2018: a year for strengthening & positioning with Ralf Dutton, President

Last year we shaped positive change – our goal to improve the efficiency and confidence of the building and construction industry and ensure government heard our industry. As much as possible, ideas that would have been detrimental to the industry were stopped in their tracks, while we worked to help advance others. While much was achieved, as we commence a new year there is more that needs to be done. Statistics report that building work has been at a record high. However, the industry is still experiencing many challenges and we don’t anticipate this will change any time soon. Work has been concentrated, leaving large parts of the industry out in the cold. The lack of affordability has restricted demand and new onerous building legislation has imposed even more costs. As these costs have continued to rise, contract prices have been contained, creating a ‘profitless boom’.

Recent changes provide no benefit for builders or subcontractors and add unnecessary additional costs. Our rapid adjudication system is inflexible and blinkered to so much of the dispute that it cannot guarantee fair outcomes. We’ll hold the government to its promise of a comprehensive review of the new security payment reforms before expanding them to cover the wider industry.

Right products New product supply ‘chain of responsibility’ should help to ensure that building contractors receive the information they need about the products they use. Our goal will be to ensure this information is easy to access, comprehensive and reliable. We’ll also be looking to ensure that the sweeping new powers given to the QBCC are wielded fairly.

In 2018, we’ll be calling on the government to commit to the following priority areas that are necessary for keeping new buildings affordable, strengthening our industry, and ensuring the industry is well positioned to deliver the buildings that Queenslanders need.

Sensible regulation

Stimulate demand

We want to ensure there’s evidence of a clear net benefit to the community. We’ll propose that all new regulation must be subjected to a rigorous cost-benefit analysis.

Government spending on new buildings, which needs to be a major driver for construction demand, remains at a historic low. Spiralling land costs and government taxes and charges add significantly to the cost of new construction, eroding affordability. We’ll be encouraging the new government to consider opportunities for government spending on key projects.

Manage payments and disputes All parties in the building chain need to be confident they’ll be paid what is owed. Solutions need to be all-inclusive; involving the owner, builder, sub-contractors, sub-subcontractors, suppliers and consultants. 4 | Master Builder

Building regulation adds a significant cost to new construction, eroding affordability. New regulatory requirements, which may appear sensible on the surface, can have prohibitive cost implications.

Quality documentation The quality of project documentation, especially the contract, can make or break a project. We believe measures are needed to make contracting between the parties to a building contract fairer, to ensure all building contractors are held accountable for their work and timely payment is made for that work.

Contain liability and risk If innovation is to flourish, contractors need to have confidence in risk management and their exposure to risk must be fair and

proportionate. Currently, contractors have no limits on their common law liability, leaving them exposed to being sued years later. We’ll advocate for a 10-year cap on builders’ liability and for all building professionals to be held accountable – including suppliers, contractors, engineers and architects.

Strong workforce The trade licences that govern our industry must reflect modern building techniques and practices. We’ll be calling for licensing reform to ensure that all technical and business core competencies are addressed and set at the appropriate level, as well as being reflected in the builder qualification.

Safe workplaces There can be no scope for the misuse of workplace health and safety laws for industrial relations agendas. Our view is that an efficient, modern and comprehensive workers’ compensation scheme is needed. One that balances the interests of employers, employees, principal contractors and host employers. We’ll be recommending that certain Queensland Codes and guidance material be improved to better reflect modern methods of construction.

Fair workplaces To remain competitive in the global economy we need an industrial relations system that enhances and encourages genuine bargaining at both the enterprise and individual level. We envisage a system where employers and employees can freely enter into agreements, which provide flexibility for employers and a safety net of fair conditions for employees. We also believe that the rules around independent contractors must continue to allow the subcontracting system, which is at the core our industry’s productivity, in order to operate effectively. 2018 is shaping up to be another big year. I’m genuinely excited to be at the helm as we navigate the waters with a re-elected Labor Government. As a collective we have greater power to influence the reforms that affect our day-to-day. Product fear hampers innovation

Give credit where it’s due

Despite all the talk about innovation in the construction industry, and with materials manufacturers investing in new products, many builders are reluctant to try new and innovative products and practices.

Employers of apprentices are investing in the future of the industry, enabling the transfer of vital knowledge and skills to the next generation of tradespeople. This should be celebrated, supported and encouraged by governments at all times.

Master Builders’ latest Survey of Industry Conditions has revealed that builders are concerned about non-conforming building products. Builders fear that products will fail and they’ll subsequently have to wear the cost of any rectification.

However, following an unusual turn of events since late 2016, many Queensland employers were left wondering whether anyone gives them credit for the work they’re doing with apprentices. Through no fault of their own, these employers now face the prospect of unexpected and unbudgeted, retrospective wage increases.

Many builders are therefore taking a more conservative approach to product procurement. Two-thirds of survey respondents are choosing to stay with the same suppliers for the same products, compared to only one-fifth who regularly source new products through new suppliers. This reluctance to take a chance and try something different is limiting the opportunity for efficiency gains. Builders are worried that if they adopt something new or different, it could fail down the track. The QBCC holds builders liable for structural defects for up to six years and three months after the fact – which is a long time to have something hanging over your head. Because of this, builders are generally opting to stick with what they know and are purchasing through suppliers they have long and enduring relationships with. Master Builders believes it’s imperative for industry to identify new and improved products, processes and systems that will help drive down the cost of building and increase business profitability. Innovation is essential for business growth, competitiveness and productivity. Competition continues to increase and the cost of building continues to rise, so we need to start looking at new ways of doing things in order to thrive in the future. However, changes around construction processes and materials carry plenty of financial risk without strong evidence of cost savings or consumer acceptance. Without scale , many alternative construction methods simply aren’t viable – and Queensland’s building industry is predominantly comprised of small businesses. In an effort to promote innovation in the industry, Master Builders is keen to work with state government to encourage the uptake of new construction materials and methodologies that reduce completion times, drive costs down and help to address the issue of housing affordability. 6 | Master Builder

