Stepping up the fight WITH INTRODUCTION OF THE NATIONAL CONSTRUCTION CODE 2022 JUST AROUND THE CORNER AND SERIOUS QUESTIONS AND CONCERNS ABOUT THE INTRODUCTION OF ACCESSIBLE HOUSING MEASURES AND CHANGES TO ENERGY EFFICIENCY, WE’VE AMPED UP OUR LOBBYING CAMPAIGN TARGETING THE QUEENSLAND GOVERNMENT. Phase 2 of our campaign builds on the success of the phase 1 ‘Measure twice. Cut once’ campaign that ran during November and December 2021. The campaign voiced the major concerns we have with the proposed changes to the National Construction Code 2022 (NCC 2022). This first phase yielded results, with doors

opened and conversations started with the Queensland Government – but there is still more to be done. While the government is now listening and started to engage with us on this topic, the next step is for them to take urgent action. Before the horse bolts, we need them to fully measure the impact of the proposed changes and address our concerns head on. Our phase 2 campaign, which will be running as this edition of Master Builder hits letterboxes, is our attempt to finally get our questions answered and the changes the industry needs in writing. We’re calling for a level-headed approach on what will be a topic that rocks the industry if

it goes ahead without these changes. We acknowledge the future provisions are needed to provide sustainable homes for the elderly and people with disabilities, but the benefits won’t be realised if they aren’t introduced properly. And these benefits shouldn’t come at a cost to builders, homeowners or housing affordability. We’ve asked the Queensland Government to give serious consideration to how they intend to address the many technical problems we and the industry have raised, as well as addressing the costs these changes will mean for builders and homeowners and the appropriate transition time that is necessary to make this work. Is industry ready for project trust accounts? AS THE GOVERNMENT CONTINUES ITS ROLLOUT OF PROJECT TRUST ACCOUNTS TO THE PRIVATE SECTOR, WE’RE CONTINUING OUR WORK TO LOBBY FOR LONGER TRANSITION PERIODS AND SUPPORT, TO ENSURE THE INDUSTRY IS READY. The steam train that is project trust accounts continues to roll on despite our best efforts, but there is no doubt that industry readiness has been hampered by the unexpected financial and business challenges arising from the COVID-19 pandemic and recovery. Back in November 2021 we addressed these issues with the Minister for Public Works and Procurement, Hon Mick de Brenni. We highlighted significant challenges faced by the industry that have impacted their readiness for this roll-out. These challenges

included the trade and material shortages and associated delays to work; persistent and unpredictable price rises and the inability for contractors to counter this contractually; and increased financial strain due to the inability to absorb increasing costs associated with project trust accounts (including software and technology costs). We’ve asked that, given the lack of availability and affordability of compliant digital accounting software (an issue that is particularly relevant to smaller builders in the market) that any further rollout be delayed for 12 months. The department should also focus on whether smaller builders have sufficient time obtain and implement these IT systems prior to the commencement of the upcoming reform phases.

Earlier this year, the minister acknowledged our concerns and that sector of the industry’s reduced ability to react given all they have faced in the last two years. We’re aware the DEPW is considering the timing of the commencement of the next phases that affect smaller business in the industry for $3 million contracts (currently slated for 1 July 2022) and $1 million contracts (currently slated for 1 January 2023). They have also confirmed the department will continue to consult with Master Builders. It is critical that when making any decisions, the department consider these challenges, including the time it will take for the building and construction industry to economically recover. We’re hopeful our efforts will result in a 12-month delay across the board. GRANT GALVIN, CEO

Murky waters ahead THE 2022 OUTLOOK FOR THE BUILDING INDUSTRY, WHILE OPTIMISTIC, INCLUDES SOME INTERESTING AND CHALLENGING TIMES BEFORE WE SEE THE TIDE TURN. Our recently released report on one hand, shows demand is still strong for building and buying new homes, on the back of a still booming property market. The most recent lending data (December 2021) is above pre-pandemic levels but is down on where we were this time last year. But while owner occupier loans for new construction fell, borrowing by owner-occupiers for renovations surged ahead, along with borrowing by investors for new homes and residential land. Dwelling approvals also dropped in December but are almost one-third above where we were this time last year, putting us at just under 44,000 dwelling approvals for Queensland for the year. All in all, these figures bode well for 2022. We are predicting 38,000 new homes

commencing across Queensland – an almost 20 per cent increase on the 32,000 commenced in 2019 (pre-pandemic). This is 10 per cent less than the 43,000 dwellings commenced in 2021 – but it’s important to recognise that these numbers occurred during the peak time following the introduction of the HomeBuilder grant – which provided incredible stimulus to a struggling industry. Despite the positive outlook, it’s important to acknowledge that builders face enormous and unprecedented challenges in delivering these new homes to our communities. The ongoing price hikes and trade and material delays are a serious thorn in the industry’s side, and we expect the issue to run right through 2022. There’s also the problem facing all Queensland businesses from the current wave of COVID-19, with quarantine requirements for close contacts hitting building businesses hard – which is certain to further exacerbate cost increases and delays.

