State budget: a mixed bag for building with Ralf Dutton, President
WE CAUTIOUSLY welcomed the Queensland Budget announcement when it was handed down in June, but warned it’s a mixed bag for the building industry. While the big injection of spending via the $45 billion infrastructure program, with a significant $250 million for education, is a godsend for commercial builders, the residential housing sector won’t fare as well. It’s a triple whammy for housing builders, with the Treasurer calling an end to the First Home Owners' Grant Boost, the recently announced waste levy and the impact of land tax increases – which together will raise the cost of building a new home. We’re incredibly disappointed that the boost has not been extended further, as there is no denying it was a foot in the door for first home buyers. The rise in first home buyers entering the market since it was introduced in July 2016 is striking, as is the flow-on effect to the building industry. With first home buyers’ numbers already on the decline, which is reflected in Housing Finance data figures released by the Australian Bureau of Statistics recently; there is no doubt that this decision will have a detrimental impact on a number of Queensland building businesses. The waste levy will also have a direct impact on anyone looking to build a new home or renovate an existing one. Once it’s introduced

roads and rail), and the associated ‘fittings and fixtures’, such as trains and equipment.
Land tax increases will add to the burden, increasing the cost of a new home to the tune of around $800-$1,000. All in all, that’s over $2,000 in unnecessary additional expenses as a result of this budget. Subsequently, potential home buyers are further disadvantaged, as artificial, additional costs make it more difficult to get a loan; with valuers compelled to ignore these tax increases and finance application coming back further undervalued.
We’ve been calling on the Queensland Government to increase expenditure on public sector building and construction – residential and non-residential buildings together with engineering construction – to reach the 25-year average as a proportion of Gross State Product (GSP).
For the commercial sector, the $45 billion in infrastructure spending is good news, although we are still waiting to understand how much will be earmarked for public sector buildings – which is essential for job creation in the construction industry. Master Builders had called for a Public Sector Building and Construction Capital Expenditure Benchmark and for a guarantee that additional funding would be spent on public sector residential and non-residential buildings, like hospitals, schools and social housing. We are delighted to see the commitment of $11.5 billion for 2018/19 around the state, but the big question for us now is how the total spend will be split between spending on new public sector residential and non-residential buildings, engineering construction (such as

Following that, the next biggest hurdle is ensuring the allocated budget is spent. In previous years the government has failed to spend budget allocations, which is a missed opportunity when it comes to job creation and the key infrastructure projects that Queenslanders need. By our calculations, the underspend for 2017/18 is currently projected to be around $333 million, which equates to 3,077 missed job opportunities. One specific example of this being the $86 million allocated to the Nambour Hospital in 2016/17, which is only projected to commence in 2019. Other aspects of the budget that will impact building and construction are the waste levy (which will have a direct impact on householders looking to buy or build a new home or renovate an existing house); property tax increases (the government has further slugged investors with a hike in stamp duty and land tax increases); and positive measures like the payroll tax rebate and WorkCover premium discount.

What if I currently pay over the award?
FOLLOWING the recent wage announcement, the Fair Work Commission (FWC) has increased the national minimum adult wage by 3.5 per cent. This equates to $24.30 per week or 64 cents per hour (based on a 38hour week).
Master Builders’ wage circulars identify minimum wages only. If you’re already paying above the relevant minimum wage rates, the wage increase may be absorbed automatically and therefore no adjustment is needed in your business.
This came into effect from the first full pay period on or after 1 July 2018.
What if I currently pay according to an enterprise agreement or Individual Flexibility Agreement (IFA)?
The national minimum wage will now be $719.20 per week or $18.93 per hour. This increase will also flow on to Modern Award rates. Most (but not all) allowances have also increased.
You may have an obligation to increase the wage rates contained in your enterprise agreement or IFA as a result of the minimum wage decision.

Building smarter…. and bigger? We like to know what people are after when they’re building a new homes, so this quarter’s Hot Topic explored residential demand and the prevalence of smart technology. Gone are the days of the three-bedroom, one-bathroom home ruling supreme. Four-bedroom houses have trumped the tradition, with our latest Survey of Industry Conditions showing 39 per cent of consumers are opting for larger homes when building new.

QUEENSLAND State-wide the non-residential sector continues to struggle. While residential conditions remained subdued, it’s safe to say we’re looking forward to a more stable future. For many respondents turnover and revenue has improved but they continue to battle with a downturn in profitability. Increasingly, they find themselves being squeezed between unchanging contract prices, and rising labour and material costs.
GREATER BRISBANE Trading conditions in both the residential and non-residential sectors remain weak. In the case of non-residential construction this is expected to stabilise over the coming three months and improve significantly for residential construction. Supporting the improved outlook is an improvement in turnover and revenue, alongside more stable contract prices and profitability. The high cost of labour and materials continues to provide the greatest challenge.
GOLD COAST Both the residential and non-residential sectors continued to struggle but both sectors are looking forward to a more stable future. While there has been an improvement in turnover and work in progress, contract prices have stagnated. With the continued rising cost of labour and materials this is putting a very real strain on profitability.
SUNSHINE COAST There was a large improvement in trading conditions for both the residential and non-residential sectors and continued optimism for the future. The optimism is well-founded with turnover, profitability and new contracts all being reported back as strong. The shortage of available land and qualified staff were reported as the most significant constraints in the region, which is further evidence of a region well into a growth cycle. 12 | Master Builder