To add further insult, some unions have wrongly claimed that these employers have been dishonest. What really happened was that in 2009, both state and federal governments agreed to continue State Award wage rates for certain Queensland apprentices, instead of moving to Modern Awards – which commenced in 2010. This meant that a large proportion of apprentices would receive lower wages than apprentices employed under Modern Awards. These special laws only applied to Queensland employers who were incorporated prior to 27 March 2006. In October 2017, the Federal Court ruled that the State Awards ended on 31 December 2013. What makes this case so peculiar is that the Fair Work Ombudsman continued to incorrectly publish State Award wage rates after January 2014. This is the main reason so many Queensland apprentices were paid less than the Modern Award for a period of up to three years. There’s no question that affected employers and apprentices were simply victims of our government failing to understand its own laws. The state government has responsibility for state vocational training and it engineered the special laws. Furthermore, the Fair Work Ombudsman failed in its responsibility to give correct advice. Our state and federal governments owe it to these employers and apprentices to help wherever they can, by taking ownership of the fiasco and providing business assistance for transition to the Modern Award. Master Builders urges both governments to step forward and give credit where credit is due. (Read page 31 for more information about this case.)

New industrial manslaughter penalties Queensland businesses, business owners and executives can now be charged with 'industrial manslaughter', due to a new Workplace Health and Safety and Other Legislation Amendment Bill, passed by Queensland Parliament in October 2017. An industrial manslaughter charge could see senior officers of businesses jailed for up to 20 years and companies fined more than $10 million if a fatality occurs in the workplace. Queensland and the ACT are the only Australian state and territory to carry this offence.

Other key changes in the legislation include: • Prohibiting enforceable undertakings in circumstances involving a fatality • Establishing an independent statutory office for work health and safety prosecutions • Referring work health and safety disputes to the Queensland Industrial Relations Commission • Mandating Codes of Practice as a minimum standard of compliance. Latest blog: It’s your money... but is chasing it just too hard? Security of payment continues to be one of the biggest issues our industry faces. Builders and subbies are suffering, and small businesses are going broke. Reform is needed. Master Builders’ latest Survey of Industry Conditions revealed that the new Building Industry Fairness legislation and changes to the Building and Construction Industry Payments Act (BCIPA) aren’t seen as the solution. “They verge on unworkable for builders, suppliers and subbies,” one member claimed. “They're confusing and are creating a gold mine for lawyers,” another commented. Some members have even noticed a trend where people, especially resident owners, are more prepared to enter a contract with no intention of paying the full amount.

Units down by 35 per cent

“I believe most consumers know more about how to get around the payment issues than they’re given credit for,” one member speculated. There are a few reasons why money isn’t being recovered. In the majority of cases, the time and effort to recover money is too great and people don’t want relationships to suffer. The cost is just too high – it’s a classic ‘catch 22’.

Often BCIPA isn’t used because it’s too complex and its scope is too limited. It’s also rigid and some members regard it as biased towards the complainant. We hear our members and agree that all parties in the building chain need to be confident they’ll be paid what’s owed to them. Solutions need to be all-inclusive; involving the owner, builder, subcontractors, sub-subcontractors, suppliers and consultants. During the coming year, we’ll hold the government to its promise of a comprehensive review of the legislative changes, push for the reintroduction of annual, mandatory reporting on the QBCC’s minimum financial requirements, and seek to replace BCIPA with a genuine dispute resolution system.

QUEENSLAND State-wide residential conditions remained muted and while the non-residential sector continues to struggle, there was an increase in those who are reporting an improvement. There’s more confidence in the future with the residential and non-residential sectors expected to strengthen in coming months. This confidence is well-founded with turnover, profitability and contract prices all being reported back as strong. The high cost of labour and materials continues as the most significant constraint on the industry across the state.

GREATER BRISBANE After six months of muted trading conditions both the residential and non-residential sectors improved over the December quarter. The outlook for the coming three months is for further improvement. This confidence is well-founded with turnover, profit, new contracts, contract prices and employee levels stronger for the majority of respondents.

GOLD COAST Trading conditions have remained subdued following a significant drop in the previous September quarter. Residential conditions are expected to improve but non-residential work will be limited, hampered by a lack of investment. There’s good news in stronger profitability and contract prices, while high labour and material costs remain the most pressing constraint affecting business.

SUNSHINE COAST While trading conditions for both the residential and non-residential sectors fell again over the quarter, there's optimism for the coming three months; optimism that’s well-founded with turnover, profitability and contract prices all improving. The cost of labour and materials is the greatest challenge for businesses in the region. 12 | Master Builder

DOWNS & WESTERN

While both the residential and non-residential sectors remain muted over the December quarter, there's more confidence for the coming three months. Going forward, higher turnover and contract prices are expected to support improved profit and employment levels. At the same time, rising labour and material costs will act as business constraints.

WIDE BAY BURNETT There was a further dip in trading conditions over the December quarter for both the residential and non-residential sectors but it’s expected to be short-lived with each of the business performance indicators reporting back strongly. The top constraints continue to be the high cost of labour and materials, and lack of demand.

CENTRAL QUEENSLAND While the residential sector continues to struggle, conditions in the non-residential sector are improving. The outlook for the coming three months is for improvement across both sectors. Turnover, profitability and new work are all stronger, while contract prices haven’t shifted this quarter. The current lack of demand, and high labour and material costs continue as significant constraints in the region.

MACKAY & WHITSUNDAY Residential trading conditions have been stable for the most part over the quarter, and the outlook for the coming three months is more of the same. Non-residential conditions were strong for the quarter but this is expected to be a one-off. There’s reason to be confident of the longer-term, with business performance indicators (turnover, profitability and contract prices) all strengthening. The high cost of labour and materials, and the low level of demand continue as the most significant constraints on businesses in the region.