Along with the HIA, Master Plumbers, Property Council & ACMA we’ve called on the Queensland Government to provide critical industry status in certain situations by expanding isolation exemptions for critical construction workers who are close contacts. If granted, this will go some way to helping building businesses navigate these tricky waters. All in all, we are gravely concerned about what will happen in the first half of 2022. Unfortunately, as 2021 came to a close, the impact of price hikes and delays were highlighted, as several building businesses failed financially as a result. The reality is, our industry hangs in the balance and any further delays will create more disruption and impact an industry already struggling. There are few solutions in sight, but we are embracing any opportunity to provide the industry with relief and support that comes our way. PAUL BIDWELL, DEPUTY CEO

What we’re predicting for OUR INDUSTRY HAS WEATHERED TWO TURBULENT YEARS THROUGH THE COVID-19 PANDEMIC.

Lockdowns and border closures had us staring at a cliff as all new construction work came to a halt. Then there was a sharp turn in demand for residential work off the back of government stimulus and shifting consumer demand. Nonresidential work did not receive the same support and continued to struggle though a lack of investor confidence. The surge in demand for residential work was mirrored not only around Australia but around the world and has led to soaring prices and lengthy delays for construction products and trades. Now in the latest twist, the industry is struggling additional delays and price hikes brought on by the spread of the Omicron variant. In 2022, demand will fall back but remains strong with no end in sight to the challenging environment in which they will need to be delivered. But it is not all doom and gloom. TOTAL BUILDING FORECAST Total builds are expected to bounce back again in 2023 when overseas migration

has returned once again pushing forward demand. This will keep approvals at an 40,000 average, a level at which the market is performing well. This strong long-term demand bodes well for our industry if it can work through the supply side challenges for which there is no end in sight. We can expect the demand in the housing market to fall more sharply in the regions, while the Greater Brisbane area will continue to hold steady.

North Queensland North Queensland experienced an 82 per cent increase in building approvals for single dwellings and 19 per cent increase for multiunits to October 2021. This combined with a strong renovation market saw skilled and unskilled labour in short supply. The rising price and supply chain difficulties for building materials have added pressure to the construction industry. In terms of the residential building sector, we expect it to remain busy throughout 2022 with some new commercial and civil infrastructure projects coming on board in the North. In brighter news, Queensland won the inter-state migration race, and we are expecting a record number of new residents moving to North Queensland from southern states. The tight rental vacancy rate has already started to soften, and our borders are now open allowing those who invested in the Townsville property market to make the journey North. With a relaxed, friendly atmosphere and affordable housing (compared to metro areas), North Queensland really has everything to offer a city slicker looking to re-locate to sunnier climes. A stone’s throw from the Great Barrier Reef and yet under twohours’ drive from the Outback; our small but perfectly formed city is a great place to live. As a Townsville resident who moved from Sydney in 2012, I love the easy going, tropical lifestyle on offer. I hope our new friends from down south embrace us to work together to make this city the very best it can be. he state government is looking to make major changes to the National Construction Code to raise the bar on energy efficiency and to include accessible housing provisions for new houses and units.

A step towards renewable gas AUSTRALIAN GAS NETWORKS IS CHANGING GAS, FOR GOOD As a provider of reliable energy that Australians need and value, Australian Gas Networks is taking active steps towards sustainable gas delivery now, and for the future. While natural gas is already cleaner than grid electricity, the energy provider is working to deliver an even cleaner new gas that can be used just like natural gas, but with zero additional emissions: renewable gas. The renewable gas is created by separating hydrogen from water using renewable electricity such as solar and wind, to create a gas that can be delivered to homes and

businesses through the existing network. This provides customers with all the benefits of natural gas, but with zero emissions.

Recycled slabs cement smart solutions A

ustralian-owned and operated construction company, Neumann Steel, has introduced an innovative and responsible method of creating concrete slabs. The NuPod, is a ground-breaking method of creating concrete slabs while still complying with Australian standards. General Manager, Kathy Bartley said NuPod is produced from 100 per cent recycled plastic and an environmentally friendly alternative to the current industry standard (polystyrene). “We are proud to take this step in the right direction and create a new product that will ultimately help cultivate a greener industry and move towards a circular economy,” she said. Both innovative and new technology in the building space, NuPod incorporates a stable and locked system that keeps its form while concrete is being placed. new initiative is encouraging Defence Force veterans to bring their soughtafter skills to the building and construction industry, carving out a new career path after their dedicated service to our nation. Master Builders, in collaboration with TAFE and Construction Skills Queensland (CSQ), hosted a morning tea for Defence personnel at the newly opened Oasis Centre in Townsville in November to launch the initiative. The Oasis Centre is a newly constructed facility designed to support Veterans. Its mission is to provide a 'single front door' for all members of the ex-ADF community in Townsville, including families, as well as current ADF members who have begun the transition journey - to transition, connect and integrate into the Townsville Community.

