Canberra’s growing up and our buildings are being recognised on the national stage Canberra has come of age and turned from the relatively unknown Bush Capital to being named third best city in the world to visit in 2018 by Lonely Planet. Those of us that live and work here have always known this to be the case – the only thing I find hard to believe is how on earth we came behind Detroit – really?

Congratulations should go to the ACT Government for having the vision required to transmute the city, and allowing it to mature into a truly international hub by detaching itself from the shadows of Melbourne and Sydney. Our city continues to evolve and I for one share the Chief Minister’s confidence and optimism and cannot wait to see what lies ahead. The Chief Minister says he wants buildings built that will win awards…well we are certainly building them! At the 2017 MBA National Awards, held in Hobart on November 25, four of our ACT residential builder members won awards. In this issue, Drewaire Constructions share their experience of attending the national awards. It would be an understatement to say that our members are ready and waiting to take on the challenge that Canberra’s new found fame might bring; be that the City to Lake Project, City Centre Renewal or the much talked about Convention Centre

redevelopment. My sincere congratulations go out to all the national winners. All the team at the MBA are truly very proud of you for embodying all that Masters Builders stands for. As you are all aware we have had some changes here at the MBA over the past few months. Since Kirk’s departure, we have decided to revisit what it is that our members want and need from their premier member association, and how we can best serve them in order to continue to grow their businesses. Kirk was a champion fighter for local jobs and local engagement and the government listened and Kate Lundy was appointed to the role of Local Industry Advocate. That was only one of the many causes taken up by Kirk that he fought with heart and soul and the board and I thank him for fighting the tough fights while CEO. After searching for a replacement the board was unanimous in its decision that the best person for the job was someone who knew the finer details of the organisation, and whom we believed to have the knowledge and skills required to take the MBA to the next phase. That person is Michael Hopkins who served as Deputy CEO for 2 ½ years under Kirks leadership. We welcome Michael to his new role and are very confident he will achieve beyond what is required of him. As our members prepare to build Canberra to realise its full potential they can be rest assured that the MBA is ready and willing to assist them to be the best they can be, and hopefully next year we can bring more National awards home to the Capital. Keep up the great work!

MESSAGE FROM CHIEF EXECUTIVE OFFICER, MICHAEL HOPKINS

An organisational restructure allows us to reset and ensure our focus remains on core business Since commencing as CEO in September, our board and management team have been working on a plan to refocus the efforts of Master Builders ACT around three key areas – advocacy, member value, and operational excellence.

Advocacy at both ACT and Federal level is core business for the MBA. Locally, we will continue to be a respected advocate for the ACT construction industry. We will work with government to ensure government policy supports our industry, helps attract investment and creates long term opportunities for our industry to grow. Regulatory reform will be a key discussion point, especially in the areas of building quality, safety, and ACT government procurement. Our members are the life blood of our organisation, therefore continuing to review our offer to members is key to our continued success. Our current suite of member services and training courses will be reviewed and improved, adding to a number of new services implemented so far this year. Early this year we have discontinued our partnership with Austbrokers Canberra, and took up a shareholding with Master Builders Insurance Services (MBAIS). MBAIS is a national insurance broking business, owned by the Master Builders Associations, which reinvests its profits back to our local industry. We have also commenced a new fixed-price dispute resolution service

targeting disputes valued at less than $40,000. Our scope of training courses has expanded, including a new short course on the Master Builders Home Building Contract. MBA Group Training will also continue its commitment to supply industry with quality construction apprentices. To achieve both of these goals we have commenced a significant organisation reform, restructure and change in key personnel. A number of positions in our organisation were recently made redundant, and we have immediately commenced recruiting for a number of new positions. The driving force behind these changes is to make sure we run the MBA to the same level of operational excellence that we expect a “Master Builder” member to run their business. In closing I urge you to take time to read this new look version of Canberra Builder magazine. Demonstrating Master Builders ACT’s commitment to quality and excellence, this edition features a number of national winners in the Master Builders Australia and CCF Earth Awards. Even though the ACT comprises less than 2% of Australia’s population, local builders took out 10% of MBA Australia awards and 1 of 6 national CCF awards. This edition of the Canberra Builder is supported by five new MBA Premium Partners. The MBA Premium Partners have made a significant commitment to support Master Builders ACT over 3 years, and will be recognised at every major MBA ACT event. A MESSAGE FROM INDUSTRIAL RELATIONS DIRECTOR, CAMERON SPENCE

The future of the rule of law in the construction industry; looking back and forward A week is a long time in politics. It seems we can’t go a week without the news that yet another MP has fallen under the citizenship knife.

>> More than $2.14 million in penalties awarded in matters brought by the ABCC – the third time in the history of the agency and its predecessors that penalties exceeded $2 million. >> Significant penalties handed down for unlawful industrial action ($1.15 million) and coercion ($710,000). >> 28 proceedings finalised before the courts. >> 1 Building Code sanction.

Instability in an elected government is never a good thing, and one hopes that this problem is sorted out as quickly as possible. This instability has raised some important Industrial Relations questions, not least around the future of the Australian Building and Construction Commission (ABCC). Bill Shorten is on record as vowing to do away with the ABCC should he be elected Prime Minister. And a few more foreign passports could see us head to an early election, so in light of that, it is worth asking; “what exactly will Bill Shorten be dismantling?” Unless you’ve been living on Mars, you will recall that Australia went to a double dissolution election in 2016, sparked by the Turnbull government’s determination to reinstate the ABCC to help enforce the rule of law in the industry. After a cliff-hanger result and a bruising passage through the Senate, the ABCC was re-instated, and a new 2016 Code came into effect. Almost a year has passed since these events took centre stage. The ABCC has recently released its 2016/2017 annual report, so this is an ideal time to look at the ABCC’s achievements, and to revisit the question of the rule of law in the building and construction industry and to look to the future. The notable parts of the ABCC report can be briefly summarised as follows:

>> 142 new investigations commenced into suspected breaches of Commonwealth workplace laws. >> 871 enterprise agreements assessed for compliance with Building Code 2016. >> More than 10,000 industry participants reached through ABCC education activities – with 5,552 attendees at presentations delivered by agency staff and 5,882 enquiries responded to over the year. So much of the heat and smoke that initially surrounded this argument has just evaporated. No one has gone to jail, no one is being bullied or threatened. Instead, what we are seeing is a dedicated government agency going about the business of making sure that the rule of law is upheld in the building and construction industry without distinction as to who they need to deal with. In a nutshell the ABCC is bringing our industry into line with mining, education, aviation, agriculture, and every other major industry in this country in which the majority of stakeholders abide by the law the majority of the time. This is a good thing. We can only hope that common sense prevails and future governments of all political persuasions understand the importance of a building and construction industry where the rule of law is respected. It’s in everyone’s interests. Why would anyone want to change that?

A MESSAGE FROM CHIEF MINISTER, ANDREW BARR

Creating world-class urban renewal Canberra will be a city of more than 425,000 people by the end of this decade and a city of that size – and Australia’s national capital – deserves a world-class CBD.

Renewing our city centre to become a great place for people to live, work and visit is a major government priority and it is integral to the success of Canberra over the coming decades. It’s how we attract and retain the smart people who are the future of our economy – and it’s how we make the CBD somewhere that today’s Canberrans and visitors alike want to be. That’s why we have created the City Renewal Authority, which is taking the same precinct-based approach that has been so successful in projects like Southbank in Brisbane and Elizabeth Quay in Perth. My objective of the transformation of central Canberra – from Dickson through to Lake Burley Griffin at West Basin – is to foster greater social, community and economic activity. By 2020, the Authority’s influence on our inner city will be shown through improved public areas, world-class designs and a greater interaction between people and buildings. The Authority’s task is to deliver “design-led urban renewal”, and the importance of design as we shape our city centre is at the heart of everything we will do.

I want Canberra to be a shining example of contemporary urban renewal. I don’t want Canberra to be a city of bland boxes. Canberra, particularly our main avenues, should contain buildings that people are talking about well after we’re gone. I want to see buildings that win awards. I know our city can do world-class work so I strongly encourage architects and builders to aim high. Be bold, be creative and win awards. The Authority will guide this work, while also focusing on social and environmental sustainability. Over the next 12 months, renewing the city bus interchange, improving the historic Sydney and Melbourne buildings and increasing the liveability of the city precinct are some of the major goals. We’re also building stage one of the West Basin project by opening a new park early in the new year, we’re refreshing courtyards in Dickson, and we’re enlivening key areas, including a micro park at Garema Place. The private sector has responded to our strategy, with major hotels and residential developments underway and being planned. The city centre we build now will be at the heart of a larger and more connected Canberra. Our CBD must be a place where people want to be.

Ozhelp news OzHelp launches the Wellbeing at Work program Ozhelp unveiled their new program Wellbeing at Work during the National Safe Work Month. Wellbeing at Work (W@W) is a short 15-minute training program delivered at work, designed to assist people to understand how they can improve their mental health and wellbeing. It aims to raise awareness of five key factors which affect wellbeing, as identified by the World Health Organisation; Sleep, Exercise, Mood, Connection and Nutrition. It also encourages participants to identify two areas that require immediate action and accordingly decide changes they can make to address the same. The rounder your Wellbeing wheel the better you are equipped to roll through the day. This program is designed to be delivered on-site and is also available free of cost for the construction industry in the ACT.

Andrew Foster Leads Drewaire To Win

THE END RESULT TOOK THE CLIENT’S BREATH AWAY.

NATIONAL MBA AWARD VERY SATISFYING Sitting confidently amongst woodland in Wamboin, a delightful stone cottage no longer met the living and entertaining needs of its owners. While still in love with their humble abode, they had outgrown the space and set about to find a builder who could extend, renovate and design the property while respecting the original design. The brief was to deliver a modern, bespoke home with larger indoor and outdoor living spaces without destroying the charm of the existing building. Drewaire Constructions was chosen for the project based on Andrew Foster’s passion for working with timber, his deep respect for the intricate craft of building, his eye for detail and obvious enthusiasm for the project. Responding to every aspect of the brief, Andrew assembled a team of talented individuals from different disciplines so that he could deliver the clients dream, without compromise. Engaging Chris Buchanan from Sellick Constructions and Gina Carmody By Carmody By Design gave Andrew the added confidence he needed to ensure that the new build blended seamlessly and artistically with the old. The coming together of Chris Buchanan from Sellick Consultants and Andrew Foster from Drewaire resulted in a marriage of minds. Working with sustainable materials is a passion for both men and they both enthusiastically embraced the challenge. The overall plan, with its special structural features, perceptive interior design and innovation ensured Drewaire Constructions was able to create a superior flow between indoors and out, welcoming the tranquil bush setting to join the family. The structure involved trusses spanning 9.5 metres with a roof height of 3.5 metres. This presented an exciting opportunity for Andrew whose extraordinary ability to understand the skills required to hand craft the trusses was extraordinary. This uncanny ability made managing the complex build relatively straightforward. His knowledge of traditional carpentry methods such as scar finger dowel pinning contributed

enormously to the sculptural form. Each of the one and a half ton trusses were carefully transported from Drewaire’s workshop, and craned into place without incident. To be nominated for a national award that recognised his workmanship and skill was very satisfying for Andrew. To say that he was proud to actually win the award is an understatement. “Bespoke carpentry jobs like this don’t come along very often so it was an honour to be selected to conceive and build the client’s dream. I was conscious throughout the build that they wanted their current home to mature and improve without leaving the past too far behind. However they still craved a Bespoke finish. The end result took their breath away. That in itself was extremely rewarding, then to win the national MBA award was overwhelming. We were thrilled to have the designer and clients with us in Hobart for the Awards presentation” Andrew Foster said The client’s were so proud of Andrew for winning the National Award and are more than satisfied with their personal reward, living with Andrew’s magnificent work of art every day. “Many thanks to the MBA for nominating Drewaire Constructions yet again and for their continued support of the building industry” Andrew concluded.