The non-residential sector continues to improve, while the residential sector has had a quiet quarter. Looking forward and the reverse is expected, with non-residential builders believing that they’ve seen the peak, and residential builders hopeful that there are improvements to come. Stable turnover and contract prices are supporting good profit and employment levels. At the same time, rising labour and material costs are a critical constraint on businesses.
WIDE BAY BURNETT
Respondents continued to report conditions well within negative territory for both the residential and non-residential sectors. This is expected to improve in the coming three months with turnover, profitability and contracts all looking stable. The top constraint continues to be the high cost of labour and materials.
CENTRAL QUEENSLAND Trading conditions in both the residential and non-residential sectors fell away over the quarter. Looking forward, improvements are expected off the back of higher levels of turnover and new contracts. There’s no expectation, however, that this will be converted to improved profitability or employee and apprentice levels. Growing labour and material costs continue as significant constraints in the region.
MACKAY & WHITSUNDAY Trading conditions for the residential sector improved, while the nonresidential sector struggles. Looking forward, builders are hopeful that there are more improvements to come. The confidence is based on improved turnover and higher work-in-progress. Contract prices, on the other hand, are stable while labour and material costs continue to surge higher. This will continue to challenge profitability.
NORTH QUEENSLAND
There has been a significant improvement in trading conditions for both the residential and non-residential sectors but this will only be shortlived. The poor outlook is based on weaker turnover, profitability and contract prices. The challenges caused by continued low level of demand has now reached a critical level.
FAR NORTH QUEENSLAND Both non-residential and residential conditions remained muted over the quarter. Stable turnover, profitability and contract prices are expected to help trading conditions in residential sector going forward but the nonresidential sector will continue to struggle. The difficulties in obtaining finance for new projects is a critical constraint acting on the region. Master Builder | 13

Toowoomba is the main economic driver for the Darling Downs and is currently undergoing its largest visual transformation since settlement. Due to a diverse range of economic contributors, Toowoomba is fortunate to be fairly insular when it comes to exposure to the peaks and troughs associated with regions that rely heavily on income derived from one or two sectors. Some of Toowoomba’s key economic drivers include, health, defence, education, agriculture, manufacturing and of course, construction. For the December 2017 quarter, unemployment levels were stable and under the state and national averages. The rental vacancy rate reported in February 2018 was 2.6 per cent with some reports suggesting its buoyancy was a result of housing workers employed on the Second Range Crossing. Predictions are that this will increase once the Second Range Crossing is finished at the end of 2018.

There is great excitement in the region for locals and investors alike resulting from the connectivity becoming available through projects such as The Wellcamp Airport, the Nexus Range Crossing, the potential Inland Rail Route and the possibility of a fast rail service in the coming years. In recent years, Toowoomba has become an attractive place to live for many refugees steering away from the less traditional migration, which was dependent on those retiring from their large rural properties. Toowoomba has become known for the lifestyle and opportunities that it can provide to residents in all stages of life and this awareness has resulted in the demand not only for more retirement/lifestyle villages but more industry and child care facilities. Toowoomba is experiencing an exciting time of growth, investment and transformation and with its own microclimate offering residents a cooler climate in summer coupled with a cool but tolerable winter, it’s becoming a popular city for those looking for a lifestyle change.

Tradies overrepresented in workplace injury TRADIES make up 30 per cent of the Australian workforce but represent three in five serious workplace injuries. Australian Physiotherapy Association Occupational Health Group Chair, Dave Hall said time off work due to poor health and injury had a significant impact on the families and businesses of those injured.
Mr Hall said it was important to seek help if ‘niggles’ didn’t feel right. “The earlier you see a physiotherapist the quicker you will recover and the less chance your work will be impacted,” he said. Mr Hall said physios could also provide advice on how to prevent injury from happening in the future.