Townsville is a proud garrison city, with both the Australian Army and Royal Australian Air Force based there, and over 15,000 personnel calling Townsville home - equating to 8 per cent of the city’s population. Master Builders North Queensland Regional Manager Emma Peters has been working with TAFE and CSQ to inform personnel who may be considering transitioning out of Defence about career opportunities in the construction industry. “The unemployment rate in Townsville is extremely low, and many members are struggling to recruit both skilled and unskilled labour,” Emma said. “Defence personnel have some key transferrable skills which make them ideal candidates to come across to construction. “They are familiar with working in hostile environments and understand the

he “perfect storm” that’s created unprecedented demand and the current materials shortage has been well-documented – but the question on everyone’s lips in the building and construction industry is, when will it end?

to transport materials isn’t going to get back to anything near ‘normal’ until 2023. The cost of transporting a container has increased from roughly $1100, to around $10,000, making it difficult for many suppliers, and driving up the price for consumers.

Around 20 per cent of Australia’s construction timber is imported from Canada and other nations, and it’s hoped the arrival of winter in the Northern Hemisphere might help ease demand from markets like the United States and Europe. Queensland’s local timber industry typically supplies around 70 per cent of demand.

Amid the crisis, the Queensland timber industry has been investing in plant capital and extra shifts to keep the mills running at high capacity.

The price of wholesale timber has risen on average by between 26 per cent to 34 per cent over the last 12 months, while steel has gone up depending on whether it’s framing or roofing, by 25 to 40 per cent, and around 100 per cent when it comes to structural steel beams. Fortunately, our local industry isn’t seeing anywhere near the increases overseas, with the US alone grappling with high volatility with price increases over 250 per cent before spectacularly falling in June 2021 and now rising again.

Timber Queensland CEO, Mick Stephens said on the back of the increased production over the past year, he expected to see an increase in timber output in early to mid-2022, because of continuing investment in capacity. “Overall, we anticipate the pent-up demand to overshoot available supply by up to 20 per cent for the foreseeable future. “This would normally be filled by imports, which translates to the longer lead times for supply that are now built into current market expectations,” he said. Mick said there was hope to build greater long term capacity for more timber resources in the future. Timber Queensland is leading the push for more forest plantations and private native forests to re-enter the market to bolster supply. Their harvest can prove a financial boost for the farmers who manage them, along with the benefits to the environment – but the industry group says the state’s current vegetation management laws is creating uncertainty for landholders to invest in native forests.

The owner had not told the member the ute had arrived so he decided he would demand the costs of the variations instead. Turns out he revealed the ute had arrived, so they ended up agreeing to a time to hand over and move on.

TRADIE profile WHO OR WHAT INSPIRED YOU TO GET INTO THE BUILDING & CONSTRUCTION INDUSTRY? It was actually by chance, I was working on boats at the time and a friend had a shade sail business based in Cairns and occasionally needed some help. After a jump in both sales and my newly discovered interest in shade sails, we then decided to step it up and start an operation in Townsville.

TELL US ABOUT YOUR CURRENT ROLE – AND WHAT YOU LOVE MOST ABOUT IT. As the owner of my business, I am running the day to day operations of the business, but happily I get to still be involved in the design and installation process too. Seeing the project evolve from a design to a completed product with a happy customer is what I enjoy the most.

WHAT WAS YOUR FIRST JOB – AND A MEMORABLE MOMENT FROM THOSE EARLY DAYS? I think my first paid job was folding and delivering pamphlets. My memory from that job, whilst not a good one, was spending hours and hours folding the pamphlets, then I had to deliver them all.

WHERE DO YOU SEE YOURSELF IN FIVE YEARS’ TIME? Since I enjoy designing shade solutions, I think I will still be at work, however, I like to think that I can take a step back and watch the business grow with the team.

WHAT PROJECT ARE YOU MOST PROUD OF? We have completed some really cool projects over the years and its hard to pick one that I am most proud of. The really big complex ones are satisfying but so too are the simple jobs like providing shade solutions for school playground areas.

WHAT’S THE TOUGHEST LESSON YOU’VE LEARNED, OR BIGGEST CHALLENGE YOU’VE OVERCOME? I think the challenges that I have overcome centre around how the business has evolved and changed over the years. Growing the business whilst still offering a personalised service to my customers is tough but also rewarding.

ESIX Watpac helps boost CQ tourism with award-winning Qantas museum project.

In the heart of Central West Queensland, a Boeing 747 and a stunning, rippled roof provide the canvas as the history of Australia’s airline is played out through an immersive light and sound experience that can only be described as extraordinary. This spectacle is the result of the work of the team at BESIX Watpac, with the Qantas Founders Museum Airpark Project at Longreach honoured as Project of the Year and winning the Tourism and Leisure Facilities over $10 million category at the 2021 Central 32 | Master Builder

Queensland Housing & Construction Awards.

