Residents forced from their homes in a southwest manor say the province needs to do more to protect tenants. Occupants of more than 60 residences at Connaught Manor were handed three-month eviction notice in May. Previously, they had been told the area was slated for “major renovations” which, according to written proof provided by Service Alberta, would have guaranteed tenants one year to vacate the premises. But that was later revised to specify the area is actually being redeveloped for commercial use, which carries a lesser eviction notice requirement of 90 days. “It’s not fair,” said manor resident Randall Lannard. “I worry for some of the seniors here. Some have been here for more than 20
years.” Speaking on behalf of MCM Property Management, which oversees operations at the manor, publicist Holly J. Wood said the group is within its legal rights. “They (the tenants) have been given the proper notice ... we are fulfilling that obligation to them,” she said. Area MLA Kent Hehr agreed the law clearly indicates a 90-day eviction period is all that’s required. He believes it is fair, but said it’s not outside the realm of possibility that a developer would attempt to bypass the extended eviction legislation. “We need to find out whether the owner of Connaught Manor is attempting to skirt around of the legislation or he’s complying,” Hehr said. “If he is, well, that’s the law.” Lannard, meanwhile, has already begun looking at other properties. “Everything around
Eviction notices Three months. All provincial eviction notices, regardless of development plans, were previously set at three months. Upgrading. Changes to the Alberta’s Residential Tenancies Act were introduced in 2007, including the year-long eviction notice requirement when upgrading rental units to a condo. Fine. The act stipulates that any violation of the legislation could carry a fine of up to $5,000 per tenant. Moving out. The eviction notices have already prompted some of the Connaught Manor residents to move out, said resident Randall Lannard.
here seems to be condominiums,” he said. “It’s hard for the older people to move out that quickly.”