Yarralumla project named National Luxury Project Home $1 million–$2 million at Master Builders Awards A modern, contemporary masterpiece in Yarralumla has been named National Luxury Project Home $1 million–$2 million at the 2017 Building Australia Awards in Hobart on November 25. One the annual awards’ most prestigious gongs went to local builder and architect team, Preferred Builders and DNA Architects for the Oliver Residence which won ACT House of the Year and Custom Built Home more than 350m2 at the 2017 ACT Master Builders Excellence in Building Awards in June. The house is the ultimate form of sustainability achieving a 6 star energy rating. The spectacular open-plan design features a private upstairs master suite and three large bedrooms, extensive use of stone and timber throughout, an outdoor life size chessboard and feature BBQ, and a supersized garage to accommodate car hoists. Michael Hopkins, CEO of Master Builders ACT, says the Building Awards both locally and nationally encourage, promote and recognise ‘best practice’ in building across Australia. “The Awards provide an opportunity to recognise impeccable talent and expertise in the building industry, and twelve finalists from the ACT were recognised for recent projects” he said.

Mentoring To Help Conquer Construction as Last Frontier for Women

Building and construction is the last frontier for women as Australia’s most male dominated industry with women making up only 11 per cent of the industry’s 1.1 million workers. But things are changing and the Women Building Australia Mentoring Program is a big step in building on the efforts of Master Builders around the country to support more women into the industry.

A new national mentoring program to boost the number of women in the male dominated building industry has been launched by Master Builder’s Australia first female CEO Denita Wawn.

“We want to build on this change for the better. There is so much opportunity for women to build careers in building and construction right now but we need to support them when they make the choice to join our industry,” Denita Wawn said. “Women Building Australia will encourage and support women who are currently working in the building and construction industry and those who are on training pathways to careers in the industry,” she said. “This is a hugely important initiative for the industry’s future. Even when women are attracted to careers in building and construction too many drop out of training or choose not to start jobs when they complete their training,” Denita Wawn said. “The industry simply cannot afford for this to continue. We need to both train and retain women in the industry and see them develop and achieve so they can form part of our industry’s future workforce,” she said. “By recruiting mentors from the thousands of builders and building businesses in communities around Australia, Women Building Australia will also help ensure more women are accepted in the industry,” Denita Wawn said.

Holcim has been serving the Canberra region since the early 1950’s, originally serving the ACT and Southern N.S.W. region under the well-known Readymix and Humes brands.

Belconnen Concrete is a family run business which opened in 1970. It was the first company in Canberra to integrate pumping, placing and finishing of concrete works and its concrete pump fleet includes some of the newest and largest of its kind in the country.

From its two modern concrete plants located in Fyshwick and Mitchell and from a fleet of 28 concrete mixer trucks, Holcim supplies aggregate, sand, ready mix concrete, and concrete pipe to the local construction market. Holcim offers a specialised range of decorative concrete and high performance concretes which have been utilised to build some of Canberra’s most iconic buildings like Parliament House, Telstra Tower, The National Gallery, Nishi Building and Canberra Airport to name a few. Oztal Architects was established by Dominic Maiuto in 1981. In 1988, Dominic was joined by two associates, Nick Pelle and Frank Parisi who are now partners of the Firm.

Purdon Planning was established in 1985 and offers a wide range of urban planning services, covering all aspects of urban planning and design including urban design, landscape design, development feasibility, statutory approvals processes, urban economics, heritage and environmental impact assessment.

Beginning in the residential field with small residential projects, the firm soon expanded to deliver a large volume of residential projects, many of which have since won prestigious housing awards. Work Health and Safety Culture in the ACT Construction Industry

A TOTAL OF 417 VALID RESPONSES WERE RECEIVED FROM PARTICIPANTS EMPLOYED BY COMPANIES OF DIFFERENT SIZES, AND ENGAGED IN DIFFERENT SECTORS OF THE ACT CONSTRUCTION INDUSTRY.

RMIT University was engaged by the ACT Government in February 2017 to conduct a culture survey to assess the current state of the safety climate in the ACT construction industry.

RMIT’s Centre for Construction Work Health and Safety Research was engaged by the ACT Government to undertake a study to provide: >> a baseline understanding of the culture of the ACT construction industry with regard to WHS, and >> evidence relating to the impact and effectiveness of changes introduced since implementing the recommended measures from the Getting Home Safely report. The study was undertaken using a mixed methods (qualitative and quantitative) research design. The survey was conducted using a work health and safety

Focus group participants identified several areas in which they perceived the culture and WHS performance of the ACT construction industry has improved since the publication of the Getting Home Safely report. These were: >> an increase in reporting of WHS incidents and injuries >> greater client attention paid to WHS, and >> improved relationships between clients and contractors A number of the issues identified in the Getting Home Safely report as areas in need of improvement were identified by focus group participants as still being areas of concern. NAWIC News The last quarter for 2017 has been a fast and furious one for women in the ACT building and construction industry. September was the time to celebrate the significant value that women bring to the sector and of the commitment that Canberrans have to supporting diversity and equality in the construction industry. The annual NAWIC awards ceremony at the beautiful National Gallery of Australia was a sold out event, with recognition of the achievements of the amazing winners a testament to their talent and drive. As always, the NAWIC Council and award judges were impressed by the quality of all the entrants and their strength and tenacity in an industry that still is not fully utilising the benefits of cognitive diversity. In the lead up to the festive season NAWIC has steamed ahead with more member events designed to inspire and enthuse members. A 4WD site tour of Ginninderry gave participants the chance to experience the incredible natural setting for the future-looking development area, to imagine the finished product and also view the Link Building. The site promises to be an incredible precinct, setting the stage for a new way of thinking about suburban development in Canberra.