The museum tells the story of Qantas, from its beginnings in outback Queensland through to present day. The new Airpark Enclosure and hi-tech Luminescent Longreach experience were a long-held dream of the Qantas Foundation Memorial Ltd Trust, the custodian of the historic infrastructure, memorabilia and aircraft at the site. The project has created a new experience for the tourism industry in the region, as well as delivering additional economic and community benefits. Project Manager, BESIX Watpac Senior Contracts Administrator Mitch Wight, said

The Trust identified the need several years ago for a roof to protect the aircraft from the outback sun and reduce the need for regular expensive maintenance. “One of the things they were having issues with is that the planes themselves cost millions to repaint – the 747 in particular is really expensive due to its size” Mitch said. “The Muesum was able to secure funding from the Commonwealth government for the main roof structure, and then the Queensland government funded the light show element of the project. “They wanted to have a drawcard, so that when you’re flying or driving into Longreach, it’s the first thing you see.” The two-stage project saw BESIX Watpac construct the Noel Robinson-designed 8,072m² Airpark Roof, Viewing Deck and Biobox supporting services, including the backbone infrastructure for the light show. The Buchan Group completed the active data equipment, fit-off of the projectors and speakers, and the sound and images.

Watpac has a long and proud history with the museum, having constructed the original building with Noel Robinson Signature Architects, and were keen to be involved in the new project under the BESIX Watpac name. The regional location was a first for Mitch – but an experience he and the team revelled in. “Our site manager Dan Smith had his second child born in the Longreach Hospital, we sponsored the soccer team to get new storage for their sports equipment, things like that – it was a pleasure to be a part of the local community. “Where possible we tried to engage the local community to assist in completing the project. The concreters, steel fixers, and the plumber were locals, we had a sparky from Bowen, a roofer from Rockhampton, the glazing for the windows comes from Emerald. The project was supported from not just Longreach but also the surrounding communities” The construction – and the outback location

The project was supported from not just Longreach but also the surrounding communities – weren’t without their challenges for Mitch and the team to overcome. “Unfortunately for us, the museum has its ‘lull’ period over the summer, so we had to build it throughout the hottest season in Longreach – it was a minimum 35 degrees, and it would get up to around 40 degrees, so there was a bit of trouble with that,” Mitch said. “Our design manager, construction manager and I were heavily involved during the design phase and getting riggers and things like steel manufacturers on board early to try and use their smarts to keep it on budget.” Being an active airport site brought extra safety considerations into the mix around aircraft and the use of cranes. In addition the roof was built around the 747 and 707 planes

as they couldn’t be moved by the Museum. Ingenuity played a major role in the success of the project, with the ARAMAX-style, ripple profile roof rolled on site in 50-metre-long aluminium sheets with no purlins required, using the one mobile mill in Australia capable of producing the desired outcome. After COVID devastated the local tourism industry, as well as impacting Qantas’ 100year anniversary celebrations, Mitch said The Trust and the Longreach community were thrilled with the final result. “With the structure, I think they love the elegance of it – when you look up at it from the ground, it’s beautiful. It’s worth seeing the light show at night - it’s an immersive experience.” Master Builder | 33

MICHAEL ROMEO M

ichael Romeo’s closest friends describe him as easy to talk about. As they share their stories and memories of their time together, the one word that keeps coming up is “selfless.” It is for his generosity of spirit, passion for the building and construction industry, and life’s mission of paying it forward, that Michael will always be remembered with honour and respect by Master Builders, following his untimely passing from cancer at age 37. Best friend Michael Martin grew up with the man he affectionately calls “Romeo” in NSW. “I’ve known him for say 22 years – we were young footy heads, we lived together, and both ended up working with his stepdad,” Michael recalled. “He was an apprentice and by then I was a tradesman doing my builders’ licence. His frame of mind never changed; he just always had the same mentality. He was always happy… nothing was ever a drama with Romeo. “He was groomsman at my wedding, Godfather to my daughter – there wasn’t much that we didn’t share or do together.” After finishing his apprenticeship, Michael headed to London, where he built up a respected reputation in project management. Close friend and Ezy Projects Director, Sam Breneger, credited Michael with helping him when he arrived in the U.K to cut out his own path. “He was working as one of the head project managers for a building company over there, and typical Michael style, as soon as I landed, he had me a job, a toolbox and work belt ready to go,” Sam said. “So, we worked together there for a couple of years before I came home and started Ezy Projects, and Michael stayed on and married his wife Cristine.” When Michael and Cristine decided to settle in Brisbane, Sam repaid his friend’s kindness

