The concert-cash scandal doesn’t warrant a police investigation, council decided yesterday. Councillors voted 15-7 against referring the matter to police, but it wasn’t a quick decision. They debated and fired questions at Mayor Peter Kelly and auditor general Larry Munroe for about five hours. A $400,000 cash advance to concert promoter Harold MacKay last year without the approval of council ignited the scandal at city hall when it was discovered in March. The auditor’s report was released last week. Coun. Linda Mosher, who put forward the motion to look into a police investigation or seek “external advice,” said it was the elephant in the room. “My request isn’t malicious. It’s based on residents’ concerns,” she said. “It’s clear ... good judgment was not followed.” Munroe told council he sought

advice on the matter and consulted with Halifax Regional Police Chief Frank Beazley. In order to lay a charge under breach of trust in the Criminal Code, proof of personal benefit is required. Munroe said there is no such evidence in this case. Councillors batted around the idea of holding a public inquiry, but cost was a big factor. Coun. Steve Streatch said an inquiry could run $2 million. “I’m not out for anyone’s head,” he said. No laws were broken but the municipality’s charter was clearly violated, said Coun.