Why variety is key in your grocery cart ARE you shopping appropriately for your site lunches and snacks each week? Gladstone-based dietician, Megan Leane says most people aren’t, but says a few small, simple tips can yield fantastic results and save you time. “Most commonly we find people are forgetting to get enough of the right things at the supermarket to last them through the week for work lunches, snacks and dinner,” she said. “I think it’s really good for people to buy a variety of things, even when we’re talking about fruit. If it’s going to run out, why not buy some pre-portioned tin of fruits or dried fruit. Look for tins of fruit that are in natural juice rather than syrup."
A pre-packaged lunch doesn’t mean you have to make it yourself IF YOU didn’t have the time to make lunch, don’t have any leftovers from dinner the night before or didn’t do any Sunday meal prep, don’t stress. “It’s about identifying the places you can buy lunch and not waiting until its lunch time at work. Perhaps you could buy something on your way to work," Ms Leane said. She advised looking for foods that meet the five core food groups; whole grains, vegetables and fruit, dairy and lean protein.
Ms Leane said the key was portion control, especially when snacking.
“It’s easy to get a variety of the five in perhaps a wholegrain sandwich, a muesli bar, crackers or perhaps, fresh fruit or a few pieces of dried fruit,” Ms Leane said.
“If you have more than a couple of tablespoons of dried fruit, if we rehydrated that, it’s going to be an entire bunch of grapes,” she said.
“Dairy might be cheese on crackers or a low-fat yoghurt. But you might have already had milk in your coffee at home before or on the way to work, so you need to be mindful of that too.”
She suggested dried fruit as a standalone snack paired with lowfat yoghurt or with a small handful of nuts as a trail mix.
Ms Leane said getting enough meat and vegetables was often “the hard one” for people.
Don’t allow yourself to get hungry
“So it’s important to use them as part of a dish. Try putting salads into wholegrain sandwiches and wraps. There are also brilliant pre-portioned vegetables that you can chuck in a microwave if you have one available at your job site or office.”
APPETITE is the biggest predictor of behaviour. “If you wait until you’re starving and you’re not prepared, of course you’re going to make a rushed choice,” Ms Leane said. Try to eat every three hours and have something you can leave in your pocket - trail mix, dried fruit or dry roasted fava beans.
Breakfast breaks the overnight fast EVEN if you’re waking up at 4am bleary-eyed and rushing out the door, grab something to eat for breakfast. “The role of breakfast is to break the overnight fast. It changes it from the sluggish overnight mode to the morning fuel mode,” Ms Leane said.

“For morning team or a snack, perhaps some eggs, nuts or legumes, a tin of tuna. You could also try dry-roasted chick peas and fava beans. They’re a packet food, but one of the better ones.”
“Breakfast helps with concentration and if you’re in an active role at work, you’ll need that blood sugar for your muscles. “Eat within the hour of waking up. The key word here is ‘eat’, it doesn’t have to be a big breakfast; it just has to be something.” Ms Leane said a glass of milk. a breakfast drink, wholegrain museli bar or a banana was enough to spark the metabolism.

Focus on yourself HOW are you going? What are you saying to yourself? What are the emotions you're feeling? Townsville psychologist, Joann Lukins of Peak Performance Psychology, says paying attention to yourself is a great starting point when checking in on your own mental health. “Maybe we don’t socialise as much or we stop exercising or start eating more rubbish food. If things don’t feel characteristic for you or don’t feel good, that’s a sign it might be time to do something for yourself,” Dr Lukins said. “Sometimes that might be a practical or sensible change that’s gone out the window when you are stressed, facing adversity and feeling like the mental fuel tank needs a refill. “Look at your exercise, your nutrition or your sleep. In terms of sleep, it can go one of two
ways; you sleep more or you can’t sleep at all,” she said. Dr Lukins said once you identify the areas you might have let slide a little, you focus on doing more of those and, more of the things you enjoy more generally. “Whether it be a hobby or a sport or kicking the ball with the dog down the park, making sure you’ve got some enjoyable activities that make you feel good is really important,” she said. “One of things I get people to do is tell me the things that are happening when their life is going well, they might say, ‘I’m going to bed early or spending more time with the family'. “When we are looking after ourselves, we’re stronger physically and mentally to deal with whatever is going on in our lives.”
Helping out a mate IF a friend or a colleague is having a tough time, sometimes it can be difficult to know what to say but Dr Lukins says being a mate is not always about having the answers. “In our lives, people matter. It’s people who get us through stuff. Listening and acknowledging what people are saying will go a long way,” she said. “You might say something like, ‘Gee it sounds like you’ve been having a tough time’. “You don’t need to solve it or fix it, just be someone who is going to be generous enough with their time to listen. You’ll soon know if someone is wanting your advice. “More often than not, people just want to feel acknowledged and heard.” Dr Lukins said the feedback she most often got was, “Thank you for listening to me”.

Managing exposure to silica dust a must in your workplace A common risk found on construction sites is exposure to dust, and more specifically, exposure to silica dust.
What is silica dust? Silica is a generic term commonly used to refer to respirable crystalline silica (RCS), including crystalline quartz. RCS and quarts are commonly found in: • Most rocks, sands and clays • Concrete, mortar, brick, blocks, pavers and tiles • Natural and composite stone benchtops • Cement-based material, like fibre sheeting and autoclave-aerated concrete. The main concern about RCS or quartz is that when it’s in the form of dust it can be toxic to the human body. RCS is a hazardous chemical and inhaling it in concentrated levels and for extensive periods has been known to lead to a disease called silicosis, which is
an incurable lung disease. It has also been known to contribute to lung cancer, renal cancer and chronic obstructive pulmonary disease. For this reason it’s very important that you minimise the risk of exposure to dust. Common activities that generate high levels of dust that may contain silica include concrete cutting, grinding and drilling, stone masonry, demolition, concrete crushing, tunnelling and civil construction.
• Use of dust extraction tools • Hosing down of areas during the demolition process • Use of vacuums with an M or H class filter. A common alternative (and addition) to the controls mentioned above is the use of respiratory protective equipment (RPE), such as masks. If you use a mask as a control you need to ensure it is fit-for-purpose and fits the individual correctly.
How do I manage the risk? There are several ways to manage the risk of exposure when doing these activities. Firstly, you should use controls that extract or supress the dust at the source, for example: • Use of wet suppression tools when drilling or cutting

