Shopping local keeps your money in your community!

Please respect our hospitality workers

As from December 17th we will once again be able to gather at our favourite coffee shop or restaurant within limits. Our hospitality and tourism workers are at the forefront dealing with the mask-averse and QR-code resistant, for example – but the vaccine rollout has made the battle lines even more fraught. Whilst some might disagree these rules are in force for the greater good of the community. They are not put in place by those hospitality workers. however those very workers are the ones facing the anger of some members of the public.

Be kind to the very hard working staff. This is next level stuff, and we are already tired from the last two years. It doesn’t take much to be cooperative and compliant to the house rules and the direction given by their staff in order to serve you. Many businesses and venues will be able to return to operating at full capacity for fully vaccinated patrons. Please be responsible for your own safety and hygiene practices. - that is not asking too much.

Please support businesses mentioned herein! Shopping Local encourages you to do just that: shop local and rediscover the quality, savings and bene ts of shopping right here at home.

Around Glass house Electorate with Mr Andrew Powell

Changes to the Parole System!

Maleny State School students graduate Congratulations not only to Diya Joy on taking out this year’s Maleny State School Improvement Award but to all 86 graduating Year 6 students. You’ve done your parents and teachers so proud! All the best at High School next year!

On December 1st, 2021 I spoke in Parliament about amendments to the Corrective Services Act. Thanks to the hard work of the Kingi family, the 72,000 people that joined their campaign and my colleague Dan Purdie MP, changes have been made to declare that a prisoner who has been convicted of multiple murders or the murder of a child may not be considered for a parole period of up to ten years. By reducing the frequency of when these heinous individuals can access parole, we will ultimately reduce the re-traumatisation of victims' families like the Kingis who tragically lost their daughter Sian.

Smart Motorways Technology to be rolled out on Bruce Highway Mr Andrew Wallace. Federal MP for Fisher A busy stretch of the Bruce Highway will receive a high-tech boost, with design complete for the installation of additional Smart Motorways technology along the Bruce Highway between the Pine River and Caloundra Road. The Smart Motorways project is part of the 15year, $13 billion Bruce Highway Upgrade Program. The work will include wireless traf c sensors which would be installed at priority locations along the 60-kilometre stretch to monitor vehicle travel times, traf c ow and speed to accurately monitor the highway’s performance. Already detailed design work has been completed. This work is expected to begin early 2022, weather and construction conditions permitting.

On a not so positive note, the Government has been forced to extend by 60 days, albeit temporarily, the time applications for parole must be dealt with. It’s nothing more than an admission the parole system is broken.

Local Show Committee member to attend the Queensland Agricultural Shows 2022 Biennial State Conference When Trevor at Queensland Agricultural Shows asked me if I’d support one of our locals to attend their 2022 Biennial State Conference in January in Bundaberg I jumped at the chance. to support Lois from the Maleny Show Society. I know Lois and others from our local shows will have an amazing time in the Wide Bay and learn so much in the lead up to the 2022 show season!

Dash Cams can work both ways! In September North Sydney Highway Patrol of cers charged the 23-year-old man over 'driving at a speed dangerous to the public' and for going more than 45km/h over the speed limit. He was initially apprehended after allegedly being caught driving at 162km/h in an 80km/h zone. His camera provided proof of dozens of other instances of dangerous driving. 'At the time of the incident, police observed that the rider was wearing a video camera and was lming his riding,' said a post on the NSW Police Traf c and Highway Patrol Facebook page. 'Due to the seriousness of the offence, police seized the memory card from the camera as evidence.’ This is legal and the police have every right to do it and the NRMA said the seizing of cameras is going to become more common. 'The important point is just assume there's eyes on you all the time. It is not just other people's dash cams being used to crack down on bad behaviour, but also your own camera. New Combined Fire and Emergency Services Complex in Maleny

There are celebrations in Maleny this month with the “of cial opening” of the “tri-service” re and emergency services complex at the corner of Dixon Avenue and Macadamia Drive, Maleny.

Severe storm creates damage After a microburst went through Nambour/ Palmwoods area on the 8th December members of the Maleny State Emergency Service had another eventful evening when Maleny crews were tasked to assist their colleagues from Nambour and District State Emergency Service after completing their own local jobs in Maleny.