MEMBERS CORNER and invited him to head up Ezy Projects’ expansion into Queensland, proving to be the solid foundation for a strong team. Michael Martin and Romeo were also reunited when he came back to Australia, living together for a few months and both once again working in the building industry. The passion Michael had shown as an apprentice continued to grow, with Sam describing his work ethic as “second to none.” “He used to get more upset about spending our money more than I would – that was his mentality. “Everyone knows Michael – he was so driven, organised…there were hundreds of contracts in Queensland. A lot of our friends who had gone and done their two-year stint in London worked alongside Romeo, and a lot of them are working for Ezy Projects now, because he built the team from the ground up.” Michael Martin said Romeo’s drive and commitment extended to his family life and beyond. “From the day he found out he was terminal, the focus was never on him, it was about paying his mortgage off and putting his wife Cristine and daughter Giulia into a better financial position than what they were – and helping others.

“HE’S THE PERSON YOU ASPIRE TO BE – AND I’M NOT JUST SAYING THAT AS A CLICHÉ – HE REALLY WAS A DIFFERENT HUMAN.” Sam also remembered Michael was focused on “making sure everything and everyone else was sweet,” even when he was so ill himself – inspiring him to write his book, Terminal

Velocity. Michael wrote the book with the aim of empowering others to take control of their finances, health and insurance, and dial down the stress and pressure of everyday life in the process. His vision for the book sums up his personality, resilience and how he thrived to help others through his cancer ordeal, through his “don’t make the same mistakes I did” attitude. With trade and materials shortages, delays and increasing costs placing a huge amount of pressure on builders, tradies and their clients, Michael’s friends agreed that his messages of empowerment and self-care are even more important and pertinent right now. “Romeo would say your most valuable asset is yourself – being able to work and to provide for your family, but we never look after ourselves or insure ourselves,” Michael Martin said. “Writing the book was never about him – it was sincerely to help others. “Like he said, if he can change the mindset of just one person, that’s a tumbleweed.” “There are a lot of different levels in that book, and the financial side of it is brilliant,” Sam said. “It does reflect what’s going on in the building industry at the moment. It is tough, it’s cutthroat…I’ve seen friends that are closing up and it’s horrible to watch.” As for Michael’s number one piece of advice to the industry he’s left such a legacy for, Michael Martin said it would be wholistically, taking better care of yourself. “It’s all about what he would say about your greatest asset being yourself – through

A few short minutes into a conversation with Liam Carey, it’s clear the Gold Coast carpentry apprentice has an older head on his shoulders.

“I didn’t want just a basic employer. I wanted someone who was really good at their job, knew what they were talking about, and would take the time to teach me. Until I found that, I wasn’t going to take just anyone,” Liam said.

It’s that maturity beyond his years, as well as his stellar work ethic and outstanding craftsmanship that saw Liam named Queensland’s Apprentice of the Year at the 2021 Housing & Construction Awards in November, after winning the Gold Coast crown earlier in the year. “I didn’t see it coming at all,” Liam said. “Just being nominated for the Gold Coast award I was blown away, I felt like all my hard work was paying off and people are recognising it. For Master Builders to even think of me being in the running for the Queensland award, that just blew my mind.” Liam’s passion for building and construction stemmed from his childhood when his Pop would regale him with stories of his own experiences in the industry. “At school, I didn’t enjoy being in a classroom and didn’t want to be in an office or anything like that – I wanted to build things,” he said. After starting his apprenticeship with another

I like to be challenged, and he challenges me every day,” Liam said. Liam holds a unique place within Kai Konstruct as fourth year who is also a leading hand for the younger apprentices. “Liam is always providing leadership and guidance, passing on the information and lessons from what he has learnt each day, and ensuring safety is maintained whatever the task,” Tim said. “A lot of the crew, even qualified carpenters and other sub-contractors, look up to Liam and hold a high amount of respect for him. I know for a fact being in the industry for over 15 years, that these qualities are rare and unique.”

Liam’s motivation is simple – he just loves what he does. That pushes me a lot,” he said. “My parents worked a lot, so I got my work ethic from them. I also like making people happy, it inspires me, so when I see a client smiling at the end of a build, that motivates me.” As for the future, Tim has already offered Liam a full-time role once he wraps up his apprenticeship. “I love working for Tim…he pushes me and makes me a better all-round person, both at and outside of work,” Liam said. “I really want to stay with him until I’ve learned everything I can from him, and I’ve grown into the person I’m meant to be. Eventually, I would love to open my own construction business, but I’ve still got a lot to learn before I do that.” Master Builder | 39

