regarded as a landmark ruling the Supreme Court of Appeal decided that on the evidence presented to it that the estate’s internal roads are not public roads. The Court also went on to hold that the approach of the Full Bench could not be supported even on the assumption that the roads within the estate were regarded as public roads’. Supreme Court of Appeal Judge Visvanathan Ponnan in his judgement held that: “It cannot be said that ordaining a lower speed limit within the estate than that prescribed by national legislation goes beyond promoting, advancing and protecting the interests of the…members or is unreasonable. This is especially so given the presence of children, pedestrians and animals (both 46
domesticated and undomesticated) upon or in the immediate vicinity of the roads themselves. Rule 7.3.2 goes no further than to record that the operating of vehicles in contravention of the Act within the estate is prohibited. I fail to see why that is prohibited.” In summary, the Supreme Court of Appeal found that: in regulating the roads the homeowners association was not usurping the functions reserved to the authorities under the National Road Traffic Act nor contravening the provisions of that Act; • there is no conflict between the rules and the National Road Traffic Act; • the rules are contractually binding on members and are enforceable against them; • the fact that the rules provide additional contractual requirements for the operation of vehicles on the roads in the estate does not mean that the rules have a public law content; and • there is no need for the homeowners association to seek authority from the MEC or the local municipality to regulate the conduct on the estate’s road network. The appeal succeeded and the Supreme Court of Appeal set aside the order of the Full Bench and substituted it with an order dismissing the appeal to the Full Bench save for the declaration of invalidity of certain domestic worker rules which was not appealed and which still stands. The judgement confirms the right of homeowners associations’ to regulate the conduct of members through a system of rules and reaffirms that the relationship between a homeowners association and it’s members is founded in contract. That having been said homeowners associations must still ensure that their particular rules are lawful and that they satisfactorily regulate conduct including, but not limited to, conduct on their internal road networks. At the time of writing it still remains to be seen whether the decision will be taken on appeal to the Constitutional Court.

Now is NOT the time to avoid investing! South Africa had its fair share of turbulence in 2018 – from higher deficits and worsening unemployment rates to challenges around land reform and a technical recession in quarter two.

hese challenges have resulted in investors opting to shy away from domestic markets, seeking investment opportunities outside the country.
“While SA’s economic growth still faces some headwinds, we believe investors should be optimistic about domestic opportunities,” says Adriaan Pask, CIO at PSG Wealth. “Despite lacklustre growth and high unemployment data, the leading business cycle indicators from the South African Reserve Bank (SARB) have been on an upward trajectory for some time. Greater certainty on a few key issues such as land reform, and decisive action being taken to stamp out corruption should go a long way towards reversing some of the negative sentiment that currently surrounds the economy,” says Pask. Lower interest rates and stable inflation PSG data shows that interest rates could remain reasonably low while inflation could also continue to be relatively stable. “Although rate cuts are always the ideal outcome, at least over the short term, we don’t think a

rate cut is likely. On the flip side, we also think extreme hikes are unlikely,” says Pask.

The hurdle for generating inflation-beating returns is also relatively low. “When inflation was running at double-digit numbers during the 90s, investors had to generate high double-digit returns to grow the real value of their capital. In short, the opportunities locally are more attractive than the majority of offshore counters.”