How can I/ my employee’s access personal leave?
How do I know if the products I’m using are fit for purpose?
Underpinning all employment is a contract that may be written or unwritten. Central to this contract is a commitment by an employee to attend work and do their duties to the best of their ability and to act in the best interest of the employer. It’s in this framework that accessing personal leave must be considered. Taking time away from work isn’t an absolute right, but a benefit that is dependent on certain conditions being met. The right to access to personal leave is dependent on the employee: • Being unable to attend work due to personal illness or injury • Being required to provide care or support for family members due to illness, injury or an unexpected emergency. The Fair Work Act requires an employee to give their employer notice of the taking of paid personal/carer’s leave. The notice must be given as soon as practicable (which may be a time after the leave has started), and must identify the period, or expected period, of the leave. Under the Fair Work Act the employee must, where requested by the employer, give the employer evidence that would satisfy a reasonable person that the leave has been taken for the appropriate reason. The most commonly requested evidence is a medical certificate or statutory declaration. The Explanatory Memorandum to the Fair Work Bill 2009 stated that it may not be reasonable on every occasion of personal illness for an employer to require an employee to provide a medical certificate. However, in the case of an absence extending beyond a short period or repeated absences on particular days (e.g. before or after a weekend or a public holiday), it may be reasonable for the employer to request a medical certificate in support of the employee’s request for leave. Other registered health professionals, like osteopaths, chiropractors or pharmacists, may also issue certificates within their field of expertise. An employee should be informed when they call in sick if a medical certificate is required so they have a chance to book a medical appointment. Evidence produced in support of personal leave must support that the employee is unable to work. For example, a medical certificate that says an employee attended an appointment may not satisfy a reasonable person that the employee was unable to attend work due to the illness. This is often the case where an appointment relates to a condition that has not previously prevented an employee from going to work. For this reason medical appointments and elective surgeries that are pre-arranged will be covered by sick leave if they are supported by a certificate that says the employee is unable to work but not, for example, because they had to travel to an appointment.

The building certifier will require documentary evidence that the building products or systems used in a project meet the National Construction Code (NCC) performance requirements or deemedto-satisfy provisions. The evidence of suitability can be supplied in various forms, such as certificates from a professional engineer or a report issued by a Registered Testing Authority (RTA), just to name a couple. Whatever the form, it’s imperative contractors carefully read the reports, certificates and any other documentary evidence noting any restrictions on the use of the product in order for the certification to be valid to the works undertaken. In August 2017, new laws were passed in Queensland that, amongst other things, required each person in the chain of responsibility (manufacturers, suppliers, installers as well as contractors, etc.) to ensure the project’s building products are not a non-conforming building product for its intended use. Why is a detailed Scope of Work important? From a contractual prospective the Scope of Work (SOW) defines the tasks that you’re required to undertake. Consequently, it excludes any other works. This reason alone would be reason enough to prepare a detailed SOW. The SOW should be detailed enough to manage the risk of any argument occurring over what your work entails. A detailed SOW provides additional benefits e.g., assist in better project planning, appropriate allocation of labour and forces a closer look at the owner’s documentation. In preparing a detailed SOW you are also likely to ask more questions upfront prior to quoting on the job. This could greatly reduce the need for Request for Information (RFI), variations, cost overruns, rework or time delays. Importantly these outcomes are a win/win for all parties.
How do I manage the risk of rising damp? Rising damp occurs when groundwater, by means of capillary action, rises up through walls, floors and masonry. Therefore, ensure the vapour barrier installed under the slab-on-ground construction for a Class 1 or Class 10 building is continuous, all penetrations are sealed, lapped 200mm at joints and repair punctures. Importantly, the NCC requires the moisture barrier to be laid entirely under the slab surface and under edge beams, to finish at ground level. Also, divert surface water away from the building. Advise owners that their landscaping shouldn’t cause water to pond adjacent the building. If your building is experiencing rising damp and the cause isn’t obvious you should immediately consult your design engineer to assist in the investigations.