NORTH QUEENSLAND

In a big turnaround for the long-struggling region, trading conditions for both the residential and non-residential sectors improved markedly over the December quarter. This is expected to moderate somewhat going forward but solid results in each of the business performance indicators (turnover, profitability and contract prices) bode well for the future. Despite the improvement there’s still a need to tackle the low levels of demand that continue as a key constraint on the industry.

FAR NORTH QUEENSLAND While trading conditions aren’t being reported back strongly, work is beginning to flow through and there's confidence in the future. The residential sector in particular, has a very strong outlook for the coming three months. The high cost of labour and materials continues to be the key constraint but turnover, profitability and contract prices are all stronger. Master Builder | 13


INDUSTRY INSIGHTS The outlook for Townsville and North Queensland continues to show a gradual recovery. With unemployment still over 10 per cent in the region, new projects and employment opportunities will steadily help the region to recover from the resources sector downturn during 2015-16. Building approvals remain down by 9 per cent on the previous 12 months. However, developments such as Lendlease’s Elliot Springs residential community will see confidence returning to Townsville and preparation for the population increase that has been predicted for our region. The last quarter of 2017, saw renewed business confidence in Townsville. Confidence was particularly pronounced among larger businesses, which coincided with the Adani Carmichael Coal Mine and Rail Project and commencement of the highly anticipated North Queensland Stadium. We also saw development on the $225 million Haughton Pipeline Duplication and the Sun Metals and Ross River solar farms.

North Queensland Boasting reef and outback, rainforest and grasslands, North Queensland has a very distinctive regional character. Its major seaport handles exports from mines in Mount Isa, as well as cattle exports from both coastal and inland areas.

Extending as far south as Ayr, north to Ingham, and west to Cloncurry, North Queensland comprises five major regional centres. They are Charters Towers, Burdekin, Palm Island, Hinchinbrook and Townsville, which is unofficially dubbed the ‘Capital of Northern Australia’.

Although times have been tough here in North Queensland, we’re definitely starting to experience some green shoots and the next few years hold much promise.

North Queensland Stadium is the pinnacle project instilling confidence in Townsville’s CBD, with Watpac reporting the stadium is on track for completion by the start of the 2020 NRL season. Watpac – Managing Contractor of the project – has identified targets to achieve by completion of the project. These targets include attributing 80 per cent of construction hours to locals, awarding 80 per cent of the construction value to local subcontractors and suppliers, and identifying 6.6 per cent of the project’s construction workforce as Aboriginal or Torres Strait Islander workers. Early works indicate those targets are currently being exceeded, with 97 per cent of construction hours attributed to local businesses, 13 out of 16 trade packages awarded locally, and 22.3 per cent of the construction workforce identified as being of Aboriginal and Torres Strait Islander origin. However, with technology moving at such a rapid rate, the decision about whether to adopt it can be disconcerting at times. While the decision should always be a calculated one, it's worth keeping abreast of what’s out there. In this special feature, we shed some light on some of the latest innovations with potential to impact our industry.

Technology trends in 2018 The construction industry is on the verge of digital disruption, with advanced technology entering the market that is designed to increase safety, efficiency and productivity on construction sites. While adapting to new technology is often a steep learning curve that requires a large initial investment of time and resources, pay-offs include greater efficiencies and new opportunities. The construction sector has often been slow to embrace new technology, which puts many businesses at risk of losing out to competitors who can offer advanced solutions. Increased use of technology in the industry doesn’t mean the end of the workforce, it simply creates opportunities for people to learn new skills and be more flexible in how they perform their jobs. Internet of Things (IoT) IoT refers to any object connected to the internet, including machines with sensors that obtain data or use GPS tracking. 16 | Master Builder

Integrating IoT into construction equipment can result in time savings and financial benefits such as increased billing accuracy, as well as increasing safety for workers, through enhanced tracking and monitoring. An example of IoT transforming the construction sector is VisionLink, which integrates tracking and management software into Caterpillar machines, creating access to real-time equipment information wirelessly from the field.

Artificial intelligence Artificial intelligence has been gaining traction across a wide range of industries, from use in chat bots handling customer service requests to virtual personal assistants like Siri. In the construction industry, smarter machines are being developed to reduce costs and improve accuracy. Construction technology using artificial intelligence will help to develop smarter sites, for example by harnessing project data to forecast budgets and resources for future projects.

Drones and unmanned aerial vehicles Drones are becoming commonplace on construction sites, primarily for monitoring projects and surveying. However, as drones incorporate artificial intelligence their use is expanding to instantly share data and analytics from remote sites to other locations. Sharing site progress with relevant stakeholders in different locations can help to reduce travel costs, save time and improve site safety by monitoring potential hazards.

Digital marketplaces Digital disruption is having a major impact on traditional labour, with sites such as Airtasker and Uber opening doors to employment and empowering consumers with greater choice of suppliers. Digital marketplaces designed specifically for the construction industry are helping tradespeople, suppliers and managers find the right tools and support. Purpose built platforms for the construction industry help to speed up the time it takes to find the right fit between job and supplier.

Telstra and Master Builders have banded together to help meet the needs of small to medium building and construction businesses, with the development of an innovative, new app – Telstra Trades Assist. The easy-to-use, purpose-built app will enable business owners and tradies to manage jobs, order parts, service customers and conduct safety checks. It also enables direct integration with industry and supply chain partners to help streamline business operations and increase profitability and

productivity in near real-time. Telstra spent significant time in-field observing the industry and conducting extensive research to understand workflow and future trends. But do you know that the next wave of new ‘smart home’ technologies, which are now available, allow homeowners to take full control of their energy use, manage their bills easier, and integrate other benefits such as home security and lifestyle improvements? Ergon Energy and Energex have released Building a Smart Home, which is a guide that explains the new technologies, how they work and what benefits they provide. We give you the lowdown on some of the technologies your customers may soon be asking about or you could be offering them to gain a competitive edge.