Queensland Builders, Take A Bow R

obert Sobyra, Research Director at Construction Skills Queensland, wraps up the state of play with construction apprenticeships – and delivers his 2022 forecast. When the pandemic broke-out in 2020, many observers (this one included) were very concerned about apprentices. There were forecasts of record low numbers of new apprentices commencing – as little as 1,200 per quarter in Queensland’s construction industry. Boy, did Queensland builders prove us wrong. A whopping 4,210 people started a construction apprenticeship in the December quarter of 2020. Another 4,384 were signed-up in the following quarter (see Graph). These numbers dwarf anything we have seen before. This is not just a Queensland story, but we are leading the trend nationally. And it is being spread uniformly across the state. From Coolangatta to the Cape, builders are signing-on record numbers of apprentices. You might be wondering if this has been offset by more non-completers leaking out of the system at the other end. Fortunately, there’s no evidence (so far) that this is happening. In fact, completion rates are above average at around 67%. It remains to be seen how long this boom will last. It’s been driven by a really tight labour market (thanks to the slowdown in migration), and a very strong market for house building (thanks to HomeBuilder). In addition, government subsidies have slashed the cost of hiring an apprentice by half. All of these factors will moderate through 2022. We expect the house building pipeline to be much thinner by the end of 2022, while migration (at least within Australia) will have resumed. The wage subsidies are due to be wound back in March 2022. But the bottom line is this: we have around 20% more apprentices in the system than before the pandemic. This pipeline of tradespeople will stand us in good stead as we work through the record levels of house building and approach the mountain of commercial activity that will follow. 44 | Master Builder

AM I ALLOWED TO COLLECT VACCINATION INFORMATION ABOUT MY EMPLOYEES?

WHAT ARE THE EARTHWORK REQUIREMENTS FOR A CLASS 1 AND 10 BUILDING?

As a rule, information about employees should only be collected where there is a valid business reason to do so. This is particularly the case where the information is health related or otherwise sensitive.

The Building Code of Australia (BCA) contains the provisions for earthworks that must be performed safely to avoid damage to structures and adjoining buildings from subsidence or the collapse of soil.

WHAT MAY BE A VALID REASON TO ASK YOUR EMPLOYEES IF THEY ARE VACCINATED AGAINST COVID?

Site cut and fill for unretained embankments can be built in accordance with the BCA slope ratios based upon normal site conditions and the soil classes rock, sand, or clay. A retaining wall must be provided for sites that exceed the BCA slope ratios.

If there is a requirement to make business decisions based on the information. For example, a company that provides maintenance services to schools or hospitality venues is required to only have the works done by a vaccinated person and so needs to have accurate information about the status of their employees. If you are collecting information about vaccination status you must have the informed consent of the employee. For that consent to be valid you must have informed your employee of the following: • What you will be using the information for (e.g., to comply with a public health order or for work safety). • The consequences of refusing to provide the information (e.g., a sacking offence or inability to assign certain work). • If the collection is required or authorised by law (i.e., is there a contractual condition, public health order, or is it part of the business’ COVID-safe plan under work health and safety laws?). • How the information will be used or disclosed (i.e., to assist the business in demonstrating to government authorities that it has complied with the requirements in a public health order or provided to clients on request where required by contract) • That employees may access or correct information and withdraw consent. General consent to hold health information under an employment or services contract may not be sufficient. There are limited situations where consent is not required. For example, where the information is required to be provided under legislation or a services contract, but employers should be wary about relying on these exceptions and should call the Workplace Relations team before deciding to do so.

Normal site conditions are when a site has not been changed due to removal of a previous building, moisture conditions due to climate changes, onsite drains, dams, or where large trees have been removed from the site. Advice should be sought from a registered professional engineer when site conditions are not normal so as a suitable design can be prepared to avoid problems during the build program. HOW MUCH COVER MUST I PROVIDE TO STORMWATER DRAINAGE PIPES? The BCA requires that the position and manner of discharge of stormwater drainage must be in accordance with the local government requirements. The legal discharge point may be at the allotment boundary, a stormwater tank, or an on-site soil drainage system such as a rubble pit. The correct cover to those drains is a critical requirement to prevent damage which may limit the adequate performance of the drain. The cover requirements for 90mm Class 6 UPVC stormwater drains installed under the ground must not be less than – under soil 100mm, or under paved or concreted areas 50mm, or under areas subject to light vehicle traffic – reinforced concrete 75mm or paved 100mm. WHEN IS SUBFLOOR VENTILATION REQUIRED? Subfloor ventilation is the cross ventilation of a subfloor space between the underside of the subfloor and the ground surface of a building. Ground moisture in that space can cause timber rot, fungus growth and the potential for termite activity.

Businesses should ensure the information is kept accurately, limit its use and disclosure to the purpose for which it was collected and conduct ongoing reviews and audits to reassess the need to keep the information on an ongoing basis.

The BCA requires that subfloor spaces must have minimum aggregate subfloor ventilation based upon mm2 per linear metre run of the wall. The openings must be evenly spaced and not more than 600mm from the corners to prevent dead air spaces. Subfloor spaces must also be cleared of all building debris, vegetation and be graded to prevent ponding of water.

If you no longer need the information, destroy it and notify employees that you have done so.