What is an exemption certificate under the new Planning Act 2016?
Are Residential Cost Plus Contracts ‘do and charge’ contracts?
As of 1 July 2018, you’re required to comply with an approved Code of Practice under the Work Health and Safety Act 2011. Alternatively, you can follow another standard to manage hazards and risk, as long as it provides an equivalent or higher standard of work health and safety to the standard required in the code.
No. All of the requirements of Schedule 1B of the QBCC Act still apply to Cost Plus contracts in the same way that they apply to Lump Sum contracts. For example, a Variation Document must be submitted and approved for every change to the scope of work, duration, quality, item selection, etc., prior to any variation work being undertaken. Extension of Time claims must be submitted within 10 business days of being aware that a delay occurred. Foundation Data must be obtained prior to entering into the contract. The rules are no different for a Cost Plus contract.
The purpose of a Code of Practice is to provide practical guidance for people who have a work health and safety duty. It gives you guidance on how to achieve the standards of compliance under the legislation as well as effective ways to identify and manage risk. Following a Code of Practice would achieve compliance with the health and safety duties in the Act, in relation to the subject matter of the code. Like regulations, Codes of Practice deal with particular issues and don’t cover all hazards or risks which may arise. Where a Code of Practice doesn’t exist for a particular risk you should look firstly at the regulation or undertake a risk assessment to determine the most appropriate way to control the risk.
Can an inspector give me a notice for not complying with a Code of Practice? Yes, an inspector can give you a notice, whether it be an improvement or prohibition notice, for failing to follow the Code of Practice and/ or not providing an equivalent or better control for a risk that’s covered by that Code of Practice. If an inspector attends your workplace and they find an unmanaged risk they will first refer you to the relevant Code of Practice to rectify that risk.
If an incident happens can I rely on the Code of Practice as evidence in court? If an incident occurs and you’re prosecuted as a result, you can rely on a Code of Practice as evidence. It’s admissible by both sides in the prosecution, either by you to show that you did follow the correct process to manage the risk, or by the prosecutor to show that you didn’t follow the correct process to manage a risk. However, if you haven’t followed the Code of Practice, you can provide evidence that you have controlled the risks in a way that is equivalent to or higher than the standard of controls required by the code. For example, you may have followed a process contained in an Australian Standard that provides a higher level of control compared to the Code of Practice.

You can still be sued if you don’t provide an ‘Estimated Total Cost of the Works’ that is fair and reasonable for the scope of work and timeframes provided in the contract. To be able to justify the ‘Estimate’ that you give, you must have a detailed scope of work and program. Additionally, to be able to justify a variation that affects that ‘Estimate’, you must have a detailed scope of work to start with. If you don’t submit variation claims when you’re directed to change that scope of work, then it could be argued that you’re representing that there’s no cost change for that variation. The owners must have an opportunity to determine if they’re willing to pay the additional cost associated with that change – just like they are under Lump Sum contracts. The level of management and risk increase significantly on Cost Plus contracts so you should carefully consider all of the key risks and change your processes to minimise those risks. Cost Plus contracts require an entirely different way of carrying out the project so don’t make the mistake of trying to approach it as a ‘do and charge’ job – it isn’t. The law is quite clear on what your responsibilities are and what you have to prove before you’re entitled to be paid. You’re required to not just prove that you spent money but also that you should have spent that money and often builders find this very difficult to do. Cost Plus contracts have a high incidence of disputes arising with home owners.
When does a home owner need an Owner Builder Permit? The QBCC Act states that an owner needs an Owner Builder Permit if; (a) They carry out building work personally; or (b) Does both of the following: (i) Engage one or more licensed contractors to carry out building work; (ii) Provide building work services; or (c) Does a combination of (a) and (b).

New laws impact termination of contracts THE ability to terminate a contract due to an ‘Insolvency Event’ has become significantly reduced. From 1 July, Federal Government reforms to protect directors of companies in financial strife came into action. These are the ‘Safe Harbour’ changes that provide directors with an exception from insolvent trading liability where they are developing courses of action likely to lead to a better outcome for the company, rather than administration or liquidation. The majority of industry contracts, including Master Builders’ contracts, include a clause that allows a party to terminate the contract if an Insolvency Event occurs (e.g. the appointment of an administrator, liquidator or receiver, etc.).
From 1 July 2018, parties no longer have the right to terminate contracts if a company enters administration or a scheme of arrangement. We’ve worked with Master Builders Australia to have the construction industry exempted from this new legislation. While we support the need for our members to be able to appoint an administrator and restructure their affairs, we have concerns about the consequences this will have on other contractors up and down the supply chain.

