Australia Day 2022 - Maleny It is a day we celebrate our nation, its achievements and most of all, its people. Australia Day is one of those days that the celebrations do not please everyone. The marking of the 26th January is an important date in Australia's history. It was on the 26 January 1788 that the First Fleet landed in Sydney Cove to set up a penal colony for English prisoners. Irrespective of your thoughts. Australia Day is about acknowledging and celebrating the contribution that every Australian person makes to our contemporary and dynamic nation. It is to many a day to celebrate the freedom we have by living in Australia. It is also one day when we as Australians believe that the day should be a time to recognise and celebrate the country's cultural diversity and to acknowledge what we love about being Australian January 26th also marks a day where some Aboriginal peoples and Torres Strait Islander peoples have mixed feelings about celebrating this day—some consider it a day of mourning, and others use the day to mark the survival of their ongoing traditions and cultures. Irrespective of your thoughts, Australia Day should be a day where we all foster constructive, respectful discussion about the contributions of all Australians past, present and future as well as where we want the

Australian community to be for the next generation. By only remembering the past will not lead to a better future for all. On January 26th right cross Australia, thousands of people who hav immigrated to Australia from other countries become Australian citizens each year at special Australian Citizenship Day ceremonies. In Maleny the Sunshine Coast Council will facilitate a ag raising and a Citizenship Ceremony followed by a celebration that takes on an even more special meaning for those new Australian citizens who, hopefully, will appreciate the privilege of becoming Australian on this day of great national pride. Normally, there is an Australia Day Expo at the Maleny Show-grounds, hosted by the Maleny District Sport & Recreation Club where a wide range of community groups invite you, not only to come out to play with your family, but learn about the community organisations that provide services and support to our community. Unfortunately, this year the Expo has been cancelled because of the threat from the growing number of people with COVID related illnesses.

Mr. Andrew Wallace Federal MP for Fisher “New Speaker of House of Representatives” National plan to end violence against women + Children

Heavy Rail from Beerwah to Maroochydore On the 14th and 15th January, 2022 Mr Ted O'Brien MP - Federal Member for Fairfax and I were joined by the Infrastructure and Cities Minister, Paul Fletcher to demonstrate rsthand the importance of HeavyRail from Beerwah to Maroochydore via Caloundra, and Kawana.

Family, domestic and sexual violence can be dif cult topics to discuss and your safety and wellbeing is important. The Australian Government is developing the National Plan to End Violence against Women and Children 2022-2032 (National Plan) to replace the existing National Plan to Reduce Violence against Women and their Children 2010–2022 when it ends in mid-2022.

Now we have secured the Brisbane Olympics 2032 and Paralympic Games, this is our best shot to get this vital infrastructure into the Coast.

The draft National Plan has been developed through consultation with victim-survivors, specialist services, representatives from the health, law and justice sectors, business, and community groups, all levels of government and other experts.

If you agree, please help me to help you secure funding for this project. It won’t just happen of it’s own accord. As a community we need to pull together to demonstrate that this is what we need and we have to shout it from the rooftops.

“Painting over smoke damaged areas” Whether from

re damage or simply from constant cigarette smoke;

painting over smoke damaged areas is dif cult to get right! The composition of smoke stains is dependent on the composition of the material that has been burnt to produce the smoke. Some smoke stains may contain high proportions of carbon particles but others can contain a wide variety of both solvent and water soluble substances. Wood and paper fires produce large amounts of carbon but plastic can produce many types of contamination.

The initial treatment of all smoke related stains must involve the washing of the surface using a Heavy Duty Sugar Soap and a sponge or soft cloth, working up from the bottom of the wall to avoid running of the stain over other work. Allow a few minutes for the Sugar Soap to penetrate the stain and then thoroughly rinse off with clean water.