GINNINDERRY SITE TOUR – MEMBER INSIGHT: “Traversing across a wooden foot bridge over a man-made pond towards the main building fondly dubbed “The Link” this beautiful architect designed structure houses the Strathnairn Arts association and is the centre of operations for the Ginninderry team. The link reflects the vision of the project utilising a raft of recycled materials including timber cladding, concrete and brickwork – representing a vanguard standard for dwellings situated within the development. Jumping into a 4WD – the only means of negotiating the wilderness – the team drove down the River Corridor Access Trail towards the lookout over the conservation corridor. After basking in an ethereal view from the Canberra to NSW border to the Murrumbidgee River the tour continued

up and across the NSW border passing refurbished farm houses from the early 19th Century towards the Ginninderra Falls. The hilly slopes presented a bumpy ride but allowed the group to absorb the stunning beauty of the land, identifying the future stages of works due to be released over the next thirty years containing stunning views. Arriving at the Ginninderry Falls we stopped for some afternoon tea looking out over the falls which have been closed to the public for nearly 20 years. This site is due to be re-instated for the community to visit as a part of the new development. Members were also treated to a ‘Speed Networking and Trivia’ night at the Duxton in O’Connor. New connections were quickly forged over 3-minute conversations followed by an impressive show of knowledge as the crowd tackled tough questions over food and wine. With the year not yet over, NAWIC has also planned the ‘Smart Cities’ industry breakfast for the end of November, adding to the busy calendar of inspiring events. Thought leaders from across the industry will share their insights into how Canberra can evolve to seize a first-mover advantage in the smart cities space, to embrace market disruptors and drive digital transformation opportunities. The event promises to provoke some interesting thinking about the future for the sector and for the national capital – a great way to end the year. DECORATIVE CONCRETE Concrete is evolving and Australian designers and builders are finding amazing ways to make this essential construction medium a new and exciting feature of construction. Today’s concrete is being coloured, stained, dyed, exposed, ground, polished, recoloured, resurfaced and featured in structures. Specialised aggregates are being introduced to enhance the design and look of concrete and to even improve the functionality of a structure, like glowing aggregates in footpaths for after dark usage. Some ways which concrete is being used as an ascetic element include: Coloured Concrete: This is typically the inclusion of a coloured oxide into pre-mixed concrete at the time of batching to provide a specific colour tone to the concrete. Exposed Concrete: Involves a chemical treatment being applied to concrete surface during installation which retards the very top of the concrete surface. This is then washed away to “expose” the colour and texture of aggregates in the concrete mix. Polished Concrete: A polished look is achieved in a number of ways, and is often handled by specialist contractors. This finished can be achieved in a number of ways including a grind and seal approach,

a burnish finish applied during placement and via a true polishing of the concrete surface. The look of the product is enhanced and individualised through the inclusion of colours and specific aggregate to the concrete. Colour Resurfacing: “Resurf” is mainly used to rejuvenate an existing concrete surface at a fraction of the replacement cost. High strength coloured slurry is sprayed by a hopper gun onto the concrete to create a new durable coloured surface. This method is extremely popular for driveways, but is also finding a market by replacing paving, tiles and other surface finishes in commercial construction and public spaces. Stamped Concrete: “Stamping” a textured finish into the surface of fresh concrete whilst it is still in a plastic state. Mainly used in conjunction with oxide coloured concrete, throw on colour, release agents and stains to create a look of tiles, timber, stones and other designs with concrete. Stencil Concrete: Or Colour Hardener, uses tapes or pre-cut stencils to provide a pattern to the surface of fresh (still wet) concrete. A coloured powder hardener is then thrown onto the surface which reacts with the wet concrete to provide a brick, rock or tile look.

Colour Sealers: A concrete paint in a multitude of colours. This system is mainly used in the residential housing and renovation market to enhance the look of driveways, paths, balconies and entertaining areas. Concrete Benches and furniture: With the endless possibilities in colour, aggregate and finish it’s easy to see why concrete furnishing has become so popular. With the added bonus of strength and durability concrete is finding its way into benchtops, tables, chairs and other interesting areas of furnishing. Concrete offers the opportunity to design a true unique piece in any project. There are numerous other systems and finished which can be applied to achieve decorative finishes including dyes and stain or epoxy, flake, polyurethane and polaspartic coating systems. Canberra has a plethora of organisations working with the local design and building community to achieve more with their concrete. Furthermore, it is important to engage with these businesses early in your construction process so you can understand what is involved with working with concrete to meet your designed vision. Start a conversation with your pre-mixed supplier, local decorative concrete supplier, concrete placer or specialist concrete contractors to see what you can achieve on your project.

WHAT’S YOUR ADVICE TO YOUNG PEOPLE THINKING ABOUT ENTERING THE BUILDING AND CONSTRUCTION INDUSTRY? I recently presented at the apprentice intake information night, where I spoke to a group of young adults considering a career in our industry. My advice to them was to be very sure about what trade apprenticeship they chose to undertake, as they can all be very rewarding but are all very different. Choosing to undertake an apprenticeship is an investment in your future and the future of our industry. Host employers, who take you on, are investing a lot of their time and money into teaching you your trade so in return you should be prepared to work hard. My message was simple; make every day count, be eager to learn and ask lots of questions, pay attention, take initiative and take ownership of the tasks you are given. Finally stay off your damn phone!