Top tips for consistency 1. Don’t overcommit You don’t need to post every single day, on every single social media platform. What’s more important is quality and consistency – that your audience can rely on you to post valuable content on a consistent basis.
2. Schedule ahead of time Setting aside a few hours each month to plan and schedule your social media content removes the “motivation” factor. It ensures that you keep showing up for your audience, even when competing priorities pull you the other way. Get to know who’s liable for design work BUILDERS, particularly residential builders often provide design services to their clients, so it’s important to understand your contractual obligations and get the right insurance cover to protect yourself. The design services you offer may include the preparation of plans and specifications for a new house, renovation or simple deck. Or, perhaps they include getting the foundation data for domestic building work as required by legislation. Either way, these services are considered ‘design work’ and may be provided under a preliminary agreement with your client. This might happen before a quote to carry out the building work is provided or it could be part of the construction contract itself. Either way, under those agreements the responsibility for the correctness and accuracy of that design work rests solely with you (the builder).
Why is the builder the one responsible for design work? When you have a contract with the owner to perform design work, you are taking on the contractual risk of performing that design work. This includes work done by engineers or building designers. Whilst they are likely to be partially responsible in negligence, the builder is the only one with the contractual responsibility for the design. What if I don’t want to be responsible for the design work as the builder? If you’d prefer not to take on this risk, don’t contract to provide design work to the client. Instead, recommend they contract directly with the engineer or building designer. Won’t Contract Works Insurance cover me? Design work isn’t covered by Contract Works Insurance Policies because it isn’t considered

‘construction work’. The engineer’s insurance will not cover a builder’s liability. The reality is, many builders do not have any insurance to cover them for design work. What can I do? Consider taking out Professional Indemnity Insurance to protect yourself for errors or faults in design work that you contract to provide or provide directly to a client. Failing to take out the right insurance coverage means you won’t be covered for any costs to rectify or to defend any legal action by the client should there be an error in the design. The liability for a design failure can be significant and the legal costs substantial.

Tips to protect your customers' personal information IF YOUR business collects personal information from customers and has an annual turnover of more than $3 million in any financial year you'll need to comply with Commonwealth privacy law. With penalties of up to $360,000 for individuals and $1.8 million for organisations, the impact of a breach on your business could be devastating. Personal information is defined as information or an opinion that identifies, or could identify, an individual. Some examples are name, address, telephone numbers, date of birth, credit card and bank account details. 1. Get familiar with your internal privacy policies Understand your personal information handling processes and procedures and undertake regular privacy training. This helps mitigate privacy risks, including human error. Be sure to provide privacy notices to your customers and ensure you handle their personal information the way you say you will.
2. Know who is responsible for privacy Everyone has a role to play in ensuring privacy is respected and protected. There should be staff with overall accountability for privacy, who: • Understand your business’s responsibilities under the Privacy Act • Handle access and correction requests and complaints and enquiries about your personal information handling practices. 3. Only collect the personal information you need when you need it You must only collect personal information that you actually need. Don’t collect personal information just because it may become necessary or useful at a later date. If you think you will need it later, you can collect it then.
4. Access personal information on a needto-know basis Generally, you should only have access to personal information that you need for your role or function. By limiting the personal information you and your staff access, you are helping protect the information from unauthorised access, use or disclosure. 5. Familiarise yourself with your data breach response plan You should have a data breach response plan in place and ensure you are familiar with it. This plan can help you respond quickly if there’s a data breach. A quick response can substantially decrease the impact on those affected. Tradie: Glen Boys Master Cabinets of Bundaberg Glen Boys heads up Master Cabinets of Bundaberg, a kitchen and cabinetry company that works in both the residential and the commercial sectors. In the residential sector, they conduct new builds and renovations and for the commercial sector perform office and apartment fit-outs. Based in Bundaberg, the work is mainly concentrated around the Wide Bay region, including Bargara and outlying areas.
At what age did you start working in the industry? How did you get into it? I started working in the industry when I was 16-years-old. I got an apprenticeship straight out of grade 10 at high school.
What appealed to you about this profession? Just working with timber.
Tell us about one of the most memorable jobs you’ve done? Back when I was younger I made the main reception counter for the Honolulu International Airport when I lived in the Atherton Tablelands. The company I used to work for did overseas shopfitting.
Is there someone who inspires or mentors you? I don’t think there is. I guess I get a bit of inspiration when I read magazines about successful business owners in the manufacturing trade. That gives me a bit of a kick in the pants and gets me going again.
What do you love most about your job? Some of the client reactions we get. You get some people who really get quite emotional
when you rip the kitchen out they’ve had for 30 years and you put something special in.
What’s the best piece of advice you’ve been given?

As far as being in business, it would be to make sure I take time out of my day to regularly invoice jobs.
Delegating and not being able to do everything myself. Sometimes it’s challenging to pass things onto someone else to do.
Have you won any work awards? If so, what are they? I did win an award when I was in the second year of my apprenticeship. I think at the time it was for apprentice of the year and it was for a local apprenticeship organisation. I was also awarded Master Builders Residential Trade Contractor of the Year at the recent Master Builders Wide Bay Burnett Housing & Construction Awards.
Have you completed any training courses with Master Builders and if so, how have they helped you? Quite a few years ago I did the Electrical Testing and Tagging course which helped me because I could test and tag my own gear.
Complete this sentence: Every tradie needs… A lot of patience, especially when you’re dealing with the public. At the end of the day the customer is the one who pays the bills.
What interests/activities do you do in your spare time?
Where do you see yourself five years from now?
I love my barra fishing and camping. I do a lot of tournaments up in North Queensland around Mackay and Proserpine.
Probably in the same position but I hope with a lot less headaches. I guess just getting people in different positions that can take some of the pressure off myself. What I’m hoping is that in five years’ time I’d have a business that I still work in but I can work on my business a lot more rather than in it.
Tell us an interesting fact about yourself. In the last eight years I have built from scratch a 21-foot off-road caravan and two hybrid off-road camper trailers. I have always in the back of my mind considered building them on a commercial basis. Master Builder | 35