Home energy management systems Home energy management systems (HEMS) are smart devices that monitor, analyse and control energy in the home to help home owners keep energy costs down. As with battery storage and electric vehicles, HEMS are expected to become more prevalent as 18 | Master Builder

large manufacturers and smaller companies further develop existing offerings or launch new systems onto the market. HEMS comprise two main components: hardware installed in the home (normally in or near the switchboard) and a software application. HEMS transmit and receive signals through the home’s Wi-Fi or its own 3G modem. HEMS will usually: • Monitor and display energy usage and generation in the home (online or via an app) • Control circuits or individual appliances to optimise energy use, for example in the form of ‘set and forget’ timers or manually switching appliances on and off via an app or website • Act as a gateway device that can ‘talk’ to other Internet of Things (IoT) devices such as air conditioners, smart appliances and door locks.

Solar power and home battery energy systems Solar power systems have dramatically lowered in price over the past decade, meaning home owners can install a large array for as little as $5,000. Obviously, householders need to be using

appliances when the sun is shining to get the most benefit from their solar system, otherwise the excess electricity is exported to the grid in return for a modest feed-in tariff. As many households have low energy needs during the day while most people are at work, installing a solar and battery system for storing the energy produced to use in the evening and overnight is now a viable option. A consideration for new homes is where to place the battery system and related components.

How to choose

While still in their infancy, electric vehicles (EVs) are starting to appear more and more on our roads. EVs are expected to increase in popularity as more models become available and prices decrease over the next three to five years.

Some builders may be hesitant to offer these technologies to customers due to fear of them being developed by ‘start-up’ companies with little track record.

Although there are an increasing number of public charging points, home-based charging is considered a necessity so that EV owners can charge their vehicles overnight. Therefore, pre-wiring the home to allow for an electric vehicle charger to be installed in the future will ensure adequate cable sizing is used to acommodate the high power draw of some chargers.

What incidents do I need to report to Workplace Health and Safety Queensland (WHSQ)? You must report all serious incidents, which are classified as ‘notifiable’ incidents. A notifiable incident is any incident involving: • Death • Serious injury or illness that requires: - Immediate treatment as an in-patient at hospital - Immediate treatment for: - Amputation of a body part - Serious head injuries, for example skull fractures - Serious eye injuries, for example loss of an eye or vision - Serious burns that require intensive or critical care - Separation of skin from underlying tissue, such as de-gloving or scalping - Spinal injury - Loss of bodily function, for example loss of consciousness or senses - Serious lacerations – when muscle, tendon or nerve damage occurs. - Medical treatment within 48 hours of exposure to a substance. • A dangerous incident: - A substance or gas escaping, spilling or leaking in an uncontrolled manner - Electric shock - Any plant, substance or object falling or being released from height - Any plant that requires authorised use either collapsing, overturning, failing, malfunctioning or becoming damaged, for example cranes and concrete pumps - A structure collapsing or partially collapsing - An excavation or shoring supports collapsing or failing - Interruption of the main ventilation system in an underground excavation or tunnel or an inrush of water, mud or gas.

My employees want to work through lunch. Should I let them? Employees are entitled to an unpaid 30-minute meal break and a paid 10-minute rest period each day, under the Building and Construction General On-Site Award. You should instruct your employees to take their meal break and rest period each day, as it’s important to rest and refuel. Some employees may want to work through lunch so they can be paid for the time or leave work early. If an employee asks to work through meal breaks, you should ask them to put their request in writing. The request needs to be agreed by you and your employee for it to take effect, after you've considered any possible impacts to health and safety. Employees who work through meal breaks without approval aren’t entitled to be paid for the time, unless you've requested them to – in which case, a penalty of double time is payable until they take their break. Each Modern Award can differ in relation to breaks. It’s important you apply the right rule to the right employee, so ensure you check the relevant Modern Award.

I have a training contract in place with my apprentice. Do I also need to issue an employment contract? A training contract with a registered training organisation (RTO) might not cover off all aspects of an employment relationship, which is why it's important to also issue your apprentice an employment contract. The employment contract regulates the relationship between you and your employee. It should cover remuneration (including the relevant Modern Award and any allowances), hours of work, National Employment Standards and entitlements, company policies and fitness for work, among other things.

You must notify WHSQ immediately after becoming aware of the incident. If you’re a builder, ensure that your WHS Management Plan outlines how notifiable incidents are to be managed, including who should notify WHSQ. This will ensure everyone is on the same page in stressful situations. If you’re a subcontractor, either refer to the WHS Management Plan or talk to the principal contractor to find out who should notify WHSQ.

How do I waterproof external decks and balconies?

How can I protect myself under a contract?

Waterproof membranes to a deck or balcony must comply with the Building Code of Australia (BCA). The Australian standards AS 4654 Waterproofing membranes for external above-ground use – Part 1 & 2 are referenced in the BCA as the acceptable construction practice for external above ground membranes used on decks and balconies. The standards outline design and installation requirements for buildings and structures such as roofs, balconies, landscaped areas and planter boxes on all classes of buildings.

Follow these four steps to better protect yourself under a contract:

To use a membrane system that isn’t detailed in the standard will require the Building Certifiers approval before it can be installed. If you want to get skilled in internal and external waterproofing, read page 62 to find out about Master Builders Certificate III in Construction Waterproofing course.

What are the substrate and grade details for membranes? Membrane detailing must be correctly applied to external decks and balconies. You should ensure: • Substrate materials are compatable with the membrane system • Particleboard sheeting, tile and slate underlay isn’t used as a substrate • Substrates are resistant to moisture caused by condensation forming on the underside • Falls in finishes drain to a drainage outlet • Falls are in the substrate or are formed by a screed over the substrate • Falls are no flatter than 1 in 100.