Smoke from cigarettes produces nicotine deposits that will produce stains through the applied paint coatings. It must be assumed that on any smoke damaged surface, both water and solvent soluble substances will be present.

process. Use sparingly on contact surfaces. Australis Stain Block comes with a 12 year guarantee not to crack peel or blister. It is quick drying oil based primer sealer that is suitable for both interior and exterior use. No sanding would be required between those coats. It is touch dry in about 30 minutes and re-coating could be completed after 1 hour. It can even be used on ceramic tiles, laminates and gloss enamel surfaces as a bonding coat. It is ideal for blocking stains including; water, nicotine, ink, graf ti, crayon markers and smoke stains.

On severely a ected areas, the washing and rinsing process may have to be repeated to effectively remove the surface contamination. The surfaces must be allowed to thoroughly dry prior to an application of Australis Stain Block multi purpose quick dry oil based primer sealer.

If you have leaking pipes or roof, you'll know what a waterstain looks like. When your walls get wet, it can create a brownish-yellow discoloration called a water-stain then this product is also good for them..

Coverage of this product is up to 10 square metres per litre, depending on the porosity of the surface being coated.

Two coats of Stain Block Sealer may be required depending on the severity of the stain and the effectiveness of the pre-cleansing

Whilst mostly it is expected that ooding will occur between December and the following April each year on the Sunshine Coast, ooding can in fact be at any time of the year.

Who knows this might be awaiting you under the oodwater!!!!

there are many decision-making factors that can overwhelm drivers into making the wrong choice under pressure, but you cannot go back if a wrong decision is made and a life is lost. It’s unsafe and inaccurate to test waters by foot. Conditions can change by the time you’re back at your car. But the decision to “Back It Up” is the bravest and smartest thing you can do.

Truthful Jones says

An Old Codger’s Thoughts & Opinions What is it with the media that they are always prepared to create some sensationalism and appropriate blame about decisions that are made by governments when there is nothing there of real substance. Wouldn’t it be better if they really concentrated on the real facts of the matter rather than the emotional or sensational side. The recent incident involving tennis world number one Novak Djokovic and his recent deportation from Australia because of irregularities with his ling of his application to enter Australia. This matter received “over the top” media coverage in the mainstream media. The matter was one of confusion because of the differing versions of all the parties involved. Why then does the media have to sensationalise each and every single detail from both parties. There is no doubt that Novak Djokovic is one of the greatest tennis players in the world, but he too has to go through the of cial procedures just as any other Australian or immigrant.. Incorrectly lling out of cial forms to mislead then blame somebody else does not apply. This matter should have followed procedures as anyone else, but the media has to sensationalise every detail and eventually the real facts become blurred and the real facts are lost in the telling of the story. It appears that the media and subsequently everyone else is judging the comments without nding out the real facts of the matter. Generally, this is done in an effort to raise ratings of sell newspapers. Would it not have been better to concentrate on the actual situation and report on the facts rather than the sideshow surrounding the facts. No wonder there is so many misconceptions about world incidents of real importance. One of the main problems is that too much of the media ownership is held in just a couple of hands. This has been done because the rich have bought out opposition news media and closed them down to the detriment of a proper balanced news.

And he swears that it 100% true. - No Bulls##t” The Three Kick Rule

A big city lawyer went duck hunting in Conondale. He shot and dropped a bird, but it fell into a farmer's eld on the other side of a fence on Ahern’s Road. As the lawyer climbed over the fence, an elderly farmer drove up on his Massey Ferguson tractor and asked him what he was doing. The solicitor responded, "I shot a duck and it fell in this eld, and now I'm going to retrieve it." The old farmer replied, "This is my property, and you are not coming over here." The indignant solicitor said, “ I am one of the best trial attorneys in Queensland and, if you don't let me get that duck, I'll sue you and take everything you own." The old farmer smiled and said, "Apparently, you don't know how we settle disputes in Conondale. We settle small disagreements like this with the 'Three Kick Rule.'" The lawyer asked, "What is the 'Three Kick Rule'?" The farmer replied, "Well, because the dispute occurs on my land, I get to go rst. I kick you three times and then you kick me three times and so on back and forth until someone gives up.” The attorney quickly thought about the proposed contest and decided that he could easily take the old codger. He agreed to abide by the local custom. The old farmer slowly climbed down from the tractor and walked up to the solicitor. His rst kick planted the toe of his heavy steel toed work boot into the solicitors groin and dropped him to his knees! His second kick to the midriff sent the solicitors last meal gushing from his mouth. The solicitor was on all fours when the farmer's third kick to his rear end, sent him face- rst into a fresh cow pie. The solicitor summoned every bit of his will and remaining strength and very slowly managed to get to his feet. Wiping his face with the arm of his jacket, he said, "Okay, you old fart. Now it's my turn." The old farmer smiled and said, "Nah, I give up. You can have the duck." Shop Locally & Shop with a Friend 10