Power of Choice starts December 1 Power of Choice will bring significant changes to the way the industry currently installs and manages meters From 1 December 2017, all new electricity meters for residential and small business customers in NSW, ACT, SA and QLD will need to be digital meters. Power of Choice is a suite of reforms to National Electricity Rules designed to encourage energy consumers to make more informed choices about how and when they use electricity. There are a number of changes to electricity metering as a result of Power of Choice. From 1 December 2017 all new meters installed (including replacements) must be smart or digital meters (Type 4), and all new meter installation requests (including alternations and replacements) will be managed by Retailers, not ActewAGL Distribution. ActewAGL Distribution no longer installs new electricity meters. Currently electricity distributors arrange your new connections. From 4 December, all new connections will be performed by Meter Providers on behalf of retailers. A Meter Provider is a contractor who’ll install, operate and maintain meters on behalf of retailers and their customers.

New accredited roles have been established in the electricity market (Metering Coordinators, Metering Providers and Metering Data Providers) to undertake metering installations. The process of installing new meters will be the responsibility of Retailers. The Retailers will engage their Metering Coordinator(s), whom in turn will arrange with a Metering Provider to perform the actual metering works. Electricians installing meters from 1 December 2017 must have a current unrestricted ACT electrical licence with a licence endorsement to perform interval metering work (contact Access Canberra for more details), and must perform the work for a Metering Provider (contact your Retailer for more information). ActewAGL Distribution’s Electricity Service and Installation Rules have also been updated, and new training is available for the electricians installing meters and working on the ActewAGL Distribution network boundary.

GOOGONG CONTINUES TO RELEASE LOTS FOR SALE TO THEIR 16 GUILD BUILDERS, AS WELL AS TO THE WIDER PUBLIC AND INDIVIDUAL BUILDERS, AT A RATE OR AROUND 300 LOTS PA – AND WILL CONTINUE TO DO SO FOR THE NEXT 15 YEARS.

Googong Closer than you think Googong is a whole new self-contained township located just 16km from Parliament House in Canberra, on Old Cooma Road NSW. It will eventually be home to around 18,000 people in 6,500 homes, and will have all the amenity you would expect of such a large town including schools, shops, employment and more. 1600 lots have been released and sold since the first releases in 2012 at around 300 lots per year. and already several thousand people call Googong home. Googong continues to release lots for sale to their 16 guild builders, as well as to the wider public and individual builders, at a rate or around 300 lots pa – and will continue to do so for the next 15 years. The town is being developed by Googong Township Pty Ltd (GTPL) in a joint venture partnership between two of Australia’s leading land development companies, Peet Limited and Mirvac. While Googong is in NSW, travel times are nonetheless favourable – Google Maps indicate that Googong is just 26 minutes to Canberra’s CBD, while Denman Prospect is 18 minutes, Ginninderry is 20 minutes, and Taylor is a 25 minute drive. Investment and growth in the township is accelerating. A $30m upgrade in the local road networks is about to commence, to improve connections from the township into Queanbeyan and Jerrabomberra, and the wider region. Denman Prospect Work at Denman Prospect development steams ahead Capital Airport Group’s Denman Prospect development is fast taking shape. The first stage of the subdivision, which includes over 400 single residential blocks, is now complete. Of these, 80 per cent have sold. Homes continue to be built and residents are moving in. “Clearly what we have seen is a very strong level of market interest,” Denman Prospect, Director Project Delivery Nick McDonald Crowley said. To help ensure each home is distinct from its neighbours, a display village featuring 14 bespoke homes opened at the top of Wyndham Avenue in October. Following the success of Stage One, Capital Airport Group is now developing Stage Two of Denman Prospect. Civil infrastructure development for 34 multi-unit sites and more than 600 residential blocks is well under way. The first two substages (Mountain View and Denman Heights) are due for completion by early to mid-2018. In November asphalt was being laid at the northern end of the Mountain View blocks, which have the most elevated views. Street lights have also been installed. Preliminary design work for a third stage of Denman Prospect, Denman Prospect North, is due to commence soon. Denman Prospect North will comprise over 1,000 separate title housing blocks. Facilities for current and prospective residents are also being built, with Denman Village Shops, which is located on the corner of Felstead Vista and Holborow Avenue, set to open in late 2018. Civil work for the 3,000m2 centre is complete and while building continues, a search for tenants for the supermarket, gym, medical centre and food outlets is underway.

Denman Prospect is located directly adjacent to Stromlo Forest Park which by the end of 2019 will have its own Olympic sized swimming pool. Denman Prospect is the first entire suburb in Australia to commit to Homes for Homes, a social enterprise created by The Big Issue. The initiative involves 0.1 per cent of the sale of each block in Denman Prospect being donated towards helping to address homelessness in Canberra. Capital Airport Group is strongly encouraging other developers and the ACT Government to take on this social initiative with their future projects and land releases.

Ginninderry Housing choices for the future – sustainable, compact and well connected With the recently published Housing Choices Discussion Paper by the ACT Government, understanding how we can better meet the housing needs of Canberrans, has never been more relevant. As noted by Mick Gentleman Minister for Planning and Land Management November 2017 “…there is no longer the presumption that everyone aspires to a large suburban block with a garden. People want different forms of housing in the suburbs, as well as in centres and mixed use areas. This includes town houses, terrace houses, secondary dwellings and apartments as well as a continuing demand for detached homes. While this is being driven to an extent by the younger generation, it is also being sought by older residents who do not want to leave the suburb they may have lived in for 50 years, but no longer want – or are able – to live in a big home that can be better used by a larger family. This desire for housing choice is complementing the drive for Canberra to be sustainable, compact and well-connected.” Ginninderry is a community with a difference, designed to cater to Canberra’s needs as a growing city. It will extend across the ACT/NSW border* to the west of Belconnen and is being developed in joint venture The Suburban Land Agency on behalf
 of the Australian Capital Territory and Riverview Developments Pty Ltd (Riverview) on behalf of Corkhill Brothers Pty Ltd (Corkhill). The community will eventually have around 11,500 homes, of which 6,500 will be in the ACT. Subject to approvals the project will be developed at a rate of 300 to 400 dwelling per annum over the next 30 to 40 years representing approximately a third of the ACT’s land supply projections over this time period. Ginninderry has been rated as a 6 Star Green Star Community by the Green Building Council of Australia – a testament to its liveability, contribution to the local economy, governance, environment, design and innovation. Planned facilities include new schools, shops, halls, childcare centres and medical centres. Just a few minutes’ drive from Belconnen Town Centre, Ginninderry