Are there requirements for door and windows at membrane junctions? Doors and windows situated in external waterproofed areas should include a subsill flashing as part of the membrane system. It’s recommended that all openings include a set down or hob to provide a vertical surface of sufficient dimension on which to terminate the membrane. If circumstances don’t allow for inclusion of a set down or hob, for example for wheelchair access, form a gutter in the substrate immediately in front of the opening.

1. Find out who you’re contracting with Conduct a simple name search using a search engine such as Google. Sites like LinkedIn, Facebook or Twitter are also a good starting point. There are also free online searches available to find out whether the contracting party has been or is involved in any legal disputes. Searches are available through the websites for Queensland and Federal Courts, QCAT and QBCC, as well as the Building and Construction Industry Payments Act 2004 decision search tool on the QBCC website. If you’re contracting with a company, an ASIC search will also provide company information including any insolvency history. For more detailed search information, contact us to obtain a factsheet.

2. Request evidence of capacity to pay A number of Master Builders’ contracts contain notice provisions that require a contracting party to provide satisfactory evidence of their capacity to pay. You can issue the notice at any stage during the contractual process. Failure to comply may be considered a substantial breach and provide grounds to suspend or terminate the contract.

3. Use the security provision in the contract Some of Master Builders’ non-financed contracts (as well as cash contracts) contain security provisions requiring the non-financed funds to be paid into Master Builders Holding Account. If your contract doesn’t contain this provision, you can include it as a special condition.

4. Request a Director’s Guarantee When contracting with a company, you can request that the Director(s) provide a personal guarantee for payment in the event the company is unable to pay. A Director’s Guarantee form is available through Master Builders’ eDocs system. Using the form is a simple yet effective way of improving securing for payment.

Bullying is not on Late last year, Master Builders received a brief but angry email from the mother of a young apprentice carpenter who was experiencing difficulties at work. The mother was clearly distraught and wanted to protect her son from what she termed ‘the vicious horror of workplace bullying’.

“I’M ASHAMED OF THE BULLYING MY SON HAS BEEN EXPOSED TO AS A HARD-WORKING, CONSCIENTIOUS YOUNG MAN,” wrote the concerned mother.

Although rare, it’s still very disturbing to hear that this kind of behaviour occurs in our industry. Workers in the building and construction sector are entitled to the same fair and reasonable working conditions expected in other industries and occupations.

There are no excuses Master Builders is totally opposed to bullying and harassment in the workplace. It’s unlawful and there is simply no excuse for it. Workplace bullying is unacceptable in any context – regardless of the industry, the business, the location or the personal views of workers. As such, our advice to the mother was that her son can seek remedies for the alleged bad treatment. Often the defence in such a case will argue that the incident was taken out of context – relying on the proposition that intimidating or offensive language is just ‘part of the culture’. Its underpinning message is that people shouldn’t take offence as that behaviour is normal. This is just plain wrong, as it’s not normal to harass a person. The building and construction industry needs the support of young men and women and their parents to stamp out this kind of behaviour.

Apprentice wage transition

The Federal Court recently ruled that special laws requested by the Queensland Government in 2009 to preserve State Awards for certain Queensland apprentices, expired on 31 December 2013. These ‘preserved’ State Awards only applied to apprentices engaged by Queensland businesses incorporated prior to 27 March 2006. The wage rates in the State Awards were less than Modern Award wage rates.

The Federal Court ruling ended speculation around a Fair Work Commission decision in late 2016 that the preserved arrangement had expired on 31 December 2013. Up until that decision was made, the Queensland Government and the Fair Work Ombudsman believed the preserved State Awards had not 'sunsetted' and were still in force. This means Modern Award rates, not State Award rates, must be paid from 1 january 2014 to apprentices engaged by those incorporated employers. If your business falls into that category, you may be required to make back pay.

Will you be prosecuted? The Fair Work Ombudsman has accepted responsibility for the error and concedes that it had published the incorrect wage rates up to 12 August 2016. Master Builders also relied on that information when giving advice to members. The Fair Work Ombudsman also advised Master Builders that it won’t prosecute employers or enforce back pay for any shortfall in wages paid prior to 7 February 2017 (the date of the first appeal). The Federal Court decision isn’t an Order binding employers to make back pay.

Be aware that you may also receive claims from past apprentices, via either the Fair Work Ombudsman or a representing solicitor or union. Getting your head around new legislation

New BIF legislation that has, or will, come into effect spells big changes for how businesses will operate. This includes changes to the Building Industry Fairness (Security of Payment) Act. Throughout December and January, we held a number of workshops designed to keep you in the know about what the changes will mean for you. Our aim was to give practical insight into how the law actually works, not just what the legislation says.

The changes Building Industry Fairness (Security of Payment) Act This new Act aims to improve security of payment for subcontractors by changing how the Queensland Building & Construction Commission operates and introducing project bank accounts (PBAs). The Minister claims these reforms will reduce disputes and payment delays, and that the cost of construction will reduce as subcontractors will no longer embed additional costs into their contracts to offset bad debts and the impacts of delayed payment. We don’t believe this will happen. We feel that construction costs will actually increase (by around 3 per cent) due to the cost of administering PBAs and the additional time to deal with disputes.

Project Bank Accounts The Building Industry Fairness (Security of Payment) Act introduced a system of project bank accounts (PBAs) from 1 January 2018 that apply to state government building projects valued between $1 million and $10 million. This will be expanded from January 2019 to cover all private non-residential, local and state government projects over $1 million. Single house and duplex projects are excluded, regardless of their value. However, residential projects on the same or adjacent sites with a combined contract value of at least $1 million and at least three or more dwellings will require PBAs.

We don’t believe PBAs will protect payment for subcontractors, mainly because the head contractor will continue to control the money coming out of the PBA, and subcontractors will still need to take action to recover amounts they claim they’re entitled to.