Maleny has a. wet. introduction to 2022

“Remember the 1974 Brisbane Floods?” The Brisbane 1974 oods - Could it happen again?

Brisbane is the only capital city in Australia built on a oodplain, and the only large metropolitan area to experience major ooding. In January 1974 a ood occurred in Brisbane, Queensland, after three weeks of continual rain. The Brisbane River broke its banks and ooded the surrounding areas. The cyclone that produced the ood also ooded surrounding cities: Ipswich, Beenleigh, and the Gold Coast. In total, there were 16 fatalities, 300 people injured, 8000 homes destroyed and an estimated A$980 million in damages. Spring of 1973 had been exceptionally wet, and by the end of October most of southern Queensland's river systems were nearing capacity. Torrential rains were caused by Wanda, a relatively weak tropical cyclone which did not even rate as a category 1 cyclone.

Continual, heavy rain began falling on January 3rd and continued for three weeks, leading up to the ood, which occurred on Sunday, 27th January 1974. This was the 1974 Australia Day weekend. On January 26th 314 mm of rain gave Brisbane its wettest day

since 1887. This led to the biggest ever emergency evacuation in Brisbane. Police, civil defence authorities, the army and air force combined to rescue more than 500 ood-bound residents from a variety of areas.

Areas close to the Brisbane River in the Yeronga area that were not expected to ood because they had high ground between them and the Brisbane River did in fact food. The water coming from the Brisbane River back up the storm water drains and lling the lower ground behind the higher ground

between them and the Brisbane River.

Just after daylight on January 27th - the tanker Robert Miller, which had just been completed at the Kangaroo Point Shipyard broke from the “ t out mooring”. It blocked the Brisbane River and acted as a dam causing more ooding. It was not until late the same afternoon that the ship was secured, but by then considerable damage had been done. The Robert Miller was not only the last ship to be built at the Evans Deakin Kangaroo Point Shipyards, but also the biggest at 67320 tonnes. The oods peaked at 6.6 metres according to the Port Of ce gauge at high tide at 2:15 am on the 29th January 1974. At the same time the city rain gauge was approximately 5.5 metres.

Maleny has a wet introduction to 2022

“Remember the 1974 Brisbane Floods? Could it happen again?” Continued from Previous Page No sooner than one highly dangerous situation was brought under control that another one appeared when a gravel barge smashed against the Centenary Highway bridge at Jindalee, damaging pylons and raising fears the bridge would be carried away.

The most ood affected suburb of Brisbane was Rocklea By January 28th much of the Brisbane Central Business area was under water. Elizabeth, Creek, Charlotte and Albert streets were metre-deep channels of fast- owing brown water thus bringing Brisbane Central to a standstill.

The Brisbane River had not reached this height since February 1893 and the rain just kept falling. The Nerang River ooded causing about 2000 people to be evacuated from their homes along the river and the canals; most of these homes suffered ood damage. The Wivenhoe Dam was built approximately 80 km upstream from Brisbane and downstream from the Somerset Dam after the 1974 oods. The dedicated use of this dam was changed in the 1980’s and it now provides a safe water supply for Brisbane and surrounding areas. In 2011 the dam level reached 175% capacity, undoubtedly reducing ood damage to some parts of Brisbane.