offers the chance to build a rewarding lifestyle in a spectacular location adjacent to the Murrumbidgee River corridor. Stage 1 of Ginninderry’s first neighbourhood in the suburb of Strathnairn was released in April 2017, with approximately 200 blocks and packages sold to date. The Estate Development Plan (EDP) Stage 2 (for 780 dwellings) has been submitted to EPSD for agency review and will include a mix of single residential blocks, terrace blocks, Flexi-living series’ packages and multi unit blocks. Subject to approvals the first release of land from stage 2 is scheduled for mid-2018. Ginninderry’s Project Director Stephen Harding says, “Importantly Ginninderry is addressing the shortage of medium density housing, known as the “missing middle” by offering a genuine range of housing options. Insights into housing preferences, reveal that 75% of our primary audience prefer free single detached standing homes, but when price is factored in, free-standing homes townhouses, compact blocks, terraces and apartments are still appealing options. Research findings also highlight that 71% of potential buyers have a budget of $400,000–$600, 000.” Ginninderry is working to provide a variety of block types to promote housing diversity and housing choice. Affordability is being addressed on various levels: >> Flexi-living Series – a suite of architecturally designed homes with eligibility criteria >> Working with community housing groups to look at equity share schemes >> Introducing more blocks to allow for studio above garage to allow for inter-generational living >> Various block types to meet different house and land price points >> Implementing design controls to ensure quality streetscapes and the overall capital value of a neighbourhood are retained. *Subject to NSW planning approval

Kids Assist is a practical, learning support program that engages high school students, identified by the school, who are disengaged with their learning environment and are at risk of not completing high school. MBA works with local government schools in Canberra to deliver a program designed to provide students who aren’t enthusiastic about school an opportunity to undertake a practical and theoretical based training and work experience program. The aim of this program is to provide a structured workplace environment, showing students the link between school learning and the workplace environment, providing learning opportunities for students to gain valuable skills and introducing them to the workforce. The students are employed by MBA Group Training and are required to behave as employees and not students.

Making choices for housing easier for Canberrans Earlier this month, the ACT Government announced the Housing Choices discussion paper to start a conversation about housing types. The government is keen to broaden the mix of housing in the Territory, in a way that respects the characteristics of neighbourhoods that attract residents in the first place; this is in response to what we heard during the development of the Minister’s Statement of Planning Intent. The ACT Government is committed to providing housing that works for all Canberrans, and has listened to community feedback about their desire for a greater range of housing options, including free-standing houses, townhouses and other housing types. Minister for Planning and Land Management Mick Gentleman said, when he released the Discussion Paper, that in providing more housing types we can cater for a greater range of needs for the community. For example an older person or couple in a large family home may wish to downsize to a smaller house, a young person may be looking for an affordable apartment, or a young couple looking to get started in the housing market might want to buy a townhouse. In releasing the Housing Choices consultation, engaging with the community will provide an opportunity to hear more from Canberrans about what sort of housing they want and how greater housing options can be delivered. It also allows us to ‘check in’ and test what we’ve already heard. Talking to the community will help us to improve our understanding of how Canberrans want to see their city develop and what options the Government needs to consider when planning new suburbs and managing urban infill. Housing Choices as a key topic of conversation will be a valuable way for Canberrans to contribute their ideas on how to achieve better housing outcomes, and be a part of the planning process in our city. In terms of planning for the ACT, we want to get residential planning and design right. The building and development industry has a crucial role to play in contributing to informed conversations about future options for residential development in Canberra.

CHC partner with disability providers to deliver Kambah project Moncrieff Project

Canberra’s leading provider of community housing, CHC, has partnered with House with No Steps and Canberra-based Care Plus Services to deliver a landmark Specialist Disability Accommodation (SDA) project in Kambah. CHC announced the purchase of six residential sites in Richman Place in July with a plan to deliver affordable housing options, in line with the company’s mission. The original properties, constructed from bonded asbestos, were used for public housing and demolished prior to sale to CHC in early 2017. Increasing the company’s tenancy-base to provide greater access to affordable rental accommodation was a goal at Kambah, but with a very special client in-mind. The planned development will consist of 11 dwellings – three blocks with standalone houses, one as a standard and ancillary house, and the remaining two will be consolidated to include six small single-storey specialist disability dwellings. CHC’s General Manager, Operations, Megan Ward said, “Early in 2017, CHC received accreditation under the National Disability Insurance Scheme (NDIS) and we quickly identified some significant challenges around connecting disability products with those that need them most.” The main challenge was the requirement under the NDIS to deliver purpose-built products, which meant that speculatively building for the future was not an option. The NDIS requires registered providers of disability housing to understand their audience in detail and design a home to their specific needs to ensure products meet the market. “We had the vision, the land and the internal infrastructure to deliver specialist disability housing but we had to overcome hurdles around connecting those in need with what we were