WHAT IS A SUBCONTRACTOR’S CHARGE?

WHAT ARE THE FIRE PROTECTION LICENSING CHANGES?

A subcontractor’s charge under Chapter 4 of the Building Industry Fairness (Security of Payment) Act 2017 (Qld) (BIFA) can secure money payable to a subcontractor by the contractor by claiming a charge over money payable to the contractor by the contractor’s client.

The new Queensland fire protection licensing framework introduced five fire licensing streams from 1 May 2021 across the Contractor, Nominee Supervisor and Fire Occupational licenses.

WHEN CAN I USE A SUBCONTRACTOR’S CHARGE? You can use a subcontractor’s charge to secure the payment of money under the contract, including the payment of retention monies held by the contractor when: • • • •

You are a ‘subcontractor’ under the BIFA. Your subcontract is for ‘work’ under the BIFA. Your claim for payment complies with your subcontract. Your claim is for payment for work done under your subcontract; and • You can prove your entitlement to your claim. However, you cannot claim a subcontractor’s charge for domestic building work to a detached dwelling carried out for an individual, unless it was carried out for a business conducted by the individual or member of a partnership. WHEN CAN I GIVE A NOTICE OF CLAIM OF CHARGE? A Notice of Claim of Charge can be given at any stage during the subcontract period, but must be given within the following timeframes after completion of the subcontract: •

For contract monies - within three months after the completion of works; and • For retention monies - within three months of the expiration of the defect’s liability period. You can claim a charge on money payable to the contractor who owes you the money, or you can ‘leapfrog’ up the contractual chain and claim a charge on money payable to a superior contractor. You can give a Notice of Claim of Charge even though the work is not completed or the due date for payment has not yet arrived. HOW DO I GIVE THE NOTICE OF CLAIM OF CHARGE? The Notice of Claim of Charge must be made in the approved form (available on the QBCC website) and include: a. State the amount of the claim. b. Include details of the work done by the subcontractor. c. The amount of the claim must be certified by a qualified person as prescribed by regulation; and d. Include any other information prescribed by regulation.

The five licensing streams are: • Passive • Special Hazard fire system • Water-based fire system • Portable • Electrical Two of the fire licensing streams have introduced a ‘design’ licensing requirement for the water-based fire systems and electrical streams. The fire protection licensing changes have impacted not only existing fire protection licensees but builders, trade contractors and workers who may perform ‘fire protection work’ regulated by the Queensland Building and Construction Commission (QBCC). Additional licence classes were introduced for the installation and maintenance of fire and smoke walls. Trade contractor carpenters may need to complete additional qualifications and upskilling and apply for the licence to complete the fire protection work as of 1 May 2021. WHAT ARE THE REQUIREMENTS? Builders are required to hold the appropriate fire protection licence to perform the fire protection work personally, however, the scope of work for the builder (Low, Medium and Open) classes have a temporary scope of work extension until 2 May 2025 that includes: •

Passive Stream install and maintain -Fire collars, fire-rated penetrations and fire-rated joint sealing

Passive Stream install and maintain - Fire and smoke walls and fire-rated ceilings.

From 3 May 2025 builders (Low, Medium and Open) will be required to hold the above Passive Stream licences to perform the work personally. Builders will need to plan now and start to complete the required courses of study and gain the required experience to ensure they hold the licence by 3 May 2025. Along with the changes to the fire protection framework it is expected that the regulator will follow with a wave of compliance monitoring. Review the work you are performing and identify any fire protection work then ensure you are appropriately licensed for the work.

In construction workplaces WVA is generally perpetrated by workers and can occur between workers of all levels including supervisors, managers, apprentices, and volunteers. It can also occur between workers engaged by different employers, for example, building contractors at the same site, tradesmen, or delivery workers. Like all work health and safety risks, WRV must be managed.

Environmental controls

Work-related violence often causes physical or psychological injury and can sometimes be fatal. It can also result in economic and social costs to the victim, their family, and their business. Workers have the right to refuse to carry out or stop work if there is a reasonable concern that the worker will be exposed to a serious risk to their health and safety from an immediate or imminent hazard. How do I manage the risks? Following a four-step risk management process will help your business meet its responsibilities under WHS laws. COVID-19 Sick Leave W

ith an increasing number of COVID-19 infections in our community, there are more employees absent from the workplace. They are either sick, or they are a close contact to an infected person. While someone with COVID-19 will be able to access sick leave, there is some confusion about the entitlement to paid leave when someone is quarantining as a close contact. Sick leave is available where an employee is unable to attend work due to their own illness or injury. Where a person is in precautionary quarantine, they do not have an illness or injury and so there is no sick leave entitlement. Of course, if the person is isolating because they have COVID-19 symptoms and are waiting test results the symptoms are an illness and they may claim sick leave. POSITIVE TESTS If an employee tests positive, normal evidence requirements to receive sick or personal leave apply. However, we encourage employers to understand that evidence of a positive COVID-19 result may be a rapid antigen test (RAT), where it is not