Montigue Road, SthBne Then & Now

Fifty years on have we learnt a lessor or will it happen again? This renewed awareness of the ood hazard in this rapidly growing region should have caused the State Government to signi cantly re-think not only ood management and mitigation practices, but where some developments may be unwise. There. are many areas around the Sunshine Coast that have already been built on ood plains and on low level land near to watercourses - think west of Caloundra and the corridor along the Bruce Highway between Caloundra Turnoff + Maroochy Motorway, or even the newer parts of Pelican Waters, just to name a few.

Photo right: At least some got their priorities right and made sure of their supplies!!!

What have we learnt other than “greed is good for some, but a heartache for others.

Changes for Landlords & Sellers in respect to their property With Trove Easton of Easton Lawyers, Male The times they are a changing…

the deposit is paid by an electronic transaction the buyer will be deemed to have paid the deposit on the day the buyer instructs their nancial institution to pay the funds from their account.

In response to numerous issues, from 20 January 2022 new Real Estate Institute of Queensland (REIQ) standard contracts used almost exclusively in residential conveyancing across Queensland will come into use.

In the case of a shared pool on the common property for a CTS in which the lot is located, there is no contractual obligation for the seller to provide a copy of the pool compliance certi cate for the shared pool in exchange for the price. However, the disclosure obligations imposed on the seller under the Building Act 1975 and Building Regulation 2021 in relation to shared pools continue to apply.

If this day is on or before the due date for the deposit, then the buyer will be deemed to have paid on time, provided the buyer meets all other conditions of this clause of the contract.

Why does anyone care? Because these contracts result in signi cant changes to conveyancing practice. Let’s look at some examples…

Extending the date for settlement

If the deposit has not been received in the account of the deposit holder by the due date, the payment may be late, and the seller may take action.

Fire alarms Dwellings or residential units for sale must have smoke alarms installed in accordance with the Fire and Emergency Services Act 1990 and Building Fire Safety Regulation 2008. If not, the buyer is entitled to claim an adjustment of 0.15% of the purchase price prior to settlement.

Either party may give a notice extending the date for settlement up to 5 business days after the Scheduled Settlement Date.

Pools

The Queensland Law Society (QLS) and REIQ have updated these provisions relating to time of the essence, to alleviate the dif culties and potentially unfair

A seller is required to provide a Pool Compliance Certi cate for a non-shared pool on the Land at settlement, or give a Notice of No pool Safety Certi cate to the buyer prior to contract.

However, this is conditional on conducting a smoke alarm search and there is no right to terminate or claim damages for breach of contract.

For a Community Titles Scheme (CTS) a seller will be required to provide a certi cate for a nonshared pool on the lot, as for the seller of land or a lot with a nonshared pool under the Building Act 1975 and Building Regulation 2021.

Electronic payment of deposit (deeming provision) Due to potential delays in electronic banking transactions if

System (BMS) or statutory authority.

result for a buyer who is unable to settle on the settlement day as a result of delays by nanciers.

contracts now coming into force Queensland wide. While these may not seem like massive changes, we will all be embracing these changes in tandem with a very buoyant Queensland property market.

Statutory notices A seller is required to comply with statutory notices to do work in relation to the Property issued prior to contract unless the notice is disclosed to the buyer in the contract or in writing prior to signing.

This will allow a buyer to extend settlement for up to 5 business days to enable the nancier time to be ready for settlement. This can only be used to extend the settlement date and will not extend other dates in the contract, for example, under other conditions such as nance or building and pest inspections. However, if there is a condition which requires performance ‘at settlement’, the time for performance will become the new settlement date set under the extension notice.

Hopefully these changes will assist in supporting the needs of buyers, sellers, agents, nanciers, and lawyers to see transactions unfold more smoothly from 20 January 2022.

If the seller fails to comply with the notice the buyer is entitled to claim the reasonable cost of complying with the notice from the seller as a debt after settlement.

If we can be of assistance, please do not hesitate to contact Easton Lawyers. Should you have any questions please contact our of ce on 07 5494 3511 Monday to Friday between 08:30 and 17:00 AEST. Take care everyone!