Member Profile: Rock Solid Tiling FROM laying $50,000 worth of Bisazza floral-patterned tiles in a swimming pool to working with $15 per square metre subway tiles in a kitchen – Fillipo Grasso says a quality finish doesn’t always come down to expensive material selection. “It’s about being able to do the application so it looks seamless and there’s that continuity throughout the job,” Mr Grasso said. It’s a fine skill he’s been honing since starting out as an apprentice for Brisbane Tiling Service to recently taking out Residential Trade Contractor of the Year at the Brisbane Housing & Construction Awards. “I learnt a lot in my formative years,” Mr Grasso recalled. As the co-owner of Brisbane-based Rock Solid Tiling, a business he started in 2006 with wife Lynda, they have grown the 36 | Master Builder
business of six staff almost as quickly as their family of the same size.

“We put a lot of time into getting to know our employees, in developing their skill. We see it as an investment of time that goes both ways,” Mrs Grasso said. She said the hustle and bustle of a job site could be very overwhelming to a new apprentice.
“You have to learn how to walk into a person’s home – a home that’s their castle – and you need to say, “I’ve got this” and just consistently perform to a high standard.”

MEMBERS CORNER requirements, including natural stone and individually hand painted tiles with two rarely a perfect match. “There’s no uniform look to them, it looks good in a small space and anyone can do a splashback but getting that to look good on bigger spaces in internal and external areas, that’s a skill that only comes with that practice,” Mr Grasso said.
“It’s the kind of work we’ve always driven ourselves to seek. But it’s great because our team gets exposed to a lot of different products.” Fillipo Grasso, Owner, Rock Solid Tiling Most recently, that tedious, testing work included tiling a pool waterfall which involved a 100-metre rock wall behind a pool out of natural stone at a job in Paddington, Brisbane. “You would cut the natural stone and put it in but each natural stone is different. When you spread those small differences across 100 metres and you’ve got four to five people doing the job, there is no continuity,” Mr Grasso said. “We had to basically put it on the wall, come back, cut out pieces and get a seamless flow of the product across that really large area.”
Before that, the team were tiling a pool for Corella Construction that involved a paintby-the-number application of floral, glass Bisazza tiles. “That was four weeks of work for us to install those tiles because we got given a bare concrete shell. We had to straighten any walls and we had to level floors and walls and get it smooth,” he said. They then painted the entire pool blue to make it one colour because the tiles were transparent. “There was two weeks of just prep work before we even installed the first tile,” he said.
“Tilers have been around for hundreds of years, however the technology in tiles in the last 10 years has increased. Not just in their performance of the actual product itself, but the aesthetic property of the tiles," he said.
“On that job, the builder spent in excess of $80,000 just on Bizzara mosaic tiles throughout the house.”
“So to be the best you can be is to understand the products you’ve been given and not treat the job as ‘I install tiles and I install it this way and if I come across tiles that are different, I install it the same way’.
Mr Grasso said he always stresses to his employees the importance of knowing about new products.
“You need to be able to adapt and have the information you need to secure the longevity of the installation.”

Downs Designer Homes owner Jeff Bubeck's stunning, showpiece creations have gathered a cult following in the Toowoomba and Darling Downs region. A family company to the core, the entire Bubeck family of four work in the business, from wife Karyn to daughter Tayla and son Jason on the tools. Bubeck’s clients are regulars on Karra View Court, labelled by the media as Millionaire’s Row and opt for inspired homes, sometimes an Italian Villa, other times a traditional Japanese home and for some, an American mid-west inspired property. A recent client, his eighth build on Millionaire’s Row, took out 2018 Downs & Western House of the Year with an Italianstyled home with ornate Indian influences. “It’s a beautiful block of land overlooking the famous tabletop mountain. Even though the home was on a difficult site, it deserved a beautiful home,” he said. Using his own European styled home, winner of 2016 Queensland Individual Home $1.26 million – $2 million, as a display home, the clients liked what they saw but wanted to add their own twist. 38 | Master Builder
“The owners had approached me early on to ask if I would be open to sourcing material overseas – mainly India,” Jeff Bubeck, Owner Downs Designer Homes “I said building a home like this is hard enough but whilst I don’t like to admit it, I do thrive on pressure. After looking at the logistics, I said yes and my wife and I travelled with the clients to India.” On the trip they sourced balustrade, doors and marble tiles, many of which needed to be hand carved in India. “One of my big things when I got there, I had everything written down to the millimetre for the trip and I started to give the measurements to the craftsman and he said, ‘I work in imperial’,” he said. Bubeck then spent hours painstakingly checking his manual conversions. “It then took up to 12 months for the last of the materials to arrive,” he said. The home was, as many of Bubeck’s showpiece builds are, designed by an