looking to build. The greatest challenge was a requirement under the NDIS to identify who would be living in the home once complete and how their individual needs were catered for,” said Lindsay Hunter, CHC’s General Manager, Development. Rather than undertaking client-identification with a siloapproach, CHC reached out to those who were already equipped to provide information, advice and a connection with Canberrans seeking disability housing. “It made sense to partner with organisations who have waiting lists for the type of homes we are looking to create. We currently have two major partners to deliver Kambah but are also discussing opportunities with a handful of other specialist disability organisations,” said Ms Ward. Based in Belrose in NSW and operating from Belconnen in Canberra, House with No Steps are a leading provider of disability services and exist to give those with a disability greater choice, control, and freedom. They provide the opportunity for Australians with intellectual, physical and sensory disabilities, as well as mental illness, the resources to live on their own terms. Care Plus Services is the local, homegrown ACT provider supporting adults and children with a disability. In addition to physical and intellectual disability support, Care Plus is also committed to providing a quality service to those who require complex supports such as palliative care, peg feeding, bowel care and catheter care. Elevated Constructions have been appointed to undertake the building of the first three of these important homes. Construction commenced in October 2017 for the standalone residences with the remainder to follow in the first quarter of 2018. “It is projects like Kambah that showcase the true value of our business. We are actively identifying demand and working with organisations that can provide insight and expertise to improve the lives of Canberrans living with a disability. By doing this we take pressure off family members providing care, hospice services and medical facilities. Our goal is to reduce disability housing waiting lists as much as we can,” concluded Mr Hunter. In addition to Kambah, CHC has new homes underway in Macgregor and Moncrieff that meet the company’s charter. Macgregor will form part of CHC’s affordable rental portfolio as another pilot for NDIS SDA and will enable CHC to deliver locational diversity, while Moncrieff will provide CHC tenants and private buyers with the opportunity to achieve home ownership under the ACT Government’s Land Rent Scheme.

Thank you to all our corporate leaders and respective industry associations who attended this very special occasion, the launch and inaugural recipients of the UC Built Environment Diversity and Inclusion Scholarship, which was held at the University of Canberra on Wednesday 25th October, 2017.

Congratulations to Michelle Anderson and Jabez Philppot as being extremely deserving recipients. Michelle is studying the Bachelor of Design/Bachelor of Landscape Architecture, she is classified as a rural and remote student and has experience working on Indigenous design projects. Jabez is studying the Bachelor of Building and Construction Management, he is classified as a student with a disability and demonstrates a commitment to diversity with regard to gender, Indigenous issues and mental health

The scholarship at UC was founded through my personal initiative and followed up with support from Bruce Henry (Xact) and Simon Butt (Manteena), rather than a corporate or business-led initiative, and the idea was developed over a long time following extensive discussions with the university. What’s different about this particular initiative is the grassroots approach to philanthropy and the provision of direct assistance with a bottom-up approach to support a new type of diversity and inclusion program. In addition, it is not just about the financial support but rather the direct connectivity between local (and national) senior industry leaders and students in the capacity as mentors and connectors to other kindred organisations. I would hope that, with success of such a program, other industries could also follow with similar initiatives with the university. Those who know me and my fellow partners, we have been long standing members of all key and relevant industry associations locally mentioned above for decades and have participated at senior and executive levels as contributors towards the success of our respective industries and more importantly the success and growth of Canberra. I’d like to seek support to communicate and participate in such a worthy program for Canberra on an ongoing basis and more importantly the talent which exists in our own backyard. Feel free to contact myself or Jock Gravel, Deputy Director, Advancement/University of Canberra, to either promote and or participate in this worthwhile program.

Rolling out the boilerplates: Time to rethink your ADR clause ALISA TAYLOR

WHAT’S AN ADR CLAUSE? Alternative Dispute Resolution (ADR) clauses are supposed to be mechanisms for people to resolve disputes without going to court. They prescribe an alternative process, and can range from simple promises to meet and attempt to resolve the dispute, through mediation, expert determination (in its various forms) and formal arbitration. ADR clauses are often stuck in the back of contracts, amongst all the other boilerplate (i.e. generic) clauses about which state or territory’s law is applicable to the contract and how the parties are to serve notices on each other. They are usually not given any attention until someone needs to rely on them – when there is a dispute. WHAT KINDS OF ADR ARE THERE? ADR clauses generally propose one of the following: >> Negotiation – a meeting between executives, with or without lawyers, to attempt to resolve the dispute. >> Mediation – an independent third party is appointed (and paid) to try and resolve the dispute. The third party mediator attempts to facilitate an agreed outcome, but cannot force the parties to accept anything. (Nowadays if you go to court, the court is likely to require you to attend mediation as an early step anyway.) >> Expert determination – an independent third party is appointed (and paid) to review the material submitted by the parties and determine who is right. It is a process a bit like statutory adjudication under the security of payment legislation but there is no legislation that governs it. The process is governed wholly by the ADR clause. It is usually specified to be binding, perhaps subject to a right of appeal. >> Arbitration – an independent third party is appointed (and paid) to run a process very much like a court hearing, but outside of the courts. Arbitration is governed by legislation in each state and territory (in the ACT, the Commercial Arbitration Act 1986 (ACT)). The arbitrator’s findings about the facts are binding but there is a statutory right of appeal from an arbitrator’s determination if he or she has made a

legal error. Arbitration has become less fashionable over the years as it is generally thought to be no faster or cheaper than court. The contract might combine two or more forms of ADR, by proposing initial non-binding ADR to be followed by a binding form if the dispute is not resolved. EXPERT DETERMINATION IS THE CONSTRUCTION LAWYER’S FAVOURITE Expert determination is often adopted in construction contracts as the chosen ADR method because the parties can appoint a technical expert who is skilled in the relevant building issue. In simple disputes with only one or two issues it can be far cheaper and faster than going to court. But expert determination involves putting all your faith in a stranger to come to the right decision. You may never meet that person, and there is unlikely to be a hearing at which the parties put opposing views and ventilate the issues. Usually the expert makes his or her decision based on documents submitted by the parties. In complex disputes, which involve a variety of technical issues (such as who caused defects or delays) as well as legal issues (such as what does the contract mean), that one person may not have all the requisite skills to properly understand everything that has happened or how the law applies to it. CAN AN EXPERT’S DETERMINATION BE APPEALED? Most expert determination clauses say the expert’s word is final and binding. But as the expert is only given the authority set by the contract, a dissatisfied party may challenge the determination on the basis that the expert did not do his or her job strictly in accordance with the contract. An expert determination is not, of itself, enforceable either – you have to go to court to get an order enforcing it. Frequently a dissatisfied party will attempt to defend an enforcement on the basis that the expert did not do his or her job properly. This argument is not always successful but it slows things down and adds expense.