A buyer is required to comply with notices to do work issued after contract unless the notice requires compliance pre settlement, in which case the seller must comply with the notice and can claim the reasonable costs incurred from the buyer as an adjustment at settlement.

This is a signi cant change to conveyancing practice and either party will be able to extend the settlement date at any time up to 4pm on the settlement date.

Unregistered easements

Trove Easton Easton Lawyers

The seller is not required to comply with a notice if the buyer requests the seller not to comply and indemni es the seller against all liability incurred for failing to comply.

There is a new right under which a buyer may terminate if infrastructure unrelated to delivery of services (gas, electricity, water, sewerage) to the Land pass through the Land and are not protected by a registered easement, Building Management

Conclusion So, there you have it, the major changes in the REIQ residential

No Plans to Extend School Year

The Queensland Government Health Minister Yvette D'Ath says the 2022 school year won’t be extended, with revised lesson plans allowing the full curriculum to be delivered to Queensland students over the condensed semester. This means an extra week proposed for Term 4 will not be necessary. Almost 13 per cent of Queensland's 5-11 year olds have now received a Covid vaccine, with the state's Education Minister Grace Grace explaining there has been a positive response in the decision to delay the school year. Following talks with school principals and the Teachers Union Ms Grace now says that the planned extra week at the end of the 2022 school year would now not be needed. Education stakeholders say they can revise lesson plans to still cover the year’s subjects. For all latest updates for Queenslanders about Covid, restrictions, and vaccination information, please go to the Queensland Government’s website at: https://www.qld.gov.au/health/conditions/healthalerts/coronavirus-covid-19/current-status

The Hinterlandgrapevine Online News Travelling Jackaroo “Getting to the Top” “Sam attracts “A new bird”!

I am now taking dancing lessons - can you blame me?.

F

ound this Gem the other day at Darwins Aviation Museum. It’s a Nomad Aircraft, which is one the RFDS used extensively as well as being the famous aircraft in the tv show RFDS from the 80s. Unfortunately they weren’t exactly very keen on selling it, one of the many planes they’re planning to hopefully restore someday. I had thoughts of making it into a proper RFDS trailer for my next adventure in a couple years. You can follow Sam’s adventures at: https://www.facebook.com/ thetravellingjackaroo

These two ladies reached out to me several months ago requesting advice on attaining sponsorship. Their plan, to drive around Australia teaching people to not only dance but to bring back a lot of old fashioned outback style waltzing and balls. As most of you know I’m a bit old fashioned myself and have been very supportive of their plan, and now that plan has become reality. Let’s get the word out there people. You know what to do (share the crap out of it). Not too many people willing to do this for charity

Here's to a cheeky-faced young Australian with a big heart and n even bigger dream. Bon voyage from Maleny, and safe travels Sam. You can follow Sam’s adventures via his Facebook Page at “The Travelling Jackaroo”

I take my hat off to them. Check out their Facebook page https://www.facebook.com/hoedownscountrytowns Their rst event is coming up in Toowoomba https://toowoombatickets.com.au/event/15051 Don’t miss it if you’re down that way.

this?

Maleny Police Station 1952 - 2017 How soon we forget - The Maleny Police Station in Maple Street, Maleny served the Maleny community from 1952 until 2017. On the 1st June 1952, Constable Tom Lugge was sent to take over until a permanent police of cer could be stationed at Maleny. Prior to this police patrolled the area from the Landsborough Police Station. The rst permanent police of cer, Senior Constable Thomas Williams took up of ce on the 1st September, 1952. Senior Constable Thomas Williams remained in Maleny until 1957 when he was promoted and replaced by Constable Joe Spooner. Constable Spooner is still well remembered by long time Maleny residents. The actual police station was initially on the left hand side verandah of the dwelling. His form of transport initially in Maleny was a BSA motorcycle and side-car. This remained until 1947 when the Queensland Police Department purchased some left hand Willeys Jeeps, ex Defence Department vehicles and one was assigned to Maleny. In 2017 the station was replaced by a new purpose built station in Macadamia Drive, Maleny.