The contractor will be required to advise subcontractors how much is proposed to be released and on what date it’s to be released, at least 10 business days before the defects liability period ends. This won’t apply to the head contract.

BCIPA Adjudication process

Disciplinary action may be taken if the licensee fails to release retention monies.

Although the BCIPA adjudication process will essentially remain the same, there are a few significant changes to timeframes and procedures. The changes relate to the definition of a payment claim, the consequences of not issuing a payment schedule, and the adjudication process. There’s a requirement for a payment schedule to be issued even if the respondent intends to pay the claimed amount in full by the payment due date. This makes no sense as the claimant hasn’t suffered any loss, but yet the respondent is put to a considerable amount of additional work. This is a significant issue given it’s an offence and grounds for disciplinary action.

Contracts There will be a new penalty (up to $45,000) if a party to a contract causes financial loss by deliberately failing to comply with a contract. It will be a requirement that contracts contain mandatory provisions, and there will also be prohibited provisions. At this stage, we have no indication what the provisions will be.

Unlicensed or unlawful building work There will be a big hike in fines for unlicensed building, including up to one year imprisonment for a third offence.

Subcontractor’s charges Directions to rectify There has been no substantial change to the subcontractor’s charges process. Subcontractors will still be required to take action to recover amounts they claim they’re entitled to.

Consumers won’t be able to request the QBCC to give a direction to rectify unless they make the request within 12 months of the consumer becoming aware of defective or incomplete work.

Retentions

The timeframe for the QBCC to issue a direction to rectify will be extended from six years and three months to six years and six months.

New changes automatically require the contracting party to release retentions when required to do so under the contract or, if the contract doesn’t provide for it, at the end of the 12-month statutory defects liability period. The penalty for not releasing retentions will be up to $25,000 or one year imprisonment. There will be an exception in cases where there’s a dispute between the parties to a contract.

There will be a new provision to allow for an extension of time to comply with a direction to rectify, and it won’t be a reviewable decision.

Phoenixing The Act extends the QBCC’s powers to clamp down on ‘shadow directors’ and corporate ‘phoenixing’. The definition of an influential person is broadened to cover shadow directors and individuals who are influential in a company’s business or financial standing.

Minimum financial requirements While the Bill doesn’t change the minimum financial requirements, annual reporting is expected to be re-introduced in the regulations (which are yet to be released). The QBCC also has increased powers of investigation.

We’ve got your back Over the past couple of years, Master Builders has been campaigning proposed legislation that we considered would result in disaster for the industry. This includes project bank accounts, the requirement for payment schedules, and the proposal to issue demerit points to contractors who are issued a direction to rectify by the QBCC.

Project Bank Accounts A review of project bank accounts and other reforms will be carried out at the end of September 2018, led by an independent panel with industry experience and expertise. Demerit points Contractors won’t be issued with demerit points when the QBCC issues a direction to rectify. Payment schedules We’re still unsatisfied about the requirement for payment schedules. Master Builders had previously agreed with the Minister that the requirement to issue payment schedules would only be triggered when a claim isn’t paid in full and on time. This doesn't impinge on a subcontractors, builders or suppliers right to get paid, but it does mean that those who are doing the right thing won't get caught up in a completely unnecessary and costly administrative nightmare. We’re still concerned about what’s required and will continue to work with the government to achieve a sensible outcome.

We made some headway as a result of our campaign efforts, and achieved some significant wins for our industry, with the government agreeing to a number of changes.

Welcome Greg Byrne With more than 18 years’ experience in building and property development, Master Builders’ new Display Village Manager, Greg Byrne certainly brings a wealth of knowledge and expertise to the fore. Holding senior positions with Pindan, LandCorp, Metricon and Cape Bouvard Developments to name a few, Greg’s reputation for building effective relationships and collaborative networks precedes him. As does his ability to drive strong revenue growth.

Greg’s role as Builder Liasion Manager with LandCorp – the WA Government’s land agency – involved managing key relationships, coordinating regional display villages and providing consultative advice to local project managers. He also worked with many WA-based Master Builders’ members.

Greg’s understanding of the nuances of building practices and materials in hot climates certainly bodes well for his new role. He has clocked up serious career mileage working across the north-eastern states of Australia – from the scorching terrain of the Pilbara and the Kimberlies, to the far reaches of the Northern Territory, as well as parts of tropical Queensland.

More recently, Greg did a stint with Lendlease, working as the Regional Sales Manager. His portfolio included managing 12 retirement villages, comprising approximately 400 homes – adding scale of service as another feather in his cap.

Greg’s passion for the industry has largely been influenced by what he terms, being a ‘serial renovator’.

“A lot of people need to touch and feel in order to visualise what their new home could look like. Project homes are tactile, so they’ll always have a place.”

“I enjoy talking to a diversity of people – from project managers through to builders and developers, as I’m always eager to learn how other people are doing things. Even when I’m visiting friends, our conversation often turns to how we could improve this or that (in their home)... It’s quite comical really but I guess it’s just in my blood,” explained Greg.

We asked Greg what role he sees project homes playing now and into the future.

Originally hailing from Perth, Greg is a Fremantle Dockers supporter. He was also affiliated with another local AFLclub, East Perth, for over a decade, volunteering as a trainer, welfare manager and director. “My association with the club was personally rewarding, so I hope I’ve been able to give something back. I made a lot of friends there and thoroughly enjoy the legendary sport.” So how does Greg feel about leading the charge for Master Builders’ display villages in 2018?