That was the start of a relationship that has continued to this day.
“In 1996, I was lucky enough to receive a phone call from John Simpson, an architect in Sydney. John was sitting in one of my display homes and, at the time, he was designing a home for his parents in Toowoomba. He said he liked what he saw and wanted to meet with me and have a chat.
“John’s been my mentor for over 20 years and I feel I was very lucky to have crossed paths with him – he’s been gracious and forthcoming,” he said.
It came just six years after Bubeck went out on his own with Downs Designer Homes.
“He’s been associated with many of my awards. Since I’ve met John, the homes have become grander and more ornate, it’s changed the landscape of Toowoomba.”
“At the time there was a lot of project builders trying to take the same piece of cake. I spent a lot of time quoting for nothing when it was going to go to the cheapest builder,” he said. “I made the decision that I wanted to build two-storeys and build bigger and people said, ‘people don’t like using stairs and climbing’. His thoughts were if blocks were smaller and they want larger homes, they'll have to. Really it only took just one person to give me a chance, we successfully built the house and it won an award."

Delay in security of payment reforms EVER since the new Building Industry Fairness (Security of Payment) Act 2017 became a reality in November 2017, Partner at Garland Waddington, Brendan Bathersby, has been out and about spreading the word through seminars and in-house information sessions, to ensure that all levels of the building and construction industry are familiar with the new legislation.

“I’ve been on a mission to ensure that building and construction industry participants are aware that the most significant change is in Chapter 3, the new security of payment regime,” Mr Bathersby said.
“Most people in the building and construction industry will know the commencement of Chapter 3 has been delayed until 17 December 2018. But there’s no time for complacency,” Mr Bathersby said.
“These changes are complex and the penalties for non-compliance are serious. It’s imperative that builders, subcontractors and suppliers get advice to understand the new legislation and to safeguard their business.”
“There are elements businesses in the building and construction industry need to do to get themselves up to speed and this small delay gives them time to be on the front foot.”
Chapter 3 of the Act will replace the existing Building and Construction Industry Payments
He said media had mainly focused on the new Project Bank Accounts regime implemented by Chapter 2 of the Act, but for the time being, that regime was of more limited impact than Chapter 3 of the Act.

Builder bucking trends in Bargara THE FORESHORE of Bargara has changed dramatically over the past 20 years as older houses are sold and regularly replaced with multi residential, high-rise apartments. But a Bundaberg-based builder is bucking the trend with his elaborate, showpiece creations putting a strong case forward for the merit of homes on the foreshore. Steve Coates, owner of Steve Coates Constructions, won Individual Home $1.26 - $2 million, Best Residential Kitchen and House of the Year at the Wide Bay Burnett Housing & Construction Awards for his esplanade project, The Gym. It marked the fourth foreshore win for Mr Coates after taking out the 2016 Wide Bay
Burnett House of the Year and Individual Home over $2 million for a project at Coral Cove, 2015 Wide Bay Burnett Home Renovation/Remodelling Project $576,000 - $1 million for a project at Innes Park and Wide Bay Burnett House of the Year and the Queensland award for Individual Home $2.5 million – $3 million for The Glass House at Kelly’s Beach in 2010. “It’s good to see a high-level home built on the front of Bargara. Not everyone wants to live in a unit. The more homes of this standard we can build along the front will help increase the property value of the area,” Mr Coates said. With limited site access on his latest project and challenging building forms, including a
folded roof and custom-built wine cellar, Mr Coates said it was no easy feat bringing The Gym to life. He credited the win and success of the 12-month build to the design of the home and liaising closely with his designer, Ben Thornton, great clients that were willing to let them be creative, his construction team and exceptional tradespeople. “It makes you very proud to build something that other people see as quality and find enjoyment in,” Mr Coates said. “The biggest reward is that the clients love living there and the house works well for their lifestyle.”
Light filled, airy home takes win A HAMPTON's style home has stolen the hearts of buyers and judges alike, taking out President’s Award at the 2018 Gold Coast Housing and Construction Awards. The four-bedroom family home, Beachmere, at Helensvale by GJ Gardner Homes Gold Coast North was a stand out. GJ Gardner Homes Gold Coast General Manager, Simon Curtis said Hampton’s-styled homes were the “flavour of the month”. “We wanted something that appealed to second and third home buyers,” he said. 54 | Master Builder
“The design of the home has the master bedroom and the parents’ retreat separate to the children’s area. Then there’s three bedrooms with their own activity space and the house wraps around an internal courtyard.” He said the award was great recognition for the hard work his team put in day-to-day. “We’re a family-owned business, everyone puts their heart and soul in and to be recognised highlights the quality of construction that we deliver,” he said.