Sometimes parties try to hedge their bets by putting in an escape valve that allows an appeal if a party is dissatisfied. If this occurs (and it is highly likely in a dispute of any real size that one party will be dissatisfied and want to appeal), it can render the ADR process futile. For example, earlier this year the NSW Supreme Court of Appeal issued a judgment1 in a fight between two construction companies about what the ADR clause in their contract meant. The clause said in the event of a dispute, the parties were to ‘meet and undertake genuine and good faith negotiations’ and, if that failed, the dispute was referred to expert determination which was final and binding unless either party sent a notice within a short timeframe saying they wanted to appeal. The expert made its determination and the dissatisfied party sent the notice and appealed to the NSW Supreme Court. The successful party filed an interim application which challenged the scope of the dissatisfied party’s appeal rights, and lost. It then appealed that interim application to the NSW Court of Appeal, and lost again. The whole dispute is now being heard before the NSW Supreme Court – a full year after the expert determination was started, and with the added expense of paying not only the expert but also legal representatives for an additional two court hearings about what the appeal clause meant. Sometime parties try to avoid the risk of a rogue expert in another way, by setting out quite a prescriptive process for the expert to follow and adding in protections such as a requirement to comply with the rules of natural justice. Unfortunately the more you try to force an expert to behave like a judge, the more you risk a court finding that the expert was actually an arbitrator and therefore the statutory arbitration appeal rights apply, even if that was never the parties’ intention. There are many examples of cases where parties have ended up in court after a ‘final and binding’ expert determination, fighting about whether the arbitration appeal rights apply to an expert determination.2 IS AN ADR CLAUSE THAT SPECIFIES EXPERT DETERMINATION EVER APPROPRIATE? Expert determination definitely has its place, but I think it only works where:

It is harder to manage when the technical issue is accompanied by a legal issue about contractual breaches and whether the work should be paid for at all. >> Confidentiality is vitally important. All ADR is private, unlike courts where the ultimate decision is published. But ADR will only remain private if the parties have faith in the outcome and no one tries to appeal or set aside the determination. >> The clause is well drafted and tailored to suit both the contract and the facts. Your lawyer needs to give specific consideration to whether the specified ADR process suits both your project and you. It should never be plonked in as a standard boilerplate clause without thought. If you do insert an ADR clause into your contract (or one is already there in the standard form), you also need to specify what happens to the contractual obligations while the ADR is going on – and bear in mind that this may be many months in some cases. The last thing you want is to be stuck fighting in court about whether ADR is a mandatory precursor to terminating if you urgently need to get rid of a non-performing subcontractor in order to complete your own contractual obligations. CONSIDER A DISPUTE RESOLUTION BOARD DRBs (or DABs)3 are the new hot thing in managing construction project disputes. The parties agree from the outset on an entirely independent and multi-skilled board (usually some combination of technical and legal experts). The board is paid to keep a watching eye on the project and be available quickly to make decisions in the best interests of the project when disputes arise. It is a bit like paying NRMA membership so that someone you already trust will come and rescue you quickly if you break down. They are my current pick for ADR on construction projects, provided the size, complexity or importance of the project warrants an up-front investment in dispute avoidance. Bernie Rees Life Membership BY GRACIETE FERREIRA

At the 2017 MBA Annual Dinner I was privileged to be given the task of awarding Bernie Rees with Life Membership of the Master Builders ACT. This is Bernie’s story… Bernie Rees commenced his carpentry apprenticeship as a 15-year-old with George Grant and Sons in 1951. George Grant and Sons were a Sydney-based company and they were working on projects at the ANU. After leaving George Grant & Sons after about two years, Bernie commenced working for the Government on various projects in Reid and then onto the Government workshop in Kingston doing office maintenance projects. After leaving his employment with the Government, Bernie joined Shell and Rankine for about three years. He commenced building his first home in Canberra in 1957, his own family home in Hemmant Street, O’Connor. In 1960, Bernie began his long and successful career working for himself having established his own home building business after having attained his first builders licence as a 20-year-old in 1956.

It is estimated that Bernie has built in excess of 200 homes in the ACT and region in addition to renovations and extensions. Bernie joined the Builders Traders Co-operative within the first 12 months of its establishment and helped purchase the land in Fyshwick on where it sits today. He subsequently served on the Board of the Builders Traders Co-op for over 30 years, including a period as chairman. Utilising his high quality and highly regarded skills as a builder, Bernie has participated in the building of many community projects through his long-standing membership of Rotary. He was awarded a Paul Harris fellowship for his service to Rotary. Bernie, at the spritely young age of 80, has decided that it’s time to down tools on a more permanent basis. Having wound up his business he has reluctantly had to cease his much valued and appreciated membership of MBA-ACT after more than 50 years. Congratulations Bernie and we look forward to having you back in 2018 to judge the MBA Awards.

Bernie began a long and rewarding membership with the Master Builders Association in 1965, a relationship which he has thoroughly enjoyed over the years. He has spent many years involved in judging the Association’s prestigious awards and mentoring young industry participants. Bernie has employed numerous apprentices over the years including his own son, Geoffrey who also established his own building business and has also served as a judge on the MBA awards. Geoffrey’s business also received awards for building excellence as did other recent MBA award recipients who were apprenticed to Bernie including Guy Gleeson and Matthew Kennedy.