Changing lives Ngoonbi Community Services Indigenous Corporation (Ngoonbi CSIC) received the inaugural 2017 Far North Queensland Diversity award. This special accolade recognises the exemplary not-for-profit organisation that has made great strides in creating job opportunities for local Indigenous people. In 2015, Ngoonbi CSIC diversified its operations and established a Ngoonbi Construction division, committed to delivering community facilities. Rather than outsource construction of the facilities as done previously, a new model was introduced to keep the work in-house. The traditional model involved engaging external building contractors, but it soon became evident that very few local Indigenous people would get the work. But, the new model, meant that local Aboriginal and Torres Strait Islander people could be directly employed by Ngoonbi CSIC and given training to improve their future career prospects and support their personal growth. Ngoonbi CSIC's funding body, the Department of Housing and Public Works, also fully supported the new model of delivery.

Here are some of the team from Ngoonbi CSIC enjoying Master Builders' hospitality at the Queensland Housing & Construction Awards, which was held at Brisbane City Hall in September last year .

The initiative involved employing a construction manager with a builders’ licence, a carpenter (trade supervisor), and four Indigenous trainees who would secure trade qualifications by completing their Certificate III in Carpentry. Three of the trainees, who were hired through a 'Work For the Dole' program, are this year completing their last year of accredited training, while the fourth trainee began the second year of his apprenticeship at the start of this year. Each employee will also be given

support to complete additional courses in construction, thanks to Construction Skills Queensland (CSQ) funding opportunities. Ngoonbi CSIC is already exceeding its diversity targets and has left a proud legacy of buildings for the local community. Employing between 90 and 110 people, approximately 90 per cent of Ngoonbi CSIC’s workforce are of Indigenous origin. Feedback from the employees, aboriginal elders and the wider community has been extremely positive.

My business, Minor Constructions, has been operating for two years now.

It’s often difficult staying on top of all the paperwork required to run a small business. The need to comply with codes and regulations, standards and supplier requirements also adds to the load.

You need to be passionate about your work.

When did you start working in the industry and how did you get into it? I was 15 when I began doing work experience in the industry through a school program. After that, I landed myself a school-based apprenticeship with a local builder.

What has been one of your most rewarding jobs? Undertaking a full house renovation on an early 1960s house, which involved stripping the home back to the bare frame inside and out, then redesigning it to make it more modern.

Have you participated in any training with Master Builders? I recently completed my Cert IV in Building & Construction.

What’s the best business advice you’ve been given? Have a good attitude, set business goals to aim for in the future, and love what you do.

What do you like most about being a Master Builders member? The staff at Master Builders are always extremely helpful.

This rocks! Each year we unearth phenomenal talent through our Housing & Construction Awards program. From remarkable homes to iconic commercial constructions, the entries we receive from members never cease to impress. But it was a project of a different kind that caught our eye last year. The Currimundi Climbing Wall and Caving System at Currimundi Recreation Centre on the Sunshine Coast is a distinctly unique project. It’s the first facility of its kind in Australia, and reportedly the longest artificial cave system in the Southern Hemisphere (at the time of construction). There were also lots of logistical challenges to overcome and stringent compliance requirements to meet in order to make the project happen. MultiSpan Australia won a tender issued by the Department of National Parks, Sport and Racing to build the $1.1 million facility, which took out top honours in the 2017 Sunshine Coast Housing & Construction Awards in the sporting facility category. MultiSpan partnered with Bulgarian company, Walltopia who constructed and installed the wall and caving system into an existing hall at the recreation centre. Parts of the original hall needed to be demolished so that structural modifications could be made to accommodate its installation. 38 | Master Builder

“The entire cave system was cast in Bulgaria then transported to Australia in around 750 separate components. When it was erected here on-site, it didn’t fit together quite as easily as when it was tested in Bulgaria. So, Walltopia’s Head of Fabrication from Europe was flown to Queensland to troubleshoot the issues. We predicted this could happen, given the intricacies and complexities of the design,” said Zac Morgan, MultiSpan Australia’s Project Manager. Engineering input from MultiSpan’s designers and engineers was imperative to ensure the wall and cave system complied with Australian engineering requirements.

“There was no Australian standard for an artificial cave of this type as it was the first one ever installed here.”


MEMBERS CORNER “There was no Australian Standard, so our team had to thoroughly review each structural component and painstakingly cross-check it against whatever relatable legislation we could find.” Opened to the public in May 2016, the artificial climbing wall and caving system spans 150 metres and two floors, with various levels of difficulty to cater for different user groups. The climbing wall has a natural rock face featuring a 'crack' climbing route installed with LED lighting and a 3D face equipped with 12 individual auto-belayed climbs. Entrances into the tunnel lead in from ‘briefing’ chambers, which feature a realistic Rocktopia finish. Stalagtittes and Stalagmites adorn alcoves of the cave, while cave sounds echo throughout to add authenticity to the man-made structure. Innovative ball pit rest areas offer respite for visitors needing to take a breather while using the cave. Working to a tight timeline, a crew of seven installers from Walltopia installed the cave system within a critical two-month period. Simultaneous to the cave being installed, an artificial climbing wall was constructed in an adjoining room.

The project was fraught with strict compliance requirements to meet various laws and regulations related to public safety, including very involved Queensland Fire and Emergency Services (QFES) requirements. For example, dedicated emergency exits needed to be installed every eight metres within the cave, and the cave needed to be mechanically ventilated with a smoke exhaust system. “The cave system is made out of an FRP material, which is highly flammable. So there were some obvious concerns about entrapment and escape from the cave in the case of a fire. We engaged the services of Red Fire Engineers to put together a fire engineering brief to present to the QFES.” Following go-ahead from QFES to progress to the reporting stage, a fire engineering report was prepared. At final inspection, QFES were satisfied with the placement of fire detection alarms, smoke extraction devices, additional fire hose reels and a demonstrated means of escape for removing an unconscious person through the cave. This meant the project was officially approved, giving the green light to this unique project that truly rocks.

Building Cambodia Social Initiative Cambodian-born, Master Builders’ member Marisa Berquin-Oum from iDesign2build on Queensland’s Sunshine Coast is no stranger to the realities of daily life in Cambodia. Despite being a vibrant and emerging economy, with a population of 15 million, poverty is rife in the country – about 70 per cent of people live on less than $3 a day.