The process started about 10 years ago, but on December 9th saw some 100 people attended the of cial opening. For Scott and his team at the Maleny RFB and Dan and the Maleny State Emergency Service crew it means no more “bumping in and bumping out” from the old show pavilion Whilst grateful to the Maleny Show Society for many years of accommodation it was high time these teams found a new home.

Draw the line Don’t drive through oodwater

That is not to say that the Maleny Dairy Cattle Pavilion did not serve the community well. It was a mark to those early members of the Maleny SES group who volunteered so many hours to building the building. It was also partly funded by the Federal Government Emergency Management Australia, previously known as Department of Disaster Management Australia. And with Captain David and the Maleny QFRS the opportunities for new partnerships and teamwork are really exciting. Maleny is lucky to have these willing bands of volunteers. The new home is worth the wait.

With ooding occurring across the state people still have bot got the message and as a result there have been a few deaths and a number of rescues of people who have “tossed the coin” and taken the risk and not heeded the message. Studies show that more than half of ood-related deaths are as a result of driving through ood water. A typical car will lose power in depths greater than 15cm as water enters the exhaust and washes into the air intake, causing it to oat once ood levels exceed 30cm. Never drive through ood waters. - if it’s ooded, forget it. If you are in a life threatening situation call 000 If you require SES Flood Storm Assistance call 132500 at any time. Do you need need a New Year’s Resolution? If you’re enthusiastic about helping your community in a time of need, maybe 2022 is the time to put your hand up and get involved.

An Old Codger’s Thoughts & Opinions Whilst the next state election is not scheduled to be held until the 26th October 2024, and that might appear to be a long way away it its important that we, the people of Queensland keep the politicians, not only honest, but working in the best interest of Queensland. At this time they appear to be working for themselves or their vested interests. The people of Queensland should be concerned about the direction that Queensland politically is heading. Over the past few months many instances of Government Departments and organisations have been found to be wanting and no action is being taken to bring them back into line. Daily we read about Queensland government bodies acting badly. Bodies such as the Queensland Building and Construction Commission, Public Trustee of Queensland, Health Department and even the Queensland Crime and Corruption Commission. The very body that is tasked to keep the various Queensland government organisations beyond reproach and is assisted by the Of ce of the Information Commissioner by keeping matters con dential. Many ordinary Queenslanders regularly report that they are being dealt with unfairly. Whilst there is always two sides to the story, not all of the complaints from ordinary Queenslanders can be dismissed out of hand. One sign of the decay of the bureaucracy is the inordinate number of high ranking public servants either leaving their organisation or being pushed from it. Many politicians themselves do not deserve to be taken seriously when we consider their behaviour, especially on the oor of what should be the sanctum of Parliament. Irrespective of the “good news” being pushed out each day by the armies of media advisers employed by the Queensland Government in all government agencies, especially in the office of the Queensland Premier many regular Queenslanders report that they have lost faith and confidence in the workings of the Queensland Government and a number of important government bodies. Many Queenslanders believe that corruption throughout the various government departments and organisations is as bad today, or even worse than before the Fitzgerald Inquiry.

Truthful Jones says

And he swears that it 100% true. - No Bulls##t” A country boy from Charleville, who just moved to Maleny walks into Finbars in BiCentenary Lane and orders three mugs of beer. He sits in the back of the room, drinking a sip out of each one in turn. When he nishes them, he comes back to the bar and orders three more. The bartender approaches and says to the country boy, “You know, a mug goes at after I draw it. It would taste better if you bought one at a time.” The cowboy replies, “Well, you see, I have two brothers. One is an Airforce pilot in Syria, the other is a soldier in Afghanistan. When we all left our home in Charleville, we promised that we’d drink this way to remember the days when we drank together. So I’m drinking one beer for each of my brothers and one for myself. The bartender admits that this is a nice custom, and leaves it there. The country boy becomes a regular in the bar, and always drinks the same way . He orders three mugs and drinks them in turn. One day, he comes in and only orders two mugs. lars take notice and fall silent. When he comes back to the bar for the second round, the bar tender says, “I don’t want to intrude on your grief, but I wanted to offer my condolences on your loss.” The cowboy looks quite puzzled for a moment, then a light dawns in his eyes and he laughs. “Oh, no, everybody’s just ne,” he explains, “It’s just that my wife and I joined the Baptist Church and I had to quit drinking.” “Hasn’t affected my brothers though...” Morale: It is important that nothing stops important family traditions when it comes to mate-ship and family ties. May all our service people always come home safely and that their efforts help to improve other peoples life style.