possible to provide evidence of who took the test. A lower level of evidence of actual illness may be practical given the difficulty in sourcing medical appointments and PCR tests. Difficulties with evidence will be likely when employees advise of isolation. PAYMENTS Workers may be entitled to access federal government pandemic leave payments of up to $750 when they have to quarantine due to being a close contact. They may also claim this if they catch COVID-19 and do not have access to paid sick leave. The Pandemic Leave Disaster Payment replaces the Queensland Hardship Payment in the listed circumstances. People who are eligible for this payment must meet strict eligibility requirements, as outlined by Services Australia. Not everyone who is selfisolating or in quarantine can get the payment. If eligible, Services Australia will pay up to $750 for each seven-day period of self-isolation or quarantine, or care for someone with COVID-19. As of 18 January 2022, payments were based on how many hours of work with a maximum payment of $750 where more than 20 hours in a week are lost. A new claim must be made for each seven-day period. New mandatory retention trust training requirements F

rom 1 January 2022, existing trustees of a retention trust account (or their nominated account administrators) must now complete mandatory retention trust training. The new training requirements were prescribed in the Building Industry Fairness (Security of Payment) Regulation 2018 in December 2021 and came into effect on 1 January. Training consists of a short course conducted online via webinar by the Queensland Building and Construction Commission (QBCC) about the requirements for retention trusts, compliance obligations of trustees

and how to operate and administer the retention trust.

The residence comprises a single building, with several wings that accommodate 1,700 residents. QBCC Financial Reporting Season - Are you prepared? THERE’S NO DOUBT THAT KEEPING YOUR QBCC LICENCE INTACT IS CRITICALLY IMPORTANT FOR BUILDERS AND TRADIES. WITHOUT A LICENCE YOU DON’T HAVE A BUSINESS. Despite this, Michael Renton from Xact Accounting says they unfortunately see more and more licensees landing in hot water with the QBCC and on the edge of having their licence suspended or cancelled. This is largely due to ongoing confusion and lack of understanding around the QBCC’s Minimum Financial Requirements (MFR). And in almost every case they deal with, the crisis could have been averted if addressed correctly in the first place. The industry is entering the third year of the QBCC’s annual financial reporting regime, and they expect the QBCC are getting more and more efficient at tracking down non-compliance. Michael also expects that current conditions in the industry will exacerbate

these underlying issues with QBCC MFR compliance. Many businesses have seen a jump in revenue due to greater demand, but with margins being squeezed, he is concerned these dynamics will trigger several MFR failures.

Michael says they understand that there have been exceptionally difficult conditions in the industry and the last thing you want to deal with is an issue with your QBCC licence. In the end, though, if you act quickly and seek specialist advice, you’ll end up saving yourself a lot of time, money and heartache – and ensure your licence is protected.

It sounds like a cliché, but the worst thing you can do is bury your head in the sand. Whether it’s because you’re too busy – or you’re not sure how to fix your situation – failing to respond to the QBCC will only make the hole deeper. The sooner you get on the front foot, with a specialist QBCC accountant at your side, the better the outcome will be. An equally dangerous approach, alongside burying your head in the sand, is engaging with the QBCC without a solid game plan. The QBCC have very specific tests for determining whether you meet your minimum financial requirements – some

s of 1 January 2022, the Queensland Government’s rollout of its project trust reforms in the building and construction industry will now impact private sector construction contracts and a broader range of government contracts. PRIVATE SECTOR CONTRACTS From the beginning of 2022, the reforms encompass private sector contracts valued at $10 million or more. Going forward, the reforms are scheduled to include $3 million and above private sector contracts entered into after 1 July 2022, and $1 million and above private sector contracts entered into after 1 January 2023. GOVERNMENT CONTRACTS The project trust laws apply to construction contracts with local government and state authorities from 1 January 2022 on a similar basis to private sector contracts. However, statutory authorities who opt to have eligible contracts above $1 million require a project trust account. For eligible construction contracts with the Queensland Government, project trusts will

apply to contracts valued at $1 million from 1 January 2022. WORKING OUT WHETHER A CONSTRUCTION CONTRACT REQUIRES A PROJECT TRUST Not all construction contracts require a project trust. However, the law governing when a construction contract is caught by the reforms is quite complex and can be challenging for the lay person. The easiest and quickest way to work out whether a construction contract requires a project trust account is to use the QBCC’s online trust accounts tool. Alternately, members can contact Master Builders for help. TENDERING FOR A PROJECT REQUIRING A PROJECT TRUST Where members are tendering or quoting on a contract that will require a project trust, keep in mind that the contract price needs to be set having regard to the additional financial management and other costs associated with administering a project trust. These additional costs may include financial accounting system upgrades, trust accounting administration and changes to cash flow management practices.