There are very few trade-qualified builders in Cambodia, and unskilled workers receive low wages of around $5 a day for 10 hours work. Workers often live on-site with their large families in unsanitary conditions, and there’s a disconcerting lack of safety on construction sites. Inequality in working and living standards, and non-existent job security – particularly in rural areas – is forcing many Cambodians out of their local villages in search of better paid work. Marisa has rallied together a team of local Cambodian and international professionals to implement a social initiative to help change this. Building Cambodia aims to have a life-changing impact on families and the wider community in her homeland, and result in a better quality of life for them. Offering expertise in construction, architecture, legal affairs, business management, and tourism, Marisa’s team will build affordable homes for disadvantaged Cambodians and teach them sustainable trade-skills to help improve their job prospects. “Ever since the birth of my son, which coincided with a trip my young family took to circumnavigate the globe – including a return to visit Cambodia – I’ve made it my mission to help tackle the poverty problem over there. Essentially, I want to empower the community 40 | Master Builder

to take control of their future. We’re doing this by providing training and employment pathways that enable them to become more self-sufficient and secure higher incomes,” says Marisa. The Building Cambodia Social Initiative is being implemented by a not-for-profit organisation, Build-Up Construction Skills Cambodia (BUCSC), and a social enterprise, Cambodia Affordable Homes (CAH).

Build-Up Construction Skills Cambodia

BUCSC is a non-for-profit organisation providing basic homes for local villagers living in poverty. The community contributes land that the homes can be built on, and the villagers are involved in building their own house – learning construction skills and gaining qualifications to an international standard, which makes them more employable. “Every $5,000 donation we receive will enable us to build a new home for a family. Our goal is to give away 10 homes per year valued at $5,000 each. The construction sites will also be used for on-site practical learning for our trade students. Qualified senior volunteers will teach local student-teachers how to deliver construction training. After 36 months of training, it’s

anticipated there will be more than 100 graduate student-teachers at Certificate 2 level, who will in turn teach a minimum of eight new students each. “We’ll also do what we can to create more opportunities for graduating apprentices seeking work with local construction companies.”

Cambodia Affordable Homes

Our social enterprise was set-up to help address the shortage of affordable housing and sustainable employment for Cambodians. Homes built through CAH are architecturally inspired by traditional Khmer designs that compliment the cityscape and climate. Dwellings are designed to reduce energy consumption and are constructed with modular components to enable the flexibility of expansion. The dimensions of the modular components are built to an international standard to keep construction labour and materials costs as low as possible. “Within the first three years, we’re aiming to provide 30 homes of approximately 80m² (US$29,900, plus land cost) and 30 homes of 120m² (US$34,900, plus land cost) in the rural countryside, as well as 10 three-storey apartment buildings featuring three units each (US$34,900) in wide suburban areas.”

Winning tips Entering the Housing & Construction Awards might seem daunting, but it’s quite simple if you follow these tips.

Include a detailed description Provide a detailed description of your house or project. Be sure to address the relevant judging criteria, highlight any special features that may be unique to your entry, and include any marketing brochures that are available. If you’re a winner, we’ll use this information at the Awards ceremony, so ensure it tells the right story.

Supply professional photography You must supply photos with your entry for it to be valid. Photos help our judges to pick winners and we use the photos to promote your win in the media and various publications. We recommend hiring a professional photographer to take a variety of photos, for example: • External shots – front entry, landscaping and outdoor areas like pools, patios and decks

• Internal shots – kitchens, bathrooms, bedrooms, living areas, media rooms, etc. • Feature shots – any main features, such as balustrades and timber or steel work. Photos must be a minimum size of 210 x 140mm at 300dpi (2480 x 1654px).

Get the OK Before submitting your entry, ensure you obtain permission from the project or house owner, client or contractor. They’ll need to sign the owner authorisation section of the entry form in order for your entry to be valid.

The name displayed on the award will be the licensee name and, if applicable, one recorded trading name (per the QBCC public register). If you have more than one recorded trading name, we’ll contact you for clarification.

Designed for creating raised floors in external applications, such as balconies, terraces and green roofs, Buzon’s Award Winning Pedestal system can be used with any type of concrete or stone paver, timber decking of all types and metal or fibreglass grid systems. A key benefit of this innovation is the patented slope correction device. This gives up to five percent fall compensation achieving a perfectly level floor finish, simultaneously allowing for positive water runoff at structural slab level.

Using the Buzon Pedestal replaces the use of sand and cement when laying pavers, therefore eliminating efflorescence and algae and reducing weight-bearing loads on the building structure. In addition the pedestal also improves thermal insulation and reduces sounds transmission.

For even more design flexibility, the system offers height adjustment from 17mm to 1070mm, millimetre by millimetre if required. This allows for unsightly services to be concealed under the floor while still offering access for maintenance of the waterproofing membrane and drainage systems.

In commercial urban environments where space is at an ever-higher premium, a building’s roof level is potentially a rich source of usable space. Buzon say their Pedestal System can be used to maximise a roof’s potential, both hiding all manner of services and protecting roof substrates from the elements, maximising integrity and longevity.

The pedestals are extremely strong as they are precision-engineered from high strength, UV resistant, recycled polypropylene and capable of supporting loads of more than 1000kg each. At roof level, this load is evenly spread by the wide base area of each unit, making them ideal for installation on any waterproofing membrane without causing damage, they can even be used directly over insulation material. The Buzon Pedestal System is also simple to install. Desired height is achieved by thread adjustment, which is lockable when reached and a range of interchangeable spacer tabs of 2mm, 3mm, 4.5mm, 6mm, 8mm and 10mm, allow for precise gaps between pavers and provide positive drainage without any concern of ponding or flooding.