Covid 19 and Public Health Directive for Queenslanders The Queensland’s borders will reopened on Monday, December 13. There are still some conditions on crossing the border after December 17th. Other Public Health directives come into effect on December 17th. To see the changes see the the link below to go to the information from the Qld State Government. All Queenslanders must follow the Public Health Directives issued by the State Government and volunteer clubs need to be up to speed on what the rules are regarding unvaccinated people entering premises post December 17th in Queensland. Please go to the link as there is a series of questions and answers that explain the issues and what each person’s responsibility is:

to be fully vaccinated by the 17th December. If a staff member has had their rst dose of a COVID-19 vaccine they will not be able to return to work until they have had their second dose. Post December 17th vaccinated people will need to provide proof of their vaccination when entering many venues. This link explains how to obtain your proof of vaccination certi cate: https://www.health.gov.au/initiatives-and-programs/ covid-19-vaccines/certi cates Further information is also available at the Federal Government’s health web site at: https://www.health.gov.au/

https://www.qld.gov.au/health/conditions/healthalerts/coronavirus-covid-19/current-status/ queensland-restrictions-80-percent-vaccination Please note that if you are operating a councilowned venue, that Council follows the direction of State Government. If you are lease holder of a council-owned venue, your group will therefore need to follow the Public Health advice given by the State Government. As things can change rapidly, it is always best to refer to the State Government's website and follow the Public Health directives as listed. Unvaccinated people will still be able to access essential services and activities - this includes going to grocery stores, pharmacies, post of ces, newsagents and clothing stores, and being able to participate in activities like going to the gym for exercise. Capacity restrictions may still be in place at these types of businesses. Please keep checking the Governments website for all information. It is a mandatory requirement for staff who work in businesses delivering non-essential leisure services

Proof of vaccination Proof of vaccination veri es that a person is fully vaccinated. You must show either a printed or electronic form before entering a business establishment or venue. Masks have been re-introduced under certain circumstances. You will still need to use the Check-In Qld app at public venues.

Selling or buying a property!

Using a Trust to hold shares in a company With Trove Easton of Easton Lawyers, Maleny If you’re considering a Trust to organise the ownership of your company this series of posts discusses some issues to consider. Following on from the previous post where we looked at the Trust, duciary relationships, Bene ciaries and Trustees, now we delve a little deeper. Discretionary trusts

and you decide to divide ownership equally, you might decide to start your company by having 1000 shares available to be owned. You and your friend would each receive 500 shares, which you could sell. However, you can arrange it so that a Trustee owns the shares in the company.

you’re the Trustee, you can distribute the pro ts from the Trust to yourself. As with all Trusts, a Trustee cannot be the sole Bene ciary which means you’ll want to appoint other Bene ciaries, such as family members to bene t from the Trust. If you are considering a trust or company, please seek legal advice before taking action.

Can a Trust Own Shares in a Company?

Discretionary Trusts arise when the Trustee can choose which Bene ciaries receive the Trust property, and how much of the Trust property each Bene ciary gets. The discretion part lies with the Trustee having the option of splitting up the Trust property however they like.

Legally, a Trust cannot own shares in a company as it is not a separate legal entity, rather a trust is simply a relationship. However, this changes when you consider the Trustee/s and what they can hold for Bene ciaries.

Unit trusts Unit Trusts in comparison are xed, express Trusts unlike discretionary Trusts. Unit Trusts allocate the shares in the Trust property for Bene ciaries in the Trust agreement, rather than at the discretion of the Trustee. Each Bene ciary is allocated a unit in the trust property as stated in the Trust agreement.

Should you have any questions please contact our of ce on 07 5494 3511 Monday to Friday between 08:30 and 17:00 AEST.

Take care everyone! Easton Lawyers

Trustees can own many types of property, including cash and property including company shares for the bene t of Bene ciaries. So, if you operate your own company, you can set up a trust to hold your shares. If

Our of ce will be closed from 4pm Thursday 23rd December and will reopen on Monday, 10th January 2022 we wish you a Merry Christmas and a Prosperous New Year.

Company ownership Ownership of a company is allocated through shares. Shares account for a small percentage of a companies’ ownership. So, if you start a company with a friend
